Abstract

Settling a contract for process design involves a negotiation between the design engineers and the client. Clients wish to offload as much risk as possible by seeking various guarantees about the process performance. Design engineers respond with preconditions and qualifiers, believing that the risk must remain with those who stand to benefit. This paper presents the engineers? point of view on guarantee types and precedents, performance testing, damages that may be claimed, and remedies that can be provided with particular reference to the mining industry.
