TWO papers on health and safety were given Thursday afternoon when a joint session of the Health and Safety Committee and the Mining Methods Committee was held. T. T. Read presided and the first paper, on ventilation at Climax, was presented by the author, L. H. Glanville. In the subsequent discussion by Cloyd M. Smith, P. B. Bucky, B. F. Tillson, D. F. Haley, J. L. G. Weysser, and others a number of interesting points not covered by the paper, which appears in full in the January Mining Technology, were brought out. Ventilation troubles in mines so often hinge on the air being too hot and damp that it was interesting to hear of one where it is frequently too cold and too dry.

In the Engineering and Mining Journal of Jan. 27, 1900, there appeared an article by Fred T. Greene, describing a method of measuring stopes by the use of strings, a clinometer and a tape. In the early part of 1899 I had occasion to use a somewhat similar method, for the purpose of accurately ascertaining the volume of a very irregular drift connecting two mines. This drift was an important factor in a lawsuit for $150,000, in which it was necessary to determine accurately the volume originally occupied by the material extracted from the drift. While it is unnecessary to give all details of the controversy, some explanation of the conditions is required for a clear understanding of the following description. This drift was started by the a E." Co. from its workings, in about 7 ft. of ore, and headed toward the " G " property, the plan being to extract all the ore between foot- and hanging-walls, but to take out nothing but ore. As the " G." workings were approached; the ore-body became very irregular and much thinner. It was, however, very closely followed, and where the drift broke through into the " G." workings, the hole was only 11 inches high by 14 inches wide, or just about the size of a man-hole in a boiler.. Thus, this connection-drift tapered sharply; and the very irregular foot-wall sloped toward the " G." workings, and entered them at a place where the stope was only about 3 ft. high, and the ground had already commenced to cave. It may be added that the ore-body was a nearly flat deposit of lead carbonate in limestone, the ore and gangue being quite soft. I was called upon by the " G." people to make the survey

THE official opening at the 134th general meeting of the Institute was held on Oct. 6, but it was prefaced by two round table conferences on Oct. 5. The open-hearth group held the fourth of their semi-annual conferences at the William Penn Hotel, devoting the morning session to discussing a paper by R. L. Cain on the "Manufacture of Forging Steel by the Open-hearth Process," and the afternoon to discussing P. H. Shaeffer's paper on the open-hearth charge. At the Bureau of Mines, a round table conference on the combustibility of coke was held on Tuesday morning, and the afternoon was devoted to a similar conference on the testing of coke. The formal opening session of the meeting assembled in the Music Hall of Carnegie Institute at 10.30 a. m. Graham Bright, chairman of the Pittsburgh Section; called the meeting to order and presided. President Taylor welcomed the visiting members and guests to his home city and reviewed briefly the advancement of mining in the past half century during which, for ex- ample, the coal output had increased from 53,280,000 tons to 523,357,000 tons per year. He emphasized the important part Pennsylvania played in mining and brought out the principal changes that had taken place in methods. In part, his remarks were as follows: The centennial year, 1876, found the coal business of. this country, as a whole, producing 53,280,000 tons, of which amount the bituminous mines of this State yielded 24 per cent. In 1925, this country produced 523,357,000 tons of coal, of which Pennsylvania produced 24 per cent.

By geographical location, the climate is most severe-long, cold winters with heavy snowfall, and short seasons of vegetation growth; this, together with its remote location from large centers of population, adds considerably to the difficulties of conducting mining operations in this area.

TEACHING engineering students how to write and speak effectively -is one of the greatest problems facing the technical schools today. No phase of engineering education has received more criticism, and rightly so, for the criticism is justified. Year after year we continue to graduate men that are indifferent to the use of a tool they will need every day of their lives. Our young engineers cannot write a clear, concise report, and their business letters are a disgrace to the profession that takes pride in precision. The problem is not new. The remark ascribed to Sir James Barrie, that "The man of science appears to be the only man who has something to say, just now-and the only man who does not know how to say it" is as uncomfortably true today as it was thirty years ago. The records of meetings of engineering educators and the transactions of the engineering societies show that the inability of the engineer to communicate his ideas has been discussed for years. Engineering educators, prodded by industry, have recognized that the problem exists, but they have not solved it. Instead they continue to expose the student to composition and rhetoric, hustle him through English and American literature, and then blame his high school because he does not know enough English grammar to write a clear sentence. We must face the fact that the graduate is not going to reflect on the high school, but on his college. If the high school has shirked the job, the responsibility for correction rests on the faculty of the professional school.

A second-order approximation to the exact solution of the diffusivity equation corresponding to the pressure build-up of a well producing at a variable rate is derived. This approximation is applicable when the well's shut-in time is larger than the total time elapsed since the well was first produced. The resulting equations are compact in form and easy to use. Thus, the need for Horner's' theoretically precise but rather laborious solution to the above problem is eliminated. In addition, these equations apply where the use of Horner's widely known approximate method is questionable. From a practical point of view, the reported method is best suited for analysis of drill-stem tests and short production tests conducted on new wells. INTRODUCTION The utility of drill-stem and short production tests in reservoir studies has long been recognized by the reservoir engineer. If interpreted correctly they could lead to a wealth of information upon which may depend the success or failure of reservoirs' analyses. Initial reservoir pressure and the average flow capacity are two quantities that are normally sought from a drill-stem and/or a short production test analysis. Pressures are the most valuable and useful data in reservoir engineering. Directly or indirectly, they enter into all phases of reservoir engineering calculations. Therefore, their accurate determination is of utmost importance. The flow capacity kh of the reservoir is indicative of its commercial capability. In addition, it can indicate the presence of a darnaged zone around the wellbore and, thus, the necessity for remedial measures. Of the several methods used to analyze drill-stem and short production tests, Horner's' method is by and large the most common. It applies to an infinite reservoir and or a limited reservoir where the effect of production has not been felt by the boundary. Horner's method makes use of the so-called "point-source" solution of the diffusivity equation. The point-source solution is approximated by a logarithmic function and the superposition theorem is utilized to give the familiar pressure build-up equation where is the shut-in time, q is in reservoir barrels per day and the rest of the symbols conform with AIME nomenclature. Eq. 1 was derived for a well which produced at a constant rate q from time zero to time t and was then shut in. In actuality, such a constant rate of production does not normally obtain. Therefore, a correction must be applied to Eq. 1 to account for the varying rates of production. Horner suggested two methods. The first, which results in a theoretically accurate solution, is rather lengthy and laborious and, thus, it is not suited for routine analysis. The second which has been termed a "good working approximation" is the one used by the majority of the reservoir engineers. In the second method, Eq. 1 is modified by simply introducing a corrected time t, and writing where q is the last established production rate prior to shut-in, and t, is obtained by dividing the total cumulative production by the last established rate. Horner's original paper does not give any indication that this method of correction is based on any theoretical justification. In addition, there is a question as to what constitutes the last established rate. In case of a drill-stem test some engineers use the average rate obtained by dividing the total fluid produced by the total flow time, while others calculate the average rate by dividing the total fluid produced by the last flow-period time. Obviously, different results obtain for the different flow rates used. Because of this, a simple method to the varying-rate case was developed which is theoretically sound and which defines clearly the flow rate and its associated time to be used in the calculations. The final equation arrived at is where q* and t* are a modified rate and time, respectively, and can be easily calculated. In addition, it is shown theoretically that Horner's approximate method, if used for a variable-rate case, gives the correct pressure but would not be expected to give the correct flow capacity. INTRODUCTION Virtually all countries have general legislation covering most aspects of mining and mineral processing, including investment and tax laws, safety and health regulation, and specific rules applying to exploration reporting procedures. Yet most developing countries negotiate individual agreements with foreign investors for major mineral projects, in particular when all or part of the expected output is exported. Such agreements are known under several different names, as for example concession agreement; technical assistance agreement or service contract; management agreement; production sharing contract; joint venture; or contract of work. The objectives and conditions governing such contracts are as diverse as these titles are. While a mining project is only one among a large mumber of similar undertakings in industrial countries, in most developing countries such projects usually have a dominating position within the country's economy. The general legislation is often inadequate and insufficiently detailed to cover all aspects of large projects with extensive foreign inputs and international markets. Therefore, the need for specific arrangements. Specific arrangements may also become necessary due to the complexity of markets for mineral products, the large number of participants - equity partners, suppliers, financial institutions, buyers, etc. - or economic and political conditions in the host country and fiscal regulations in the home country of the investors. Most agreements are concluded between governments, or government agencies, in developing countries and private industry headquartered in developed market economies - Canada and the United States of America in North America, Western European countries, Japan, South Africa and Australia - or, in some instances, with state-owned firms in these countries. There are fewer agreements between developing countries and the centrally planned economy countries - Eastern Europe and the USSR - which cannot be considered here because of absence of adequate information. Agreements can be concluded at any of the different stages from exploration through closing of a mine. While most contracts are negotiated at the time when a potentially viable ore body has been delineated and investigated sufficiently to anticipate a realistic time for commencement of production, other agreements start with "grass-roots" exploration, during operation of a mine, smelter or refinery or, exceptionally, after a temporary shutdown. While several major provisions are included in all types of agreements, others are covered in much more detail (or not at all) in some contracts reflecting the specific work programme of each project. While it is realized that subdivision and classification of complex contractual relations is necessarily arbitrary to a certain extent, such grouping is useful in practical terms, especially for the non-specialist. The following discussion, therefore, will start with a description of the major forms of contractual relation - concession, investment contract, joint venture, management agreement, service and production sharing contracts. Major issues covered in all, or almost all, agreements will then be dealt with. These include stages of development, corporate structure and control, fiscal arrangements, infrastructure development and environmental law, and dispute settlement and renegotiation. FORMS OF CONTRACT RELATIONS There has been marked change in the type of agreement entered into during the 1960s (and before) and the early 1970s and the period thereafter. While straight "concessions" - granting of exclusive rights to foreign investors over a certain deposit or areas with little restriction or well-defined obligations - were the rule during the first half of this century, more complex agreements have evolved since. Some of these cover every conceivable aspect, foreseen or only possible, and define rights and obligations of all partners to the last detail. Over the years, agreements have without doubt become more beneficial for the developing host countries, in part as a result of well-publicized nationalizations, as for example in Chile, and in part due to changed attitudes in all countries

Generalizations therefore are made whenever possible and not always is the source of the information meticulously cited. The United Nations regularly publishes trade data on mineral commodities. E. J. Gealy, and C. L Kimbell, of the U S Bureau of Mines (USBM), work with these data and estimate that they cover approximately 78% of total mineral commodities traded. In addition the General Agreement on Tariffs and Trade (GATT) publishes analyses of certain trade data The most complete report of production and trade in minerals 1s probably the international volume of the U.S. Bureau of Mines Yearbook The latest available edition is for 1968, and some of the data in this edition cover only as late as 1967. THE NATURE AND SCOPE OF INTERNATIONAL TRADE The two and a half decades since World War II have witnessed an unprecedented growth international commerce The end of the war found the world economy seriously crippled. Many countries had suffered severe war damage; international trade was disrupted and nations had to resort to exchange controls and bilateral trading arrangements. The postwar recovery, however, was remarkably rapid Within two decades, world Income more than doubled, and world trade which was less than $60 billion in 1948 exceeded $200 billion in 1968, 8 and reached $278 billion in 1970.18 The growing world trade contributed to world prosperity which in turn fostered growth of trade. This dramatic growth of international commerce was made possible by the progressive liberalization of trade and capital movements by the major trading nations of the world which began immediately after the War and has not yet completely lost its steam. The 64th Texas Legislature passed the "Texas Surface Mining and Reclamation Act," Chapter 131, Texas Natural Resources Code (subsequently referred to as "the Act"), at a point in time when little surface mining had taken place within the state. Thus, enactment of regulatory control governing mining operations in our state has, for the most part, preceded widespread, intensive mining activity. I should point out that the statute applies only to the extraction of coal, lignite, uranium and uranium ore. A recent opinion rendered by the Attorney General's office has stated that extraction of the named elements, when it occurs incidental to the extraction of other materials, e.g., clay, is not not an activity subject to the Act. An important theme of the Act, frequently overlooked in other environmentally oriented legislation, is recognition of the Act's affect on the mining industry. The Act states that "the extraction of minerals by surface mining operations is a basic and essential activity making an important contribution to the economic well-being of the state and nation" and, in reference to reclamation being accomplished contemporaneously with mining, provides a recognition that "the extraction of minerals by responsible mining operations is an essential and beneficial economic activity." This legislative recognition is, of course balanced against the need for proper mined land reclamation, the rights of surface owners, the need to guard against unreasonable degradation to land and water resources and numerous other actions or events that the Legislature wanted protected. Another rather pervasive general theme that is established in the Act is the concept that the agency is entitled to obtain whatever information, or take whatever action, that appears reasonably necessary to effectuate the purposes of the Act. This concept, coupled with the detailed requirements placed on mining operations in the portions of the Act dealing with Permit Applications, Reclamation Plan and Reclamation Standards, easily insures that surface mining activities can and will be regulated to the extent necessary. Section 131.102(b)(2) is probably the most relevant provision in the Act which deals with the preclusion of mined lands becoming waste lands. This portion of the Act states that the surface mining operator shall: ". . . restore the land affected to the same or a substantially beneficial condition. ." In this language the Legislature had made it abundantly clear that the abandoned or orphaned lands found in some of the Eastern states, will not be tolerated in this State, and provided the Commission with a degree of latitude to determine what condition would be appropriate in each individual mining situation. I bring this area of the Act to your attention because it is the area which has received the most inquiries and concern by operators, i.e. what does "substantially beneficial" constitute? The Commission's staff has spent a considerable amount of time wrestling with the statutory language "substantially beneficial" to determine the legislative intent and provide operators with guidance of what they can expect. In this regard, the most definitive criteria in our opinion lies in the Act's legislative hsitory. The Legislature had before it basically three reclamation standards namely: House Bill 656, considered to provide the most stringent reclamation standard and identical to Senate Bill 66; House Bill 1717 which was supported by industry spokesmen and was considered to contain the least stringent reclamation standard; and Senate Bill 55 which was adopted by the Legislature. During the Bill's initial hearing before the House Environmental Affairs Committee, the House sponsor of the Senate Bill 55, which was the Bill eventually adopted, made the following statement: (I am quoting verbatim from the Committee's transcript although substituting the speaker's reference to the authors names with the Bill's numbers.) "An example of the differing approaches of the four bills can be seen in the area of reclamation standards and this is critical. House Bill 656, talking about restoring the surface of the land, House Bill 656 has this statement: 'At least fully capable of supporting the use to which it was capable of supporting prior to any mining or any higher or better use.' In other words you have to restore it to the level it was prior to the mining. Senate Bill 55: 'Restore the land to the same or substantially beneficial use.' Substantially beneficial use. (Emphasis his) House Bill 1717 says: 'Restore insofar as practical to appropriate beneficial post-mining use.' So that House Bill 1717 said to, 'restore insofar as practical to appropriate beneficial use. I think that's too weak, whereas I think the House Bill 656 that would call you to restore it to at least the use it had prior to the mining may also be too tight the other way. I think the Senate Bill 55 approach is down the middle of the road which says that you do restore it to the 'same or substantially beneficial use,' is a proper way to go there." Therefore, the conclusion that we have drawn from the legislative history of the bill is that the extent of reclamation required by "substantially beneficial" may be something other than the use it was prior to

In 1931 the Philadelphia Company acquired by lease several coal mines in southern Greene County, Pennsylvania. These mines were known as the "Dora," "Seventh Pool" and "Rosedale" mines in the Sewickley seam, and the "Rosemary," "Seventh Pool" and "Warwick" mines in the Pittsburgh seam. All these mines are in the immediate vicinity of Greensboro, Pa., with considerable river frontage on both sides of that village. The mines in each seam are contiguous and to some extent the properties in the two seams lie one above the other. In 1938 the property known as the "Sandy Run mine," in the Sewickley seam, adjoining the Dora mine, was purchased from the Fredericktown Coal and Coke Co. Altogether, by purchase and lease, the company gained control of approximately 3400 acres of coal land in Greene County, from which it was estimated that some 20,000,000 tons of coal could be extracted. Geology of Warwick Properties Both seams of coal outcrop along or near the river on both sides of the town of Greensbgro. They lie on the eastern slope of the Lambert syncline, near the southern end of the axis, consequently the predominant dip of the seams is away from the river, so that development for river handling has the unavoidable disadvantage of adverse grades for haulage to the outside. Predominant grades away from the river at right angles to the "butt" cleat of the coal average about 2.25 per cent dipping in a westerly direction, but local dips occur, which are considerably greater. Predominant grades parallel to the river and at right angles to the "face" cleat of the coal average about one per cent dipping in a northerly direction. Both seams of coal lie in the Monongahela formation, the Pittsburgh bed being the bottom measure of the formation and the Sewickley bed lying about 90 it. above. Approximately midway between the two lies the Redstone coal bed, which is generally thin and of erratic occurrence and therefore of little commercial value. It is mined only locally where it attains sufficient thickness. Sewickley Bed The Sewickley bed is commonly called the "five-foot" or Mapletown" seam, because in Pennsylvania it reaches its greatest thickness and has been mined most extensively in the vicinity of the village of illapletown, approximately one mile west of Greensboro. In the early development of the Warwick properties, which occurred near the river, the seam had an average of 5 it. 2 in. in height. As development proceeded away from the river, however, the height gradually decreased until the average height of the present workings is about 4 ft. 6 in. ZEST in the search for new supplies of metallic ores and petroleum is difficult to maintain with stocks of raw materials accumulating and with over- production rightly or wrongly blamed for most of our industrial troubles. Enthusiasm over new methods of prospecting has consequently diminished and exploration programs in many fields have been drastically cur- tailed. Very naturally the effects have been felt with particular keeness in highly specialized phases of the work, such as geophysical prospecting, for the feverish scramble for new areas in which to drill beneath magnetic or electrical anomalies has abated, and there is even a lull in the firing in the battle over salt domes on the Gulf Coast. It is unquestionably an unhappy time for many of the organizations dependent on this work, but in certain respects the situation may be beneficial in correcting unsound practices that .have grown up through the necessity for haste and for quick decisions. With the restriction of the field to the more competent workers by the harsh rule of survival of the fittest, a general improvement, not only in technique but in business methods, can be expected which may go far in restoring public confidence. IN 1833, less than one hundred years ago, Michael Faraday discovered and stated the laws of electrolysis. His discovery formed the foundation of a new use of metals which has now reached a variety of application not ordinarily appreciated. Furthermore, things can be done with electro-deposited coatings which have thus far defied other methods. Some of the uses of electro-deposited coatings are interesting. The tonnage of metals already finding an outlet through such a channel is considerable. In general electro-deposits have two characteristics: ornament plus utility; utility plus ornament. Both these factors are usually found associated in electro- deposits. Ornament plus utility was probably the first use. For example, the silver-plating of tableware, having its real birth in Birmingham, England, about 1844. However, this same ornament plus utility retarded the development of electro-plating, because in the beginning, electro-plated articles were branded with the odium of imitation and shunned accordingly. The gold brick of the swindler may be an exception to this statement.

After the close of the Revolution, settlers began to pour over the mountains, to settle in the western parts of Pennsylvania, of Virginia, to move down the Ohio into Kentucky, and in the late seventeen-eighties to settle on "the Indian side" of the river, now Ohio. With the growth of population the interest in coal increased and it was not long before the production of coal west of the mountains was larger than that east of them. Foreign nations, too, became interested in the young republic and in 1783, at the instance of the Swedish government S. A. Hermelin, an engineer, visited this country to investigate its iron industry. He made a very interesting report, not published until 1931, in which he gave many details of the iron plants in the eastern United States; apparently he was not west of the mountains, but was well informed about conditions there. He says, "that some coal near the first branches of the Schuylkill River has been mined and utilized by the blacksmiths," referring, of course, to anthracite; again that "coal mines have also been worked for several years near Pittsburg," and that "great supplies of iron ore are available at the Ohio Falls and further to the west, at Coney Creek, a part of the Green River, where there is also coal."' In 1788, Dr. Johann David Schoepf, who came to this country with the Hessian troops, visited Pittsburgh. He was an intelligent man and acquainted to some extent with minerals and methods of working them. Gold, silver and platinum-group elements occur normally in very low concentrations in their ores. Because their market value is in many situations high enough to justify their full recoveries, mineralogical studies before any routine recovery is attempted are particularly important for the description of their manner of occurrence and decision on the appropriate recovery techniques. Gold and silver, although sometimes treated by similar metallurgical processes, may require different approaches and treatments because of the different manner in which they occur in their ores: gold has a relatively simple mineralogy limited to native gold, electrum and less often tellurides. Silver has a very complex mineralogy including over 200 different minerals. On the other hand, gold is more often than silver recovered from ores where its fine grain size requires the breaking of the host minerals by chemical methods. Mineral, grain sizes and host minerals all affect the metallurgy of the platinum-group elements..
