Engineers who are in charge of industrial operations, and their number is legion, sense as much as anyone the present feeling of unrest in the' country and more than anyone else realize the present inefficiency of labor. Undoubtedly the two phenomena are closely correlated and no doubt are due to a multitude of causes which it will be impossible to enumerate. From my experience in mining I estimate that the present efficiency of labor is only about two-thirds of what it was under pre-war conditions. In the mining industry, at least, we have not a large surplus of men looking for work and usually under these conditions men are rather more independent and will not work as efficiently and faithfully as if they felt there were plenty of men ready to take their places. Wages in metal mining have advanced more than the increased cost of normal and sane living. The result is that the men often work fewer days in a month and do not seem to have very much interest in their work while actually engaged in it. Then again, they have been listening to the more or less vague propaganda of the I. W. W. and the radical wing of the socialists, who are harping on the fact that the distribution of newly created wealth is unfair and that the laborer really is not working for himself or his fellow laborers but is carrying on his exertions for the benefit of a small and lim-ited class of exploiters. A continued harping on this view is bound to influence the judgment of even a conservative workman who is not a student of economics and who hears little or nothing upon the other side. I am a great believer in the common sense of the American people and in the long run I do not think that they will be carried away by unsafe doctrines. The trouble with so many of these propagandists of industrial in-equality is that they do not differentiate between production and dis-tribution. Even if we admit that distribution is unfair, unless goods are produced there will be nothing to distribute. A great many unthinking people seem to feel that wages are paid out of a pot which is inexhaustible and do not realize that eventually what comes out of the pot can never exceed what is put into it. The workman is not paid in money but is paid in goods, money as we all know being used simply as a measure of value and a medium of exchange, and that all that can be used to pay the laborer is what he produces.

The Secretary : The work of Mr. A. E. Outerbridge, Jr., of Philadelphia, first made known in his paper on " The Mobility of Molecules of Cast-Iron," read at the Pittsburgh Meeting of the Institute, in February, 1896, has been reviewed by the Committee on Science and the Arts of the Franklin Institute, whose report, dated May 5, 1897, is accompanied with a table of tests made by the Committee, and amply confirming the statements of Mr. Outerbridge. Concerning the originality and novelty of his investigation, the Committee says: " The fact that a certain molecular change takes place in cast-iron in the course of time has been known and recognized by many persons for a long time, and that this change tends to relieve the internal strains and render the casting tougher has often been noticed and acted on, although in a very crude way; but, so far as the sub-committee has been able to learn, Mr. Outerbridge has been the first to make a careful study of this, and to note that the change may be hastened by impact, and the whole effect produced in a short time, and also to make a scientific study of the phenomenon. We believe great credit is due him for the initial observation and the careful work dependent thereon. The results were first given to the public in a paper read before the American Institute of Mining Engineers, on February 20, 1896. This aroused a wide-spread interest and discussion among users of cast-iron, and so far as the sub-committee has been able to determine, it has not been shown that anyone, either in this country or abroad, has antedated Mr. Outerbridge in his work in this line. The Franklin Institute therefore recommends the award to him of the John Scott Legacy Premium and Medal." This report has not been published, hut I have had the opportunity to read it in manuscript. Peruvian production for the year 1935 amounted to 17,064,879 bbl., a record amount for any year, bringing the cumulative production of the country up to 188 million barrels. The 1935 figure is an increase of 785,769 bbl. over the 1934 total. The property of the International Petroleum Co. contributed 636,812 bbl. of this increase, and the Lobitos property 158,625 barrels. Exploration work in the country was again active, with attention focused on three areas, the Huallaga River, Lake Titicaca and the Coastal Zone of the Province of Tumbes. It is reported that in the Huallaga River area the Selden Breck Construction Co. has completed geological and engineering studies on its Pachitea River concessions and has ordered a drilling rig. In the Lake Titicaca region further studies in the vicinity of Pusi were made by Government geologists. During the period from 1906 to 1915, the Pirin anticline in this area produced 285,936 bbl. of low-grade crude. The Government holds 120,000 hectares of reserved lands in this area. In the Coastal Zone of the Province of Tumbes explorations by the Government were continued on the National Reserve, and a test location has been selected in the Quebrada Zapotal about 10 miles from the Port of Zorritos. An order has been placed in the United States for drilling equipment. LaBrea-Parinas Estate.—Production on the LeBrea-Parinas Estate reached an all-time high in 1935 of 14,756,914 bbl., an increase of 636,812 bbl. over the 1934 record. The total production from 1890 to 1935 was 148,541,523 bbl. During 1935 a total of 63,021 ft. was drilled in new wells and 5449 ft. in deepening existing wells; 23 wells were deepened and 29 new wells were completed, of which 27 were producers and 2 were dry holes. At the end of the year 2873 wells had been drilled on the Estate, of which 1838 were still productive. The remaining 1035 wells represent abandoned producers or dry holes. Practically all the drilling on the property has been done with cable tools, but during 1934 three strings of rotary tools were introduced. The opening session of the Institute was held at Hazle Hall, Tuesday evening, October 27th, with a large attendance of members. President Raymond called the Institute to order, and after a few introductory remarks, introduced Mr. I. Lowthian Bell, President of the Iron and Steel Institute of Great Britain, and Honorary Member of the American Institute of Mining Engineers. Mr. Bell was received with great applause, and made his acknowledgments in a brief speech, of which the following is the substance: He desired to thank the Institute personally for the honor conferred upon him in his election to membership, and also for the invitation extended last year to the body of which he was President. The difficulty felt by many members of the Iron and Steel Institute, of leaving for a long journey the works of which they had charge, aggravated by special industrial troubles at the time of the invitation, had obliged them to conclude that it could not then be accepted in a fitting manner. The iron .manufacture of this country is a subject of great interest to Englishmen, who look with pride upon the achievements on this side the water of the descendants of a common ancestry. His own reception in this country had far surpassed in cordiality even the well-grounded anticipations he had formed from the assurances of the President and other friends. Notwithstanding the flattering manner in which his friend, in introducing him to the Institute, had spoken of his contributions to the science of iron metallurgy, he could not take to himself alone the significance of this welcome. He knew it was a recognition of the services rendered by the body which he had the honor to represent; and he was glad to see present a member of that body, Mr. Thomas Whitwell, who had fortunately been able to make the journey at this time, arid whom he had had the pleasure of meeting on the shores of Lake Champlain. THE morning session on mining methods with R. M. Raymond as chairman was devoted mainly to papers on explosives and the discussion of these papers. A paper on the numerical index of the re-sistance which rocks offer to the penetration of a drill bit was also read. The first paper, "Relation Between the Oxygen Bal-ance and Propulsive Strength of Eight Gelatin Dynamites" by G. St. J. Perrott, N. A. Tolch and J. E. Crawshaw, was presented by Mr. Perrott, super-intendent of the Pittsburgh Experiment Station of the U. S. Bureau of Mines. In this paper which is the beginning of a series of publications on explosives, Mr. Perrott stated that the attempt was made to put down in quantitative form the facts which have been known to explosive engineers for a long time. Eight samples of 40 per cent gelatin dynamite, with oxygen content varying from + 15 to - 36 per cent of the theoretical amount necessary to form complete combustion with all of the combustible elements were tested. The experimental work showed that a bal-anced explosive did not give the greatest propulsive strength-but the most favorable range was from - 8 to - 25 per cent oxygen. The experimental work also brought out the fact that the wrapper of a stick of dynamite enters quite completely into the explosive reaction, and gelatin dynamites from which the wrapper had been removed developed less strength than the a same explosive with the wrapper. The second paper, "Effect of Oxygen Balance of Gelatin Dynamites on the Gaseous Products of Det-onation," by G. W. James and G. St. J. Perrott, was also presented :by Mr. Perrott. The first portion of this paper is given over to a discussion of the relative merits of different types of apparatus for testing and analyzing the combustion products of dynamites. Three types were used (1) the Bichel gage, (2) the Crawshaw-Jones apparatus and (3) the Hercules tank. All three of these types were used in testing dynamites whose oxygen balance varied from-35 to + 6 per cent.

THE writer has been unable to find much information relative to tests made to determine the effect of forging on the specific density of steel. The opinion, however, among men engaged in the business, seems to he that forging greatly compresses or consolidates the steel. While such is doubtless the case with spongy or porous steel, the following experiments indicate that there can be little or no change in the density with steel initially free from cavities: Ten ingots of basic open-hearth steel cast as shown in Fig. 1 were used in the experiments. All the specimens were 0.53 carbon with all other elements the same, the analysis being determined from drillings taken midway between the center and outside of the upper end, as shown in Fig. 2. The specimens were selected from over one thousand ingots so that the tests could be comparative for the work done in forging only, but no two of the ingots were cast in the same heat. Each ingot remained in the mold approximately 30 min., when it was removed and air-cooled. About 12 hr. later, when the temperature had been reduced to approximately that of the surrounding atmosphere, the head was discarded and the ingot heated in an oil furnace to approximately 2250° F. (1235° C). Approximately 1 min. was required to forge under the steam hammier to 1 ¼ in. (31.75 mm.), rough diameter, as shown by the dotted lines in Fig. 2. All ingots were allowed to air-cool after forging. Cylinders ½ in. (17.7 mm.) in diameter and ½ in. high were then turned from the forged and unforged parts of the ingots and numbered. The ten pairs of specimens were submitted to Louis E. Endsley, Professor of Railway Mechanical Engineering, University of Pittsburgh; A. N. Talbot, Professor of Applied Mechanics, University of Illinois; L. Z. Slater, chief chemist, Scullin Steel Co., St. Louis, Mo. No in-formation was furnished as to which specimens were forged or unforged and each laboratory used the same specimens, submitting the average of three independent determinations, a tabulation of which is shown in the accompanying table in which the laboratories are designated by

THERE was presented for discussion at the February (1924) meeting of the American Institute of Mining and Metallurgical Engineers a report of a committee named by the United States Bureau of Mines on the Use of Oxygen or Oxygenated Air in Metallurgy and Allied Processes. An extensive discussion followed the presentation of the papers, which dealt with the matter entirely from a theoretical standpoint. The results of only a limited, amount of research work were presented and discussion centered around the question: "Is it worth while to carry on research and expend money in determining what can be done in metallurgical operations if cheap oxygen can be produced?" More experimental work on this subject has not been done because metallurgists have not thought that cheap oxygen could be produced, thinking "Why waste time experimenting. with a reagent that cannot be procurable in commercial quantities?" While the producers of oxygen have said " Why waste money on the development of a process to make cheap oxygen unless we know that there will be a market for it when produced?" The discussion brought out two facts: First, many metallurgists believe that their operations can be conducted more economically if they can add oxygen to the air used in various smelting operations; second, a number of chemists believe that relatively pure oxygen can be produced in metallurgical quantities at very small cost. Negative views were expressed to both propositions, but so overwhelming was the view that if cheap oxygen could be produced, many metallurgical operations would benefit that it was voted to recommend that the Bureau of Mines continue its research work, pending the production of the cheap oxygen hoped for. Few experimental data being available, and the attitude of disputants being based largely on theoretical considerations or on reactions and temperatures incapable of positive proof, it has been decided to publish only a summary of the papers and discussions arising from their presentations. It is believed, however, that this will be sufficient to show the lines of reasoning that have been adopted, and be a guide to others who are to make their own calculations or engage in experimental work.

A STUDY of the kinetics of embrittlement in engineering alloy steels during tempering has indicated that the presence of alloying elements may define two distinct regions of embrittlement: 1) at 800° to 1000 °F, termed low temperature embrittle-ment, and 2) in the temperature range 1150 ° to 1250°F, termed high temperature embrittlement.13 It has been suggested that embrittlement in each region may be due to a different mechanism. At intermediate temperatures and extended times the course of embrittlement may be influenced by the superposition of the embrittlement occurring in the two regions. Furthermore, low temperature embrittlement has been known to decrease as the temperature is raised slightly above the maximum embrittlement range.' Jaffe and BuffumV ave presented data for a Ni-Cr steel illustrating the removal of the em-brittlement occurring at 932°F by reheating to 1250°F for an hour. Their data further shows that embrittlement proceeds continuously with increased time at 1250°F, becoming pronounced at long times. They interpreted this behavior as a retrogression phenomenon involving the solution of the small nuclei of precipitate formed at 932°F as the temperature was increased, and reprecipitation of larger nuclei stable at 1250°F, with the reoccurrence of embrittlement. It appears desirable to reconsider this explanation in the light of the two regions of embrittlement proposed by the authors1 for some alloy steels. In addition, it appears desirable to determine any influence of a preconditioning treatment in each temperature range upon subsequent development of low and high temperature embrittlement. It is thus the object of this investigation to study the characteristics of the two modes of embrittlement proposed in a commercial Ni-Cr alloy steel (AISI 3140). Experimental Details Material—The material used in this investigation was commercial AISI 3140 steel bar stock, received as % in. hot-rolled rounds. The steel analysis was as follows (in percentages): C, 0.39; Mn, 0.79; Si, 0.30; S, 0.028; P, 0.015; Ni, 1.26; and Cr, 0.77. The efforts towards curtailment in Texas have been successful, despite the great area covered and the wide variety of oils offered. There are, of course, examples of noncooperation, perhaps of absolute indifference, but of such it can at least be said that they have benefited from the restrictions imposed elsewhere. The prevention of waste is the legal background for proration in Texas. The legislature in 1899 passed the first laws to prevent waste of oil and gas. Subsequent legislatures, especially those of 1905, 1913 and 1917, undertook to regulate the development and transportation of oil and gas to the end that waste would not occur. In 1917 a constitutional amendment was submitted to the people, providing that natural resources of the state should be conserved and requiring that the legislature pass appropriate laws. This amendment was adopted, and the Acts of 1919 and 1929 have been passed, and these have had the effect of making a rather elaborate plan for the conservation of oil and gas and their protection against waste. In 1930 the new pipe line act, designed to provide for ratable purchases, was passed. The administration of these laws has been placed under the Oil and Gas Division of the Railroad Commission of Texas. The Commission can only consider actual waste, not economic waste. The various proration plans in use in the state, while differing in efficiency, are based on engineering principles. In the proration of flush fields, the limiting of drilling and the steady production of oil under restriction are the principal points involved, and these methods are entirely different from those which prevailed until recently in the Oklahoma City Pool, where apparently nothing beyond the restriction of production on a time basis was attempted. There is little to say in defense of proration in the older and smaller producing areas in Texas, except that, inasmuch as the market outlet has been reduced, proration distributes the market ratably among the producers. THE history of the development of the strip in- dustry, mentioned in this paper, was covered in considerable detail by Stephen Badlam in his paper presented. before the American Iron and Steel Institute at its meeting in New York last October. The description of progress in rolling strip there out-lined will be found good reading by anyone interested in the subject. Quoting from Mr. Badlam's paper, "For practically thirty years, we find no record of the use of the backing-roll principle, until in 1916 the Lukens Steel Co., Coatesville, Pa., put in a 206-in. plate mill of the four-high type. This was a reversing mill with two 32-in. working rolls and two 50-in. backing rolls and is today making the widest and heaviest plate made anywhere in the world." The functioning of this mill, though rolling hot plate, is, on account of the extreme width and thinness of plate rolled, quite comparable to the rolling of wide strip either hot or cold and was a considerable factor in demonstrating the marked advantages available with the four-high or backing-roll mill for thin accurate rolling. As the writer has brought out, a demand for a product, the rolling of which required the character-istics of the backing-roll mill, was broached by the In-ternational Nickel Co. This resulted in an inquiry of March, 1924, for the building of a mill capable of cold-rolling wide nickel and monel metal sheets or strip, as mentioned. It may be of some interest to note, that whereas the .six-roll cluster mill with plain bearings was built for this installation, the mill designed by the United En-gineering and Foundry Co. for this inquiry was of the four-high type with roller bearings on the backing-roll necks, being essentially the same design as the four-high roller-bearing mill built in 1925 for the Rome Brass & Copper Co. This Rome mill, to quote again from Mr. Badlam's paper, "fulfilled every requirement, and was the model on which succeeding mills of this type were built."

IT is not known when silica sand was first noticed along the north coast of Puerto Rico, but the first mention of its occurrence was made in 1922, by N. L. Britton,1 who described its presence in isolated patches extending from Loiza westward beyond Manati. Further observations were made in 1925 and 1926 by Meyerhoff,2 who extended the known occurrences still farther westward to the low hill belt in the Quebradillas limestone immediately south of Hatillo. The extraordinary purity of the sands, which in most localities exhibit no contamination from the nonsiliceous materials surrounding them, was quickly appreciated, and the feasibility of utilizing them for the manufacture of glass was investigated, initially by the Committee on Mineral Resources3 and later (1936) by the Puerto Rico Reconstruction Administration and by H. C. Ray, mining engineer of the Insular Bureau of Mines. In 1934 samples submitted to the Hazel Atlas Glass Co., of Washington, Pennsylvania, were reported to have the composition as shown in the table on column two. Appreciation of the quality of the sand prompted geological and quantitative studies of the deposits, as well as commercial investigations to determine the feasibility of utilizing it locally or on the mainland for the manufacture of glass containers. [ ] DISTRIBUTION OF THE SANDS The quartz sands consistently lie within the outcrop area of the Quebradillas limestone, the youngest of the Miocene formations in the Tertiary coastal plain that fringes the northern coast of the Island. Many of the deposits are closely associated with limestone outcrops, but some appear to be embedded in lagoonal sediments at some distance from rock exposures, and at least one deposit, near Dorado, has been reworked by waves and littoral currents. With this single known exception, the deposits consist of irregular, patternless patches of white sand, which have sharply defined contacts with the surrounding material. Although patches of sand are present in a 90-km. belt that is not more than 5 km. wide, extending from Loiza to Hatillo, they attain maximum size, purity and number in the north central coastal area between Dorado and Barceloneta. During the present year the Santa Fe Springs field has proved to be the most important oil field under development in the United States. Its production will exceed that of any other field. Without it, production within the United States would have been almost in even balance with consumption. The field has forced to the fore and compelled, more than any other single factor, serious consideration of the need of conserving the gas resources of the State of California. It has also contributed much to the development of new drilling equipment and important features in petroleum engineering, and has required the development of a new cement for use in deep wells because of high temperatures. It is the only oil field in the country where wells 8000 ft. deep have become so common that they are no longer given special attention. The field covers a little less than 1400 acres of land. In it 196 producing deep-zone wells have already been drilled since August, 1928, and 224 wells are still drilling. More wells may be drilled. This indicates that probably more than 450 wells will be drilled in the present campaign. In hardly a year's time it has caused the outlay of nearly $50,000,000 for drilling, and within the year 1929 it will have returned practically an equal amount of revenue. In contrast to conditions during 1923, when this field was once before an important and disturbing factor, the California oil industry has not been forced to refinance to meet the situation presented by such a large production of oil. There has been practically no unit selling and no stock selling, nor any unnecessary development far beyond the limits of the field. Production is now about 275,000 bbl. per day and gives every promisc of remaining at this figure or increasing to nearly 300,000 bbl. Six months from now the field should still be capable of producing more than 200,000 bbl. per day. Obviously, the need for conserving gas that would be blown to the air, incident to the production of so large a volume of oil, represents a problem in conservation deserving of the most serious attention of the oil industry and of the State of California.

Fully a decade ago, demand for ground mica began to exceed supplies of scrap mica from manufacturing operations and of waste block from feldspar and sheet mica mining in the United States, with the result that in recent years the market has absorbed larger and larger quantities of mica recovered as a by-product from clay washing,1 as a joint product with kyanite12 and by grinding schists. So far, only schists that contain a large percentage of mica have been utilized for making ground mica, but already there has been a good deal of wishful thinking with regard to recovering mica as an aid to the prospective working of low-grade gold ores and ores of certain base metals. With wet-ground mica selling at $60 to $100 a ton and even dry-ground mica worth over $20 a ton, many ores that could not be considered as otherwise workable under present conditions will show commercial possibilities if they can be made to yield even a relatively small percentage of salable mica. An interesting paper might be written on the coming role of industrial minerals as joint products of metal mines. It is largely a matter of markets. Many years ago I watched the mess left behind the gold dredges in the mountains of Colorado and thought of the Denver sand and gravel operators who prided themselves upon their canniness in providing devices for catching gold merely as an incident to their regular business of selling what we miners classed as "tailings." Nowadays almost every milling or mining operation near settled communities finds use for at least part of its waste for road material or concrete aggregate and several eastern iron mines have gone into the crushed-stone business. Promoters now mention fertilizer "filler" as potentially salable at all the way from $1 to $10 a ton, or whatever is needed to cover costs of mining and treating the "ore" and leave the metal values as "clear profit." With this single known exception, the deposits consist of irregular, patternless patches of white sand, which have sharply defined contacts with the surrounding material. Although patches of sand are present in a 90-km. belt that is not more than 5 km. wide, extending from Loiza to Hatillo, they attain maximum size, purity and number in the north central coastal area between Dorado and Barceloneta. THE history of the development of our great iron and steel industry has been recorded in many publications, not the least important of which are the TRANSACTIONS of the American Institute of Mining and Metallurgical Engineers. During the life of the Institute, of less than 60 years, the annual production of pig iron in the United States has increased more than 23 times. Such a rate of growth may seem small when compared with that of the automotive industry, which has increased 100 times in the last 20 years, or when compared with the growth of other industries of recent birth. The comparison appears less unfavorable, however, when the fact is taken into consideration that the iron and steel industry has existed on the earth in some form for thousands of years. The trade journals, the Department of Commerce and technical societies keep us currently informed concerning technical and corporate developments and the statistics of the American iron and steel industry. Merely to describe the high spots of the industry as it exists today would require a book of no small size. It involves the utilization of about 900,000 people, the payment of $1,400,000,000 in annual wages and salaries, the-investment of $14,000,000,000, the mining annually of 70,000,000 tons of iron ore, 15,000,000 tons of limestone, and 120,000,000 tons of coal. It results in the production of 40,000,000 long tons of pig iron and 50,000,000 long tons of steel ingot. In addition, the industry includes ownership and operation of railroads and steamship lines, the production of cement, timber, coke, gas, by-products, and many other activities. The leading part played by the iron and steel industry in promoting the confidence of the public in corporations and corporate management is well known. The industry has also provided worthy examples of vertical integration and mass production. The social activities within the industry have been no small factor in promoting the fuller development and greater happiness of the American working man-and his family. In the yew 1879, Congress, acting tinder the advice of tile National Acdemy of Sciences, discontinued the temporary surveys or explorations under Hayden, powell, and Wheeler, and established as a permanent organization the United States Geological Survey, making it a Bureau of the Interior Department. A great step was thus taken toward obtaining the greatest practical results from the expenditure of the public money for geological purposes. The recommendations of the National Academy also contemplated the consolidation of all the various organizations for the mensuration and mapping of the country—-such as the Coast, Engineer, and Land Office Surveys—under one single head; which, also, should assume the duty of providing the mays necessary as a basis fir the work of the Geological Survey. But this useful measure did not meet the approval of Congress, and the various mensuration surveys were left in statu quo. With the final establishment of a permanent Geological Survey of the United States, it became necessary to adopt a plan of work which would enable it in time to take the prominent rank among the older surveys of other civilized nations of the world, which is justified by the great, wealth and mineral resources of the country it is destintd to study. The somewhat vague wording of the organic law under which it was created, directing an examination of the geological structure, mineral resources, and products of the public domain, left the details of the policy to he pursued very largely a matter of discretion with its director. That adopted by Mr. Clarence King, the first director, as foreshadowed in his Annual Report to the Secretary of the Interior for 1880, was one whose distinguishing feature was the prominence that should be given to economical geology, or the practical application of geological investigations to the development of the mineral resources of the country. In earlier Government Surveys, which were topographical reconnoissances in a practically unknown region, geology occupied a secondary and unimportant position. With the Fortieth Parallel Survey, inaugurated in 1867, and its successors, the Hayden, Powell, and Wheeler Surveys, geology became an essential object of the work, but owing to the want of already existing maps topography

It is not known when silica sand was first noticed along the north coast of Puerto Rico, but the first mention of its occurrence was made in 1922, by N. L. Britton,1 who described its presence in isolated patches extending from Loiza westward beyond Manati. Further observations were made in 1925 and 1926 by Meyerhoff,2 who extended the known occurrences still farther westward to the low hill belt in the Quebradillas limestone immediately south of Hatillo. The extraordinary purity of the sands, which in most localities exhibit no contamination from the non-siliceous materials surrounding them, was quickly appreciated, and the feasibility of utilizing them for the manufacture of glass was investigated, initially by the Committee on Mineral Resources3 and later (1936) by the Puerto Rico Recon-structionAdministration and by H. C. Ray, mining engineer of the Insular Bureau of Mines. In 1934 samples submitted to the Hazel Atlas Glass Co., of Washington, Pennsylvania, were reported to have the composition as shown in the table on column two. Fully a decade ago, demand for ground mica began to exceed supplies of scrap mica from manufacturing operations and of waste block from feldspar and sheet mica mining in the United States, with the result that in recent years the market has absorbed larger and larger quantities of mica recovered as a by-product from clay washing,1 as a joint product with kyanite12 and by grinding schists. So far, only schists that contain a large percentage of mica have been utilized for making ground mica, but already there has been a good deal of wishful thinking with regard to recovering mica as an aid to the prospective working of low-grade gold ores and ores of certain base metals. With wet-ground mica selling at $60 to $100 a ton and even dry-ground mica worth over $20 a ton, many ores that could not be considered as otherwise workable under present conditions will show commercial possibilities if they can be made to yield even a relatively small percentage of salable mica. An interesting paper might be written on the coming role of industrial minerals as joint products of metal mines. It is largely a matter of markets. Many years ago I watched the mess left behind the gold dredges in the mountains of Colorado and thought of the Denver sand and gravel operators who prided themselves upon their canniness in providing devices for catching gold merely as an incident to their regular business of selling what we miners classed as "tailings." Nowadays almost every milling or mining operation near settled communities finds use for at least part of its waste for road material or concrete aggregate and several eastern iron mines have gone into the crushed-stone business. Promoters now mention fertilizer "filler" as potentially salable at all the way from $1 to $10 a ton, or whatever is needed to cover costs of mining and treating the "ore" and leave the metal values as "clear profit." An intelligent discussion of the oil situation and its needs, whether from the standpoint of the prospector, the operator, the engineer, or the public administrative officer, must be founded upon a knowledge of the law under which oil lands are obtained. A consideration of new legislation must be prefaced by an understanding of the present law and its results. This paper undertakes to present no new remedy for the ills of the present situation, no new solution of the problems the oil business is facing. It attempts merely to summarize the present law, its provisions, its origin, its development, and its effects. The discussion does not pretend to be exhaustive from a legal standpoint. It aims to avoid legal intricacies which tend to. confuse rather than clarify. It seeks but to present the essentials of the existing situation. The title to government lands known to contain valuable deposits of petroleum may be acquired only under the terms of the placer law as embodied in Section 2329 et seq. of the Revised Statutes. As a preliminary to considering the desirability of this situation it is profitable to examine into its origin. Origin of the Law Congress has left no room for doubt as to the legal applicability of the placer law to oil lands. The Act of Feb.11, 1897(29 Stat., 526), provides: "that any person authorized to enter lands under the mining laws of the United States may enter and obtain patent to land containing petroleum or other mineral oils, and chiefly valuable therefor, under the provisions of the laws relating to placer mineral claims.' . The immediate cause for the passage of this Act was stated in a brief report in the, House of Representatives (there was no debate in the Senate) to be a decision of the Department rendered Aug. 27, 1896 (Union Oil Co., 23 L. D., 223), directing the cancellation of an oil placer entry on the ground that land containing petroleum cannot be located and entered as a placer mine.
