The Berlin gold-quartz mine is situated in Nye county, Nevada, on the west flank of the Shoshone range, about 40 miles south and 30 miles west from the town of Austin, the county-seat of Lander county. The distance from Austin is about 60 miles by stage-road. The outcrop of the vein, at the top of the incline-shaft, is situated just at the base of the mountain proper, almost exactly at the intersection of the mountain-side with the gravelly bench that slopes for about three-quarters of a mile to the flatter sage-brush plain, or desert valley, below. The vein itself consists almost entirely of quartz, with perhaps 2 per cent. of sulphide of iron, copper, lead, zinc and antimony, and perhaps a trace of some of the compounds of tellurium with gold and silver, although none of the latter have been as yet positively identified. The relative proportion, by weight, of silver and gold in the ores, varies in different parts of the vein, from 12 silver for 1 of gold, to 7 silver for 1 of gold. The quartz vein-filling is usually frozen fast to the walls, and is very hard and compact, seldom showing the friable, fissured, or shelly structure often to be found in quartz-veins. Comparatively little evidence of relative motion of one wall of the vein upon the other is to be found—a fact indicating that during the formation of the vein, and prior to the extensive movements herein described, little disturbance had taken place. No evidence whatever of metasomatic origin has been observed. On the other hand, occasional occurrences of comby structure, in which the axes of the quartz-crystals are at right angles to the plane of the vein, rather indicate deposition from solution in a pre-existing fissure. SOME mixtures of sulphide and oxide ores from the Tintic district in Utah are of a sufficiently good grade to be shipped to the smelter without beneficiation. In mining this type of ore, however, a material tonnage of ore of a similar composition but of lower grade is obtained. It is a question of economics whether such ore should be shipped with a certainty of a small return or concentrated if that would yield a sufficiently increased return to amortize plant construction and upkeep and yield a higher rate of profit than at present. It may be assumed that the tonnage of this borderline ore is constantly increasing and that eventually it will attain such proportions as to justify plans for milling on a relatively large scale. Under existing conditions, the producer of mixed sulphide and oxide ores is not greatly concerned about the physical characteristics of his ore or of its mineralogical complexities, since his contract with the smelter calls for payment on the basis of chemical analysis. When concentration is contemplated an entirely different picture is presented. Percentages of valuable metal content must then be considered in terms of minerals, for it is in the form of minerals that recoveries are made and losses sustained. In describing the performance of a given flotation mill and reagent combination, it may be stated as a generality that a specific percentage recovery of valuable elements is made. Technically, however, the concentrator is really constructed and the reagents are selected to recover the valuable minerals. These considerations must be given prominence in discussing border- line ores from the Tintic district because of their physical characteristics and mineralogical composition. Because of these peculiarities they may be justly termed complex, since their lead, silver, and copper contents are each represented by two or more minerals of different chemical composition and presenting widely divergent physical properties. Gasoline is undoubtedly of major importance not only to the petroleum refiner but to the producer. To study the economic aspects of gasoline is, in a measure, a constructive effort to solve the problem of overproduction not only for the refiner but for the entire petroleum industry. After all, the prime object of producing crude petroleum is to supply motor fuel and lubricants to nearly 25,000,000 American motor vehicles, not to mention the increasing demand for these products abroad. Since gasoline furnishes the chief source of revenue to the refiner, it follows that this important product should veritably become recognized by all branches of the petroleum industry as an almost infallible index of day to day requirements of the producer and the refiner. A careful study of gasoline statistics over the past decade or more reveals that there is a definite correlation between world-wide gasoline requirements and the demand for crude petroleum, as well as all other petroleum products. This leads the writer to the conclusion that gasoline is literally the economic yardstick of the entire petroleum industry. Control of Operations That the refiner has begun to recognize the urgent need for controlling his operations is evidenced by the results of the past three years. Unfortunately, it is a difficult problem to convince the refiner that he cannot run crude in excess of the demand for gasoline, without incurring a consequent decline in the market value of this and all other products of distillation. Undoubtedly, he still has much to learn in this respect. Few commercial products have enjoyed such phenomenal growth in demand as has gasoline, and, at the same time, few products have failed, as has gasoline, to reap financial benefit from the popular demand for a national necessity. Perhaps this unprecedented demand was responsible for the overextension of retining facilities, which resulted in the excesses of recent times; at any rate, as the demand for gasoline grew by leaps and bounds, so the refining industry continued to increase its capacity for

Over a period of years the writer has presented a number of studies1 on various aspects of proration, in a progressive attempt to analyze critically and constructively the economic complexities of this interesting institution, which in a decade has revolutionized the economics of oil production in the United States. In the course of the investigations leading to these papers, the changing nature of proration and the principles underlying its evolution have gradually become clear, so that it is now possible to depart from the analytical method and to construct a synthesis of the steps that, if furthered by the industry, should carry proration past the economic hazards that still surround it to the goal of maximizing the value of the petroleum resource to the industry and the public alike. Nature of Proration Proration literally means the allocation of demand among competing producers on a pro rata basis, but the term now carries a much broader significance for it is employed to describe the entire process by which the production of crude oil in the United States is regulated. There is naturally much confusion of thought on the subject, for proration is an evolving system of control based upon principles of conservation and equity and embracing a body of practices that are tending to adjust themselves to the needs of the situation but are subjected to varying and divergent influences in the process. As it is now constituted, proration is a planned production measure designed to prevent waste, insure ratable takings, and balance supply and demand. The procedure is administered by State regulatory bodies through use of the police power of the States under authority of State conservation laws; the practice is supported by a considerable degree of voluntary conformance on the part of operators; and the Federal Government has accorded its cooperation by providing advisory quotas, circumscribing imports, checking movements of hot

(written discussion ?).-The two papers on coal-mine costs and pride fixing that Mr. Norris has contributed to the Transactions possess as much general interest and are of as much value to the coal-mining industry as any papers that have been presented in recent years. Until recently one of the troubles with the coal business, and especially the bituminous branch of it, has been that because of the lack of a uniform system of cost accounting (many operators, I regret to say, not having had any system at all), the industry as a whole may be said not to have known where it was at. The system adopted by the Federal Trade Commission may not be absolutely perfect but it has accomplished something in that it has compelled a uniform method of reporting and tabulating costs giving results of these compilations which are comparable. The Institute and the coal-mining industry owe a vote of thanks to, and of confidence in, Mr. Norris and his two associates on the Engineers Committee of the Fuel Administration, Messrs. Garnsey and Allport, for the great work they have done in interpreting the results compiled by the Federal Trade Commission, not to speak of the personal sacrifices made by them in giving their services to the government. Those who have read Mr. Norris' paper will probably join me in wishing he had brought out a little more fully the real meaning of the charts so far as they indicate the difference between the cost of producing a ton of anthracite and the price the operators receive for their product. Mr. Norris could have done this more satisfactorily than anyone else. It seems to me that particular attention should be drawn to the fact that, according to these charts, and the tables accompanying them, not less than 25 per cent. of the total output of anthracite, whether "company" or "individual," during the period covered by Mr. Norris' paper,

The iron-mines of the Ilsede Hutte Co. are at a town called Peine, about 20 miles east of the city of Hanover, on the railroad to Brunswick (Braunschweig). Hanover, the capital of the province, is a military city, of approximately 250,000 inhabitants, and Brunswick, 33 miles to the westward, has half this number. The mines here described are located in a hamlet called Bulten. The Ilsede Hutte Co. operates two mines, 1.5 miles apart, in this district, Gruber Bulten Adenstadt and Gruber Lengede Bodenstadt. It also operates an iron-mine north of Hanover, known as Eiserhaven, and one in the Harz mountains, the Georg Friedrich, at Grauhof. At Bulten a coarse conglomerate, a, Figs. 1 and 2, contains nodules of limonite, cemented together by calcium phosphate. The ore contains Fe, 25 to 45; Mn, 3 to 4; P, 0.6 to 1.4; '5, 0.02 to 0.09; and CaCO,, 40 per cent. Directly above the conglomerate is limestone, 6, followed by a mixture of clay and sand, c. Below the conglomerate is a hard clay floor, d. The ore-body, from 10 to 12 km. long, and from 3 to 4 km. wide, has a maximum thickness of 20 m. It dips approximately 10" S.E., and strikes K 45° E. Diamond-drill prospecting shows that the thickness diminishes to 1 m. as the end of the deposit is approached to the northward. At this point the deposit is 250 m. below the surface. In Fig. 2, the arrow, A, indicates the general direction of the work along the face, a, which is carried forward in a straight line for its entire length. At B, a train is approaching, which has come from the bench-track, shown at C, by a circuitous route, and is dumping the overburden behind the face, in the space left by the excavated rock. The needs of the World War showed the necessity of a metal stronger than cast iron which would supplement the supply of steel. SO patriotic metallurgists were spurred to new efforts to improve the status of that half-breed of the metal world that had been, more or less erroneously, christened semisteel. As a result, it was developed that for certain purposes semisteel was superior to steel in the manufacture of shells. Steel, because of its greater strength and toughness, is able to carry a greater charge of explosive, weight for weight; consequently, a steel shell can be expected to cause greater destruction when used against fortifications or other inanimate objects, while semisteel, because of its comparative brittleness and its resulting greater fragmentation, is capable of inflicting more serious loss of life when used against opposing forces of men. Therefore, each has its proper place in the economy of war. For the present purpose, steel may be defined as a comparatively pure iron whose physical nature is modified by small amounts of carbon, silicon, sulfur, phosphorus, manganese, and possibly other rarer elements; while cast iron generally is limited to approximately 93 per cent. of iron, the remainder consisting of larger percentages of carbon, silicon, sulfur, phosphorus, and manganese. Semisteel may be defined as cast iron in which the carbon and silicon have been reduced to as low a point as is consistent with maintaining the nature of gray iron, and in which the remaining elements are adjusted so as to give the greatest strength. The fact that the addition of steel scrap, in varying percentages, is the means used to reduce the carbon, together with the fact that a considerable increase in strength results, is probably the explanation of the origin of the name semisteel. IT was stated in a former paper1 that an intensive study of anthracite costs was being made by the engineers of the United States Fuel Administration. The results of this-study are now available and are offered as a supplement to the former paper. Anthracite costs as reported, for the 6-months period, December, 1917, to May, 1918, inclusive, as compiled by the Federal Trade Commission, were used as a base, and charts similar to those described in the-former paper were made for the standard white ash anthracite and for red ash and Lykens valley coals. ADJUSTMENTS The adjustments of cost from a reported to a price-fixing basis, as described for the bituminous methods, were applied but showed only minor adjustments as necessary. The great spread in anthracite prices on the varying sizes, which for the 6-mo. period under review ranged in average from $5.244 for nut to $2.074 for barley coal, makes the question of the percentage of sizes produced at the different collieries a vital one. The realization with the same prices for each size must be within very wide limits, when it is considered that the percentage of prepared coal reported from different collieries varied from over 80 per cent. to below 30 per. cent. for fresh-mined coal. Hence, as the spread in prices for the various sizes must be predicated on some percentage, it is essential to find some method of adjustment to allow for this variation. The logical method of adjustment is to calculate actual costs to costs as of the standard percentage of sizes, so that the margin between the adjusted costs and the average realization shall be the actual margin for each colliery between its actual costs and actual realization clue to its particular percentage of sizes. As a base for realization the actual percentage of sizes for fresh-mined coal for the 6-mo. period was adopted. This percentage is given in Table 1.

Efficient ventilation of metal mines consists in having such complete control of air currents that there is always supplied at placcs where men work sufficient moving air to allow working at maximum capacity without injury to health; and in case of underground fire or of surface fire in the vicinity of mine openings, underground air currents may be quickly reversed if desired, or air may be sent into or excluded from any region and fire fumes confined to only part of the mine workings, instead of penetrating practically the entire mine. Health and safety of workers in mines as well as proper safeguarding and operating efficiency of mining properties are so intimately associated with proper ventilation of mines (both coal and metal) that they are inseparable, yet ventilation is only too frequently neglected, especial1y in metal mines. The metalliferous operator, generally not confronted with inflammable gas or explosive dust which so frequently force ventilation of coal mines, usually disregards air supply altogether except such as may be obtained from compressed air; and generally, even when attention is given to metal-mine ventilation, the air currents rarely are found where they are needed, namely, the working places, especially the working faces. After several years' study of miners' consumption, the writer is convinced that long continued breathing of air impregnated with large quantities of any kind of finely divided dust, such as is found in a large number of the working places of our mines, will ultimately produce some respiratory disease, whether it be asthma, bronchitis, or phthisis; and the progress of these diseases is hastened if there are also present high temperatures, high humidities, or harmful gases or if there is present (and allowed to remain to be breathed) large quantities of the finely divided dust when air temperatures are low, hence favorable to maximum performance of work with accompanied maximum breathing into the respiratory passages of the harmful material. This paper gives observations on ground movement and subsidence resulting from pillar drawing in the Lick Run section of Montour No. 10 mine of the Pittsburgh Coal Co. adjacent to solid coal owned by the U. S. Bureau of Mines at its Experimental mine in Snowden Township, Allegheny County, Pennsylvania. The investigation was planned by George S. Rice, chief mining engineer of the Bureau, who arranged the necessary cooperation with Dr. L. E. Young, vice president of the Pittsburgh Coal Co. Engineers of that company placed permanent monuments on the surface to establish the boundaries of the coal owned by the Bureau and to furnish fixed points to which all levels were referred. Engineers of the Experimental mine staff then covered the ground under observation with a checkerwork of monuments made of oak pegs set into the ground at 50-ft. intervals in two directions at right angles to each other. The level of these pegs was determined first from Dec. 16 to 30, 1929; again from May 25 to June 5, 1930, and finally from July 7 to 15, 1931. Observations were then discontinued because work had been stopped temporarily in this part on Montour 10 mine. General Conditions Fig. 1 is a plan of the part of the area under observation with which this paper deals. The mine is developed on a room and pillar system known locally as half advancing and half retreating. As Nos. 35 and 36 butt entries were advanced, rooms were driven from No. 36 and drawing of the room pillars followed their completion. When the entries reached the boundary, rooms were started from No. 35 butt beginning at that point, and all remaining pillars were drawn as rapidly as possible. The rib lines of Jan. 9 and June 13, 1930, were surveyed a week to 10 days after the first and second sets of levels were run, and there was some advance in that period. SPECIAL sands are those that are employed for special purposes. They have a limited use, as compared with sands for concrete and plaster. The sands discussed in this chapter are those used for foundry purposes, glass manufacture, filter beds, abrasive purposes, sandblasting, engine sand, sand for sheet asphalt, and furnace sand. These sands are almost invariably high in silica, consisting chiefly of quartz grains. In some-for instance, glass sands-freedom from ingredients other than silica, such as iron oxide, is important. Certain grades, like filter sand, require rather careful sizing, and in foundry sands the bond, usually clay, is important. One deposit may sometimes be used to supply several grades or types of sand by appropriate methods of screening and washing. The special sands discussed here are usually obtained from deposits of unconsolidated material but sands high in silica are derived occasionally from soft sand- stones that can be disintegrated easily. Requirements are not the same for all uses, and, while certain properties may be demanded, there are no officially adopted standard tests except for foundry sands. FOUNDRY SANDS Definition-Foundry sands include those siliceous sands that are used to make the forms for casting metals. If these are employed for making molds, they are known as molding sands; if for the cores that form the hollow spaces in the casting, they are called core sands. Naturally bonded sands are those containing a variable, though not usually large, amount of clay, which serves as a bond. Synthetic sands, now much used, represent an artificial mixture of sand with usually fire clay or bentonite. Core sands may be bonded with oil, cereal binders, resin, pitch, or other materials. The foundrymen apply the term "sharp sand" to one that is free from bond. Properties-The important properties to be tested at room temperature are texture or fineness, permeability, strength, deformation, and flowability. Those tested at elevated temperatures are compressive strength, expansion and contraction, sintering point, and durability. More attention probably has been given to research on the properties

The numerous and copious reports of geological surveys made in the lead and zinc region of Wisconsin leave, perhaps, but little room for any original work, or for descriptive details of the nature and origin of the deposits not already given in the exhaustive memoirs of Percival, Whitney, and Chamberlin and their associates. HOWeyer, since the completion of the last survey, in 1879, much more attention has been given than before to the exploration of the ores of zinc, especially of late years, since the region has been better opened up by railways and the zinc industry of the country has assumed large proportions, giving a constantly increasing demand for zinc-ores. A residence of more than a year in the region, and the active direction during that time of mining operations over a considerable area, have familiarized me with the forms and peculiarities of many of the deposits; and it appears probable that some observations upon them, especially from the mining and commercial standpoint, may interest the members of the Institute. A few notes on the structure of the deposits from the mineralogical and chemical standpoints have already been presented by me to the Wisconsin Academy of Arts and Sciences." The presence of lead-ore in the soil at many points along the Mississippi river was well known to the aborigines, and early attracted the attention of the frontier traders, who purchased from the Indians the ore and even lead smelted out by the squaws. The demand for the lead-ore soon increased, and it became one of the early and potent factors determining the settlement of southwestern Wisconsin, and the development of its mining and agricultural resources. The mines of that section, together with those of Missouri and the Mississippi valley, may be said to have been the cradle of mining in the western United States. MILLING is one of the metallurgical arts whereby the extraction of the largest possible proportion of the value in an ore is effected at the least possible expense. Stamp-milling* is that particular process in which a heavy body of iron is caused to fall upon the ore so as to disintegrate it and thereby induce a separation between what is valuable and what is worthless. The latter is usually less in specific gravity, and is therefore, by the further aid of water, removed from the former, which is then collected by the use of mercury. Several similes have been employed to describe this process. The stamp has been likened to a hammer of which the stem is the handle and the die the anvil. The ore upon which the stamp falls has been compared to a nut awaiting the descent of the hammer whose blow is to separate the valueless shell, the quartz, from the valuable kernel, the gold. When we begin to pursue our inquiries, however, we find that the analogy is just sufficiently true to emphasize the departures from it. The hammer falls, the anvil is fixed; so with the stamps and the mortar. The anvil is made of softer metal than the hammer; so also the die is often, and should be always, of steel or iron less hard and more tough than that of the shoe. The movement of the hammer and the drop of the stamp are both intermittent. In regard to their intermittent action, as in many other respects, stamp-mills arrange themselves under two types, which, though apparently contradictory, have both been evolved from a common original, and are united by a great variety of intermediate modifications. The slow speed and the high drop of the mills of Gilpin county Colorado, appear to have very little in common with the fast speed and short drop of those of the main gold belt of California; yet the practice of the one was largely derived from that of the other,

NORMAN CARMICHAEL.-We realized the objections too the gable-bottom car, but were almost forced to its adoption by the same reasons that caused us to retain the 20-in. gage. To use another car would have meant a vast number of changes, for our transportation system was quite extensive; all mine chutes and ore bins were arranged for that car. Had we been laying out, new works, many of our decisions would have been different. MEMBER.-If you were planning it now, would you not put in box bottom cars with a rotary dump? NORMAN CARMICHAEL.-We surely would. One objection to the gable-bottom car is the spill. No, matter how carefully the cars are kept up,: there is always leakage and spill. The cost of keeping and maintaining the cars in a good state of repair, so as to keep that loss at a minimum, is not necessary for a box-bottom car.

The Aztec mine is not widely known, by reason of its isolation and the relative insignificance of its tonnage; financially, however, it has an enviable record and geologically it is extremely interesting. The town of Baldy, Colfax County, the mine camp, at an elevation of 10,000 ft. (3048 m.) is 8 mi. west of Ute Park, the terminus of a branch of the A. T. & S. I?. Ry. The mining tract was designated by the Maxwell Land Grant Co. as the Aztec Reservation, and lies on the east slope of Mt. Baldy, the summit of which, 12,491 ft. (3807 m.), is one of the highest in the state. Rich copper float was found on the northeast slope of the mountain in 1865, and discovery work was begun the next year. At the same time, gold placers were found on Willow Creek, on the southwest side of the mountain, and the Elizabethtown settlement followed shortly. Gold washing lasted many years. In 1867, placer gold was found also on Ute Creek, the tracing of which to its source led to the locating of the Aztec mine by Lynch, Dogherty, and Fosley in the following year. The early production came from the contact of shale and sandstone or from sandstone immediately above the contact. Exact record of production is lacking, but L. C. Gratonl gives estimates ranging between $1,250,000 and $1,500,000, of which about $1,000,000 was taken out in the first four years. After the exhaustion of the early bonanza, production continued intermittently until 1909, when the Maxwell Land Grant Co, undertook systematic development, through four adits at intervals of 75 ft. vertically or approximately 100 ft. on the dip of the contact, which was thought to contain generally a quartz-pyrite vein. Tarnish films on some of the common metals (particularly on copper and silver) have been of much scientific and commercial concern for a long time, but before the development of the electrical method1 of measuring film thicknesses there was no satisfactory quantitative approach by which to study the separate parts of these complex films. This method has been adapted to the measurement of duplex (cuprous-cupric) oxide films on copper.2 In the present work it has been used to measure tarnish films on copper when they were mixtures of cuprous oxide and cuprous sulphide, and also when they contained cuprous oxide, cupric oxide and cuprous sulphide, each component part being measured at a different potential value. Oxide-coated copper specimens, prepared by heating copper in air at chosen temperatures for given periods, were exposed to moist hydrogen sulphide in air to forml the various oxide-sulphide films studied. The comparative resistances afforded by (I) different thicknesses of oxide films, and also (2) equal thicknesses of oxide and sulphide films, against severe attacks of hydrogen sulphide were measured. The electrical method requires that the time be observed for the cathodic reduction of each part of the film substance, and these respective time values multiplied by the constant current give the corresponding quantities of electricity expended. Then each millicoulomb per square centimeter represents a film thickness of M X 108____ 2DX 96,494 X 103 where M is weight of oxide (or sulphide) giving one gram-atom of oxygen (or sulphur) for cathodic reduction, D is density of the oxide (or sulphide) and t is the thickness in Angstrom units per millicoulomb per square centimeter. The value of t for cuprous sulphide (cubical) is 14.27, and is obtained by substituting 5.78 for D and 159.20 for M in equation a. Previous values hf t for cuprous and cupric oxides (12.36 and 6.39, respectively) were used in the present work.

This paper presents results of static capillary pressure measprements made both by the restored-state and by the mercury-injection methods, and of dynamic capillary pressure measurements made by the Hassler technique. The results indicate a variation from sample to sample of the factor used to convert capillary pressure obtained by mercury injection to those applicable to a water-gas system. Static capillary pressures measured by the restored-state method were found to be in close agreement with dynamic capillary pressures, indicating that data obtained from static measurements may be utilized with confidenre in the solution of dynamic problems of fluid flow. Experimental data are presented on the use of "J-curves" for the correlation of capillary pressure-saturation relations for a number of cores from a particular geologic formation. It is shown that the correlation was improved in some cases by reqtricting it to rertain lithologic classifications. INTRODUCTION The Meaning and Importance of Capillary Pressure The coexistence of two or more immiscible fluids within the voids of a porous medium, such as reservoir rock, gives rise to capillary forces. Because of the interfacial tension existing at the boundary between two immiscible fluids in a pore space, the interface is curved, and there is a pressure difference across the interface. This pressure difference is termed the capillary pressure. The magnitude of the capillary pressure between two immiscible fluids which together fill a porous medium depends upon several factors: the textural properties of the medium, the wettability of the medium, the interfacial tension between the fluids, the respective saturations of the fluids, and the manner in which these saturations are attained. For a given pair of immiscible fluids in a particular sample of reservoir rock, the capillary pressure is a unique function of the fluid saturation, provided that the saturation of the fluid which wets the rock has previously been decreased unidirectionally from an initially complete saturation. The Aztec mine is not widely known, by reason of its isolation and the relative insignificance of its tonnage; financially, however, it has an enviable record and geologically it is extremely interesting. The town of Baldy, Colfax County, the mine camp, at an elevation of 10,000 ft. (3048 m.) is 8 mi. west of Ute Park, the terminus of a branch of the A. T. & S. I?. Ry. The mining tract was designated by the Maxwell Land Grant Co. as the Aztec Reservation, and lies on the east slope of Mt. Baldy, the summit of which, 12,491 ft. (3807 m.), is one of the highest in the state. Rich copper float was found on the northeast slope of the mountain in 1865, and discovery work was begun the next year. At the same time, gold placers were found on Willow Creek, on the southwest side of the mountain, and the Elizabethtown settlement followed shortly. Gold washing lasted many years. In 1867, placer gold was found also on Ute Creek, the tracing of which to its source led to the locating of the Aztec mine by Lynch, Dogherty, and Fosley in the following year. The early production came from the contact of shale and sandstone or from sandstone immediately above the contact. Exact record of production is lacking, but L. C. Gratonl gives estimates ranging between $1,250,000 and $1,500,000, of which about $1,000,000 was taken out in the first four years. After the exhaustion of the early bonanza, production continued intermittently until 1909, when the Maxwell Land Grant Co, undertook systematic development, through four adits at intervals of 75 ft. vertically or approximately 100 ft. on the dip of the contact, which was thought to contain generally a quartz-pyrite vein. In the utilization of natural resources owner, operator, and consumer* should share the attendant benefits. Development needs to be planned under terms recognizing fully the interests of all concerned, for ally undue advantage given to any one of these participants is apt to involve even greater and disproportionate injury to one or both of the others. For this reason it is well to preface any consideration of needed reforms in legislation affecting the disposition of public land with a survey of certain fundamental principles that determine the general conditions of a11 land transfers preliminary to development, utilization, and production. The disposition of any undeveloped natural resource, whether timber, oil, coal, or water power, as a transaction to which land owner and prospective developer are parties, must be based in theory upon a division of expected returns.' Whatever the terms of such disposition, neither party can reasonably ask for anything other than an equitable division of the returns. Under this analysis three and only three questions need to be discussed; namely, what are those profits, how is this division to be accomplished, and what is the equitable basis of division ? The answer to the third question should probably be found by applying to the problem the principles of theoretical sociology, and the question need not be mentioned further at this time, inasmuch as it does not involve the practical considerations to be kept in mind in connection with the other questions, which are concerned with only the measure of returns and their division. That is to say, whether the land owner's equity is to be stated as 95 per cent, ox as 6 per cent, of the profits attending the development of the particular resource, no change would be necessary in the method to be adopted of arriving at the closest approximation of the prospective total profit.
