One of the numerous requirements of many grades of present- day steel is that the steel shall be free from non-metallic inclusions. These inclusions may be composed of oxides, sulphides, complex oxy- sulphides, and nitrides, which enter the steel with the furnace charge, result from sulphur absorption from the furnace gases, or are formed in the steel during the deoxidation process. Although few' data are available which indicate in any quantitative manner the specific effects of inclusions in steel, there is a large mass of circumstantial evidence which points to the advisability of producing steel free from these impurities for many purposes. At the present time there is a growing feeling among metallurgists that non-metallic inclusions should be divided into two distinct types: (I) those readily visible under the microscope at ordinary magnifications; and (2) those in colloidal suspension or in solid solution. Both types are profoundly influenced by the character of the charge, the manipulation of the furnace slag, and the method of deoxidation. The work described in this bulletin deals primarily with inclusions visible under the microscope at ordinary magnifications, but the steels made by the various methods of deoxidation are being used LO study certain effects which may be ascribed to the second classification, named above. This latter work will be the subject of further bulletins on the effect of deoxidation practice on the physical properties of the steels involved.

IN anticipation of a shortage of labor for hand-tram-ming at the Cliffs shaft mine of the Cleveland-Cliffs Iron Co. at Ishpeming, Mich., early in 1923 three 4-ton Goodman storage-battery locomotives, equipped with Edison batteries, were purchased. Storage-battery locomotives were chosen for this work because the expense and time required to put up trolley-wire and to bond the rails of the complicated system of tracks on the levels, where the locomotives were to be used, would not have been warranted by the amount of ,ore to be handled. The only changes in the tracks necessary for storage-battery locomotives were new switches and extra ties and braces on curves. The tracks were 24-in. gage, and were laid with 20-lb. rail. Edison batteries were chosen, because it was desired to charge the batteries from the trolley circuit already, in the mine, and this would have been impracticable with lead batteries. Each locomotive is equipped with 126 A-4 Edison cells, which are charged in series from the 240-volt trolley circuit while the trolley locomotives are running; and are discharged in parallel in two banks of 63 cells each. These locomotives were so successful that later 5 smaller locomotives, weighing 11/2 tons each, were pur-chased for use e with cars that are filled by hand and on levels where the amount of ore handled is small. These locomotives, built by the Geo. D. Whitcomb Co. of Rochelle, Ill., are equipped with batteries of 40 A-4 Edison cells each, the cells being the same as those, on the larger locomotives. They are charged from mer-curial-are rectifiers. These locomotives are operated by the trammers themselves, and have not special oper-ators like the larger machines. The trammers are all young men of American birth, and take quickly to the operation of machinery, and the simplicity of the con-trol on these locomotives has made special training unnecessary. A survey of the results was made by the A. C. Nielsen So., an excerpt from which follows: Eight Edison-equipped battery locomotives are now in use at an Ishpeming mine of the Cleveland-. Cliffs Iron Co. This equipment was installed to take the place of men who formerly pushed loaded cars by hand. Results have been very satisfactory and the de-pendable, trouble-free operation of the Edison batteries is considered to have been an important factor in the effectiveness of the new hauling method.

Gentlemen : If my first words were other than those of thanks for the high honor of being called to preside over the American Institute of Mining Engineers, I should do injustice alike to you and to my own sense of the obligation, under which I have been placed by your voluntary choice. When the position was first suggested to me, I resolutely declined to allow the use of my name, on the ground that, by training and occopation, I was not entitled to this honor, which, it then seemed to me, should be conferred only on a professional engineer. In fact, the history of the Institute, which had honored itself, as well as my distinguished predecessors, David Thomas, Rossiter W. Raymond, and Alexander L. Holley, by elevating then] to its highest office, seemed to indicate the line and the limit of safe precedent, in which I did not then see how I could be included. But my scruples were finally removed by the consideration that, as in the course of human industry, the pioneer, of whom Mr. Thomas was so marked a type, must precede the mining engineer, so fitly personified in Dr. Raymond, and be followed by the mechanical engineer, whose incarnation we behold in Mr. Holley; so all these must be supplemented by the man of affairs and finance, in order that "enterprises of great pith and moment" may be prosecuted to a successful issue. I felt, therefore, that I had no longer any right to resist your preference, or to deprive myself of what I must regard as the crowning honor of an active career. On an occasion like the present it seems appropriate to review the history in this country, during the last hundred years, of those industries which the Institute of Mining Engineers specially represents. There is much in the story with which other members of this body are more familiarly acquainted than myself; yet I fancy that to all of them, and not less to our distinguished and most heartily welcome gnests from abroad, a comprehensive outline of the progress of mining and metallurgy in the United States mill prove interesting. I ask your attention, therefore, to a condensed account of that subject, embracing a statement of the beginnings of the industry on our shores, of the notable events attending its increase, and of its present

Since 1909, when an agreement between Minnesota's Tax Commission and the University of Minnesota's School of Mines was worked out, it has been the annual responsibility of the School to evaluate and classify the iron ore deposits within the State. These unique duties of an academic institution have provided School officials with an excellent view of the past, present and probable future of the mining industry in Minnesota as the average grade of iron ore (excluding taconite) * diminishes while at the same time it competes with beneficiated taconites and foreign high-grade ores for use in America's eastern blast furnaces. SYSTEM OF EVALUATION In the latter part of November of each year, the Mining Division of the Department of Taxation makes a preliminary study of the active mines which the Department wants the School of Mines to review. These are discussed with the engineers of the Ore Estimate Division of the School of Mines and with the mining companies. After these discussions, a list of the mines of each of the major operating companies is submitted to the Ore Estimate Division of the School of Mines with the request that these properties be reviewed by them as of the next assessment date (May 1st). At the same time, a letter is sent to the mining companies requesting that they submit to the Division their own estimates on the selected mines operated by them, together with all computations, drill records, maps and cross-sections. The mining companies are re- quested to send in this information during the first half of the year, and, as far as is possible, they have always complied with this request promptly. Much of this information received by the School of Mines is of a confidential nature and is treated as such.

The engineers for whom it is written are those who, having glimpsed the formidable formulas and discussions of the geophysicists, give all publications on the subject a wide berth. For a few years now the geo-physicists have had a tendency to be ingrowing at their meetings, going deeper and deeper into theory and instrument construction, and forgetting to present the topics that would interest the practicing engineer who desires merely to know how geophysics can help him, not why.

I. INTRODUCTION. DURING the last twenty years or so the chemical investigation of rocks has made great advances, and it is now generally recognized that a knowledge of the chemical composition is as essential as that of the texture or mineral composition-if not more so-for the proper classification of rocks and study of their origin and relationships. Rock-analyses have vastly increased in numbers and, what is of greater importance, in quality. New and improved methods permit of greater accuracy than was possible in the early days, and the list of chemical constituents frequently determined has risen from the seven or eight of the greater part of the nineteenth century to twenty or more. Indeed, rock-analyses with determinations of so many constituents are now commonly made by the chemists of the United States and Australia, while in Germany, Great Britain, France, and Italy the rarer constituents are determined more frequently than formerly. As a consequence of this modern, accurate work, it has been discovered that some elements which were formerly supposed to be rare are of wide-spread occurrence and are often present in considerable amount. The fact is further being developed that the elements tend to show certain relations of occurrence or abundance in connection with each other. This is a fact which is applicable to the rarer elements, and which also finds a broad geological and petrological expression in the recognition of petrographic provinces. We are beginning to obtain some definite, though as yet rudimentary, knowledge of the distribution of the elements among igneous rocks. Some of the results along these lines obtained by study of the vast accumulation of analytical data now available are well known to petrologists, while others do not seem to be so gener-

THIS paper gives the results : first, of a research into the somewhat extensive literature of titanium; and second, of a series of original tests upon the effect of titanium on iron castings. New investigations have also been made upon the effect of titanium on steel, but I hope to treat this subject in an independent paper at some later date, and, therefore, will not discuss the experiments in detail here. The combined results of this study, which extended over a period of more than two years, can be briefly summarized as follows: 1. Steel or cast-iron, in which the titanium is properly proportioned, and which has been properly treated, is improved in strength, toughness, and durability against wear, such as, for example, the wear of railroad-rails, of steel and chilled-iron .rolls, car-wheels, etc. 2. These improvements seem to be caused, not so much by the direct effect of titanium on the metal, as by its cleansing influence in removing harmful impurities, such as oxygen and oxides, nitrogen, occluded slags, and perhaps also sulphur. It appears also to reduce segregation, which would contribute to the same end. 3. In order that its effects may be fully realized, the treatment of steel or iron with titanium must be correctly performed. The mechanics of filtration are described by a theoretical-empirical nonlinear diffusion equation which, under certain circumstances, may,be linearized and then solved explicitly. For filtration under static conditions linearization leads to a boundary value problem analogous to a heat flow problem with a known explicit solution. The corresponding solution for static filtration is compared with published experimental data. Under dynamic conditions filtration takes place in three successive stages. During each of these the rate of filtration and/or the thickness of the filter cake are different functions of the filtration time. The proposed mechanism explains the observed high resistance of dynamically deposited filter cakes against erosion and also the connection between filtration rate and viscosity of the drilling fluid. Several of the quantities governing dynamic filtration have no counterpart in the static filtration mechanism. The static filtration rate is, therefore, not a reliable measure for the dynamic rate and vice versa. INTRODUCTION Filtration under simulated borehole conditions, i.e.. either from a static suspension or from a suspension flowing parallel to the filter cake (dynamic filtration), has been the subject of several laboratory studies.1-7 This experimental and theoretical work showed that many aspects of the filtration mechanism cannot be explained by an elementary filtration theory based on the assumption that the filter cake is incompressible. For a more satisfactory theory compressibility should be taken into account. This has been done. at least to some extent, in the filtration theory developed for the chemical industry. Surveying the literature (see Ref. 8 for a bibliography) it becomes apparent that, although several properties of filter cakes deposited from many different suspensions have been measured, including compressibility, the filtration equations are essentially empirical in nature. No attempt has been made, for instance, to develop filtration theory along the lines of consolidation theory.12 This theory, upon which a highly successful development in soil mechanics rests, would appear to be an excellent starting point for a filtration theory since the compressibility concept is an essential part of it. As we will use this theory in the following development it is well to state the four assumptions on which it is based: 1. The fluid flow through a compressible porous medium is governed by Darcy's law. 2. The rate of change in fluid content of an element of the porous medium is proportional to the rate of change of solid pressure between the particles. 3. The solid particles are incompressible within the range of pressures considered. 4. The total pressure on a surface normal to the line of flow is equal to the sum of the fluid pressure and the pressure between the particles (solid pressure) at that surface. To calculate the rate of filtration and other quantities of interest it is necessary to know the filter cake compressibility and the permeability as a function of the solid pressure. It has not been possible to calculate these functions from theoretical considerations and they will therefore be introduced in this paper as empirical expressions. Both are determined in a compression cell where the cake is subjected to a mechanical load. Permeability and compressibility are measured after the solid pressure has stabilized, i.e., after the excess fluid pressure has been dissipated and the uniform pressure is transmitted entirely by the solids. The permeability and compressibility thus determined are not the same as during filtration in the borehole, under either static or dynamic conditions, because then, due to frictional drag, the solid pressure and hence also the permeability and compressibility vary along a line normal to the direction of the mean flow and can only be defined locally. DERIVATION OF THE FILTRATION EQUATION FOR COMPRESSIBLE FILTER CAKES As the filter cake in the borehole is thin compared to the radius of the hole the filtration may be considered as linear. TAXES in general are onerous and are not a pleas- ant subject for discourse. There are, however, some very cogent reasons why we should dedicate a part of our thoughts and services to the solution of our taxation problems: The happiness of every individual in the United States depends on the maintenance of a stable government. The collection of taxes is an indispensable function of a stable government, and the power to collect taxes depends in part on the question whether taxes are fair and equitable. As representatives of the mining industry it is our duty to .protect it from tax burdens that are discriminatory or- unjust, As citizens we find that taxation is incessantly endeavouring to unravel the knots in our purse-strings. Many members of the Institute may be consulted .by clients on taxation problems, especially the phases which re- late to depletion and valuation. It is the hope of the writer that the discussion of some of the current depletion and valuation problems will stimulate interest in the problems, and as a consequence of this new interest facts will be ventilated, opinions rendered and services performed, which will be a means of solving the problems to the satisfaction of all parties interested.

AMERICAN consumption of industrial diamonds has increased five fold in the past 25 years and today accounts for 15 to 20 percent of the world's sale of rough diamonds. In another decade the value of industrial diamonds sold may well equal or exceed that of gemstones. It is generally understood that industrial diamonds are one of the strategic minerals being stocked by the Government in the present crisis to ensure rapid and efficient armament production. Diamond die making is a trade largely confined to artisans in Switzerland and in certain parts of France. Today, in addition to turning out pilots, we should train expert artisans in diamond die making, for thousands of miles of tremendously small-gauge wire will be needed to make the instruments by which the efficiency and safety of these pilots is assisted.

AFter a year's continued impact of war, the task of the petroleum-refining industry stands out clearly and looms up in larger aspect. This time it is not, as it was so largely in the first World War, simply a matter of increased quantity—more and more of the same petroleum products that had substantially been standard for years. In this era the emphasis is largely on newer and improved materials which had been produced, if at all, in comparatively insignificant quantities, and for which manufacturing equipment was not available on a large scale. At the beginning of 1942 four great product needs (besides a number of lesser ones) confronted the industry: 100-octane aviation gasoline, toluene for T.N.T. production, high-quality lubricating oils for aviation and Army equipment service, and petroleum chemicals for synthetic rubber manufacture. The difficulty in presenting a review of engineering progress in petroleum refining during 1942 is that there is so little one is free to say about so much which has been and is being accomplished. At the opening of 1942 the program was to increase the then existing capacity of 50,000 bbl. a day of aviation gasoline to over 150,000 bbl. daily by building new plants at an estimated installation cost of $150,000,000. Later in the year. after the announcement by President Roosevelt of a large increase in the program for war-plane building, additional contracts were made between the Reconstruction Finance Corporation and rehers to raise the capacity to 250,000 bbl. per day. The greatly increased scope of the war activities in all parts of the world, the obligation of the United States as the arsenal of the United Nations, and the greater importance and use of bomber, transport, and cargo planes will undoubtedly bring about plans and installations for a further increase in production of aviation gasoline over the present announced plan. In this connection, Jesse Jones, Reconstruction Finance Corporation Chairman, announced that as of Oct. 31 the R.F.C. had through its subsidiary Defense Plant Corporation entered into contracts for the construction, expansion, or equipping of 28 plants to increase 100-octane aviation gasoline production, but gave no data on 'capacity involved or completion dates. His list did not, of course, include a number of existing plants, and some installations being made by companies who are themselves financing the construction. Production from existing operating installations was materially increased in a number of instances as a result of pooling knowledge of improvements in operation and also by the exchange of Components going into 100-octane blend to enable greater quantities of aviation gasoline to be produced from the over-

ChEap power is essential to large-scale mining and metallurgical operations, particularly where fine grinding of large tonnages has to be resorted to, as is the case with an increasing number of mines treating disseminated copper ores, or low-grade gold ores, in the grinding of which considerable power is consumed. A comparison of the cost of generating power with Diesel engines and steam turbines and a brief discussion of the different factors governing the profitable use of either type of prime mover may be timely in view of the importance of a cheap supply of power to the mining industry, and the prominence that has lately been given to Diesel engines in America. As many of our most important mines and largest producers of metals are located in sections where neither cheap coal nor water power is available, and the price of oil fuel is increased by long hauls, the Diesel engine will become a prime mover of increasing importance. This applies particularly to the Southwestern States, where an ample supply of cold water for condensing purposes is unusual and local climatological conditions interfere in securing the high vacua essential to high turbine efficiency. About 12 times as much water will be required for condensing purposes with steam turbines under general conditions as is needed for jacket-cooling of two-stroke cycle Diesel engines; four-stroke cycle Diesel engines require only one-twentieth of the cooling water. Another condition favoring the use of Diesel engines is the high load factor at which most mine power plants operate. The influence of load factor on the cost of generating power is shown in Tables 1. and 2 and in Fig. 1. The higher the cost of fuel and the load factor, the greater will be the proportion of the fuel to the other costs making up the total cost of generating power. Capital charges (interest and redemption), maintenance, operating labor, and lubrication are practically constant amounts regardless of the load-output of the station; the fuel consumption and its cost are practically the only variables with the load. The costs here given are based on conditions as generally found in the Southwestern States, and on Diesel engine operating experience in European countries, where this type of prime mover has reached a high state of perfection, units upward of 4,000 hp. having proved entirely successful in operation.

IT is with particular pleasure that I welcome the members of the Open-hearth Conference of the I American Institute of Mining and Metallurgical Engineers to this meeting, as I feel this is one of the most useful activities of the Institute in the field of ferrous metallurgy. For the information of our other members I might say the Open-hearth Conference was organized by Mr. Reynders when he was president, and is made up of open-hearth superintendents and metallurgists. All the plants are invited to send representatives, and practically all do, with the exception of the U. S. Steel Corporation. It meets twice a year to discuss various problems in connection with the manufacture of steel, and its minutes are published for the benefit of those attending, the expense being defrayed by the participating companies. This conference, .1 believe, should be a model for activities in the other branches of the work covered by this Institute. It works, not by reading formal papers, which we all know is not a very satisfactory method to bring out the experience of others, but rather by a round-table method of discussion. The spirit of the meetings is such that each member feels perfectly free to state his experience, and he gets as much as he gives. A series of topics for, discussion is brought to the attention of the chairman and after one is exhausted the next point is taken up. In this way there is a real interchange of ideas and experiences which cannot fail l to be of the greatest benefit to those attending. That these meetings are beneficial is evidenced by the "continued growing attendance and lively discussions at these half-yearly meetings.

THE great work of Gorgas in stamping out yellow fever in Panama during the construction of the Canal was one of the chief factors contributing to the ultimate accomplishment of the task, two previous attempts having failed largely through the demoralization of workers by epidemics of contagious diseases. Mining camps, rapidly constructed during the boom days of the rushes to new fields, have been frequent sufferers from typhoid when, as so often used to be the case, little or no attention was given to bacterial examination of the water supply or to the method used for disposing of the sewage.

A galvanic cell, using as electrolyte a fused salt solution of calcium carbide and as electrodes carbon and a Fe-C alloy of known composition, has been set up to study the thermodynamics of Fe-C alloys in the temperature rmzge 800" to 1000°C. Time independence and reproducibility of the cell electromotive force were taken as evidence of the reversible behavior of the cell. Carbon was believed to be present in the electrolyte as the so-called acetylide ion, C;-. The plots of the cell electromotive force us temperature for a specific alloy composition were straight lines within the limits of experimental error. The average Partial molar enthalpy of carbon in iron relative to pure carbon was found to be +10,610 i 93 cal per g-atom C. Thermodynamic analysis of the data has led to the following equation for the carbon activity, ac, based upon pure carbon as the standard state: In ac = In Zc + 10,560/RT + (10.02 + 77O/T)ZC - 2.350 where ZC is the lattice ratio [nC/(nF, - nc )] and T is the absolute temperature. This equalion gives carbon activity values generally slightly lower than those from gas equilibration studies reported in the literature. METAL LOGRAPHIC examination of a polished cross section of the steel anode used in the electrolysis studies of fused salt solutions of calcium carbide by Morris and Harry revealed extensive carburization of the steel by the electrodeposited carbon. This carburization was reflected in the variability, with time, of the applied potential to the electrolysis cell, necessary to maintain a constant current density at the electrodes. This observation suggested the setting up of a galvanic cell of the "alloy concentration" type to study the thermodynamics of some metal-carbon alloys. Cells of this general type have been widely used for the study of alloy systems.2 In view of the availability of published data in respect of the austenite phase of the Fe-C system, it was decided to carry out measurements upon these alloys before proceeding to studies of less well documented systems. The galvanic cell may be written: where [C] is carbon dissolved in iron. The electrolyte was a fused salt solution of calcium carbide, containing some 5 to 10 mol pct of carbide. The cell reaction is believed to be: C(s)-[CI [I1 Carbon forms an interstitial solid solution in iron, with the atoms located in the octahedral interstices. In the fcc crystal structure of austenite there is one octahedral interstice per iron atom. Thus, the lattice ratio, ZC, shown by Gurney3 to be the fundamental concentration parameter in the context of interstitial solutions, is given by: where nc and nFe are the number of carbon and iron atoms, respectively. chipman4 has recently shown empirically the advantages of using this concentration parameter instead of the more usual atom ratio or atom fraction. The cell electromotive force, E, assuming reversible behavior, is related to the carbon potential or the partial molar free energy of carbon in the solid solution relative to pure carbon at the same temperature and pressure, GP at the composition ZC, by the equation: where z is the carbide ion valency and F is the Faraday constant. An activity of carbon, ac, in the solution relative to the value of unity assigned to pure carbon, and an activity coefficient, qC , are defined such that: where R is the gas constant and T the absolute temperature. GF is further related to the relative partial molar enthalpy Hm, and the temperature coefficient of the cell electromotive force, (aE/aT)Zc, by the equations: Measurement of the cell electromotive force thus enables calculation of the relative partial molar thermodynamic properties of carbon in iron, if z is known. At E = 0, the solid solution is in equilibrium with pure carbon. More convenient for many purposes is the standard state based upon the infinitely dilute solution, Henry's law. The relationship between the activity coefficient of carbon based upon this standard state, and that based upon the pure carbon standard state, qC , may be obtained by considering the free energy of transfer of carbon from the latter standard state to the former. LEAD SMELTERS AND REFINERS in 1932 were confronted with the problem of adjusting operations and costs to curtailed production and consumption at reduced prices, a problem which has been partially solved at least by improvements in operating technique and increased efficiency. At the Mount Isa properties in Australia, a third blast furnace and additional Dwight-Lloyd sintering machines were installed during the year, designed to increase the production to 6,000 tons of bullion per month. The large proportion of lead carbonate in the ores to be treated has presented metallurgical problems. Of the total lead contained in the concentrates to be smelted, two-thirds is Dresent as carbonates and one-third as sulfides. In the iiitial operations, the resulting Dwight-Lloyd sinter was soft, contained an excessive amount of fines, and was easily fusible. When charged to the blast furnaces it developed accretions in the upper part of the furnace owing to the easily fusible lead carbonates softening and fusing at the top of the charge column. This was remedied by the addition to the sinter feed of diluents of higher melting point, granulated slag and crushed limestone. The sinter feed consists of concentrates, Cottrell dust and wind-box cleanings, totalling 57 per cent of the charge; return sinter fines 15 per cent; granulated slag 23 per cent; and crushed limestone 5 per cent. The sinter produced contains 34 per cent lead and 0.5 per cent sulfur. Experiments indicated that double sintering under these conditions was of no advantage, so the original plan of single sinter treatment was retained.

SEVERAL criteria have been used more or less successfully in finding and developing orebodies in this district. Among them is the relation of the fracture to the orebodies. It has been known for some time that there was some relation, but it has been but recently. that careful study has been given to this subject. Like all the criteria used in this district, this relationship must be used with caution, for what-is true in one part of the district is not necessarily true in another.

IN COMPARISON with recent years 1932 has yielded much less tangible evidence of progress in copper reduction and refining. The industry has been extremely quiet, especially in the United States. Design and construction has been throttled by lack of new capital expenditures. The excess producing capacity of the whole industry and the extremely gloomy outlook for the future have made it unwise to tie up more capital except under special conditions. The plants built during the previous year have, however, been placed in operation. Older plants have been abandoned, temporarily shut down, placed on part time operating basis, or continue to operate at a low percentage of normal capacity. In the United States the Phelps Dodge Corporation at Douglas, Ariz., has completed the remodeling of the former Calumet & Arizona smelter. A new roaster and Cottrell plant chimney was completed this year. Though operations have been limited the new equipment has been found to justify all expectations. The reverberatory plant addition consists of two furnaces 26 by 107 ft. inside dimensions, with a high arch, and modern steel binding of excellent design. Natural gas fuel gives good results. One of these furnaces will treat 1000 tons of solid charge per day with a fuel consumption of approximately 3,000,000 B.t.u. per ton. The larger converters have not only yielded the expected lower costs, but have simplified operations in the converter department. When rock is subjected to a load it is deformed. Ordinarily this is observed in a mine as the displacement of one point with respect to another-the deflection of the roof, which may be observed as a convergence between roof and floor; or the extrusion of material from the rib, which may be observed as a decrease of the distance between the rib and the post of a timber set. The effect of excessive pressure may be a rockburst if the rock is strong, or it may be "squeezing" ground if the rock is "soft". Some desirable effects of high stress (high in relation to strength) are the caving of roof in a longwall mining operation, the caving of ore in block caving, and the decrease in mechanical energy required to break down the mineral seam in a retreating pillar-robbing operation. In any case, whether the observable effect of rock load is desirable or undesirable, it is a displacement, and depends on the following four factors:
