This chapter deals with the systems of laws by which governments regulate the exploration for and production of the minerals within their jurisdictions. It is a summary, restricted by necessary space limitations, of material assembled by the author for a publication of the United States Bureau of Mines, "Summary of Mining and Petroleum Laws of the World," (Information Circular 80 1 7, 196 1. ) The present study is organized in three parts, dealing with (1) the historical background of these legal systems, (2) laws of the United States, and (3) laws of other countries of the world. The reader's attention is invited to the acknowledgments at the end of the chapter, which inadequately express the appreciation due those who have assisted in the collection of this material. Part I. Historical Development of Major Western Systems of Land Tenancy with Respect to the Ownership and Control of Minerals The use of metals in primitive societies was largely confined to the manufacture of weapons for self-preservation. The ruler's control over copper, then bronze, then iron, was essential to maintenance of his own ascendancy at home and his group's position against neighbors who had access to similar metals. Ancient societies were thus characterized by the ruling group's ownership of minerals and metals. The Egyptian civilization, which emerged in the fourth millenium B.C. upon the agricultural subjugation of the lower valley of the Nile, was responsible for extensive development of the upper valley as a source of mineral wealth. The production of gold during the height of that civilization has been estimated at $30,000,000 per year, thus equaling the early placers of California and Australia. The mines of Egypt were the property of the Pharaohs and were controlled at their direction. Greek mining developed a different scheme of land tenancy which more closely resembled modem concepts. A plate of an 18 pct Ni (250 grade) maraging steel was homogenized, cold rolled, and re crystallized to produce a fine grained, homogeneous structure. The strength properties were then measured as a function of cold rollinq prior to aging. Material in the solution heat treated condition exhibited substantial strengthening from cold rolling. The strength increase and the rate of strengthening were proportional to the amount of cold work. This benefit, of up to 50 ksi, was retained during aging for 3 hr at 900°F. The structures produced by cold rolling and aging have been systematically investigated by transmission electron microscopy. The dislocation debris produced by cold work influences the morphology and distribution of precipitate particles as well as the rate of precipitation. An essential feature of the high nickel maraging steels is a martensitic transformation from y to a with the resultant production of a supersaturated bcc solid solution. This solution decomposes to form precipitates during a subsequent aging treatment.' The martensitic transformation in low carbon Fe-Ni alloys and the mechanical properties of these alloys have been studied extensively.2"4 The carbon content of maraging steel is kept very low to avoid the embrittling Fe3C phase and to minimize the acicular, or twinned martensite common to high carbon steels. Maraging steels are usually strengthened only by heat treatment, but cold working is also quite effective in this respect as was shown by Decker, Eash, and Goldman,' Kula and Hickey,5 and the present work. There is, however, some disagreement between the present results and those of Kula and Hickey. Because of their unusual combination of strength and toughness, the maraging steels are suitable for applications where reliability at high stress levels is required. The strength level is achieved through a combination of solid solution hardening,' substructure hardening,3 and precipitation hardening,6 of which the last is the most important. The toughness of these steels has been reported to be a result of the absence of brittle grain boundary precipitates,7 and the fact that the matrix is a massive martensite rather than a twinned martensite.' One of the problems in the manufacture and use of maraging steel has been its tendency to develop laminations in sheets parallel to the rolling plane.9,10 The present investigation was intended to determine whether or not an improvement in the microstructure of this steel by thermomechani-cal processing would improve mechanical properties. I) EXPERIMENTAL PROCEDURES A plate ($ in. thick) of an 18 pct Ni-250 grade maraging steel* was obtained and examined metallo- "Analysis, wt pct: 18.1 Ni, 8.6 Co, 5.3 Mo, 0.4 Ti, 0.07 Mn, 0.05 Cr, 0.05 Si, 0.002B. 0.1 Cu. 0.05 Al. 0.002 Zr, 0.016 C, balance Fe. graphically. It was found to contain laminations as described by previous investigators. This plate was then annealed at 2100°F for 24 hr to promote homogeneity. Pilot studies on small coupons had shown that this was the minimum temperature required to accomplish homogenization in 24 hr. Since this treatment caused excessive grain growth, the steel was subsequently cold rolled and recrystallized. Cold rolling was accomplished at about 5 pct per pass to a total reduction of 66 pct. The standard solution annealing treatment (1 hr at 1500°F) was adequate to cause recrystallization of the cold worked steel. The recrystallized steel was then cold rolled and ground by various amounts to produce specimens with uniform thickness and selected amounts of cold rolling. All tensile specimens with less than 90 pct cold reduction were ground to a thickness of 0.050 in. Specimens with 90 pct cold reduction were 0.025 in. thick. All

PROBABLY everyone is well aware that from April 1 to September 11, 1922, anthracite production was completely suspended; during those 163 days not one ton of coal was produced in the anthracite region. The production loss was about 30 million tons, and although production is now at its peak, there is no possible way by. which, within any short space of time, that deficiency can be made up. During that time the miners sacrificed in wages something over 100 million dollars. The anthracite companies paid out in cash, keeping their mines in condition to operate when mining should be resumed, something like 30 million dollars without taking in one cent of revenue. The tonnage of domestic sizes included in that lost output was about 21 million tons. The anthracite operators figured that between September 11, 1922, and March 31, 1923, they would possibly be able to produce about 60 per cent. of the tonnage that was mined the preceding year, that is, from April 1, 1921, to March 31, 1922. The problem then arose as to how that tonnage could be distributed equitably throughout the United States and Canada. We had in our records in Phila-delphia the distribution by communities, about 20,000 of them, to which anthracite had been shipped during the last five years, so that we were well posted as to what each community should be entitled to receive. We allotted to each of those 20,000 communities 60 per cent. of the tonnage that it had received during the preceding coal year, and we have endeavored to see that whatever tonnage we have been able to produce should be equitably distributed on that basis. It was a matter simply of voluntary cooperation by the anthra-cite operators who placed the distribution of their tonnage practically in the hands of the Pennsylvania Fuel Commission; the anthracite companies have almost without exception acceded to every request that we have made of them. When communities were reported entirely out of coal, a telegram or letter to the directors obligated to that community has resulted in some anthracite being shipped there, so that we have thus far kept the distribution on a fairly equitable basis. Prior to the suspension of mining operations, pre-liminary negotiations were carried on for the renewal of the wage scale, the operators thinking that it could be adjusted satisfactorily, and that the same method of procedure would be followed as during the 20 years succeeding the strike of 1902. At every termination of the wage agreement since that date, until last year, an agreement had been reached early in the season that mining operations should be continued, with the under-standing that any new agreement should be retroactive to April 1. At the meeting of the committees of anthra-cite operators and miners, on March 21, 1922, the opera-tors were presented with an ultimatum by the miners to the effect that unless an agreement were reached within ten days, mining operations would cease. That was protested against by the committee of operators as being unfair, not only to the operators and the public but to the men themselves. In spite of this protest the suspension occurred and, as you know, continued until September 11.

WHEN the drilling of an oil well is completed a permanent opening from the reservoir to the surface must be provided. This is done by lining the hole with pipe, commonly known as casing. In the past, all but a small amount of casing has been run in the hole and joined by threads and couplings. Recently, however, in California, Texas, and Oklahoma, there has been a definite tendency 'to adopt -the welded joint for the following reasons: (1) Plain end casing for welding may be bought for 15 per cent less than thread-and-coupled casing; some of this is offset by the cost of welding the pipe in the hole but a respectable net profit remains.

INTRODUCTION To provide a background for discussing long-range financial and operational planning in the mining industry, we would like to begin by describing the role of planning in Codelco. Having taken part in Codelco's planning process since its inception in 1976, we believe that useful conclusions may be drawn for the experience we shall relate. Although Codelco is a state-owned copper producer with an important role in the Chilean economy, and is consequently very much at the core of national economic planning, the following discussion is not related to government planning but to planning in an operationally and commercially autonomous business concern with all the characteristics of a private enterprise. The only way in which Codelco differs from private business is that its financial successes or failures have a more direct impact on the countryls ability to participate in international trade, to meet its international financial commitments and to achieve economic and social growth. Thus, what follows is a presentation of the conceptual features of the planning process at Codelco and a description of the current state of planning in the company. It is understood that certain conceptual components are basic to any formal strategic planning process, and that the components of Codelco's planning process are therefore generally applicable in similar companies. First, the mission and scope of operation of the company must be defined, and goals must be set to achieve leadership in the business activities in which it engages. Having set this framework, the company must constantly scrutinize those internal elements and conditions that are essential to fulfill its mission and achieve leadership. In Codelco this means considering the actions which can best serve to define future capacities, taking into account declining ore grades and determining optimal production levels; watching over the productivity and skills of its labor force, and; keeping abreast of technological developments in non-ferrous mining and processing. If the company is proficient in these three areas, it will be cost efficient and there- fore competitive. Codelco must also watch over the business environment in which it operates. The company sells concentrate, blister and fire-refined copper, wirebar, cathodes and wire rod and must study the behavior of the market to attune its product mix to the demand existing for these various commodities in the international market and the copper consuming industries in general. By examining the internal and external environment in which the company conducts its production and commercial operations, it is able to diagnose its strengths and weaknesses, to identify the hazards it must overcome to stay ahead in the copper trade, and to take full advantage of business opportunities as they arise. CHARACTERISTICS OF CODELCO-CHILE Although our subject is Codelco, readers should keep in mind that there are many other copper producing operations in Chile, all in the private sector, and many valuable deposits that may be exploited in the future. Codelco is the only public sector copper producer, although there is one other state enterprise that operates smelting and refining facilities principally to serve a large number of very small producers of copper concentrate. In the mid-19801s, Codelco is the largest copper mining company of the world and the largest producer and exporter of copper with yearly sales totalling close to US$ 1.8 billion in 1983. Moreover, it is a highly profitable copper company at a time when the world copper industry as a whole has reported losses for several years. Codelco-Chile is a fairly new organization. The history of the four mining operations it manages is much longer: El Teniente was opened in 1912, Chuquicamata in 1915, Salavador in 1959 -- with installations of the old Potrerillos mine dating from 1927 -- and Andina in 1970. Mica is an orchid among minerals. It is formed in pegmatites, one of the most bizarre of igneous formations, and is exceeded by few other minerals in the perfection it may attain as to size, color, and cleavage. First used for window glazing, as an ornament and article of trade, it has become one of the most essential insulators of electricity, heat, and shock. Most internal combustion engines use mica condensers or capacitors and such machines of war as planes, tanks, and submarines are immobile without it. The original manuscript of this guide was written in April 1943 at the peak of war emergency. It was not used be- cause shortly thereafter a decision was made to buy on a one price basis eliminating differentials for both quality and size. This is now presented with the thought that from the standpoint of preparedness we can only consider an- other war imminent and every effort should he made to set up in usable form the experience gained during the Second World War. Colonial Mica Corp. was set up by Metals Reserve Co. as a wholly owned government agency to encourage production of domestic mica and to purchase it. It soon became the exclusive buying agency for such mica. The writer as Southern Manager called on all the private agencies buying mica to assist in formulating buying policies, methods, and prices.

It is apparent that repressuring of the oil measures is becoming increasingly important to the oil industry, and is a matter that warrants the best efforts of the petroleum engineer charged with applying this method of operation to a producing property. Considerable attention has been directed to repressuring in various California oil fields, such as Dominguez and Seal Beach, which have served to sell the more progressive operator on this idea and also to keep him sold. The projects that have received most attention are in comparatively young fields where the fluid levels are high, the wells, perhaps, still flowing, where the wet gas production is of considerable volume, and where there is vital need of immediate conservation of gas, which otherwise would be blown to the air. The new State of California Gas Law, which prohibits the waste of gas, has served to interest the oil industry in means of conserving the gas that is now being blown to the air because of lack of markets. This vitally affects the operator in the older, well-depleted oil fields of the state, because in many cases he has a limited market for gas, on account of the flush production from the more active oil fields. While the waste of gas is relatively small in these older fields, such as the Midway-Sunset area, it now attains considerable importance, since under the new State Gas Law it must be put to some bcneficial use. Repressuring in the older fields of California has not received the attention of the petroleum engineers that is warranted by the present situation. This paper was prepared with the view of presenting the salient features connected with repressuring in the well-depleted oil measures of the older fields, and to show what results have already been obtained in these fields by injecting the unmarketable gas into the sands, particularly in the Midway-Sunset field in the San Joaquin Valley of California. Other projects in the older fields of the state offer some supporting data in this connection, such as the Shields Canyon and the Brea Canyon fields. The careful work of Gross and Zimmerleyl has established the fact that the energy actually used in grinding is proportional to the new surface produced. This confirmation of Rittinger's law was made by crushing quartz in a frictionless drop-weight machine and determining the surface of the quartz by its rate of solution in hydrofluoric acid. The details of this procedure have been described adequately elsewhere and need not be repeated here. The resultant data furnish the only available basis for comparing accurately the efficiency of grinding machines. This method is so cumbersome experimentally that it has been little used. As an alternative all sorts of approximations have been proposed. The best of these is complete size analysis by sieving and elutria-tion. Such procedure is very lengthy and difficult to carry out accurately. Furthermore, any sizing method becomes very inaccurate for determining surface with very fine sizes where the ratio of surface to volume becomes very large. To avoid the lengthy and difficult technique of elutriation it has been proposed to estimate the size distribution below 200 mesh from various probability formulas. Such a procedure is at best an engineering approximation; at worst it is a mere guess. Some time ago Dr. V. H. Gottschalk2 found that the coercive forces of magnetite powders were directly proportional to the surface area, regardless of size distribution. It was at once apparent that this furnished a method for determining grinding efficiency quickly and accurately. The only requirement was a single determination of the relation between the work input of the Gross-Zimmerley drop-weight machine and the coercive force of the resultant crushed magnetite. I HAVE been asked by the Chairman of the Engineering Education Committee to outline what the engineering colleges would like the mining companies to do with the young engineer just, out of college. It has been suggested that, because my own personal experience has been almost entirely within the coal industry, I handle this subject from that view- point. Many thoughtful engineering educators are today wondering what effect the present employment policies of many industrial companies are going to have on the young man just starting out in his profession. Since before the World War large industrial concerns, such as those in the electrical and mechanical industries, have gone to the colleges to interview 'likely graduates until today there has developed in most of our engineering colleges, especially in the eastern part of the country, what appears to be a lively competition on the part of these companies in bidding for the young graduate engineer. The employers of mining engineers, with one or two exceptions, have not yet begun to enter this competition. It remains to be seen how serious this situation will become, how it will affect the training of other engineers, and what effect, if any, it will have on the mind of the young man about to enter college who may be inclined to take up mining engineering, but who gains the impression from this well advertised employment service just mentioned that there is no opportunity for him in the mineral industry as com- pared with the opportunities offered in say civil, mechanical, and electrical engineering.

I. INTRODUCTION. DURING the last twenty years or so the chemical investigation of rocks has made great advances, and it is now generally recognized that a knowledge of the chemical composition is as essential as that of the texture or mineral composition-if not more so-for the proper classification of rocks and study of their origin and relationships. Rock-analyses have vastly increased in numbers and, what is of greater importance, in quality. New and improved methods permit of greater accuracy than was possible in the early days, and the list of chemical constituents frequently determined has risen from the seven or eight of the greater part of the nineteenth century to twenty or more. Indeed, rock-analyses with determinations of so many constituents are now commonly made by the chemists of the United States and Australia, while in Germany, Great Britain, France, and Italy the rarer constituents are determined more frequently than formerly. As a consequence of this modern, accurate work, it has been discovered that some elements which were formerly supposed to be rare are of wide-spread occurrence and are often present in considerable amount. The fact is further being developed that the elements tend to show certain relations of occurrence or abundance in connection with each other. This is a fact which is applicable to the rarer elements, and which also finds a broad geological and petrological expression in the recognition of petrographic provinces. We are beginning to obtain some definite, though as yet rudimentary, knowledge of the distribution of the elements among igneous rocks. THE annual fall meeting of the Institute of Metals and the Iron and Steel divisions, in conjunction with the American .Society for Steel Treating and the Metal Congress and Show, at Boston was from many standpoints the most successful we have had to date. While many faces were missing from the various gatherings, the Institute registration reached the high mark of 324 members and guests. Cooperating with the Steel Treaters were also the American Society of Mechanical Engineers, the Society of Automotive Engineers and the American Welding Society. ,The meeting was, as usual, a three-ring circus with technical sessions 'galore, plant .trips, visits to the Exposition, social events such as lunch- eons and dinners as well as entertainment for the ladies present.

The pumping operations at the Chief mine have been unique in the respect that for many years the entire flow of water into the mine has been disposed of by pumping into natural underground " caverns" or "sinks." Volumes up to 4000 gpm have been pumped into these caverns with no apparent tendency for the caverns to fill with water, and it has never been proven that any of the water returns to the mine workings. Major pumping operations have been carried on during two periods, the first from 1918 to 1927, and the second from 1942 to the present time.

MINING methods and customs in many districts of England are to this day strangely bound about by the records and traditions of the past. In some mining fields this is more apparent than in others, yet it is everywhere in evidence, for Cornwall with her mines under the sea, Wales with her famous quartzites, and Derbyshire with her remarkable cavern deposits, are all tinctured with quaint customs that have come out of the almost forgotten past. Here, modernism has never replaced tradition, and many of the laws are woven of the woof and warp of ancient custom. Indeed, these things exist because they have come to be part and parcel of the civil laws. And these laws are observed with meticulous care and accorded all the reverence due their venerable age. All activities pertaining to the mining of metals are hedged around by curious and ofttimes clumsy laws, each minute and trivial detail being covered by the civil code, and each petty law enforced by an ofttimes pompous official.

ATER the preliminary registration at which approximately 380 members and guests were registered, the 138th meeting of the Institute was opened in the Concert Room of the Palace Hotel. E. A. Hersam, chairman of the San Francisco Section, voiced a brief welcome and introduced F. W. Bradley, president of the Institute, who presided over the remainder of the morning session. After expressing the welcome of the Institute to the members and guests, he read a telegram from Secretary H. Foster Bain, extending the best wishes of the eastern staff and members for a successful meeting. He next introduced Theodore J. Hoover, dean of the School of Engineering, Stanford University, who read an address by the Secretary of the Interior, Ray Lyman Wilbur, briefly outlining California's part in the mining industry and giving the welcome of California to this meeting of the Institute.

As is well known, many questions affecting the properties and uses of a metal cannot be answered without careful consideration of the state of purity realized in the various operations of preparation, refining, or special treatment that have brought the product to its final state. The occurrence of an impurity in minute quantity offers no guarantee that its effect will be inconsiderable because dissolved substances often modify the properties of a metal quite out of proportion to their concentration. In such cases the determination of solid solubility must be accepted as a problem of considerable difficulty, requiring the use of especially purified materials and methods not ordinarily used in the metallurgical laboratory. This aspect of the equilibrium between metals and their oxides is especially important and a search for fundamental data reveals little except .conflicting opinion even concerning the systems of common occurrence and interest. Rhines and Mathewson1 in 1934 studied the solubility of oxygen in solid copper by annealing to equilibrium in air and gave reasons for the failure of other methods, notably the ordinary procedure of heat-treatment followed by microscopic examination, to yield reliable results. In this paper, a similar study has been made of the solubility of oxygen in cobalt. The simple theory of this method is outlined below.

The heat treatment of the bronze composed of 88 per cent. copper, 10 per cent. tin, and 2 per cent. zinc, has been investigated by H. S. and J. G. S. Primrose,' and also by the U. S. Bureau of Standards.2 The results obtained by H. S. and J. G. S. Primrose on dry-sand castings subjected to reheating followed by air cooling, or by quenching in water, are shown in Figs. 1 and 2. The values for tensile strength have been converted from tons per square inch to pounds per square inch. Figs. 3 and 4, have been plotted from values obtained by the Bureau of Standards on material of the same composition and treatment. Both investigations show that the ductility of the cast bronze is improved by heating to 700' C. and cooling in air, the strength not being impaired by this treatment. They are not in agreement, howevcr, as to the effect of quenching, Messrs. Primrose reporting a decrease, and the Bureau of Standards an increase, in both strength and ductility when the cast bronze is heated to 600' or 700' C. and quenched. SINCE the publication of the paper of Mr. Scholz, The Effect of Humidity on Mine-Explosions,' I have undertaken a study of the meager available data of barometric and temperature conditions it times of mine-explosions, and have arranged these data in a manner which may be of interest to other students of mine-explosions. This study covers the period from 1898 to 1909, during which an ever-increasing percentage of collieries has been ventilated by fans giving air-currents of high efficiency. Previous to 1898 this percentage was smaller than at any time since. The vari¬ous States have become, from time to time, more exacting in their demands upon poorly-ventilated mines. This general im¬provement in ventilation throughout the Appalachian field has undoubtedly brought about a condition which is annually the cause; .or a very important attendant, of the high percentage of fatalities in mine-explosions, through the daily passage of from hundreds to thousands of gallons of water, invisibly suspended in the air, carried out of the mines by the ventilating-currents during the existence of certain temperature- and humidity-conditions. There is a wide-spread opinion that these conditions exist from November 1 to March 31; but it is more likely that they have a much wider range, which varies from year to year. Certain years show an increase or decrease of rain-fall from the mean ; the daily temperature may fall far below or rise far above the mean established by a record of a period of years; and the daily humidity varies likewise.
