IN March 1949 the Calaveras Cement Co. was sued by five landowners whose properties are located in the vicinity of the plant. These landowners—all of them cattle ranchers—sued for dust damages of $120,338 and for an injunction preventing the company from casting dust upon their properties in injurious quantities. The issue was split, the jury deciding the amount of damages and the court handling the injunction features. The action came to trial before a jury in April of that year and resulted in damages being awarded in the amount of $7,508. A month later the court issued its injunction requiring recovery of stack dust to an 87 pct minimum. The Calaveras plant, shown in Fig. 1, is located three miles from San Andreas in the heart of the Mother Lode country, about 45 miles east of Stockton, Calif. Since it is in a small town, the company's responsibilities to its employees and to the community are different from those of plants located in large centers of population. Construction of the plant was begun in 1925, and production was started the following year. Standard gray Portland cement as well as several specialty cements are produced. Production facilities have been continually enlarged so that the present capacity is more than double what it was 25 years, ago. The most important item in the company's expansion program was the purchase in 1945 of an 11 ft 3 in. x 360 ft Allis-Chalmers kiln which had been declared surplus by the Defense Plant Corp. The company is now able to produce about 2,500,000 bbl of cement a year, and employment at the plant is approximately 300. The production of cement has always involved a dust problem, solution of which has been attempted in a number of different ways. By far the most efficient method of catching dust discharge is electric precipitation. Soon after the company went into production in the 1920's, the landowners near the plant began complaining about dust discharge. The company settled the matter by paying them a total of $27,000 for dust damages incurred during the period from 1929 to 1938. In the latter year the two-unit Cot-trell Electric Precipitator shown in Fig. 2 was installed and collected over 85 pct of the dust resulting from operation of the two 11 ft 3 in. x 10 ft x 240 in. kilns. From 1938 until 1946 the landowners registered no objection and were apparently satisfied with that dust recovery. In 1946, however, the substantially higher production resulting from operation of the new kiln immediately overtaxed the facilities of the existing two-unit precipitator. In a short time claims for dust damages were again received from the landowners. The company informed them that because of postwar shortages it would take several years to install a new precipitator. The company stated that it intended to purchase an additional precipitator and offered in the meanwhile to pay the landowners a fair amount to cover their damages. This offer was rejected and the landowners filed suit in the Superior Court of Calaveras County asking for total damages of $120,-338 and for the injunction outlined above. Case for the Ranchers The attorneys for the plaintiffs produced three different types of witnesses: first, the landowners themselves and members of their families; second, other cattle raisers who were sympathetic to the plaintiffs; and third, several types of technical experts: veterinarians, soil chemists, and an aerial photographer. The testimony of these witnesses was designed to establish that the flue dust from the plant had not only damaged the land and the forage, but had also caused fluorine poisoning to their animals. By a combination of these causes, the plaintiffs attempted to prove substantial loss of profits.

FREE competition, long the controlling ideal of domestic trade within the United States, has had the fundamental geographical advantage of functioning in the world's largest area of unrestricted commerce. Goods moved back and forth across state lines, unimpeded by customs, and industrial operations have developed rapidly to meet the expanding needs of a pioneer country richly endowed with natural resources. Fifty years ago, antitrust laws were adopted to protect the competitive private enterprise principle. It became illegal for one person to combine with another to restrain trade or commerce among the several states or with foreign nations. The original legislative measures defining this philosophy were the Sherman Act of 1890 and the Clay- ton Act passed in 1914. The development of Europe and other parts of the world was influenced by different conditions which led to a different theory of trade. Here were many small nations, with limited natural resources and a thin market, and they attempted to protect their national economy by tariff walls. International business arrangements for the purpose of diminishing the ups and downs of the more competitive system --crux of the modern cartel operations-seemed a logical device to stabilize production and guard the interests of both workers and consumers. European governments as well as European industrial interests became convinced that if com- petition could be held in bounds the danger of business depressions and un- employment could be reduced.

AT a joint meeting of the Tulsa Geological Society and the Mid-Continent Section of the A; I. M. E., held at Tulsa on March 21, the history of unit development in the Kettle- man Hills field was discussed. Robert C. Patterson? Super- visor for the U. S. Geological Survey at Taft, Calif., was the speaker. An abstract of some of his remarks follows: On July 1, 1923, curtailment agreement for two years was made between the operators of North Dome Kettleman and the U. S. Department of the Interior. In this it was agreed to consider a plan of unit development, or other cooperate method of developing the structure. As a result, Kettleman North Dome Association was incorporated in December, 1930, as a non-profit cooperative corporation under the laws of California. Approved in January, 1931, by California Oil and Gas Supervisor and by Secretary of Interior. On Feb. 10, 1931, it became an active organization through election of executive officers and eleven- directors. General manager chosen. Association started to function April 1, 1931. Assumed control of 10,800 acres of proved and semi-proved land, as shown in Table 1.

PHOSPHATE ROCK is a low- priced commodity. This fact has influenced the choice of mining and beneficiating methods to a greater degree, perhaps, than in most other low-grade mining operations. The fact that many yards of everburden and matrix must be stripped and mined per ton of salable "rock" produced and sold has necessitated he development of relatively simple btneficiating plants having high capacity and low capital and operating costs. The law of diminishing returns must always be reckoned with in phosphate mining and washing, and often recovery must be sacrificed in favor of costs in order to achieve the highest over-all economic efficiency. The phosphate-bearing formation, known as "matrix," is composed of (1) phosphate pebbles, which are somewhat rounded in shape and which vary in size from 1-in, to micron sizes, (2) rounded quartz grains usually smaller than 10 mesh, and (3) clay, of varying "stiffness," which is the binder of the matrix. The phosphate pebbles vary in hardness. Their color, which varies from white to black, is not a reliable indicator of the Bone Phosphate of Lime (B.P.L.) content of the

Under a cooperative agreement between United States Bureau of Mines and the Truax-Traer Coal Company, some operating-scale experiments have been made with the cyclone thickener in the preparation plant of the Shamrock No. 1 mine at Kayford, West Virginia. These tests were made with a 14-in. cyclone of the type developed by the Dutch State Mines in Limburg. It was applied experimentally to the thickening of solids in washery water to obtain performance data to show the range of sizes that may be recovered and other operating characteristics that would indicate the field of usefulness of this device in coal preparation practice. This is a progress report only. It covers results obtained in a series of 17 tests of the operation of what has been considered a unit of commercial size operating on suspensions of fine coal mixed with a relatively small amount of freeimpurities. The underflow material, after further dewatering in centrifuges, is a marketable grade of coal.

AMERICANS like engines, but more than anything they like powerful engines, and next to that they want them quiet, silent, smooth; perhaps a slight purr might be permitted, but they must not knock. To provide a gasoline to fit all these requirements, American petroleum technologists have experimented for years, and mounting octane numbers of the gasolines the refiners have produced both before and during the war bear witness to their success. The question on everyone's mind now is what may we expect in the way of engine fuel in the postwar period? The gasoline drouth during the war rationing, the inconvenience of doing without a car were major annoyances to all motorists, but they put up with them pretty cheerfully for the most part. However, now that the war is over, and the jalopies are all out and the better cars have been taken off the jacks and brought out on the road, the call is for "Some of that good gas-fill her up, if you please."

AN accelerated trend toward mechanical mining was noted in 1940, calling for improvements in and better performance of transportation, hoisting, and ventilating equipment. One of the most interesting experi¬ments in transportation is the track shuttle-car operation first put into use by the Princeton Mining Co. in Indiana and later at the Montour 4 mine of the Pittsburgh Coal Co. This system is based on the use of 10-ton drop-bottom mine cars operating on track and han¬dled by an ordinary gathering loco¬motive. These mine cars are loaded and taken in trips of two to a central dumping station which serves four or less loading machines. The dumping station consists of two standard chain-and-flight room conveyors, approximately 50 ft. long placed side by side approximately 4 ft. below the track from which the drop-bottom cars are dumped. These conveyors are operated at low speed and discharge into two similar elevating conveyors which operate at a higher speed and convey the coal to a trip of standard mine cars. A dumping station is usually located so that approximately 500,000 tons of coal may be handled through it before a move is required. This plan appears to have considerable possibilities for the mine equipped with small mine cars and standard locomotives since the advantages of large mine cars can be secured at a fraction of the cost required to install such cars throughout the mine. It appears logical that the future will see a much wider use of this modification in transportation.

The principle of sliding or graduation in royalties is accomplished either by the block, period, cumulative, or class method. The block method calls for a very low royalty rate on all oil produced up to a certain amount. This amount would normally be that which is believed to suffice to repay the cost of the well. A higher rate would be charged after the well is making a profit. This method, common in many industries, is peculiarly inadaptable to any industry such as this where the productivity per day of the units gradually and inevitably decreases. This, for reasons given later, is because it forces an early abandonment of the well and so offends against conservation. In the period method, the royalty rate is changed by some definite amount when the well produces less than a specified quantity per day or other given unit of time. While simple to explain, it operates badly because a great deal is made to depend upon a small reduction in production, whereas the reduction as a matter of fact declines rather erratically owing to the exigency of lease management, connecting of tankage, and vagaries of the gaugers. These disadvantages are obviated by the cumulative method. In this method, all the production less than a certain amount per week has one rate of royalty, or none at all, and the oil produced in excess of that amount pays an additional rate of royalty. In the long run the calculation is probably no greater than with the period method, for simple tables will be published and printed in the oil papers that can be cut out, enabling quick readings to be made. Even without the table the calculation is easy with the few royalty rates, two or three, which would be used. In this method, the amount paid in royalty declines gradually, rather than suddenly as in the period method. The following reasons might be advanced for the adoption oi cumulative royalties: 1. To distribute the burden in accordance with the capacity to pay. This principle is a unique one in business, although familiar in taxation. This is because it does not distribute reward in proportion to efficiency.

The desirability of employing the centigrade scale for the measurement of temperatures is becoming more and more recognized in this country, particularly in view of the fact that this scale is used almost exclusively in technical papers and publications—exclusively in those published in French or German. There are, however, a large number of factories and laboratories which still employ the Fahrenheit scale. It therefore frequently becomes necessary to convert one into the other and the accompanying chart (Fig. I) has been found very convenient for this purpose. It has been stated, by Sir James M. Barrie, that "the man of science appears to be the only man who has something to say, just now-and the only man who does not know how to say it". The friendly jibe of the novelist contains enough exaggeration to make it humorous to the followers of Huxley and Spencer; but could any litterateur poke similar fun at the exponents of the avowedly utilitarian branches of science-the men of technology-without suggesting an unpleasant truth? Indeed the engineer does bungle language deplorably. He makes a fetish of efficiency, yet he shows no regard for the effective use of one of his most important tools-the pen; he believes devoutly in accuracy, yet he employs an instrument of precision as carelessly as a small boy handles a gun. This inconsistency may be due to causes such as were indicated by the Academic Senate when it undertook to explain the defective writing of the; students in this university.* The Senate suggested that the student is "constantly subjected by his environment to the unedifying influence of myriad examples of poor English", and that he is also affected by "a certain public prejudice against correctness of expression ". With these statements most of us will agree. Our local newspapers, for instance, tend to spoil the student's taste for good English; later in life, as an engineer, his daily contact with illiterate men inclines him to careless speech and slovenly writing. TO certain people the name of Northern Rhodesia brings only a vague recollection of a distant country somewhere in Africa; to others, it means a big game territory and the opportunity for excellent shooting; to some, a land of sunshine and peace; but to mining men the name signifies the land where the latest discoveries of copper ore are astonishing the mining world and bid fair, in a few years, to make Northern Rhodesia one of the largest copper- producing countries. There is a fascination about this part of the globe that is somewhat similar to southern California, and at the same time there is that feeling of mystery peculiar to a tropical climate. Perhaps it is the isolation, the fear of wild animals, or the influence of an undefinable something which cannot be expressed.

IN the parlance of Hollywood, it was a super-colossal meeting. In the more restrained language of engineers, the Institute's 75th Anniversary Celebration attracted the largest crowd ever; was the longest Annual Meeting ever held, occupying a full week; had more important papers, more important people, more of an international flavor, and more glamour than ever before. And in the minds of those who came to the big city from the wide open spaces, one other record should be mentioned: for those not on an expense account, it was the most expensive affair ever staged by the Institute! To state the attendance down to the last digit for a meeting such as this is impossible. The total names registered on cards, plus those who attended the Annual Banquet but were not otherwise registered, came to 3149. But a few were registered twice, and probably a still larger few did not register at all, but just dropped in for a session or two in which they were interested. It would appear that 3200 would be about as close an estimate of attendance as could be made, and that is some 300 more than came to the biggest Annual Meeting of the past-in 1944. A considerable number of members brought their wives, but most were delegates at large.

Not infrequently, in the case of the failure of a metal structure, such as a bridge, tank, airplane, gun carriage, etc., a doubt arises whether the failure was due, among other causes, to the effect of an overburden or of an explosive maliciously or accidentally exploded in contact with it. As few means of discriminating between the effects of these causes have been known and these means were of a rough qualitative character, it was surprising to find in the record of an inquiry into the failure of a structure, the statement that, by observations on the Neumann bands in the structure, it was possible to determine the speed of breakage in the metal and to distinguish between a fracture caused by an explosion and one caused by an ordinary mechanical strain. Such a criterion, if well proved, was of value to the explosives experts of the Bureau of Minea, the Ordnance Department of the United States Army and the Bureau of Ordnance of the United States Navy, but search showed no record of it in the literature nor did any of the metallurgists and metallographers consulted know of any data on which such a criterion could be based having been assembled and critically studied. However, it was universally held that there was promise in the idea and that there exkted unique facilities at the Bureau of Mines Experiment Station at Pittsburgh for the preparation, under definitely known conditions, of material for study by metallographers, and that material of value might also be obtained from the proving grounds of the Army and Navy. Therefore, with the approval of the Director of the Bureau of Minea and the Chiefs of Ordnance of the War and Navy Departments, the Chairman of the Division of Engineering of the National Research Council, on April 12, 1919, appointed a Committee on the Investigation of Neumann Bands, which has since been engaged in this study and which, after some slight change in its personnel, consists now of the following: Dr. William Campbell, Advisory Metallurgist, Bureau of Ordnance, Navy Department. This paper, descriptive of a single mine, is presented in the belief that it may furnish useful suggestions to mine-managers encountering similar problems; and it includes the details which will enable them to estimate the value of the methods employed—especially where these depart from common practice. Tt should be added, however, that this mine is not typical of the San Juan district, but differs markedly from neighboring mines in physical conditions and metallurgical requirements. The Liberty Bell mine is situated in San Miguel county, Colo., on the west front of the San Juan mountains, 2 miles north of Telluride. The vein was discovered in 1876 by Wm. L. Cornett, who, with subsequeilt locators, took up claims along the apex. A few hundred feet of development-work was accomplished, and a few? tons of ore were smelted or milled; but profitable working proved impossible under existing

THE Alaska Juneau mine has been developed through an adit driven at the elevation of the top of the mill and all mining is done above this main haulage level. As a result of wholesa1e"mining operations about 11,000 tons rock containing one dollar' per ton in gold is, hauled to the. concentrator during every 24 hr. Due to the method of mining, whereby a system of oreways delivers-the.ore direct from the stope to the bottom level of the mine, no tramming of ore is done on any of the upper levels. However, ;in doing exploratory drifting and crosscutting on the upper levels, the broken material is trammed by hand in 1-ton 18-in. gage cars to a nearby raise connecting with one of the several oreways. This constitutes the only tramming operation except that on the main level.

ALTHOUGH the Andean mountain belt, which contains almost all the metal deposits of the other South American nations, does not enter Brazil, this country is rich in mineral resources, for in area it accounts for half the continent and geologically it contains almost all of the Brazilian Shield. This great mass of ancient rocks has been relatively stable for a long time and forms a great area of plateaus and highlands interrupted only by the syncline which carries the Amazon River across it to the sea. Lowland Brazil - the great flood plains of the Amazon. Tocantins, Paraguay, and Parana Rivers-is of no interest to the miner, and in fact supports but a small proportion of the country's population. The highland area is divided into unequal parts by the Amazon River; the north half is underlain by the north lobe of the Brazilian Shield which extends into Venezuela as far as the Orinoco, and into the Guianas, and is known as the Guiana Highlands. Mineralization appears to have been weak in the Brazilian portion of these hills. In fact most of the ore deposits are to be found in the States of Minas Gerais and Bahia, although the neighboring states of Sao Paulo, Pernambuco, and Piauhy can also boast of some deposits. Goias and Matto Grosso are as yet incompletely prospected but are considered to contain reserves for the future.

FOR many years the cost of making pig iron and steel in the Birmingham district has been about the lowest in the United States. The close proximity of the important raw materials such as coal, iron ore, limestone, and the large available scrap supply made it possible to assemble all of the important ingredients necessary for steel- making with only nominal costs for transportation. Both iron ore and coal were being mined in this district at one time for about $1 per ton from underground operations. At that time mining wages were low everywhere and the labor rate in the South was considerably below that of other mining districts. This situation persisted until the emergence of labor unions as an economic and political force, emigation of southern labor to northern plants, and continued growth of industry in the South in the years following the depression of 1932. Since that time union organizing of miners and steel workers throughout the nation has increased labor costs in mining and steelmaking. This influence has been felt particularly in underground mining operations since the proportion of labor cost to total cost is still high. The previous advantage in basic labor rate in the South has been almost entirely eliminated by the equalization of labor rates in basic industries by national unions. Since 1945 these influences have been especially noticeable in increasing the cost of mining coal and iron ore in the South. The northern steel districts are still being largely supplied with iron ore from the Minnesota open-pit mines and the cost of this ore has not increased nearly as much as the cost of ore obtained from underground mines in Birmingham. A similar situation exists in coal mining; the thinner seams in Alabama are not so amenable to mechanization as the northern mines and, as a result, the output per man-day in southern mines is only about three tons of coal as compared to five or six tons per man-day in the large captive mines of West Vir-
