A. I. Blank.*-—Mr. Kanter has spoken of failures from causes other than creep itself in metals that are subjected to creep stresses. Would it be possible for the author to enlarge on this very important matter of "cataclysmic types of failures? " J. J. Kanter.—Of course, it is always a delicate matter to discuss specific failures. I would prefer to keep the present discussion on fundamentals and principles. H. L. Burghof.*—Mr. Kanter, I should like to ask what you consider the responsibility of the designer in avoiding stress concentrations that would lead to these types of failures? J. J. Kanter.—lt was my feeling in looking over the papers of this symposium that they were significantly lacking in consideration of what happens to the metals when strained under conditions that lead to rupture. Often creep tests are run that produce only a fractional percentage of the deformation, in several thousand hours. That kind of information gives the designer no assurance whatever that cracks will not result in his structure at points where stress concentrations, and therefore deformation concentrations, exist. I think anyone in this day and age who presents a paper on creep should incorporate with those studies a thorough investigation of creep rupture if it is expected to make an impression upon the design engineer.

From L. K. Armstrong, Secretary of the Columbia Section of the Institute, we have received information as to the activities and plan of the Spokane Engineering and Technical Association, which was recently organized under the joint auspices of the local sections of the American Institute of Electrical Engineers, the American Society of Civil Engineers, and our own Institute. The first meeting was held on September 20, at which a program for the following year was adopted. The, meeting was then conducted by the Civil Engineers., the principal business being the reading of a report by Mr. Flinn, Secretary of the United Engineering Society. The second meeting was held on October 18, of which the Columbia, Section of our Institute took charge. According to the program adopted, meetings will be held regularly on the third Friday of each month, except June, July and August. It is understood that these meetings shall not interfere with nor abridge the independent activity of the participating societies. The proposed work of the Association is to be conducted by a large number of committees, whose attention will be devoted to such subjects as the following: Municipal, Highways, Resources, Manufacture and Industries, Legislative, Educational, National and State, Patents and Inventions, Americanization, Safety and Rehabilitation, Research, Emergency. When all of these committees shall have been filled, and their work begun, it is expected that the engineers of Spokane and vicinity may take a more active part in things affecting human welfare in that vicinity.

(Presented by invitation at a meeting of the Spokane Local Section of the institute, Feb. 17, 1912.) THE Pilares de Nacozari mine is located in Sonora, 75 miles south of Douglas, Ariz. The town of Douglas is on the International Boundary and is the place at which the ores from the Bisbee mines are smelted. The Moctezuma Copper Co. owns the mines at Nacozari, and the copper-concentrates shipped to the Copper Queen smelter, at Douglas, make a good smelting-mixture with the Bisbee ores. The Moctezuma Copper Co. and the Copper Queen smelter at Douglas, as well as the railroad from Douglas to Nacozari, are owned by the Phelps Dodge Co. The ore-deposit occurs in the form of a large ellipse with a major axis of approximately 2,000 ft. and a minor axis of about 600 ft., the major axis bearing about 90 W. of N. The whole of this ellipse is more or less mineralized; the surface being principally an iron gossan with some occasional copper-stains. Below the oxidized zone, which is not more than 50 ft. deep, the minerals are pyrite and chalcopyrite, with occasional seams of chalcocite, the latter being rare. There appears to be no well-marked zone of secondary enrichment, the oxidized gossan over the greater part of the deposit changing suddenly to what is apparently the original unaltered ore. The copper-values are concentrated around the perimeter of the ellipse, and it is principally around this perimeter that the mining is done. The ore mined averages a little more than 3 per cent. of copper, with a small amount of silver, less than an ounce per ton. Some ore of considerably higher grade than this has been shipped, however, but the above average is of the mill-run. The ore is wider near the two ends of the ellipse than along the sides, and is mined in some cases to a width exceeding 200 ft. In the Journal of the Iron and Steel Institute for the year 1878, in the account of the proceedings of the annual meeting in March of that year, when Mr. Bell read his paper On the Separation of Phosphorus from Pig-Iron, occurs the following statement, as part of the reported discussion of that paper: " Mr. Sidney Thomas stated that he had succeeded in effecting the almost complete removal of phosphorus in the Bessemer process. Experiments had been carried on at Blaenavon, with the co-operation of Mr. Martin, on quantities varying between 6 lbs. and 10 cwt., and some hundred analyses made by Mr. Gilchrist (who had the conduct of the experiments from the first) showing the removal of from 20 per cent. to 99.9 per cent. of phosphorus in the converter. He believed the practical difficulties in the way had been overcome, and that Cleveland pig might be made into good steel without any intermediate process. He hoped on a future occasion to lay full details before the Institute." I was present at that meeting, and I doubt if any one in the hall knew, either by sight or name, the young man who had dared to rise in that august body and claim that he had accomplished that after which the great metallurgists of Europe had been unsuccessfully striving ever since Mr. Bessemer's great discovery. THE detonation of a high-explosive charge having a metal-lined conical cavity (shaped charge) results in a fast-moving jet and a slow-moving slug.1-4 Clark and Bruckner reported the metallographic studies of a cast-iron slug. The present note describes the metallographic studies of a copper slug and discusses the principle of flow involved. The shaped charge consisted of a 5-cm diam cylinder of cast high explosive (60-40 RDX-TNT mixture) having a 45 deg and 0.16-cm thick copper cone. The copper (99.5 pct purity) had a grain size of 0.06 to 0.08 mm diam and a hardness of 65 to 75 Hv. These were fired into a deep container of water and the slugs were recovered undamaged. The longitudinal and transverse sections of the slug were polished, etched, and examined for mi-crostructural changes. Macroexamination revealed a radial grain flow inwards towards the center and a downward component of flow towards the base of the slug. Fig. 1 shows schematically the micro-structural changes observed on the longitudinal section of the slug. The region D near the apex and also along the outer surface of the slug was characterized by the presence of heavily deformed and twinned grains. THE experiments reported in this paper have been fruitful in disclosing the mechanism of the deformation of iron in compression. They have established the nature of "deformation bands," "etch bands," or "X-bands," that have been a recognized but little understood feature in the structure of cold-worked metals since the early days of metal-lography, and have shown the role of the bands in the development of preferred orientations by cold-working. The work has also shown the relation of the orientation of individual grains to the preferred orientation of the aggregate. Some of the methods previously used in the determination of the indices of slip planes and slip directions are shown to be untrustworthy in the presence of deformation bands. The conclusion is reached that many slip planes and slip directions must operate during each stage in the compression of a single crystal, and that theories failing to take account of this require revision. In conducting the experiments a method f compression has been used by which extreme reductions can easily be reached, even to the limit set by the metal's capacity to deform with-out fracture. The work is a portion of a research program on the plastic properties of iron and steel. It is being used as a foundation for studies of orienta-tions resulting from recrystallization and is being extended to other metals and other types of deformation.

IN a recent article,1 which described the softening effect of columbium in plain high-chromium steels, the authors stated that their investi-gations had shown columbium to be also a particularly valuable inhibitor of intergranular corrosion in steels of the 18 per cent chromium, 8 per cent nickel type. It is the purpose of the present paper to record some of the results obtained through the introduction of columbium to the austenitic chromium-nickel steels. The damaging effects of this type of corrosion have become so widely known as to restrict considerably the applications of the steels under consideration, and therefore there is little question of the importance of the goal to be attained. Numerous contributions concerning the susceptibility of the aus-tenitic chromium-nickel steels to intergranular corrosion have appeared during the past few years, and among others who have dealt construc-tively with the subject are such well-known authors as Strauss and Houdremont of Germany, Hatfield of England, and Bain in the United States. Different theories have been propounded as to the cause of intergranular corrosion, and various remedial measures have been proposed, the majority of which involve the use of addition agents. Titanium is the addition agent at present most generally employed, as suggested by Houdremont and modified as described by Bain, Aborn and Rutherford.2 Little has been published on the effects of holding these steels for long periods at the relatively lower temperatures in the presence of

INTRODUCTION Landowners in Texas for many years have freely granted, reserved and leased "oil, gas and other minerals" or interests therein. In recent years we have witnessed much litigation concerning what sub- stances should be included as "other minerals" within the phrase "oil, gas and other minerals," and this question has received the attention of numerous legal scholars. At the South Texas Uranium Seminar held in Corpus Christi, Texas, in September, 1978, Mr. William R. Dodson presented a paper dealing with this very subject and entitled "Uranium - Mineral or Surface? Who Owns It?" In his paper, Mr. Dodson reported on two recent Texas Supreme Court decisions, Acker v. a, 464 S.W.2d 348 (Tex. 1971) and Reed v. Wylie, 554 S.W.2d 169 (Tex. 1977). which held that the particular substance in question in each case is not a mineral within the phrase "oil, gas and other minerals" if substantial quantities of the substance lie so near the surface that production will entail the stripping away and substantial destruction of the surface. Since that time another chapter has been written in the Texas saga of "When is a Mineral not a Mineral?" and it is the intent of this paper to present an update of the Texas law. A review of the early Texas cases so ably covered by Mr. Dodson in his paper will not be repeated, except as is necessary to illustrate the evolution of the legal doc- trine which has been so aptly named "The Surface Destruction Test". BACKGROUND In order to appreciate the genesis of the problem, one must consider that oil and gas production commenced in Texas many years ago, Spindletop came in in 1901. As oil and gas became more valuable, land- owners with considerable frequency sold interest in the oil, gas and mineral estates in their lands, and reserved interest in the oil, gas and mineral estates in their lands when they disposed of their property. Due to the oil and gas background, and perhaps be- cause oil and gas was paramount in the minds of the parties, the traditional language employed in these grants and reservations was "oil, gas and other minerals" or variations thereof. There are literally hundreds of instruments employing this language constituting a link in the chains of title to thous- ands of acres of Texas land. In addition, there are thousands of acres of Texas land held by oil, gas and mineral leases, the primary terms of which have been perpetuated by production, containing similar language in their granting clauses. The severance of the mineral estate from the surface estate results in two separate and distinct estates, each having all of the incidents and attributes of an estate in land. with the surface estate being the serviant estate, and the mineral estate being the dominant estate and having certain easements in the surface estate to explore. produce and remove the minerals. Harris v. Currie. 176 S.W.2d 302, 305 (Tex. 1943). As observed by the court in the Harris case, this is because a grant or reservation of minerals would be wholly worthless if the grantee or reservor co~lld rwt enter upon the land in order to explore for and extract the minerals granted or reserved. Although the Texas law has recognized that an oil and gas lessee has the right to use so much of the surface as is reasonably necessary to produce the minerals. Warren Petroleum Corporation v. Monzingo, 304 S.W.2d 362, 363 (Tex. 1957), recent decisions of the Court have qualified this doctrine. In Getty Oil Company v. Jones. 470 S.W.2d 618 (Tex. 1971). Getty's pumpine, units were interfering with ones self-propelled sprinkler system utilized for irrigating the premises, and Jones sought to require Getty to install the-pumping units in cellars so that the sprinkler system could pass over them. In an effort to accommodate both the surface estate and the mineral estate, the court held (page 622) "...where there is an existing use by the surface owner which would otherwise be precluded or impaired, and where under the established practices in the industry there are alternatives available to the lessee whereby the minerals can be recovered, the rules of reasonable usage of the surface may require the adoption of an alternative by the lessee". Bearing in mind that the "reasonable use doctrine" grew up in the oil and gas industry involving sub- stances which can be produced by methods that do not destroy or deplete the surface estate, the question presented is whether the Texas courts will extend this doctrine to situations where claimants of "other minerals" seek to produce shallow deposits of iron ore, coal, lignite and uranium by surface mining methods which do destroy or deplete the surface estate? The surface destruction test has answered this question in the negative, at least as to iron. coal and lignite. However, the multitude of mineral estates in Texas which have been created by a grant. reservation or lease of "oil, gas and other minerals" will, doubtlessly, continue to fuel the fires of litigation. THE quantitative study of grain shape in three dimensions has been a difficult one from the practical standpoint. Experiments on grain shape have usually been based on indirect observations of two-dimensional metallographic samples or on grains separated by intergranular corrosion or fracture. The latter method was used in particular by Deschl in 1919 in observing the shapes of ß-brass grains which had been separated with mercury. The similarity in detail of shape and packing that exists between bubbles in a soap froth and metal grains was noted by Desch who remarks that: "Surface tension has an. important share in determining the form of the crystal grains in a solidifying metal and such grains have a tendency to assume the shape of foam cells." More recently the relation between grain shape and grain growth has been studied by Harker and Parker.' The importance of surface tension forces in determining microstructure has been discussed by Smith," and an analysis of the topologi-cal rules that apply to such structures has been made by the same author.' Biologists have made valuable contributions to the general problem of shape and form in an assembly of space-filling cells subject to surface tension forces. Particular mention must be made of the extensive researches of Lewis5,8 on botanical and anatomical tissues, and Matzke and Nestler,7,8 who have made painstaking studies of bubble shapes in different kinds of foam. The present paper introduces a new method of studying individual grains in particular alloys—a method which may well find use in other metallurgical researches, and which seems also to be applicable in biological problems. Metal Grains in Three Dimensions The individual grains in a piece of metal or the bubbles in a soap froth must satisfy two conditions —they must be in juxtaposition so as to fill space and their interfaces must conform to the laws of surface tension. If a further restriction is imposed, namely, that only one type of polyhedron be used, then the sole possibility is an assembly of "minimal" tetrakaidecahedra," each polyhedron having eight doubly-curved hexagonal faces and six plane quadrilateral faces, the angles between adjacent faces being 120". Such cells could be stacked on a body-centered cubic lattice and would be quite stable. For many years it was believed that soap bubbles actually possessed the shape of this ideal body, and the hypothesis was the starting point for several investigations on the shapes of soap bubbles, biological cells, and metal grains. These investigations have shown, what might have been obvious in the beginning, that if the condition of symmetry is relaxed the tetrakaidecahedron is almost never found. If we retain only the rule that all contacts should be in local surface tension equilibrium and that the assembly should fill space, metal grains may then take a nearly infinite variety of shapes and no single one may be regarded as an archetype. These two conditions, which are fully discussed in one of the previously mentioned papers,' lead us to think of a typical grain in an annealed metal as having the following characteristics: 1—A grain may have any number of faces, but usually between nine and eighteen. The faces (each of which is, of course, shared by two grains in the assembly) may have any number of edges, but usually between four and six. PLAGER gold is perhaps the most difficult of the common mineral deposits to evaluate. Not only are the erratic pay streaks a source of never-ending uncertainty, but the spotty distribution of the gold in iso¬lated nuggets is a perpetual source of error and disappointment to the sampler. Experienced engineers have long realized this difficulty and have been wary in predicting assay values except in the most general terms, and then only after extensive and usually expensive sampling. During the past year I have had the opportunity of checking a number of gold placers, and from the results obtained I believe that the microscope may be employed to advantage in placer sampling.

THE preliminary study of electrochemical desul-furization performed by Ohtani and Gokcen1 left a number of points concerning the process to be investigated. Two of these were i) the determination of the effect of greater current and voltage on the desulfurizing Flower of acid slags (% CaO/% SiO2- 1) and ii) the possibility of the loss of silica in slag by the reactions 2C (in metal) + SiO2 (slag) = Si (in metal) + 2CO(g) and C + SiO2 (in slag) = SiO(g) + cO(g) proceeding to a point at which the composition of the slag was sufficiently altered toward the basic side so a1.s to noticeably affect the rate of de-sulfurization. The apparatus and the procedure used in the present investigation were the same as those used by Ohtani and Gokcen, except the control circuit was connected to 120 v dc instead of 24 v dc and thereby allowed greater freedom in choosing the values of both current and voltage. The graphite crucible containing the melt and serving as the cathode was 3-in. high, and was of 1 1/2-in. ID with a graphite bar of 3/8-in. diam and 8-in. length threaded into the bottom for electrical connection. The Panhandle area of northwest Texas embraces the northern portion of the Permian Basin of Texas as well as a considerable portion of the western part of the Anadarko Basin of Oklahoma. For the purpose of this report it will include in addition to the 20 counties of the Panhandle proper the two tiers of counties lying to the south, a total area of about 32,000 square miles. Crossing the Texas Panhandle diagonally from northwest to southeast is the Amarillo Arch, related to which is all of the production discovered to date. Oil Production Up to Jan. 1, 1930, the Panhandle has produced about 125,000,000 bbl. of oil. The peak yearly production occurred in 1927, during which period 49,000,000 bbl. were produced. In 1928 the production fell to 25,000,000 bbl., but in 1929, on account of important discoveries in Gray County, the total increased to 31,000,000 bbl. To date Hutchinson County has produced 64 per cent. of the total. Table 1 shows the total yearly production by counties. The present production of the Panhandle is 100,500 bbl. from 1745 wells or an average of 57.6 bbl. per well compared to a production on Jan. 1, 1929, of 59,748 bbl. from 1468 wells or an average of 40.7 bbl. per well. DURING the past ten or twelve years, the average reader of newspaper and magazine articles has been led to believe that enormous deposits of high-grade coal exist in the northland and that these can be mined for practically nothing. But much of the reputed glitter and attractiveness of Alaskan coals disappears when viewed at close range. Many areas of coal-bearing rocks are widely distributed geographically from Cape Lisburne, on Bering Sea, to Admiralty Island south of Juneau. Bituminous coal is found at Cape Lisburne, on the Bering Sea, at Five Finger Rapids on the upper Yukon, and at Herendeen Bay and Chignik Bay; lignite is found on the Kobuck River, along the Yukon River from points near the mouth to Tonakat, near Rampart, at Dawson, on the east shore of Cook Inlet, and in the Tanana Valley, 50 mi. south of Nenana. The Susitna and Matanuska Valleys contain coal ranging from lignite to anthracite, and in the Bering Lake district, there are coals ranging from semi-bituminous to anthracite. No effort will be made to describe all of these fields, but the writer wile confine himself to the four principal fields, namely, the Nenana field, in. the interior of Alaska, tributary to the Fairbanks district; the Matanuska, field, in the Matanuska Valley; the Kachemak Bay field on the east shore of Cook Inlet; and the Bering River field, east of the mouth of Copper River.

The use of ultrasonics in forming emulsions is not new. As early as 1927 Wood and Loomis' reported preparation of emulsions with ultrasonics. In 1935 Rschevkin and Ostrawskyz described the use of great ultrasonic power in producing fine emulsions of various oils and paraffin in water. Recently Oyama and Tanakahmployed ultra-emulsification to increase the effectiveness of sodium ethyl xanthate in flotation of chalcopyrite and galena. An emulsion is a two-phase system consisting of two incompletely miscible liquids, the one being dispersed as finite droplets in the other. The dispersed liquid is known as the internal or discontinuous phase, and the surrounding liquid is termed the external or continuous phase. There are two types of emulsions; one is oil-in-water (O/W) and the other water-in-oil (W/O). The word oil refers to the liquid other than water. Circumstances exist in which the emulsion type is not clearly defined, and the internal and external phases both contain portions of the opposite phase. This is said to be a dual emulsion. Among the many hypotheses', 6v proposed for the formation of emulsions, the Bancroft's adsorbed film or double interfacial tension theory is widely accepted. Bancroft ""educed that in the process of emulsification the interfacial tension between oil and water is lowered by the formation of an emulsifying film, which contains the adsorbed molecules and/or ions from the emulsifying agent and the two liquids.

On July 15, 16, and 17, 1918, through the good offices of Secretary Stoughton, and the courtesy of War Department officials, Columbia Section was able to secure a series of moving pictures which were presented under the auspices of the Spokane Engineering and Technical Association.. The title was "The Way Out," representing the activities of individuals who had lost an arm, a leg, or both, yet whose apparent misfortunes were made the stepping stones to advancement in various human activities. The exhibitions were given at Natatorium Park in the evening, each of the three performances being attended by 1000 per-sons. Later the films were shipped to Kellogg, Idaho, where they were shown in the principal playhouse one evening to a full house. On July 31, 1918, the Columbia Section participated in the luncheon and other entertainment in honor of Alfred D. Flinn, Secretary of the Engineering Council, who made a trip through the country to meet different classes of engineers, members of the National Societies, for whom he had a message. The entertainment was under the auspices of the Spokane Engineering and Technical Association, Mr. Peter Mogensen presiding. The luncheon was held in the Elizabethan Room, Davenport Hotel, at noon, 35 engineers being present, of whom about one-third were our members.

THE eastern section of the Park City dis-trict is drained to an elevation of 6300 ft. by means of the Ontario drain tunnel owned and maintained by Park Utah Consolidated Mines Co. This elevation represents a depth of 920 ft. in Park City Consolidated Mines Company's property. When development below the goo-ft. level was commenced, sinking was at-tempted through an incline winze in the fissure. The intensely fractured quartzite forming the walls of the vein could not be held after water was encountered, so it was decided that further sinking should be done in a vertical winze far enough in the foot-wall to be in the more solid quartzite out-side the fractured zone containing the vein. Progress was good until a depth of 200 ft. below water table was reached, where the flow of water became serious. Sinking pro-gressed 300 ft., to the 1200-ft. level, and there approximately 750 gal. of water per minute was being pumped. The last 20 ft, of sinking cost more than $200 per foot direct charges, whereas the over-all cost for the 300 ft. was $100 per foot. This high last cost was caused by excessive lost time in pumping. Crosscutting to the vein disclosed the fact that the 1050-ft. level had been devel-oped only after drainage had been effected from the 1200-ft. level, but that the 1200-ft. level could not be opened because of the

Having shown1 the difficulty of assaying so-called cyanide bullion and the extreme variations often found in the results, an investigation was undertaken to discover, if possible, the causes of these variations by a series of tests upon the specific action of various metals during cupellation. Zinc.—In order to test the effect of zinc, 48 assays were made in sets of 6, 2 rows of 3. The charge for the middle cupels consisted of 500+ mg. Au, 1,125 mg. Ag, 10 mg. Cu. To the end cupels 50, 75, 100 and 125 mg. Zn were added, and a set of each proportion was cupelled with 4 and 8 grams Pb. The cupels were assayed and showed the following gold contents in milligrams, the figures being arranged as the cupels stood in the muffle: In many instances the zinc does not appear to affect the cupel gold, but various exceptions are apparent, generally in the cupels in the back row. With 100 and 125 mg. Zn, in some cases the Zn burned with its characteristic flame' before it could alloy with the other metals. Also, less fusible oxidized lumps were observed during the cupellation and some cupels showed a scum.
