The attenuation and phase shift which formations produce in the electromagnetic field of an induction-type electrical well-logging instrument are great enough to substantially affect the response of the tool to formation conductivity under normal logging conditions. The application of the general equations for the propagation of an electromagnetic field in a conductive medium to the transmitter-receiver coil pair of an induction-logging-tool coil system gives an expression for the response which properly takes the propagation effects into account. A comparison of a calculation of this type with the response computed from the commonly used geometric factor concept, which does not include the propagation effect, leads to a factor Go representing the ratio of the responses computed by the two methods. The value of Go decreases not only with increasing formation conductivity, but also with increasing transmitter-to-detector coil spacing. For a single coil pair with a 40-in. spacing, the value of Go is 0.972 in a 20-millimho/m formation. The value is reduced to 0.915 and 0.812 for conductivities of 200 and 1,000 millimhos/m. As a result, the basic signal generated by the induction-logging coil system is not linearly related to formation conductivity as expected from the geometric factor concept. A uniform conductivity scale can be obtained only by adding a suitable nonlinear element to the recording system. The addition of auxiliary coils, having spacings less than the main-coil span, to achieve focusing results in an even greater departure of the basic signal from linearity with conductivity. The solution of the field equations near the interface between two formations of different conductivity gives the curve shape on an induction logging tool in crossing the interface. The addition of auxiliary coils to achieve focusing can add anomalous character to the curve shape in crossing the interface, which might be mistaken for lithological detail. Preliminary calculations which include the propagation effects in the determination of the conductivity correction for thin beds lead to correction factors which are substantially smaller than those obtained from geometric factor considerations. It is apparent that thin-bed corrections derived from geometric factor calculations are of doubtful validity. INTRODUCTION Although the electromagnetic induction type of electrical well log has been used for a number of years and has gained general acceptance in quantitative well-log interpretation, no technically complete investigation of the mechanism and of its operation has been published. The studies which have been presented are based upon the premise that neither the shape nor the intensity of the induction field of the logging tool is in any way affected by the electrical characteristics of the formation. From the inception of induction logging it has been recognized that under some formation conditions the performance of the instrument could be expected to be substantially different from that predicted by the simplified analysis. This anomalous performance has been called "skin effect" since it is the result of the same phenomenon which causes high-frequency alternating currents to flow only near the surface of metallic conductors. In the range of conductivities encountered in the sediments, the formation actually does not exhibit the sharply defined conducting "skin" shown by metals. The gradual modification of the distribution of the currents in the formation, produced by the induction field of the logging tool, is the direct result of phenomena associated with the propagation of the electromagnetic field through the formation. Therefore, it can be much more appropriately described as the "propagation effect". One purpose of this paper is to review the results of a solution of the equations for the performance of a single transmitter-receiver coil pair induction-logging system which takes into account the propagation effect, showing the manner in which the tool performance established by this analysis differs from that derived from the less comprehensive analyses currently in use. Handling and storing ore at transfer points underground are encountered frequently. An ideal solution to these troubles is probably still to be found, but at the Mather mine "B" shaft a method incorporating scraping trenches has been developed giving better service, from the standpoint of safety and simplicity, than obtained from other schemes. When shaft pockets are used for storage, the size of the ground opening required to assure capacity is often prohibitive, and shaft depth below the last level can become excessive, particularly if a crushing station is used. Also, if the material being handled contains large amounts of wet fines, it is difficult, if not impossible, to hold the material with regular chute gates. In order to remedy these problems Cleveland-Cliffs' Mather "B" has utilized three types of trenches. Types I and I1 are now in service and the third is under construction.

At this last meeting of our Institute for the year 1899, it is appropriate that we should look back at the past. To review the century's progress in the exact sciences and the resulting arts that fall within the scope of our labors is beyond my ability. But I wish to draw your attention to some phases of that progress, almost as important, which lie within the zone of sociology, touching at so many points the domain of applied technology. One of these is suggested by the library of technical literature which this century has produced —not the least important contribution to which is our own Transactions. The nineteenth century has witnessed the beneficial spread of democracy in politics. Under the impulse, to no small degree, of the same spirit, there has grown up a brotherhood of fellow-workers and a sense of fellow-ownership in the secrets of nature. Though the Patent Office has assumed such proportions as to hare become a source of national revenue, and a multitude of inventors, great and small, are seeking through its agency to secure some pecuniary profit from their devices, there is even greater eagerness among both interested and disinterested workers in the field of technology to publish their observations, and even their discoveries, and to give them to the world without remuneration. Reginald S. Dean (Manganese Extraction by Carbamate Solutions and the Chemistry of New Manganese-Ammonia Complexes, P. 55) was born in Rolla, Mo. and attended the Missouri School of Mines. Mr. Dean has worked as metallurgist with Western Electric Co. from 1920 to 1929 and with U. S. Bureau of Mines from 1929 to 1946 as chief metallurgist and assistant director, and has been a metallurgical consultant in Washington, D. C. since 1946. An AIME member, Mr. Dean has presented at least 50 papers before the society. Mr. Dean is a member of American Society of Metals, American Chemical Society and Electrochemical Society. C. O. Dale (Illinois Operations of the Eagle Picher Mining and Smelting Co., co-author with W. J. Rundel, P. 72) was born in Twin Bridges, Mont. and attended Montana School of Mines and received his B.S. in mining engineering in 1944. Mr. Dale was with U. S. Navy Air Corps. as an electronics technician and worked as an engineer with C. O. Dale & Sons, Anaconda Copper Mining Co. and with Eagle Picher Mining & Smelting Co. At present he is Wisconsin manager of Eagle Picher Mining & Smelting Co. The application of machinery to mining is of special interest to Mr. Dale. A member of AIME, Mr. Dale is on the Room and Pillar or Stope and Pillar Committee of Mining Subdivision for 1951 to 1952. Mr. Dale is a member of Montana Society of Engineers and Lions Club. Magnetic torque studies of ferromagnetic single crystals have been carried out in a number of laboratories during the last decade&apos;s2 and some work has been reported on polycrystalline material showing preferred orientation. Goss3 used the method extensively in developing electrical sheet with desirable magnetic properties, but he used it as a control rather than as a means of studying the texture. Bozorth4 made a quantitative correlation of a torque curve he obtained from some cold-rolled iron with the texture as determined from X-rays, but did not extend his studies beyond the one specimen. Other studies, which have been reported from time to time2,5 have also been incomplete in the sense that no effort was made to study a whole series of samples, differing only in degree of cold reduction or in the annealing temperature, in order to ascertain the effect of such treatments on the texture as revealed by torque measurements. It is the purpose of this investigation to make such a study, mainly in order to see how useful the method can be made when used under favorable circumstances and to find what kind of a correlation can be expected between magnetic and X-ray studies of texture. Before proceeding further, it is desirable to say a little about single crystals, so as to make clear the concepts involved in magnetic torque measurements. Magnetic Torque Method It is fairly well known nowadays that single crystals of ferromagnetic substances have directions of easy magnetization and of hard magnetization. In Fig. 1 are reproduced typical magnetization curves for a single crystal of iron, which show that in a < 100 > direction saturation occurs at low fields compared to those required to saturate the same crystal in a <110> or a <111> direction. In the Carlsbad area potash is dry-mined and wet- concentrated. Wet concentration involves recirculation of saturated brines, with resultant difficulties of brine disposal and inherent losses in recovery through solution of the KC1. A dry beneficiation process for potash minerals would offer many advantages over present methods. International Minerals & Chemical Corp. has been working on development of a dry process for some time. This article is a progress report.

In the last few years, much study has been devoted to increasing stoping efficiency. The reasons for this are shortage of manpower, shorter working hours, operating regulations, and shortages of essential materials. More efficiency in mining methods is needed to offset these adverse factors. In the past, attention has been centered upon haulage, hoisting equipment, mill flowsheets, etc., but recently the spotlight has been focused on the cost of stoping and the cost of handling materia,ls. Scrapers and scraper hoists have thus assumed greater importance. In order to make it possible for certain ore bodies to be mined at a profit, it has been necessary to apply assembly-line practices to the streamlining of mining methods. All cycles of the mining operation must balance, and the sooner broken ore is removed from the working face, the sooner another round can be started. Since the introduction of scraper hoists in metal mines more than thirty years ago, much progress has been made in their design and application. Alert operators are now constantly watching for methods in which to apply scrapers. The saving of: manpower in development work and the changing of mining methods that once employed manual handling of materials are increasing vital wartime tonnages. Essential ores from newly discovered ore bodies are moving rapidly from stopes to reduction plants—because it is now possible to develop an ore body and place it in production with a minimum of manpower and development work. Today, speed is one of the prime essentials of mining. Everywhere, there is a concentrated effort to use experienced miners in breaking rock, in timbering, and in carrying out the various phases of mining that require many months of training. Much effort is being made to mechanize the working places because experienced men naturally prefer to work where the majority of materials are handled mechanically. In line with this policy, many new men are being taught the details of scraper work, because even green men can quickly become acquainted with scrapers and thereby release older heads to perform the more skilled phases of mining. In some places it has been found economical to change from .one system of stoping to another that more readily allows the application of mechanical muck-handling equipment. Where blocks are worked faster, the cost of materials, time, and labor is cut drastically. This favorable situation allows more manpower to remain on straight breaking and timbering—or straight production mining. Moreover, when blocks are mined faster, more floors can often be mined vertically before the mucking or wheel floor is moved. This results in several direct savings. There are cases where it has been proved that by working a given block faster more area, longitudinally or vertically, could be mined at one time, thus permitting the reduction of development cost. IN view of the circumstance that very few important changes have been made within the last 15 or 20 years in the equipment of rod and wire mills, the description of a new process introduced by Grenville Mellen, of Llewellyn Park, N. J., to take the place of the present laborious system of producing rods of lead, zinc, brass, copper, aluminum, etc., may be interesting to members of the Institute. This new process consists in the production of cast rods at one operation in a small continuous casting machine. The hot liquid metal is transferred from the melting crucibles directly into an endless chain of mold blocks in the machine, where solidification takes place, and the rod comes out continuously in a solid form at one end as long as the molten metal is supplied. The operation of these mold blocks so as to produce a solid rod of uniform structure constitutes an important part of Mr. Mellen&apos;s invention. The machine (Figs. 1 and 2), 12 ft. in height over all, 2 by 3 ft. in horizontal- cross-sectional area, and 6,000 11). in weight, has a framework of cast iron, holding in position two endless chains of mold blocks, which are made in sections and join in center alignment. The mold orifice is made up of these mold sections, into which the liquid metal flows. The molding chains are composed of steel blocks, grooved on one face to form the molding cavity, and linked together with flexible joints. Each block is carried on four rollers which guide the chain around the end sprockets and carry it in its course through the machine. The accuracy of alignment requisite to the production of a perfect rod in the mold groove formed by these sections is secured by careful machine work, and by building the four ways, down which the alignment takes place, so that two of the sides are fixed permanently, while the opposite sides are held to their position by spring pressure. The guides carrying the molds, while in casting position, are water-cooled square tubes.

SECRETARY&apos;S NOTE.-The complete list of all officers of the Institute will be found on p. iv. of this number of the Bulletin. The following explanation may recall to old members, and convey to new ones, the relations of the two governing bodies, as determined by the, Certificate of Incorporation of the Institute, and the Constitution and By-Laws adopted in accordance therewith. The body legally responsible for the business management is the Board of nine Directors (three elected annually to serve three years), which elects its own officers. This body, for reasons of practical convenience, is composed of well-known members, residing in New York City, and able to attend, without serious inconvenience or expense, the necessary meetings of the Board. The officers of this Board are legally the officers of the Institute. But, apart from business manage-ment, the Board exercises no control over the election of members, or the professional and technical work of the Institute, except that its vote is required to elect honorary members, upon the recommendation of the Council. The Council is a. body, constituted in all respects (except that it has no Treasurer) like the Council existing before the incorporation of the Institute, in January, 1905, and charged with all duties and powers, except those which the Board of Directors must legally perform. It elects members, appoints the times and places of professional meetings, and controls the publication and distribution of papers and volumes, etc. Its members (President, Vice-Presidents and Councilors) are elected by the members of the Institute, voting in person or by proxy, and after publication of the nominations received ; and it is intended to repre¬sent, as far as practicable, both the professional and the geographical distribution of the membership. Consequently, whatever professional honor attaches to official position belongs to membership in the Council, rather than in the legal Board of Directors. This remark implies no disparagement of the members of the latter body, every one of whom has served, or is now serving, as a member of the Council. But it is only fair to explain that their election and continued re-election as Directors is simply a matter of legal convenience.

Phosphosilicate glass films were formed, by reacting gaseous P2O5 with SiO2, over a large range of temperature (800° to 1200°C) and gas phase composition (nearly two orders of magnitude of effective P2Ospressure). The film compositions generally corresponded with the liquidus curve, delineating the maximum solubility of the tridymite Phase of SiO 2 in phosphosilicate liquid solution at the temperature of film formation. It is shown that the P2O5 concentration of the phosphosilicate liquid film tends to decrease by reaction with the underlying SiO 2 layer until the liquidus curve is reached. The validity of the thermodynamic argument used in this explanation is supported by the results of a determination of the composition of borosili-cute films, prepared by reacting gaseous B2O3 with SiO2 at different temperatures. The kinetics of phosphosilicate film formation were described by a model predicated on a steady-state diffusion of P2O5 through the film. UNDERSTANDING of the processes leading to formation of phosphosilicate and borosilicate glasses is of great importance for producing passivating layers on FET devices. Passivating films with optimum characteristics are preferably formed in a separate step, independent of the doping of the semiconductor.&apos; The results of an investigation carried out to gain improved insight into the mechanism of glass formation are presented in this paper. It would be expected that application of the known Pz05-Si02 and B 2 O 3-SiO2 phase diagrams should be useful in extending understanding of the glass-forming processes. However, the question of the propriety of treating thermally grown SiO2 in these binary oxide systems by the methods of equilibrium thermodynamics must be considered when this application is attempted. Although Sah et a1.&apos; and Allen et al. 3 investigated the kinetics of formation of phosphosilicate glass (PSG), they failed to adequately relate their diffusion models to the occurrence of experimentally observed phases in the PSG/SiO 2/Si system. Horuichi and yamaguchi4 investigated the diffusion of boron through an oxide layer and described their results in terms of a model similar to that of Sah and coworkers. More recently, Kooi 5 and Snow and Deal6 reported the compositions of PSG films formed by depositing P2 O 5 onto SiO2. These compositions apparently coincide with those at the liquidus curve delineating the maximum solubility of crystalline SiO2 in phosphosilicate liquid solutions. These authors did not discuss the thermodynamic implications of their results on the structure of thermally grown SiO2 films. The structure of thermally grown Sio2 films and that of vitreous silica are generally thought to be quite similar. Since the solubility of a substance depends on its structure, it is relevant that the solubility of vitreous silica in water7 is highly reproducible, like the solubility of thermally grown SiOz in phosphosilicate liquid. Furthermore, the vitreous silica-water system appears to be in true thermodynamic equilibrium (viz., the same solubility value can be approached from both supersaturated and under-saturated solutions). Sosman7 suggested that a type of two-dimensional lattice may form at the silica/solution interface, resulting in the observed solubility behavior that is characteristic of a crystalline solid. An alternative explanation may be that vitreous silica has a microcrystalline grain structure. Other investigators have suggested that vitreous silica has essentially the structure of B cristobalite,&apos; or is composed of microcrystals of p tridymite or cristobalite, or a mixture of both. Presumably the grain size would be sufficiently large to minimize any appreciable contribution of the grain boundaries to the solubility of the crystalline matrix. The present investigation was carried out to clarify the significance of the boundaries in the Pa,-SiO, and B2O3-SiO2 Systems in determining PSG and BSG (borosilicate) film compositions. Furthermore, the kinetic data for PSG film formation were extended, using a wider range of formation parameters than were previously reported. One model describing the kinetics of film formation will be presented that is compatible with the thermodynamics of the Pa5-Si02 system. EXPERIMENTAL PROCEDURE Glass Film Preparation. SiO2 films (1000 to 8000A thick) were obtained by oxidation of silicon substrates in dry O2 at 1100°C. PSG and BSG films were prepared by exposing these layers to gaseous oxides obtained by reacting high-purity POC13 and BBr3, respectively, with O2. It is commonly recognized that a given material may be described as ductile or brittle only with reference to the conditions of test. Thus under the usual test conditions quartz is brittle, but under high pressures it is ductile. Salts that are brittle at room temperature become ductile at elevated temperatures. Pitch, brittle with respect to rapid loads, flows at low rates of loading. Pearlitic steel, ductile under the usual conditions of test, may be embrittled under the proper conditions of combined stresses, temperature, and rate of loading. Earlier Investigations A clear analysis of the conditions necessary for plastic flow and for fracture was first given by LudwikI1 who introduced two types of stress, the "flow stress" and the "stress at fracture." These stresses may refer to tensile or to shear stresses, or, in fact, to any type of stress. Ludwik considered these two stresses to be independent of one another, functions of the conditions of test and of the prior history of the material. For the purpose of analysis. both a Flow stress and a stress at fracture can be envisaged as functions of strain over the entire range from zero to infinite strain. Thus, the material is brittle if the stress at fracturc is less than the flow stress and ductile if the reverse is true. According to Ludwik&apos;s analysis, the problem of determining the effects of combined stresses, of temperature and of strain rate upon the behavior of metals reduces to a problem of determining the effect of these variables upon the flow stress and upon the stress at fracture. In the present paper, methods are described for determining the effects of two of these variables, temperature and strain rate, and examples are given of the dependence of tlow stress and stress at fracture, upon these two variables. It is commonly recognized that a given material may be described as ductile or brittle only with reference to the conditions of test. Thus under the usual test conditions quartz is brittle, but under high pressures it is ductile. Salts that are brittle at room temperature become ductile at elevated temperatures. Pitch, brittle with respect to rapid loads, flows at low rates of loading. Pearlitic steel, ductile under the usual conditions of test, may be embrittled under the proper conditions of combined stresses, temperature, and rate of loading. Earlier Investigations A clear analysis of the conditions necessary for plastic flow and for fracture was first given by LudwikI1 who introduced two types of stress, the "flow stress" and the "stress at fracture." These stresses may refer to tensile or to shear stresses, or, in fact, to any type of stress. Ludwik considered these two stresses to be independent of one another, functions of the conditions of test and of the prior history of the material. For the purpose of analysis. both a Flow stress and a stress at fracture can be envisaged as functions of strain over the entire range from zero to infinite strain. Thus, the material is brittle if the stress at fracturc is less than the flow stress and ductile if the reverse is true. According to Ludwik&apos;s analysis, the problem of determining the effects of combined stresses, of temperature and of strain rate upon the behavior of metals reduces to a problem of determining the effect of these variables upon the flow stress and upon the stress at fracture. In the present paper, methods are described for determining the effects of two of these variables, temperature and strain rate, and examples are given of the dependence of tlow stress and stress at fracture, upon these two variables. This paper deals in a general way with certain of the necessary requirements of refractories for the open-hearth furnace. The refractories in common use for the different parts are discussed both as to the service they are giving and their suitability to withstand existing chemical, thermal and physical requirements. The relation between the service and allowable cost of a refractory is discussed and suggestions are requested on these points. The purpose of this paper is not to report, to the Institute, the results so far obtained in the survey, by the Bureau of Mines, of the metallurgical requirements for open-hearth refractories, but to present an outline that we hope will serve as a basis for discussion. The systematic survey that the Bureau proposes to make has not been outlined, although considerable preliminary work has been done in the way of interviewing open-hearth superintendents in several of the larger steel plants from the Chicago district eastward. At the several conferences so many of the opinions were diametrically opposite, when considering the same point, that it was thought that such an opportunity as the Institute offers in the way of a clearing house for moot metallurgical topics should not be overlooked. For this reason, the paper has been prepared as a basis for a discussion which, it is believed, will be of value in outlining the program of the Bureau. D. A. LYON, Assistant Director. THE importance of securing suitable refractories for metallurgical operations is daily becoming more universally recognized; particularly in the manufacture of open-hearth steel, where the life and earning power of the furnace depends largely on the judgment and care exercised in the selection of the correct quality of refractory for each of the parts. Any innovation that would make available to the steel manufacturers refractories with longer life or better suited to their needs than those now employed, and at a cost that would permit of their use, would be of enormous value to the industry at large. Mr. ASHBURNER&apos;s paper on the Classification and Composition of Pennsylvania Anthracites, read at this meeting, well shows the need of new and accurate determinations of the heating value of these coals. A similar need exists for the determination of the value of bituminous coals, since the variation in quality of the latter is greater than the variation in anthracites. The recent extensive use of liquid and gaseous fuels, " patent" fuels, tan-bark, and other refuse fuels, also makes a necessity fix some correct method of determining the relative values of each of these fuels. Mr. Ashburner has recommended that tests of coals should be undertaken by the Second Geological Survey of Pennsylvania, and Professor Dewey, as stated in Mr. Ashbnrner&apos;s paper, has suggested a plan for tests of American coals, by the Smithsonian Institution, for which an appropriation by Congress will be asked. It is to be hoped that if any extensive series of tests of coals is carried on under either Government or State auspices, the erroneous methods of test which were followed by Professor Johnson in 1842, and by Quartermaster-General Meigs in 1882, will not be adopted.* The first requisite in determining the heating-power of a fuel is proper apparatus, such as has not been used in any of the tests of American coals yet reported. In the hope that more accurate means may be used in future tests, the writer desires to call attention to an apparatus which he has designed for the purpose. Not having had opportunity for making a trial of it, nor even of having it criticised by others, he does not offer it as the best possible apparatus; but if it contains any points of value, and leads to the design of still more suitable devices by others, the object of the presentation of this paper will be accomplished. The tests by Professor Johnson and General Meigs were made by evaporating water into steam in ordinary steam-boilers. A steamboiler of ordinary construction is not a good apparatus for determining the heating power of a fuel, for the following reasons:

About eight years ago a comprehensive study of American timbers was begun in the U. S. Division of Forestry with a twofold object. On the one hand, it was desired to deternliiie the working-qualities of our numerous economically important timbers, and to furnish reliable standards of strength. 011 the other hand, it was intended to get a clearer insight into the properties and behavior of wood in general, with a view of establishing more rational methods in its use, and to furnish data for physical inspectioil which would permit an intelligent application of the standards of strength, and place upon a rational foundation the so-called " factor of safety," which is at present a mere baseless guess. The first object, namely, the establishment of standards for any given species, requires a very large series of tests, since Wood is an exceedingly variable substance, so much so that in the same tree a variation of 50 per cent. in strength may be found; hence the greater need of rational data of inspection. So far, the insufficient appropriations and facilities at our disposal have permitted us to establish really reliable standards for five species of southern conifers only. These have been deduced from nearly 20,000 tests. Besides these, 10,000 other tests have furnished indicatious regarding some two dozen other species. This work is now entirely abandoned, waiting for more prosperous times. The study of wood in general, however, can be carried on with smaller means, and has this year yielded not only very interesting, but highly important results, which will soon be published in detail. The 64th Texas Legislature passed the "Texas Surface Mining and Reclamation Act," Chapter 131, Texas Natural Resources Code (subsequently referred to as "the Act"), at a point in time when little surface mining had taken place within the state. Thus, enactment of regulatory control governing mining operations in our state has, for the most part, preceded widespread, intensive mining activity. I should point out that the statute applies only to the extraction of coal, lignite, uranium and uranium ore. A recent opinion rendered by the Attorney General&apos;s office has stated that extraction of the named elements, when it occurs incidental to the extraction of other materials, e.g., clay, is not not an activity subject to the Act. An important theme of the Act, frequently overlooked in other environmentally oriented legislation, is recognition of the Act&apos;s affect on the mining industry. The Act states that "the extraction of minerals by surface mining operations is a basic and essential activity making an important contribution to the economic well-being of the state and nation" and, in reference to reclamation being accomplished contemporaneously with mining, provides a recognition that "the extraction of minerals by responsible mining operations is an essential and beneficial economic activity." This legislative recognition is, of course balanced against the need for proper mined land reclamation, the rights of surface owners, the need to guard against unreasonable degradation to land and water resources and numerous other actions or events that the Legislature wanted protected. Another rather pervasive general theme that is established in the Act is the concept that the agency is entitled to obtain whatever information, or take whatever action, that appears reasonably necessary to effectuate the purposes of the Act. This concept, coupled with the detailed requirements placed on mining operations in the portions of the Act dealing with Permit Applications, Reclamation Plan and Reclamation Standards, easily insures that surface mining activities can and will be regulated to the extent necessary. Section 131.102(b)(2) is probably the most relevant provision in the Act which deals with the preclusion of mined lands becoming waste lands. This portion of the Act states that the surface mining operator shall: ". . . restore the land affected to the same or a substantially beneficial condition. ." In this language the Legislature had made it abundantly clear that the abandoned or orphaned lands found in some of the Eastern states, will not be tolerated in this State, and provided the Commission with a degree of latitude to determine what condition would be appropriate in each individual mining situation. I bring this area of the Act to your attention because it is the area which has received the most inquiries and concern by operators, i.e. what does "substantially beneficial" constitute? The Commission&apos;s staff has spent a considerable amount of time wrestling with the statutory language "substantially beneficial" to determine the legislative intent and provide operators with guidance of what they can expect. In this regard, the most definitive criteria in our opinion lies in the Act&apos;s legislative hsitory. The Legislature had before it basically three reclamation standards namely: House Bill 656, considered to provide the most stringent reclamation standard and identical to Senate Bill 66; House Bill 1717 which was supported by industry spokesmen and was considered to contain the least stringent reclamation standard; and Senate Bill 55 which was adopted by the Legislature. During the Bill&apos;s initial hearing before the House Environmental Affairs Committee, the House sponsor of the Senate Bill 55, which was the Bill eventually adopted, made the following statement: (I am quoting verbatim from the Committee&apos;s transcript although substituting the speaker&apos;s reference to the authors names with the Bill&apos;s numbers.) "An example of the differing approaches of the four bills can be seen in the area of reclamation standards and this is critical. House Bill 656, talking about restoring the surface of the land, House Bill 656 has this statement: &apos;At least fully capable of supporting the use to which it was capable of supporting prior to any mining or any higher or better use.&apos; In other words you have to restore it to the level it was prior to the mining. Senate Bill 55: &apos;Restore the land to the same or substantially beneficial use.&apos; Substantially beneficial use. (Emphasis his) House Bill 1717 says: &apos;Restore insofar as practical to appropriate beneficial post-mining use.&apos; So that House Bill 1717 said to, &apos;restore insofar as practical to appropriate beneficial use. I think that&apos;s too weak, whereas I think the House Bill 656 that would call you to restore it to at least the use it had prior to the mining may also be too tight the other way. I think the Senate Bill 55 approach is down the middle of the road which says that you do restore it to the &apos;same or substantially beneficial use,&apos; is a proper way to go there." Therefore, the conclusion that we have drawn from the legislative history of the bill is that the extent of reclamation required by "substantially beneficial" may be something other than the use it was prior to
