(Read at the Amenia Meeting, October, 1877.) IN the case of The Eureka Consolidated Mining Company v. The Richmond Mining Company of Nevada, recently tried at San Francisco, California, the real defendant was the Richmond Consolidated Mining Company, of London; but this being a foreign corporation, holds its mining property in Nevada through the Nevada corporation of similar name, in which the London Company owns all the stock, except the few shares necessary to "qualify" the American directors. The trial would naturally have taken place in the Circuit Court at Carson City, Nevada, and before a jury. But by stipulation of the parties, the case was tried in San Francisco, before Hon. Stephen J. Field, Justice of the Supreme Court of the United States, Hon. Lorenzo Sawyer, United States Circuit Judge of the Ninth Circuit, and Hon. E. W. Hillyer, United States District Judge, for the District of Nevada. The hearing began July 23d, 1877. The witnesses occupied two weeks, and the argument of. counsel three days. Very eminent lawyers were. engaged on both sides ; for the plaintiff, Messrs. Solomon Heydenfeldt, R. S. Mesick, John Garber, and H. J. Thornton ; for the defendant, Messrs. S. M. Wilson, Thomas Wren, and J. J. Williams. The court held the case under advisement until August 22d, when Mr. Justice Field delivered its unanimous opinion in favor of the plaintiff. The action was a complaint in ejectment, and an appeal was taken to the United States Supreme Court. The questions at issue between the Eureka and the Richmond Company in this suit, comprised several points in the construction of the mining law of the United States, and its relation to the customs and regulations of the mining districts, which possess an importance and an applicability far beyond the limits of the case in which they arose. A speiss is an artificial arsenide, sometimes an antimonide, formed in lead smelting, smelting of oxide copper ores, and in some lead-refining operations. The production of speiss is closely allied with the amount of arsenic and metallic iron in the blast-furnace charge, while dross is produced mostly from the copper and sulphur, with varying amounts of antimony, arsenic and nickel. Most speiss is essentially an iron arsenide containing some sulphur, copper and nickel, if these elements are present in the furnace. The recent introduction of the soda treatment of lead drosses has produced a speiss high in copper. Speiss is not miscible to any extent with molten copper, lead, matte or slag. Miscibility increases with temperature. This property of the speiss is clarified in the latter part of this paper. Most speisses are produced in conjunction with matte and their sulphur content points to the solubility of matte in speiss. . Some plants have insufficient speiss to warrant separate treatment. When arsenic is high in the blast-furllace charge, there may be sufficient speiss to tap separately from the first settler. Arsenic From the foregoing, it is obvious that a study of the treatment of speiss would not ,be complete without consideration of arsenic. Inasmuch as perhaps go per cent of the blast-furnace feed may be sinter, a definite knowledge of the properties of arsenical ores and compounds that go in to the roaster and sinter feeds is of value. Lcad smelters obtain their arsenic from ores and concentrates, as well as from flue dusts shipped from other plants, particularly copper smelters. The percentage of arsenic in ores is usually low, although occasional lots of high arsenical products are smelted. These crude ores may be sulphides, as arsenopyrite; or oxides like scoiodite, which carry gold or lead minerals. The small amount of arsenic in the original ores received is greatly increased by a circulating load of arsenic in secondary products at are resmelted for their lead or precious metals. More important than the arsenic present directly in the concentrates treated is that in fumes and dusts that may originate in the blast furnace or sinter plant of the lead smelter, or may come from a copper smelter as lead-bearing converter fume or roaster dust. Thus the lead smelter not only must treat its own arsenic but is compelled to handie that from some copper and perhaps other lead plants. Where copper and lead plants exchange products, each plant may be forced to re-treat part of the arsenic it has shipped ,outside its own confines. Speiss from the lead blast furnace contains chiefly iron and arsenic with some lead, copper and sulphur and often appreciable amounts of gold and silver. If its copper content is sufficient this speiss may be sent to the copper smelter where usually it is treated in the converter and the copper is separated as blister. THIS paper describes (1) the effect of sodium on the tensile ductility of magnesium-lithium base alloys, and (2) the precautions necessary to avoid sodium contamination. Effect of Sodium on Properties The harmful effect of sodium in magnesium-lithium base alloys has been recognized by other investigators.1,2 However, quantitative data on its effect have not hitherto been published. The effect of sodium on the ductility of an 87 pct Mg-9 pct Li-4 pct Zn alloy is shown in fig. 1. The sodium was introduced by adding sodium chloride to the flux, which consisted of 50 pct LiC1-50 pct KC1. Moderately high ductility was obtained at an indicated sodium content of about 0.05 pct. Actually, the value probably was less than 0.05 pct, be-cause analyses of the lithium, which were more accurate than those of the alloy, indicated that the highest ductility was obtained when its sodium content was 0.02 pct or less. In fact, in alloys having somewhat greater strength than this particular composition, the sodium content of the lithium must be under 0.01 pct to avoid embrittlement. The effect of sodium on the ductility of several alloys having fairly low strength levels is shown in fig. 2. These alloys were melted with a flux containing 75 pct LiC1-25 pct LiF, to which various quantities of sodium chloride had been added. Sodium had no significant effect in pure magnesium but markedly decreased the ductility of the magnesium-lithium-zinc alloy, even though the alloy contained only 3 pct Li. As the lithium content of the binary alloys was increased, the ductility of the sodium-free alloys also increased. However, the effect of sodium on ductility became progressively more pronounced. Sodium raised the minimum hot-rolling temperatures, particularly those of the high-strength alloys, but its effect, in this respect, was less critical than its effect on tensile ductility. For optimum cold roll-ability, a low-sodium content was required. No deleterious effect of sodium on the stability of properties at slightly elevated temperatures was found. Control of Sodium in the Alloys Optimum ductility is obtained in the magnesium-lithium base alloys when sodium-free materials are used. Commercial lithium was formerly the chief source of contamination. Now purified lithium is usually available. When lithium of ordinary purity is used, the effects of sodium can be minimized by using a flux consisting of 75 pct LiC1-25 pct LiF. Bubbling nitrogen through the melt also helps remove sodium. The damaging influence of sodium on the ductility of the magnesium-lithium base alloys was observed very early in the alloy development program. The discovery came about as a result of chemical analyses made on the lithium used in the alloys. Ductile alloys had been made from lithium containing about 0.2 pct Na, whereas the lithium used in the brittle alloys contained about 0.9 pct Na. The first magnesium-lithium alloys were melted under commercial fluxes ordinarily used in melting magnesium alloys. These fluxes were unsuited for scavenging the contaminating sodium, and the resulting alloys were not ductile. Next, a flux containing 50 pct KC1-50 pct LiCl was tried. This was somewhat more effective but still was not satisfactory. After a number of different experimental fluxes had been investigated, one containing 75 pct LiC1-25 pct LiF was adopted. This flux made it possible to obtain good ductility in the alloys. The

This is the first of a series of theoretical papers on the iron-carbon system. A simple critical analysis of the ordinary constitution diagram of the iron-carbon system yields valuable information regarding the nature of the equilibria in the liquid and solid states. It is shown, for example, that the solute in the melt is Fe3C, but in solid Fe (austenite) the solute is carbon. The thermodynamic laws of the depression in the freezing point of solid solutions have been developed and discussed. Using the usual method of plotting the logarithm value of the concentration of the solvent (in this case, the ratio of concentrations of the solvent in the liquid and solid phases) against 1/T, curves are obtained. A rigorous thermodynamic analysis of these curves has been shown to yield considerable information regarding the internal equilibria of the system, with which the phase rule does not deal altogether. In this way, it is shown again that the solute in the melt is Fe3C, but in the solid rFe the solute is carbon. Various heats of reaction (fusion and transition) and other thermal data have been derived: and discussed with a view to correlating the conflicting experimental data obtained by different investigators of the system.

This paper describes experiments which represent an effort to measure preciscly the pressure-time history in detonating condensed commercial explosives. The performance of explosives in mining has been a favorite subject for experimentalists and theorists for many decades. Much useful empirical information has been developed; but it has not yet been possible to predict, or even to account for, the behavior of explosives in mining on the basis of fundamental physical principals. A basic piece of information that would appear necessary for any rigorous analysis is the pressure-time history in the detonating condensed explosive. The experiments described here represent an effort to measure this relationship precisely in commercial explosives. THE EXPERIMENTAL METHOD The experimental method, first described by Cowan and Jacksonl has been extensively evaluated by Cowan and Balchan for relatively simple explosives. The experimental procedure involves the detonation of a layer of explosive between metal plates whose external surfaces are polished to a mirror finish (Fig. 1). Edgar Hall, Silverspur, Queensland, Australia (communication to the Secretary*):—Dr. Douglas has written on this subject before, and his influence has had a powerful effect on the eide of freedom among the' younger generation of engineers. Moreover, it is not the first time that he has attributed the decline of the copper-smelting industry in Swansea to the secrecy maintained by the firms there engaged in smelting-operations. In this latter statement I think his conclusions are open to criticism. Whether the firms mentioned have suffered by their secrecy is their own business—I hold no brief for them ; but that the decline of the copper-industry at Swansea was inevitable seems to me to he proved conclusively by Dr. Douglas's own writings. In his paper on The Copper Situation,' Dr. Douglas says : "In comparing iron and copper mining,...it must be remembered that 2 tons of average iron ore from the most prolific source now available ... will make 1 ton of metal; whereas from 33 to 75 tons (say an average of 50 tons) of copper ore must be mined to produce 1 ton of copper." And further: "Last year's production of iron was made from approximately 50,000,000 tons of ore. Our copper mines, to yield a production of 900,000,000 pounds, must have handled approximately 22,000,000 tons of ore, or nearly half the quantity raised from our iron mines." Is not this the key to the whole situation ? In transporting the 50,000,000 tons of iron-ore, 25,000,000 tons of the metal iron were carried so much nearer to the market, but the transportation of 22,000,000 tons of copper-orc would have carried only 450,000 tons of the metal copper nearer to its ultimate destination. No devclopment of major importance has been made in the south central fault-line district of Texas during 1939. Four new fields have been discovcred, all of which appear to be of minor importance, with small wells in the Navarro sand, the Taylor marl or the Austin chalk. Drilling along the fault line has not developed any new prospects in the Edwards lime, the most prolific producing horizon of the district. At the close of the year, a few deep tests for lower producing horizons have been projected and should prove to be of interest, and plans are under way for further development of the Pearsall field, which has been under the control of a single company until recently. Production from the 46 producing fields was maintained at 8,460,000 bbl. for the year, a decrease of approximately 400,000 bbl. under 1938. This decrease is due in part to natural decline of production and in part to decreased allowed production. Approximately 55 producing wells were completed on proven acreage in the Darst Creek and Salt Flat fields. No new lease plays were made during the year, although approximately the same amount of land, 600,000 acres, remained under lease during the year. Some geophysical operations of various types were carried on along the fault-line area itself and also in the Edwards plateau and in the area south and southeast of the main fault line.

Production of oil by expansion from a cylindrical reservoir composed of two concentric regions of different properties has been determined as a function of time for a reservoir producing at constant terminal pressure. The parameters involved are permeability, porosity, compressibility and oil viscosity. Results agree with those of a generally accepted method for uniform reservoirs when all parameters are taken as uniform. Cumulative production at any given time is reduced below that of the uniform reservoir when a region of considerably lower permeability adjoins the well; cumulative production increases when a high-permeability region adjoins the well. Curves are presented illustrating quantitative effects of these variations. INTRODUCTION Most petroleum reservoirs can be exploited by release of pressure and consequent expansion of underground fluid. During part of the production history of certain reservoirs by this mechanism, fluid compressibility can be considered small and constant. Cumulative fluid produced by this means as a function of time was calculated for a uniform reservoir by van Everdingen and Hurst.l For certain cases where a production well has been damaged or where an acid treatment has been used, a zone of properties different from those of the reservoir may be created around the production well. In such a case, expansion of the reservoir fluid takes place in a system composed of two concentric cylindrica1 regions of different reservoir properties. Such composite systems were studied in connection with heat flow by Jaeger2 who presented a solution for temperature distribution in a radial system with an infinitely large outer radius. Similar heat flow problems have been studied by other authors Oil production from composite reservoirs was studied for constant production rate by Hurst,4 Loucks and Guerrero,5 and Carter.6 THEORY This work considers constant terminal pressure. Cumulative flow is calculated for a composite bounded system in which no flow takes place across the outer boundary (Fig. 1). Since the flow is considered to be purely radial, the problem involves only one space dimension and time. It is convenient to define the following dimen-sionless pressure drops (Fig. 1).

INTRODUCTION For many tailings ponds, particularly those having substantial watershed areas, the control of pond water levels will be a major factor influencing the operation of the pond and the design and construction of the dam retaining the pond. This paper summarizes the basic factors affecting the control of water in tailings ponds, methods of water control, and methods of estimating the variables involved. The influences that pond water levels can have on the design, construction, and stability of tailings dams are explained in order to emphasize the importance of water control in the overall planning of mine tailings disposal systems. Two examples of pond water control planning conclude the paper. BASIC FACTORS The principal factors influencing the control of water in tailings ponds are illustrated on Fig. 1. Fig. 1 (a) shows the general disposition of the tailings solids and water in the pond; the solids settle from the slurry to form "slimes", deposits sloping down into the pond from the points of discharge; these slimes hold volumes of water in the voids between solid particles; water in excess of this "retained" water forms a pool of "free" water laying over the slimes deposits. In some cases, tailings solids (and water) go to the tailings dam for its construction. Fig. 1 (b) indicates those ways additional to tailings disposal in which the pond gains or loses water. These include surface and sub-surface runoff from the pond watershed, water reclaimed from the pond for ore processing, evaporation, and seepage. Seepage losses sometimes include water draining from tailings sand placed in the dam, but a portion of the total seepage flow is often collected and returned to the pond in order to avoid downstream pollution and to recover water for re-use. PRINCIPAL REQUIREMENTS In relation to the control of water in a tailings pond, the first requirement is usually to maintain a pool sufficiently large to ensure adequate clarification of the free water prior to its reclaim for use in the mill, or its discharge from the pond.

The separation of synthetic mixtures of heavy minerals by hindered settling classification and jigging was comparatively tested in water and five organic heavy liquids, of various specific gravities and viscosities. It was found that in the hindered settling classification process the separation efficiency was directly proportional to the concentration criterion, the liquid viscosity being a minor factor. There is therefore a decisive advantage in using heavy liquids as classification medium. In the jigging process the advantage of using a heavy liquid is masked by the detrimental effect of a higher liquid viscosity, which, in this case constitutes an important factor. Considerable interest has been aroused lately by the development of mineral beneficiation techniques 1,2 using TBE (tetrabromoethane), a heavy liquid of specific gravity of 2.96, which has been made available for industrial use by a new process3 producing TBE directly from the Dead Sea brines at a reasonable price. Most of the applications investigated until now were based on the sink-float separation of minerals in a heavy liquid of intermediate specific gravity. The TBE can be conveniently diluted with many organic solvents, and thus sharp separations are possible in a wide range of specific gravities up to 2.96. Although this maximum specific gravity is sufficient on most cases for the elimination of the bulk of the barren gangue and the production of marketable concentrates, some practical problems came up for investigation in which the separation of two (or more) minerals, heavier than TBE, was required.* *Among the cases studied in the IMI Laboratorles which fall into this category we can mention: alluvial deposits, such as heavy minerals in sea sand, tin deposits, or ground coarse-grained rocks, such as pegmatites. The National Pocahontas Mine in Wyoming County, WV, has been developed in the Pocahontas No. 3 coal. During 14 months of ventilation surveys, the locations of large rockfalls, many in areas infrequently visited by mine personnel, were mapped. Several dozen rockfalls were later studied in detail. Kettlebottoms, rider seams, root-penetrated roof strata, slicken sides, and shales that spall are common in areas with a high density of rockfalls. Large-scale crossbedding and micaceous and carbonaceous films in sandstones are less common. Density of rockfalls in any area is related to the time elapsed since mining, thickness of overburden, and orientation of entries and panels. Some linear features overlie areas where rockfalls are densest. Most rockfalls occur during summer.

2.2-1. Need for Acquisition Operating Plan. In planning a trip by automobile, a road map is procured and studied. Travel by plane suggests detailed examination of route maps, weather charts, and navigation charts. Planning for construction of a factory, office building, shopping center, or housing subdivision envisages working out a complete development plan. Household needs arc generally jotted clown on a shopping list, with each item checked off as it is purchased. In turn, forwarding of any surface mining project should be undertaken only after an acquisition operating plan has been set out, by checklist, under three general headings: 1. Public relations-a check list setting out applicable Federal, State, and local laws and regulations, and the office, board, commission, and individuals having responsibility for licensing, administration, and enforcement of each such law or regulation. 2. Land requirements-a complete check list encompassing all aspects of land acquisition, ownership, management, control, and disposition, with applicable laws. 3. Water requirements-a full check list embracing all aspects of water development and control, acquisition of rights to use, manner of use, and manner of disposition, with applicable laws and regulations. 2.2-2. Public Relations Aspects of Operating Plan. NEED TO DETERMINE APPLICABLE LAWS. The laws and regulations governing acquisition of land and mineral rights, water and water rights, and the use and control of those rights, vary so much from state to state that one cardinal rule must govern all preplanning: determine applicable Federal, State, and local law at the outset. Changing conditions in the past century have resulted in a multiplication at all levels of governmental agencies interested in, and having responsibility for, acquisition, use, control, and disposition of minerals and mineral lands. The same is true of waters and water rights found in, brought to, or discharged from, the operating site.

THE Eastern district, composed of New Jersey and eastern Pennsyl-vania, with its native ores, was the cradle of the iron industry of the United States. The district attained and held the leadership in produc-tion of pig iron for over 100 years, from pre-Revolutionary days to approximately 1875. The first shipment of Lake hematite ore was made in 1853. It was a small shipment, transported by a sailing vessel and a canal barge, but it was the beginning of the end of the supremacy of the Eastern district, although at that time the ore was supposed to be too rich to be successfully smelted with the block coal then in use at western furnaces. The iron made from the first shipment of Lake ore was worked into nails by the Sharon Iron Co., at Sharon, Pa. The writer's great-grandfather, David Agnew, and his brother, John P., Agnew, owners and-operators of the Sharpsville furnace, Sharpsville, Pa., worked the shipment through a furnace. Because of this, the writer feels some satisfaction in having been one of a group that solved the problem of making profitable an operation using Eastern district ores exclusively. With the development of Lake mines, and the production and use of coke, the Middle West district gradually assumed the position of leader-ship in production; because, even though the ores were transported 1000 miles by water and rail, its cost figure on pig iron was better than that of the eastern producer whose furnace was next to his mine. Such a cost figure was possible because the ore was naturally rich in iron and reduced easily. It was possible to carry a heavy burden on the furnace, which resulted in large tonnage and low coke per ton of iron. This paper is in no sense a technical one. The purpose is to show that with the proper physical preparation of the Eastern magnetites they will reduce as easily as the Lake hematites, and because of the high iron concentration give the Eastern producer just as much advantage as formally he was at a disadvantage in comparison with the Middle West producer.

THE situation in 1872, from the standpoint of the prospector, the locator, the possessory claimant, and the patentee of mineral land under Federal statutes, cannot be understood without a knowledge of the situation prior to 1866, and between 1866 and 1872. The Situation before 1866 The western public domain acquired by the United States through treaties, as the result of conquest or purchase, was invaded after Marshall's re-discovery of gold in California, by an overwhelming multitude of prospectors and miners from all parts of the world. The mineral lands of the whole Pacific slope were practically unsurveyed. Congress, disgusted with the experiment of leasing mineral lands; which it had tried for 40 years, and abandoned in 1847, enacted no laws for the management of these public mineral lands, and the pioneers made their own laws governing mining titles. These local regulations applied at first to gulch-mining in the auriferous river-beds only; and they constituted a simple and practical system, adapted to the needs and means of primitive communities-significantly called "camps." They had the means of measuring distances, but not angles; they knew no -property except personal property in the form of pickaxes, pans, supplies, camp-equipage, horses or mules, and mining rights. The earliest codes which they developed expressed what might be called the law of the lariat. With the lariat they measured the distance assigned to each miner along the gold-bearing gulch-a double portion to the discoverer, and a single portion to his successors, in the order of their coming. With the lariat, they hung, after such due process of law as was available, the rascal who stole a horse, or a bag of gold-dust, or a; mining claim, or killed another man without giving him fair notice and a chance to defend himself. In these pioneer codes, adopted in mass-meetings and enforced by the same authority, two features concern us most:

Fox perhaps one hundred years scientists have been engaged in attempts at devising a satisfactory method of classification of coal. During this time many charts, tables and graphs have been proposed, some of which have had considerable merit, but no one system has been found to be applicable to all ranks of coal, nor has any one system received general acceptance. In many of the proposals, water eliminated between room temperature and 105° C. has been regarded as extraneous matter and calculations have been made to the air-dry or water-free basis. Such methods of. calculation do not lend themselves to satisfactory grouping of the high-moisture coals.1,2 A consideration not only of the properties of the high-moisture coals and their behavior on drying but of the generally accepted ideas of the coalification process and the role of water in this process indicates that water is an essential constituent of all coals and therefore should not be neglected. For example, in such low-rank coals as the lignites of the Northern Great Plains' deposits the inherent moisture of the lignite as mined plays a very important part in the physical properties thereof. Freshly mined lignite contains upwards of 30 per cent water and is extremely tough and resistant to shock. Upon exposure to the atmosphere, the lump loses part of its moisture and checks and splits, leaving a friable and broken up residue. So far as we have been able to determine, water is the only thing lost in this process and we are forced to the conclusion that moisture plays an extremely important part in the structural properties of the original lignite. With reference to the coalification process, Mack and Hulett3 pointed out in 1917 the important part that water played therein. They observed that water cannot be removed from peat or coal by pressure alone, but only as the result of chemical reaction, and suggested that peat in its early stages may be largely a hydrosol. Slow chemical changes occur over a long period of time until finally the mass becomes more largely a hydrogel. These views are substantiated to some extent by the experi-

The problem of disposing of excess waste water coming from The Anaconda Co.'s two uranium mills in Grants, N. M., first confronted the company's engineers in 1956. The increased discharge of mill waste water was due to the start-up of a second mill, recently completed to supplement production from a smaller plant which the company had operated since 1953. The waste water is mildly acidic and has a low level of radioactivity due to small amounts of uranium-natural, thorium-230 and radium-226. In addition, it contains large amounts of manganese, iron and the sulfate and chloride salts of sodium, calcium and magnesium.
