It is a time-honored custom in this, as in other kindred bodies, for the retiring President on giving place to his successor, after a year of official duties which have been the means of directing his attention in a more than usual degree to the work and interests of the Association, to report the results of his observations from this outlook, and the thoughts that may be suggested by the view. In looking out over the many fields of activity within the range of this Institute, the attention may be arrested by special features marking recent progress and development, or such as by their meager outline or lack of important detail stand in less pleasing contrast, or. even form unsightly objects in the view. It may be that the special field and particular work in which one is engaged will, when observed from the more distant standpoint, or in the light of the whole outlook of the profession, assume a different aspect or develop features of new interest and importance. In this way some special object may suggest to the observer a, fitting theme for the occasion. To others, again, an outline of the whole view may seem a more useful subject for study and review. All fields are examined and the wide horizon of the whole profession scanned to note and report whatever is new in knowledge and practice—the new permanent bench-marks that appear near the horizon designating ground definitely located; the stakes which mark reconnoissance into new territory, and even the prominent objects that faintly appear through the mist of the distant atmosphere, and which may serve later on as points of attachment for the advancing lines of survey into the unknown. Many of the sedimentary rocks contain small amounts of radioactive constituents. These vary in quantity in different layers. Some recent deposits show rather high activity as; for example, the deep sea oozes and some lake deposits.lv2 Measurements made in boreholes have also shown considerable changes in activity from horizon to horizon. The first to publish data on this fact was Ambronn,3 and recently Russian geophysicists have shown remarkable variations of activity from one layer to the next in various wells. Spak4 felt even that he was able to line up horizons from data measured in two neighboring wells.‡ The measuring of radioactive radiation is fairly difficult. Large errors are possible by the circulation of gaseous emanations in the well and porous strata. It is, therefore, never certain whether the activity of the layer where the instrumental device or collector is located will be measured, or that of some adjacent layer. For this reason it seemed to be advantageous to take samples of rocks into the laboratory and test them there for their contents of radioactive material. Such a method has been followed in the past to distinguish radioactive ore from other rocks. Radioactivity of rocks, especially of the igneous type, was also determined in the laboratory by numerous authors for absolute age investigations.= Corresponding data from studies of sedimentary formations are scarce. Specimens taken from a core of the Bradford oil sandstone were tested by Landsberg and Ingham,7 with the results illustrated in Fig. 1, which shows that within relatively small vertical distances the differences of relative activity were considerable. If one assumes that the distribution of radioactive material is fairly uniform throughout a layer, measurements of radioactive radiation in various horizons would offer additional information for stratigraphic

I AM very much impressed by this manifestation of international brotherhood; the mining engineers on both sides of the ocean have similar subjects to deal with, meet with the same difficulties, expose themselves sometimes to similar dangers; they are like companions in arms in the battle fought by mankind in order to subjugate the natural forces and to draw profit therefrom. There is no other field where this fraternity must manifest itself more actively than in the studies pursued with a view to improving the safety of mines and to rendering impossible in the future these mining disasters, which every year claim hundreds of victims. These are very difficult problems, the solution of which requires numerous and laborious experiments accompanied by very arduous scientific investigations; it is extremely desirable that the various mining countries, which have undertaken to solve these difficult problems, should unite their efforts in order to succeed as soon as possible and as well as possible. This idea has been fully grasped by your Bureau of Mines, which has brought me to Pittsburg; the daily exchange of views with the distinguished chief of-the mine investigation division, George S. Rice, and with his excellent collaborators, the comparison of the results obtained at Lievin and Bruceton, the checking of these results by means of new tests, the profound study of the measurements, diagrams, measuring and laboratory apparatus, the cooperative investigation of new apparatus, or the preparation of new investigations, are, I hope, of such a nature as to bring about great progress. I think that it will be interesting to you to know what has been done in France along this line.

The income of the Institute is derived from dues, subscriptions to MINING AND METALLURGY and sale of publications. These sources are fortunately supplemented by the interest from invested funds now amounting to over $500,000, a considerable portion constituting endowments for especial purposes. Aside from the medal funds the principal endowments are the James Douglas Fund for support of the Library, the Rocky Mountain Fund and the Seeley W. Mudd Memorial Fund. The income from the two last named is available for the support of research and a variety of other purposes. It is allocated by the Board of Directors upon recommendation of standing committees in each case. 'An active effort is being made to increase the endowments of the Institute, it being felt that unusual opportunities exist for research and public and professional service through the organization.

THE discovery of SAP alloys (sintered aluminum powders) by lrmannl has stimulated investigations in other alloy systems.23 Not only do such alloys have good room-temperature properties, but they maintain high strength after prolonged service at elevated temperatures. In addition, they show high structural stability, including unusually high recrystallization temperatures. These characteristics are secured by dispersion hardening. For this investigation, Zn-ZnO alloys were selected. Practically, the fact that commercially pure zinc recrystallizes near room temperature prohibits strengthening and hardening by cold deformation and therefore limits the application of zinc where mechanical strength is important. INTRODUCTION THE present sketch is submitted by request in the hope that it may serve as a basis for geologic discussion of the mining camps in Mohave County, which is experiencing a marked revival of activities. The region, commonly known as the Mohave district and Kingman district, lies in western Arizona in the southern part of Mohave County, bordering California and Nevada on the west (Fig. 1). Kingman, the principal-town; is situated near the center of the area. on. the Atchison, Topeka & Sante Fe Transcontinental Railway. This region is composed of naked desert ranges of mountains and broad detritus-filled valleys, the southern extension of the characteristic topography of the Great Basin. In altitude it varies from 500 ft. in the southwest to 8,300 ft. on Hualpai Peak southeast of Kingman. The mountains trend north-northwest. They rise about 3,000 ft. above the valleys, are generally rugged and were formed mainly by erosion. They are composed in the main of a, complex of pre-Cambrian granitoid rocks which underlies the area as a whole. Like the valleys, they average about 10 miles in width. Beginning on the east, they are the Grand Wash Cliffs, the Cerbat Range, the Black Mountains or River Range, and the Eldorado Range. The upper or dominantly cliff half of the Grand Wash Cliffs, marking the edge of the Colorado Plateau, is composed of nearly horizontal sedimentary Paleozoic strata of the Grand Canyon section, and the lower half of the underlying pre-Cambrian complex. The Cerbat Mountains situated in the central part of the area, and the Black Mountains situated between Detrital-Sacramento Valley on the east and Mohave Valley, the great trough of the Colorado River, on the west, are locally flanked or overlain by Tertiary volcanics (Fig. 2). The latter consist of five groups of mountains of which the most important is the Black Mesa group on the south. The Eldorado Range, rising from the great trough of the Colorado on the west and containing Searchlight, Eldorado Canyon, and other camps, is topographically and geologically similar to the Black Mountains.

This investigation was undertaken at the suggestion of Prof. Henry M. Howe, of the Department of Metallurgy, Columbia University, who, in a letter to the author, dated October 23, 1900, wrote as follows, suggesting the subject of this dissertation : "The extraction of silver from copper mattes by either the Ziervogel or the Augustin process depends upon converting the silver into silver sulphate by means of the sulphuric anhydride evolved from the decomposition of ferrous sulphate and cupric sulphate, which are formed during the roasting operation itself from the iron and copper sulphides present. "It occurred to me, some time prior to the autumn of 1897, that these processes might be made much easier by adding to them, at the proper stage, ferrous or cupric sulphate, or both, in the form of green or blue vitriol. That is, instead of having to rely solely on our ability to generate these sulphates in this very delicate roasting operation, my idea was that we could add a small quantity of already-prepared sulphate at the proper state of roasting, viz., at or before the period when the solphatizing of the silver occurs. The comprehensive audit of the accounts of a mining company is extremely important in its relations to the legal situation and obligations of the corporation, the personal liability of the directors, and the interests of the investing public. A consideration of the subject as affecting the professional duties and fixing the responsibility of a mining engineer engaged in the expert examination of a mine or in charge of mining operations, is equally important, though this phase of the question is not often presented systematically.

A method and equipment have been developed for measuring the impact strength of grains of brittle materials. It is shown that brittle materials develop a characteristic particle size distribution when fractured by impact. A simple mathematical model has been found to describe this distribution, and one of the parameters of the model has been designated the r value. The r value is directly proportional to impact energy and, for fixed impact energy, it becomes a useful criterion of grain strength. Data are presented on the variation of the r value as a function of sample history, initial size, energy input and number of impacts. The results are interpreted in terms of the flaw theory of brittle fracture. The view is now widely held that brittle materials comprise a strong matrix, throughout which flaws or points of weakness are scattered at random. Failure always starts at one or more of these imperfections, and planes of fracture are established by the geometry of the flaw distribution. This view has been developed extensively by Weibull 1,2 and experiments of a confirmatory nature have been reported.3,4 Thus the process of fracture or size reduction of brittle materials can be regarded as a process of elimination or creation of flaws, and the concept of strength is intimately connected with the size and history of the specimen tested. One consequence of the point of view described above is that brittle materials will fracture to yield similar size distributions, although the impact energy to produce a given amount of fracture may vary greatly from one material to another. Generally speaking, experimental investigations of brittle fracture in solids have been confined to two extreme experimental situations. On one hand, we have tests on single specimens of well-defined, but artificial, geometry and, on the other, empirical data have been obtained on the feed-product relation in a variety of mills. The first situation necessitates specimen preparation, which in the case of brittle materials is equivalent to a priori size reduction, while the second one suffers from the disadvantage that little knowledge is gained about individual fracture events. Also, the statistical significance of single specimen tests may be questioned. Our approach lies somewhere between these two extremes. We test a large population of sized specimens and yet subject each specimen to a single fracture event. In 1956 G.H. Fetterley of Norton Co., Chippawa, Ont., made the empirical observation that product size distributions obtained from impacting sized grits can be described by the following equation where R is the proportion by weight of the grain that remains on a screen having an opening x on a side, x, is a parameter having the dimensions of length, and r is a number. This equation has since been derived on a theoretical basis by Gaudin and Meloy.5 They identify x, with the initial size of the test piece and r with the number of flaws per unit length. As will be shown below, our experiments indicate that both x, and r are functions of energy and hence they should more properly be called the effective initial size and the effective number of flaws respectively. Also, our empirical data give us no basis for assuming that r represents the effective number of flaws per unit length, rather than per unit volume. METHOD AND MATERIALS The impact test machine has been designed to feed specimens, essentially one at a time, into an evacuated chamber, where they fall freely and are struck with random orientation by one or the other of a pair of flat steel vanes. The vanes are mounted at opposite ends of a steel bar, which rotates at a closely controlled angular velocity about a vertical axis. Fig. 1 shows the flat circular vacuum chamber with the cover removed, and the horizontal steel bar with the steel vanes at the ends. The cylindrical pot in which the grains are collected after impact appears at the left. Fig. 2 shows the equipment assembled for a test. The early work of Terzaghi1 showed that the true stress state of a rock can be expressed by the principle of effective stress. This principle states that effective stress is equal to total applied stress minus the pore pressure. Since the introduction of this principle, a great effort has been made to measure the pore pressure of rocks so that the true stress state can be determined. For clean, permeable sandstones, it is usually found that the effective stress principle can easily be applied. Direct measurement of the pore pressure is achieved with a hydraulic pressure device and the effective stress state thereby computed. However, for fine-grained rocks which contain large amounts of clay (referred to herein as shales), pore pressure measurements are usually quite difficult because of the adsorptive forces of the clay platelets, which produce negative internal pressures. No suitable device is known for measuring internal pressures of dry shales; the effective stress approach is therefore not feasible and data are usually presented in another form. As an example, data from compressive strength tests are presented as a function of rock wetness, rather than effective confining stress. The work of Belopoloskii2 and Colback and Wiid3 are examples of such data. It was pointed out by Lambe and Whitman4 that a better way must be found to express the effective stress of argillaceous rocks. The information presented herein is an attempt to fill that need. Various authors have been able to measure moderate negative pore pressures (0-240 psi) within rather wet, argillaceous rocks by means of various pore pressure devices. In 1961 Lambe5 resented information which shows that pore pressures in argillaceous rocks are indeed negative ; he presented values of suction pressure as low as - 14 psi. Likewise,

The electrical specific resistance of rocks in the field is measured by sending a current through a medium of great volume, compared to the electrodes, whose resistivity should be measured. The whole resistance can be determined by the Wheatstone bridge and the specific resistance calculated by a well-known formula. The resistivity of some rocks in place in Germany and in Switzerland is given; first, of a rock near the surface, and especially near electrodes. Practical applications are made in the determination: (1) of the continuity of a conducting orebody; (2) of the surface ares of an orebody; (3) in the detection of a water-bearing fault in a salt mine. Preliminary 'observations are described: (1) on the influence of the depth of ground-water table; (2) on the detection of gas under high pressure in coal seams. The observations in this paper of the electrical resistivity of rocks and soil in place are along the lines of the very interesting method and results of the Messrs. Gish, Rooney, Hotchkiss and Fisher. 1,2 All the work described has been done since 1920. Method Used The very simple method consists in the application to the rock of two plane circular electrodes of iron or brass of a suitable diameter, with the aid of a contact substance, and in measuring the resistivity in a Wheatstone bridge with alternating current of 100 to 400 Hertz frequency per sec.). IT will soon become apparent that the Conference Committee's choice of the title for this presentation is a fortunate one for the speaker; since if it had read "Review of Known Facts Controlling Slag Volume" he would best step down right now. There is a dearth of facts in a quantitative sense on this subject, especially in regard to the effects of slag volume on the acid electric practice for steelmaking, as borne out by a library search involving some 175 references from 1915 to date. Even the opinions in these references on any phase of slag volume are meager. This, then, leads to a report that is candidly based on private observations, on readings and on conjectures gleaned from gossiping with fellow practitioners. Perhaps the subsequent papers, which, as I understand it, are substantiated by actual measurements, of slag volume versus specific contributing factors, will be able to acclaim or disclaim my remarks.

If New England were located in some distant and almost inaccessible region, there is no doubt that its mineral resources would have been ere this well developed and generally acknowledged, but laboring under the disadvantage of nearness, it has been neglected. Its surface, moreover, is not cut up by mountains and canons, and the remnants of many of the old ridges are extensively covered by glacial drift. Having for the past ten months been engaged in the development of a mineral district in Southeastern Maine, 1 would take this opportunity to lay before the Institute sketches of results, and try to give some idea of the formations as found. The Sullivan Mining District extends from the town of Franklin, through Hancock, Sullivan, and Gouldsborough, from northwest to southeast, about sixteen miles. A general idea of this locality may be gathered from the map accompanying. (Fig. 1). DURING the 30-year period spanned by these annual Howe Memorial presentations, many lecturers could proudly claim a kinship either as a student or an associate of the man whose memory we honor. Although it has been my good fortune to have attended many of these annual lectures, it was not my privilege to have known Henry Marion Howe personally. However, his great repute as teacher and scientist was known to all undergraduates of my day and the later years have enhanced my appreciation of his wisdom and foresight. Those who knew him well have said he derived particular pleasure from speculations on the future world of metallurgy. For this reason, I feel that perhaps he would not be unsympathetic to a lecture in his honor which departs from the highly instructive scientific presentations made in the past by so many able Howe Memorial lecturers, and which is concerned more with the practical phases of various steelmak-ing processes and some speculations on their future form and relative importance. The word "revolutionary" is frequently applied to each seemingly important improvement in the production of steel ingots, but in retrospect these changes, impressive as they appear at the time, are merely steps of progress. In the hundred years from the inception of tonnage steelmaking, only three processes can be truly classified as revolutionary. They are the pneumatic process, known in this country as the bessemer process; the reverberatory method called the open hearth process; and, the electric furnace process. There have been many variations and combinations of the three fundamental methods, but they remain truly the only revolutionary methods in steelmaking since its early history. Everything else has been evolutionary, in effect. doing the same things that we have done in the past but doing them better, correcting our errors through experience, and slowly but inevitably reaching a higher state of accomplishment. It has often been said that coming events cast their shadows before, and the production of steel ingots is no exception. As a result of the unrelenting demands of World War I1 and the years that followed, truly impressive progress has been made in steel ingot production. The incessant pressure for immediate results during this period required the employment of initiative and daring, as in few past decades, and many developments were brought to fruition. Of equal importance is the possible effect on future steelmaking methods of the many ideas initiated but still in formative stages. Fig. 1 portrays ingot production in the United States by the three fundamental processes over a period of 75 years and is interesting because it poses some questions as to future trends. The early ascendancy of the bessemer, its replacement in importance by the open hearth process, the amazing growth of the latter, and the recent challenge of the electric furnace are evident from the chart. Management is fully aware of these changes, but is even more interested in the future trends. Our concepts of the relative importance of the more recent developments and their possible effect on future processes may perhaps be best exemplified by a specific, hypothetical problem. Let us assume management is contemplating a new ingot producing plant with an output of 100,000 net tons per month, located in an area where some purchased scrap may be obtained but where by far the largest component will be own-produced blast furnace iron. Management requires a process or combination of processes which will yield highly uniform quality characteristics in the ingot form, and represent the soundest selection in investment and operating cost. Under these conditions, the obvious selection for the past four decades has been the open hearth process but, in view of more recent developments, management may believe that it is no longer permissible to disregard other possibilities with impunity. Accordingly, to be assured of the best possible selection, they request that you review not only the possibilities of utilizing the conventional open hearth, duplex, bessemer, and electric furnace methods, but also the more recent developments, such as the turbo-hearth, the Linz-Donawitz method, the Perrin modifications, and other possibilities. With this background, one might then appraise the relative importance of these methods to meet a specific need, and concurrently speculate on the forms that future ingot processes will assume and the relative importance of these processes.

INTRODUCTION Landowners in Texas for many years have freely granted, reserved and leased "oil, gas and other minerals" or interests therein. In recent years we have witnessed much litigation concerning what sub- stances should be included as "other minerals" within the phrase "oil, gas and other minerals," and this question has received the attention of numerous legal scholars. At the South Texas Uranium Seminar held in Corpus Christi, Texas, in September, 1978, Mr. William R. Dodson presented a paper dealing with this very subject and entitled "Uranium - Mineral or Surface? Who Owns It?" In his paper, Mr. Dodson reported on two recent Texas Supreme Court decisions, Acker v. a, 464 S.W.2d 348 (Tex. 1971) and Reed v. Wylie, 554 S.W.2d 169 (Tex. 1977). which held that the particular substance in question in each case is not a mineral within the phrase "oil, gas and other minerals" if substantial quantities of the substance lie so near the surface that production will entail the stripping away and substantial destruction of the surface. Since that time another chapter has been written in the Texas saga of "When is a Mineral not a Mineral?" and it is the intent of this paper to present an update of the Texas law. A review of the early Texas cases so ably covered by Mr. Dodson in his paper will not be repeated, except as is necessary to illustrate the evolution of the legal doc- trine which has been so aptly named "The Surface Destruction Test". BACKGROUND In order to appreciate the genesis of the problem, one must consider that oil and gas production commenced in Texas many years ago, Spindletop came in in 1901. As oil and gas became more valuable, land- owners with considerable frequency sold interest in the oil, gas and mineral estates in their lands, and reserved interest in the oil, gas and mineral estates in their lands when they disposed of their property. Due to the oil and gas background, and perhaps be- cause oil and gas was paramount in the minds of the parties, the traditional language employed in these grants and reservations was "oil, gas and other minerals" or variations thereof. There are literally hundreds of instruments employing this language constituting a link in the chains of title to thous- ands of acres of Texas land. In addition, there are thousands of acres of Texas land held by oil, gas and mineral leases, the primary terms of which have been perpetuated by production, containing similar language in their granting clauses. The severance of the mineral estate from the surface estate results in two separate and distinct estates, each having all of the incidents and attributes of an estate in land. with the surface estate being the serviant estate, and the mineral estate being the dominant estate and having certain easements in the surface estate to explore. produce and remove the minerals. Harris v. Currie. 176 S.W.2d 302, 305 (Tex. 1943). As observed by the court in the Harris case, this is because a grant or reservation of minerals would be wholly worthless if the grantee or reservor co~lld rwt enter upon the land in order to explore for and extract the minerals granted or reserved. Although the Texas law has recognized that an oil and gas lessee has the right to use so much of the surface as is reasonably necessary to produce the minerals. Warren Petroleum Corporation v. Monzingo, 304 S.W.2d 362, 363 (Tex. 1957), recent decisions of the Court have qualified this doctrine. In Getty Oil Company v. Jones. 470 S.W.2d 618 (Tex. 1971). Getty's pumpine, units were interfering with ones self-propelled sprinkler system utilized for irrigating the premises, and Jones sought to require Getty to install the-pumping units in cellars so that the sprinkler system could pass over them. In an effort to accommodate both the surface estate and the mineral estate, the court held (page 622) "...where there is an existing use by the surface owner which would otherwise be precluded or impaired, and where under the established practices in the industry there are alternatives available to the lessee whereby the minerals can be recovered, the rules of reasonable usage of the surface may require the adoption of an alternative by the lessee". Bearing in mind that the "reasonable use doctrine" grew up in the oil and gas industry involving sub- stances which can be produced by methods that do not destroy or deplete the surface estate, the question presented is whether the Texas courts will extend this doctrine to situations where claimants of "other minerals" seek to produce shallow deposits of iron ore, coal, lignite and uranium by surface mining methods which do destroy or deplete the surface estate? The surface destruction test has answered this question in the negative, at least as to iron. coal and lignite. However, the multitude of mineral estates in Texas which have been created by a grant. reservation or lease of "oil, gas and other minerals" will, doubtlessly, continue to fuel the fires of litigation. ALTHOUGH iron ores occur in many parts of Sweden the two principal deposits are those at Grängesberg (see accompanying map) and at Kiirunavaara-Gellivare. Both of these deposits are con-trolled by a holding company, Trajikaktiebolaget Grängesberg-Oxelösund, which sells annually about one-half of, the iron in ore traded in world markets and has a fleet of 24 seagoing ore boats, with a total dead weight capacity of 172,500 tons. Because of its pre-eminence in international iron ore trade a brief outline of its operations will be of interest. ORE DEPOSITS OF GRÄNGESBERG The Grängesberg deposits have been known since the Middle Ages, but up to the middle of the nineteenth century the ore was transported from the mines to the furnaces in winter in. sleighs. Railway building began in 1853, and in 1873 the complicated structure of capital investment was tottering, but the basic bessemer process created a demand for ore high in phosphorus, as this is, and refinancing on the initiative of Sir Ernest Cassel put the principal operation on a firm footing. There are numerous property owners in the district, but they are all controlled by a joint administration board, and 90 per cent of the ore is produced by a subsidiary of the Grängesberg company from proper-ties which it either owns or leases. The ore, a mixture of magnetite and specular hematite, is in lenticular bodies, dipping about 70 E. in. fine-grained gneiss, and contains about 61 per cent Fe and 1 per. cent. P. There are two principal veins; the total ore reserves to a depth of 500 meters are estimated at 150,000,000 tons. As seen in the accompanying illustration, the ores were first worked in open cuts, but eventually underground shrinkage stoping was adopted. Difficulties were encountered in the support of the workings and from the freezing of the ore in the stopes, so slicing was adopted, although block-caving is used in one place. Most of the mining is now done at a depth "of 150 to 190 meters. The present annual output is about 1,400,-000 tons of crude ore, which yields about 1,000,000 tons of concentrate after being subjected to magnetic con-centration and jigging.

HAVING told you about steel in the previous chapter, it seems to me necessary to speak here of brass for the same reason, for it bears the same relation to copper that steel does to iron. It is the opinion of some concerning both of these that they are true minerals because Pliny in his Natural History calls it aurichalcum and says that it has its own ore; he does not say, however, where it is found, and I have not heard from anyone else that it has been found anywhere, and, surely, if it had been found when he wrote, it would also be found today. Since I have no knowledge other than that gained through my own eyes, I tell you as a certainty that just as steel is iron converted by art into almost another kind of metal, so also brass is copper given a yellow color by art. How do you make a mine out of 500 000 kg (1.1 million lb) of uranium oxide contained in a low-grade deposit with high clay content? Confronted with these limited reserves and mineralogical problems at France's St. Pierre du Cantal uranium deposit, engineers adopted a rather unusual mill process to keep capital costs to a minimum. Crushing and grinding were eliminated by using a high pressure monitor to slurry ore directly from stockpiles. After mechanical separation of the high-grade fines from low-grade sand, the sand fraction is washed of clay to increase permeability and then it is heap leached. Fines are sent to agitated vessels for acid leaching, and the pulp from this operation is diluted by pregnant solution from the heap leaching.

THE Blueberry mine is about 10 miles west of Ishpeming, Marquette County, Michigan. The property consists of about 2000 acres in sets. 3, 4 and 5, T. 47, N.R. 28W. and sets. 32, 33 and 34, T. 48, N.R. 28W., and, excepting one intervening 80-acre tract, contains the iron formation for a length of about 2 1/4 miles. The property is traversed by State Highway M-28 and is served by three railways, the Chicago & Northwestern, the Duluth, South Shore & Atlantic, and the Lake Superior & Ishpeming. The Northwestern transports the ore to a dock at Escanaba; the other railways, to Mar¬quette. Ore for Chicago goes via Escanaba and that for Lower Lake ports, as Detroit, Cleveland, and Buffalo, via Marquette.

The writers have no new system and no new principle of taxation to propose. The general subject of taxation is as old as governments are and as familiar to taxpaying Americans as the general thesis on the inalienable rights of man. We believe, therefore, following the committee of the National Tax Association, that improvement in the general conditions of taxation, including mine taxation, maybe brought about mainly through a better adjustment of known and tried principles and methods of taxing to modern complex forms of property and income, and that not much is to be expected from abandonment of experience for new ways and means, methods and principles, should anything new be discovered, which in our opinion is very doubtful. The committee referred to has constructed the general framework of its Model System of State and Local Taxation1 on familiar forms of taxing, by eliminating some that ' have proved bad, suggesting improvements in others, and adopting the best, leaving plenty of room for the accommodation of the general plan to the varying conditions of taxation in the several states. Unfortunately, the taxation of mines is dismissed by the committee with the statement that the subject has been reassigned for further investigation and report by a special sub-committee, frankly recognizing that the peculiar difficulties of this phase of the subject require special study and investigation. Much may be hoped for from the labor of this sub-committee if the problem is approached from the viewpoint of recommendations already published. In this paper, the writers state their opinion on some of the broader aspects of mine taxation with too little attention to the grounds on which they rest. Contrary to inclination space requirements compel them to resort to summary statements without adequate discussion for a satisfactory presentation of the whole subject. All they can do is to qualify the witnesses and record the testimony.
