THE decision of the Supreme Court of the United States not to review the findings of the lower courts closes an interesting chapter in the mining litigation that has arisen as a result of the extralateral feature of the mining law. The time seems opportune to record some of the important geological features, and also some of the legal features, of the controversy, in the hope that these will be permanently accessible to members of the mining profession. After many rumors of litigation, the Utah Consolidated Mining Co. sued its neighbor for the ore that had been, it was alleged, wrongfully extracted from its so-called Yampa limestone lode. This ore lay beneath Utah-Apex surface and was claimed by virtue of the extralateral rights conferred on the Utah Consolidated Co. through the ownership of certain specific mining claims, one of the principal claims being the Yampa. Previous to bringing suit, the Utah Consolidated Co. had strengthened its position by purchasing the Old Yampa mine and by making an agreement with the Utah Metal & Tunnel Co., which gave it clearer title to the outcrop of the Highland Boy limestone. Access to the workings of the Utah-Apex Co. was secured and reciprocal privileges gave Utah-Apex representatives the right to enter the properties of the Utah Consolidated Co. This resulted in the Utah-Apex immediately bringing countersuit for ore alleged to have been wrongfully extracted from under its surface in the Leadville country, see Fig. 4. Six cases came up for consideration: five related to the original suit and the countersuit, and one related to the Dana extralateral claims of the Utah-Apex Co.

The science of particle shape analysis has expanded rapidly in the decade since precise numerical-statistical techniques were developed for use in characterizing the shape of closed forms. Use of Fourier descriptors permits shape to be quantified to whatever degree of precision is required. With this technique, particles and particle systems can be compared either on the basis of shape characteristics displayed by individual particles, or on the basis of aggregate shape characteristics representative of large samples of particles. Shape characterization work completed to date has shown that the physical characteristics of particle systems (porosity, permeability, strength, mechanical stability, chemical reactivity, and flow characteristics (viscosity)) are related directly to particle shape. Furthermore, it has been shown that particle shape is a function of chemical composition, process of formation, and post-formational history of the particle. In this light, particle shape analysis has potential applicability to a host of engineering and industrial problems encountered in processing particulate material. It can be used to optimize the efficiency of separation processes and particle feed systems, to trace particle pathways through processing systems, and to monitor the operation of specific processes, the wear of critical machine parts, and the quality of end products in processing systems. In this paper we discuss these specific applications of shape characterization to particle processing.

In practically all rock-excavation problems there is need for a careful study of the rock structure, its fault, cleavage or bedding planes, and even the texture of the rock itself. These studies should form the bases upon which an excavation method is selected and they should be carefully considered in predicting the amount and extent of the excavation. The need for such studies was forcibly illustrated in the problems involved in a cut made in 1929, along and underneath a 200-ft. high rock projection for a State-highway near the City of Easton, Pennsylvania. The rock mass was badly faulted and also contained a number of cleavage planes at approximately right angles to the fault planes. Much of this structure was visible and could have been studied and analyzed before' the work was begun. The State had rigid specifications as to finished grade and slope of cut, which apparently were made without reference to the geologic structure. The contractor complied with the specifications, under the close inspection of the State engineers. A tunnel blast was, placed in the base of the cliff, with the result that 65 per cent more rock was broken than was intended by the specifications. About four years after the blast, the writers of this paper studied the circumstances surrounding the operation, to determine the cause of this excess excavation.

So much has already been wimitten on this vast subject of ground movement and subsidence, and so many data collected and commented upon, that in this paper the author proposes to confine himself to the submission of some plans showing what has actually occurred in the mining of several of the orebodies which have come under his direction during the last 20 years or so at Rio Tinto, Spain. Some notes are added for the purpose of describing the plans. The author does not attempt to give his opinion as to the reasons why the subsidences have occurred in the manner in which they are found, but confines himself to giving as true a picture as possible of the movements that have taken place. Effects of Excavation on Ground Movement Broadly, the effects of excavations on the overhead or adjacent ground can be classified under three headings, as follows: 1. Ground movements due to excavations made from surface only, such as those made in opencasts where no excavations underlie them. The stability and strength of the ground to resist movement must determine the slopes. 2. Ground movements due to underground excavations only; i. e., where the surface is not removed. 3. Ground movements due to a combination of both; i. e., from excavations taking place from the surface for the purpose of stripping an orebody and recovery of the ore to a certain horizon combined with excavations being carried out below, at the same time, for the winning of the ore below the horizon at which mining by stripping or opencasting under the specific conditions is no longer economical. Nos. 1 and 2 represent independent and distinct problems and No. 3 is a combination, which presents results much more difficult of explanation. The accompanying plans and sections give examples of what has occurred under the three conditions. Unfortunately, the class of ground is not exactly the same in them all, but the difference is not greater than is generally encountered over districts of equal area. The advances in basic open-hearth practice which have occurred during the past decade have been principally in the direction of the physical development of larger units, decreased fuel consumption and increased length of furnace campaigns. However gratifying the economies which have resulted from these improvements are, it must be granted that like advances in chemical, physical-chemical and metallurgical knowledge pertaining to open-hearth practice would have added greatly to these already attained reductions in costs and it is the purpose of this paper to stimulate the discussion and study of these phases of cooperation and their relation to ingot yields. Definition and Calculation oF Losses In discussing basic open-hearth yields, the writer refers to the ingot yields obtained in the process of converting pig iron, scrap and ore to steel. In this conversion some scrap is produced. The difference between the total weight of ingots and scrap produced and the original metallic charge constitutes the loss. Basic open-hearth yields vary considerably, and while some of the divergencies can be explained metal-lurgically because of differences in slag analysis, proportion of pig charges, and character of steel made, there often remain differences that apparently do not readily disclose themselves. In reconciling yields by the usual accepted methods of calculation, one is often forced to evaluate large losses as ((unaccounted for." Such a system is prone to accept these large losses as inherent to the operat.ion and not, susceptible of appraisement and correction. It is obvious that if the ingot yield plus the scrap recovered subtracted from 100 per cent. determines the loss, a drop in yield may increase the loss or the scrap, and both contribute to a monetary loss. To be sure, one can subdivide these unaccounted for losses into various components, such as metallics in slag, free Fe in slag, spillage, etc., and thereby reduce the amount of losses considered as "unaccounted for." If empirical methods could indicate with some degree of accuracy all losses, however slight, the undetermined losses become appreciably smaller and resultant calculations will check actual

This note will give the cost of driving an adit at the Melones mine, in 1898, and, for purposes of comparison, the cost of similar work, in 1888, at the Hogsback mine, Placer county, Cal. The property of the Melones Consolidated Mining Company is situated on the Mother Lode of California, on Carson Hill, near Robinson's Ferry, and adjoins on the south the famous Morgan mine. The Mother Lode of California extends for a distance of over 100 miles in length through several counties, with a general strike of northwest and southeast. Three veins (commonly called the east vein, middle vein and west vein) comprise the " lode " in this section. The Melones property is situated upon the east and middle vein, and includes 1407 feet on the east vein and 5166 feet upon the middle vein. A shaft had been sunk on the Reserve mine, which is on the east rein, and within 230 feet of the Morgan mine. At the bottom of this shaft drifts and cross-cuts had been run and a large body of ore developed. It was deemed advisable by the Melones Mining Co., which holds this property under bond from the Melones Consolidated Mining Co., to run a tunnel and develop this body of ore at a greater depth. An option was obtained upon the South Carolina mine, which adjoins the property on the south, and is on the same east vein, upon which a tunnel had been run a distance of 1080 feet. This tunnel was cleaned out and continued to a point within forty feet of the Morgan mine. It passes directly under the Reserve shaft, 425 feet below the 200-foot level. MAGNETITE is the important iron ore of New Jersey although bog ore, limonite and red hematite were mined in sizable quantity early in the state's min-ing history. The deposits of mag-netite are found in the Highland area in the northern part of the state. These ores outcrop a broad belt 20 miles wide, extending in a northeasterly direction from Phil-lipsburg, on the Delaware River, to Greenwood Lake, at the southern boundary of the state of New York, a distance of 60 miles. The area in which the magnetite is found (see map, Fig. 1) contains 1200 square miles and the center of the area is at Dover, 40 miles west of New York City. In the general area are found 18 parallel ranges or lines of ore deposits. These ranges may be re-garded as mineralized zones in which occur orebodies that are rich enough in magnetite to war-rant mining. Usually a number of the orebodies lie one above the other in the same plane, all dipping and pitching in the same direction. Within the ranges, there may be several parallel orebodies of work-able size. The average strike of the orebodies is N.41° 30' E., with an average dip of 55° southeast and an average pitch of 15 ° to the northeast. Orebodies suitable for mining range from 6 to 100 ft. wide, as measured from foot wall to hanging wall. Their heights, as measured on the dip and normal to the long axis of the orebody, vary from 200 to 3,000 ft. The length along the pitch has never been determined by mining, al-though several of the orebodies have been worked to lengths of 10,000 ft. The grade of the ore as mined today varies from 30 to 60 per cent iron, and the gangue min-erals are chiefly silica, alumina, magnesia, lime and phosphorus.

Prof. Henry Lours, of Armstrong College, Newcastle-on-Tyne, England, a distinguished member of this Institute and other technical societies, has recently sent to the Institution of Mining Engineers, and to the Institution of Mining and Metallurgy, in Great Britain, a communication, the substance of which is as follows : Professor Louis calls attention to the absence of any recognized English term for the definite description of a frequent phenomenon—namely,the oblique position of an ore-body in the plane in which it lies. In this connection, Professor Louis says that in America the term " pitch " has been occasionally applied to this relation, and proposes that, in the literature of ore-deposits, it shall be hereafter restricted to this particular meaning, the angle of the pitch, like that of the dip, being always measured from the horizontal, and the dip being always taken at right angles to the strike, while the pitch is taken on the plane of the dip, in the direction of the strike. Thus, for example, in a vein or bed striking N-S., and dipping, say, 45' E., there might be an ore-body, the axis of which pitched northward, at an angle of 45O below the horizontal line, as measured on the plane of the inclosing vein or bed. If' the term " pitch " had this universally recognized meaning, the situation could be simply and perfectly expressed by its use, in connection with the general data of strike and dip. As Professor Louis says: "This suggestion has a certain practical value, and is not merely academic. Every mining engineer of practical experience in such types of ore-deposit will have met with cases, in which a vertical shaft has been sunk with the object of cutting the deposit, but has missed it, because the dip alone has been taken into account, while the pitch has been overlooked." He adds the acute observation that such an oversight is much likelier to occur with regard to a condition not definitely desig-

MetallURgical research has discovered many an alloy possessing properties not combined in any single metal, and progress still consists chiefly in the investigation and utilization of alloys. In the case of iron, the demands of automobiles, high-speed machines and high-duty engines have led to the production of special iron alloys which will meet any reasonable specifications in that field. In like manner, the bronzes, brasses and other alloys of copper have been brought to remarkable perfection, and for nearly every industrial purpose some alloy has been , found more suitable than the pure metal. Less complete success has attended the attempt to find substitutes for gold, platinum, and the other precious metals. Indeed, it is not likeiy that a material can be produced which, will possess all the properties of any one of them; yet it is reasonable to hope that, for any given use, the properties required may be found in some less expensive material. Thus, in incandescent electric lamps, the wire passing through the thick glass neck of the bulb was, until recently, almost universally made of platinum, for the single reason that no other known material, suitable as a conductor, had the same coefficient of expansion as glass. But a comparatively recent investigation of the iron-nickel series1 has shown that alloys of those metals maybe produced, the coefficient of expansion of which can be accurately controlled between that of iron or nickel and zero. Thus, in that particular industry, a substitute for platinum has been found. According to statistical reports, not only considerable quantities of gold and iridium, but also more than one-third of the annual supply of platinum, are used (and, in the nature of the case, irrevocably lost) by dentists. Platinum is thus employed in several forms. As a thin foil, it serves various purposes for which its high melting point, pliability, chemical resistance, and other properties—including the ease with which it may be soldered—are invaluable. MY subject covers the effect that recent metallurgy has had on operations at the Utah-Delaware mine. This mine is the old Highland Boy mine of Bingham Canyon, Utah, one that has now been in operation for about 30 years. It was first operated by Messrs. Weir and Newhouse as a gold mine, under direction of the Highland Boy Gold Mining Co. The ore was oxidized gold ore and it was treated on the property in a cyanidation plant. During the process of development, sulfide ore was found assaying about 5 per cent copper. It proved to be the discovery of what is yet the largest sulfide copper orebody in the State. The first shipment was made in December, 1896. A smelter was built in Salt Lake Valley to treat this ore and not long after the property was sold to the Utah Consolidated Mining Co. From 1900 to 1924, the mine was a large producer of direct-smelting ore which averaged for many years 4.5 per cent. copper, then later dropped to 2 per cent. copper. During the years 1912 to 1920, direct-smelting lead ore was also mined. In 1918'and 1919 ore developments at depth showed a decided increase in silica content and a porphyry sill so closely associated with the ore that it was impossible to mine the ore clean and it was found necessary to build a copper flotation Eoncentrator at Tooele. The mill had a capacity of 1000 tons a day and made a recovery of 90 per cent., and would have been responsible for a continuance of profitable operations had it not been for a slump in the copper market and the necessary high cost of mining ore on the lower levels. RESULTS OF SELECTIVE FLOTATION In 1924 the mine was on the point of a shutdown which had all the earmarks of being permanent; it was being operated at a heavy loss and preparations were made to pull the pumps and salvage the machinery. The plant at Tooele was remodelled for selective flotation by the Inter- national Smelting Co. in order to treat custom ores, and incidentally to clean up a possible 10,000 tons of lead-zinc ore which it was thought possible to get in the Utah-Delaware before shutting the mine down. Results were so encouraging that an effort was made to develop more lead-

With portions of two coal basins within its borders and a few scattered fields already developed, the question arises: What is the future of Kentucky as an oil-producing State? Is the long list of failures due to lack of commercial pools, or unintelligent prospecting? A study of its beds and irregularities of structure points not only to a large waste of development money on unpromising areas, but also to the presence of a few structures well worthy of development. The surface rocks of Kentucky show in succession more than 4,000 ft. of Paleozoic sediments and more than 2,000 ft. of Cretaceous, Tertiary, and more recent deposits. Folding and erosion have brought these beds to the surface, where they have been observed and studied in detail by my associate, James H. Gardner, myself, and others. This has given opportunity to observe the beds offering suitable reservoirs and having the proper impermeable covering; also the mapping of outcrops and outcrop lines, taken in conjunction with available well records, indicates that certain areas are worth testing, and with even greater definiteness shows areas which should be excluded, as devoid of possibilities. West of the Tennessee River, Cretaceous, Tertiary, and Quaternary sediments occur so that all trace of ancient folding is obliterated, the sediments overlapping unconformably Mississippian rocks. This area embraces 2,000 square miles, or one-twentieth of the area of the State, the Paleozoic rocks covering the remainder. Since there is nothing upon which to base the location of tests for oil and gas in the Cretaceous-Tertiary beds of Kentucky, the Paleozoic area will be chiefly considered. The distribution of Paleozoic rocks in Kentucky is centered about the north-northeast striking Cincinnati geanticline, bringing to the surface on the Jessamine dome the oldest rocks exposed in the.State, those of the Devonian, Silurian, and Ordovician systems. On either flank of this great earth-arch are the Mississippian rocks, sloping gradually beneath the coal-measure basins to the west and to the east. West of the western coal basin, and. between it and the Cretaceous-Tertiary rocks further west, is a high area of Mississippian rocks. Crossing the State

THE sixteenth annual meeting of the Woman's Aux¬iliary, A. I. M. E., was held Tuesday morning, Feb. 16, at the Engineering Societies Building. The meeting was well attended, there being 99 registered from the metropolitan area and 78 from the sections throughout the United States. Mrs. Sharpless, the secretary, read the minutes of the annual meeting held a year ago, after which Mrs. Bassett, the president, gave her address of welcome. Mrs. Bassett said in part: "I would like, at this time, to welcome you all to this, our sixteenth annual meeting, and to express my appreciation to all the national officers and members of the board of directors for their loyal support and for the excellent work done by the chairmen of sections and their members. It is with much pleasure that I look back upon my visits with the sections in Washington, Arizona, Northern and Southern California, Chicago, Colorado, Western Pennsylvania and Utah before I assumed the office of president. During the last year I have much enjoyed meeting with the sections in Boston, Washington and New York. It is our duty to see that the achievement for 1932 be equal to that of the year that has just passed."

MARSHAL Foch has been made an honorary member of the four national American societies of civil, mining and metallurgical, mechanical, and electrical engineers. The governing bodies of these societies, aggregating 45,000 members, conferred this signal honor in expression of the appreciation of American engineers for the unmatched services of this master of engineering principles. At Engineering Societies Building, in New York City, on Tuesday afternoon, Dec. 13, the presidents of the four societies presented one beautifully engrossed certificate of honorary membership in the four societies. The auditorium was filled so that not even standing room was left, more than a half hour before the cere-monies began, and the main entrance on the street had to be closed. J. Vipond Davies, president of the United Engineering Society, made the opening address. Col. William Barclay-Parsons, 'who was commander of the first engineer regiment to go abroad, addressed Marshal Foch in French. Colonel Parsons said: The art of engineering was defined a long time ago as "the art of directing the great sources of power in nature for the use and convenience of man." No better definition can be found today. Of all the sources of power in nature, the greatest, the most valuable, and at the same time the most difficult to direct, is the energy of man himself. He who can direct human energy and turn it to the service of mankind is a great engineer. You, Marshal, have directed a greater mass of human energy than any other man has ever done. And you have successfully directed this mass for the highest uses of mankind, in that you by its aid have preserved for him one of the most precious of human possessions-liberty-liberty not only for your own illustrious country, but for all the nations of the world. The four national engineering societies, of the United States now desire to make record of their appreciation of this fact and to convey to you an expression of their most profound admiration for the great leader of men by conferring on you honorary member-ship in all the societies, the highest honor in their gift and one hitherto never conferred on a single individual. Four thousand members of these societies were enrolled in the armed service of the United States, the greater part of whom had the glorious distinction to serve the common cause in France under your orders. They heard the voice and they saw the hand of the master as he led them through battle to victory. Now we desire that you will still continue to lead us, but in peace, by permitting us to inscribe your name at the head of our roll of honor, where it will be, as your deeds have been, an example to us to do better work, and where it will remain forever a noble inspiration for all future generations. Marshal, in the name of those members of the societies who served under your orders and particularly .in the name of those who fell on the field of honor in France, I salute you.

Introduction Grinding circuits are used to reduce the particle size of ores to the size desired for beneficiation or to grind a concentrate to a size required for final marketing. Grinding and classification can be carried out using either wet or dry circuits. Most sulfide ores are ground in wet circuits using one or more stages of grinding to obtain the necessary mineral liberation to produce a final concentrate which will meet the desired criteria. Iron ores are ground in circuits applicable to the particular ore using either wet or dry grinding. Nonmetallic minerals frequently present different requirements. Barite is likely to be subjected to wet grinding before beneficiating the ore; the concentrate is dried and then dry ground to meet market particle size requirements. The one thing that most mill operators will agree to is that there is no such thing as the "best" configuration of equipment for grinding. The circuit which works well on one ore may be totally unsatisfactory for another ore body. The general trend in the industry is flow sheet simplication with fewer parallel circuits instead of multiple-line circuits using small mills. This change in philosophy has been brought about by the saving of both capital and operating costs that may be possible with larger equipment. Remember that comminution is basically a very inefficient process, and that the costs can range upwards to 50% of the total milling costs. It, therefore, behooves the mill operator to carefully design his grinding and classification circuits. He must ascertain the optimal economic particle size for beneficiation and then make certain he has achieved the best balance between capital and operating costs to achieve the desired mesh of grind. Equipment Grinding circuits consist of one or more pieces of equipment to grind the solids. Generally, these circuits include one or more grinding mills, classification equipment, and the necessary materials handling equipment such as pumps, pipelines, and conveyors. There are many different types of equipment available which are used to grind and classify ores and minerals. Following is a tabulation of most of the equipment used for wet and/or dry grinding.

The resistance to dry sliding abrasion us been measured for some hardened and tempered carbon steels. The wear resistance, defined as the reciprocal of the volume loss per unit sliding distance, is found to vary linearly with the hardness of the abraded surface. The data fit two lines, one, of high slope, for the pure metals and for the annealed steels and another, of smaller slope, for the hardened and tempered carbon steels. A relationship is developed showing the alwasion resistance to be proportional to the hardness of the material and to en, where n is the exponent of work hardening. The values of n and of the hardness FOR most materials a high resistance to abrasion is generally associated with a high value of indentation hardness. Brine11 even used the abrasion resistance as a measure of hardness in an attempt at expanding the hardness range covered by his indentation-hardness test.' When comparing different types of materials there is, however, only a very general relation between abrasion resistance and hardness. Sample brittleness seems to contribute to the deviation from a direct relationship. In general, increased brittle- are those relating to the heavily deformed abraded surface. However, for materials having n constant or varying m a regular manner over a wide range of strailts, the wear resistance will also be a linear function of the bulk hardness of the material. For tempered steels containing a dispersion of cementite in ferrite the increase in wear resistance due to the dispersion is found to be a linear function of the volume fraction of Fe3C and of the reciprocal of the mean free ferrite path. This indicates indirectly that the yielding of this material, when it is already heavily deformed, follows the Orowan criterion. ness leads to decreased abrasion resistance.' When comparing materials in the same group, e.g., the metals, the spread is less. Kruschov found that the abrasion resistance of pure metals and of annealed steels is directly proportional to the hardness of the metal. For hardened and tempered steels he obtained another linear relationship, one of smaller slope and intersecting the line for the pure metals at the location of the data for the annealed steels. He also found that the abrasion resistance of cold-worked metals is independent of the degree of cold working. This shows, as he concluded, that the process of abrasion work hardens the metal in the surface region to a very high degree.

ACCORDING to petrographic investigations, 1-4 cooled steel furnace slags contain a number of substances that have been shown to be ferro-magnetic5,6 and hence capable of undergoing appreciable changes of susceptibility with temperature. Since any alteration of the suscepti-bility of a constituent affects the average susceptibility of the sample, information concerning the nature of the substance should be deducible from its magnetic behavior. The possibility of obtaining information concerning slags in this way led to the construction of the apparatus to be described. FUNDAMENTAL PRINCIPLES OF APPARATUS The most convenient method of observing changes in mass suscepti-bility? with temperature is the one employed by Curie7 in his original investigation of the changes in magnetic properties of substances at elevated temperatures. As the method has been described frequently in the literature and in textbooks, only a brief review of the fundamental principles need be given here, but the particular arrangements used in the present work require a more detailed description.

THE object of the present investigation was to discover a physical basis for rank differentiation of coals, particularly the coals of the Illinois basin. Vitrain1 was selected as the most appropriate coal material to use in the investigation, because of its homogeneity and ease of acquisition and handling. Previous Investigations.-Hoffman and Jenker2 have shown that their index of reflection is a characteristic of coal rank and that the Leitz slit microphotometer may he used in determining the different intensities of reflection. Zhemchuzhnikov3 measured the luster of several Russian coals with a color analyzer and found that the degree of luster was indic-ative of rank. Luster-volatile matter curves based on data from Sucan and Donetz coals were satisfactorily used for determining the rank or volatile content of other coals after the luster strength was determined. In 1934 Fisher4 reported refractive indices of 1.76 for bituminous vitrain and 1.87 for semibituminous vitrain. Investigation of Angle of Polarization.-Early in the present investiga-tion several determinations of the refractive indices of the vitrains were made by immersing the minus 150 plus 200-mesh powder in oils. It was found that all the samples fell within the range 1.6 to 1.8. However, difficulty was encountered in securing oils in this high index range that were closely enough spaced to separate some of the coals. The writers made a number of determinations of the angle of maxi-mum polarization from the polished surfaces of the vitrains and derived their refractive indices by the procedure described in the follow-ing paragraphs.
