THE Sierra Mojada mining district is situated in western Coahuila, about 8 km. east of the Chihuahua state line, and about one-half way from the northern to the southern extremity of the state. It is at the terminus of the Mexican Northern R. R., 125 km. northeast of Escalón, Chihuahua; also about 240 km. due west of Monclova, Coahuila. The altitude is approximately 1500 m. above sea level. The Sierra Mojada valley is about 10 km. long, from east to west, with a width of 1 to 2 km. It is approached from the east through the Puerto del Oro, where the Mexican Northern R. R. enters the valley; the slope from west to east is gentle. The Sierra Mojada, of which about. 300 m. is an almost vertical wall, bounds the valley on the south side; on the north side, the slope to the crest of Sierra Planchada is more gradual, rising only 200 or 300 m. above the valley. Water is relatively scarce in the district, and there are no running streams. The rainy season, usually beginning at the middle of June, lasts through July, and occasionally into August or September. In some years the rains fail entirely. The slope of the ground is such that nearly all the water immediately runs off. The arroyos along 'the flanks of the mountains are not very deep, but in heavy rains, sometimes approaching cloudbursts, a tremendous volume of water rushes down them, carrying large boulders. A certain amount of seepage collects in the agglomerate, lying below the conglomerate, and is retained in the local fractures. Some shallow wells have been sunk in this agglomerate, and one well over 150 m. deep was sunk on, the Volcan ranch, supplying about 76 1. (20 gal.) per min. A considerable supply of water is collected in large earth reservoirs in and below the town of Esmeralda. In ordinary years this supply will last until January or February, after which the Volcan well has to be depended on until the next rainy season.

THE first presentation of this paper was before the Pennsylvania Anthracite Section of the Institute in May, 1914, after which a committee was selected to verify and add to the data contained in the original paper. The author is indebted to G. W. Engel, H. W. Montz, R. V. Norris, and H. H. Otto, of this committee, for additional information. I also wish to acknowledge the courtesies extended me by a number of the mining companies for information relative to accidents, systems of proving, and mining practice. The paper should bring forth additional criticism and recommendations, which will be of value in establishing future practice relative to this subject. Throughout the northern anthracite field of Pennsylvania glacial and alluvial deposits of sand, gravel, and clay exist in varying quantities. The extent and character of these deposits are described by N. H. Darton in Bulletin 45 of the U. S. Bureau of Mines, entitled, Sand Available for Filling Mine Workings in the Northern Anthracite Basin. It is estimated that the northern field contains 10,000,000,000 tons of these deposits, or a sufficient quantity to cover the 176 square miles of coal area to a depth of about 25 ft. These deposits of sand, etc., overlying the coal measures attain a maximum depth of more than 300 ft., and are usually saturated to such an extent as to render them semi-fluid. It is .this condition of fluidity that limits the mining of coal seams cropping in or in close proximity to these deposits, and it is in the interest of safer and more efficient mining methods under these conditions that the study of this -subject is here presented. The dangers incident to mining under deep deposits of sand have long been realized by operators in the northern anthracite field, and much has been done to prove the contour of the rock and vein croppings underlying these water-bearing deposits of sand and gravel.

IN recent years a considerable tonnage of the 18 per cent chromium and 8 per cent nickel steels has been used in lightweight high-strength structures that must be resistant to deterioration under atmospheric conditions. These steels are austenitic in character and their strength can best be increased by cold-working. Although a marked increase in tensile strength is obtained, claims have been made that the cold-worked steels do not possess fully satisfactory elastic properties. Under certain conditions, however, this has caused no great concern, because, as explained by Ragsdale,1,2 the cold-rolled steels have been widely applied for construction of lightweight, high-strength trains using spot welding for joining purposes. Ffield3 agrees that the ease with which thin sections of the cold-rolled 18-8 steels can be joined by spot welding is greatly in their favor, but that they would be more satisfactory if higher elastic properties and a higher modulus of elasticity could be obtained. He states that, as far as the mechanical properties are concerned, the straight chromium stainless steel is superior to the cold-worked 18-8 steel, and in order to illustrate, he presented the data of Fig. 1, which also give a stress-strain curve for a low-carbon 13 per cent Cr steel. Ffield? pro-posed that columbium-bearing or titanium-bearing cold-rolled 18-8 steels be given a heat-treatment (preferably for 1 hr.) in the range 400° to 600°C. to precipitate carbides in order to obtain better mechani-cal properties. Discussions by Sutton,4,5 de Ganahl,6,7 8 Krivobok and Lincoln,9 Knerr,10 and Thaden11 have given further information on the properties of the cold-rolled 18-8 steels compared with other materials used in light-weight, high-strength structures. These investigators and others point out that the ultimate tensile strength of the cold-rolled 18-8 steel can be increased to 200,000 lb, per sq. in. or higher; Krivobok et al. indicate that

THE ever increasing array of information concerning the measurement of the effect of the welding process on the properties of a steel is an indication of the tremendous effort that is being expended in this field. The methods that have been considered may be divided into two groups: first, those that measure directly the effect of welding on the ductility of a steel, and, second, those that observe the change in some property, such as the hardness of the heat-affected zone, and assume a direct correlation between this change and the resultant ductility. The nick-bend test is a direct method designed for studying the effect of welding on the ductility of a steel. The test specimen (Fig. I) consists of a bar cut from a plate with a bead weld on the surface. The specimen is prepared with a saw-notch placed so as to restrict deformation to the heat-affected zone under the bead weld when tested as a static bend. Failure is caused by rupture of the low-ductility metal in the heat-affected zone. The angle at maximum load is used as an index of the effect of the welding process on the material. In the development of the nick-bend test considerable scatter was noted in some of the results, although the agreement of duplicate specimens welded at the same time and tested consecutively was excellent. Upon further investigation it was found that the change in ductility was dependent upon the interval of time between the welding operation and the testing of the specimen. For the six steels of Fig. a, the angle at maximum load in four cases was doubled and in one case was tripled. All steels that have been studied show an improvement in the angle of bend for longer intervals between welding and testing. The last few years have shown an increasing interest in the subject of beneficiating iron-ores in all iron-producing countries. In the United States, this movement has been slower than in certain parts of Europe, for the obvious reason that the abundance and relative cheapness of the Lake Superior irou-ores has hindered the development of enterprises for the preparation of low-grade ores. Gradually, however, conditions have changed. The world's consumption of iron is increasing enormously. Being in 1900 about 40,000,000 tons, in 1910 it was already 60,000,000; and there is no reason to doubt that for the near future the increase in iron-cousumption mill continue at the same rapid rate, especially with the development of China, certain parts of Africa, and other regions which have hardly been touched as yet by modern industrialism. It is, therefore, not surprising that apprehension is felt that the known available iron-ore resources of the world are gradually being depleted. Signs of this feeling are the recent iuvestigation, under the direction of the U. S. Geological Survey, of the iron-ore resources of the United States, and the estimate presented to the last International Geological Congress, at Stockholm, Sweden, of the iron-ore resources of the world. These investigations have emphasized the fact that the known high-grade ore-deposits are limited in extent, and will, at a not distant future, be exhausted, compelling the iron industry to depend for raw material on the enormous deposits of low-gratle ores which are distributed over almost all the world. The discovery of new deposits of high-grade ore, in countries not yet thoroughly explored, will not materially change this prospect. Of course, the part which such new deposits will play in the future cannot be forecast. The difficulty and cost of transportation will probably exclude many of them from use at the present centers of the iron industry.

DETAILED knowledge of purchase specifications established by coal consumers is essential to the successful design and operation of a coal preparation plant. ANTHRACITE Specifications should be considered by both the consumer and the producer as guide posts outlining a certain path for both to follow. Plants differ, therefore specifications must differ to meet the varied requirements. Specifications are not of themselves a "cureall" or an assurance of complete satisfaction in fuel utilization. Specifications should not be regarded as a license to engage in an orgy of buying any and all coals that may happen to fall within their limits. This would lead to the indiscriminate mixing of coals which may vary in their burning characteristics. Different coals of equal grade tend to be individualistic in their burning characteristics. Rather, specifications should be used to help simplify coal selection, to reduce the actual number of coals used over a given period; in other words, to have a stabilizing influence on coal or customer turnover. In the final analysis, the use of too many coals per year in a plant is costly to both the consumer and the producer. Too many sources usually result in higher operating and maintenance costs for the consumer and higher sales costs for the producer. Finally, the statement included in the report accompanying the comprehensive Coal Selection Charts prepared by the Coal Committee of the National Association of Purchasing Agents, and released in 1938, is significant. This Committee worked diligently for a period of 15 years seeking to find a scientific and reliable method for selecting coals. The two following paragraphs are quoted from its report: More important is the fact that no ready-made classification or set of specifications can possibly replace the judgment and resourcefulness of an experienced combustion engineer or fuel technologist, nor the usual need for full scale plant tests under the exact conditions of use before a final decision is made.

This paper describes experiments carried on at the Case School of Applied Science, together with their results. Their success led to the design of the larger furnace herein described, but which has not been built. A PREVIOUS article' by the authors contained a general description of the new roasting furnace herein described but it did not go into detail as to the metallurgical behavior or the results obtained. Believing that such information would be of great value, they have elaborated on the subject and have given many unpublished details. The furnace described applies the principle of roasting finely divided zinc-sulfide ores, now produced in large quantity by the flotation process, in gaseous suspension; that is, the ore particles are carried, in suspension, in a current of air and gaseous products of the roast. The relatively great fineness of flotation concentrate presents difficulties and problems of roasting in furnaces of the ordinary type; the fine ore is forwarded through the furnace in the form of a shallow bed and its very fineness leads to dense impervious bedding which prevents oxygen from reaching the interior of the bed, thus unduly lengthening the time of roasting and preventing the elimination of the last of the sulfur. The fineness of the concentrate, normally, should lead to a rapid and complete roast, for the speed of roasting is a function of the surface exposed to oxygen, which surface is greatest, per unit of weight, in very fine material. The difficulty in bed roasting is to get the oxygen to the particle. If the fine ore, during the roasting, could be freely suspended in oxidizing gases, full advantage could be taken of the great surface conferred by its fineness. This fundamental idea, of course, is not new, for the Stedtefelt furnace, familiar to the older metallurgists, is an example of it; but the manner in which this is accomplished may be new.

Marked differences of opinion have been expressed by engineers interested in cleaning iron blast-furnace gases for use in hot-blast stoves and under boilers, in reference to the advantages of a hot-dry method over a cold-wet method. One point at issue involves the sensible heat energy in the moisture contained in the gas. Some advocates of the cold-wet methods claim that the condensation and resultant removal of the greater portion of this contained moisture by wet scrubbing, spraying or similar methods, results in a saving of some of this sensible heat energy, by reason of the fact that water vapor has a high capacity for sensible heat energy and may carry from the exit of a hot-blast stove, for example, more heat units than are sacrificed or lost when the gas is cleaned by this cold-wet method. Other advantages claimed for the latter method are: That gas burns more readily when it is free from moisture in any form; that because gas is made denser by cooling and removing the moisture it has a higher calorific value than hot gas carrying moisture; and that higher flame temperatures are obtained when the gas is cleaned by the cold-wet method. A search through the available literature fails to disclose any extensive calculations or records of conditions obtained in practice, bearing upon these phases of gas cleaning. This paper deals with these problems from the standpoint of the economy of using a gas of higher flame temperatures, of improved stove design, and of economy in the gas-cleaning department. Calculations have been made which show that by cleaning the gases by a cold-wet method the sensible heat energy of the blast-furnace gases is greatly reduced; and, in general, this loss of heat energy is far greater than that lost from the stoves or boilers due to the sensible heat capacity of the water vapor if carried away by the exit gases. THE development, within recent years, of core drills capable of drilling holes up to 72 in., or even more, in diameter, has made possible an entirely new and valuable method of geologic exploration. Although little used until recently as an exploratory tool except in the United States, by the Tennessee Valley Authority and the Corps of Engineers of the U. S. Army, for the exploration of damsites, the large-diameter core drill may be used to good advantage in other types of geologic exploration. Its principal utility is that of supplementing, rather than replacing, other means of exploration. Although core is frequently recovered intact, the greatest advantage of large-diameter drilling is that the holes produced are large enough to be entered by the geologist and engineer, and thus afford an excellent means of examining undisturbed rock. The walls of the holes are smoothly cut, and in some rocks nearly or quite polished, so that the most minute details of structure and stratigraphy are clearly disclosed. Such features as faults, joints, bedding planes, weathered "seams," and beds or layers of soft materials, which are not always amenable to disclosure by cores recovered from small-diameter holes, are conspicuously displayed in the walls of large holes. Frequent reference to the drilling of large-diameter holes is made in engineering literature, but comparatively little emphasis has been placed on their value in geologic investigation. It is, therefore, intended that the present paper acquaint the geologist, as well as the engineer, with the large-diameter core drill and the technique involved in its use, and also with its advantages, disadvantages and limitations as an implement of geologic exploration. THE EQUIPMENT The equipment generally employed in the drilling of large-diameter holes consists of a trunnion-type drill head mounted on a sliding base, which allows it to slide clear of the hole and thus permit the introduction

This report presents the comments of members of the Institute's Sub-committee on Physics of Mine Ventilation on the proposals of a special committee of the Institute of Mining Engineers (London). This report is as follows: THEORY OF MINE VENTILATION Abstract of a report submitted June 16, 1925, to the Council of The Institution of Mining Engineers by a Special Committee Laws of Flow of Aib The law of flow of air in mine galleries is, at present, expressed by two formulas differing slightly in shape but both derived from the original hydraulic formulas of Chezy and others. These formulas are: The Atlcinson Formula.—Pa = KsV2, which in transformation becomes a3 where P = pressure producing flow; K = coefficient of friction; s = surface of the mine galleries; V = velocity of flow; Q = rate of flow; a = area of mine galleries. This formula is especially applicable to mine galleries, but is unwieldy in application, as in many problems we are dealing with changes produced in the same set of airways when K, s, and a are assumed not to change, and the only variables are P and Q. Great uncertainty prevails as to the exact values to be assigned to the coefficient K in different types of airway, as different workers have given widely differing values. This formula assumes: (I) That resistance to flow is independent of the pressure within the gallery. (2) That changes in volume within the limits of pressure ordinarily met with may be neglected. (3) That changes in density and viscosity and mode of flow of the air may be neglected. (4) That the coefficient K is a constant. (5) That P is proportional to the square of the velocity. We cannot find any reliable experimental work leading us to conclude how far these assumptions are justifiable in mining practice. George IV. Goetz, Milwaukee, Wis.: Mr. Campbell deserves much credit for his interesting paper. The literature of the development of the open-hearth process is distributed in many technical journals, and is difficult of access to many engineers. Since the development of the basic process, the open-hearth furnace has been raised from a subsidiary to an independent position. Certain high grades of soft steel can be produced in the basic open-hearth furnace, which cannot be produced by any other known process. In the United States the charges for the acid process generally consist of either scrap and pig-iron or so-called wash-metal and scrap : the pig-and-ore process, as carried out in England, is practiced but very little. The introduction of the basic process has made it possible to use about four times as much pig-iron with scrap as can be used in the acid mixtures. The availability of a cheap pig-iron, very low in silicon and sulphur, and carrying several per cent. of manganese, is one of the reasons why the basic open-hearth process has developed so rapidly in Germany, as regards the output per furnace and the excellent quality of the material produced. The acid Bessemer steel has an inherent stiffness, which is plainly shown when spring steel is made by the Bessemer and by the openhearth processes. In order to get them of about equal stiffness, the open-hearth steel must have about 0.60 per cent. carbon ; whereas, the Bessemer steel must then have ahout 0.45 carbon, the remaining constituents being apparently about the same in each product. It has proved impracticable, with American coke-pig-iron, to interrupt blowing at a certain point in order to make hard steel; and experience has therefore shown that it is best to eliminate nearly all the carbon, and then to recarburize to the desired point. It is well known that manganese will desulfurize molten iron through the formation of manganese sulfide, which, being only slightly soluble in the metal, rises to and enters the slag where it remains as such (mixer slag) or is converted partly or wholly to calcium sulfide (basic open-hearth slag). The reaction by which manganese sulfide is formed is Mn + FeS = MnS + Fe. This reaction is generally considered to be reversible, although McCancel states that such is not the case. The experimental work was carried out to confirm the results of Roh12 as to the reversibility of the reaction. Six trials are herein considered. In each 200 gm. of electrolytic iron free from manganese and sulfur were melted in a pure zirconia crucible in a carbon resistance electric furnace. To the melted iron in runs 2, 3 and 4 metallic manganese and manganese sulfide were added to give 1, 2 and 4 per cent. manganese respectively, with 0.50 per cent, of sulfur in each. In runs 5, 6 and 7, metallic manganese and iron sulfide to give the same proportions of. manganese and sulphur as in runs 2, 3 and 4, were added. DURING the last several years many papers have appeared dealing with the structure of highly polished metal surfaces The awakening of interest in this subject is due to the applicability of the electron diffraction technique to the study of surfaces The original theory of Beilby1 considered the surface of polished metals as of the nature of a super-cooled liquid or a vitreous, amorphous solid The electron diffraction effects from polished metals have been interpreted by many to be a direct experimental proof of the correctness of the Beilby theory This interpretation has been strongly opposed by others, so that at the present time the subject is in an uncertain and controversial state In the present paper new, and hitherto unpublished, electron diffraction effects from polished zinc are described These observations indicate that the polished surface of zinc is crystalline PUBLISHED WORK Many papers2-10 have interpreted the electron diffraction evidence as proof of the Beilby amorphous theory All investigators agree that highly polished metals give rise to two diffuse diffraction haloes, similar to those obtained by the diffraction of X-rays in liquids and vitreous solids It is this similarity that leads to the amorphous-layer interpretation of polished metals Strangely, the interatomic distances calculated from these haloes are very similar for the various metals investigated, in spite of a rather wide range of such distances in the crystalline and liquid states The calculated atomic sizes are, furthermore, smaller than are experienced in the normal states of the metals In spite of these anomalies, the amorphous-layer interpretation has been adhered to by many One investigator, S Dobmski,11 differs from the others in his experimental results By polishing under benzene in order to avoid the possibility of oxidation, Dobinski obtains diffuse haloes of [radire] different from those previously obtained He thus obtains a more rational quantitative correlation of-the diffuse haloes with the amorphous-layer theory

So far as the elementary composition of petroleum is known, it may be briefly stated. Petroleum consists principally of a few series of hydrocarbons, with admixtures of sulfur, nitrogen, and oxygen derivatives in comparatively minute proportions, which may be regarded as impurities to be removed in the preparation of commercial products. But as each series is represented by many homologs, in the aggregate, crude petroleum is an extremely complex mixture of hydrocarbons and their derivatives. In part, these hydrocarbons individually conform in structure to the system of synthetic hydrocarbons whose structure is well defined and represented by the typical series CnH2n, + 2, C.H2n, the series CnH2n,-2, CnH2,-a, the members of which have not been sufficiently studied to establish their structure, and the series CnHz,e composed of the aromatic group, benzene and its homologs. Hydrocarbons of greater density contained in the portions of petroleum that cannot be distilled without decomposition doubtless have less hydrogen than is represented by these formulas. Since to every hydrocarbon there is a definite temperature, even in vacuum, at which its constituent carbon and hydrogen atoms fall apart, and since for the heavier bodies this temperature is not much above 360" C. in vacuum, it is evident that some other method than distillation must be devised for their separation if anything further is to be learned concerning their individual constitution. Classification of Petroleums There is such a wide variation in the composition of petroleum from Merent fields, it would seem possible to make a classification on this basis were it not that no single variety is entirely free from hydrocarbons contained in others. Such a classification has been suggested of the exceptionally pure Pennsylvania petroleum, the sulfur oil from Trenton limestone and other sources, the California oil with its large amount of nitrogen (quinoline) derivatives, and the Russian oil, composed chiefly of the naphthene hydrocarbons.' The need for a practical method of deciding upon new alloy steel analyses to widen its markets was the problem facing the Chrome Steel Works at the beginning of 1927. In addition to determining the physical properties of the alloys under consideration, it was necessary to test their value in service. Small melts of steel in a crucible, from which test specimens could be made, were insufficient to determine more than physical properties, therefore actual castings and ingots had to be made before the products could be placed in service. Furthermore, to save further experimental work, it was desirable that these heats should be made on a "pilot" basis; that is, actually duplicating regular open-hearth furnace practice. Therefore a one-ton (2000-lb.) acid open-hearth furnace was built. Furnace Design There are no special features in the design of this furnace. Standard acid open-hearth practice is followed, with the reproportioning of the dimensions necessitated by its small size; notably, a considerably increased length in proportion to width in order to get proper flame propagation. After the first heat was made it was found that the check-ers were insufficient. The checker chambers were increased in size and the checker openings were made much smaller. The furnace was started late in March, 1927, and made 65 heats. Experimental work was then stopped unti1, the data accumulated could be worked up and summarized. The run was resumed in November and the furnace is still operating, having made at this writing 60 additional heats. For the last series of runs, there was some rebuilding of both the furnace itself and the checkers. Slag pockets were added. Fig. 1 shows details of construction; Fig. 2, the general appearance. All designing was done by the operating and engineering staff. Construction materials were those available around the plant. The reversing valve is a standard butterfly type taken from an old furnace. The slag pockets and checkers are cleaned by digging down to arched openings which have been bricked up.

The development, within recent years, of core drills capable of drilling holes up to 72 in., or even more, in diameter, has made possible an entirely new and valuable method of geologic exploration. Although little used until recently as an exploratory tool except in the United States, by the Tennessee Valley Authority and the Corps of Engineers of the U. S. Army, for the exploration of damsites, the large-diameter core drill may be used to good advantage in other types of geologic exploration. Its principal utility is that of supplementing, rather than replacing, other means of exploration. Although core is frequently recovered intact, the greatest advantage of large-diameter drilling is that the holes produced are large enough to be entered by the geologist and engineer, and thus afford an excellent means of examining undisturbed rock. The walls of the holes are smoothly cut, and in some rocks nearly or quite polished, so that the most minute details of structure and stratigraphy are clearly disclosed. Such features as faults, joints, bedding planes, weathered "seams," and beds or layers of soft materials, which are not always amenable to disclosure by cores recovered from small-diameter holes, are conspicuously displayed in the walls of large holes. Frequent reference to the drilling of large-diameter holes is made in engineering literature, but comparatively little emphasis has been placed on their value in geologic investigation. It is, therefore, intended that the present paper acquaint the geologist, as well as the engineer, with the large-diameter core drill and the technique involved in its use, and also with its advantages, disadvantages and limitations as an implement of geologic exploration. The Equipment The equipment generally employed in the drilling of large-diameter holes consists of a trunnion-type drill head mounted on a sliding base, which allows it to slide clear of the hole and thus permit the introduction

The purification of iron ores by means of hand magnets dates back more than 100 years. The first record in the United States Patent Office of a machine for the magnetic separation of ores shows that on Feb. 20, 1849, U.S. Patent 6121 was issued to Ransom Cook for improvement in electromagnetic ore separators. The patent covered the use of a revolving cylinder, or drum, with poles of electromagnets in its periphery for the purpose of separating magnetic oxide of iron from substances with which it might be associated, by causing the electrornagnets when revolving as component parts of the cylinder to be successively charged to take up the ore and discharged to part with it. Since this patent was issued the science and technique of magnetism have advanced more than most other fields of endeavor. The development of electrical machinery has required and obtained better and better magnetic materials, and the science of applied magnetism is as completely and satisfactorily developed as any branch of physics. Nevertheless, the patent of Ransom Cook, issued in 1849, comes close to covering everything that is now being applied in magnetic separation. The cynic may conclude that this proves the uselessness of modern science and may point in confirmation to flotation, which has grown in a few years, practically without benefit of science, to be the most versatile and useful of concentration methods. On more careful study, however, it appears that an accurate determination of the magnetic properties of minerals and their amenability to control by mechanical and heat treatments has not heretofore been made. The first essential, therefore, in the design of improved magnetic separators has been missing. In spite of this hiatus in scientific data inventors have been busy, and patents are on file covering mineral separations by means of nearly all known magneto-mechanical effects. Because of a lack of knowledge of mineral properties, most of these inventions never worked well enough to find commercial use. The Metallurgical Division

(Read at the Amenia Meeting, October, 1877.) IN the case of The Eureka Consolidated Mining Company v. The Richmond Mining Company of Nevada, recently tried at San Francisco, California, the real defendant was the Richmond Consolidated Mining Company, of London; but this being a foreign corporation, holds its mining property in Nevada through the Nevada corporation of similar name, in which the London Company owns all the stock, except the few shares necessary to "qualify" the American directors. The trial would naturally have taken place in the Circuit Court at Carson City, Nevada, and before a jury. But by stipulation of the parties, the case was tried in San Francisco, before Hon. Stephen J. Field, Justice of the Supreme Court of the United States, Hon. Lorenzo Sawyer, United States Circuit Judge of the Ninth Circuit, and Hon. E. W. Hillyer, United States District Judge, for the District of Nevada. The hearing began July 23d, 1877. The witnesses occupied two weeks, and the argument of. counsel three days. Very eminent lawyers were. engaged on both sides ; for the plaintiff, Messrs. Solomon Heydenfeldt, R. S. Mesick, John Garber, and H. J. Thornton ; for the defendant, Messrs. S. M. Wilson, Thomas Wren, and J. J. Williams. The court held the case under advisement until August 22d, when Mr. Justice Field delivered its unanimous opinion in favor of the plaintiff. The action was a complaint in ejectment, and an appeal was taken to the United States Supreme Court. The questions at issue between the Eureka and the Richmond Company in this suit, comprised several points in the construction of the mining law of the United States, and its relation to the customs and regulations of the mining districts, which possess an importance and an applicability far beyond the limits of the case in which they arose.
