THE decision of the lower court (United States District Court for the Southern District of New York) in the suit of the Dwight & Lloyd Sintering Co., vs. John E. Greenawalt has been affirmed by the United States Circuit Court of Appeals for the Second Circuit. In the original suit, infringement of seven patents was alleged, these covering the process of producing a sinter .out of finely pulverized metalliferous ores as practised in shallow pans operating intermittently in distinction to the Dwight 6: Lloyd continuous machine. The court found that the long delay in bringing suit precluded any recovery of profits from the defendant under the basic down-draft sintering patent, although Dwight & Lloyd are recognized as the inventors of this' contribution to the art and its .importance is acknowledged.

SINCE boyhood I have had a keen interest in mining engineering. To see the prospector with his pack outfit and his pan, followed by the assayer and the trained engineer, has always had -something of the lure of romance for me. It is appropriate that the American Institute of Mining and Metallurgical Engineers should hold a general meeting in California, since this State has long been a home of mining engineering. Here, after the early open methods of mining, it has been necessary for the universities to train men in geology and mining, so that the earth could be penetrated and the rich ledges opened. In the eighty years in which the mines of California have been offering experience to the miners of the world, we have seen mining engineering evolve from a comparatively simple art, covered largely by rule of thumb, into a complex group of specialties, each utilizing the very latest discoveries in the various fields of physical sciences. Mining, too, has become a great business requiring large financial support and the most careful handling. Those mining engineers who have applied new processes in special fields have thus been able to give a wide-flung range to their activities in all parts of the world. The hand of nature in distributing minerals over the surface of the earth has compelled the mining engineer to become a modern pioneer, facing the heat of the tropics as well as the frozen regions of the north. There has been a marked cosmopolitan aspect to mining engineering, since the engineer had to go wherever the prospector discovered favorable leads. This has meant dealing with the harshest of conditions, the handling of labor of all sorts, the control of sanitary conditions, and relations to all forms of transportation. Naturally this has called on some of the very best minds in all countries to unlock the stores of hidden wealth. To make them available for civilization has been the job of the mining engineer.

YOU can place an exclamation point after the "and How" if you want to, but the way it stands it sum¬marizes the Mining Geology sessions quite nicely; "Why" in the morning, "How" in the afternoon. It is altogether fitting that Prof. McLaughlin and Reno Sales, who have themselves achieved enviable reputations in company work, should have led the program by presenting informally a chapter from the volume dedicated to the beloved dean of all economic geologists, Waldemar Lindgren. In opening the morning session, over which Sydney Ball presided, Donald McLaughlin emphasized the continuous role mining geology should play in operating technique. He pointed out the importance of structural relations in a broad sense, and the preponderant role they play in developing the manner of ore occurrences. He illustrated this by an account of the work at Homestake, using slides to show the stratigraphic sequence, the folding, and the orebodies of that camp. An interesting piece of detail was the distinction they found could be made be¬tween the chlorite near the ore masses, and that in the country rocks. Whether the cummingtonite, characteristic of the rock in which the ore is found, is of regional or of contact metamorphic origin caused some discussion. Dr. Lindgren inclined to the belief that it was contact, but L. C. Graton replied that they had found the weight of evidence was for a hydrothermal origin. D. F. Hewett raised the question as to whether, in the advancing development of the mining industry, there was still a place for the U. S. Survey geologist, and the consensus seemed to be that there should be. His role is changing from that of mapping mining districts in detail, now the task of the companies, towards a more general serving of the industry through the wider perspective his work gives him in contradistinction to the greater detail of knowledge accumulated by the resident geologist.

PRODUCING operations abroad during 1940 were shrouded in the fog of war. Little, if any, concrete information is available, and the data that issue from the belligerent countries are too frequently distorted for military purposes, for the volume of supply of gasoline and fuel oil has become an important strategic secret. Despite this lack of information signs indicate the spread of a slow paralysis which is gripping producing operations in foreign countries. Only in the Caribbean area are developments proceeding normally and even there the destruction of the Western European market is being seriously felt. This creeping paralysis is being brought about partly by the serious shortage of materials so necessary for drilling and other producing operations such as steel, machinery, and the like-together with a scarcity of that prime munition of war-money. Markets too have been curtailed by the operation of exchange control as all exchange is needed to support war efforts. As a result, gasoline is tightly rationed in all belligerent countries. The growing casualties in shipping are fast restricting the water-borne trade in petroleum, but have had a local stimulating effect in some areas where the risk is less or where water-borne transport can be efficiently used as for instance Trinidad and Egypt. The type of product needed for war effort, particularly the great demand for aviation gasoline, has changed the schedules of .refinery operations. As a result of all these influences the world oil picture outside the United States- has vastly changed during the year.

ANTHRACITE in 1943, in common with the coal industry as a whole, passed through a year of wage negotiations that seemed endless. In the early months discussion of the United Mine Workers' demands was taken up and carried on continuously until May, finally reaching an impasse when the Union refused to continue at work, while submitting their demands to the War Labor Board. Thus a strike threatened, averted by the Federal Government taking over the industry, effective May 1, by order of the President. An office of the Bureau of Mines was established in Wilkes-Barre under the direction of J. J. Forbes, Mineral Production Security Division, as regional manager, who conducted operations until September, 1943, when the collieries were turned back to the operators. But the miners did not agree with the War Labor Board's award rendered in the fall, resulting in a recurrence of the previously threatened strike. again averted by Government control. In addition to the major upsets, a number of individual suspensions occurred at various mines. In spite of these drawbacks, to which might be added the difficulty of obtaining equipment and the scarcity of man power, the industry by November was only little less than a million tons short of the previous year. and in all probability, finally produced but little less than in 1942. This little less. however, was greatly missed in the market.

THE thesis of this article is that the age of Newton is now coming to a close, and that recent scientific discoveries have in store an even greater revolution in our entire outlook than the revolution effected by the discovery of universal gravitation by Newton. The revolution that now confronts us, arises from the recent discovery of new facts, the only interpretation of which is that our conviction that nature is understandable and subject to law arose from the narrowness of our horizons, and that if we sufficiently extend our range we shall find that nature is intrinsically and in its elements neither understandable nor subject to law. The new experimental facts are in the realm of quantum phenomena. Comparatively little has been written for popular consumption about this new realm which has opened in the last fifteen years. The man in the street has been much more interested in relativity, which to him has seemed extremely interesting and revolutionary. Occasionally, however, there has filtered down to him the news that nearly all the theoretical physicists are occupied with a new order of phenomena which they find very much more exciting and revolutionary than any in the realm of relativity. For after all is said and done, the practical effects of relativity, measured in ,dollars and' cents or in centimeters and grams, are exceedingly small, and require specially de- signed experiments executed by men of the highest skill to show their existence at all. The phenomena with which quantum theory deals, on the other hand, are of the greatest practical importance and involve the simplest aspects of everyday life. For example, before the advent of the quantum theory no one could explain why a tea kettle of water boiling on the stove should not give out enough light in virtue of its temperature to be visible in the dark; the accepted theories of optics demanded that it should be visible, but every burned child knew that it was not.

THE meeting" of the Rare Minerals and Metals Committee was held Monday afternoon, Feb. 17; Donald M. Lidclell, chairman, presiding. The first paper (T. P. 279), "Progress in the Use of Tantalum," by George W. Sears, was read by Mr. Smyth. Dr. Sears' paper contains an interesting summary of the uses, alloys and ores of tantalum and a resume of present method of reduction. The uses of tantalum is based on its extreme rise to the reaction of even the strong mineral acids, its great avidity for the common gases and its capacity for transforming alternating to direct current. Tantalum, as an alloy material, has received considerable study and many alloys have been reported. Among them three types appear to .be most prominent, alloys of high melting point, hard alloys and acid rising alloys. As the estimated quantity of tantalum in the earth's crust is less than that of gold, it must be looked upon as n rare metal. Australia is the greatest producer and the Black Hills of South Dakota produce minor amounts. As the one type of mineral available contains both tantalum and columbium, the extracting and metallurgy of tantalum are difficult chemical processes. Greater simplicity in this and the development of a market for columbium would undoubtedly be of great benefit to the tantalum industry, andl make for a greater use of tantalum produced.

This year, Great Britain is looking back over a century to August 14, 1850, the day when the first "Act for the Inspection of Coal Mines" was passed in that country, an act which signaled the end of over two hundred years of hitherto uncontrolled and dangerous mining practices. It was back in the time of Queen Elizabeth that . thousands of pounds were invested in mining, particularly coal mining in England and Scot- land. By 1640 there were collieries producing 10,000 to 25,000 tons of coal per year. In the seventeenth century the Tyne district coal industry was organized into powerful partnerships, and coal took an even larger part in industry, as a source of power and as fuel for the iron industry. In the early 19th century a "phenomenal, almost devastating expansion" characterized Britain's coal industry, and it was sparked by a 111 pct in- crease in the population of England and Wales in the first half of the century. Coal production for those 50 years increased 470 pct and pig iron production was up 946 pct for the period 1801-51.

FROM the first days on the Norman beaches to the last days on the Elbe the Army Engineers of World War II lived off the countryside for the great bulk of the construction supplies needed for the fulfillment of their ultimate mission-to keep the army moving. To accomplish this end, vast tonnages of rock, timber, and steel were required in the construction of roads, railroads, and bridges. Combat Engineer battalions operated quarries under shell fire as a routine matter. An Engineer forestry company was decimated while cutting bridge timber on the Siegfried line. Oneof the more spectacular feats of the Army Engineers in obtaining construction materials was the operation of the Hadir Steel Works during the fall and winter o f 1944.

A GEOLOGIST --one versed in geology, the science which treats of the history of the earth and its life, especially as recorded in the rocks; that is Webster's definition. William Embry Wrather-one of the country's foremost geologists who heads the U. S. Geological Survey; this is the 1948 President of the Institute. He has studied the geology of areas on the face of the earth as far-flung as Texas and the Balkans, and now heads the world's largest staff of geologists. Vital statistics on Dr. Wrather would show his place of birth as Brandenburg, Ky., the year 1883. He will celebrate his threescore and five years of full living the twentieth of this month. As is usual in biographical sketches of this nature, the formative years of youth, and in many ways the most important years of one's life (since professional tendencies as well as many important personal decisions are evidenced before the teens are left behind) are passed over with the mere fact noted that a degree was earned at such and such educational institution. And so we note that Dr. Wrather received his Ph.B. degree at the University of Chicago in 1907, and followed up that degree with two years of graduate study.

ONE of the essential functions of any modern community is to provide a fully accredited public school system. The Climax Molybdenum Co. was cognizant of this fact and erected a modern school building in 1937 to meet this need. The building was named after the president of the Company, Max Schott, who was largely instrumental in making it a reality. The building is a two-story brick structure with fourteen rooms, eight of which are regular classrooms. The others consist of a room for industrial arts, two for home economics, one for commercial arts, one for a science laboratory with a dark-loom for photography, and one large room for a combination library, study hall, and assembly room. Cook, Pottstown, Pa.:—Many friends and acquaintances seem to be under the impression that the Warwick Iron & Steel Co. received a' license from Mr. Gayley, free of cost, as an inducement to adopt the process. This impression is not correct, since the license was paid for, and I think it was the first payment that Mr. Gayley received for the use of his process. As president of the Warwick Iron & Steel Co., I am responsible for its earnings, and with only the experience at the Isabella furnaces as a guide, the directors of the company considered that there was a great risk in expending the large sum of money required for the plant. They, however, acted favorably upon my recommendation, and to this extent I am responsible for the installation at the Warwick furnaces. I made the best agreement possible with Mr. Gayley, and naturally our company received certain advantages. It will be contrary to all experience if subsequent plants do not show some improvements and economies in construction. It is to our indirect benefit that all subsequent licenses granted by Mr. Gayley should be charged at a much higher rate than we paid; and I trust that he will see to it that all such licenses granted, especially to companies making merchant iron, shall be at a maximum figure. The Warwick Iron & Steel Go. is not interested in any way in exploiting the merits of the Gayley dry-blast process; on the contrary, looking at the subject from a narrow and selfish standpoint, it is to the advantage of our company that no merchant blast-furnace competing with our iron-product should be equipped with a dry-blast plant. (communication to the Secretary): In connection with Mr. Douglas's mention of the continuous charcoal kiln used at Kopparberg, some further data concerning this important invention may be of interest. Before giving these, however, I will say a word or two concerning other features of Swedish practice. In 1894 I spent two days at Soderfers with Mr. Tom Bergendal, the manager of the works, and was specially interested in the gas-producers and wood-drying kiln, illustrated in the paper contributed to our Transactions by Mr. Odelstjerna in that year.* The wood-drying kiln is, however, quite different in design and construction from Ljungberg's charcoal kiln. In the summer of 1894 it was discovered that by placing the gas-producer as close as possible to the open-hearth furnace, and working the producer hot, ordinary weather-dried wood, still containing a considerable percentage of moisture, could be used to advantage in the melting-furnace. Hence, the dryingkiln was needed for wet wood only. One of the iron-works of the Udeholm Go. was the first to adopt the Lundin saw-dust gas-producer and condenser, enabling them to make gas from saw-dust containing 45 per cent. of moisture, and convey the gas from the condenser through wooden pipes to the Siemens steel-melting furnace.† This sawdust gas gave very satisfactory results in iron-works; but the proprietors experienced much trouble by reason of the pollution of rivers by the tar-water from the condenser. Recent economic and environmental setbacks have not slowed Occidental Oil Shale, Inc.'s program aimed at the commercialization of oil shale. In fact, the firm expects to have a 795 MI (500C) bbl) per day production unit working by the end of 1976. The key to Occidental's ambitious program is an in situ method that extracts the valuable oil by retorting the shale in place. The process will require practically no water and will leave the spent shale in place underground. Additionally, all plant operations are to be located within the mine. These factors thus serve to make the operation attractive from an environmental viewpoint, in contrast to proposed conventional schemes which call for extensive underground mining, crushing and grinding at the surface, and construction of a massive surface retorting facility.

ENGINEERS have long pondered the answer to the question of "How am I doing?" and in large measure the answer from the economics angle is provided by the 1946 survey of the engineering profession now being published by the Engineers Joint Council as an eighty-page bulletin entitled "The Engineering Profession in Transition." The survey, based upon a completely precoded mail questionnaire, aimed at three major objectives: (1) to determine the general impact of World War II upon the profession in the period 1939 through 1946; (2) to obtain re- R liable data from which valid findings could be derived to predict how active the profession would be after 1946; and (3) to determine if the war's upheaval had changed materially the pattern of professional activities, education, background, and earnings from those which existed prior to 1939. Abundant data on the economic status of the engineer based upon years of experience in his particular field, the specific branch of the industry in which he served, and his educational background are presented. In the valuable paper of Mr. Dunbar D. Scott and its varied discussion, on the evolution of mine-surveying instruments, the tripod-head has not received the attention it merits. During the last 50 years this very necessary adjunct to the surveyor's instrument has been much improved. The legs are of better construction; and the devices for laterally moving the instrument over the station-point and for quick leveling, without the use of the screws, have given to the instrument fitted with the modern tripod-head the same facilities possessed by the oldfashioned ball-and-socket, with more perfect accuracy, not attainable in the latter, while saving from 30 to 50 per cent. of the time required for setting the instrument over a station. AT a recent meeting of the AIME Board there was considerable discussion of a suggestion that companies should be more interested in promoting AIME membership among their employes. The advocate of this idea argued that companies benefit greatly if their employes are active AIME members, so even on purely a selfish basis they should use various means to encourage membership. Also he argued that companies in general make no contribution to the support of the AIMS although benefiting from its work, so should not object to making more of a contribution, financial or otherwise, than they do. One Director stated that an investigation had developed the fact that a large majority of members felt it unwise for employers to pay the initiation fees or dues of employes. They felt that AIMS membership should be on a purely personal basis; that the rewards of active membership were sufficient so that it is a good investment for a man in developing his own professional stature, presumably resulting in an increase in salary sooner, or in greater amount, than would otherwise be the case. If an employer paid a member's dues or initiation fee the member would take less interest in the Institute. But this Director felt that an employer should otherwise encourage his employes to join the Institute, attend its meetings, and write papers based on company work for presentation and publication. Another Director reported that his company pays the expenses of AIME members in its employ to meetings; the company also encourages nonmembers to attend AIME meetings but does not pay their expenses unless they present papers of interest to the company. Another Director, representing a supplier, stated that his company's policy was to send some of its staff to all AIME meetings at which papers of interest were to be presented or at which valuable contacts could be made.
