Bethlehem, Pa.-In discussing the question personally with Mr. Matteson I have found that he simply proposed this as a suggestion and he recognizes, as well as a great many other oil geologists and oil operators, that to put into practice such a suggestion would mean the overcoming of many difficulties. Yet perhaps it may be possible to overcome the various objections that may be offered. Undoubtedly one of the most serious objections is that of incomplete and inaccurate well records. Faulty records are worse than no records at all. Perhaps, however, definite instructions and insistence on their observation may remedy this defect after a time. THE CHAIRMAN (M. L. REQUA, San Francisco, Cal.).-This subject is a. very important one, but just how far the National Government can go in .taking action is a question: It involves, of course, the question of State rights. California, I .think, has done very well up to date and probably will do better in the future. The law that was passed at the session of the Legislature 2 years ago is working as satisfactorily as anything of that kind can work with so little experience to guide the framers of the statute. We recognize in California the vital necessity of conserving the oil of the State. We have come to the conclusion that there is not as much oil ,in California as we thought there was. In the month of December the State drew on its oil stocks to- the extent of 1,800,000 bbl. and I think that the January statistics will show probably as much more. There is more or less of a.: panic at the present time among the large marketing concerns regarding the question as to where they are going to get their oil for future requirements

ALTHOUGH the application of light metals in war materiel increased during the year, based on the number of uses, the trend in aluminum and magnesium production in 1944 was characterized by a sharp decline in the production of both metals accompanied by a further accumulation of large Government reserve stocks. Several primary reduction plants were curtailed to prevent building excessive inventories. By the end of the year, however, a lively revival of war production took place when resistance stiffened on the western front in Europe. Production of primary aluminum ingot was reduced from over 90,000 tons per month at the start of the year to 45.000 tons per month by the end of the year.

THE Tri-State zinc and lead-mining district is in the northeast corner of Oklahoma, the southeast corner of Kansas and the southwest corner of Missouri. The area throughout which active mining has been conducted is about 45 miles long and about 5 miles wide, extending northeasterly from Commerce, Okla., to Alba, Missouri. Although the lead ores were mined on a very small scale in the vicinity of Joplin, Mo., as early as 1848, nothing of any importance was done in the district until 1870, since when both mining and smelting have been prosecuted with considerable vigor. In the beginning the lead ores only were exploited, but within a few years extensive deposits of zinc ores were found and since that time the production of zinc ore has far exceeded that of lead. Both the surface and mineral rights in Missouri and Kansas were under individual ownership by the time ore was discovered. Although some of these rights were purchased by mining companies, most of the mining has been done under leases covering small areas, usually 40 acres, although in the past many leases were given on much smaller tracts. In Oklahoma most of the mineral land had been alloted by the Government to various Indian tribes and although the title to some of these lands had been acquired by various white men before the discovery of the rich Picher field, the title to most of the land has remained with the Indian tribes and the leasing of the mineral rights has been done by the Federal Government for the benefit of the Indians. The Indian allotments were of 200 acres each and some of the mining leases covered entire allotments, although many leases were granted for only 40 acres or even less. Practically all of the leases granted in the past required the erection of a concentrating plant on each lease, a condition that has had a pronounced effect upon the mining and milling methods of the district, since the apparent ore reserves on each tract were too small to justify large

The underground losses of oil exceed by hundreds of thousands of barrels all the oil that has been lost in storage, transportation, or refining. The quantity lost is, of course, indeterminate; but when it is considered that the contents of an entire oil field have been excluded from recovery by invading waters, some idea of the amount wasted may be gained. Similarly, enormous quantities of gas have been lost underground. Conservation of the oil, therefore, should start before it is brought to the surface rather than after it is placed in storage tanks. Water is one of the most important causes for underground losses and the operator should give as serious consideration to an underground flood of water as he would to a destructive surface flood. The best insurance, of course, is to have the wells drilled in such a manner that water has no access to the productive oil and gas horizons, and on abandonment the wells should be properly plugged. The encroachment of edge water and the occurrence of waterin;the base of an oil sand present a very serious problem to an oil company sooner or later these waters are bound to cause considerable damage, if they do not entirely destroy the possibilities of further production. Too often, however, a field has been considered to be in a hopeless condition, whereas wells in as bad a condition in other areas have been repaired and the life of the field appreciably lengthened. The corrections are very often suggested by technical study. Very successful results have been accomplished by detailed underground work in the California oil fields, in Cushing, Oklahoma, and in other areas. The purpose of this paper is to outline briefly1 general methods of analyzing oil-field water problems in a producing or in a producing and developing oil field, with a view to suggesting repair work on offending wells. Reference is continually made to producing oil wells; the same general method of procedure, however, should be adopted in a gas field.

Drilling for oil and gas in Missouri continued at a slightly lower rate than has been prevailing. A summary of operations for the past few years as compiled and published by the Missouri Geological Survey and Water Resources is as follows: Two oil pools are being developed in Cass County. Neither area has been drilled completely, and detailed descriptions will not be given at this time. In the Endicott pool in the southern part of T. 44 N., R. 33 W., oil is found in the Warrensburg sand, which is now considered to be the Big Lake sand of eastern Kansas. The top of the sand is about 125 ft. below the Herthalimestone. The best well is reported to have made 14 bbl. per day for the first four days. The oil is 30" to 32' BB. gravity. This is the only pool in the state, aside from the older areas on the east and west edges of Lees Summit, Jackson County, that is producing oil from the Warrensburg sand. Drilling continues in the Knoche pool in the central part of T. 46 N., R. 33 W., where the oil is found in the Squirrel sand. The oil produced by both these pools is sold by truck in Kansas City.

IN VIEW of the extensive use of the brasses and bronzes in engineering practice it is indeed surprising that so little scientific work has been done on the oxides in these alloys. Recognition of the ill effects of these compounds is universally accorded, both in foundry procedure and in such specifications as cover the melting of these useful mixtures. In the latter, limits, for example, are placed on the proportions of scrap metal in the charge, and clauses governing the use of fluxes are included, the addition of fluxes to the charge being made with the object of avoiding oxidation during the process of melting and of subducing and separating non-metallic matter from the melt.1 In the manufacture of brass it occasionally, though rarely, occurs that the virgin metals, copper and zinc, alone are used. In the event of virgin metals being employed, that of the higher melting point is always melted first. If it is melted under suitable conditions, little or no oxidation will occur. Whether oxidation has occurred or not, however, can best be determined by microscopic examination of a sample taken from the melt.

THE presence of soluble base metals in precious-metal ores usually precludes cyanidation as the best method of treatment. The laboratory experiments described in this paper show the possibility of cyanidation of gold-silver ores containing less than 0.5 per cent. of cyanide-soluble copper and the effect of zinc in the cyanide solution. PART 1.-COPPER IN CYANIDATION The proposed process of cyanidation of precious-metal ores containing copper is based on the regeneration of about 80 per cent. of the cyanide used in the dissolution of the copper. The method of regeneration involves a combination of the sulfide and the acid precipitation of the copper and silver. The resultant solution is made alkaline with lime, and the gold is precipitated with zinc dust.

A PROCESS for the electrolytic preparation of molybdenum from molten salts has been described previously. This previous work centered on electrowinning and electroplating characteristics of the process. In this paper the properties of the process as a refining medium are discussed. In producing metals from ores, it frequently has proven most economical to obtain a comparatively impure metal by smelting, and to purify the product by electro refining. Direct electrowinning from molten salts is rather difficult when a porous diaphragm is required in the process, as in the case of molybdenum, since satisfactory refractory materials for such a diaphragm in molten salts have not yet been developed. In electrorefining, however, a soluble anode is used. By suitable control of anode and cathode current densities, the lower-valent molybdenum compound used in the electrolyte is not oxidized, and a diaphragm is not needed, thus avoiding difficulties which are encountered with other electrowinning processes. Electrorefining may result from two different processes in the cell: Dissolution of the molybdenum and the less noble impurities with a separation of the more noble impurities as an anode sludge; the electrodeposition of molybdenum and the more noble metals at the cathode, leaving the less noble metals in the electrolyte. The amount of separation which occurs in each process is determined by the potential of the operating electrode and the relative concentration of the various species at (or in) that electrode. Since molybdenum has a comparatively noble position in the EMF series in molten alkali halides,2 most refining would be expected to occur at the cathode. In this work only the cathodic process was studied. The objective was to determine to what extent various metallic ions, if they dissolve from the anode or are otherwise introduced, were concentrated in the electrolyte. The necessary conditions for the separation of each and the limiting concentration which may be tolerated in the electrolyte for effective refining were studied. The deposits were chipped from the cathode and analyzed spectrochemically for metallic impurities. Besides determining the major contaminant, a general qualitative analysis was obtained to be sure that other metallic ions were kept at a very low level during each series of runs and to be sure that the baths were not being contaminated accidentally. Samples of the bath, for analysis, were taken at the temperature of operation so there was no chance of selective crystallization during cooling. In this way the ratio of molybdenum in the bath to the other metal could be determined readily. These data permitted a check on the anode efficiency and any volatilization that took place during the electrolysis. Experimental Apparatus—The apparatus as shown in Fig. 1 was used to determine the effect of the various foreign ions upon electrodeposited molybdenum. The entry chamber A allowed the cathodes to be removed without cooling the bath and without allowing oxygen or moisture to enter." The cathodes were made Prom 0.25-in. tungsten rods and were rotated during the electrolysis. The balloon in the lower arm B was inflated with helium after the cathode was drawn up into the upper section for removal. A new cathode was then placed into the entrance chamber A after which the chamber was flushed

Literature on the electrolysis of aluminum from cryolite melts and on the structure of these .melts is surveyed critically. Data on density, freezing point, and other properties are reviewed. Theories of the electrolysis are examined in the light of these data. Two theories are presented which account equally well for the observations. In the early days, the process was thought of as a simple one. The actual mechanisms must be tremendously more complex. This paper is devoted to a rather narrow part of the whole subject, namely, what ions are present in the bath, and by what mechanism the current is carried. Using cryoscopic data, Rolin has determined the following composition for molten cryolite. Na2,AlF 3Na + 3F + AlF [1] He postulates the following equation for the ioniza-tion of alumina at low concentrations Al2O3 Al + AlO2 +O. [2] At concentrations above 0.025M he supposes the ionization of alumina to proceed as follows Al2O3 AlO + AlO2. [3] Rolin's mechanism of electrolysis for the more concentrated solution in Eq. 3 is as follows. The AlO' ion migrates to the cathode. where it is dis- charged, giving metallic aluminum and 0' ions which migrate to the anode. The AlO2- ion migrates to the anode, where it is discharged, giving Al ions and oxygen which reacts with carbon to form CO2 In the case of the extremely dilute solution in Eq. 2 the Al ion migrates to the cathode and the AlO2-and 0 migrate to the anode as before. Another possible mechanism for the electrolysis follows. [7] Although both Rolin's and the present mechanism of the Hall process may be qualitatively satisfactory, present data are not adequate for quantitative tests of the theories.

An increase in the number of deep wells being drilled where extreme bottom-hole temperatures are encountered, and the anticipated drilling of wells where temperatures in the range of 500°F or higher may occur, has brought about a comprehensive investigation of cementing materials and of the techniques involved in their proper usage at these elevated temperatures. Included are developments in cements, retarders, weighting materials and other cement additives which make it possible to formulate a variety of compositions to help resolve the cementing problems of these extreme well conditions. The problems associated with the selection and testing of cements are discussed, and a resume of field results is included. Previous studies on strength retrogression indicate that caution should be exercised in the selection of a cementing composition for use in high-temperature wells. It now appears that, by the addition of silica flour as a stabilizing additive to certain cements, compositions covering a wide range of slurry densities can be designed to meet extreme well conditions without strength retrogression. Improvements in cement retarders make it possible to produce a four-hour thickening time at static temperatures up to 500°F. This temperature is considerably higher than conditions presently being encountered in drilling and completion work. Inert weighting materials, used to produce 20-lb/gal or heavier cement slurries, are reviewed. INTRODUCTION As the search for oil continues, the number of wells being drilled to depths of 10,000 ft or below has continued to increase over the past decade. During 1959, there were 50,893 wells drilled in the United States for a total of 209 million ft of hole. Of this total, approximately 4.45 per cent were drilled below 10,000 ft and 0.30 per cent below 15,000 ft, with a record depth of 25,340 ft recorded (Table 1). With the drilling of this record-shattering hole comes the question, "How deep can wells be drilled?".' Limitations with respect to equipment (surface and subsurface), cementing materials and techniques would cause some concern; however, a panel of experts have agreed that the U. S. oil industry has the equipment and know-how to drill a 50,000-ft hole. The greatest deterrent would be the 700°F temperature they would anticipate encountering at this depth. Although the number of wells drilled under what is generally considered hot-hole conditions (230°F and higher) has been relatively high, each well often presents distinctly individual problems and requires separate consideration and selection of special materials, techniques and equipment. At the present time there are over 30 additives and special cements available for use in "tailoring" a cementing composition for a specific well. It is not uncommon to use three or four different additives with the basic cement to produce the desired slurry characteristics. A generally accepted procedure is to make laboratory tests on selected cementing compositions prior to pumping them into wells deeper than 12,000 ft, or where static temperatures are in the range of 260°F or higher. In some instances, it is recommended that laboratory tests be made where less severe well conditions are encountered. Prior to selecting a cementing composition for a particular well, key personnel representing the operator, drilling contractor and service company should meet to determine that each individual is acquainted with every detail which might influence cementing results and to discuss the execution of the job. For cementing hot-holes, a number of factors must be evaluated before proceeding with the operation. Consideration must be given to the following. 1. Thickening time—The slurry must remain fluid for a sufficient length of time to allow displacement down the casing and up the annular space in a primary cementing job or, in squeeze-cementing, adequate thickening time for both the build-up of a satisfactory squeeze pressure and the reversing out of excess cement. The thickening time of standard retarded cements will often be too short under extreme temperature conditions, thus involving special formulations and requiring laboratory tests to determine the proper amount of additional retarder to obtain the desired pumpability.

THE North Texas district presented in this paper includes the counties of Archer, Baylor, Clay, Cooke, Foard, Hardeman, Jack, Knox, Montague, Wichita, Wilbarger and Young. It corresponds with the Texas Railroad Commission's district No. 9. Table I conforms with the nomenclature of pools as designated by the Commission. Most of the oil and gas produced in this region, generally referred to as the Red River uplift, comes from the Pennsylvanian strata. In recent years, however, increasing amounts are being developed in both the Mississippian and Ordovician.

And it is the one with which I purpose to deal in this paper ; premising, however, that my object is merely to indicate the direction in which an answer should be sought for, rather than to give it myself. This subject may be divided into two parts, "Economy in the production of pig-iron," and "Economy in the manufacture of wrought-iron ;" but it is to the former alone that I shall confine myself this evening.

THE general public does not know that there is such a thing as metallurgy and it is very seldom that you see the word metallurgy in print except in technical magazines. Perhaps it is more to the front now than in former years; the Dee. 30, 1929, issue of Time mentioned under the heading of "Science7' certain new achievements in metallurgy, which may be cited as a rare instance of the use of the word in anything but the technical press. Too often the part the metallurgist plays in the advancement of the different branches of engineering is overlooked. To say that the public does not know there is such a profession as metallurgical engineering seems to be a bold statement, but had there beep time a questionnaire could have proved this beyond doubt. Suppose a carefully-planned questionnaire had been sent to all high school students asking them, among other questions, to list the different branches of engineering, I believe that the several professions would have been listed in this manner: (1) Electrical engineering; (2) mechanical; (3) civil, and (4)' mining. One in each hundred might have listed metallurgy as an engineering profession. Even the Society for the Promotion of Engineering Education in its Bulletin No. 10-"Investigation of Engineering Education" lists Civil, Mining, Mechanical, Electrical, and Chemical, leaving out Metallurgical Engineering.

Before the outbreak of the war in 1914, the only electric-furnace smelting plant operating on a commercial basis west of the Mississippi River was an electric pig-iron plant in California; rare metal ores were not smelted, concentrates of molybdenum, tungsten, uranium, and vanadium ores being shipped East for reduction. Practically no chrome ore was being mined, and only comparatively small amounts of manganese ore. Today there are two electric smelting plants in California, one in Washington, one in lowa, and four in Colorado; two plants are under construction in California, and one in Montana. Ores of manganese, chromium, molybdenum and tungsten are now smelted in the West, and although uranium and vanadium concentrates are still shipped to the East, they will probably be treated in western plants in a short time. The plant of the Ferro Alloy Co., at Utah Junction, contains one 750-kw., three-phase furnace, to which power is supplied by three 250-lrw. transformers, connected /Y to give 129 volts on the furnace cables, the transformer ratio being 13,200 to 75 volts. The furnace operates with an actual voltage of 120 volts, and produces about 3 tons of ferrochrome per 24 hr. from 40-per cent. Cr2O3 ore. The furnace consists of a steel shell of circular cross-section, 8 ft. (2.43 m.) in diameter by 7 ft. (2.13 m.) deep, lined with magnesite, and having three vertical carbon electrodes 12 in. (30.48 cm.) in diameter. A 450-kw. furnace, of the same size as the 750-kw. furnace, is also operated on chrome ore. This furnace is three-phase in appearance, but operates electrically as a single-phase furnace. There are three vertical

The testing of flotation oils has occupied a large part of the time of the testing departments of various companies using the flotation process in the beneficiation of their ores. The great differences in ores and in oils has made such work necessary, as it has not been possible to select the oil best suited for the purpose without trial of many kinds. In fact, individual shipments of flotation oils from the same manufacturer will often differ so radically that the mill men have been forced to test every lot of flotation oil before its use in the mills. Further, although almost every imaginable product of the distillation of wood, from alcohol to pitch, has been tested in a more or less perfunctory manner by various people, few companies have allowed the results of their tests to be made public. This work was undertaken for the purpose of obtaining reliable data regarding the value as flotation agents of a number of products that are obtained from the distillation of wood by different methods, and incidentally to determine whether some of the products not used at present could be used. Large quantities of such materials are being masted or burned in the wood-distillation plants of the United States, and if some use other than fuel could be found for these materials, such a use would represent a distinct saving to the country as a whole, would increase the profit of wood-distilling plants now operating and perhaps make it possible for others to operate which at present cannot do so except at a loss. At the same time it was thought that if such products can be used as flotation agents, then their use would serve to increase the number of oils and other products available for flotation purposes. It was also hoped that it might be possible to discover a substitute for some of the most effective but comparatively high-priced oils which are now used for flotation

Danville, the county seat of Montour county, Pa., was one of the earliest and best-known centers of the iron intlustry in the State. It is situated on the north bank of the north branch of the Sosquehanna river, twelve miles east of the confluence of the north and west branches of that river at Northurnberlttnd. The ore-belt, extending for a distance of twelve miles along the north bank, has been developed in a number of places, but nowhere so extensively as in the immediate vicinity of Danville. Hence, a description of the mines in that locality will suffice, as typical of the workings of the entire section. Geology. The Montour ridge consists of an anticlinal fold extending from the source of Wapwollopen creek on the east to the west branch of the Susquehanna, which it reaches at the mouth of Chilisquaque creek. According to the reports of the First Geological Survey of Pennsylvania, the length of the ridge is nearly twenty-seven miles, with an average breadth of three-fourths of a mile, and a maximum elevation of six hundred feet in the vicinity of Danville, where it also attains its greatest width. Just north of Danville the Mahoning creek cuts through it, exposing the iron-ore on the hill-side, where advantage has been taken of this to work the beds on the southern slope of the ridge by means of drifts. The sections given in Fig. 1 are taken from the reports of the First Geological Survey of Pennsylvania, made in 1858, by H. D Rogers, whose description of the Moatour ridge was so complete and accurate that the entire report was reprinted as an appendix to Vol. G 7 of the Second Geological Survey. THE official title of our topic for today is "Resources of Metals and Other Strategic Minerals," but in accepting the invitation to open this discussion I claimed the privilege of being allowed to talk about problems other than resources for the two reasons that a great deal has already been said about resources and because we can never discuss them with the degree of certainty that an engineer likes. Resources are uncertain for many, reasons. One is that we do not know what is in the earth. It is four thousand miles to its center and although oil wells 1 ½ miles deep are becoming common and engineers are now talking of drilling holes 2 miles deep, even when they do they will have advanced only one two-thousandth part of the total distance. Only a relatively few mines are over a mile deep as yet. We know certainly that it is comparatively expensive to work at such great depth, but it would be a very foolish man who would assert it will be' impossible, one or two hundred years from now, for engineers to obtain from great depths mineral supplies that are now being obtained at or near the surface. As long as- I can remember I have been hearing that our petroleum resources were in imminent danger of speedy exhaustion, and yet the yearly output is now of the same order of magnitude as the total resources were once estimated, with ' the cry of over-production the loudest it has ever been. Tapping progressively deeper and deeper sources of supply, has produced this result. Even in the thin layer that we are now working much-exploration still remains to be done. .

The results of repressuring (or gas-drive) have been very encouraging to the several companies doing experimental work along these lines in California. The most notable examples are the Shell and the Union Oil companies at Dominguez, the Marland Oil Co. at Seal Beach, and the California Petroleum Corpn. at South Mountain. The results of the Marland test at Seal Beach are interesting in that re pressuring was started while several wells were still flowing; also, on account of the high pressures required to overcome the hydrostatic pressure exerted by high-head edge water. The well first chosen for repressuring is about halfway up the flank of the structure and had been on the beam making about 250 bbl. of fluid daily, cutting about 60 per cent. emulsion. The fluid lcvel was 230 ft. from the surface and the top of the sand was 4393 ft. Tubing was run to 4000 ft. with a packer and the space above the packer was filled with water to balance the high pressures. Gas was started in slowly to allow the fluid to be pushed back into the sand, and required three days at a pressure of 1500 Ib. per sq. in. before starting into formation. The pressure was once built up to 1800 Ib. and the compressor was shut down for a few hours. When again started, the well took gas at 1500 Ib., and after about three weeks the pressure was dropped to 1450 Ib. The present pressures required range between 1400 and 1450 lb. Volumes as high as 1,500,000 cu. ft. per 24 hr. were put into the well. Increases as high as 50 per cent. in production were obtained in wells up-structure with very little increase in wells down-structure. Also, the water cut on one edge well materially decreased. After about 40 days the repressuring was moved to two wells farther down-structure and the well originally repressured was put on production. The result of this was a great increase in the production of wells one location farther down-structure, a rapid increase in one well one location up-structure, and a decrease in production of the wells farthest up-structure. Later the gas started to short-cut to the nearest well down-structure, nullifying to a certain extent the effects of the repressuring work. INTRODUCTION Landowners in Texas for many years have freely granted, reserved and leased "oil, gas and other minerals" or interests therein. In recent years we have witnessed much litigation concerning what sub- stances should be included as "other minerals" within the phrase "oil, gas and other minerals," and this question has received the attention of numerous legal scholars. At the South Texas Uranium Seminar held in Corpus Christi, Texas, in September, 1978, Mr. William R. Dodson presented a paper dealing with this very subject and entitled "Uranium - Mineral or Surface? Who Owns It?" In his paper, Mr. Dodson reported on two recent Texas Supreme Court decisions, Acker v. a, 464 S.W.2d 348 (Tex. 1971) and Reed v. Wylie, 554 S.W.2d 169 (Tex. 1977). which held that the particular substance in question in each case is not a mineral within the phrase "oil, gas and other minerals" if substantial quantities of the substance lie so near the surface that production will entail the stripping away and substantial destruction of the surface. Since that time another chapter has been written in the Texas saga of "When is a Mineral not a Mineral?" and it is the intent of this paper to present an update of the Texas law. A review of the early Texas cases so ably covered by Mr. Dodson in his paper will not be repeated, except as is necessary to illustrate the evolution of the legal doc- trine which has been so aptly named "The Surface Destruction Test". BACKGROUND In order to appreciate the genesis of the problem, one must consider that oil and gas production commenced in Texas many years ago, Spindletop came in in 1901. As oil and gas became more valuable, land- owners with considerable frequency sold interest in the oil, gas and mineral estates in their lands, and reserved interest in the oil, gas and mineral estates in their lands when they disposed of their property. Due to the oil and gas background, and perhaps be- cause oil and gas was paramount in the minds of the parties, the traditional language employed in these grants and reservations was "oil, gas and other minerals" or variations thereof. There are literally hundreds of instruments employing this language constituting a link in the chains of title to thous- ands of acres of Texas land. In addition, there are thousands of acres of Texas land held by oil, gas and mineral leases, the primary terms of which have been perpetuated by production, containing similar language in their granting clauses. The severance of the mineral estate from the surface estate results in two separate and distinct estates, each having all of the incidents and attributes of an estate in land. with the surface estate being the serviant estate, and the mineral estate being the dominant estate and having certain easements in the surface estate to explore. produce and remove the minerals. Harris v. Currie. 176 S.W.2d 302, 305 (Tex. 1943). As observed by the court in the Harris case, this is because a grant or reservation of minerals would be wholly worthless if the grantee or reservor co~lld rwt enter upon the land in order to explore for and extract the minerals granted or reserved. Although the Texas law has recognized that an oil and gas lessee has the right to use so much of the surface as is reasonably necessary to produce the minerals. Warren Petroleum Corporation v. Monzingo, 304 S.W.2d 362, 363 (Tex. 1957), recent decisions of the Court have qualified this doctrine. In Getty Oil Company v. Jones. 470 S.W.2d 618 (Tex. 1971). Getty's pumpine, units were interfering with ones self-propelled sprinkler system utilized for irrigating the premises, and Jones sought to require Getty to install the-pumping units in cellars so that the sprinkler system could pass over them. In an effort to accommodate both the surface estate and the mineral estate, the court held (page 622) "...where there is an existing use by the surface owner which would otherwise be precluded or impaired, and where under the established practices in the industry there are alternatives available to the lessee whereby the minerals can be recovered, the rules of reasonable usage of the surface may require the adoption of an alternative by the lessee". Bearing in mind that the "reasonable use doctrine" grew up in the oil and gas industry involving sub- stances which can be produced by methods that do not destroy or deplete the surface estate, the question presented is whether the Texas courts will extend this doctrine to situations where claimants of "other minerals" seek to produce shallow deposits of iron ore, coal, lignite and uranium by surface mining methods which do destroy or deplete the surface estate? The surface destruction test has answered this question in the negative, at least as to iron. coal and lignite. However, the multitude of mineral estates in Texas which have been created by a grant. reservation or lease of "oil, gas and other minerals" will, doubtlessly, continue to fuel the fires of litigation.
