In June 1996, the United Nations International Seabed Authority opened shop in Kingston, Jamaica as an autonomous international organization charged with the administration of seabed mineral developments in all areas beyond national jurisdictions. The Authority is a consequence of the 16 November, 1994 entry into force of the 1982 United Nations Convention on the Law of the Sea (UNCLOS) and the 1994 Agreement relating to the Implementation of Part XI of UNCLOS. The total seabed area included within the Authority?s purview has yet to be assessed accurately, but clearly constitutes the largest single jurisdiction on the planet. The Authority is governed by legislative bodies called the Assembly and the Council and an administration called the Secretariat. The Assembly includes representatives of the 132 member states which are currently parties both to UNCLOS and to the 1994 Agreement. These member states directly fund the operations of the Secretariat. They include most of the world?s developed nations, island nations, and others among the 188 independent countries which are members of the United Nations. Notably absent are the United States and Canada, which are the only developed coastal states not represented. The Council is a 36-member subset of the Assembly representatives selected through a somewhat involved process designed to achieve a balanced representation of the specific interests of the members. Ultimate responsibility for the Authority?s actions resides in the Assembly, but most initiatives originate in the Council. Also included in the Authority are two subsidiary advisory bodies, the Finance Committee, which reviews the Secretariat?s budget, and the Legal and Technical Commission, which evaluates claims and drafts technical regulations. The Secretariat itself includes a staff of about 30, including 15 highly qualified and competent attorneys, accountants, engineers, and scientists. "INTRODUCTIONFerromanganese (Fe-Mn) crusts are a kind of marine chemical sediment composed of Fe and Mn oxy-hydroxides as well as small amounts of clastic sediments, which are ubiquitously found on the surface of slopes of seamounts and oceanic plateaus at depths from 900 to 5500 meters below sea level (mbsl). Fe-Mn crusts contain extremely high concentrations of useful minor metals such as Co, Ni, Te, REEs, and thus are expected as submarine mineral resources. Also, Fe-Mn crusts record the change of chemical compositions of seawater during last several tens million years, which allow us to obtain clues to clarify the paleoenvironmental conditions at the time of its deposition. However, occurrence, chemical compositions, microbial community and growth patterns of ferromanganese crusts are yet fully understood. Hence, a comprehensive study on the genesis of ferromanganese crusts, such as growth rates and enrichment processes of elements, is required to better understand their resource potential as well as their applications to paleoceanographic study.Based on the resource potential of ferro-manganese crust, the project entitled “Next- Generation Technology for Ocean Resources Exploration” was launched as one of the governmental projects to develop the exploration technology based on the scientific research on the submarine resources such as hydrothermal deposits (e.g., a poster by Kawada et al.), ferro-manganese crusts. We have made several research cruise to seamounts in the north-western Pacific such as Takuyo-Daigo and Takuyo-Daisan seamounts (Fig. 1) ."

The continental shelves occupy a vast area of Russia and contain complexes of commercial placer minerals. Of prime importance are Cenozoic placers of valuable minerals including gold, cassiterite, diamonds, chromite, platinoids, and minerals of titanium, zirconium and rare earth elements, biogenic amber and fossil ivory (1). Commercial placer minerals are associated with shelf placer formation zones (SPFZ). These zones are located at junctions of marginal orogens and shelf troughs in morphostructures where upwarping, subsidence, and sign-variable neotectonic movements are not significant. The SPFZs are characterized by ancient buried leveling planes with mantles of waste, series of wave-cut aggradation terraces on land and beneath the sea, and drowned and buried stream valleys. The occurrence of mineral placers in the SPFZs was caused by endogenic mineralization and exogenic placer hosted formation. Concentrations of commercial biogenic minerals are associated with areas of burial of biogenic material (release of resins by plants and theriofauna thanatocoenoses) and with their transition zones. Since the Oligocene, alternations in marine transgression-regression have dominated the shelf areas. This has resulted in the formation of polygenic placers. Climatic conditions are of great importance: warm and humid climate in the Paleogene-Neogene changed to colder climates in the late Pliocene (polar type sedimentation; formation of permafrost strata and sea glaciation). These events are responsible for the regularity in placer formation during the Cenozoic in which the early Cenozoic (Eocene-Oligocene-Miocene) and late Cenozoic (late Pliocene-early Pleistocene and late Pleistocene-Holocene) epochs are prominent.

Hawai'i is surrounded by a series of potentially valuable marine mineral deposits. These include manganese nodules between Hawai'i and Mexico, cobalt-rich manganese crusts and phosphorites in the Exclusive Economic Zone around the Hawaiian Island Archipelago, Johnston Island and the neigh- boring island states and sand and gravel deposits off the main Hawaiian Islands largely in State waters. Hawai'i has an economy that is very narrowly based on the tourist industry. In an effort to avoid the difficulties coming from such a vulnerable economy, significant efforts have been made toward economic diversification. The State has set up a range of programs looking to find new industries. New ocean industries figure prominently among these efforts as Hawai'i is surrounded by ocean. Naturally, among new ocean industries the potential for new marine mineral industries is significant given that Honolulu is the only full service port in the Central Pacific and Hawai'i is in the middle of the mineral belt. The port of Honolulu is now being actively used by mineral exploration vessels of several countries and with the current number of ship visits varying from 10-15 per year, this puts several million dollars a year into the State economy. It helps to fulfill the State's goal of dynamic growth in the ocean sector of the economy. Nonetheless, a major marine minerals industry, particularly one which would involve processing of minerals in Hawai'i, is controversial in a State whose main source of revenue is tourist expenditures based on the image of a pristine environment. In addition to the perceived threat to the hotel and fishing industry, is the whole highly emotional debate concerning preservation and development. To complicate the issue further, the major interest in developing a marine minerals is currently largely from Korea and China rather than from domestic U.S. industry. On the other side of the debate is the fact that the State's economy is hampered by many low paying jobs and a lack of technical jobs. This is further exacerbated by the fact that lower paying jobs are held disproportionately by people of Hawaiian and Pacific Island ancestry. Naturally, this leads over time to a certain amount of resentment. The higher paying technical lobs associated with a minerals processing industry could help to alleviate this problem.

Following the recent award of a prospecting license by the New Zealand Government, Widespread Energy Ltd. (Widespread) is focused on the acceleration of its exploration program in order to bring a potential phosphorite deposit to market in the near future. Rock phosphate is the primary constituent of most fertilizers that are manufactured and distributed in New Zealand. Field trials in the 1980s demonstrated that direct application of rock phosphate can result in a more effective fertilizer (than super-phosphate) with less environmental damage from run-off. At present virtually all of the rock phosphate used by the New Zealand fertilizer industry (approximately 1 million tonnes a year) is imported from Morocco. In recent years price increases of up to 12 fold (peak of $500/t) with massive increases in freight costs have bought to the forefront the economic opportunity to in part replace foreign imports with a local source of phosphate. The Chatham Rise phosphate deposits are relatively well understood, having being discovered during the 1950?s and it is estimated that approximately 100 years supply (at current requirements) is present at shallow depths. An estimated 100 million tonnes of rock phosphate is present within the license area based on previous private and publicly funded research. Widespread has engaged several parties to assist in the exploration planning to confirm the resource potential. Widespread has commenced investigating the feasibility of recovering the phosphorite nodules off the sea floor, and presently has several conceptual technical solutions under consideration and will advance the discussions with potential contractors during the exploration phases. Widespread is acutely aware of its responsibilities to conduct both the exploration program and extraction of the rock phosphate, in a manner that causes minimal disruption to the marine environment. To this end, the National Institute of Water and Atmosphere (NIWA) ? a New Zealand Crown Research Institute has been engaged to assist in designing sampling and extraction methods that will minimize disruption to the seabed. All sampling and extraction activities are planned to be conducted with reference to the environmental guidelines published by the International Marine Minerals Society ?Code for Environmental Management of Marine Mining.? Widespread is conducting its project with a background of changing regimes to both the allocation and environmental management of its activities.

INTRODUCTION Due both to the political history of UNCLOS and the sensitivity of the ocean floor and environment to man made impacts, both the Convention (including also the 1994 Amendment) and subsequent codification (such as the ISA draft code on Exploitation of Mineral Resources in the Area) put a focus on information about, and conveyance of, technology employed by interested deepsea mining companies, to inter alia the Authority and developing countries. In contrast, companies usually are (or by their nature should be) interested in safeguarding their technology and business secrets in order to secure unique selling propositions in a competitive environment. On the background of the meanwhile maturing regulatory régimes on deep sea mining, the presentation will look into some of the key regulatory provisions mirroring these apparently antagonistic interests, how the players involved could deal with them, and how they might in some cases be reconciled. Progress of Presentation The presentation will start by briefly examining some classical methods of protection of technology, such as patents, copyrights, and (not the least) secrecy. It will be found that some of the statutory means of protection due to their territorial character may face problems in being implemented in areas outside national jurisdiction, such as the Area, but that, thinking globally, they nevertheless retain much of their value for the purpose of protection. Depending on available presentation time, a model case may be used to illustrate the above – and also some of the following – findings.

The City of Honolulu mines sand from nearshore deposits for beach maintenance. The suction dredging operation creates a discharge plume which is carried by currents and other motions until it settles out of the water column. The dispersion of such a plume is influenced by distribution of particle size, as well as site dynamics. Interest in dispersion characteristics stem$ from concern about possible deleterious influences of such a plume on the nearshore environment. The behavior of such plumes has been modeled by Brandsma and Divoky (1976), as well as others. This study is an attempt to calibrate a plume model (modified from Brandsma and Divoky's model by Wang), using concentration, turbidity, and fluid velocity measurements of a small plume taken under field conditions. This calibrated model could then be used to predict dispersion characteristics of a much larger plume. Sand suction-dredged at a depth of 12m with a four-inch pipe and discharged at midwater was used to create a test plume closely simulating the conditions found during regular mining operations. Water samples containing suspended material were taken at varying distances from the discharge, from which concentrations were measured in the lab. Transmitted natural light measurements were used to provide estimates of turbidity. Current velocities were measured using current meters, as well as drogue-following methods. These data were then used to help estimate the vertical diffusion coefficient in the model.

Two principal types of the hydrothermal fields in Atlantic - axial and off-axis - could be established based on their structural setting in the rift zone of the Mid-Atlantic Ridge (MAR) (Figure1). The first (axial) type is represented by five high- and three low-temperature hydrothermal sites (Table 1). All of these fields are connected with young axial effusive volcanism and related to large linear volcanic ridges or central volcanoes at the inner floor of the rift valley. The hydrothermal activity here is controlled by the intersection between longitudinal magma feeding faults and transverse weakened zones characterized by high permeability. [ ] The hydrothermal sites of the second (off-axis) type (such as Rainbow, TAG, 24°30?N, Logatchev, newly discovered 13°N (Figure 2) and possibly 16°48?N sites) are related to large tectonic dislocations forming marginal scarps of the rift valley as well as transverse discontinuities.

Since becoming a public company in October 2005, Neptune Minerals has continued to advance its primary aims. New Zealand lies astride a convergent plate boundary that extends north-eastwards from the Taupo Volcanic Zone (TVZ) to Tonga. This boundary is marked by the Kermadec arc, c. 1200 km of which falls within New Zealand’s EEZ, and which is host to numerous volcanic edifices both on the arc and in a zone immediately behind the arc to the west. In 1999, thirteen volcanic centres in the southern 260 km of the arc were surveyed for their hydrothermal plumes with seven of them discharging vent fluids into the surrounding ocean. Three of the seven volcanic centres have had mineralised rocks recovered from them during dredging and submersible operations, namely Brothers, Rumble II West and Clark. Presentday plume data combined with mineralogical evidence indicate that the vent sites at Rumble II West and Clark are waning, although the presence of Cu-rich sulphides in samples recovered from Rumble II West suggest there may be a massive sulphide (Cu-Zn-Pb-Ba ± Au) deposit located within the caldera. Brothers volcanic centre is host to the largest polymetallic mineral deposit discovered along the Kermadec arc and has numerous, up to 7 m tall chimneys within a c. 600 x 200 m area located on its NW caldera wall. Geochemical data indicate that concentrations of base metals are variable and depend critically on sample type. When combined with mineralogical and plume data, this indicates addition of a magmatic fluid component to the vent fluids.

Phosphate deposits on the southeastern U.S. coastal plain have long been the major force in world phosphate markets. World markets continue to grow, but the role of U.S. resources is rapidly declining. This situation results from a complex interaction of economic, political, and environmental factors. Causes for this ongoing erosion of the U. S. market include 1) escalating costs, 2) changes in land-use patterns, 3) environmental pressures oh conventional mining techniques; 4) exhaustion of shallow, high-grade resources in Florida, and 5) increased, low-cost production in other countries throughout the world. In fact, some agencies and commodity personnel predict that the U.S. will become a net phosphate importer early in the next century. If this projection is correct, the U.S. industry must look towards major changes in the near future in order to continue to compete in the world market. One possible change includes development and application of unconventional mining techniques to cheaply recover vast 'new' potential resources in areas with lower land-use pressures. These 'new' resources include 1) deep phosphorites within major sediment basins of the southeastern coastal plain and 2) subsurface phosphorites on the continental shelf and within the U.S. EEZ. These latter resources include extensive deposits in Onslow Bay, N.C.; broad regions offshore of Savannah, Ga. and Cape Canaveral, Fla.; and the central portion of the west Florida shelf. Ferromanganese crust samples collected from Central Pacific sea-mount areas became of special interest after surprisingly high nobel metal contents have been analyzed. Hydrogenetic crust growth is controlled by the conditions of the oceanic water column. Thicker encrustations show two crust generations of different age ranges. The mean values of the chemical composition state that the older generation is richer in P, Ca, Ni, Cu, Zn, and Pt and depleted in Fe, Ti, Co, Al, and Si. The differences apparently indicate a distinct change of the geochemical environment. The Pt concentrations vary up to 1800 ppb and do not clearly correlate to one of the other metals. This might indicate a bond of multiple nature. Several mechanisms have been proposed to explain the Pt concentrations in ferromanganese samples. Our models consider seawater and cosmic spherules as responsible Pt sources. In seawater the main species of dissolved Pt probably exist as the doubly negatively charged tetrachloro-complex. A precipitation of Pt in seawater may take place if the chloro-complex is decomposed by reduction of pt2+ to pt0. On the other hand, the Mn02 precipitation is caused by an oxidation of Mn2+ which is supplied from the oxygen-minimum zone. Studies of benthic recolonization following the cessation of dredging in U.K. waters and elsewhere are limited, and are largely confined to experimental circumstances. Investigations of the physical and biological status of licensed areas in the U.K. at various times following cessation of commercial dredging are very limited and so judgments as to the likely progress towards environmental restoration and the time-scales are often based on predictions rather than real data. This study was established to address this deficiency by assessing the status of seabed substrata and associated benthic fauna within and outside areas where dredging had ceased and to conduct follow up sampling to monitor progress towards full recolonization.

Co-rich hydrogenetic ferromanganese crusts are typical marine interface products of growth processes taking place on sediment-free substrate rocks on the seafloor. They grow very slowly and preferentially in water depths below the oxygen-minimum zone (OMZ) and have so far been found even in water depths of up to more than 5000 m, i.e. also below the calcite compensation depth (CCD); these deep ferromanganese crusts are particularly rich in Fe. It is assumed that the O2-minimum zone is the most important source layer of dissolved manganese, the decomposition of fecal pellets here also contributes to this Mn-budget. The process of hydrogenetic precipitation is basically an inorganic colloidal-chemical as well as a surface-chemical mechanism. Microbial mediations can be assumed, in particular since steps of redox-reactions are involved. The two main components of the hydrogenetic substance are hydrated d-MnO2 (vernadite) and x-ray amorphous Fe-oxyhydroxide, both of which are intimately intergrown with each other forming the extremely fine-grained hydrous oxidic material. In seawater, elements occur as dissolved hydrated ions or as inorganic as well as organic complexes which, in general, have either a positive or a negative surface charge depending on the pH of the respective marine environment. These complexes form hydrated colloids that interact with each other or with other dissolved hydrous metal ions. The main agent to oxidize the dissolved Mn2+ ions is oxygen, transported upwards from deeper water by turbulent eddy diffusion and turbulent rise processes at seamount slopes.

In this first sub-seafloor examination of an active hydrothermal system hosted by felsic volcanic rocks at a convergent plate margin, we drilled 13 holes altogether, achieving deep cored penetrations at two sites. Our aims were (1) to delineate the lateral and vertical variability in mineralisation and alteration patterns below the PACMANUS hydrothermal site near the 1650-1700 m-deep crest of Pual Ridge in the eastern Manus back-arc basin, so as to understand links between volcanological, structural and hydrothermal phenomena, and (2) to establish the nature and extent of microbial activity within the system. Technological innovations vital to success included our precise location of holes on small targets with drill-stem video, the use of a new hard-rock re-entry strategy, and deployment of casing with a new hammer drill. Other technical achievements were the first ODP application of an advanced diamond coring system, and the first direct comparison in a hardrock environment between structural images obtained by wireline methods and by logging-while-drilling (resistivity-at-bit).

Studies of benthic recolonization in the aftermath of marine aggregate dredging in the U.K. and elsewhere are limited and are largely confined to experimental circumstances. Investigations of the physical and biological status of licensed extraction sites in the U.K. at various times following cessation of commercial dredging are very limited, and so judgments as to the likely progress towards environmental restoration and the time-scales involved continue to be based on predictions rather than real data. This field-based research programme was commissioned to enhance the understanding of processes leading to physical and biological recovery of the seabed following dredging, thereby aiding the identification of practices to minimize environmental harm at licensed sites, and to promote rehabilitation on cessation. The outcome of survey work will have the notable benefit of allowing questions about the present status of locations hitherto subject to commercial exploitation to be answered directly, rather than by inference.

The development of marine mining in the offshore areas adjacent to most of the insular and continental European States is limited by the complex and evolving nature of its legal regime on the basis of the relevant applicable international, European and domestic rules. As the development of marine mining requires investments in capital-intensive technologies, the bankable feasibility of marine mining projects is very much dependent on the legal security of mining rights, assets and operations in offshore areas. This is quite difficult to assess due to the constant accumulation of applicable and potentially conflicting international and domestic laws in these areas, in particular the coastal zone, the territorial sea, and the Exclusive Economic Zone (EEZ). The often conflicting interaction of international treaties, laws and regulations in offshore areas raises specific and major issues in terms of permitting processes, access rights, ownership rights over the mineral resources explored and mined, flag vs. coastal State jurisdiction over mining vessels and marine mining equipment, international environmental liabilities, and unitisation and multi-forum disputes. In addition, the determination of jurisdiction and the legal regime under which marine mining could take place is becoming even more complex with the development of EU Law and the recent revision of the International Law of the Sea, particularly the new extension regime of the EEZ and jurisdiction over the continental shelf.

An international research team working through the Hawai?i Undersea Research Laboratory (HURL) undertook a bold challenge to explore the chemistry, geology, mineral formation and superheated hydrothermal vents of the Kermadec Island Arc. With the mothership, R/V Ka?imikai-o-Kanaloa, scientists from six research institutions explored the active submarine volcanoes stretching over a line of volcanoes 1,000 miles long between Samoa and New Zealand. The expedition left Hawaii on the 18th of March 2005 and returned on the 5th of August having covered a distance of 10,000 miles between Hawaii and New Zealand. Scientists from the USA, New Zealand and Germany used the HURL submersibles, Pisces IV and Pisces V, as well as the remotely-operated vehicle RCV-150, aboard the R/V Ka?imikai-o-Kanaloa to dive into active volcanoes to water depths of 2,000 meters. Scientists from New Zealand, the USA and Germany conducted 41 dives on the previously unexplored (from manned submersibles) submarine volcanoes. Ten active volcanoes were explored during this time. Hundreds of specimens of new and unusual marine life, water chemistry, extremophile microorganisms, mineral formations and volcanic rocks were collected during this expedition with the two submersibles and the ROV. Bizarre natural events, such as the oozing of hot liquid sulfur from the ocean floor onto the skids of the submersible were observed. Carbon dioxide gas was observed profusely streaming into the seawater from the volcanoes, making these one of the greatest contributions to hot house gasses entering the atmosphere.

The recovery of most minerals, which are amenable to gravity concentration, is standardly determined by accurate sampling and assaying. .With respect to particulate - gold ores, sampling and assaying are still the convention, but the accuracy and reproducibility of these operations are much discussed and debated points. Evaluation of gravity concentrators by conventional sampling and assaying techniques is very time consuming, costly and may introduce a large amount of uncertainty into the results due to the particulate nature of placer gold. These problems are not unique to placer gold ores and apply to any low grade ore with particulate values. A gravity concentrator evaluation process developed by MIRL employs the use of neutron activated gold (198Au) and radiation detection circuits which monitor the concentrator's product pulp streams. Concentrator recovery is determined from the ratio of the number of gold particles detected as passing into the concentrate to the total number of gold particles detected over all monitored pulp streams. This system eliminates the experimental errors introduced by sampling, sample reduction, and assaying and allows recovery to be evaluated for gold particles of specific sizes, shapes, and flatness. This system enjoys its greatest utility where a large number of tests are to be run in order to evaluate a concentrator over a variety of operational settings, i.e. factorial designs, and allows accurate testing of concentrators operated in closed circuit systems. Beginning in 1984, MIRL conducted radiotracer studies of unit processes, which included jigging, static wedge wire screening, elutriation, and concentration with compound water cyclones.

"Seafloor massive sulfide (SMS) deposits are a new frontier in global metal resources. Hydrothermal chimney’s (black smokers) precipitate Cu, Zn, Ag and Au rich from hot fluids (>250°C) during interaction with cold seawater ~2-4°C. Here we compare the sulfide mineralogy and geochemistry of Cu-sulfide chimney samples from two different tectonic locations: Solwara 1, a Cu-rich, transitional arc-back arc (Arc-BA) type SMS ore deposit and; Ashadze-1, a Cu-rich, ocean ridge type SMS deposit (Hannington et al., 2011).This work represents the first stage of a project aimed at investigating and understanding the significance of high Cu concentrations in SMS systems. Comparing these particular systems is significant because they share critical similarities despite being located at different seafloor depths, hosted in different rocks and are located in two different endmember tectonic environments. Critical similarities include: 1) age of mineralization, ~6000 years to current (Firstova et al., 2016; Johns et al., 2014); and 2) high copper contents, with chalcopyrite dominating sulfide mineralization (Firstova et al., 2016; Lipton, 2012). The reason for high Cu concentrations in both of these locations is still not entirely understood. The youthfulness (<6000y to current) of both locations is important because it reduces the possibility of increased zone refining, allowing us to understand the source characteristics better. This research will advance our understanding of the copper systematics of SMS systems by investigating and comparing the mineralogical and geochemical signatures from two, Cu-rich, end-member type SMS sites."
