OWNERSHIP OF ORE-CONSTRUCTION OF CONTRACT. A contract between the Republic Mines Corporation and the Quilp Gold Mining Co. provided that upon forfeiture of its rights under a contract the Republic Mines Corporation was required to give a good and sufficient deed conveying to the Quilp Gold Mining Co. all ore bodies of every description lying east of the west line of the Quilp Mining Co. claim extended downward vertically and lying south of the north end line of the Quilp claim extended downward vertically and which may apex within the lines of the Surprise, an adjoining mining claim. It must be presumed that the contracting parties under such circumstances had in view their statutory rights as provided by the mining statutes of the United States, and that both were familiar with the provisions as to extra- lateral rights granted by the statute to locators of mining claims. This contract means to include all ore bodies of every description lying east (or easterly) of the west (or westerly) line of the Quilp claim extended downward vertically and south (or southerly) of the north end line of the Quilp claim extended downward vertically within the Quilp claim excepting the part that was overlapped by the Surprise claim, owned by the Republic Mines Corporation. Quilp Gold Min. Co. v. Republic Mines Corp. (Washington), 165 Pacific 57, p. 61. PURCHASE OF GAS-REFUSAL TO DELIVER SALE TO OTHERS. A gas company that had entered into a contract to purchase a quantity of natural gas refused to receive and accept the gas that was tendered on the ground that it did not conform to the requirements of the contract; subsequently the company refused to sign a writing by which it was asked to consent to the sale of such gas to other persons. But the refusal of the purchasing company to sign such a writing giving its consent or its refusal to consent to such sale did. not affect the rights of the seller to dispose of the gas elsewhere and to other persons. OWNERSHIP OF MINERALS IN HIGHWAY. All mineral deposits within the limits of a highway belong to the owner of the fee and he is entitled to remove them so long as he does not interfere with the public use of the highway. City of Scranton v. Scranton Coal Co. (Pennsylvania), 100 Atlantic 813, p. 819. SALE AND CONVEYANCE. SALE AND CONVEYANCE EXCEPTION AND RESERVATION. The owner of an undivided interest in oil and gas lands conveyed the same to certain named grantees by deed containing a clause excepting and reserving all the oil and gas produced from the undi- vided interest in the land described. The language is not apt for the creation of either an exception or a reservation, but is rather that of a layman unfamiliar with legal distinctions. Strictly and literally construed, it affords a basis for a contention that that which was excepted and reserved was not realty in any form or anything inci- dent thereto, but personalty produced from the land. Immediately following the description of the tract, the grantor excepted and reserved something from the land described. What he excepted and reserved, he excepted and reserved then, and it was from his interest in the land. The clause expressed according to the evident intention of the grantor would read: "Excepting and reserving from the above all oil or gas which may hereafter be produced therefrom." No other construction can reasonably be placed upon the language used. The carving out of a separate estate in the oil and gas in land is a common occurrence in oil and gas producing fields. Mandle v. Gharing (Pennsylvania), 100 Atlantic 535, p. 536. RESERVATION CONSTRUED AS AN EXCEPTION. Where apt words of reservation are used in a deed they will be construed as an exception where this is the evident intention of the parties to the instrument. Although an exception and a reservation differ in legal effect, yet in their creation there is no magic in words, and if the meaning is clear either expression will operate for the purpose designed. The technical distinction between an exception and a reservation is frequently disregarded in the ordinary use of the word, and whether the language used creates an exception or a reservation must be determined from the intention of the parties ascertained from the entire instrument.

The purpose of this work was to Investigate the rate at which coal is delivered from the underground working face by gathering arm type loaders as employed on continuous mining machines, to identify the factors - geometrical , geological, mechanical, or procedural - which affect the delivery rate, and to develop quantitative rate-descriptive equations for the loading function. The mathematical techniques employed were factor analysis and multiple linear regression. It was determined that the coal-cutting function of the continuous mining machine is the factor that primarily Influences the loading function The geometrical factors -the dimensions of the work area In relation to the dimensions of the mining machine -were the factors of secondary influence. Fifty-five percent of the experimental variation in the loading function was explained in terms of the six most prominent Independent variables. It is expected that this work will be useful In operations-research studies as applied to underground coal mining, and with refinement will enable mine planners to select equipment based on the operating characteristics of the equipment and the mining conditions.

Active and abandoned mine sites can be an irresistible- - and sometimes deadly - - draw for outdoor enthusiasts, particularly children and young adults. Despite repeated warnings, posted signs, and fencing, tragedies involving accidents on active and abandoned mine property continue to make headlines, especially with the arrival of warmer weather and the summer months ahead. Over the last few years, there have been dozens of tragic incidents involving children and adults ventur­ing onto active and abandoned mine property. They include: A 16-year-old youth suffered fatal injuries after his all-terrain vehicle became airborne in an accident at a gravel mine near Albany, New York. A young boy was electrocuted when he contacted a high-voltage power line while sliding down a stockpile at a sand and gravel mine in Grand Island, Nebraska during its off-shift hours.

"INTRODUCTION The strategic importance of zinc warranted investigation of the Silver Eagle zinc prospect, which was first examined by an engineer 3/ of the Bureau of Mines in January 1943.From October 12, 1943, to March 16, 1944, the Bureau explored the deposit by trenching, core drilling, and sampling to establish the amount and grade of ore and to test for the presence of sulfide-ore minerals at depth.ACKNOWLEDGMENTSIn its program of exploration of mineral deposits, the Bureau of Mines has as its primary objective the more effective utilization of our mineral resources to the end that they make the greatest possible contribution to national security and economy. It is the policy of the Bureau to publish the facts developed by each exploratory project as soon as practicable after its conclusion. The Mining Branch, Lowell B. Moon, chief, conducts preliminary examinations, performs the actual exploratory work, and prepares the final report. The Metallurgical Branch, R. G. Research work in the Bureau of Mines cryogenic laboratory requires the use of high-sensitivity galvanometers of the d'Arsonval type in a building that is subject to unusually severe vibrations. A modified form of the galvanometer suspension described by Julius3 has damped the vibrations so successfully that a short note concerning it is thought to be desirable, The laboratory is on the site of the Amarillo helium plant near a building that houses gas engines of from 180 to 250 hp., driving compressors and electric generators. The distances from the galvanometers to the individual engines range from about 80 to 180 feet. The subsoil, consisting of black clay loam, transmits the impulses without much damping. The usual methods of protecting galvanometers from vibration were tried and proved fruitless. A Julius suspension purchased on the market was carefully installed in the hope that it would overcome the difficulty, but the conditions were too severe even for this elaborate arrangement. Several mudifications of the original Julius suspension, which were then introduced, resulted in almost complete elimination of all vibrational effects.

SCIENTIFIC inquiries concerning phenomena that may influence mining technology were widely publicized during the year. The deep-hole drilling project "Moho," 3 the use of nuclear explosives underground, and the recovery of minerals from the depths of the sea became subjects of scientific and general discussion. The mining industry continued to watch these developments with keen interest: but its more immediate concern was the increasing tempo of competition between mineral commodities, the domestic producers of these commodities, and foreign sources of supply. The competitive situation has intensified the industry's efforts to develop more efficient new mining methods, as well as to improve the efficiency of present practices. The attitude of the industry was well illustrated by rapidly expended use of low-cost ammonium nitrate explosives, the establishment of rigid schedules for equipment maintenance, and close attention to the detailed costs of production. The complexity of planning a new coal mine is aptly illustrated by the editors of Mechanization in the April 1959 Issue, in which they outline the cost of developing a mine and the various problems, factors, and decisions involved.4

The mineral dressing research here reported is part of a continuing program by the Bureau of Mines to develop new or improved concentration processes for oxidized or partly oxidized lead and zinc ores. A sample of low-grade sulfide-oxide, lead-zinc ore from Jasper County, Mo., containing galena, cerussite, pyromorphite, hemimorphite, smithsonite, and sphalerite was concentrated by froth flotation and tabling to a grade of 66 percent lead. Because of the presence of a high content of slime-size values, the overall recovery of lead was limited to 64 percent at this grade. Tests to recover the zinc by froth flotation and by gravity concentration did not give satisfactory results. INTRODUCTION Since its establishment, the Rolla Metallurgy Research Center has con-ducted studies of base metals as a part of its overall program (1, 2, 3, 4, 5,6,7).3/ This research has been, and is, directed to beneficiating complex and submarginal ores, to retreating rejects from commercial installations, and to developing fundamental data.

Research by the Bureau of Mines includes efforts to devise means for maximum recovery of critical and strategic metals from primary and secondary domestic resources. As part of that effort, the Bureau developed a hydrometallurgical process to recover Co, Ni, and Cu from Missouri lead-smelter matte. The process includes leaching with H2S04 plus Mn02 as an oxidizing agent, liquor purification, selective precipitation of CuS, (Co,Ni)S, and MnC03, and crystallization of Na2S04&apos; This report is concerned primarily with liquor purification, in which As and Fe are removed from the leach liquor by pH adjustment and filtration. Two variations of the purification step are described. One variation provides liquor containing <1 mg/L As and Fe but requires two solid-liquid separations, The other is achieved with only one solid-liquid separation but leads to a lower degree of purification.

The Kroll-Betterton process for debismuthizing lead is based on adding calcium and magnesium to impure molten bullion to form solid Ca-Mg-Bi inter-metallic compounds that float on the surface as drosses. Present practice in industry is to hand-skim off these drosses, often followed by hydraulic pressing to squeeze out some of the entrapped liquid lead. In an effort to develop an improved technique, the use of an argon-shrouded dipping centrifuge to perform the required phase separation was investigated. Centrifugation experiments demonstrated that the bismuth content of an impure bullion could be lowered from an initial 0.5 percent down to 0.03 percent with a lead recovery of 90 percent, which is comparable to lead recovery after hand skimming of drosses in commercial lead-debismuthizing operations. Centrifugation provides better control in removing drosses, faster operation with less oxidation and relatively little fuming, and recovery of a lead bullion that approaches commercial specifications.

ALL of the 45 political divisions of Africa were accessible to non-Communist world industry and commerce throughout 1964, although in some of them revolt and political attitudes presented problems. The position of the continent as a whole for mineral and mineral fuel resources, production, and oversea exports continued to improve. At yearend, significant quantities of a greater number of mineral commodities vital to industry and agriculture were being produced than in any other continent. This statement excludes Communist areas on other continents but might well hold true even if such areas were included. Deriving from its exceptionally diversified production, Africa furnished overseas industrialized countries as a w ole a greater variety of key mineral commodities than any other area. In addition, the value of mineral imports from Africa into the United Kingdom and continental non-Communist Europe probably exceeded the value of such imports from any other area if gold is included and mineral fuels excluded.

In an effort aimed at monitoring mining-induced stress changes that may influence ground failure, the US Bureau of Mines conducted a series of active 3-D seismic tomographic surveys at the Homestake (Lead, South Dakota) and Lucky Friday (Mullan, Idaho) mines. Existing rock bolts were used to mount geophones and as strike points for introducing seismic energy using a 3.6 kg sledge hammer. Travel time measurements were recorded spanning up to 160 m between drifts at several levels. The tomographic uncertainty was minimized by computing iso-velocity surfaces of constant probability based on statistics from multiple reconstructions and a threshold criteria. Periodic imaging using tomographic velocity surfaces demonstrated that temporal and spatial changes in the local stress field occurred in response to ground failure and stope advancement at a gold and silver mine, respectively. Growing concern from labor unions, regulatory agencies, and industry about the safety of a prevalent underground coal mining method which utilizes remote control has prompted human factors field evaluation of mining activities. Remote control operations were implemented with little consideration given to human-system interactions. Ideally, collecting and analyzing information prior to implementing new technology would have helped to address potential problems. One such problem that operators and other mine personnel are faced with is the question of where they should safely position themselves to avoid injury while remotely operating machinery. To determine work methods employed by machine operators before and after implementation of the new method, work sampling techniques have been used to provide data about positioning of face crew members at different points in the mining cycle. This data provides information for optimal positioning, leading to safer operating procedures and identifying training shortfalls.

DOMESTIC production of carbon black increased 4 percent in 1962 to 2,056 million pounds. Furnace black output was 8 percent, or 132 million pounds, above that in 1961 and accounted for 90 percent of total carbon black production. Channel black output continued to decline and was 55 million pounds less than in 1961. Carbon black shipments during the year totaled 2,082 million pounds and were 5 percent above those of 1961. About one-fifth of these shipments were exported; the balance were sold domestically. An increase of 180 million pounds in domestic sales was partially offset by a decline of 80 million pounds in exports. Total value of carbon black production in 1962 was $145 million. The average value per pound of 7.06 cents was 0.24 cent per pound less than in 1961. Producers&apos; stocks declined 26 million pounds during the year.

The Bureau of Mines undertook the development and evaluation of a system to provide a simultaneous, on-line determination of both iron and silica in iron ore beneficiation streams as part of a program to improve the efficiency to mineral separation processes, Californium-252 (252-Cf) was the neutron source used in the system for measuring the amounts of silica and iron in bulk slurries by thermal neutron capture-gamma ray spectra analysis. The theory of thermal neutron capture-gamma ray reactions and their potential application to mineral processing stream analysis is discussed. The prototype system and supporting software developed by the Bureau is described. During the initial phase of the work, both simulated and actual pilot plant slurries were investigated using a 60-to 32-µg 252-Cf neutron source. The percent solids of the slurries was ranged from 2 to 40 percent and the silica and iron content ranged from 1.5 to 83 percent and from 10 to 65 percent, respectively. Accuracy of the determination of the components in the solids was dependent upon the percent solids in the slurry.

The National Institute for Occupational Safety and Health (NIOSH) mining research program at the Pittsburgh Research Laboratory (PRL), includes the areas of coal mine dust control and monitoring, and explosion prevention. One very important project at PRL is development of a continuous recording person-wearable respirable dust monitor. This Personal Dust Monitor (PDM) is a respirable dust sampler and gravimetric -equivalent analysis instrument that is part of a belt-worn mine cap lamp battery unit. Prototypes were successfully tested in the laboratory and in four underground coal mines. The PDM testing demonstrated that it was convenient to wear and use, robust, and provided accurate and timely data. NOSH is also conducting research in the program area of coal mine explosion prevention, suppression, and mitigation. Aspects of this research program include: full scale explosion research, laboratory scale research, frictional ignition of methane, mine ventilation seal construction, prediction of coal mine methane emissions, mine monitoring systems, flame cutting and welding operations, spontaneous combustion, and emergency preparedness.

Each year at least one and in some years several explosions are reported as having resulted from firing of mudcapped shots in coal mines; undoubtedly a number of small or local explosions occur that are not reported; in addition there are numerous accidents, some of them fatal, attributable to this reprehensible blasting practice. It is surprising that so few explosions and other accidents from this cause occur since the practice of firing mudcapped, Even in gassy "adobe," "dobe," "sand blast," or "bulldozed" shots is widespread. mines where general blasting is safeguarded by being done with permissible explo- sives, rocks or bowlders frequently are blasted with mudcapped shots of dynamite; even if permissible explosives are used, this type of shooting is dangerous. The usual method of preparing a mudcapped shot is to place the explosive, either in loose or cartridge form, with the detonator or "cap" on top of a piece of rock or coal and cover it with several handfuls of moist clay, loam, sand, or When the shot is road dust; in many cases there is no covering of any kind. fired a dense cloud of dust, together with an intensively hot fleme, are thrown into suspension, and if the dust is explosive or ignitable an explosion or igni- tion is likely to result practically simultaneously. The presence of gas greatly increases the explosibility of the dust, as well as the probability of an ignition. This Bureau of Mines investigation was conducted to obtain an experimental solution of stress changes in the vicinity of a circular opening in an infinite plate. Plates were stressed biaxially in compression and subjected, by four different-length shoes, to a uniform pressure at opposing points on the opening periphery. The principal stresses along the vertical and horizontal axes, which result from peripheral pressure, were obtained from the photoelastic analysis of four frozen-stress epoxy models. These principal stresses were then super-imposed on the mathematically determined principal stresses (along the same axes) obtained from a theoretical biaxial stress field in which the magnitude of the lateral pressure was one-third that of the vertical pressure. The results indicate that an increase in shoe length increases the radial compressive stress and the tangential tensile stress (except tangential compression at r/a = 1, which exists for all shoe lengths). Also, a partial control of the stresses within one-half radius of the opening surface is accomplished by a change in the magnitude and placement of peripheral pressure.

The National Institute for Occupational Safety and Health (NIOSH) evaluated microseismic activity from three field sites to compare and contrast the characteristics of microseismic emissions from very different geologic, stress, and mining environments. Recently, NIOSH has embarked on a research program to evaluate the use of microseismic monitoring information to identify roof fall failure processes and to assess its potential to warn of unstable roof conditions. Large roof instabilities, such as roof falls and certain roof caving events, have proven difficult to anticipate representing an increased risk to miners working in these inherently hazardous areas. When local failure processes are better understood, appropriate control measures can be engineered to mitigate these hazards. This study used microseismic emissions to help identify three local rock failure processes. It was also shown that analysis of microseismic emissions can aid in assessing the degree of instability associated with these local rock failure processes.

In May l942, the Bureau of Mines started exploring for manganese on the Black Poch manganese property, Esmeralda County, Nev., to determine possible reserves of manganese in the deposits. The work was done by the Bureau in cooperation with the Federal Geological Survey and comprised a study of the geology, mapping the area, and exploring by trenching, test pitting, and sampling. All ore bodies were examined and sampled, and the three most important areas were explored by trenching and test pitting. This report notes the location, ownership, and history of the deposits; explains the physical features of the district; mentions briefly mine workings and metallurgy; and describes the geology and ore bodies. The Bureau erected a temporary camp, repaired 5 miles of temporary road, constructed 1,000 feet of new road, dug 3,173 foot of trenches with a vertical crone section of 4 x 10 feet and 91 test pits with a cross section 3 x 6 feet, averaging about 6 feet deep, and cut 134 samples.
