ARTICLE I - General Section 1. Name. The name of the corporation shall be The Rocky Mountain Coal Mining Institute. Section 2. Objects and Purposes. The objects and purposes of The Rocky Mountain Coal Mining Institute and the nature of the business to be carried on by it are as follows: (a) To sponsor educational programs pertaining to coal mining technologies and production techniques, mining management and safety, federal, state, and local laws, rules and regulations pertaining to coal mining, and other energy related issues. (b) To disseminate to the public and to educational and scientific institutions knowledge, and the results of study and research into recent developments in coal mining technologies and production techniques, mining management and safety, federal, state, and local laws, rules, and regulations pertaining to coal mining, and other energy related issues. (c) To do and engage in all lawful activities that further or are consistent with the preceding objects and purposes of the corporation. Section 3. Nonprofit Corporation. This corporation shall operate as a nonprofit corporation under the laws of the State of Colorado. ARTICLE 11- Principal Office and Corporate Seal Section. 1. Principal Office. The principal office and place of business of the corporation in the State of Colorado shall be in the County of Jefferson, Colorado, or at such other location as the Board of Directors may from time to time determine. Other offices and places of business may be established from time to time by resolution of the Board of Directors. Section 2. Corporate Seal. The seal of the corporation shall be inscribed with the name of the corporation, the year of its incorporation, and the words "Colorado" and "Seal," and shall be in a form approved by the Board of Directors, which may alter the same at pleasure. ARTICLE III - Members Section 1. Classes. The membership of the corporation shall be divided into three classes, consisting of active members, life members, and senior members, who shall have such rights, privileges, and qualifications as these bylaws may provide. Section 2. Qualifications. The members of the corporation shall have the following qualifications: (a) Any individual interested in the goals and purposes of the corporation may become an active member of the corporation upon payment of such annual dues as the Board of Directors may determine from time to time by resolution. (b) An individual who has devoted long and dedicated service to the corporation and to its goals and purposes may become a life member of the corporation upon being elected to that status by the Board of Directors, and such individual shall retain such status for life. (c) An individual who has been at any time an active member of the corporation and who has reached 70 years of age may become a senior member upon payment of such annual dues as the Board of

MORTENSEN: On behalf of the Rocky Mountain Coal Mining Institute, I take great plea¬sure in saying good morning to you at Vail. With a few clouds in the sky, at least we won't get sunburned. We won't have to worry about our kids in the swimming pool, perhaps. It is delightful for me to have been able to have represented the Rocky Mountain Coal Mining Institute for the year 1982-1983. This has been our 71st year and this is our 79th meeting. In recognizing the attendance here, that dinner we had last night, and some of our entertainment must have gotten to some of us, or it is a little early. But I'm sure as the day goes on, and with the speakers outlined, it will be very beneficial for those who do attend. We do appreciate your attendance. I'd first like to make an introduction of our head table. Doris Finnie, she is our executive secretary. As most of you are aware, Gussie Whiteside retired as secretary. This will be the first time since the Institute started that there has not been a Whiteside present at one of our conventions. I'm sure Gussie would appreciate any calls or letters that any of you would care to make to her. Doris, I might add, has been a great help to me and all of the people who have been working on the program for the Institute this past year. There's been lots of reorganization and we are very pleased with Doris's ability to take hold from Gussie without any waves. Much credit must be given to you Doris for this and we do appreciate the help you have given us and believe me she has kept us out of trouble. Next, we have Art Neill. He is our vice president of the Institute from Montana and he also works with Western Energy Company. We appreciate the help that all of these session leaders and chairmen give to us. We have other names on the head table, but they will fill in as the morning goes on, so we won't bother you with any of those at this time. To set the stage for business, first I would like to call on Doris for a motion to approve the minutes of last year. MS. FINNIE: Thank you, Vernal. Mr. President, I suggest that the reading of the minutes be dispensed with and that the members refer to pages 9 through 80 of the Proceedings for the 78th regular meeting of RMCMI, as published MR. The twenty-eighth regular meeting of the Rocky Mountain Coal Mining Institute, which was held jointly with the Utah Section of the American Institute of Mining and Metallurgical Engineers, was called to order at eleven o'clock A. M., Monday, March 11, 1929, President Otto Herres presiding. Introductory remarks were made by John M. Boutwell, Chairman of the Utah Section of the American Institute of Mining and Metallurgical Engineers, who outlined the intent and purpose of the joint meeting, and its co-operative program. He spoke of the in- creased recognition being given to men in the engineering profession by the public, which has recently been manifested by the election of President Hoover, an engineer of outstanding ability, and the re-election of Governor Dern to the Governorship of the State of Utah. He then introduced Governor Dern, a fellow member, to make the address of welcome. Governor Dern assured the meeting a hearty welcome. He spoke of Utah as one of the important mining states of the Union, particularly in metal mining; the magnitude of Utah as a coal mining state being limited only by its market; of the enormous coal resources of Utah, and the problems of the coal mining industry.

Mrs. Kuhlmann is President of Citizens for Total Energy, an International volunteer grassroots organization with the purpose of educating the public on energy alternatives. His introduction of President Bridwell follows: Ladies and gentlemen, it is my privilege and pleasure to open this session of the Sixty-first Regular Meeting of the Rocky Mountain Coal Mining Institute. The subject of this paper may seem threadbare to, many of you, but even if I repeat what you already know, just smile to yourself and think how much wiser you are than your neighbor, for it is startling what a number of tipples are erected that violate the elementary fundamentals not only of good design but of practical operation. Possibly a coal screening plant is a simple plant. If so, we treat it like we do a great many other simple things. We treat it entirely too lightly and fail to take into consideration, not only the changes that may occur later, the conditions we may be compelled to meet as competition changes, but even the elementary physical conditions that exist right at the tipple site. If I get too positive over some particular point, don't blame me, but remember some of the heart-breaking experiences we have had correcting these omissions, trying to make a tipple do merely what it was designed to do, when the builder tied everything up in such a constricted space, that no room was left to get the results he must have. Perhaps some of the things will look too expensive. Don't say that you can't afford them. Many of them you can't afford to do without, and when you figure that a tipple is put up for possibly twenty years of operation, you can't afford to omit any reasonable precaution not only in taking care of the present, but in foreseeing the future. We will consider a tripple screening plant, suitable for Western conditions, capable of handling approximately 2,500 tons per eight hours. The largest screen sizes must be loaded into either open cars or box cars, and arrangement provided for screening and loading not less than five sizes of coal: lump, egg, nut, slack, dust, or any reasonable combination of these. As we are considering only the preparation of the coal, we will omit all consideration of the method of haulage, pit cars, methods of dumping, and will take the coal after it is in the dump hopper. The track arrangement will frequently be determined by the ground layout. Our sizes and tonnage can be loaded on three tracks, but four tracks are better. The two outer tracks should be left for loading lump coal, No. 3 track should be left for egg coal, and No. 4 track for loading nut, slack and dust. Where a fifth track can be provided, No. 5 track should be held open only for run-of-mine coal, to act as a storage where emergency coal can, be run, should there be any delay in the screening equipment or in changing cars. Track No. I should be used for loading lump coal into box cars only. Track No. 2 should be used for loading lump coal into open cars only, and may or may not be provided with picking table, loading boom, or both. Where picking is necessary, a picking table can frequently be put between the two "lump tracks, heading down track, pivoted at one end, so it may be raised or lowered to feed either open or box cars; with

Flexoid tubing for ventilation and some of the reasons for its use in re-opening old workings at the Union Pacific Coal Company's mines at Cumberland, Wyoming. , These mines are located on a branch line off the Oregon Short Line Railroad, about sixteen miles south of Kemmerer. The seam averages from 16 feet to 20 feet thick and is split about six feet from the bottom with from six inches to four inches of fire, clay; and is covered by a heavy sandstone roof about 45 feet thick and a fire clay floor about 15 feet thick. Pitch of seam 21 degrees. These mines were opened up with 5 openings on the pitch to the west, with main slope, north and south manways and north and south aircourses on 50-foot centers with parallel entries driven north and south at right angles to the slope and rooms turned on 50-foot centers up the pitch ; entries being 350 feet apart and chutes used in the rooms. Several years ago there was a heavy, squeeze came on these mines which necessitated shutting down all of No. I Mine below the third entry, the slope being down to 12 entry; also shutting the lower end of No. 2 Mine down from the twelfth entry to fifteenth entry and from the third entry down to the tenth entry, so as not to work too much territory at the one time. These mines are very gassy and were subject to heavy bumps during the squeeze ; also at the present time. In reopening these slopes, aircourses and entries for the recovery of the pillars, ventilation was quite a problem, as the squeeze had caused them to be practically tight; also the rooms for about 50 feet from the entry and the face of the rooms for about fifty feet. These rooms in the open space being either filled with Methane or depleted air. It was found in opening up these entries that in driving back entries parallel with the top entries for ventilation. which had to be skipped along the barrier pillar left from the face of the rooms of the entry below, that we had more bumps or bounces which made it a dangerous proposition to nine, as it will be noted as stated that the entries, room necks and face of rooms were more or less squeezed tight, showing that all the weight was centered on these points and the more they were disturbed the more it relieved the overlying pressure and something had to give; hence the bumps or bounces which have filled slopes, aircourses, entries and rooms with coal from the ribs and face, for hundreds of feet, throwing cars off the track, both loads and empties, and throwing track up to the roof and discharging timbers. We found it necessary to abandon driving back entries and have used Flexoid tubing with small blower fans to open up these slopes, aircourses and entries which has proved a success. [Mr. Brown did not make his speech available for reprint.] Productivity is the Answer - Always Was; Always Will Be When Bill Balaz invited me to speak here this morning, he asked me to examine the three most important issues Consol will face over the coming decade. There are more than three. But the more I thought about that question, the more I realized all our issues come down to only one. As I reviewed the U.S. coal industry over the past ten years, and as I thought ahead into the year2000, one thing stood out. Not markets. Not government regulations. Not record tonnages. But productivity. The recent history of American coal is a tale of productivity improvement. It is a story that needs telling. And understanding. Not just for the good of the coal industry, but for the benefit of the American economy. Americans today do not appreciate the value of productivity growth. I don't say that lightly. As I review recent debate over American industrial competitiveness, as I look at certain legislative proposals, I see disturbing trends. It's not that anyone is against productivity per se. But many people seem to fear the very processes that enhance productivity. Twentieth century America enjoyed unprecedented growth in productivity. And in personal standards- of-living. Those two go together. This century has been one of change. Demographics. Education. And technology. Many new industries-cable television, computer services, telecommunications, for example-have grown from mere dreams to billion- dollar enterprises employing tens-of-thousands. And some older industries have declined. The nature of work has changed-from manual work to know- ledge work. From agriculture, to manufacturing, to services. In the mid-1960s. AT&T employed more than one million people. These were not high-paying jobs: telephone operators, linemen and equipment assemblers. Today, the successor Bell companies and their new competitors employ no more than a few hundred thousand. Because of automation. Because of enormous gains in employee productivity.

CHAIRMAN ALLEN: Gentlemen, I have been asked to call this meeting to order by Mr. Marchant, and am acting here temporarily in the absence of Mr. Nyman, who is unable to be with us. Mr. Nyman sends the following telegram: "Will not be able to be present at the Institute meeting. Serious illness of my father has made it necessary for me to remain in Salt Lake Please arrange substitute. Very sorry." In addition to having to pinch-hit for Mr. Marchant and President Nyman, I am here representing the Governor of the State of Colorado also who is unable to be here. The Governor of Colorado is a very busy man. His appointments are made months ahead. We only got word of the possibility of his addressing this meeting yesterday morning, and I went over to the Governor's office this morning to see if there was any possibility of getting him here, but he had been booked up for two months ahead of this time to appear at the convention of the Veterans of Foreign Wars in Trinidad, Colorado, where he is today, and which makes it impossible for him to attend this meeting. I know that he would have liked to have been here with you, as there is not any doubt but what the Governor of Colorado has the interests of the mining industry at heart. This was manifested last week when he called a meeting of representative men of the different lines of industry so that we could arrive at some results and some arrangements to see if it was possible to get at the bottom of the condition causing our bad times, and the appointment of commit- tee groups to find out what these problems were and to see if they could get any possible solution to them. The meeting was adjourned with the suggestion that those who were present would among themselves select such committees to investigate the conditions of the coal mining industry, and offer suggestions for betterment.

The 81 st Regular Meeting and convention was called to order by the President, Charles W. Margolf at 9:00 a.m. Monday, July l, 1985 in the Silverton Room of Tamarron, a resort hotel near Durango, Colorado. President Margolf welcomed the members and others in attendance to the convention and noted his theme of "Make It Happen!" He introduced those present of the 1985-86 Board of Directors and Officers who were elected by the Board of Directors at their Annual Meeting June 29. They were: Arthur K. Neill, President; Bernard Bernstrom, President-Elect; Loren V. Linville, Convention Liaison Officer; Vice Presidents Douglas J. Hammer of Colorado, C. Joe Presley of Montana, Alva L. Smith of New Mexico, Fred Wertz of North Dakota, Rex Berry of Utah and Thomas J. Lien of Wyoming; and Doris G. Finnie, Executive Secretary & Treasurer. He also introduced Ira. E. McKeever who was elected to serve as chairman of the Advisory Board by that group. Margolf mentioned that one three-year term as a Director would be voted upon at the annual business meeting which would be held Tuesday, July 2 at 1:30 p.m. in the Windom Peak Room and introduced James "Doug" Ingram, the nominee of the Nominating Committee. MR. STROUP: As soon as the mine workers realize that machine loading is going to be with us permanently, they will gradually accept the view that they, as well as the Mine Operators, will be in the end better off. Don't you find that to be true? MR. BUTLER: I do find that the antagonistic feeling that prevailed at the start is getting less and less and that the miners are co-operating with us. The machine is going to stay with us and I believe it is going to be better for them because instead of having the hard work of heaving coal, they will merely run the machinery that heaves the coal for them. I believe they all feel that way about the matter. MR. McAULIFFE: Mr. Farnham, out of his professional diplomacy, was very careful not to even mention his own machine by name. I would like to say a word about salesmen and about the men who develop the machines. They are perhaps doing more for the industry than we are doing ourselves. This applies also to the railroad business that I put a great part of my life in. If it were not for the energy, courage, and ingenuity of the men who manufacture machines, we would not occupy the advanced position we do today in the mining world.

?Twowinters ago, what had been a mediocre safety record at West Virginia?s Sago Mine grew dramatically worse. Over 23 months beginning in February 2004, two dozen miners were hurt in a string of accidents, some of them caused by rock chunks falling from the mine ceiling. Federal safety inspectors slapped the mine with citations 273 times, or an average of once every 2 ½ days. Despite this record, the price paid by Sago?s operators was light. Government regulators never publicly discussed shutting down themine and never sought criminal sanctions. The biggest single fine was $440, about 0.0004 percent of the $110 million net profit reported last year by the mine?s current owner.? -Washington Post, January 8, 2006

"Dock" Schloss follows: It is indeed a pleasure to call the meeting to order and to welcome you to this, the 58th regular meeting of the Institute. This morning I have the pleasant assignment of presenting to you a person who has been so active in the Institute, and has worked so closely with many of you, that I am sure most of you have known him much longer than I have.

PRESIDENT LITTLEJOHN: Is there any member that has any question to ask Mr. McCleary on the subject? MR. TESCHER: What do you figure it costs to do this? MR. McCLEARY: Between one and a half and one and three-quarters cents per kilowatt hour. MR. TESCHER: That includes all charges? MR. McCLEARY: All charges, fuel and labor. PRESIDENT LITTLEJOHN: Mr. McCleary, you were talking about a ten-inch top on the cars. Don't you find there is considerable spillage when raising or lowering the cars? MR. McCLEARY : Not after the men get accustomed to loading cars properly; at first, they just loaded it on in any old way, but wall it onto the cars solidly after a few days at the mine. I do not think we have that condition now. PRESIDENT LITTLEJOHN: Did I understand from the paper there that the rock dust you are using contains 90 per cent silica? MR. McCLEARY: Twenty; less than twenty. PRESIDENT LITTLEJOHN: I got that figure wrong. Are there any other questions to ask? MR. SCHLOSS: I would like to know what kind of machinery Mr. McCleary is using for rock dusting and are they rock dusting the rooms, or not? MR. McCLEARY: We have only recently started rock dusting, and the machine that we are using is Mr. Tescher's machine. We start in at the face of the main entry and move against the air current rock dusting every room and the entry every 50 feet. Every 50 feet, we stop the machine fifteen or twenty minutes at that point and rock dust up in the room and around the entry at that point. PRESIDENT LITTLEJOHN: Do you do any water sprinkling at the faces-at the working face? MR. McCLEARY: Yes, sir, every working face is sprinkled every day, and at least every two days at all points in the mine. PRESIDENT LITTLEJOHN: Does it affect the rock dust in any way? MR. McCLEARY: That was true before we started rock dusting. The faces only are sprinkled now. PRESIDENT LITTLEJOHN: Where you stop to sprinkle with water, you do not figure on rock dusting? MR. McCLEARY: I will just change that around. Where we do rock dusting, we do not expect to sprinkle. Where the faces of the coal are fresh, from day to day, that is where the sprinkling will be clone. PRESIDENT LITTLEJOHN: That is the fresh faces? MR. McCLEARY: Yes. I might add right here, I believe Mr. Tescher made the statement that cross-cuts up an 8 per cent pitch were the steepest that
