Dear Mr. Shubart: At your request, am submitting to you several suggestions for the amendment of our safety code which you felt should be kept up to date. As before, am advising you that these suggestions do not have the approval of the entire Safety Committee, but rather are the individual opinions of several members who have expressed their wishes in the form of letters to me. I am particularly indebted to Mr. Dan Harrington and Mr. Wm. Littlejohn for their assistance. Would recommend the following amendment a to the various sections. Section 1. Wherever possible trolley wires should be securely hung to roof or timbers at a distance of not less than five feet and not more than six and one-half feet above rail and six inches to one side. Spacing of hangers should be from 20 to 25 feet apart. Section 2. 500 volts D. C. should not be allowed in any installations. Trolley wires should not carry a voltage of more than 250 D. C. Pumps, mining machines and other small machinery units where A. C. power is used should not carry a voltage of more than 220. Large units, such as pumps, motor genera- tor set and hoists, may use a voltage of 2,200. When power cables to operate same are of armored construction, cables should be securely buried at all crossings. Section 4. Where power lines pass through door frames or stoppings they should be properly insulated with porcelain or rubber tubing. Whenever men get on or off man-trips in vicinity of trolley wires same

The tenth annual Mine Resale Evaluation was held in conjunction with the RMCMI 2001 convention at the Steamboat Springs Sheraton Resort, Steamboat Springs, Colorado June 23 through 26. The purpose of the mine rescue evaluation program is to provide an opportunity for mine rescue teams to learn new skills and improve their existing ones in a non-competitive environment. Several staged ?disaster? scenarios were held where the teams are called upon to exhibit their life saving abilities. The evaluators meanwhile are offering suggestions, both verbal and written, to help the teams better understand the situations presented them. This non-competitive environment allows the teams to work together and share their knowledge with fellow mine rescue teams providing everyone with a positive learning experience. Mine Rescue Chairman Bill Balaz, Balaz & Associates, was in charge of coordinating the events. Six teams consisting of seven to twelve members each (totaling 60 members) participated in the three-day event. Each ream was required to respond to direr different real-life scenarios plus a written general knowledge test daily. Cindy Burnham has assisted Bali, for a few years. Her responsibilities include grading all of the written tests. This year's tour professional evaluators included Art Seanz (Hazardous Ma¬terials) of Western Environmental Associates ; Guy Norton (Ropes), Guy Horton Rope Rescue; Mary Bailey (Medical), MBA Training and Morley Hense (Confined Space). Carolyn Durga, BHP Coal, also assisted in hazardous materials and medical scenarios. They each provided three different challenging mock situations per day per team. The teams had no prior knowledge of what the scenarios would be as details were provided only as they arrived. Ten volunteer victims added much drama and excitement to the event. Their realistic enactment, complete with false blood makeup and severed limbs, made for some very tense scenarios. The Mine Rescue Teams participating this year were BHP LaPlata, BHP Navjo, BHP San Juan, all from Farmington, New Mexico; Bridger Coal Co., Rock Springs, Wyoming; Sabine Mining, Longview, Texas; Solway Minerals, Green River, Wyoming and Western Energy Co., Colstrip, Montana. Many new friendships were made and much knowledge shared. A swap meet was held Saturday afternoon for the teams to exchange miscellaneous equipment, hats, shirts, etc. The trams were asked to evaluate the program and the evaluators. They responded with many positive suggestions that will help improve the upcoming events in the years to come. Culmination of the Mine Rescue program was a Tuesday morning awards breakfast where the teams were presented with trophies. Each member was also given a gold pin with the words Continuing Challenge - Ropes.' The pin was the first in a series that will be given over the next few years. The participating victims and evaluators were also commended for their outstanding efforts. Special signed "Victim" shirts were given to select volunteers. Sponsors for the Mine Rescue program were Flanders Electric Motors, Magnum Metals, Rocky Mountain Electric Motors, Sedona Consulting and Balaz & Associates. Many hours of volunteer tine and effort from various family members of participants helped make the 2001 event a huge success.

The 77th Regular Meeting of The Rocky Mountain Coal Mining Institute convened at the Marriott's Mark Conference Center, Lionshead Village, Vail, Colorado, and was in session at 10:00 a.m. Past President, Loren V. Linville, District Sales Manager. Industrial Products Division. Uniroyal. Inc., Denver. Colorado, called the meeting to order. He introduced President, Edward F. Ziolkowski, Senior Vice President and General Manager, Energy Development Company, Hanna. Wyoming. A biographical sketch follows: Ed Ziolkowski is a 1953 graduate from the Colorado School of Mines with a degree in Engineer of Mines. His mining career began with Pickands Mathers Company in Gogibic Iron Range in Northern Wisconsin and Michigan. In 1961 he joined Texas Gulf Sulphur Company as Shaft Mining Engineer for their Cane Creek Potash Project near Moab, Utah. After serving as General Mine Foreman. Mine Superintendent and General Superintendent at Cane Creek, he was transferred in 1969 to Green River. Wyoming as Project Manager of Texas Gulf Black's Fork Trona Development. In 1971 he joined Allied Chemical Green River Works, as Resident Manager. In 1972 he joined Energy Development Company, an Iowa Public Service Company Subsidiary, as General Manager of their Coal Development. He currently is Senior Vice President and General Manager of Energy Development Company, and serves on their Board of Directors as well as the Boards of several other subsidiaries. This past April he was elected to Iowa Public Service Company's Board of Directors. Ed, his lovely wife Pat and children live in Hanna, Wyoming. He has been a member of the RMCMI since 1973. Is a staunch supporter of his community and the mining industry.

For the past quarter century, it is fair to say that the political agenda of Western industrialized societies has been driven by those opposed to forms of economic growth providing sustenance to a growing population. They regard growth as the major threat to their social philosophy which champions a wholly "new ethic of biocentric equality" or "living as if Nature mattered." This ethic demands that "a violent, plundering humankind" must abandon its alleged rape of Planet Earth and derive its ethical norms from pre-existing harmonies and fragile, precarious balance present in Nature. A Green political agenda appeals strongly to deep longings shared among many people whose temperament seeks tranquillity in a world of wild natural beauty uncluttered by dependency on tools and experts and specialists. According to proponents of the Green philosophy, our world is pregnant with enormous problems. Armed with expanded political powers, regulatory guardians at state and local levels have mustered their forces with shotguns cocked, poised to prod an ignorant and lazy citizenry to the altar for an exchange of vows with Environmental Ethics. Social engineers have skillfully discredited the traditional role of professionals in scientific engineering who are summarily dismissed as the failed architects of an industrial system pillaging the earth. They stand accused of producing unmanageable offspring - from mining minerals and energy resources to disposing of toxic wastes - whose disputed parentage and expectant crimes against humanity must be prevented by removing them from normal custody. Green critics claim that markets cannot be given custody of industrial offspring - pollutants, wastes, land-use abuses. Markets appear to have failed to provide equity to present and future generations. The only custodian with sufficient coercive power seems to be the regulatory bureaucracy. The upshot is a stark Hobson's choice - Shotgun Wedding vs. Custody Dispute. It derives its fateful predestination from an uncritical acceptance of several preconceptions which currently undergird the altar of Sustainability characterized by its acolytes as "a new and exciting doctrine." It is significant that Limits to Growth slogans of the 1970s have been displaced in the 1990s by the more palatable language of Sustainability. As a policy recommended to forestall an impending doom, Sustainability derives its credibility from dire predictions of global warming, ozone depletion, acid rain and the like. The Rio Declaration announced to the world in June 1992 that, although energy is essential to human well-being, its production and consumption in wealthy industrialized nations is unsustainable. It called for a complete overhaul of energy systems with nothing short of a total replacement of fossil fuels, uranium fission reactors, and large hydroelectric projects by means of so-called renewable energy sources, augmented by coercive regulations to force conservation and limit consumption demands. The operation of gaseous mines is a problem, due to the fact that we have not only the ordinary mine accidents to guard against, but have also the ever present menace of a mine disaster involving a large number of human lives, and the destruction of valuable property. In looking over the reports of mine disasters throughout the country in the past several years, we find that methane gas, coming in contact with an ignition agency of some kind, has been the source of at least 75 per cent of our mine explosions. Coal dust, of course, plays its part in propagating the explosive action throughout the mine workings and rendering it more violent and destructive; nevertheless, the initial ignition of a body of explosive gas-sometimes of very small volume-has been the primer for the large majority of our mine disasters. We find also, that the places of initial ignition are most frequently found at the working faces, or in close proximity thereto. This is mainly due to the following reasons: First-The working faces are, as a rule, the places where methane gas is most freely generated. Second: They are places that are most poorly ventilated. Third-They are the places where ignition agencies are most frequently found. The sources of ignition, as a rule, consist of naked lights, the shooting -of shots, defective flame safety lamps, and electrical arcs. The problem, then, in the operation of gaseous mines, is primarily to so ventilate the working faces that an explosive mixture is not likely to occur, and to endeavor to keep away from the working faces all sources of ignition. To do both of these things may seem impossible. Nevertheless, by working along both of these directions, a great many disasters can be avoided. The efficient ventilation of the working faces is paramount. By efficient ventilation, we mean the continuous passing of large volumes of air at the working faces. This can only be accomplished by adequate ventilating equipment, capable of being driven by at least two independent and distinct sources of power, together with large, clean, straight air courses which are free of short turns, constructed areas, and leaky doors and stoppings. In other words, furnish a suitable course for its travel through the mine. Many of us sharpen our pencils and rack our brains to properly estimate the proper size pump and pipe equipment that may be needed to handle a certain amount of water. We estimate the size of copper conductors to a nicety. We immediately rush to repair leaks in our water, compressed air or electric lines. But how many of us give serious thought to the travel of the air through our mines, the health and safety-giving fluid on which so much depends! In driving air courses, a certain economical cross-sectional area should be adopted and maintained as standard. When turns are necessary, they should be made with long radius curves, and the cross-sectional area should be increased on the curves. All entry stoppings should preferably be built of monolithic concrete, with suitable hitches into floor and ribs, and after the concrete has set, they should be examined and leaks due to shrinkage and settling should be eliminated. Overcasts and their approaches should have cross-sectional areas larger than the entries leading to them, to allow for the sudden change of direction, bearing in mind that air wants to travel in straight lines. The seventh Annual RMCMI Mine Rescue Evaluation was held during the 1998 Institute convention at the Silvertree Hotel, in Snowmass Village, Colorado. The Mine Rescue committee, co-chaired by Becki Boam and Elliott Tsosie, is one of 18 committees of the Institute. In 1998 a record number of 10 teams participated in the program. The teams were from the four western states of Montana, New Mexico, Texas and Wyoming and were comprised of about eight members each. Teams participating were BHP-La Plata Mine, BHP-Navajo Mine, BHP-San Juan Mine, all from Farmington, New Mexico; Bridger Coal Company, Rock Springs, Wyoming; General Chemical, Green River, Wyoming; Jacobs Ranch Mine, Gillette, Wyoming; Powder River Coal Company-North Antelope/Rochelle, Gillette, Wyoming; Sabine Mining, Hallsville, Texas; Solvay Minerals, Green River Wyoming, and Western Energy-Colstrip, Montana. The professional evaluators provided challenging scenarios for over 90 participants and many observers. The evaluators were: Art Saenz and Tom Bass of Western Environmental Associates, Keith Mitchell and Jim Jennings of Emergency Services Detail; Mary Bailey of Mary Bailey Associates; and John Peleaux of Innovative Access. Teams are not given advance warning of what the problem will entail. They are provided the necessary details when they arrive at the scenario location and work to resolve the problem in an effective and efficient manner. [ ] Seven participants made up each team with an . eighth member as an alternate. Team trainers and other mine personnel traveled with the team from scenario to scenario providing support and encouragement. The teams were presented with four scenarios each day, involving High Angle Rescue, Low Angle Rescue/Medical, Hazmat, and Confined Space. All of the victims, except for one, were provided through the cooperative efforts of the Snowmass Fire Department, who also assisted with providing several evaluators. Snowmass Fire Department is to be commended for providing over 20 victims/evaluators each day to facilitate the evaluations. Training sessions were held Friday afternoon and Saturday evening to help the teams prepare for the scenarios. A swap meet was held Friday evening for teams to trade hats, shirts, belt buckles, stickers, etc. All mine rescue participants and spouses and registered families attended the Bar-B-Q on Sunday evening followed by an adult dance. Eight of the ten teams had a proficiency level of 3 and 2 teams achieved a proficiency level of 2.

President Lien presented Mrs. Holmes with the first of speaker appreciation gifts presented by his firm Amax Coal West, Inc. These were books by Rand-McNally entitled The Executive Golfer Guide. Following the coffee break, Clark Moseley presented the first annual Institute Safety Achievement Awards for the safest mines in the eight member state region. The awards were based on: 1. Total man-hours 2. Total number of lost time accidents 3. Incidence rate 4. Number of S&S violations 5. Description of safety program 6. Safety awards received 7. Health and safety training efforts 8. Safety Policies 9. Does the operation take employee suggestions and implement them? 10. Letter(s) of commendation from agencies individuals The awards were judged by the senior/graduate level class of Mine Safety & Health at the Colorado School of Mines under the supervision of professor Edward Hollop. Gentlemen : It is a pleasure to come to Glen- wood Springs to participate in this meeting of the Rocky Mountain Coal Mining Institute an organization created to handle chiefly the economic questions dealing with the coal industry of the Rocky Mountain District. I am not unmindful of the many and varied problems confronting the mining industry of this country which is so general at the present time throughout the United States. By reason of the difficulties experienced in marketing the product of your mines, there is all the more reason for greater economy and efficiency in production. No industry can be efficiently operated without giving due consideration to the safety of the employees. Safety and efficiency are inseparable for the success of any industrial enterprise. While the Bituminous coal companies of the United States are doing splendid work in the promotion of safety, yet our fatality rate is exceedingly higher compared with that of foreign countries, and with greater cooperative organized effort on the part of mine owners, mine officials, mine workers, and state and federal governmental agencies having jurisdiction, much more substantial progress can be made in the future and a greater economic saving .to the industry effected, not taking into consideration the greatest and most important phase of safety, which is the conservation of life and health of all those who are engaged in the occupation of mining. You are concerned with freight rates, marketing of coal and similar operating problems. At the time of mine accidents one frequently hears the expression "there will be accidents as long as there are mines", or it may be varied to state that the accident in question was unavoidable, or something similar indicating inability to prevent accidents. However, it is the opinion of the writer, after over twenty-one years experience in both coal and metal mining, seven years being spent wholly in safety work, that by far the greater number of all accidents is due to carelessness or negligence. This carelessness or negligence may be on part of the victim of the accident or of one of his companions, or on part of his employer or possibly even of the inspector or safety man, and in some cases all of these agencies are involved. It manifests itself in various guises, one of the most serious being violation of state mining laws or regulations or of mine rules, and frequently the rules of ordinary common-sense. The cause very frequently is that trait in human nature to "take a chance" and it has been the writer's observation that the worst offender is the old-time miner who has come safely through many years experience, who was mining when the "safety man was a baby", and who clings to old-time ideas and practices and has "no use" for "newfangled" present-day "notions". Unquestionably, there are accidents, wholly unavoidable and many are caused by ignorance and by the new-comer in mining, yet as previously indicated, the writer's observation is that the old-timer is by far the worst offender, bringing grief to himself, companions and employer. Of the numerous manifestations of carelessness and negligence in connection with mine accidents, which have come to the notice of the writer, only one will be treated in this paper, viz: Violation of State Mining Law, and mention will be made only of explosions and major accidents in coal' mines with which the writer came in personal contact as investigator. In most cases, in addition to mine inspection after the accident, the writer heard the evidence given at Coroner's inquest and thus was enabled to for¬mulate fairly definite impressions as to events and conditions leading up to the occurrence.
