Good Morning. Thank you for your kind welcome, Lyle and thank you for having me here today. I spoke at the fall meeting of the Utah state RMCMI in Price and it's nice to be invited back. I can see by the program that you have two great days of interesting and informative meetings, including the mine rescue team exhibition and the safety recognition award presentations. As you all know, I am here standing in for Dave Lauriski, who is in China with Secretary of Labor Chao. As you also know, Utah is near and dear to his heart - and so is the Rocky Mountain Coal Mining Institute. I want to assure you Dave would be here if it were at all possible. But it is my good fortune that I could come in his place. We have made great progress as an Agency thanks to the hard work and dedication of MSHA's employees. But we are always looking for new ways to solve problems and continue to send more miners home safe and healthy every day. And we have been working on some great ways to do that, including thinking strategically. During my presentation today I'm going to talk about where the Agency is in terms of our transformation to the MSHA of the 21st century, a little bit about how we got to be where we are, and then describe our roadmap to the future state. And I'm going to focus on the significance of our plan and the planning process to demonstrate the implication for the mining industry. Former President Dwight Eisenhower once said, "In preparing for battle I have always found that plans are useless, but planning is indispensable." Now I do like Ike, but I would have to take exception to the first part of the sentence. I have found plans and the planning process to be indispensable - the plan to give me a roadmap to my goal, and the process to focus me on the steps I must take to get there. We all know that having a strategic plan makes the difference between success and failure. We've seen it time and time again, in business, in our lives - and in government: Having a strategic plan is crucial to success. And the process of making the strategic plan is crucial to its success. Putting together a workable strategic plan - a good roadmap - that will successfully lead you to your goals requires a thorough, careful process that takes into account each factor that you may encounter along your way to success, as well as those with whom you will travel. In order to talk about our current plan I want to take you back to three years ago, when Dave Lauriski went to Washington to lead MSHA. He knew that change was in the air. Thank you very much for that introduction. I spent part of my early career in the coal industry here in Colorado, and I am always happy to return. In such a beautiful setting, it seems out of place to talk about "Improving the Climate". But in our work-a-day worlds, we know the climate for the coal industry is something less than picture perfect. But unlike Mother Nature's climate, there are some things we can do about the climate for coal. Today, I want to talk to you about sonic of the activities that we are engaged in... and that you can support... to improve that climate. A number of challenges and opportunities face our industry. I will try to set the stage for this conference by briefly describing the current climate for coal - which is indeed very challenging. I will then outline some of the steps we are taking to broaden our base to include our allies in the rail and electricity industries and the public at large.

The fourth annual Mine Rescue Evaluation program was held in conjunction with the 1995 Institute convention at Crested Butte, Colorado. The Mine Rescue committee is chaired by Lynn Busskohl and is but one of 16 such committees of the institute. In 1995 seven teams participated in the program. They were BHP Minerals, The Coteau Properties Company, Decker Coal Co., The Falkirk Mining Company, Kerr-McGee Coal Corporation, Sabine Mining Co. and Western Energy Co. [ ] Professional evaluators who provided challenging scenarios for the near 60 persons were Jack Knight of Pensacola, Florida; Dave Medick of Northwestern Resources, Jewett, Texas; Joe Nugent of Idaho Springs, Colorado and Jack Peleaux of Innovative Access, Evergreen, Colorado. Each team was comprised of seven members and one trainer representing the states of Montana, New Mexico, North Dakota, Texas and Wyoming. This committee challenges the incoming Colorado vice president to locate a team for the 1996 program in Durango, Colorado. Five different scenarios were presented the first day of evaluation and three the second. Each team was given the pertinent information to solve the problem as they assembled at the site. The realistic industrial related scenarios closely simulated the stress of actual rescue incidents and were going on simultaneously. Each team was unaware of the circumstances until arriving on the scene. Lynn Busskohl presented an overview of the Mine Rescue committee work at the Monday Institute welcome session and invited all attendees outside to view the various pretend rescue operations. Valuable suggestions were made by the team of evaluators following each scenario. These teams are providers of immediate rescue and medical care for accident victims at their respective properties. The members are prepared to act with immediate and professional knowledge to save lives and prevent further injuries. [ ] Many donors financially assisted with the 1995 program. They are: Blattner Constructors; Butler Machinery Co.; CMC Rescue, Inc.; Galls, Inc.; General Equipment; PMI-Petzel Distribution, Inc.; SafetyMaster; Skedco and TIC of Wyoming. An adder to the 1995 convention was golfing on Saturday, June 24 for three foursomes. This may become an annual event if there is sufficient interest. Team meetings, tests and swap meetings were attended by all participants during the Friday thru Monday program. A fun competition took place after lunch Monday followed by a training session. All events were chaired by Lynn Busskohl. On Saturday evening, June 24 a reception for all mine rescue participants and spouses who had advance registered for the social event. The RMCMI Board of Directors was invited to attend and meet with the teams. As convention attendees, all mine rescue committee members attended the Monday night country western reception and Bar-B-Q with their families. This was followed by an adult western dance evening. The Mine Rescue committee looks forward to a 1996 return to Tamarron near Durango, Colorado which was the site of the first evaluation program. Plans call for all convention housing to be at Tamarron.

The 68th Regular Meeting of the Rocky Mountain Coal Mining Institute convened in Manor Vail Lodge, Vail, Colorado, and was in session at 10:00 a.m. The meeting was called to order by Past President Max A. Robb, Vice President and General Manager, U.S. Fuel Company, Hiawatha, Utah. Mr. Robb welcomed the members and guests and was pleased with the large attendance. He then introduced President Joseph E. Ward, former District Man- ager, Denver Office, Coal Division, Joy Manufacturing Co. (Retired). A brief biography follows: Mr. Ward is a transplanted Westerner, having spent the greater part of his life in the Eastern and Southern areas of this country. In 1927, he graduated from what was then the Carnegie Institute of Technology in Pittsburgh, Pa., with a B.S. degree in Mining Engineering. He dropped out of school for a period between his Junior and Senior years and worked in the coal mines in order to obtain sufficient money to complete his education. Practically all his adult life since graduation, has been spent in or around the coal mines in this country. After graduation, he worked the next 15 years of his life as an underground supervisor, first for the Hudson Coal Co., in Scranton, Pa. and later for the U.S. Steel Corporation in Birmingham, Alabama. He then went into sales, selling basically to the coal mine industry and other mining operations. The last 13 years of his business career were spent as a district manager for Joy Manufacturing CO., 10 years of which were in the Coal Division of their Denver office, covering the Rocky Mountain area. He retired in August 1970 but still retains an active interest in the Rocky Mountain Coal Mining Institute and the Rocky Mountain Coal Industry it supports. He is a widower, his wife, Thelma having died in July 1970. He has two children and six grandchildren.

The sixth Annual RMCMI Mine Rescue Evaluation was held during the 1997 Institute convention at Sheraton Steamboat Resort, Colorado. The Mine Rescue committee, co-chaired by Becki Boam and Gary Cook, is one of 18 committees of the Institute. In 1997 the largest number of teams participated in the program. There were nine: BHP Minerals - La Plata Mine, BHP Minerals - Navajo Coal Co., BHP Minerals - San Juan Coal Co., Bridger Coal Co., The Coteau Properties Co., General Chemical Co., The Sabine Mining Co., Solvay Minerals and Western Energy Co. Professional evaluators who provided challenging scenarios for the 80 participants were Jack Knight of Milton, Florida; Wilson Begay, Chris Saxon, and Gaylon Yazzie all of Western States Security; Mary Bailey, Bailey Associates; Tom Bass, California Department of Corrections; and Art Saenz, BDC. Seven members made up each team plus one or more trainers and represented the states of Montana, New Mexico, North Dakota, Texas and Wyoming. Ten different scenarios were presented during the two day evaluation. Each team was given the pertinent information to solve the problem as they assembled at the site. Mine Rescue families and friends participated as victims providing realistic scenarios to simulate the stress of an actual rescue incident. Each team was unaware of the circumstances until arriving at the various scenes in and around the Sheraton resort. [ ] These teams are providers of prompt rescue and medical care for accident victims at their respective properties. The members act with immediate and professional knowledge to save lives and prevent further injuries. Sponsors who contributed financially to the 1997 program are: Argo Industrial, Antelope Construction, Fisher Safety Supply, Flanders Electric Motor Service, Inc; Intermountain Electronics, Inc.; King Energy Services, Inc.; Rocky Mountain Electric Motors, LS.; TerraMatrix and Triune Inc. On Saturday evening, June 28, a reception was held for all mine rescue participants and spouses who had advance registered for this social event. The RMCMI Board of Directors was invited to attend and meet with the teams. As convention attendees, all mine rescue participants and registered families attended the Monday night country western reception and Bar-B-Q. This was followed by an adult western melodrama. [ ] Glass awards with the RMCMI logo and a Mine Rescue figure were presented at the Tuesday Mine Rescue buffet breakfast to all nine teams, each of which had achieved proficiency at level 3. Captains of the teams pictured below are (from left standing): Ron Neff, BHP-San Juan; Ted Laughline, Bridger, Terry Davis, Coteau; Jim Knutson, General Chemical (from left kneeling): Dan Allerdings, Rosebud; Ron Miller, BHP-Navajo; Jonathan Sorrell, BHP-La Plata and Ray Blaisdell, Solvay. Gary Cook is to be commended for his solo last minute supervision of the Mine Rescue program, due to Becki Beam's unavoidable absence. The teams look forward to the 1998 convention at Snowmass Village Resort, Colorado Thursday and Friday, June 25 and 26.

The seventh Annual RMCMI Mine Rescue Evaluation was held during the 1998 Institute convention at the Silvertree Hotel, in Snowmass Village, Colorado. The Mine Rescue committee, co-chaired by Becki Boam and Elliott Tsosie, is one of 18 committees of the Institute. In 1998 a record number of 10 teams participated in the program. The teams were from the four western states of Montana, New Mexico, Texas and Wyoming and were comprised of about eight members each. Teams participating were BHP-La Plata Mine, BHP-Navajo Mine, BHP-San Juan Mine, all from Farmington, New Mexico; Bridger Coal Company, Rock Springs, Wyoming; General Chemical, Green River, Wyoming; Jacobs Ranch Mine, Gillette, Wyoming; Powder River Coal Company-North Antelope/Rochelle, Gillette, Wyoming; Sabine Mining, Hallsville, Texas; Solvay Minerals, Green River Wyoming, and Western Energy-Colstrip, Montana. The professional evaluators provided challenging scenarios for over 90 participants and many observers. The evaluators were: Art Saenz and Tom Bass of Western Environmental Associates, Keith Mitchell and Jim Jennings of Emergency Services Detail; Mary Bailey of Mary Bailey Associates; and John Peleaux of Innovative Access. Teams are not given advance warning of what the problem will entail. They are provided the necessary details when they arrive at the scenario location and work to resolve the problem in an effective and efficient manner. [ ] Seven participants made up each team with an . eighth member as an alternate. Team trainers and other mine personnel traveled with the team from scenario to scenario providing support and encouragement. The teams were presented with four scenarios each day, involving High Angle Rescue, Low Angle Rescue/Medical, Hazmat, and Confined Space. All of the victims, except for one, were provided through the cooperative efforts of the Snowmass Fire Department, who also assisted with providing several evaluators. Snowmass Fire Department is to be commended for providing over 20 victims/evaluators each day to facilitate the evaluations. Training sessions were held Friday afternoon and Saturday evening to help the teams prepare for the scenarios. A swap meet was held Friday evening for teams to trade hats, shirts, belt buckles, stickers, etc. All mine rescue participants and spouses and registered families attended the Bar-B-Q on Sunday evening followed by an adult dance. Eight of the ten teams had a proficiency level of 3 and 2 teams achieved a proficiency level of 2.

MR. McKEEVER: I think we had to start some- where. The proceeds of the beltbuckles and hard hat stickers will certainly be a beginning in a scholarship for some of our young people. And maybe, you know we might even get one of them sometime to go to the University of Oklahoma. A few years ago the luncheon speaker for tomorrow, Brooks Mitchell, got a few of the mine presidents together and we spent a full five hours of just dedicated listening to Carl Terzian. We listened basically on three subjects: how to work with the media, how to work with image, and how to identify with our political systems and those who are in them. I remember that as one of the turning points in my perspective on how our system really works. This gentleman who will be addressing you today, Mr. Terzian, will be conducting about a three-hour session tomorrow. And it's a shame that our other activities will not allow some of the golfers to probably be there. Those of you who can come to the session tomorrow morning will find it most rewarding. A little bit later on we will also have a panel session. And I see all of the panelists are here except for Bob Golten, but I understand that he is registered. We should have a full afternoon session with Charlie and his panel. When we started working on this, we naturally went back to Carl Terzian to give us some guidance. If there is anything wrong with your session, it's my fault because he knows how these should be done and he guided us along the way. One thing that I am sorry, it wasn't his fault necessarily, is that Harry Reasoner will not be with us for lunch tomorrow. Brooks Mitchell is going to make all of the PR he can out of the fact that Harry got scratched and he got in place for him. Brooks gave me one comment along that line. He said, "Do you know what you get when you cross a gorilla with a computer"? Of course I bit on that. He said. "Well, you get a Harry Reasoner." A little over a month ago I was invited out to California to Woodbury University at Carl Terzian's insistence. I happened to be sitting by one of his vice presidents. It was a formal affair. We had to wear tuxedos and everything and Mr.Green was sitting there and he said, "You know," he didn't know who I was at that time, but he said, "You know Carl really didn't want this formal affair. Said he had a couple of friends coming from the coal mining industry and they wouldn't know what to do with tuxedos." So with that Carl, we will start this little session and it's your mike. MR. TERZIAN: Thank you very much Ira. Let me begin by expressing my appreciation to the men and women of the Institute for allowing me to be here. I'm deeply concerned about my reputation, my image and don't want you to get the inference that I am responsible for Ira McKeever's image. Nobody could be responsible for that! But it is a great case in point that we all should be concerned about our images. I guess tomorrow morning from about 8:30. a.m. to about 11:30 a.m. we are going to do a? hopefully, a productive and very pleasant expertence for all of us in this growing field and great interest that people have in the area of image. I happen to be from Los Angeles. I have a national firm which has handled about 600 corporations', over the years through the areas of public relations,' community, civic involvement all built around a strengthening and safe guarding our precious, free enterprise system. And the message that I hope to give you, as you will be eating your lunch today, is really not so much about the image of individuals but as the attitudes built on what Bill Banowsky

The Trapper Mine is a large surface coal operation located in northwestern Colorado US. The coal seams at the mine dip an average of 8 degrees so, historically, their dragline pits have been orien-tated parallel to the dip of the coal seam to balance stripping ratios. However, the mine plan in the future G and Z pits is designed to take advantage of pit orientations that are parallel to the strike of the coal. During the initial presplit and cast blasts in G pit, significant slope damage occurred. This damage included the opening of joints and tension cracking. There was also block movement directly above the L coal seam, which is the main plane of weakness in the slope. A detailed site evaluation was conducted to develop specific blast design modifications to protect the slopes during future blasting. The modified de-signs successfully controlled vibration levels during the blasting of the Z pit box cut. This paper includes a review of the blast vibration related factors that influence slope stability along with a detailed discussion of the field tests and design modifications developed.

When the writers were asked to prepare a paper on this subject for this meeting of the Institute there was some question in our minds as to what to say that would be of interest to the members. You all know that Utah has some wonderful seams of good coal, on which have been opened some of the most modern mines in the United States, and that her coal operators have been putting forth many efforts to reduce losses due to accidents as well as disease. While I believe that the physical condition of Utah's mines is as good as in any other state we are not unaware of the fact that a great deal can still be done and we are always willing to frankly discuss the accident situation in the state. Dr. Murray has assembled some interesting figures showing the monetary loss due to accidents and disease which I will will proceed to give you to show the necessity of continued efforts in welfare work regardless of humane considerations.

Chairman Doc, distinguished guests, and fellow members of the Rocky Mountain Coal Mining Institute: It's a genuine pleasure to meet with you again at the 54th regular meeting. I might add that it is always pleasant to be at the top of the batting order. The field is wide open since there is no danger of repeating something already said. At the same time, I am aware that the lead-off speaker has a responsibility to avoid stepping on the toes of subsequent speakers. I promise to confine my remarks to areas other than those to be covered by the well qualified speakers that follow. During our meetings at this convention, many fine papers will be presented. Our thanks are due Bob Williams and his hard working program committee for the superior selling that brought so many eminent speakers to our meeting. And, of course, our special thanks go to Doc Schloss, general chairman of this meeting. Doc and his able colleague, Stan Shubart, have been the spark plugs that fired up all of the arrangements we are enjoying here in Glenwood Springs. I'm sure all of us are appreciative of the many hours Doc has devoted to seeing that our meetings will be pleasant and profitable. When we mention arrangements, we always think of that master arranger, Fred Whiteside, who, as a charter member and secretary-treasurer of the Rocky Mountain Coal Mining Institute, has had more to do with more matters around these parts than just about anyone I can think of.

I read a book the other day called Opportunity 2000. The book, Opportunity 2000, talks about what's going to happen in the next nine or ten years as we propel ourselves through the 1990s into the 219 century. The book, Opportunity 2000, is a futuristic book, somewhat like Megatrends. It said that by the year 2000, baby boomers will be old people, and when you got here before the baby boomers, how does that make you feel? It said that there will be more women in the American work place by the year 2000 than men. The book, Opportunity 2000, discusses diversity. The big challenge for the 1990s is ?diversity?. We'll have the D-word in the 1990s. We had the G-word in the 1980s ? ?global.? Diversity in terms of more immigrants, more minorities, more females into the American work place, but also value systems diversity. We'll have to deal and adapt to four different generational clusters in dealing and interacting with employees and management in the 1990s-value systems diversity. I think there will be five generational clusters that we'll have to deal with. Massey says four. He says we'll still have the old people around, the World War II mentality; those who

The subject of my few remarks addressed to the Rocky Mountain Coal Mining Institute, "Guessing or Knowing! Which," may perhaps suggest but little to you here today. However, I am sure you will all agree with me when I say that in the conduct of a coal mining operation there should be no choice between guessing and knowing. The value of, and the results to be obtained from this Institute, its meetings and printed transactions, as well as those of other similar educational organizations, depend very largely on the mental attitude of those who constitute, through their pronouncements, the more active portion of the membership. Perhaps the most apt criticism that is now being made of the coal industry is that, to an extent possibly exceeding any other industry of similar magnitude and importance, it depends for its conduct altogether too much on "rule of thumb" and "tradition," rather than on proven practice and actual fact. The records of our coal mining association meetings bear expression of many conflicting opinions, the majority of which are sincerely put forth by those expressing same as representing the facts; the extremes expressed, however, frequently fix the question raised as one yet located in "no man's land." There are yet too many chances taken we are still "weighing pounds on railroad track scales" and measuring yards with the proverbial "bit of string." The actual expense of conducting any one of the several operations incident to the production of coal is rarely determined, and in many instances the general cost figures, prepared some weeks after the work is complete, are of that sweeping character that very little can be abstracted therefrom. Many coal companies are now making a daily cost sheet, showing the cost of labor and material in detail, as used in the several related operations,, and such is decidedly helpful, particularly to the mine superintendent and his foreman, who, without such, sail an uncharted sea; the auditor's belated monthly summary rarely ever seen by these men who are held responsible for the labor and material used. I have made reference to this situation as an accentuation of the fact that the coal industry contains more "serious minded, conscientious guessers" than does any other similar industry, although the annual cost of our product runs up well beyond the billion dollar mark, and what is more important, our industry is one that still continues to exact a heavy toll of human life. Now this brings me to the question of safety, the one question that should be, and which is, I know, uppermost in your minds. The coal mining world, engineering and operating, is now well sold on at least two things the theory of using permissible explosives and the elimination of the open light. Furthermore, the industry, particularly that portion which is located in Great Britain and the United States and Canada, are now planning vast extensions of the use of "rock" or "shale dust," both in the form of "dust barriers" and in "direct application" to entries and cross-cuts. This is well; however,, my study of past mine explosions has convinced me that the great majority of such had their very beginning in gas accumulations; frequently originating in restricted areas at the working face, in abandoned worked-out areas, or in some other certain place where ventilation is not, maintained as it should be; and that again leads me to the point where it can again be well said, that there is too much "rule of thumb," too much guessing now being done in regard to the volume of air required, and continuously furnished, in a given entry,, panel, room or area. Just to emphasize this situation, is it not a fact that the majority of mine inspectors express the ventilation conditions as measured by them, in terms of cubic feet per man employed, in each certain split, and does not the mining laws of many states yet demand a minimum of "100 or 150 cubic feet

It's my pleasure to welcome the Rocky Mountain Coal Institute to Montana. Now that you've ended a 74 year history of meeting outside our borders, I hope you'll be back more often. Even if I can't convince you to come back before 2060, when another 74 years will be up, I'm confident the Kalispell and Flathead Lake area will do the persuading for me. In recent weeks, I've made a number of speeches around the state pointing out just how wrong the revenue projections in Montana's state government made in April of '85 were when we came to April of '86. Since the middle of this month, Montana's legislators have been in Helena struggling to balance a state budget that, by the end of fiscal year '87, threatened to be some $88 million in the red. Other western states reliant on natural resource and agricultural economies have found themselves caught in the same deflationary spiral. The "window of opportunity" I proposed and the 1985 Montana Legislature passed, couldn't have been opened at a more difficult time. What was envisioned as an incentive to expand Montana's coal production, and our tax base, ran aground on low oil prices and excess hydroelectric power. De- spite the one-third severance tax rebate offered on new coal production, year-to-date figures published in the June 2nd Coal Week show that production in Montana is down almost 10 per- cent from last year. Again, we're not alone. Production in Wyoming is down 8 percent and in North Dakota, it has dropped 13 percent. An over- all 3 percent production decline in western states looks even worse when contrasted against a 12 percent increase for your eastern competitors. Montana's "window of opportunity" had the potential to be a significant signal to your industry. That potential was quickly tempered by the inability of Arab nations to stabilize world energy prices. If any of us had forgotten, the last twelve months have reminded western states that the well-being of our natural resource economies has a tremendous impact on the ability of all levels of government to provide services. The past year has also driven home that in the world of business and in the business of the world, risk-taking is still the name of the game. The Western Governors recognize the problems facing this industry - and our states - and we're prepared to fight for the future of western coal. In the past two decades, legitimate environmental concerns have created a vast body of new legislation affecting coal producers. The industry has been required to meet new reclamation standards - tough regulations relating to ground water, air quality and wildlife habitat. To the industry's credit, coal companies have hired professionals with the technical know-how to do it right. Rather than considering reclamation laws to be an unreasonable burden, today's coal company is more likely to view its reclamation efforts as a source of corporate pride. In a sense, the industry and the agencies which regulate it have matured together . . . although at times OSM is reluctant to admit that either of us capable of or willing to play by the rules. Certainly some abuses exist and OSM's oversight has been helpful in ensuring parity between those states willing to comply and those that would rather defy federal law. Nonetheless, penalizing the more modem and responsible western coal industry for abuses that occur elsewhere is both unfair and counterproductive. In presenting a summary of the uses of fine and pulverized coal the writer has borne in mind that we are not trying to determine what a combustion engineer should know but we are only trying to find out in what ways the consumption of slack can be stimulated. First discussing the use of powdered coal it can be stated that it has passed the first experimental stage but is still capable of much development and improvement. It has already found successful application in stationary and locomotive boilers, cement kilns, calcining furnaces, reverberatory smelting furnaces and many other types of furnaces, such as open hearth furnaces and annealing furnaces. For stationary boilers it seems to have been thoroughly demonstrated that powdered coal is more efficient than stoker installations. Over-all efficiences of boiler and furnace in stoker installations of the best type run from 70 to 76 per cent; whereas the efficiency of powdered coal installations averages slightly over 80 per cent. However, due to the increased cost of pulverized coal, the increased efficiency of these installations over stokers, from a money stand-point, will not be more than 1 or 2 per cent. The fusing of the ash in pulverized coal installations has given some trouble but apparently is easily overcome, on the other hand the fine ash, which is carried along with the draft, causes trouble both in the boiler and by settling on surrounding buildings or ground. Offsetting the disadvantages the great advantages of pulverized coal for stationary boilers seem to be: First-the ease with which a change in the load on the boiler can be taken care of. Second-when a boiler is cut out for a short period the "stand-by" losses are much less and, Third-a much poorer grade of fuel can be used. In many cases where pulverized coal has been used it has replaced slack coal which is of little advantage to the coal operator. However,, in other places it has replaced gas or oil and this is where the coal man is interested. Pulverized coal has the same advantages as the liquid or gas fuel but the question as to which is preferable depends on their relative cost at the point of use. In small stationary boilers where stokers are not used, very frequently the larger sizes of coal are, and it would be an advantage to the coal industry for them to be converted so as to burn pulverized coal, but so far there are only records of a few of such small installations having been a success and there is apparently room for a large amount of experimentation. In furnaces, such as smelting and assaying furnaces, annealing furnaces, etc., slack coal is not used and where pulverized coal has been installed it nearly always replaces fuel oil or gas. Just how much increased consumtion of coal can be made by pulverizing it for use in furnaces of this type can not be determined but it seems worthy of investigation. For locomotive boilers pulverized coal has found some application up to date but where it was being used in the United States it was stopped when we entered the war. In Brazil, however, the Central Railway has been using pulverized coal for locomotives with excellent results. If it could be possible to apply it to locomotive use where fuel oil is now used, or the larger sizes of coal, it would certainly make a big difference in the slack situation. Now as to the uses of slack coal without pulverizing. The writer's investigations lead him to believe that the greatest opportunities in this direction are in the line of increasing its use by apartment houses and small home owners. In fact in looking into the subject I found that a number of men in Salt Lake City are using run of mine coal in the usual type of house furnaces, some of them by separating the fines and wetting them down before feeding to the furnace claim they get no loss whatever through the grate. However, for best results with fine coal different types of furnaces must be installed and for apartment houses it would seem necessary to have either a small automatic stoker or else spray the fine coal in with an air blast from

At 10 a. m. registration was commenced and completed. At 11:30 a. m. the meeting was called to order by the President, William Littlejohn. There was no unfinished business, new business nor reports of committees. The minutes of the previous meeting, as published in the proceedings, were approved. The report of the Treasurer was referred to the Auditing Committee who were auditing the report of the previous year. At 2 p. m., President William Little- john called the meeting to order for study session. Mr. J. Samuel Pyeatt, the new president of The Denver & Rio Grande Western Railroad, ad- dressed the Institute at length, expressing his pleasure at the opportunity of meeting the coal operators, pledging his cooperation toward the solution of the mutual problems that are arising. He reviewed the change in the Western Industrial situation; explained how the revenue of The Denver & Rio Grande Western Rail- road was being received from freight rates, only twenty-four per cent above the rates of 1914, yet laborers receive 97 per cent more, supplies cost 58 per cent more, showing that no reduction in rates can be expected unless other conditions are adjusted. He gave figures to show the immense sums, aggregating ten million dollars, that have been spent on improvements in the last ten years. The railroad is improving and will continue to improve. Mr. Pyeatt feels that the serious troubles of the railroad are over and that with the cooperation of the shippers, better service and more profits are ahead. He showed the increase in rates on farm products to be only 48 per cent, as against an average in- crease in price of farm products, them- selves, of DG per cent. The position of the farmer is not as serious, nor un- fair, as has been claimed. More equitable legislation is promised, and this is needed to offset the efforts of demagogues to deceive the people as to the actual facts. Much equipment has been put into the railroad, much new and powerful equipment, and ten of the largest narrow gauge locomotives ever built have just been ordered, engines that will do the work of three of the present locomotives. This ratio of improvement will be maintained throughout the narrow guage system, and the Rio Grande will not lag behind the shippers and the operators in co- operation. The President answered Mr. Pyeatt's remarks, and then called the meeting to order for discussion. The study sessions were held; papers were read by .J. H. Emrick, "Cutter Bits"; D. A. Ladies and gentlemen, I appreciate this opportunity to be with you, and to share my outlook on the future of Federal coal leasing. I'm told that you wanted the best speaker on this subject in the world. Perhaps it's a reflection of these trying financial times, but I'm glad you finally agreed to settle for the best speaker your budget would afford. I have been asked to give you some insight on the status of Federal coal leasing, and how the budget problems facing the Department will affect the coal program. So I've polished up my crystal ball, and I'll try to give you a peek at the future. Before I do that, however, let me first go back in time - to when this Administration took office in 1981. We had a coal program then, after a hiatus of ten years. But that program was untested and - for reasons well known to all of you - did not work well in practice once we began operating the program. We went back to the drawing board and redesigned the program so that it can do what it is intended to do. We've made the program more predictable. That means that when future lease sales are scheduled, those sales will be reflective and reactive to the need to lease coal. On February 26, Secretary Hodel unveiled a framework for resumption of Federal leasing program activities, ending a more than two-year suspension of regional coal sales. The new program will provide the opportunity to satisfy market demand for acquiring and developing new leases, assure the government of fair market value for its coal reserves, and provide a stable supply of coal for this country's energy needs. The new program grew out of the Department's response to recommendations of the Linowes Commission and the Office of Technology Assessment, coupled with a supplemental environmental study. The Linowes Report, issued in 1984, contained 36 recommendations and three Judgments on leasing levels, tract selection, sale procedures, appraisal methods, key statutory and related factors, and organization and management of the leasing program. Major changes in the new leasing program reflect these concerns. We have developed a definition for captive tracts and devised procedures to appraise their value to the adjacent coal or mine owner. Other steps include a coal lease appraisal guide which describes our appraisal methodology and is available to the public. Improvements have also been made in the gathering of lease assignment information to help in estimating the value of potential lease tracts. To improve market analysis, a three-tiered system will be used to ensure that steps of the lease sale decision process are undertaken in the context of coal supply and demand. Regional Coal Teams will thus have the advantage of long range, regional and tract specific market studies to help them determine whether sufficient demand is expected first to warrant the initiation of activity planning, then to set regional leasing levels, and finally to actually offer specific tracts for lease sale. Sale procedures will also be improved in many ways to encourage competition, improve the chances for receiving adequate bids, and to evaluate whether bids represent fair market value. We made additional modifications to the program in response to the OTA recommendations. Regional Coal Teams have been given a larger role in recommending key decisions concerning the amounts of coal to be studied and the actual selection and scheduling of tracts for lease sale. These recommendations will be accepted unless the Secretary can cite an overriding national interest factor, or a governor's request to modify the recommendations. Smaller, more frequent sales will be held, to better judge market conditions and prevent over- or under-leasing. Public participation guidelines have been written, to document all opportunities for the public to comment at various stages in the planning process. We also decided that resource management plans prepared after the passage of FLPMA in 1976 must be completed, in order for a new round of lease sale planning to begin. The BLM will also beef up its procedures for consulting with affected Federal agencies during the planning process, to assure that the purposes and values of those agencies are considered and factored into land use decisions. To assure consistent use of an adequate data base in coal lease decision-making, Regional Coal Teams will develop standards and guidelines for data adequacy, and document the use of these standards. These procedures will also be applied to the unsuitability criteria screening process. Thus, the new leasing system announced by Secretary Hodel: is fully responsive to recommendations made by the Linowes Commission and the Office of Technology Assessment for improving environmental planning and fair market value procedures; gives the regional coal teams a major say in determining leasing levels, and on the timing,
