The 66th Regular Meeting of the Rocky Mountain Coal Mining Institute convened in the Opticon Theatre, Snowmass-at-Aspen, Colorado, and was in session at 10:00 a.m. The meeting was called to order by Past President, Stanley C. Shubart, Secretary-Treasurer, Schloss & Shubart, Inc., Denver, Colorado. Mr. Shubart welcomed the guests and was pleased at the large attendance, in view of the fact, that the site for the convention had to be changed at the last minute from the Stanley Hotel in Estes Park to Snowmass-at-Aspen. He stated that Joe Ward, our General Chairman, could not be present due to the serious illness of his wife, Thelma. He called on Bob Wilson, Chairman of the Registration and Hotel Committee, to give his report on applicants for membership since the last meeting. Mr. Wilson stated that there were 89 applicants and 242 registrations, an all-time record. A list of new members follows.

Profiled on these pages are the eight RMCMI 1996 Scholarship Award winners. All eight winners were present as guests of the Institute at the June convention in Durango, Colorado. Each received recognition at the Institute Awards Luncheon Monday, July 1. 1996. Each state vice president sewed as the host for the collegiate winner and his firm provided travel and hotel expenses. In addition to receiving a plaque from the Scholarship Chairman, Alan Czarnowsky, each winner receives $1,000 tuition credit for the coming academic year, as well as transportation hotel lodging and meals at convention as guests of the Institute. Because this is a continuing award, the winners from the previous year also receive a $1.000 tuition credit in their senior year if recommended by the dean of the college or university and are full time students. A resident from each of the eight RMCMI member states is selected from among Board approved institutions. Criteria for these awards to be made in the spring annually is that the recipient (1) Is a full time sophomore student who will use the tuition credit during the junior year. (2) Be both a U.S. citizen and a resident of the member state. (3) Maintain good academic standing, be pursuing a degree in a mining related field and have an expressed interest in western coal as a possible career path. The scholarship program includes curricula other than in the mining departments, but in engineering disciplines, such as geology, mineral processing and metallurgy. Contributions to this worthy project are tax deductible to each individual RMCMI member or his firm. Through annual donations of $100 or more, the Patrons of the Institute fund the scholarship program. A listing or current donors is found elsewhere in this book. Profiles of the 1996 Scholarship Winners follow. [ ] ARIZONA WINNER Michelle Begaye New Mexico Tech - Socorro. New Mexico Michelle Lisa Begaye plans to work in a mine near her Navajo Reservation after graduation. She would like to continue teaching the young in her community as she has been doing for the past few years. As a volunteer with the Natani' Trails, she takes at-risk students on wilderness experiences such as rafting, repelling, etc. Active in school, she played the trombone, was in speech and drama, played softball, and was the first female to play football as a right and left tackle. A member of National Honor Society in High Shool, she also made the Dean's List at Navajo Community College. Michelle will pursue a degree in Environmental Engineering when she transfers to New Mexico Tech this fall. [ ] COLORADO WINNER Nicole Albert Colorado School of Mines - Golden. Colorado Nicole is pursuing a BS in Mining Engineering with a Minor in Mineral Economics - and has already proven her serious intent with her many activities related to mining. She is a member of the Society of Women Engineers; Society of Mining, Metallurgy and Exploration; and has participated in two different projects related to mining, one of which was to clean up a mine tailings site. Nicole enjoys hunting, camping, fishing, softball and horses. Growing up with her father, working at a surface coal mine, sparked her interest in this industry.

SECRETARY SHUBART: This letter will not surprise you. (Reads) UNITED STATES DEPARTMENT OF COMMERCE Bureau of Mines Washington Sept. 4, 192G. Benedict Shubart, Secy, Rocky Mountain Coal Mining Institute. Denver, Colo. Dear Sir: "Sorry not to be able to be with you but since my function in the Institute has been largely along the line of `stirrer up of trouble' (of course always with the aid of Dalrymple), I do not wish to fall from grace now so am sending you a pamphlet on the last page of which is a' tabulation as to accident indices of various coal mining states and it seems to indicate that the states comprising the Rocky Mountain Institute have the poorest accident record of all the states producing coal. "It seems to me that even allowing for possible deficiencies in connection with placing accidents upon basis of hours of exposure, our western states need to `tighten up' as to safety practices, hence I hope that the Safety Committee report will be both drastic and progressive and that western coal mines apply the drastic proposals in addition to approving them as the policy of the Institute. Why wouldn't it be advisable to have a committee appointed to ascertain why the safety record of the states comprising the Institute is so bad as to coal mines? Wishing the Institute all kinds of success." (Signed) D. HARRINGTON. SECRETARY SHUBART: He encloses this pamphlet issued by the Bureau of Mines. On the back of it is this table; and it is a fact that the Rocky Mountain States are down at the lowest in almost every case, at the lowest point, with the highest accident rate in almost every kind of accident. Maybe he is wrong; maybe he states this for reasons. That is a rotten looking table for us.

Our next speaker this afternoon is a good friend of mine of some years. I must introduce him by way of a little story. Now Harris Sherman, many of you know because he was really in charge of everything to do with the mining industry in the State of Colorado for a good many years. Some of you may know that before he became part of Governor, Lamm's first cabinet as Director of Department of Natural Resources, he was an attorney for the Environmental Defense Fund and that caused me considerable panic as I think it might have caused some of you. I have observed Hams from the time he stepped into that office until he retired from that office to go into private practice as the senior partner of Arnold & Porter's Denver office, one of the , nation's most prestigious law firms. Hams is a Colorado native. He's lived here all of his life. He's a graduate of Columbia Law School for his law degree and a graduate of Colorado College down at the Springs for his BA. He has served in state government, but I thought it might be appropriate, since he is no longer in state government, if we used Harris, today, to tell us from a former state official's perspective what the image is of the coal industry from the seat he held in Governor Lamm's cabinet for a good many years. On motion of Gilbert Davis, duly seconded, it was voted that the reading of the minutes be dispensed with, inasmuch as they are printed in the proceedings. Owing to the absence of Mr. H. C. Marchant, who was unavoidably detained in Washington, Mr. F. W. Whiteside, Secretary Pro Tem, made the annual reports of the Secretary-Treasurer, which, on motion duly made and seconded, were received."

PRESIDENT SHOTT: Gentlemen, the meeting will now come to order, please. Members of the Institute: It is with great pleasure and honor that we welcome you to the thirty-ninth regular meeting of the Rocky Mountain Coal Mining Institute. I assure you that Mr. Krippner, the General Chairman, and his associates have an outstanding program in store for you, and trust it will be of much interest to the industry. I note by the program they have me slated for an opening address, but I am going to defer that, proceed with the remainder of the program, and endeavor to go on schedule and keep matters on schedule as outlined on our program. The first item on the program is the reading of the minutes of the thirty-eighth regular meeting by the Secretary. I might say that it has been customary in the past that we omit the reading of the minutes. If that is not agreeable, we will read them; otherwise, I would like for someone to make a motion that we dispense with the reading of the minutes, inasmuch as they are published in our annual report each year. MR. DAVIS: When the Secretary asked me to continue our accident experience in safety work at Dawson to cover the year just closed, I rather felt that he was asking 'a good deal, for we had said about everything that we could last year. I am not going to say very much, but in line with his request I have merely brought the figures up to date. I want to say, to start, that 1934 was, rather disappointing. It was the poorest year since 1930, as you will notice (indicates on diagram). This first column represents the accidents per thousand shifts worked. We cannot assign any real valid reason for the increase. We think we worked just as hard, but we are rather inclined to lay it onto the times; in other words, to lay it to the unrest and the changing conditions that are existent not only in this country but probably all over the world. We had twelve lost time accidents last year. As I explained last year, a lost time accident with us is an accident wherein the injured man is not able to return to his regular work, the next day-the day following the injury. So this represents (indicating) the lost time accidents per thousand shifts worked. We had one fatality in the twelve accidents which is reflected in the severity rates, which are also based upon thousand shifts worked instead of per million hours. The reason we are on the thousand shifts worked is be¬cause the Copper Branches of the Phelps-Dodge Corporation are all kept that way, and we are on the same basis for easy comparison.

PRESIDENT WHITESIDE: If the chair may be pardoned, he would like to say he knows something of the work of this committee, and I assure you that they have all worked faithfully and hard, holding meetings at least every other day, and sometimes oftener, hustling money and going through all the different work necessary to bring about and to make a successful occasion of this kind, and I-who really acted as an outsider and viewed their work-was certainly appreciative of their efforts, and I know you would have been had you been able to see how hard they all worked. One of the sad things in life always is when one becomes a "has-been." I have been more or less active in the work of the Institute ever since its in¬ception. Just why the high honor of President was conferred upon me I have never been able to fathom, but my time is about over and I am about to join the "has-beens," and while the position naturally has entailed a certain amount of work, it has been very pleasant work, and when one has the hearty co-operation of his fellow workers, such work is always a pleasure. It is, therefore, with a certain amount of regret that I lay down the gavel and take it up again to present to my successor; but in doing so, I wish to thank you, one and all, for your very hearty help and co-operation, and to wish my successor, Mr. George B. Pryde, all the possible success that can be his. Mr. Pryde. (Applause.) MR. PRYDE: I will make no extended speech at this time. I think possibly the next year I will have enough opportunity to do that; but I had a letter from my friend, Murphy, before this meeting, and he thought we were going to have a very good meeting; but I don't know the motive behind his letter. (Laughter.) I remember the story about the Scotchman who went to see the doctor, and the doctor said: "Sandy, you drink any?" "Oh, yes." "Well," he says, "you have got to cut that out. Do you smoke?" "Oh, yes; I smoke a great deal." "Well, you will have to cut that out also." And Sandy picked up his hat and started for the door. "Wait a minute, Sandy; you haven't paid me for my advice." "Yes, but I am not going to take your advice." (Laughter.) But I am deeply appreciative of the honor you have conferred upon me, electing me to be head of this Institute for the next year. I have belonged to this Institute, I should say, ever since it has been organized. This present session especially has been a very good session. As I look back over the different meetings, I think this one stands out among all the others in the papers presented and the spirit of co-operation that prevailed among the members here, and I am not going to ask your co-operation during the year; I am sure I will get it from all of you. I want to thank you for the honor conferred upon me. (Applause.) MR. WHITESIDE: The retiring President did not quite follow the reading of the by-laws, I think, in which it says that immediately after the election of a new President, the new President shall assume office, and I got so busy I forgot all about that. The committee which the chair decided to appoint is as follows. This is to formulate safety rules: For Utah, John Crawford, William Littlejohn; for Wyoming, Peter Patterson, Glen Knox; for New Mexico, William Risdon, Allan French; for Colorado, James Dalrymple, J. C. Roberts; and last and surely not least, as chairman of the committee, Mr. George B. Pryde. (Mr. Pryde later appointed D. Harrington as a member-at-large.) C. M. GODDARD: Mr. Chairman, we all realize that in a gaseous mine the application of, safety measures transcends everything else. Pictured on these pages are the seven RMCMI Scholarship Award Winners for the 1987-88 year followed by a brief profile. Six of the winners were present as RMCMI guests at the June convention in Breckenridge, Colorado to receive their recognition plaques at the welcome session held Monday, June 27, 1988. In addition to the plaques, each winner receives $500.00 to be used toward tuition in the coming academic year. Also, as this is a continuing award, the winners from the previous year will also receive an additional $500.00 for tuition use in their senior years provided they have maintained a good academic standing and are recommended by their university. Criteria for these awards is (1) That the award be made in the spring to a sophomore student to be used toward tuition during the junior year. (2) That the recipient be both a U.S. citizen and a resident of the state involved. (3) That the recipient have good academic standing, be pursuing a degree in a mining related field and have an expressed interest in Western coal as a possible career path. Bowler University of Arizona Tucson, Arizona Tony has taken a well balanced curriculum and at the same time maintained significant progress toward a Geological Engineering degree. He is interested in computer science and programs as a hobby He is the master of several computer languages including machine language on different personal computers. [ ] Christopher Taylor Colorado School of Mines Golden, Colorado Before matriculating at Mines, Chris served four years with the U.S. Army Special Forces attaining the rank of sergeant. He is active in the military, serving in the Reserves and R.O.T.C. This duty precluded his attendance at the Breckenridge meeting. He plans to get summer work experience in mining before graduation and is interested in the managerial and technical aspects of the mining business. [ ] Laverne West New Mexico Institute of Mining & Technology Socorro, New Mexico A native American of Laguna/Navajo ethnic origin, Laverne graduated from the Sante Fe Indian School as valedictorian. She served as both secretary and president of the American Indian Science & Engineering Society. She works at the Nevada Test Site with contractors assisting project engineers in a variety of jobs. She plans to earn a dual degree in Mining and Geological Engineering then pursue a Master's degree in Mineral Economics at the University of California at Berkeley. Among her honors are a four year scholarship from Sante Fe Southern Pacific Foundation, a one year scholarship from Mobil Oil Corporation and another from Eastman Kodak.

"Dock" Schloss follows: It is indeed a pleasure to call the meeting to order and to welcome you to this, the 58th regular meeting of the Institute. This morning I have the pleasant assignment of presenting to you a person who has been so active in the Institute, and has worked so closely with many of you, that I am sure most of you have known him much longer than I have.

MR. MARGOLF: Thank you very, very much Harris. There's sure a lot there to think about in terms, of our image, particularly. I think we should keep' in mind what Harris said about our history not being monolithic. Therefore our image can only be that, which is reflecting the weakest link in our industry and I think that's a burden on all of us. Perhaps to do some policing amongst ourselves to try to improve whatever might be our weakest link and thereby elevate our entire industry. Our third speaker this afternoon is another good friend of mine of long standing and I am very pleased to be able to introduce to the Rocky Mountain Coal Mining Institute Bob Golten. Bob is a graduate of the University of Michigan with a degree in Economics and Harvard Law School. His professional experience encompasses private practice in Chicago where he was born and in the federal government as a public defender in Washington, D.C. and in the Department of Justice as a tax , attorney. Some of us have come to know Bob more in his present role as the senior counsel for the I National Wildlife Federation. He's also Adjoint Professor of Law and Director of the National Wildlife Federation Resource Clinic, University of Colorado. Boulder campus. In addition, Bob has served with the Rocky Mountain Center on Environment as one of its directors for a number of years. He's very active in a number of areas that are not only civic but he does reflect what I would present by way of introduction as a perspective

At the time of mine accidents one frequently hears the expression "there will be accidents as long as there are mines", or it may be varied to state that the accident in question was unavoidable, or something similar indicating inability to prevent accidents. However, it is the opinion of the writer, after over twenty-one years experience in both coal and metal mining, seven years being spent wholly in safety work, that by far the greater number of all accidents is due to carelessness or negligence. This carelessness or negligence may be on part of the victim of the accident or of one of his companions, or on part of his employer or possibly even of the inspector or safety man, and in some cases all of these agencies are involved. It manifests itself in various guises, one of the most serious being violation of state mining laws or regulations or of mine rules, and frequently the rules of ordinary common-sense. The cause very frequently is that trait in human nature to "take a chance" and it has been the writer's observation that the worst offender is the old-time miner who has come safely through many years experience, who was mining when the "safety man was a baby", and who clings to old-time ideas and practices and has "no use" for "newfangled" present-day "notions". Unquestionably, there are accidents, wholly unavoidable and many are caused by ignorance and by the new-comer in mining, yet as previously indicated, the writer's observation is that the old-timer is by far the worst offender, bringing grief to himself, companions and employer. Of the numerous manifestations of carelessness and negligence in connection with mine accidents, which have come to the notice of the writer, only one will be treated in this paper, viz: Violation of State Mining Law, and mention will be made only of explosions and major accidents in coal' mines with which the writer came in personal contact as investigator. In most cases, in addition to mine inspection after the accident, the writer heard the evidence given at Coroner's inquest and thus was enabled to for¬mulate fairly definite impressions as to events and conditions leading up to the occurrence.

Misses Helen Kelly and Marian Rodell presented President Weber with vases of flowers in behalf of the Institute. The coal producers of the Rocky Mountain states have led in one of America's true industry revolutions - the leaps in productivity and competitiveness that deliver coal-fired electric power to the U.S. economy at prices that are the competitive envy of the world. You are a primary reason the average price of industrial power in the U.S. - the power that creates and upholds jobs - is: ? 10 percent below the French average, where nuclear power is dominant; ? 37 percent below the average for industrialized Europe; ? 49 percent below the German average, where subsidized coal and nuclear rule; ? And 73 percent below the Japanese average where nuclear and liquified natural gas dominate. There are interests ambitious to change all of that; and they will be a subject of my remarks, some by name, rank, and affiliation. Coal-fired power plants in the Rocky Mountain states deliver some of America's lowest cost electricity; and America's coal-fired plants deliver some of the world's lowest cost electricity. Represented here in one room are producers from states that deliver more than 40 percent of America's coal and five of her top 10 producing states. You are cornerstones of America's economic strength and future growth. The theme for this meeting is "The Many Partnerships of Coal;" and, in this keynote, I'd like to offer a variation on the theme. I'd like to discuss a determined partnership that is dedicated to overturning everything you have accomplished, plus the structure of our society - very dedicated, very patient, very determined. This partnership masks itself as being in the public interest but behind the mask a political alliance of three distinct private interests can be seen: ? One is ambitious for economic reward as a right and without the trouble of effort; ? One is ambitious for economic advantage in trade without the trouble of competing; ? And one is ambitious for the power to govern people without the trouble of winning consent in elections - to change the way other people choose to live in accord with their own passionately held beliefs. The international agreement on climate is being used as an artifice to advance these interests, and the interests are making the United Nations a mechanism for achieving those objectives - for turning the screw, so to speak. The President that Americans elect this year soon will come under intense pressure from these partners to: ? First, quickly adopt policies that will raise U.S. energy prices and restrict use under the climate agreement; ? And in 1998 - if they follow their own published plans - to begin the subordination of the independence of the United States to a collective sovereignty in economic, political, legal and other matters. The Worldwatch Institute inaugurated this pressure last year with a policy monograph entitled Partnership for the Planet: An Environmental Agenda for the United Nations. This is but one indicator of the situation I ask you to consider. The pressure will increase after the election. Worldwatch is one of those intellect-oriented "public interest" groups whose work often leads to policy proposals and debate. Worldwatch gets money from the U.N. Population Fund and the MacArthur Foundation among others. And so my remarks require wading waist deep into one of the more sporting current propositions of American public policy - discussion of ambitions for and within the United Nations to achieve that which the ambitious call global governance.
