Mr. Pickett's remarks were primarily concerned with the legislative aspects of the coal industry. Mr. Pickett stated that as a result of the 1952 election, only two senators and eleven representatives are now in the legislature who have ever served under a republican administration. He said there are 425 legislative issues now on the floor of Congress concerning the coal industry, but the coal industry has difficulty in legislation, because, although there are 31 coal states, only 11 states produce more than 5,000,000 tons per year, and 11 states produce between 500,000 and 5,000,000 tons of coal a year. In these states there are 44 senators and 195 representatives, less than a majority in either house, if all could be counted on to support the coal industry. An important committee to the coal industry is tile House Ways and Means Committee, composed of 25 members, 15 Republicans and 10 Democrats. Even with the support of the senators and representatives from these 22 states, legislative action is difficult.

ARTICLE I - General Section 1. Name. The name of the corporation shall be The Rocky Mountain Coal Mining Institute. Section 2. Objects and Purposes. The objects and purposes of The Rocky Mountain Coal Mining Institute and the nature of the business to be carried on by it are as follows: (a) To sponsor educational programs pertaining to coal mining technologies and production techniques, mining management and safety, federal, state, and local laws, rules and regulations pertaining to coal mining, and other energy related issues. (b) To disseminate to the public and to educational and scientific institutions knowledge, and the results of study and research into recent developments in coal mining technologies and production techniques, mining management and safety, federal, state, and local laws, rules, and regulations pertaining to coal mining, and other energy related issues. (c) To do and engage in all lawful activities that further or are consistent with the preceding objects and purposes of the corporation. Section 3. Nonprofit Corporation. This corporation shall operate as a nonprofit corporation under the laws of the State of Colorado. ARTICLE 11- Principal Office and Corporate Seal Section. 1. Principal Office. The principal office and place of business of the corporation in the State of Colorado shall be in the County of Jefferson, Colorado, or at such other location as the Board of Directors may from time to time determine. Other offices and places of business may be established from time to time by resolution of the Board of Directors. Section 2. Corporate Seal. The seal of the corporation shall be inscribed with the name of the corporation, the year of its incorporation, and the words "Colorado" and "Seal," and shall be in a form approved by the Board of Directors, which may alter the same at pleasure. ARTICLE III - Members Section 1. Classes. The membership of the corporation shall be divided into three classes, consisting of active members, life members, and senior members, who shall have such rights, privileges, and qualifications as these bylaws may provide. Section 2. Qualifications. The members of the corporation shall have the following qualifications: (a) Any individual interested in the goals and purposes of the corporation may become an active member of the corporation upon payment of such annual dues as the Board of Directors may determine from time to time by resolution. (b) An individual who has devoted long and dedicated service to the corporation and to its goals and purposes may become a life member of the corporation upon being elected to that status by the Board of Directors, and such individual shall retain such status for life. MR. MONAY (Vice President Kinney Coal Co., Scofield, Utah): The past year and a half has witnessed a series of coal mine disasters in Utah and Wyoming, concentrated into the short space of a few months, following a long period of years in which the industry was comparatively free from devastating calamities. The natural result has been a hysterical activity on the part of bureaus, commissions and professional reformers who know little about coal mining from a practical standpoint. This activity has been met by the industry in Utah with an attitude of submission, no doubt the result of the fear of being misunderstood by the public. But it is my firm conviction that the lives and property of the coal industry will find their surest guaranty of protection in the humanity, and in the self interest of those operating and working in the mines, rather than in governmental regulation. Inelastic, inflexible blanket statutes and rules will simply stifle and hamper the initiative and progress of our industry in working out its own salvation, under the varying and changing conditions of different localities, different conditions, and in different mines. We who have spent our lives in digging in the mines and operating them, know more about this business than anyone else and I believe it is time for us to speak up and no longer sit meekly by while inexperienced bureaus and unskilled commissions make up laws, rules and regulations for us which when made are on the books to stay, even though in a short time they may prove inapplicable, in whole or in part, or be superseded by something different, and which in some cases create new dangers or lull us into a false sense of security. Shortly after the Castle Gate explosion in March, 1924, a new set of safety rules was issued by the Indus- trial Commission of the State of Utah to become effective July 1st of the same year, the most important of which prohibits the use of black powder in any mine--gaseous or non-gaseous; prohibits the use of open flame lamps in any mine-gaseous or non-gaseous; and requires that rock dusting in all main haulage ways as far as the freezing point and required that all mining machines be equipped with water to be applied while cutting. These rules have been characterized as "Utah's Monument to her Dead Miners" in a large poster spread broadcast over the country from an office in New York that styles itself the Association for Labor Legislation. In reviewing the coal mining history of the State of Utah, in the year 1900, a serious disaster occurred at Winter Quarters. The cause of the same is believed to be an explosion of powder that was stored in the mine, which was a common practice in the early days, and from that time until the Castle Gate disaster, March 8, 1924, a period of some twenty-four years, no explosion of any kind occurred in this district. During all this period open lamps were used, considerable black powder was used, rock dusting was unheard of, sprinkling with water was very generally done-all without any catastrophe. Since the adoption of the new rules, we have 'had a very violent explosion at the Carbon Fuel mine in Spring Canyon. At the time of this explosion, 3,000 feet of the main slope had been rock dusted several times between July 1st and September 21st. The second left entry, which is a main haulage way, a distance of 3,000 feet was completely rock dusted on the date of the explosion. This mine is not considered extremely gaseous, yet an explosion as violent as that of the Castle Gate mine occurred. Some thirty men who had been loading coal in various parts of the mine on this Sun- day, the day of the explosion, and other men employed in rock dusting the second left entry, had just left the mine a little while before it occurred, and no abnormal condition in the mine was noted. At the time of the explosion five machine men were in the mine.

FEBRUARY 20TH. MORNING SESSION: The fourteenth regular meeting of the Rocky Mountain Coal Mining Institute was called to order in the Magnolia Room of the Albany Hotel. Monday, February 20th at 11 o'clock A. M., with the President, Mr. R. M. Magraw, in the chair, sixty-two members being present. The first number upon the program was the reading of the minutes of the previous meeting by the Secretary. There being no corrections or alterations, the minutes were approved as read. As Mr. Dan Harrington was unavoidably absent, his paper, subject: "Coal Mine Accidents and State Mining Law" was, by request of the President, read by Mr. J. Q. Lalor. Following this was a short discussion. There being no further business the meeting adjourned. AFTERNOON SESSION: The meeting was called to order in the Magnolia Room of the Albany Hotel at two-thirty o'clock P. M. with President R. M. Magraw presiding, fifty-eight members being present. Mr. Ben Shubart and Prof. J. C. Roberts were appointed a committee to draft and telegraph a message of condolence to Mr. E. S. Brooks of Rock Springs, Wyoming, on account of the recent death of his daughter. The com¬mittee submitted a copy of the following telegram, which was read by the Secretary: "E. S. Brooks, Rock Springs, Wyoming. We extend to you and your family our sincerest sympathies in your deep affliction. (Signed) THE ROCKY MOUNTAIN COAL MINING INSTITUTE." The following resolution was next presented by the Secretary and upon motion, duly seconded was carried by a unanimous vote: WHEREAS, it has come to the knowledge of this Institute that the Coal Mining Course of the Colorado School of Mines has been abolished; and

On Monday, June 27, 1921, at 6 p. m., twenty-four members of the Institute from. Colorado and New Mexico, left Denver on the Union Pacific for Rock Springs, Wyoming, arriving there at 9:42 a. m., June 28th. The party was met at the depot by the Rock Springs committee and a large number of the local Institute members. The day was spent in visiting the Central Power Plant of, the Union Pacific Coal Company and adjacent mine, the new 'E Plane, the Reliance, Dines, Winton and Sweetwater coal properties in the district. At noon a very elaborate lunch was served in the First Aid Building at the Reliance mine, which was most heartily enjoyed by all. In the evening the members and friends visited the new Rialto theater and saw the pictorial exposition of the' "Sky Pilot". The evening terminated with a dance in the ballroom of the Masonic Temple from 9:30 until midnight, concluding one of the most enjoyable days which the Institute has ever spent in Rock Springs. At 12:3o a. m. the original party, augmented by six members from Rock Springs, were again enroute to Salt Lake City, arriving there at 8:30 in the morning of Wednesday, June 29th. The Hotel Utah had been selected by the local, committee as the headquarters for the convention, and the majority of the -members at once proceeded to that place where the books were opened and the paying of dues and registration of the members were carried on until 11:45 a.m. At noon a majority of the members were entertained at the L. D. S. Tabernacle with an organ recital, which was up to its usual standard of excellence.

It is quite generally conceded that the coal mining industry is among the most progressive in the adoption of modern and efficient equipment and mining methods, but most woefully antiquated in many respects in the matter of systematic accounting. The cause of this condition is problematical, but is usually thought to be due to false economy. We realize that those who do not understand accounts, or like accounting, are inclined to be disdainful of accounts and statistics, and to under-estimate the benefits derived from the expense and labor involved in proper accounting. The business that is run without a proper accounting system is subject to haphazard financing and courts disaster. Furthermore, the operator who disposes of his product without due regard to the requirements of the industry as a whole, as reflected in the cost of doing business, is an unfair competitor. No one will deny that the possible production of coal in the United States is much in excess of the demand. While it is true there is an occasional shortage in certain localities, it is due to temporary abnormal conditions which are overcome in a short period of time, when the mines are again obliged to take idle time, and herein lies the danger, not alone to the operator who neglects to keep informed as to operating costs; but to his competitor as well. While physical conditions and operating methods differ materially, accounting methods must likewise differ in some respects, but irrespective of how the result may be obtained, a true statement of cost is absolutely essential. Daily cost statements may be preferred by some, but have proven unsatisfactory, generally speaking, because of variation in production as well as in both labor and material expense from day to day; therefore, we will confine our attention to a monthly cost statement. To be most effective, operating cost statements should be prepared and submitted to the officers as soon after the close of the month's busi¬ness as possible, to enable them to remedy any defects in the operations that might be discovered by an analysis thereof. Opinions differ materially with respect to the most efficient method of compiling and the distribution of labor and material. The writer believes that a time book which provides space in which to enter the number of hours worked each day of the month by each employe, together with distribution thereof, is the most accurate, simple and complete. This record will show the service performed by an employe each day of the month and the account to which same is properly chargeable. This, of course, refers only to the employe working by the-day or month. Ladies and gentlemen, I appreciate this opportunity to be with you, and to share my outlook on the future of Federal coal leasing. I'm told that you wanted the best speaker on this subject in the world. Perhaps it's a reflection of these trying financial times, but I'm glad you finally agreed to settle for the best speaker your budget would afford. I have been asked to give you some insight on the status of Federal coal leasing, and how the budget problems facing the Department will affect the coal program. So I've polished up my crystal ball, and I'll try to give you a peek at the future. Before I do that, however, let me first go back in time - to when this Administration took office in 1981. We had a coal program then, after a hiatus of ten years. But that program was untested and - for reasons well known to all of you - did not work well in practice once we began operating the program. We went back to the drawing board and redesigned the program so that it can do what it is intended to do. We've made the program more predictable. That means that when future lease sales are scheduled, those sales will be reflective and reactive to the need to lease coal. On February 26, Secretary Hodel unveiled a framework for resumption of Federal leasing program activities, ending a more than two-year suspension of regional coal sales. The new program will provide the opportunity to satisfy market demand for acquiring and developing new leases, assure the government of fair market value for its coal reserves, and provide a stable supply of coal for this country's energy needs. The new program grew out of the Department's response to recommendations of the Linowes Commission and the Office of Technology Assessment, coupled with a supplemental environmental study. The Linowes Report, issued in 1984, contained 36 recommendations and three Judgments on leasing levels, tract selection, sale procedures, appraisal methods, key statutory and related factors, and organization and management of the leasing program. Major changes in the new leasing program reflect these concerns. We have developed a definition for captive tracts and devised procedures to appraise their value to the adjacent coal or mine owner. Other steps include a coal lease appraisal guide which describes our appraisal methodology and is available to the public. Improvements have also been made in the gathering of lease assignment information to help in estimating the value of potential lease tracts. To improve market analysis, a three-tiered system will be used to ensure that steps of the lease sale decision process are undertaken in the context of coal supply and demand. Regional Coal Teams will thus have the advantage of long range, regional and tract specific market studies to help them determine whether sufficient demand is expected first to warrant the initiation of activity planning, then to set regional leasing levels, and finally to actually offer specific tracts for lease sale. Sale procedures will also be improved in many ways to encourage competition, improve the chances for receiving adequate bids, and to evaluate whether bids represent fair market value. We made additional modifications to the program in response to the OTA recommendations. Regional Coal Teams have been given a larger role in recommending key decisions concerning the amounts of coal to be studied and the actual selection and scheduling of tracts for lease sale. These recommendations will be accepted unless the Secretary can cite an overriding national interest factor, or a governor's request to modify the recommendations. Smaller, more frequent sales will be held, to better judge market conditions and prevent over- or under-leasing. Public participation guidelines have been written, to document all opportunities for the public to comment at various stages in the planning process. We also decided that resource management plans prepared after the passage of FLPMA in 1976 must be completed, in order for a new round of lease sale planning to begin. The BLM will also beef up its procedures for consulting with affected Federal agencies during the planning process, to assure that the purposes and values of those agencies are considered and factored into land use decisions. To assure consistent use of an adequate data base in coal lease decision-making, Regional Coal Teams will develop standards and guidelines for data adequacy, and document the use of these standards. These procedures will also be applied to the unsuitability criteria screening process. Thus, the new leasing system announced by Secretary Hodel: is fully responsive to recommendations made by the Linowes Commission and the Office of Technology Assessment for improving environmental planning and fair market value procedures; gives the regional coal teams a major say in determining leasing levels, and on the timing,

Men and institutions are what they are largely because of inheritance. Out of the past comes experience that enables men to build more wisely than did preceding generations. The field of possibilities has widened as the horizon of men's vision has been extended. The realization of these possibilities has depended largely on the application of men's natural endowments, brain and brawn, to the problems at hand. In the field of mechanized mining, Wyoming has a greater percentage of men with vision, who have a realization of the possibilities of mechanized mining, than any other state in proportion to tonnage production. With the introduction of mechanized mining systems have come problems that have caused the men who are connected with the safety work much thought. Discussions on mechanical drilling, cutting, loading, conveying, haulage, etc., have come in for their share of the debate. There have been a few attempts made to show that mechanical mining is safer than are the more primitive ways of doing underground work by man power. We also have a number of places in the coal producing States of the United States, where the mechanized systems have been abandoned chiefly on account of the safety element involved bringing about condemnation of the system by State inspection forces. Certain types of scraper systems have been condemned, and some have voiced opposition to long faces. This would lead us to believe that the question is still a debatable one as far as the safety element is concerned. It is only fair that we discuss the operations of mechanical systems and from the results obtained take analysis of conditions as they exist, basing our conclusions from the results obtained.
