PRESIDENT LITTLEJOHN: Before we open the discussion on the Utah mining laws, I want to bring out what I consider a slight misunderstanding on some of the things that I said this forenoon relative to our comparison of accidents. I did not mean to infer that we, as mine officials, are satisfied we have done the best we can to eliminate the accidents, when I was talking about a four-to- one comparison. I do not want any- one to get the idea in their heads that I do not think we are doing all we can. There is not any of us who can state that, even if we better these figures. It is the general understanding that these figures are based upon ratios per thousand man shifts and not upon the tonnage basis that we use. If it were based upon a tonnage basis, I think the figures would be pretty nearly reversed, for we are producing from two to four tons more per man than they do in Great Britain. The discussion will now be continued as I said this morning. There is a gentleman in the audience here that is as guilty of making these laws as I was, and I am quite sure when speaking he will confine himself to the subject of Utah Mining Laws and the prospective results. Before Mr. Monay starts with his paper, I want it understood that this discussion must be finished by 2:30 for the reason that we have still quite a lot of business before us this afternoon.

The Sixtieth Regular Meeting of the Rocky Mountain Coal Mining Institute convening at the Stanley Hotel in Estes Park, Colorado, was declared in session at 10:10 a.m. by Past President Mike Zakotnik, Jr., General Superintendent, The Kemmerer Coal Company, Frontier, Wyoming. Mike introduced Claude P. Heiner, President, Minerals and Development Corporation, Salt Lake City, Utah; and President of the Rocky Mountain Coal Mining Institute. President's Address Members of the Rocky Mountain Coal Min- ing Institute, guests, visitors and friends: I feel this is a distinct honor to talk to you on the occasion of this 60th regular meeting of the Institute. I once assumed this would be the Institute's 60th birthday, but later found that the first meeting was held in the State Capitol at Denver on November 12, 1912, at which time a comparatively small group of operators duly organized the Institute; a Mr. Weitzel of Colorado Fuel & Iron Company was then elected president and our late and dearly remembered Fred W. Whiteside, whose wife Gussie now carries Fred's work forward, was elected secretary. From Fred's records, early meetings were held semi-annually at rather irregular intervals, so that this 60th meeting is approximately the 52nd birthday of the organization and I am number 44 to serve as president. This latter development, I am sure, was conjured up last year by certain members at Glenwood Springs when I was absent. Anyway, I am honored and trust 'that these sessions will be both interesting and instructive in helping us on our way in the coal business.

Dear Member: The Proceedings for the Institute for the past year are enclosed. We hope you will read them, for there are some good ideas expressed, and the papers are far above the average. The job of publishing the Proceedings has always worried the Secretary. The Secretary, being at the same time the Treasurer, has to pay the bills, and this time he enlisted the co-operation of some of our friends. You will find this co-operation shown in the ads in the proceedings. Read the ads just as carefully, even more so, than you do the text. They carry messages from our friends. Don't forget the winter meeting in Denver, the last of February, the 26, 27 and 28. Another good paper to be read then will be that of A. L. Jones on the subject of "Power Problems of the Coal Mine." MR. MARGOLF: Our final speaker this afternoon before we have an opportunity for some questions for the members of the panel, is a gentleman who has spent more than 40 years in the newspaper industry. He started out as an office boy while he was still in high school. He worked his way through college working for a newspaper in Lexington, Kentucky where he graduated from the University. He has a long association with the Albuquerque Tribune but what brings him here today is in his position as editor of The Rocky Mountain News which is certainly one of our largest circulations. James Westfield, Assistant Director, United States Bureau of Mines, Washing- ton, D. C., called the second morning session of the Rocky Mountain Coal Mining Institute to order, and promptly introduced John Peperakis, Manager of the Sunnyside Operations, Kaiser Steel Corporation. Sunnyside, Utah, who spoke on "Ground Control Developments, Sunnyside Mines, Kaiser Steel Corporation." Mr. Peperakis illustrated his talk with a number of slides which were not reproduced with the printed text. (For the printed text of Mr. Peperakis' paper see index.) James J. Diamanti, President of the Car- bon Fuel Company, Helper, Utah, was introduced by Mr. Westfield, and he spoke on "Small Mine Operators Help Themselves." The labor turn-over at coal mines has long been a fertile subject for parade by complaining coal operators, the question invariably occupying a place of prominence in the list of disabilities that tend to increase the cost of producing coal, adding likewise to the now startling number of accidents that occur in coal mines. This disability, however, is like the weather question, which some humorist once remarked of by saying, "The weather is something we all talk about, but nobody does anything to improve it." Endless compilations covering the shift of employment by coal mine labor have been made and published, and while the actual loss expressed in cents per ton in cost of coal produced has never been determined, the fact remains that such represents a substantial item, taking the mines of the country as a whole. Efficiency engineers who have made studies covering the cost of breaking in and training each new man employed in certain manufacturing industries, fix same as averaging not less than $100.00 per man, and when the character of mine employment is given due consideration, including its ever-present hazards, the difficulty of close personal super- vision of individual employes, and the, at times, almost impossible ability to transmit to men of many diverse nationalities understandable instructions, it is quite safe to say that the cost of securing and breaking in new men for underground mine work will fully equal that suffered by the factory managements. When we speak of mine labor turnover we must necessarily exclude the enforced shifting about of men who are laid off by the closure of mines due to accident or lack of market, con- fining ourselves to the turn-over occasioned by- (a) the dismissal of individual men or groups of men; (b) the voluntary resignation of the individual workman. It is these two methods of severance that the employer and employe alike suffer from; the item "Unclaimed Wages" carried in the accounts of every large coal company illustrative of the "quit this job, get another one" attitude of many workmen, who frequently, when leaving, fail to claim small sums due them, while others, in turn, leave a train of debts, large and small, behind. Man's capacity far fretting is endless, and no matter what difficulties we surmount, how many ideals we realize, there is a stealthy pleasure in rejecting mankind or the universe as unworthy of our approval. - Will Durant Until recently, reasons for favoring one or another energy alternative were advanced on the basis of technical considerations and economic realities. However, it is an indication of the cultural climate of our society and growing realization of why energy is our master resource that many citizens have begun to express concern about the social and ethical implications of our energy deci¬sion-making. A vivid indication of this shift toward ethical concerns is reflected in the attention being focused on conservation - even to the point of regarding it as a virtual panacea equivalent to a "free energy resource." Among others, the authors of a publication by Resources for the Future cautions us about the difficulties of defining conservation. They also point out that unrealistic expectations for achieving the high levels of conservation claimed by true believers may boomerang if, at the same time, we are morally required to maintain economic growth and robust productivity for the basic well-being of more people. In its economic meaning, conservation signifies the most economic or cost-effective applications of energy, together with other resources, in a given process or activity. To achieve conservation that is cost-effective, saving energy alone is not sufficient; the cost involved in saving the energy must be no greater than the cost of the energy that is saved. Using its thermodynamic meaning, conservation and efficiency are viewed as constrained by physical laws and measured against ideal limits set by these laws and processes. Since achieving higher levels of technical performance is not without costs, the economic meaning of conservation must be factored into technical possibilities. It is the ethical, equity and environmental meaning of conservation that concerns us here. In its third meaning, conservation consists in moderation as a value which appears inherently worthwhile both in itself and in relation to social choices dedicated to achieving distributive justice. The value of moderation seems predicated on the assumption that natural resources and the environment have fixed, finite, exhaustible capacities for satisfying human needs. Hence norms for moderating human behavior appear to require prescriptions by some authority. Such norms presuppose some agreement on "essential" uses of energy. However, the difficulties of setting behavioral norms loom large, because "... it is as difficult to determine essential energy consumption as to determine what is essential in any other phase of consumption, whether it involves food, clothing, shelter, or recreation." The ethical meaning of conversation is further complicated by a centuries-old argument over the proper exercise of stewardship - i.e., how best to develop natural resources. On the one hand, the preservationist position insists on an inviolate, "hands-off" policy and stands opposed to ongoing development of wilderness areas and mineral resources. On the other hand, the "scientific conservationist" who preaches the "gospel of efficiency" insists on development of resources based on principles of sustained-yield, multiple use and - in the case of competing claims - reserving resources or land for their "higher use." Current confusion reigns among opinion leaders in the environmental movement because they appear to have lost the genius of the original Conservation ethic, developed in the 19th century. They seem to think that conservation is preservation. The question I wish to explore is whether a single-minded, exclusive pursuit of "conservation" in its economic, thermodynamic and preservationist meanings may actually do more harm than good in serving the ethical goals of conservation. Thank you very much for that introduction. I spent part of my early career in the coal industry here in Colorado, and I am always happy to return. In such a beautiful setting, it seems out of place to talk about "Improving the Climate". But in our work-a-day worlds, we know the climate for the coal industry is something less than picture perfect. But unlike Mother Nature's climate, there are some things we can do about the climate for coal. Today, I want to talk to you about sonic of the activities that we are engaged in... and that you can support... to improve that climate. A number of challenges and opportunities face our industry. I will try to set the stage for this conference by briefly describing the current climate for coal - which is indeed very challenging. I will then outline some of the steps we are taking to broaden our base to include our allies in the rail and electricity industries and the public at large.

MR. DAVIS: When the Secretary asked me to continue our accident experience in safety work at Dawson to cover the year just closed, I rather felt that he was asking 'a good deal, for we had said about everything that we could last year. I am not going to say very much, but in line with his request I have merely brought the figures up to date. I want to say, to start, that 1934 was, rather disappointing. It was the poorest year since 1930, as you will notice (indicates on diagram). This first column represents the accidents per thousand shifts worked. We cannot assign any real valid reason for the increase. We think we worked just as hard, but we are rather inclined to lay it onto the times; in other words, to lay it to the unrest and the changing conditions that are existent not only in this country but probably all over the world. We had twelve lost time accidents last year. As I explained last year, a lost time accident with us is an accident wherein the injured man is not able to return to his regular work, the next day-the day following the injury. So this represents (indicating) the lost time accidents per thousand shifts worked. We had one fatality in the twelve accidents which is reflected in the severity rates, which are also based upon thousand shifts worked instead of per million hours. The reason we are on the thousand shifts worked is be¬cause the Copper Branches of the Phelps-Dodge Corporation are all kept that way, and we are on the same basis for easy comparison.

Since the day when one of the most progressive of our flat-head for- bears used a pry pole to loosen large rocks to crash upon the head of his, enemy, thereafter making notes of his performance on tablets of stone, the arts of mechanicalization have developed and progressed to the benefit of mankind. In the early coal pits of England the crudest of tools were wielded in the most slavish of toil to win a very small amount of product. In our own country it is but a few years since coal was hewn by negro slaves in the mines of the southland. The past thirty years have brought the use of the mining machine, power drill and locomotive, and we now stand on the brink of the coal mining era that will change the toiler of the mines into a skilled mechanic and render far more safe the winning of the fuel necessary to the nation's need. The ingenuity of our citizens has made it imperative that coal be produced at a lesser cost. Vast supplies of fuel oil have been developed; enormous resources in water power are turning the wheels of many mills and, most commendable but distressing to the coa.1 producers, the high price of coal has resulted in efforts and accomplishment in fuel economies unheard of a short five years ago. The railroads of the United States alone in 1924 accomplished more hauling with $30,000,000 less in coal bills than in 1923. The loading of coal by machines has been under investigation and trial for some time past and in an effort to have its men informed of the practice of the eastern coal fields, The Union Pacific Coal Company sent the writer through a number of states to view as many operations as possible. Notes were taken of machines and processes seen and time was spent with engineers of the various coal companies; also with the United States Bureau of Mines Engineers, particularly Mr. Edwin H. Johnson, who devoted one year to the most careful study of the mechanical loading of coal. The writer wishes, at this time, to acknowledge the helpfulness of the information acquired through contact with Mr. Johnson.

resident Schloss called the meeting to order at 9:30 a.m. Bob Dean, manager of the Hotel Colorado, gave a brief explanation of hotel policies governing the swimming pool, and also extended an invitation to the Institute to return in 1963, and stated that the dates June 30 through July 3 were available for next year. He also stated that June 28 through July 1 were available for 1964. He felt that holding the convention during the 4th was not good policy, and that dates prior to or following the 4th would make for better attendance. John A. Reeves, chairman of the Resolutions Committee presented the following resolutions: RESOLVED: That the members of the Rocky Mountain Coal Mining Institute in convention assembled, hereby ratify and confirm all official actions of the officers, the Executive Committee and other committees of the Institute between June 28, 1961, and the present time.

The 69th Regular Meeting of the Rocky Mountain Coal Mining Institute convened in Manor Vail Lodge, Vail, Colorado, and was in session at 10:00 a.m. The meeting was called to order by Past President Joseph E. Ward, former District Manager, Denver Office, Coal Division, Joy Manufacturing Co. and now retired. Mr. Ward, after reading a brief biography of President O. F. "Os" Lewis, introduced him to the assembly. Biographical sketch read as follows: Mr. Lewis is President, General Manager, and a Director of Colowyo Coal Company. "Os" was born in Reno, Nevada. He attended the University of Utah at Salt Lake City, Utah, and later the Denver University in Denver, Colorado. His career in the Western Coal Industry started back in 1923 when he was employed by the Central Coal and Coke Company of Salt Lake City, Utah, as a clerk, then chief clerk and as a traveling sales representative for a period of 13 years. Later, in 1936, when that company was acquired by an affiliated company of Harris Coal Company, he was transferred to Denver as Assistant Sales Manager, Purchasing Agent and later as Executive Assistant to the President.
