MORTENSEN: On behalf of the Rocky Mountain Coal Mining Institute, I take great plea¬sure in saying good morning to you at Vail. With a few clouds in the sky, at least we won't get sunburned. We won't have to worry about our kids in the swimming pool, perhaps. It is delightful for me to have been able to have represented the Rocky Mountain Coal Mining Institute for the year 1982-1983. This has been our 71st year and this is our 79th meeting. In recognizing the attendance here, that dinner we had last night, and some of our entertainment must have gotten to some of us, or it is a little early. But I'm sure as the day goes on, and with the speakers outlined, it will be very beneficial for those who do attend. We do appreciate your attendance. I'd first like to make an introduction of our head table. Doris Finnie, she is our executive secretary. As most of you are aware, Gussie Whiteside retired as secretary. This will be the first time since the Institute started that there has not been a Whiteside present at one of our conventions. I'm sure Gussie would appreciate any calls or letters that any of you would care to make to her. Doris, I might add, has been a great help to me and all of the people who have been working on the program for the Institute this past year. There's been lots of reorganization and we are very pleased with Doris's ability to take hold from Gussie without any waves. Much credit must be given to you Doris for this and we do appreciate the help you have given us and believe me she has kept us out of trouble. Next, we have Art Neill. He is our vice president of the Institute from Montana and he also works with Western Energy Company. We appreciate the help that all of these session leaders and chairmen give to us. We have other names on the head table, but they will fill in as the morning goes on, so we won't bother you with any of those at this time. To set the stage for business, first I would like to call on Doris for a motion to approve the minutes of last year. MS. FINNIE: Thank you, Vernal. Mr. President, I suggest that the reading of the minutes be dispensed with and that the members refer to pages 9 through 80 of the Proceedings for the 78th regular meeting of RMCMI, as published MR. MORTENSEN: Thank you, Doris. Do we have a motion to so approve? MR. LINVILLE: I so move. MR. MORTENSEN: Loren Linville so approved. Do we have a second? MR. GARR: Second. MR. MORTENSEN: All in favor say aye. (Audience responded affirmatively.) MR. MORTENSEN: Those opposed? Hearing none, the motion is carried. I'm sure glad we didn't have to read those 80 pages. Is Doug Hammer in the audience? He was going to give us a list of new members of the Coal Institute and ask for your approval. But because of his absence, the names will be listed so that you can read them at a later date, I will entertain a motion that we approve the new members who have joined the Institute. DR. BANOWSKY: Thank you very much. That was the shortest introduction that I have had lately, and I didn't have time to get my coat on. But I appreciated it, and I'm delighted to be here with an industry with which 1 feel strong affinity. At the University of Oklahoma we have an energy history. We are a little more currently involved in oil and gas, and those of you who know the history of our state would be aware we have an early coal development back really before the turn of the century in the southeast part of our state what we call Little Dixie. How many of you have spent anytime in Oklahoma or are from the state of Oklahoma? I'm not going to ask how many are from OSU or the University of Colorado. We did send you a football coach here from Oklahoma, and 1 see you have exchanged him. Several of you were only interested in the lobby in asking about our football team this year. 1 would like to go somewhere where we can talk about something besides football. I'm just trying to build a University that our football team can be proud of. We're going to be strong again. 1 can assure you. We've got the best football team money can buy. It's not quite as bad as the college president who called the coach in and said, "Coach we're in trouble, you're losing games and the alumni is very unhappy." "What can we do?" the president asked. The coach said, "Well the football team is flunking the admissions test. We can't get them in with the standard achievement and SAT tests." The president said, "What can we do?" The coach said, "Well the coaching staff has substituted for the American College Test the simple fill in the blank questionnaire." The president said, "Let's use it. We have got to get the team in." The first question was, Old MacDonald had a (-). And a couple of the big tackles were taking it and one of them said, "Hey, what did Old MacDonald have?" His friend said, "Stupid, Old MacDonald had a farm." "Well how do you spell farm?" He said, "Stupid, e i e i 0." Now the gentleman who met me at the registration line from Lakewood, Colorado, was asking me about one of our great big tackles; and he is doing well. We call him Doctor Death; he is also a wrestler and that gentleman said, "1 don't know how bright he is." 1 said, "He is bright enough for our academic tutoring that he is going to get through all right." So I'm delighted to see you and be here with my very dear friend, Carl Terzian. Carl and 1 were in Los Angeles together for 10 or 12 years when I was president of Pepperdine University. He and I are exactly the same age. Born in 1935 and 1 a month or two later in 1936. Fewer children were born in that period than in any other period of time in this century. For those of you who remember anything about that period, you will know why no one was having babies during that period. But Carl called and said, "Bill do you know where Vail, Colorado is?" Well when you live in Oklahoma, you learn where Colorado is in a hurry. 1 not only know this beautiful area, but have made too much of an investment here at a place called Beaver Creek. The real estate is cheap over there. 1 play regularly in the Gerald Ford Invitational Golf Tournament here. Hope you will visit Beaver Creek. It's just 10- 12 miles to the west. The sight of the 1976 winter olympics until the people of Colorado voted them out. And now Vail Associates and I are good Oklahoma families. Bass family, Harry Bass of course, many of you know this story, who is chairman of the Board of Vail Associates, is making quite an investment in that year-round resort area. Our next speaker this afternoon is a good friend of mine of some years. I must introduce him by way of a little story. Now Harris Sherman, many of you know because he was really in charge of everything to do with the mining industry in the State of Colorado for a good many years. Some of you may know that before he became part of Governor, Lamm's first cabinet as Director of Department of Natural Resources, he was an attorney for the Environmental Defense Fund and that caused me considerable panic as I think it might have caused some of you. I have observed Hams from the time he stepped into that office until he retired from that office to go into private practice as the senior partner of Arnold & Porter's Denver office, one of the , nation's most prestigious law firms. Hams is a Colorado native. He's lived here all of his life. He's a graduate of Columbia Law School for his law degree and a graduate of Colorado College down at the Springs for his BA. He has served in state government, but I thought it might be appropriate, since he is no longer in state government, if we used Harris, today, to tell us from a former state official's perspective what the image is of the coal industry from the seat he held in Governor Lamm's cabinet for a good many years. He has been the recipient of a number of honors that I think you should know about including Phi Beta Kappa and

MR. MARGOLF: Our final speaker this afternoon before we have an opportunity for some questions for the members of the panel, is a gentleman who has spent more than 40 years in the newspaper industry. He started out as an office boy while he was still in high school. He worked his way through college working for a newspaper in Lexington, Kentucky where he graduated from the University. He has a long association with the Albuquerque Tribune but what brings him here today is in his position as editor of The Rocky Mountain News which is certainly one of our largest circulations. MR. ENZI: hank you very much. I'm sure there?s a lot of you out there just realizing that Rock Springs and Gillette is not one city. I'm sure there's a lot of you wondering why a person from a town who has the image in the national media that the town of Gillette has is talking to you about image. I had a person this morning ask me if Gillette wasn't the end of the world. The only response I can give is "no, but you can see it from there." We have been researched a lot and, I realize, we've been very lucky because I've observed that researchers cause cancer in rats. In fact a wonder drug is one that has no effect on mice. In fact I've been thinking of posting a sign in my office that would read "due to the large number of interviews by journalists who already have their articles written, we would most respectfully request that anyone wishing to insult the city of Gillette, please limit themselves to 3,000 words or 15 insults, whichever is shorter." I don't know if any of you saw the article in Playboy about three months ago on the city of Gillette. What you probably don't realize about that article is that that was an attempt by Playboy magazine to see if they couldn't change their image to a national municipal magazine. I think it's important to know Gillette is the frontier city, a pioneer city, it's a shopping center for northeast Wyoming and most importantly, we're the energy capital of the nation. We're on the threshold of the Powder River Basin and we will be the nation's energy solution. Besides coal, we're, already the heart of the state's leading oil producing area and we have vast uranium resources. But I, want to tell you the biggest resource that we have is, the people who have come to live in Gillette. You will find Gillette a busy, young, pulsating community. We're experiencing the excitement of growth. We're welcoming a higher percentage of newcomers than any other town in the nation. Yes, growth to us is exciting. Where else can you get ten years of experience in two years? We realize you can't maintain the status quo. Growth can be painful but not as painful as the alternative, recession and depression. For a little bit of background, we are now at 16,000 people and we have another 4,000 people who live on the outside but look like they live on the inside. The Census Bureau says that we have, 11,225 people but we have that many people in a traffic jam on the Douglas Highway in one day. I?ll , tell you about a few things happening in Gillette. I think it's very important to emphasize that I didn't , do these things; it's the youth and the energy of the community that has done these things. Right now the city of Gillette has 32 major projects underway. We have water for 50,000 people and we're seeking more water. The city in 1975 was 1 .8 square miles. Last year alone we annexed I square mile. We build 10 miles of paved streets a year. For the last 8 years we've doubled our parks' budget. I

A symposium concerning "The Image of the Coal Industry" was presented at 2:00 p.m. in the Conference center and chaired by Charles W. Margolf, RMCMl Program Chairman and Vice President, Western Coal Development, W. R. Grace & Co. MR. McKEEVER: I'd like to do one thing and that's to introduce our Program Chairman, Charlie Margolf, who will be handling this portion of the program. Charlie and I have been acquainted since late 1973. He has worked together with me on several projects at W. R. Grace here in the west; a dear friend and one that I just want to say thanks to again. I think I have a little token of that appreciation here for Charlie. Here you are Charlie. (present given) I turn the command over to you. Mr. Margolf, a native of State College, Pennsylvania, received a Bachelor of Science Degree in Industrial Engineering from Pennsylvania State University in 1950 and a Juris Doctor Degree from University of Pittsburgh School of Law in 1953. His professional experience has beem as an attorney in the Law Department of Reynolds Metals Company, Richmond, Virginia, where he served as legal counsel to the Geological Department the mining subsidiaries of the parent company both foreign and domestic, the Power Department and the Oil and Gas Division. He was closely associated with Reynolds Mining Corporation's project at Lake DeSmet, Wyoming, from its inception in 1954 and became Manager of the Wyoming Division of Reynolds Mining Corporation when it was established in 1966, holding that position until September 1972 when he joined Cameron Engineers, Inc. of Denver, Colorado as Vice President in charge of its coal, water and environmental activities. Mr. Margolf joined W. R. Grace & Co. in January 1974 as Director of Western Coal Operations. Memberships are held in the Virginia Bar Association, the Wyoming Bar Association, the American Bar Association and its Section of Natural Resources Law, the Wyoming Engineering Society, the Colorado Mining Association, the Rocky Mountain Coal Mining Institute which he has served as vice president for Wyoming, the Society of Mining Engineers of the American Institute of Mining, Metallurgical and Petroleum Engineers, the Minerals Information Committee of the Denver Chapter of AIME and the Denver Coal Club which he has served as Chairman of its Board of Directors. He has also been a member of the Montana Coal Council and served as a director, the Wyoming Water Development Association which he has served as a director for industry and as first vice president and the Wyoming Mining Association. He has been reappointed by Governor Lamm to the Governor's Scientific Advisory Council. He was appointed by the Federal Power Commission, Gas Policy Advisory Council, to its Supply- Technical Advisory Task Force - Synthesized Gaseous Hydrocarbon Fuels and served as Vice Chairman of that Task Force. He has been reappointed by the Secretary of the Interior to the Solid Fuels Unit, Department of the Interior, National Defense Executive Reserve. He also serves on the Advisory Council to the Industrial Ecology Institute of the Colorado School of Mines and was recently elected a member of the Board of Directors of ROMCOE (Center for Environmental Problem Solving). The 78th Regular Meeting of the Rocky Mountain Coal Mining Institute (hereafter referred to as RMCMI) convened at the Marriott's Mark Conference Center, Lionshead Village in Vail, Colorado. The meeting was called to order at 8:45 a.m. by the President, Ira E. McKeever, Jr., who is President, Western Mining Operations, Natural Resources Group, W. R. Grace & Co. McKeever was introduced by Past President Edward F. Ziolkowski, Senior Vice President and General Manager, Energy Development Company in Hanna, Wyoming. MR. ZIOLKOWSKI: The first order of business this morning is to introduce the president and for a business meeting as well as other items on the program. It is my pleasure to introduce Ira McKeever to you this morning. Ira was born and raised in Kit Carson, Colorado, and served in the U.S. Navy prior to obtaining his geological engineering degree in 1952 from Colorado School of Mines in Golden. He then spent the next 20 years involved in mining sulphur, pot ash and coal with Texas Gulf Sulphur at that time and Gulf Resources Chemical Corporation. In 1972 he joined W. R. Grace & Co. as president of the Mining Division, Natural Resources Group. He was named Colowyo Coal Company's president and general manager in 1976 to develop what is currently Colorado's largest coal surface mining operation. Last year he became W. R. Grace's president of Western Mining Operations which is the position he presently holds. Ira is active in civic affairs; he is currently serving on the Colorado Energy Impact Assistance Advisory Committee. He is a member of the Colorado's Metropolitan Water Roundtable, he is also a director of Project Colorado, a member of the committee for the Colorado Division of Commerce and Industry. He has, in the past, served as chair- man of the Craig Hospital Board. In 1967 Ira was the recipient of the Colorado School of Mines van Diest Gold Medal Award, and in 1981 was given the individual service award for outstanding accomplishments in the field of health, promotion, physical fitness by Colorado's Governor's Council for the Health and Promotion of Physical Fitness. Memberships are also held in Denver Coal Club, the Colorado Mining Association, and the American Mining Congress. Will you please welcome Ira McKeever? I do have one other piece of business here. If you will all join with me, yesterday was Ira's birthday. I asked what year that was, but I couldn't get that out. So, I'm not going to lead the singing. Someone is going to lead the singing. But I think it would be appropriate if we did sing happy birthday this morning and I think it would also wake us up. How's that? All right, will you join me please? (A chorus of the Happy Birthday song followed.) President McKeever's address: MR. McKEEVER: The secret is that I'm double nickles. So I've got a few more years hopefully to be with you and this wonderful industry that we represent. Thank you Ed. I realize now more than ever, the tremendous effort that you put in the program last year and the magnitude of the job that is placed in the presidency of the Institute. It was indeed with tremulous hands that I undertook to lead the Institute this year, and I found a tremendous amount of strength and guidance in my friend Ed whom we've known since college days and worked together. On behalf of that lifetime of memories and good thoughts, Ed, I would like to present to you a little token of appreciation. 1 would like to join Ed in welcoming you all to Vail. Ed arranged the weather, 1 arranged the program along with Charlie Margolf. This is the 70th regular meeting of the Rocky Mountain Coal Mining Institute; and in accepting the leadership a year ago, 1 obligated one very special person to fill the role of chairlady and hostess for this meeting. I would like to have you all, if you haven't already, meet my wife, Linda. I would like to thank her publicly for her guidance and help she continues to provide me. It's absolutely necessary that you also meet and recognize Charlie Margolf our program chairman who will be helping through the meeting to present and monitor our program; and anyone who knows Charlie knows the sincerity and dedication he brings to anything or any phase of life he touches. We will be seeing him in action this afternoon when he chairs the most interesting panel presentations. Don't miss it if you can help it. A couple of logistical comments. MR. MARGOLF: Thank you very, very much Harris. There's sure a lot there to think about in terms, of our image, particularly. I think we should keep' in mind what Harris said about our history not being monolithic. Therefore our image can only be that, which is reflecting the weakest link in our industry and I think that's a burden on all of us. Perhaps to do some policing amongst ourselves to try to improve whatever might be our weakest link and thereby elevate our entire industry. Our third speaker this afternoon is another good friend of mine of long standing and I am very pleased to be able to introduce to the Rocky Mountain Coal Mining Institute Bob Golten. Bob is a graduate of the University of Michigan with a degree in Economics and Harvard Law School. His professional experience encompasses private practice in Chicago where he was born and in the federal government as a public defender in Washington, D.C. and in the Department of Justice as a tax , attorney. Some of us have come to know Bob more in his present role as the senior counsel for the I National Wildlife Federation. He's also Adjoint Professor of Law and Director of the National Wildlife Federation Resource Clinic, University of Colorado. Boulder campus. In addition, Bob has served with the Rocky Mountain Center on Environment as one of its directors for a number of years. He's very active in a number of areas that are not only civic but he does reflect what I would present by way of introduction as a perspective

RMCMI members were welcomed at 12:30 p.m. by President McKeever. Following the luncheon held at the Conference Center, McKeever introduced Mr. Brooks Mitchell who is President, Human Resources Management, Inc. in Richardson, Texas. His topic was "Perspective on the Last Five Years. " The RMCMI Championship Tennis Tournament was held at the Marriott's Mark courts under the direction of Chairman Alan W. Czarnowsky and his committee members Mary Kay Aisenbrey and Jon Pratt. EVENING Tuesday, June 29, 1982 From 6:00 to 9:00 p.m. a Mini-Banquet was held for the young people of RMCMI members in the East Room of Lionsquare Gore Creek Lodge. The 6:00 p.m. time found RMCMI members gathered for a social hour at Marriott's Mark poolside, The Annual Speechless banquet followed at 7:00 p.m. in the Conference Center. After the dinner, President McKeever introduced the Golf and Tennis Chairmen who announced the prize winners. Robert W. Wilson, Chairman of the Nominating Committee, presented the following slate of officers for 1982-83: President, Vernal Mortensen; Vice Presidents-Colorado, Charles W. Margolf; Montana, Art K. Neill; New Mexico, Robert Diederick; North Dakota, James A. Brown; Utah, Bernard Bernstrom and Wyoming, John T. Goodier. It was moved by Loren V. Linville, seconded and carried that the elective ballot of RMCMI be cast for the officers as nominated. Mr. Wilson advised RMCMI that a successor to Mrs. Whiteside would be selected at a later date by the Committee and Executive Board inasmuch as Mrs. Whiteside's resignation had been received only ten days earlier and there had been no time for interviews. There being no further business, the meeting was adjourned at 9:30 p.m. MORNING SESSION Wednesday, June 29, 1982 President McKeever called the meeting to order at 9:30 a.m. in Salon A of the Marriott's Mark. New business included a report of the Auditing Committee and it was moved by Chairman Paul Hronich, seconded and carried that the Financial Report as prepared by the Treasurer, Mrs. Augusta Whiteside, be approved as submitted. The report of the Resolutions Committee was presented by Chairman Ed Ziolkowski who moved that certain resolutions be approved. The motion was seconded, carried and the resolutions follow: 1. RESOLVED, WHEREAS, in the year since the last convention of The Rocky Mountain Coal Mining Institute, the Institute and the coal industry have suffered the loss, through death, of the services of: John Chrystal Richard R. Fenner G. D. Grayer Albert M. Keenan C. E. Osborn Stanley C. Shubart George Sumers Cal Witmer NOW THEREFORE, BE IT RESOLVED, that there be recorded in the minutes of The Rocky Mountain Coal Mining Institute recognition of the passing of these members, who have so greatly contributed to the advancement of the industry, both nationally and in the Rocky Mountain area, and that a copy of this resolution be sent to the next of kin as evidence of the sincere and deep regard and sympathy of the members of the Institute. 2. RESOLVED, that in recognition of the faithful service to the coal industry generally, and to this Institute in particular, the status of Life Membership in The Rocky Mountain Coal Mining Institute be hereby conferred upon these members: John T. At 5:30 p.m. a social hour was held for all RMCMI registrants on the lawn area south of the Gondola Lift House. This was followed by a western steak fry and dancing to the country western band, "The Cat's Night Out". MORNING SESSION Tuesday, June 29,1982 RMCMI golfers came out in force for a shot-gun start of the Championship Golf Tournament at Vail Municipal Golf Course which began its first session at 7:30 a.m. followed by a second at 1:15 p.m. The tournament was headed by William Carpender, chairman and his committee members Gary Bennewitz, Jr. and Gene Christmann. RMCMI members were treated to early morning rolls and coffee in the Conference Center preceding a showing of the RMCMI slide/tape program on enhancing the image of coal mining, by telling the story of the Institute. Following this, the meeting was called to order by President McKeever at 8:30 a.m. when he introduced Mr. Carl Terzian who presented a workshop entitled "Sure You Have an Image - But What Kind?". MR. McKEEVER: Good morning Carl. I see you're ready to address this bright and busy tail audience. One of the things that I really want to point out this morning and I knew we would have a second chance with Carl Terzian but Carl is someone that will leave a good lasting impression on you and what he will hopefully be talking about, as I remember, is that what he's saying here can be used personally, or for company, or for the Institute, or anything else on image. Carl is Chairman of the Board of Carl Terzian Associates. He is a prominent author, lecturer and consultant. He is headquartered in Los Angeles and he's nationally known: governmental affairs, man¬agerial development and executive speech training and has served nearly four hundred clients since 1969. Each year he travels nearly 300,000 miles to address conventions, conferences and sales and management meetings as a motivational speaker. Carl has been speaking professionally for more than twenty-five years. He was graduate magna cum laude 1957 from the University of Southern California where he was elected Phi Beta Kappa and student body president. He later served as State Department goodwill ambassador for President Eisenhower; public relations director for Lutheran Hospital Society of Southern California; dean and professor of political science and speech at Woodbury University and public affairs director for architect Charles Luckman. He has been honored for his civic and philanthropic and professional accomplishments by the Congress and State Department, California Assembly and Senate, City and County of Los Angeles, Her Majesty the Queen of England, and six times by the Freedom Foundation of Valley Forge.
