Environmental rehabilitation has increasingly become a central concern in the regulatory and fiscal landscape governing South African mining operations. A key issue within this domain is the extent to which mining entities may claim tax deductions for expenditures incurred in fulfilling their environmental rehabilitation obligations. The Supreme Court of Appeal's decision in Sishen Iron Ore Company (Pty) Ltd v Commissioner for the South African Revenue Service [2025] ZASCA 16 addresses pivotal questions regarding the tax treatment of such expenditures. The judgment offers authoritative clarification on the interpretation of the Income Tax Act 58 of 1962—specifically sections 11(a), 11(c), and 36(11)(e)—as they pertain to mining activities and the environmental responsibilities imposed under the Mineral and Petroleum Resources Development Act 28 of 2002. This commentary critically examines the multifaceted implications of the Sishen ruling, highlighting the intersection of statutory interpretation, operational realities, and environmental accountability within South Africa’s mining sector.

The paper will attempt to identify the threats, however obscure, that could confront the South African platinum industry. South Africa has the largest reserves of platinum group metals in the world, and is the largest producer of those metals. This situation is no different from that which existed in the gold sector fifty years ago. Since then South Africa?s share of world gold production has dwindled, and the gold mining industry has lost its dominance. Unlike gold, platinum has widespread use as an industrial commodity. Its investment value is a minor portion of its total value. It is therefore subject to different market forces. The sheer magnitude of the industry in South Africa obscures the fact that it is a wasting industry, and that South Africa exports almost all its production as a refined metal in the form of autocatalyst. Since Hotelling published his seminal work The economics of non-renewable resource in 1931,the science of mineral economics has developed exponentially. The paper will present a background of mineral economic theory and compare to this the development of the South African platinum industry. Of particular concern to a mineral exporting country is the question of mineral rent?its definition and employment. This will be the mail theme of the paper.

The world is rapidly becoming more ?green? i.e. energy conscious. Since mining and mineral processing are massive energy users, the mining industry is seeking ways to reduce its energy footprint. In mining and mineral processing operations, energy is often the most expensive cost item. Comminution, i.e. grinding, is frequently the most energy-intensive step between mine and metal. High pressure grinding rolls (HPGR) are being installed in a rapidly growing number of ?hard rock? mineral processing operations. In the energy conscious cement industry, HPGR grinding has been standard practice for decades. HPGR is known to be energy-efficient; the question is how energy efficient? How can the energy efficiency of HPGR be enhanced? This paper reviews recent HPGR applications for the processing particularly of copper, gold, platinum, PGM-Ni-Cu and iron ores. HPGR technology is discussed with respect to energy efficiency. The harder the ore the greater the energy savings are likely to be. Typical energy savings of 10?20% can be expected when installing HPGR vs. a SAG mill. Wipf(2005) showed why conventional Bond Work index tests on HPGR product is likely to under-estimate the energy savings that can be achieved by installing HPGR. Energy efficiency of HPGR is, however, ore-specific. The biggest energy savings of HPGR tested thus far is 9.5 kWh/tonne claimed for Vista Gold?s Mt. Todd gold ore from Western Australia, a savings of over one-third of conventional SABC comminution energy. Several commercial scale iron-ore pellet feed plants install HPGR for fine-grinding of concentrate to increase the surface area of pellet feed in a manner that reduces overall energy consumption. Energy-consumption in comminution is, however, only part of the energy savings benefit story. HPGR typically also reduces the amount of steel lost through wear of mill liners and media. Marsden(2008) showed that when the energy that would have been consumed to produce the steel that is saved by applying HPGR is factored in, then the overall energy savings of HPGR is considerably greater. Johnson et al.(1988, 2005) tested HPGR in a flowsheet in which energy savings of around 50% can be expected if HPGR product screen oversize is recirculated to the HPGR. Innovative flowsheets have been proposed by Rule et al.(2008) and by Morley (2008) which are expected to result in significantly increased energy savings. HPGR applied in flowsheets in conjunction with coarse ore separation devices, e.g. ore sorting or DMS to remove barren waste from HPGR feed promises significantly greater energy efficiencies. Fine-grinding and ultra-fine grinding of ore or concentrates in conventional ball mills results in energy consumptions that increase exponentially with product fineness. Wipf (2009) presented a flowsheet in which he proposed the installation of HPGR ahead of the Aerosion ?Disintegrator? for ultra-fine grinding of ores and/or concentrates. This dry grinding arrangement is expected to achieve ap80 = 7 µm using up to 100 kWh/t less energy than could be achieved by wet ball milling. Using conventional comminution, an ore might require grinding to p80 = 45µm (? 325 mesh), for example, to liberate the valuable components, e.g. magnetite, from gangue, e.g. silica. Inter-particle comminution in HPGR may break some ores along grain boundaries thereby liberating valuable minerals from gangue at a much coarser particle sizes. Early magnetic separation rejection of silica gangue liberated from magnetite by HPGR at coarser grain sizes could further reduce downstream comminution energy consumption.

In recent years there has been an increased focus on corporate governance matters worldwide. The duties and responsibilities of directors of companies have come under close scrutiny, with shareholders increasing their demands for greater responsibility and accountability. Media attention and pressure groups have also had their effect. Governmental actions have supported these demands and directors have witnessed sweeping legislative changes imposing more onerous duties and liabilities than formerly imposed upon them at common law and in terms of the Companies Act. At the same time, the power of regulatory bodies has been increased to enforce this legislation and make someone pay to remedy an alleged infringement. Breach of such duties may incur personal or criminal liability, or both. Environmental protection legislation has become a particularly prevalent feature in this regard, and the number and complexity of statutes concerning the environment have increased over the past few years. Directors of South African companies will be familiar with relevant acts such as the National Environmental Management Act 107 of 1998; Conservation of Agricultural Resources Act 43 of 1983;Hazardous Substances Act 15 of 1973, as well as the National Water Act 36 of 1998. Now the directors of mining companies are faced with the Mineral and Petroleum Resources Development Act 28 of 2002.

Mineral Resource Throughput Management is based on the extraction of the maximum potential value from an ore reserve with the emphasis to generate maximum ROI and ROR (return on reserve). A steel producing company in India implemented MRTM to significantly improve their ROI and ROR. The value chain of this company consists of their own iron ore and coal mines, ore washing plants, sinter plants, steel plants, and sales and marketing division. The target for the mines was to produce at a stable and predictable rate and at specific quality requirements. These requirements were set to improve productivity and ROI of the steel plant. The implementation constituted the alignment of the reserve potential, total production chain, human resources and management culture at the mines with the requirements of the steel plant. Many typical mining practices were challenged and changed. Production targets regarding lump vs. fines ratio, consistent product tons, quality targets such as Fe, Al content and moist, and standard deviation on the quality targets were not achieved. A reverse distribution model with release mechanisms to satisfy the demand were developed and implemented at the mines. A stable and predictable flow of mine product with quality standards well within the required standard deviation targets were achieved. The contribution from the mines to significantly improve the Net Profit, ROI and ROR of the company were reached.

Spain is a major producer of dimension stone, which is one of the most important industrial sectors in the northwest of Spain. This justifies the maintenance of these industries, although the technical and environmental requirements for their continuity are increasingly demanding. The main target of this paper is to present a new methodology in order to obtain k-ratio stress values on the basis of flat jack measurements and finite element numerical back- analysis with Rocscience© RS2 software. Continuous iterations were performed to try to find a relationship between the k₀ and the measured stress in the tunnel roof and sidewalls. It focuses on technical aspects of the method for designing mine chambers in the slate industry that were previously mined by open pit methods. The size of the chambers impacts the operating cost, and the dimensioning of a correct support ensures better efficiency and safety. Correct knowledge of the k₀ therefore is critical for the design of the support. The proposed new method entails a simplification of the classical procedure for estimating the k-ratio.

"Rio Tinto’s Western Australian expansion, combined with mining within structurally complex geology and increasingly below the water table, presents challenges in effective slope management to ensure safe and economic mining.The Geotechnical Management System (GMS) was developed by Rio Tinto Iron Ore (RTIO) to manage geotechnical risks identified during the design process and implementation, and to ensure feedback based on the ‘as-found’ conditions. The GMS utilizes a risk-based approach to geotechnical risk management and is centred on the geotechnical risk and hazard assessment management system (GRAHAMS). GRAHAMS is used to assess pre- and post-control risk for future potential risks (planned slopes), current risks (as-built slopes), and actual geotechnical hazards (realized risks) identified in the pit. This serves as a core operational risk management tool in identifying and prioritizing key risk sectors and management of critical controls. The system’s database reporting functionality supports effective communication of operational risks to operational personnel, as well as reporting the risk profile across operations to management.A rigorous engagement process between design engineers and sitebased engineers is implemented to ensure that key design assumptions, limitations, risks, and opportunities are understood by the site teams. This information, together with mine plan schedule details, is used to assess the design risk and develop appropriate controls. These controls typically include slope performance monitoring and slope reconciliation. The design feedback loop is closed through sharing of key slope performance and reconciliation data with the design teams.The GMS has been successfully implemented in RTIO pits and is fundamental to successful geotechnical slope management. Improved characterization of design assumptions has allowed for re-assessment of the pit design and improved hazard management in high-risk pits. The GMS, GRAHAMS, and other processes reduce the incidence of unexpected slope instability. Improved understanding of rock mass conditions has allowed for economic optimization through redesign of slopes, allowing for an improved understanding of risk and fewer unexpected conditions (surprises), hence an increased realized value."

Worker participation in equipment development can result in improved user acceptance and product quality. This paper focuses on worker engagement in equipment development processes in the South African minerals sector. Qualitative data was gathered during interviews with original equipment manufacturers (OEMs) and industry experts. A lack of inclusion in equipment design from workers from all organizational levels in mines was reported. Meanwhile, the historical context and workplace culture of the mining industry (including leadership, trust, training, performance, and remuneration factors) were evident barriers to the implementation of new technology. Worker engagement processes should include securing management commitment, creating multidisciplinary teams, effective facilitation, shared understanding of needs, training and development, and iterative design. Human-centred design approaches and independent platforms for engagement on equipment design requirements are recommended.

The objective of this paper is to describe the research followed in creating a generalized, readiness assessment tool for mining projects. We start by highlighting the need for the assessment tool and then progress towards explaining the methodology followed during the study. The selection and finalization of the list of elements, sections, and categories that make up the unweighted values are described, followed by a summary of the weighting process applied. The outcome of this process is a weighted readiness assessment tool for mining project studies. The main benefits of the tool are that it will guide decision-makers and project managers through the definition phases of the project and improve the likelihood of project success.

In dealing with transformational aspects, the South African Constitution aspires for a balance between attempts to broadly represent the country’s demographics in the way in which organizations are structured and the need to maintain the necessary skills to ensure continual retention of skills for optimum and efficient organizational performance. Through the Mining Charter, government aimed to redress gender and racial imbalances in the mining industry as part of transforming the demographic representation of mining companies to include black people, women, and people living with disabilities in all job levels up to top management. While the Constitution calls for an appropriate balance between demographic representation and competency, this aspiration for mining poses challenges for companies due to the proficient and competent skills needed in this industry. To this end, the South African mining industry has been subjected to substantial criticism from government regarding the slow progress of transformation. The mining industry justifies its slow pace of transformation by pointing at inconsistent, varying legislation and definitions governing transformation, limited skills available from historically disadvantaged groups, and cautioning not to compromise the sustainability of mining companies by marginalizing white males and white youth with the objective of addressing racial imbalances. This lack of understanding between industry and the government has led to considerable confusion regarding the accountability of stakeholders in transforming the industry. This article presents the perspectives of ten mining executives on transformation in the South African mining industry. The theoretical description of transformation, as well as other mining stakeholders’ interpretations of transformation. is presented. Qualitative data from interviews with mining executives demonstrates their understanding of transformation through rich descriptions, interpretations, and implications in their contexts. The findings demonstrate that transformation in the mining industry is not simply about race and gender, but about cultural change, a change in mind-sets, embracing diversity, equalizing rights and opportunities, and attaining social justice. Moreover, transformation is clearly a gradual process. The article concludes with a recommendation for the definition of transformation to be corroborated with the views of mining executives and that of the Constitution of South Africa. This will create an overarching, simplified definition of transformation that can be accepted and interpreted by all stakeholders.

This paper presents results of a feasibility study of recycling manganese furnace dust generated in production of ferromanganese and silicomanganese at Tasmanian Electrometallurgical Company, Australia. Dried manganese furnace dust contains about 20 wt% of carbon, in average 33.4 wt% of manganese and 1.3 wt% of zinc. Manganese in the dust is in the form of MnO, Mn3O4 and MnCO3; zinc is mainly in the form of ZnO andZnSO4. Analysis of the zinc balance with dust recycling showed that to keep zinc intake at the acceptable level, it should be partly removed from the dust. In the reduction laboratory experiments, zinc oxide was reduced to zinc vapour by tar of the dust. Reduction of zinc oxide started at 800°C and zinc removal rate increased with increasing temperature; removal of zinc was close to completion at 1100oC. Optimal conditions for removing zinc from the dust include temperature in the range 1000-1150°C, inert gas atmosphere and furnace dust fraction in the furnace dust-manganese ore mixture above 60%. In the sintering of manganese ore with addition of manganese dust in the sintering pot, zinc was reoxidised and deposited in the sinter bed. Removal of zinc in the sintering pot tests was in the range 4-17%. Up to 30% zinc removal was achieved from the bottom layer of the sinter bed. It can be concluded that zinc removal will be low during the processing of manganese furnace dust in the sinter plant. The zinc removal rate will be the highest when pelletised manganese furnace dust is added to the bottom layer of the sintering bed.

Determining the efficiency of a surface coal mine operation is an essential activity, which can help in deciding on the optimal use of input resources, including effective capital allocation, in generating a desired quantity of coal of a specific quality. Mines operate today in challenging conditions, with diminishing reserves of high-quality coal, remote location of new coal deposits, infrastructure problems, environmental legislation, and the effects of climate. All these have an impact on the performance of a mine. Given such challenges, a company has to be technically efficient compared to other existing coal producers in order to generate profits. It can use the measurement of its efficiency to evaluate its productivity, benchmarking this against the best-performing mines and determining optimal variables in order to minimize slack and achieve the desired outputs. This paper discusses the use of Data Envelopment Analysis (DEA) in evaluating the efficiency of a surface coal mine supply chain for the coal export market. The supply chain is considered to be composed of subprocesses that are modelled as a multistage system. Numeric examples will be used to illustrate the application of DEA.

Crushing plant managers need to assess, manage, and communicate the environmental impact induced by their crushing plant operations as a step towards the sustainable development of the company. However, performing reliable environmental impact calculations of crushing plants can be challenging when the availability of operational and emission data is low, and when the company’s environmental expertise is not adapted and connected to plant operations (or does not currently exist). To address these challenges, this paper proposes a practical approach where the lifecycle assessment methodology (LCA) is combined with process simulations in a web-based tool. To describe what functionality such a tool should have to be incorporated into a company’s workflow, the system that surrounds a crushing plant is analysed. Further, a case study with a three-stage crushing plant is introduced to showcase how the simulated power draw results produced with the beta version of the tool can be compared to measured sensor data from the crushing plant for one operational day. The results indicate that the simulation tool can provide an adequate estimation of the specific energy for the different material fractions and give an overview of the environmental impact of the process caused by electricity and explosives consumption. Plant managers and operators can use this tool to calculate the environmental impacts of their plant and simulate how different operational strategies influence them. "Mining companies globally are currently facing severe economic and financial challenges. In addition to global challenges, the South African mining industry has to face other operational challenges that are unique to the country and which threaten the survival and competitiveness of the industry. Profit margins are being squeezed by rising costs and decreasing commodity prices, while labour productivity is greatly affected by intermittent labour unrest. This paper analyses how the South African gold mining industry has performed pre-, during, and post the global financial crisis of 2008. The competitiveness of the industry in terms of labour productivity and industry cost curve position is analysed for the period 2006–2013 to assess the impacts of both the global financial crisis and labour unrest. An analysis of the South African gold mining industry is presented at company as well as mine level. Productivity measure in this paper is limited to labour productivity, in line with limited reporting on productivity. All the data analysed was obtained from the public domain. IntroductionSouth Africa dominated the world as the number one gold producer until 2009 when China took that position, and today South Africa ranks fifth after China, Australia, Russia, and the USA. According to Statistics South Africa (2009), South Africa still had about 30 years of production in the gold sector, a forecast that fluctuates based on the day’s modifying factors. Although South Africa has a comparative advantage in terms of minerals endowment, there are challenges faced by the mining industry that hinder translation of the comparative advantage into a competitive advantage. The industry continually seeks to address these challenges to remain competitive in global markets while addressing national and community needs.Neingo and Cawood (2014) argued that stakeholders in mining are continually concerned with mine management’s ability to translate use inputs effectively into quality outputs. They further suggested close monitoring of effective utilization of people, materials, and money to obtain maximum production of commodities under given conditions. Productivity is measured in various ways, including unit cost, output per employee, and output per unit capital equipment"

The risk associated with mining induced seismicity is one of the major threats to the safety and sustainability of deep underground mines. This paper describes techniques that allow site practitioners to efficiently control such risks in mines. The proposed approaches rely on ground support to strategically control seismic risk and re-entry time to tactically control this risk. The strategic approach is based on the detailed understanding of past seismicity to as certain the seismic hazard of individual sources throughout the mine. This approach also relies on assessing the potential damage that these sources can induce on nearby excavations using the excavation vulnerability potential (EVP) and rockburst damage potential (RDP) concepts proposed by Heal et al. (2006). It is then possible to investigate how to reduce the risk of experiencing damaging seismicity in mine drives by locally enhancing the ground support system. The tactical approach relies on a proposed methodology to estimate reliable re-entry times or exclusion periods based on the seismic decay following blasting. Some examples of how these techniques have been applied in Australian mines are given.

Potholes on the Merensky and UG2 reefs in the Bushveld Complex occur as near-circular to elliptical depressions or slumps on the reef horizon, normally presenting as severe disruptions which prevent economic extraction. Within the pothole, the reef and other strata may either be attenuated, absent, or highly deformed, this being the result of the overlying hangingwall strata having slumped down. The hypotheses for pothole formation involve several mechanisms, including downward erosion, upward fluid movement, or synmagmatic deformation. When potholes are exposed in mine workings, significant fracturing is often observed. This fracturing is particularly evident in anorthosite rock types. Stress measurements were conducted in a pothole on the Merensky Reef to determine if the fracturing was due to high stress conditions. The paper describes the measurement results and numerical modelling that was done to determine the influence of depth and mining on the stress condition at the site. The results show that high stresses do exist in at least some potholes, and that current formation theories do not adequately explain the measured stresses. In support of understanding the high local stress associated with the pothole, the study explored several rock engineering modelling processes to validate the conditions of the study site and enclosing excavations. A better understanding of the stress conditions in potholes with additional data could lead to more appropriate support design and avoidance of potential rockbursts in these structures.

Zimbabwe hosts a varied array of coloured gemstones. With the exception of emerald deposits and several world-class pegmatites, few of the gemstone occurrences have received detailed attention from the scientific or mineral exploration communities. In the present contribution we summarize the status of knowledge of the gemstone deposits and occurrences in Zimbabwe, paying particular attention to the geological settings in which they were formed. Synthesis of this regional geological approach reveals that there may be significant exploration potential for further gemstone occurrences, particularly in the extensive pegmatite fields and in Al-enriched orogenic belts that have undergone greenschist to granulite facies metamorphism. Further socio-economic and developmental initiatives will aid in optimizing the value generation from this important sub-sector.

The processing of heavy mineral concentrates can be enhanced by the use of power ultrasound to clean their surfaces of oxidation products and fine coatings, mainly through the large, but very localized forces, produced by cavitation. Results are presented of the application of power ultrasound to remove coatings from the surfaces of mineral sand concentrates in order to improve the sharpness of their high-tension separation and, in some cases, the quality of the low iron components such as zircon. Improvements of 10–15% in recovery and up to 20% in grade compared to unsonicated material were achieved in a single stage laboratory high-tension separation. Cavitation also ensures that a fresh, clean surface is presented to leachants during the leaching of suspended solids. At the same time, the effect of cavitation and the shearing effect of the sound wave passing over the solids ensure that the saturated boundary layer is kept to a minimum if not completely removed. This application of power ultrasound helps to speed up leaching processes as applied to the removal of excess alumino-silicate contaminants in some ilmenite. The Great Dyke of Zimbabwe constitutes the world&apos;s second largest reserve of platinum group elements (PGE) after the Bushveld Complex in neighbouring South Africa. Within the Great Dyke, economic concentrations of PGE are restricted to sulphide disseminations of the Main Sulphide Zone (MSZ), which are currently mined at the Ngezi, Unki, and Mimosa mines. Near-surface oxidized MSZ ores have a large potential. Their total resources are in the range of 160-250 Mt; however, all previous attempts to extract the PGE from this ore type have proved uneconomic due to low PGE recoveries (<< 50 per cent) achieved by conventional metallurgical methods. Within the ores of pristine, sulphide-bearing MSZ, the PGE are bimodally distributed. Platinum occurs mainly in the form of discrete platinum group mineral (PGM) grains (mainly bismuthotellurides, sulphides, and arsenides), whereas approximately 80 per cent of the Pd (and some Rh) is hosted in pentlandite. Within the oxidized MSZ ores, the PGE are polymodally distributed. Whereas the arsenide- and sulphide-PGMs that make up approximately 25 per cent of the original Pt content of the ore largely remain stable (relict PGMs), the remaining PGMs are disintegrated. The base metal sulphides are destroyed, partly releasing their base metal and PGE contents, and are replaced by iron oxides or hydroxides. Unspecified amounts of the PGE are redistributed and either form secondary PGMs, are found in chemically and mineralogically ill-defined (Pt/Pd) -oxides or hydroxides, or in iron-hydroxides, Mn-Co-hydroxides, and in secondary silicates. The problematic processing of oxidized MSZ ores is attributable to their complex nature and polymodal distribution of the PGE, prohibiting a significant upgrading of the ores by conventional metallurgical methods. Therefore, only bulk leaching methods are viable for ore treatment, and novel metallurgical methods have to be developed for the processing of these ores. Our ongoing work aims at locating the PGE in their mineralogical form in order to understand the mineralogical balance of the PGE in the ores and thereby facilitate the evaluation of metallurgical options for their recovery. A short overview on options and recent advances regarding the recovery of the PGE from oxidized ores is given.
