"Impact and Benefit Agreements (IBAs) are intended to be a negotiated agreement between an industrial proponent and a community, local or regional citizens’ organization. Although the elements have grown over the past two decades from a simple agreement to exceedingly complex legal frameworks, the intention remains the same: to outline the roles and responsibilities of the two stakeholders and the natural resource development on their lands beyond environmental assessment. These agreements were born out of comprehensive indigenous land claims and have become the cornerstone of community engagement today in most indigenous nations. In the case of mixed communities, those that have beneficiaries of land claims and those who are not, social acceptance remains uneven and reflective of an unequal distribution of decision-making power (political ecology). This Differential Social License can cause conflict and a breakdown of the societal fabric that binds communities of diverse populations, resulting in inequality, fictitious wealth generation and failure of infrastructure. This paper presents a case study of how the development of Differential Social License developed in the Hamlet of Cambridge Bay, Nunavut as a result of an IBA negotiated between Tahera Diamond Corp. and the Kitikmeot Inuit Organisation in 2004 for the Jericho Diamond Mine.Introduction / Background Social license (social license to operate or SLO) has become an essential part of the social governance ‘toolkit’ demanded by mining stakeholders in today’s world. Stakeholders are now insistent that companies operate more closely under the tenets of sustainable development and provide for an increased level of community participation. Social license is not simply a matter of communicating with a community, to earn its consent for or acceptance of a project. It requires that we engage with the individuals and organisations who ally themselves with communities, or who sometimes side with dissident factions of a community. SLO is a process associated with and informed by political ecology or the recognition that unequal decision-making power exists amongst stakeholders."

The past three years have been the most difficult period in the modem history of the barge line industry. Having withstood the fuel cost run ups of the late 1970s and the imposition of inland waterways system user fees, the industry has struggled more recently with an overcapacity problem of unprecedented proportions. In responding to these challenges, the industry is undergoing important long-term structural changes, with the various individual barge lines pursuing an array of divergent long-term business strategies. This paper discusses these strategies in terms of their probable impact on the industry as a whole, and argues for the survival of a competitive number of large, national, independent barge lines as the outcome most in keeping with the long-term interests of the mining and minerals industry.

I. INTRODUCTION Lawyers are a cautious breed; and it might be expected that a paper concerning a broad and complex area of legal regulation, prepared by lawyers for presentation to a predominantly non-legal audience, would commence with several caveats. Ours are the following: First, we have written a broad (and, in some instances, simplified) overview of the regulatory system and of some of the more important requirements generally applicable to uranium mine and mill wastes in the United States. Our paper is not a legal opinion setting forth all of the governmental requirements that would have to be met by any particular mine or mill. Similarly, we do not imply that the requirements we mention are necessarily applicable to each and every mine and mill in the country; depending on the facts, some of the requirements may be inapplicable or avoidable through exemption or variance proceedings. Compliance decisions and strategies for particular facilities must be considered on a site-specific basis. Second, we have undertaken merely to describe the regulatory framework and some of the generally "applicable" requirements which have been promulgated and proposed by administrative agencies. We express no opinion on whether, under the U.S. Constitution and statutes, the existing and proposed agency regulations are valid in general or as applied to any particular mining or milling operation. There are, of course, procedures for judicial review of agency action; and newly promulgated environmental regulations have frequently been challenged, with varying degrees of success, before the courts. For us even to begin to consider such issues would expand an already forbiddingly long paper to totally unmanageable proportions. Third, in light of the subject of this Conference we have limited our paper to the legal framework and requirements applicable to uranium mine and mill "wastes" -- primarily mine overburden and waste rock and mill tailings (including waste tailings solution). We treat operating discharges (e.g., emissions from yellowcake drying) only peripherally. Fourth and finally, it is important to note that this paper, at least in so far as it concerns the specific requirements of particular regulations, will likely soon be out of date in some important respects. INTRODUCTION Froth flotation is the most widely used and economic means of concentrating metal sulfide ores such as those containing copper, lead, zinc, nickel, molybdenum, and pyrite. Also recoverable are other metal species that are often associated with sulfide ores, such as cobalt, platinum, gold, silver, etc. Flotation of metal sulfide ores has been successfully practiced at the industrial scale for more than 50 years. It is the relative technical/economic ease of floating metal sulfide minerals that has been a major driving force behind the rapid expansion in the supply/demand of metals over this 50 year period. It is estimated that 1.6 billion tons of feed sulfide ores are processed each year in the free world based on the froth flotation process, Klimpel (1987) and the manufacture/use of associated chemical reagents is a major portion of the 1.5 billion dollars (U.S.) free world mining chemicals business, Klimpel (1988b). The use of froth flotation appears to be increasing partially due to the ever decreasing feed grades and liberation sizes of the feed minerals. Froth flotation has shown itself to be a flexible process that lends itself well to many solid/solid separations. Thus, with surprisingly little equipment modification, separations can involve very different particle sizes and densities, and relative weight ratios of materials to be separated. In addition, the flotation process is economic, especially when compared to size reduction, its associated precursor process. Flotation also lends itself to continuous operations with a variety of equipment configurations. Such operations exhibit an ability to vary feed rate of solid to the process by as much as 50% without a total collapse of separating efficiency. In addition, the widely used mechanical flotation cell is scalable from 2.8 to 57 or 85 m3 (100 to 2000 or 3000 cu ft) with surprising ease relative to other unit engineering operations over the same relative size increase. The separating medium used is water. Most of the chemicals required -- pH regulators, frothers, collectors, activators, and depressants -- are all relatively inexpensive and common. They are not usually used in large quantities. While there has been a tendency for the quality of metal sulfide ores in any one geographic location to deteriorate over time due to mining intensity, the overall global supply of sulfide minerals is still very ample. Thus, the physical supply side of sulfide ore concentrates has not been under strong technology improvement pressure with increasing metal demands. Part of this is due to the ability of capital to consistently move to new geographic sources having suitable-grade sulfide ores. In these moves, the actual froth flotation technology used (including collector chemicals) has had to change little. As an illustration of this trend, of the approximately 80,000 metric tons of thio collectors used commercially (1980) in the free world, almost 987 were known and manufactured in some form 25 years ago. This is clearly not typical of reagent development in other process-related industries. In addition, the industrial-scale practice of froth flotation applied to sulfide ores has proceeded since the 1920's with often little direct (predictive) scientific explanation due to the extreme complexity of the flotation process. Empirical testing has been a mainstay of industrial flotation reagent development and use. Even today there is often strong disagreement between researchers as to the mechanisms of chemical flotation practices that have been performed successfully on an industrial scale for many years. Thus the industrial process of froth flotation, especially as applied to the recovery of sulfide minerals, poses a dilemma: such a process is widely used, economic, versatile, forgiving, etc. and yet is still not very well understood in a mechanistic sense leading to prediction of results from fundamentals even after 50 years of usage. The Bureau of Mines analyzed coal mine blasting accident data obtained from the Mine Safety and Health Administration (MSHA), U.S. Department of Labor. The data were examined to determine the causes, frequency, and severity of accidents in an effort to point out the most dangerous aspects of coal mine blasting. Accident data for the 14 years from 1971 through 1984 show that there has been a total of 43 fatal and 926 nonfatal blasting accident victims in surface and under- ground coal mining. This is an average of 3.1 fatal and 66.1 non- fatal injuries each year. Underground coal mining accounted for 60.5% of the fatal and 78.7% of the nonfatal accidents involving explosives and breaking agents in coal mining. In addition, since 1970 there have been 53 fatal and 20 nonfatal injuries that occurred when explosives were the ignition source for dust and/or methane explosions in underground mines. Abstracts from 297 accidents that occurred from 1978 through 1984 were also examined to determine accident causes. Most accidents occur during scheduled blasting, and failure of the blast area security system is the leading cause. Blast area security problems in surface mining are failure to clear the blast zone, failure of personnel to follow instructions, inadequate guarding, and failure to retreat to a safe location and/or take adequate cover. Other common causes in surface mining include premature blasts, excessive flyrock, and misfires. In addition to the above causes, accidents in underground coal mining can be due to rockfalls triggered by the blast, unexpected breakthroughs, fumes, and incidents associated with Airdox-type systems.

During the past decade, researchers at Virginia Polytechnic Institute and State University have worked to develop a novel flotation process for treating very fine particles. This process, which is now commonly known as [microbubble column flotation] (MCF), has been shown to be very effective in a number of applications related to fine coal processing. These applications include the retrofit of existing preparation plant circuits and the recovery of additional coal fines from refuse streams. In addition, work conducted under the sponsorship of the United States Department of Energy indicates that the MCF process is capable of producing superclean and ultraclean coals from many eastern U.S. coals. This paper describes some of the basic problems associated with fine particle flotation and the design and operational features of the MCF process used to minimize these problems. Also presented are the results of ongoing pilot- and field-testing programs.

The McLaughlin Mine is a world class epithermal gold deposit located in the coastal thrust fault of Northern California, U.S.A. Homestake adopted a proactive strategy in the permitting of the Mine. Extensive environmental baseline studies were undertaken. Engineering and process alternatives were evaluated for environmental impact along with other factors. A unique pressure oxidation process was selected. Screening studies were conducted as a basis for the selection of waste rock and tailings disposal sites. Project engineering and permitting were fast tracked. Construction required eighteen months, and the first gold bar was poured in March of 1985, six years after the initial discovery. Project facilities are designed and operated so as to minimize environmental impacts. A comprehensive monitoring program demonstrates permit compliance. Reclamation of the site is ongoing throughout the Mine's twenty year life. Nonmined lands are managed to maximize wildlife habitat value.

Performance assessments are carried out to monitor operations, to evaluate performance and to identify processing problems. The assessment involves collecting and analyzing representative samples from critical points in a flowsheet and interpreting the data. Sample analysis techniques include chemical analyses, mineralogical investigations, mineralogical analyses, and materials balancing. Chemical analyses provide the lowest cost assessment and should be used liberally, particularly in monitoring a process. Materials balances performed on chemical assays for a suite of samples are used as a first step in evaluating a process. Mineralogical investigations are more expensive than chemical analyses but need to be used only at the beginning of mining and metallurgical operations and as a second step in assessing processing problems. Quantitative mineralogical analyses combined with materials balancing provide the most complete performance assessment, but the procedure is expensive. On the other hand, the assessment has the potential of a large payback when carried out where warranted.

High value materials, such as gold, platinum and other precious metals are subject to loss through unauthorized removal from mines, smelters, refiners, and other places where such materials are processed. A study published in 20011 determined that between 1994 and 1998 an average of 603 kilograms of gold per year was stolen from South African miners and subsequently recovered. This does not include the gold that was stolen but not recovered. At 2011 prices, 603 kilograms of gold would be worth approximately $33 million. Mine security personnel believe that the unrecovered stolen gold far exceeds what is recovered2. Traditionally, metal detectors have been used to screen personnel leaving secure areas to discourage such unauthorized removal. However, with the current near-record prices of gold, platinum, and other precious metals, it has become worthwhile for people exiting a facility to walk out with quantities of product that are too small for ordinary metal detectors to register, resulting in substantial financial losses.

Many of you are familiar with the Washington Metro Project. However, inasmuch as some may not be, and others may want to refresh their memories regarding certain facets of the project, I will cite a few summary details about the rail transit system we are constructing. That summary will also give each of us a common point for departure as I develop the principal thoughts that I want to leave with you. The Washington Metropolitan Area Transit Authority (WMATA) is an interstate agency established by Compact between the District of Columbia, Maryland and Virginia and approved by the United States Congress. Currently, the Authority has approval to build and operate a 101-mile (162.5 km) regional rapid rail transit system as shown on Appendix A. Of that total, 38 miles (61.2 km) will be in D. C., 32 miles (51.5 km) in Maryland and 30 miles (48.3 km) in Virginia. (Mileage figures, because of rounding error, do not add to 101 miles.) Referring again to the 101-mile total, 48 miles (77.2 km) will be underground, 42 miles (67.6 km) on the surface and 10 miles (16.1 km) on aerial structures. Of the 48 miles (77.2 km) that are underground, 15 miles (24.1 km) are rock tunnel, 14 miles (22.5 km) are earth tunnel, 0.5 miles (0.8 km) 9.s sunken tube and 19 miles (30.6 inn) are cut-and-cover construction. The system will include 86 stations, with 51 of them underground. Referring again to the full 86 stations, 43 will be in D. C., 23 in Maryland and 20 in Virginia. We currently have 37 miles (59.5 km) of line and 41 stations in operations as shown on Appendix B. Also shown on Appendix B is another 16 mile (25.7 km) increment and 13 stations which have been substantially completed, but are not yet in service. Additionally,

In recent years, the bioleaching of sulfidic raw materials has been of great interest. However, the application of this biotechnology is now very limited for many different complex reasons. The mechanism of the chemical and electrochemical reactions taking part in the process is not well understood. The application of electrochemical techniques is useful in its elucidation. Among the common sulfides, galena has been studied very little with respect to its behavior during bioleaching. Therefore, the electrochemical evolution of massive electrodes of lead sulfide in the presence and absence of' a mixed culture of mesophilic microorganisms was investi¬gated by the application of potentiometry, anodic and ca¬thodic polarization and cyclic voltammetry. The agitation rate, the use of pH control and the composition of the nutrient mediums did not have any significant affects on the oxidation of galena. However, the temperature (25 'to 45 °C), the scan rate (4 to 100 mV/s) and the acid used to adjust the pH were significant variables that influenced sulfide oxidation. There¬fore, the peak (600 to 1,000 mV) corresponding to the oxida¬tion of sulfide ions from the mineral was only detected in the presence of a complexing anion of lead. In the presence of bacteria, the peaks corresponding to galena oxidation de¬creased and, at the same time, new peaks appeared both during the oxidation at -300 mV and during the reduction of the mineral surface at 150 and -300 mV. These signals were more important when the attack time increased. The rest potential of bioleached mineral increased with an increase in leaching time, which was related to the electrochemical transformation of the galena surface.

Heavy media processes have been used for cleaning +28 mesh coals for a number of years, Two applications, i.e., the vessels and the cyclones are widely used in the U. S. for this purpose. The basic reason for the popularity of these systems is their extremely high efficiencies for particle sizes above 28 mesh, However, application of heavy media technology to fine coals below 28 mesh, has been limited due to the following reasons: o Inability to make size separations effectively at sizes below 28 mesh o Necessity of feeding large quantitites of magnetite to the separators o Difficulty of recovering magnetite in the presence of large quantities of coal o High levels of coal contamination in the recovered media, leading to high circulating loads and ineffective control of media gravity

Service vehicles, often called support vehicles or auxiliary vehicles, are used in secondary functions to support production activities such as loading, drilling, and timbering. Probably the most common support vehicles are the personnel carriers used to move miners to and from work areas. Utility designs are used to transport supplies and various less mobile equipment. Specific application designs are used for special work such as explosives transportation and loading, equipment maintenance, and equipment lubrication. PERSONNEL CARRIERS Personnel carriers are available in a wide variety of sizes and configurations. Some are two-wheel drive, though most are four-wheel drive. Smaller versions carry at least two men and usually have sufficient capacity to carry a small payload of supplies or equip¬ment. The American Motor's 05 Jeep, equipped with an optional diesel engine, has been adapted successfully for this light duty. Larger personnel carriers with ca¬pacities of 12 to 20 or more men currently are available, as shown in Fig. 1. The designs often are customized to the operating characteristics of each mine. All meet the latest federal requirements for rollover protection, emergency brake systems, etc. UTILITY VEHICLES Utility vehicles are adaptable to numerous duties. Probably the most common are ordinary haulers with a flat bed or low-sided box. They are used for hauling supplies and equipment from one point to another. Some occasionally are used for towing and may pull one or more trailers. Fig. 2 shows a typical utility truck. SPECIAL-APPLICATION VEHICLES Special-application vehicles are possibly the most important of all support types since these vehicles di¬rectly support and maintain production equipment. Such vehicles are available in a wide variety of sizes, mechanical functions, and operating specifications. Most versions are four-wheel drive and articulated. Among the more common vehicles are explosive haulers and loaders, mechanic's trucks, lubrication trucks (Fig. 3), and special carriers. TYPICAL APPLICATIONS Development Utility haulers are essential in trackless operations to bring supplies to advancing headings. Some utility haulers may be dedicated to bringing in steel sets and may be equipped with boom lifts to unload heavy sup¬ports or even place them as required. A rockbolt hauler may have a boom-mounted operator's basket which can be used for bolt installation or inspection. Various mechanic's trucks and pipe trucks service the heading to keep power, air, water, and ventilation at the face and to keep face equipment at maximum utilization. Production Production operations require a variety of support equipment. Because of the larger crew size brought about by the addition of the production force, personnel carriers play a greater role. Correspondingly, steel¬support hauling equipment and bolting trucks usually see limited application. PRODUCTION UNITS Capacity Personnel carriers are available to carry almost any number of people desired. Likewise, other types of carriers or haulers can and are built to fit specific re¬quirements. Physical size, capacity, and operating char¬acteristics can be varied to fit any size of opening and operating condition. Generally, articulated models offer greater maneuverability than straight frame-axle steer designs. Most vehicles of this type are lower in power than production units, generally under 74.6 kW (100 hp). Operating performance still compares favorably to that of production equipment, i.e., the support vehicles can travel at equivalent speeds on the various mine gradients. Manpower Auxiliary vehicles should require only a single opera¬tor. Specific application vehicles may require more than one person. For example, ventilation trucks usually require a crew of two where pipe must be installed.

During the last ten years, Paques Inc. has been engaged in the development and installation of treatment systems to remove sulfur compounds from water and gaseous streams using biotechnological processes. Metal and sulfate can be removed from mine waters in two biological steps. In the first step, sulfate-reducing bacteria converts sulfate to hydrogen sulfide (H2S). The HS reacts with the dissolved metals to form insoluble metal sulfide precipitates. In the second step, sulfide-oxidizing bacteria convert excess H2S to elemental sulfur. The Budelco Zinc Refinery in The Netherlands installed a groundwater treatment system to remove metals and sulfate using the biological steps described above. The system has been operating since May 1992 and has been treating 5,000 m3/d (180 thousand cu ft/day). A pilot plant began operation in November 1995 at Kennecott's Bingham Canyon Utah copper mine to develop processes for metal and sulfate removal from groundwater and for the selective copper recovery from leach water. Introduction Gravity-based coal/mineral preparation plants must be operated to yield products of a quality satisfactory to existing markets. However, because of historic control problems, recovery is frequently sacrificed to achieve quality, resulting in losses of valuable product. Plant control has ranged from intuitive in-plant spot quality judgments made by various operators to gross methods involving such devices as density gauges, floats, grabsample on-the-spot sink/float tests, etc. Millions of tons of quality coal/minerals are lost to refuse each year, because of the historic lack of a continuous and dependable control system. The result is serious economic, as well as environmental, losses. While the economic losses are obvious, the less obvious environmental ones, in the case of coal, result from the misplacement of more ignitable quality fuel to refuse banks. Until recently, a control system capable of supplying a market-grade coal/mineral product, while continuously minimizing product losses to refuse, has been technologically unavailable. Coal/Mineral Washing Tracer System Performance Monitor (CMWTSPM) The first Coal/Mineral Washing Tracer System Performance Monitor (CMWTSPM) originated in the late 1970s as an innovative idea and ultimately resulted in Leonard Patent No. 4,345,994 issued on August 24, 1982. In a classic example of successful university basic research, the patent was followed by two US Department of Energy (DOE) merit awards for fundamental optimization research at the University of Kentucky, a number of publications, a successful applied research program (underwritten by SENTREX at Irvine, CA) and field tests at the Rochester and Pittsburgh Coal Company Keystone Mine near Indiana, PA. The system is now operational and is marketed by SENTREX as the SENTREX Performance Monitor. A diagram of the system is shown in Fig. 1. This system relies on metal detection as the basic tracing medium. Since it is capable of tracing particles as fine as 0.19-in., the system is ideal for coarse coal/ mineral cleaning processes. Basically, the CMWTSPM records the distribution of synthetic coal/mineral particles, of known size and specific gravity, between product and refuse output streams of coal/mineral washing, gravity-concentrating processes. For any given particle size, surface area and shape are constant. The particles are [ ] designed to find their way into the center of their respective inprocess specific gravity/size streamlines. The system will yield a complete partition curve to show the percentage of misplacement for any selected size/specific-gravity particle fraction, thereby providing a point-to-point insight into process failure. When used to evaluate operational processes, this full partition curve is far more diagnostic than the simplifying, derivative, single index number known as the Ep value. The Ep value is commonly used for convenience to represent symmetrical partition curves, but, if the actual partition curve is non-symmetrical, use of the Ep value can result in serious diagnostic error. While the Ep is useful in design and for rapid performance evaluation and process adjustment, the full partition curve is by far the more diagnostic. It will provide insight into the behavior of particulate flow, through non-symmetry, as a means to highlight potential systemic failures. Performance of the process is measured and improved by determining the extent of particle misplacement and by making timely adjustments to the unit to reduce the misplacement. Used in this manner, the CMWTSPM is not only a long needed processing control monitor, but it is also a very powerful diagnostic tool which, in the hands of skilled operators, has

The trend in the U.S. coal industry in recent years has been a continuous increase in the percentage of coal produced by surface mining methods. Though the predicted energy demands promise a good market for coal, growing legal and environmental issues make the exploitation of a coal deposit by surface methods a difficult and challenging task. Major emphasis has to be placed on the development of integrated mining and reclamation schemes which enhance the possibilities of post mining land uses. Since no major breakthroughs are foreseen in the near future in surface mining equipment, innovative applications of current equipment must be developed. Draglines have been and are expected to continue as the primary earthmovers in surface mining of coal. A dragline simulation model has been developed which has the capability to analyze various deployment schemes such as conventional side casting, advance benching, and extended benching. The mathematical aspects of the model, the input data, and the output results are discussed with reference to an application in an operating mine. The model can be used to select a suitable dragline for given geological and mining conditions and to study the effect of alternative mining layouts and spoiling plans on machine production.

On Nov. 4, 1981 A/S Sydvaranger's 1-kt/h (1,100-stph) wet-process, iron ore ball mill completed its first four months of uninterrupted, full-load operation in Kirkenes, Norway. This 6.5-m-diam (21-ft-diam) mill is driven by a gearless ring or wraparound 8.1-MW (10,860-hp) motor at 13.1 rpm-a first of a kind in this segment of industry. This article examines reasons for selecting this type of drive over more conventional schemes, lists specific advantages of such large mills, and describes the installation in Norway. History For almost a decade, good operating experiences have been gained with 28 gearless ring motor drives in the cement industry, driving 2.5 to 4-m-diam (8.2 to 13-ft-diam) tube mills with drive powers ranging from about 3-4 MW (4,000 - 8,000 hp). Why then did the mineral ore processing industry hesitate until 1980 to adopt this successful concept for similar applications on ball, semiautogenous, and autogenous mills? There are a number of good reasons in the eyes of conservative mill builders and operators, the most commonly cited ones are: • No operating experience in this segment of specialized industry. • More severe environmental conditions in the wet ore grinding process. • An indifferent attitude of mill builders and electric motor manufacturers towards new drive technologies. • Limited confidence in solid-state power supply systems, such as frequency converters of the required size. There have been and still are numerous problems associated with low-speed geared mill drives of any kind, especially with individual motor/gear sizes approaching or exceeding about 4 MW (5,360 hp). Every mill builder knows about them, but operators learn to accept them as inevitable. The Decision to Change Three things combined to break this technological stalemate: the courage and progressive spirit of one major iron ore processor in Scandinavia, the cooperation of three experienced manufacturers, and an unusual application problem that could not be solved by any conventional approach. The last factor was surely the decisive one, but the first one does not come as a surprise either. The Swedes near Kiruna and the Norwegians around Kirkenes are experienced ore miners and processors, and much credit goes to them for technological breakthroughs in the industry. At A/S Sydvaranger in Kirkenes, above the Polar circle at about the latitude of Alaska's northern tip, the existing grinding facilities, with a total of 14 100 to 240-t/h (110 to 264-stph) ball mills, can not be expanded. Nevertheless, to increase mill throughput, only installing a larger mill in place of an existing smaller one was a practical alternative. For this replacement, the owners set requirements that seemed impossible to meet: • The old 100-t/h (110-stph) ball mill should be replaced with a new ball mill with 10 times the rated throughput, without significantly impairing the operation of the remaining mills, and without significantly changing the mill building. • The new mill should have a variable-speed drive to ultimately optimize the grinding process by means of a closed-loop process¬computer-controlled grinding cycle, and to minimize the specific energy consumption. • Availability, efficiency, and life expectancy of all new components must be higher than those being replaced. • Inrush-current and harmonic loads on the rather weak electric supply line must be minimized to ensure safe plant operation. All old ball mills at A/S Sydvaranger are the geared type, using single synchronous and wound-rotor, slow-speed motors with ring-and-pinion gears. Operators are familiar with the limitations and problems associated with such drives, and they are aware that the following items become major concerns when drive powers are drastically increased: • Gears are subject to wear and tear, require frequent maintenance, and eventual replacement of major parts. • Gears are sensitive to misalignment, overload, and thermal distortion, limiting their useful life. • On dual or quadruple drives, load-sharing and torque oscillations between motors can be a major reason for concern. • At these speeds, ring-and-pinion gears reach their torque transmission capabilities altogether at around 4 MW (5,360 hp) per motor/pinion. To obtain the desired variable-speed performance of the new drive, the only practical and economical conventional solution would have been a frequency-controlled, low- or medium-speed dual motor drive with about 8 MW (10,720 hp) of power. This, however, was not feasible because of limited floor space. Therefore, bids were solicited for the alternative drive method, the gearless ring motor. General Considerations Why are such large mills considered? After all, one could avoid all the problems by simply staying with smaller mill unit sizes. Under competitive pressures of free markets, however, grinding efficiencies and specific energy consumption become key factors in selecting new equipment. Experts, like many of the speakers at the SME Annual Conference, are frequently called upon by lawyers to assist them in litigation. Due to the technical nature of many cases, the testimony of an expert with knowledge and experience in a particular field is necessary to help a judge or jury understand and decide certain issues. Environmental litigation is no exception. Experts routinely are called upon to offer testimony to establish the existence of contamination and its source, as well as the potential health and environmental risks associated with the contaminants. This article will briefly discuss the factors courts apply to determine whether to admit expert testimony after the recent Supreme Court decision in Daubert v. Memell Dow Pharm., Inc., 509 U.S. 579 (1993). The Court's decision in Daubert overruled a long-standing test that had based the admissibility of scientific evidence on its "general acceptance" in the field in issue. Next, the article will discuss in general terms what a party must do to "link a particular defendant's conduct to the contamination involved in order to recover from that defendant. This link, known as causation, varies depending upon the type of claim being asserted. Expert witnesses are used extensively to help establish causation. JUNK SCIENCE OR GOOD SCIENCE- HOW DOES A COURT DETERMINE WHAT TO LET IN A frequent complaint in litigation involving technical or scientific issues is that one party or another is trying to use so-called "junk science" to prove its case. While some expert testimony might be so clearly lacking in support or so "off the wall" that a court can easily determine to exclude it, other testimony, especially testimony on the "cutting edge," is much more problematic. In 1923, the District of Columbia Circuit Court of Appeals decided the case of Frye v. United States, 293 E 1013 (1923). In deciding whether to admit certain expert testimony, the court in Frye stated that while a court will "go a long way in admitting expert testimony deduced from a well-recognized scientific

For several years iron ore processing plants, located in the northern U.S. experienced seasonal decreases in the grinding efficiency of their primary autogenous mills. Kawatra and Eisele (1992) studied this phenomenon in an operating plant and characterized it in terms of specific energy consumption (Fig. 1) and production of critical size material (Fig. 2). Critical size material is defined as ore that is too small to be effective grinding media and too large to be ground. This data showed that both specific energy consumption and critical size production increased during the winter months. The increased energy consumption was in part a result of an increase in the viscosity of the mill pulp at colder pulp temperatures. However, viscosity could not fully explain the changes in critical size production. These changes are most likely due to changes in the breakage characteristics of the ore. Other studies were also conducted to determine if thermal and physical properties of iron ore changed at colder temperatures. These are summarized below:

The recommendations resulting from a Dispute Review Board (DRB) hearing of a contract dispute are being challenged more and more frequently. This paper explores possible causes based on the authors’ experiences. Challenges facing the DRB process include: The DRB process is starting to lose some of the informality and flexibility. Both owners and contractors appear to be putting too much weight on a board recommendation on a dispute. DRB’s do not make “decisions,” they provide recommendations for dispute resolution to both parties. The DRB process is not just for contractors to present an unresolved issue to a board hearing. Owners can also initiate a request for a hearing on a disputed issue. For the DRB process to remain a viable element of the successful construction project, confidence must continue to be maintained in a process that is intended to work on behalf of both parties to the construction contract.
