The recent spate of catastrophic events at U.S. mines raises the question as to whether or not the mine safety and health system in the U.S. is broken. The prescriptive regulatory regime in the U.S. is not a cure-all for a broken system. Without totally dismissing the contribution of a prescriptive regulatory approach, this paper argues that safety in the U.S. mining industry would be enhanced if the nation adopted a scheme that provides a balance between specification standards and two alternatives: performance and systems-based standards. This would allow effective and flexible means to continuous health and safety performance improvement. Mine operators, regulators and politicians could then go beyond thinking that compliance alone equals strong safety by creating a proactive system that emphasizes continuous improvement. By adopting performance and systems-based standards, exemplary safety and health performers can be recognized, allowing regulators to focus their efforts on those without sound occupational safety systems and who have substandard safety performance. "The Mine Improvement and New Emergency Response Act of 2006 (MINER Act Public Law 109-236) was passed by Congress in response to three major underground coal mine accidents in the United States that claimed the lives of 19 miners. The Act resulted in substantial changes in the underground coal industry relative to the use of technology for mine escape, rescue, disaster response and other areas where the lack of these technologies contributed to the fatalities caused by these tragedies. This year marks the 10th anniversary of the MINER Act, which makes it an opportune time to reflect on the events that led to its passage, the changes that have been made since then, and the work that remains to be done. As discussed below, the last decade has demonstrated tremendous cooperative efforts among mining operators, technology innovators, labor, The National Institute for Occupational Safety and Health (NIOSH), the U.S. Mine Safety and Health Administration (MSHA) and state regulators, resulting in substantial improvement of the technologies used for escape and rescue and noteworthy progress toward meeting many of the goals of the MINER Act. While the MINER Act and this article pertain primarily to coal mining, many of the technologies are equally applicable to any underground mining and have already found some acceptance outside of coal. TECHNOLOGY GAPS TARGETED BY THE MINER ACT The MINER Act addressed several technology challenges: • Problems with donning and switching between self-contained self-rescuers (SCSRs). • Poor visibility in smoke. • No wayfinding assistance for escape from the mine. • Limited breathable air supply. • Inability to locate trapped miners. • Inability to communicate with trapped miners. • Failure of mine seals. The MINER Act had several provisions that prescribed specific safety technologies intended to address these issues. Many of these were directed at post-accident technology requirements — an area in which Congress mandated additional technology investment. Specifically, the Act required mine operators to submit emergency response plans (ERPs) that contained provisions for implementing new or improved post-accident communications, tracking, lifelines, refuge alternatives and breathable air supplies along with training for emergency procedures and local coordination of emergency response. Most of the requirements were to be carried out within three years of the ratification of the MINER Act. In addition to these requirements for mine operators, the Act clarified and expanded NIOSH’s role and authority in enhancing the development of new mine safety technologies and expediting their commercial availability. The MINER Act also required NIOSH to develop research on refuge chambers, mine seals and the use of belt air and fire-retardant belts. Mine seals had to be upgraded and MSHA turned to NIOSH for applied research to establish the new explosion-resistance requirements. Progress toward closing the gaps."

Loudoun Water is currently implementing a quarry to reservoir conversion that will improve water supply reliability in periods of drought and flexibility in water supply operations when turbidity in its Potomac River supplies are high. The Milestone Reservoir Project consists of an inter-tie to the existing Potomac River Pipeline; new pipeline and tunnel; and a pumped intake and outlet works. Planned construction involves significant risks due to underground conditions which includes hard, igneous rock and high groundwater at the creek crossing. In addition, the site is constrained by Goose Creek, an adjacent residence, active mining in a quarry next to the new reservoir, public use of adjacent park space, and the Washington and Old Dominion Trail. Working with these constraints will require close coordination with active mining operations and public and private property owners. Safety of personnel involved with construction also represents a concern with quarry high walls over 30 meters in height near the planned construction. In consideration of key projects risks, Loudoun Water determined that an innovative CMAR delivery approach provided the best opportunity to achieve its goals in quality, innovation, front-end cost and schedule certainty, and operational flexibility and reliability. What matters most to Loudoun Water is the value in having a builder participate in the design process where key decisions can be made based on consideration of risks, cost, schedule, quality, and operability and maintainability of the system. While a progressive design-build delivery model may have produced similar outcomes, Loudoun Water had already invested in substantial development of the design for the work, and ultimately, CMAR provided Loudoun Water the opportunity to retain the partnership with the design team while gaining valuable input from a contractor. Among the challenges with CMAR in the Commonwealth of Virginia is a substantial limitation on self-performance corresponding to 10 percent of the construction value of the work. A significant industry outreach program was initiated by Loudoun Water to encourage participation with incentives in contract terms that allowed for the CMAR Contractor to make a reasonable profit. This paper reviews the CMAR procurement process and discusses contract incentives that were adopted to promote the work within the constraints of contract law in Virginia.

This project took a watershed approach in the evaluation of water-quality impacts from past mining activities and current restoration projects in the Bear Butte Creek basin, a small and well defined drainage in a heavily mineralized area of the northern Black Hills. The basin contains numerous inactive and abandoned mines as well as a currently active heap-leach surface gold mine. Bear Butte Creek normally loses all of its discharge to sinkholes in the Madison Limestone aquifer and thus can affect the water quality of this regionally important water resource. Water-quality data were analyzed, stream surveys were conducted, and two abandoned mine restoration projects were monitored to evaluate the effectiveness of the watershed approach and to identify practical remediation techniques that could be applied to other watersheds. A geographic information system (GIS) was developed to organize information on stream quality, abandoned mine locations, and other geologic and hydrologic data. The watershed approach toward assessing and reclaiming abandoned mines appears to be effective when compared to a point-source approach that might improve water quality at specific sites but not result in significant overall improvement to the watershed because of adjacent sources.

In the screening process, used to prepare particles for many applications, shape is known to have a significant effect. The degree of flakiness of construction aggregates has been considered particularly important. The objective of this research was to find values of operating parameters that optimize the separation of flaky from non-flaky particles by slotted screens. Thus an investigation was conducted to experimentally determine the influence of the particle size and thickness on the screening process. The Response surface method was employed for modelling and analysis of the data. Experiments employing a central composite design were performed on a pilot-scale, rectangular-aperture, vibrating screen to examine the effects of the screening variables the mass recovery of flaky and non-flaky particles to the oversize product. The SAS statistics package was used to fit a second-order model to each response and to analyze the fitted surface to determine the optimum levels. The optimization associated with a dual response system was then considered. The results of this study should provide a basis for optimizing screening conditions to obtain maximum recovery of non-flaky particles to the screen oversize while minimizing the recovery of flaky particles, which should be of interest to the aggregate industries.

"INTRODUCTION Site location and history The Holden Mine is a former underground copper mine that was developed and operated by the Howe Sound Mining Company (Howe Sound) from 1938 to 1957. The mine is located in north-central Washington State, U.S., near Lake Chelan in the area shown as Holden Village in Figure 1. Although Rio Tinto never owned or operated the mine, they are managing and funding a several hundred million dollar clean-up to prevent future water and soil contamination and to reclaim the former mine site under the United States Environmental Protection Agency (USEPA) Superfund process. The former mine included an onsite mill and a nearby housing complex for the miners. Howe Sound developed the mine as a series of near-horizontal drifts and tunnels, interspersed with stopes and shafts that connect different mine levels underground. The tunnels that were excavated to develop the mine total nearly 100 km in length.During development of the underground workings, Howe Sound removed more than 230,000 cubic meters (m3) of waste rock from the tunnels and deposited this material in two waste rock piles. Ore was processed from the mine in the onsite mill to produce a copper concentrate that was shipped off site for smelting. Roughly 10 million tonnes of tailings were produced as a by-product of the milling operation, most of which were deposited in three large impoundments (Tailings Piles 1, 2 and 3) directly south of and adjacent to Railroad Creek. Howe Sound closed the mine in 1957. In 1961, the property was transferred to Holden Village, Inc. (Holden Village), a not-for-profit corporation that maintains a year-round community and operates an interdenominational religious retreat in the former miners’ town. With the exception of the patented private land, the remainder of the Site is on National Forest lands and is administered by the U.S. Forest Service. The mine is remote. It is only accessible by boat or float plane from Chelan, Washington, up Lake Chelan to Lucerne, nearly 40 km. Vehicle access from Lucerne to the mine is provided through a 17.5-km-long winding gravel road that climbs 640 meters in elevation. The general site features are shown in Figure 2. Physical setting The Holden Mine is located on the eastern slopes of the Cascade Mountain Range at an elevation between 975 and 1,050 m above mean sea level. Holden Mine was developed adjacent to Railroad Creek, which lies in a glacial U-shaped valley carved into the igneous and metamorphic bedrock with steep-sided slopes (Figure 2)."

Entrapments are a huge risk in underground mines. This happens when miners (or any other persons who have entered underground) survive the initial event of an accident, become trapped or lost in unknown and life-threatening locations after evacuation, and remain unaccounted for. At this point, every second counts, and emergency response is highly desired for any chances of saving survivors. The survival chances of the missing persons depend on how quickly they can be located. Rescue teams are often deployed to search for the missing persons underground. However, the rescue teams are forced to search in random and presumed areas of the mine. This is due to the unavailability of information pertaining to the whereabouts of the missing persons. Not only the provision of accurate locations, but various other types of information such as post-accident two-way communication can enhance the survival chances of the missing persons. This information can be provided by a fit-for-purpose missing person locator system. A wide variety of missing person locator systems are already commercially available, some are in testing phases and others in prototype and development phases. This includes tracking, tracing, location detectors and post-accident two-way communication systems. These systems have unique functionalities, capabilities and limitations; making it difficult for mines to select the most effective, applicable and suitable system specific to their mine. In this study, the user requirements for a fit-for-purpose missing person locator system were developed. The purpose of the user requirements was to provide a guideline to facilitate the system selection process. The user requirements can also be used as a tool to measure and evaluate the performance of the selected missing person locator system. The user requirements were also used to predict the success of the selected system under different missing person incident scenarios. The development of the user requirements showed a potential for many other benefits for missing person locator systems.

The intent of this paper is to provide overview context to allow broader understanding of conventional tailings dam failure mechanisms. The research leverages global knowledge, experience, and data collection and interpretation for the safe and controlled management of the geotechnical stability of a tailings storage facility. The motivation for this review is to facilitate transparent access to tailings dam background and understanding. This paper addresses the core understanding of geotechnical failure mechanisms, and how these eventuate to instability and failure of tailings dam structures. This research focuses on foundation failure, internal erosion and piping, overtopping, seepage, seismicity, and slope instability and provides insight into what factors contribute to failure, how failure progresses due to such failure, anticipating and monitoring for the aforementioned failure modes, and designing to mitigate their risk.

The United States Forest Service, as a land managing agency, is responsible for the surface administration of National Forest lands. The basic objectives of management are protection and utilization of renewable resources such as water, forage, timber, wildlife, recreation, and clean air. Much of the National Forest land in this country is open to mineral prospecting and development. When large de-posits of minerals are extracted from the forest environment, especially by surface methods, there are oftentimes conflicts between accepted mining methods and the objectives of other resource management goals. Such is the situation in Southeast Idaho where several members of the phosphate industry are operating on and adjacent to the Caribou National Forest. In 1966, the phosphate industry and the Caribou National Forest became mutually concerned with the problems of rehabilitating mined areas and minimizing potential damage to adjacent forest areas. A Cooperative Administrative Study was initiated with industry supporting the Forest Service financially and with equipment, material, and manpower, as well as interest and enthusiasm. The objectives of the study are to provide basic, applicable information pertinent to: 1. Protecting the quality of water emanating from mined water-sheds. 2. Providing for soil stabilization on mined areas. 3. Returning mined areas to surface resource production. 4. The feasibility of making mined areas esthetically acceptable. It was concluded that the following separate--yet intergrated--fields should be studied in order to obtain the desired information:

The business of mineral exploration and development has become much more than simply a problem of locating orebodies and designing mines. Favorable economic analysis of mining and processing feasibility is no longer sufficient to justify the development of a mine. New laws, enacted by virtually every level of government, require comprehensive land use planning, environmental analysis, mineland reclamation, mine safety studies, and many other considerations. This profusion of new laws says in effect, that the mining company is no longer responsible only to its stockholders. Mineral development today can be compared to a partnership. As in all partnerships, the risks and liabilities as well as the benefits are held jointly by all the participants. In addition to the mining operator, this partnership consists of the public, through its many levels of government, interest groups, and individual citizens. Therefore, you'd better know your partner very well - his responsibilities and capabilities. Mining is considered a high risk venture. The risk on the part of the operator and the lending institutions has long been recognized. The risk that the public and its government take in these mining ventures has now been recognized also. The people and their government have learned that they inherit, through abandonment or forfeiture, the mistakes and problems of individuals and companies regarding these natural resources. In looking through the "Mining Engineering Handbook" recently published by the Society of Mining Engineers, I noted that in their discussion of liability for excavations, the authors quoted from the book of Exodus, 20th chap., where Moses said to his people: "When a man leaves a pit open, or when a man digs a pit and does not cover it, and an ox or an ass falls into it, the owner of the pit shall make it good; he shall give money to its owner, and the dead beast

Underground longwall coal mining sections are operated as sealed gobs if the coal is prone to spontaneous combustion. Sealing along the gate roads during longwall face retreat limits the flow of fresh air (oxygen) into the gob and, thus, deprives the spontaneous combustion reaction of oxygen. In a project sponsored by the National Institute for Occupational Safety and Health (NIOSH), researchers at the Colorado School of Mines have used computational fluid dynamics modeling to simulate the flow of gases in sealed longwall gobs. The models were validated using measurements and observations from the field and demonstrate that targeted injection of nitrogen along the gate roads inby the face can be used to control the size and location of explosive methane clouds within the gob and to minimize or eliminate the explosion hazard resulting from the formation of flammable methane-air mixtures.

The reduced need for traditionally trained and educated personnel in the mining industry is systemic to the changing mining industry. Universities and other training institutions are meeting the traditional skill needs required by the industry, but are the skill needs going to be the same in the near future? The answer may be no. Mining is changing because of increased liabilities and costs of environmental and safety is-sues; lower grades of minerals in traditional mining activities and the advent of new bio-chemical processes and robotic equipment. More productive and economic alternatives, and larger, more sophisticated and automatic equipment, are also changing the industry. Engineering is more specific, accurate, precise and expensive. Measurement is more thorough and timely of progress, production, costs and productivity. And, the industry will likely be engaging in more undersea mining, possibly space-based processing, less human interaction and more remote control of events than was previously thought possible.

Under various state laws enacted mostly within the last 20 years, reclamation requirements and standards for hard-rock mining operations have been established virtually everywhere in the western United States. Unlike the uniform and detailed coal mine reclamation requirements under the federal Surface Mining Control and Reclamation Act ( "SMCRA" ) and state programs mode led after SMCRA, the various state law hard-rock mine reclamation requirements are based upon a variety of objectives, and therefore are subject to varying standards from state to state. While the diversity of reclamation requirements complicates the determination of what reclamation measures will be required at any particular mine, there are valid reasons for this diversity. There are dozens of different commodities mined in the United States, and mining methods are different for each commodity. Local natural conditions such as climate, precipitation, geology, hydrology, and biology vary widely across the county. Site-specific conditions also affect mining and reclamation methods. Also, factors such as economics, land use, and environmental protection issues receive different priorities in different states and communities within those states. State reclamation requirements in general provide the flexibility to consider site-specific circumstances, allowing operators to design and engineer the best reclamation measures for each mining site. To the mine developer or manager, reclamation requirements must be translated into design, operational, and closure measures for mine planning. Each of these measures must then be assigned additional costs to be factored into the economic decisions for a particular mining operation. On a broader level, reclamation costs must be factored into decisions such as where to invest in exploration and mine development. The purpose of this paper is to provide a summary of the state non-coal mine reclamation requirements in twelve western states. This summary comparison may be useful as a starting point in considering how local reclamation requirements will impact potential mining costs.

Political issues and a glaring infrastructure deficiency have retarded the emergence of a strong mining component to the Alaskan economy in recent years. Barriers to orderly mineral development are slowly being removed attendant upon changing political circumstances. Infrastructure development, as an investment avenue as well as a responsibility of the State, is receiving much greater attention than in the past. Alaska of course has a rich and varied mining history going back to the 19th Century. This paper, however, focuses on the mining potential, not the mining heritage of the 49th State. The mining industry is emerging from a nadir in the economic cycle - times during which it was buffeted by unsympathetic administrations and confused and confounded by the protracted land status- conflicts prior to enactment; of the Alaska National Interest Lands Conservation Act (ANILCA) and other milestone legislation. Today Alaska's mining industry looks toward a bright and healthy future and, in the process, will become a very important and vital component of the State and national economy.

Rare earth elements (REEs) are considered critical minerals for industrial and defense sectors. REEs are not as rare as the word “rare” portrays; yet, the exploitable and/or profitable deposits of REEs may be found only in certain geographical areas. The political and social conditions characterizing these areas may not always be in favor of mining operations. These conditions are imposing the need for extra consideration on the geopolitical constraints prior to any decision-making and before any mining project begins. This study assesses the risk related to mining projects for areas that feature REE deposits based on a geopolitical viewpoint. Probable ranking differences between the current assessment and a 2015 assessment are discussed. The comparative indicators used and the appraisal procedure applied in this comparison are based on a number of different geopolitical indicators. Several ranking changes occurred between 2015 and 2019.

"This study explores froth flotation and selective flocculation methods to recycle waste phosphors containing several rare earth elements, namely, yttrium (Y), europium (Eu), cerium (Ce) and terbium (Tb). The effects of the presence or absence of collector and of flocculant and their dosages, as well as the pH, were investigated. Reverse flotation resulted in concentrates with grade of 27.03 percent and recovery rate of 71.36 percent, while flocculation resulted in concentrates with grade of 31.43 percent and recovery rate of 91.28 percent. The flotation and flocculation behaviors were further analyzed by X-ray diffraction analysis, zeta potential measurements, particle size distribution and other methods. The successful separation of rare earth minerals by flotation was attributed to the selective adsorption of the collector onto quartz, making it particularly recoverable by reverse flotation so as to be separated from the valuable materials. The analysis of the particle aggregation process indicated that its better flocculation performance was due to the selective adsorption of flocculants onto the unwanted materials, enlarging the flocculant sizes by forming aggregations and facilitating the separation of rare earth minerals from waste materials based on different settling rates. IntroductionBecause waste phosphors pose the problems of heavy environmental burden and high risk to human health (Hu and Cheng, 2012) as a result of containing heavy metals such as mercury and manganese (He et al., 2006; Lucas and Emery, 2006), they have received added attention as urban mining resources for extracting rare earth elements (REEs) like yttrium (Y), europium (Eu), cerium (Ce) and terbium (Tb).At present, chemical processes such as acid leaching, alkali fusion, roasting and extraction are the primary methods for recovering REEs from waste phosphors (De Michelis et al., 2011; Li et al., 2012; Li, 2010). With these strategies, phosphors can be effectively decomposed and their REEs extracted. After the removal of impurities, the REEs can be efficiently precipitated by adding an H2C2O4 solution (Porob et al., 2012). Although relatively high recovery rates are achieved, those processes entail high energy consumption and can cause severe environmental pollution."

The Purpose of the Paper It is fitting that the first paper of a session on the Financial Aspects of Mining should be on the basic data upon which any financial discussion of a mining project must be based. The history of a mining project starts with exploration in an area considered geologically favorable for mineralization and culminates in the discovery of a body of valuable mineral material commonly known as a mineral deposit. Subsequently more detailed exploration establishes the approximate size, shape, tonnage and average grade of the deposit by surface and/or underground drilling, -surface trenching and/or underground workings. Some preliminary metallurgical testing and other studies, as required, are made at this time. Development work is then carried out to provide representative samples for determining flowsheet and metallurgical balances, preparing the deposit for production and establishing more firmly the grade and mining characteristics of the deposit. A feasibility study is then made of the engineering aspects of the project including the estimation of operating coats, the capital required to place the deposit into production, profit and return on investment. At the turn of the century the keys to industrial success were coal and iron. At that time, Pennsylvania was the ranking mineral producer among the States and close to 90% of the Nations energy output was generated by coal. The growth of this Common-wealth into the greatest industrial State in the nation has been due to the huge resources of easily accessable coal found by the early settlers. It was the development of these deposits that provided the United States with a new source of fuel energy. For nearly a century, the Commonwealth was the chief powerhouse of our nation and the chief source of its industrial blood and bone. In 1928 it was truly said that coal was king in Pennsylvania. Pennsylvania that year mined a billion dollars worth of coal. A single train carrying this output would reach more than twice around the world at the latitude of Pennsylvania. Coal formed nearly 67% of the freight of Pennsylvania and was responsible for its four billion dollar iron and steel industry. Coal was the real reason why Pennsylvania although 32nd in size was second and not tenth or fifteenth in wealth, population and industry. Pennsylvania was slow to take-up her heritage as the greatest coal producing State in the union. But the knowledge that coal was present was not slow in accumulating. In fact the Indians were aware of its existence long before the white man arrived. They knew that many of the hills were underlain with black stones that would burn. It is reasonably certain that Arnold Viele, the first white man to cross the mountain in this State saw coal in them in 1692. But awareness was not enough. The population in these days was confined to southeastern corner of the State and the population at this time had little need or interest in the resources further inland. Pennsylvania anthracite was discovered in 1762 but was first regarded only as a curiosity. Commercial productions started in 1820. This stimulated the development of many native industries and extensive canal system and afterwards an elaborate net-work of railroads were constructed at great costs to bring the products of the hard

The Washington Metropolitan Area Transit Authority(WMATA) officially came into existence in February 1967 after the District of Columbia, Maryland, and Virginia joined in a com¬pact pursuant to Federal creative legislation signed the previous November to build a regional rapid rail transit system called METRO (1). The parent organization was the National Capital Transportation Agency (NCTA), a Federal agency, subject to Federal statutes and regulations. Soon after the completion of the transition from NCTA to the new "non-Federal" status of the Authority, the Board of Directors of the Authority formally adopted procurement policies and procedures (2). These are specific statements concerning competition by formal advertising for bids or by solicitation of proposals for negotiation, contracting authority, approval of awards, awards of contract modifications, and processing of claims and disputes. These policies and procedures are silent as to Federal procurement statutes and regulations. But because of the Authority's origin, the sensitive nature of the compact among the several sovereign jurisdictions, Federal financing of two-thirds of the costs, and the resultant surveillance by the General Accounting Office over staff operations, the Authority's procurement practices follow closely Federal regulations adapted to WMATA's needs. This is an important point and is the foundation of contractual relations between the Authority as the owner and its construction contractors. Various constraints and flexibilities of this arrangement with respect to excavation and tunneling contracts will be pointed out in the ensuing discussions.

In virtually all jurisdictions, comprehensive environmental protection regulations or standards are in place that apply to all industries, including mining. The only other legitimate mine-permitting concern is post-mining land use (PMLU). PMLU includes all uses of land after mining as well as the ecosystems appropriate for those uses. Although flawed, the New Mexico Mining Act (NMMA) of 1993 is a PMLU-based permitting statute. It requires measures during closure that will establish a PMLU or self-sustaining ecosystem for each mine unit. PMLU-based permitting avoids prescriptive, one-size-fits-all measures and keeps permitting focused on the legitimate goal of responsible land management..
