In September of 1988, the United States Environmental Protection Agency (US EPA) published final regulations that effect owners and operators of underground storage tanks (USTs). These regulation include stringent technical requirements for owners and operators of USTs containing petroleum and certain hazardous substances. The technical requirements effect both new (those installed after December 1988) and existing USTs and include notification; performance and operating standards; release detection, reporting, investigation; release response and corrective action; and closure requirements for out-of-service USTs. The USEPA also published final regulations regarding financial responsibility requirements for owners or operators of petroleum USTs in October of 1988. These regulations require owners or operators of petroleum USTs to demonstrate financial responsibility for the costs of corrective action and compensating third parties for bodily injury or property damage caused by releases from petroleum USTs. Like thousands of other industries, the mining industry must become thoroughly familiar with these new regulations in order to properly manage their UST systems, ensure compliance, and understand other ramifications imposed by these regulations.

The Arizona Legislature is currently in the process of considering mined land reclamation legislation in the 1994 legislative session. A bipartisan legislative study committee has drafted proposed mined land legislation. The committee has attempted to craft legislation that is appropriate for the unique conditions in Arizona. Existing Arizona and federal laws and regulations extensively regulate the environmental performance of mines in the state to protect public health, safety and the environment. The proposed mined land reclamation legislation does not replace or duplicate these statutory provisions relating to environmental protection. Instead, the purpose of the proposed legislation is to provide for the reclamation of land that is being mined and to fill the gap in existing laws by requiring the reclamation of land that currently is being mined or that has been mined since 1986 to provide for future land use. The legislation would require an operator to submit a reclamation plan describing the exploration operations, mining operations, post-mining land use and the proposed reclamation measures for review by a state agency. Financial assurance also would be required in an amount such that a third party could complete the approved reclamation measures. Arizona's mined land reclamation legislation would recognize Arizona's leading role in hard rock mining and emphasize the mining industry's economic importance to Arizona and the nation. Because mining operations necessarily require disturbing the surface of the earth to extract valuable minerals, reclamation requirements would be adapted to different conditions and would vary depending on site-specific conditions and on the commodity being mined. The current proposal does not identify the state agency that will administer the mined land reclamation program and approve reclamation plans, substantial changes to plans, and transfers of reclamation plans to other operators.

Under a Section 319 Water Quality grant from the U. S. Environmental Protection Agency, a working group of government agencies, mining industry representatives, and University of Alaska researchers undertook reclamation of an abandoned mine site on Birch Creek, near mile 101 of the Steese Highway. Stream hydrology, water quality, and the extent and nature of natural revegetation, were measured before the site was then recontoured to decrease the bedload deposition and bank erosion of the streams. Methods for stabilization of streams and rivers appear to have much in common with those for locations further south, but are subject to complications unique to the North, such as the formation of aufeiss, and to a lack of accurate climatological data. Natural revegetation appears to be possible for most northern placer mine sites. However, it may take place more slowly than required by public perception. Preliminary data indicate a surprising lack of nutrients in the floodplains of mined areas. Natural revegetation may be enhanced by selective planting of grasses and willows, which will contribute variously to soil quality, bank stabilization, and short-term appearance. Monitoring of hydrologic and water quality data, and of natural and artificially placed vegetation will continue at the .Birch Creek site through the summer of 1995,

P&H MinePro Services Canada is supplying Syncrude Canada three more of its model4100BOSS electric mining shovels. The shovels will be delivered during 2003. Syncrude’s oil sands operations already use five P&H shovels. The first 4100BOSS shovel was commissioned at Syncrude’s operation in northern Alberta, Canada in October 2001. The unit loads more than 9 kt/hr (10,000 stph) of unblasted oil sands. Since it began operation, the 4100BOSS has shown a 28% production increase over the four P&H 4100TS shovels also on site.

The purpose of this paper is to provide general information about the bioaccessibility of metals and specific information about the use of bioaccessibility in risk assessments (human health risk assessments [HHRA] or ecological risk assessments [ERA]) and a list of sites where regulatory agencies have approved the use of bioaccessibility data in risk assessment. The memorandum also cites current U.S. Environmental Protection Agency (USEPA) guidance as well as state specific guidance where applicable. BRIEF HISTORY OF METAL BIOACCESSIBILITY TESTING AND METHODS The bioaccessible fraction of a constituent is that fraction that dissolves or desorbs from its matrix (e.g., soil) in the gastrointestinal tract and is available for absorption (USEPA 2007a; ITRC 2011; ITRC 2017). This is different from the bioavailable fraction, which is the percentage of the amount of an element that an organism is exposed to that is absorbed by that organism during a given time under defined conditions (USEPA 2007a). The bioaccessibility factor is the percentage of a metal that is potentially available for absorption and, therefore, is a conservative estimate of the bioavailable fraction since all that is available for absorption may not ultimately be absorbed into the organism’s system. Currently, there are two main techniques for estimating bioavailability of metals within a medium: in vivo animal studies (time-consuming and often cost-prohibitive), and in vitro tests that simulate human, or animal digestion in a laboratory setting. In vitro and in vivo test methods and protocols have been extensively evaluated by numerous researchers (Ruby et al. 1996; Rodriguez and Basta 1999; Sips et al. 1998; Sips et al. 2001; Molly et al 1993; Oomen et al 2002; Kelley et al. 2002; Oomen et al. 2003; Furman et al. 2006; Drexler and Brattin 2007; Basta et al. 2007; Wragg et al. 2009; Wragg et al. 2011; Chaney et al. 2011; Bradham et al. 2015; Bradham et al. 2018). The most recent scientific literature demonstrates that protocols used to estimate the bioavailability of metals to mammals also predict bioavailability of metals to birds as well (Beyer et al., 2016).

A nickel-copper sulphide concentrate was treated in a pilot plant at Warren Spring Laboratory during 1961, by a hydrometallurgical roast-leach- solvent extraction process devised to cleanly separate the metal values, and produce acid sulphate liquors containing the metals. It is shown that 86 percent of the nickel and 95 percent of the copper could be leached from the calcine, after a sulphatizing roast on finely ground flotation concentrate. Iron was removed from the leach liquor by limestone neutralization with a small loss of values. Copper and nickel were separated by solvent extraction with naphthenic acid in kerosene after partial neutralization of the iron-free liquors with ammonium hydroxide. Hydrogen sulphide and chlorine were used to remove zinc (and residual copper) and cobalt impurities respectively. The recovery of pure copper and pure nickel, by electrowinning, from the acidic solvent extract strip liquors finally produced, appears technically feasible.

The Environmental Protection Agency (EPA) is in the early stages of developing a national mining waste program. Our goal is to develop a mining waste program that will be state implemented, multimedia in nature, flexible, utilize and enhance existing state programs, and protect the environment. The Agency appreciates the cooperation the mining industry is providing through its participation in the Policy Dialogue committee on Mining and by providing the Agency with technical data. The following is a discussion of what led to the development of a national mining waste program, the agenda initiative to evaluate Toxic Substances Control Act authority in phosphate manufacturing, and the important steps being taken through the Policy Dialogue process to frame and discuss issues. EXTRACTION AND BENEFICIATION OF ORES The Resource Conservation and Recovery Act of 1976 (RCRA) and subsequent amendments created a framework for the regulation of hazardous wastes under Subtitle C and nonhazardous waste under Subtitle D. In 1978, initial regulations were proposed for hazardous waste management units under RCRA. These identified a universe of special wastes that were large volume, low hazard and less amenable to Subtitle C control techniques. EPA noted that waste materials from the "extraction, beneficiation and processing of ores and minerals m fit these criteria. In October 1980, Section 3001 of RCRA was amended. This Bevill amendment excluded solid waste from the extraction, beneficiation and processing of ores and minerals from regulatory control under RCRA's hazardous waste Subtitle C. This was done pending a report to Congress and a regulatory determination regarding the Subtitle C status of these wastes. Thus in November 1980, EPA published an interim final amendment to the RCRA Subtitle C regulations to reflect the Bevill amendment. RCRA requires EPA to perform studies and make reports to Congress regarding the management methods and potential hazards of managing waste. RCRA also calls for a regulatory determination regarding whether Subtitle C (hazardous) or D (non- hazardous) controls are warranted for these wastes. In December 1985, EPA submitted a report to congress entitled, “Wastes from the Extraction and Beneficiation of Metallic Ores, Phosphate Rock, Asbestos, Overburden from Uranium Mining and Oil Shale." In that report, EPA found that some mining wastes exhibit hazardous characteristics, that the range of risk from mining waste is broad, and that waste management practices have caused environmental damage. In July 1986, EPA published a regulatory determination based on information gathered in the 1985 report to Congress and comments from interested parties. The mineral sector is a fundamental part of the U.S. economy. It contributes to the real gross domestic product (GDP) at several stages—basic (mining), intermediate processing, manufacturing of finished goods and construction. The estimated growth rate for the real GDP of the United States for 2006 was 3.2 percent. The nominal GDP was about $13.2 trillion. The value of minerals mined in the United States in 2006 rose significantly because of increased unit price for some metals—particularly copper, zinc and other base metals. There was also a significant reduction in metals stocks. Infrastructure expansion and manufacturing in China and India have been absorbing a significant portion of world output. At that time less than two dozen codes were incorporated into the engineering design and they were somewhat static and well known by the engineering designers and managers. A cooperative study was undertaken by representatives of the environmental community, the mining industry, and state government to identify and resolve environmental issues associated with base and precious metal mining in a neutral atmosphere before a commercial mining development is announced. The study included testing Minnesota's as-yet-untried non-ferrous mining regulatory program using three hypothetical mining developments sited in environ-mentally sensitive areas where future mining could occur. Results include identification of critical paths for regulatory decision making, identification of particularly sensitive environ-mental issues that will need continued deliberation before resolution, and characterization of data necessary for environmental review and permitting decisions.

"On January 9, 2014, a large chemical spill occurred on the bank of the Elk River near Charleston, WV. Within hours, the potable water supply for more than 300,000 people was contaminated, and the incident captured national headlines for weeks. Although the primary chemical, crude 4-methylcyclohexanemethanol, or MCHM, is deemed nonhazardous, the impacts of the spill are significant – with all stakeholders, including the public, members of industry, and relevant government agencies experiencing losses. This case highlights the need for a more proactive approach to environmental management, shifting from crisis control and remediation to crisis prevention and risk management. INTRODUCTION On the morning of January 9, 2014, approximately 10,000 gallons of crude 4-methylcyclohexanemethanol (MCHM) leaked from a 48,000-gallon storage tank sitting on the bank of the Elk River near Charleston, West Virginia (WVDEP, 2014; CSB, 2014). MCHM is a chemical commonly used in preparation of fine coal, and is deemed nonhazardous in terms of transportation and storage regulations and also toxicity (CDC, 2014a). Freedom Industries, Inc., a producer and vendor of specialty chemical products, had acquired the storage facility where the spill occurred from Etowah River Terminal, LLC just a few weeks prior in December 2013 (WVDEP, 2014; Freedom, 2005). The direct cause of the spill was ultimately determined to be two small holes in the base of the 76-year-old tank, which were created due to corrosion damage (Bauerlein & McWhirter, 2014). The spill site was located just over a mile upstream from the intake of a municipal water treatment facility operated by West Virginia American Water (WVAW), which serves a population of 300,000 across nine counties in central West Virginia (CDC, 2014a). In a matter of hours, the leaked MCHM made its way through the treatment facility and into the water of nearby homes and businesses, where its strong smell was noticed almost immediately. On the evening of the spill, WVAW concluded that its conventional treatment processes, which include carbon filters to remove a variety of contaminants from water, were not capable of fully removing the MCHM and a “Do Not Use” order was issued for all customers (WVAW, 2014a). With little information readily available regarding the potential human health effects of MCHM, the US Centers for Disease Control and Prevention (CDC) quickly issued an advisory ruling that set a maximum screening level of 1 ppm for safe drinking water (CDC, 2014a). Based on this recommendation, the “Do Not Use” order remained in effect for a total of eight days, until January 17, when the WVAW distribution water was confirmed to have MCHM concentrations below this level (WVAW, 2014a). However, due to the pungent odor of the chemical, its presence was still recognizable in the WVAW facility and in consumers’ tap water after the order was lifted (Manuel, 2014). Recent studies have shown that the chemical can be detected in water at concentrations as low as 0.55 ppb by individuals experienced in odor identification (Rosen et al., 2014); and even individuals with no such training can detect pure MCHM at just 7 ppb (WVTAP, 2014). The fact that this chemical can be sensed at such low levels – indeed far below those considered safe – undoubtedly added to growing public concern. In response to numerous complaints and demands, WVAW continued flushing the treatment facility and pipes until February 25 when MCHM levels were measured below 2 ppb (WVAWb, 2014), and eventually replaced the affected filter media (WVAWc, 2014)."

In today's work environment a tremendous amount of data is required to provide the regulatory agencies justification to issue a mining permit. The demands for data, specifically environmental characterization data, grow and the mine plans must address the issues raised by the interpretation of that data. Computers and computer software can provide operators and consultants with the tools necessary to assimilate, digest and interpret these seemingly unmanageable data sets. This paper presents some examples of how Mincom's MineScape software can be applied to the task of developing coal mine permits in an electronic format.

The Environmental Impact Statement (EIS) has become a routine requirement for mining operations on federal lands. A similar document is being required in developing countries. Baseline studies are needed prior to writing an EIS and these studies involve surface water, groundwater, air quality, and wildlife/ native plant evaluations. The required baseline hydrology and geochemical studies are often the most expensive and lengthy evaluations. This paper summarizes the hydrology and geochemical baseline studies required for .An EIS and presents suggested methods to expedite these studies and to shorten the time and the cost to complete the studies and the EIS.

The benefits of historic mining to this country have been many, but have come at a cost to the environment that has only begun to be understood over the past twenty years. While estimates vary, it is generally recognized that there are over 200,000 inactive and abandoned hardrock mines, with most of them located in the western U.S. Only a fraction of them are believed to be sources of metal releases with significant adverse environmental effects to the watersheds and receiving streams. State water-quality and natural resource management agencies have noted that hundreds of miles of streams are metal-impacted, and the aggregate effects of these sites within watersheds and drainage basins is poorly understood. Resources for the environmental assessment of abandoned mine land (AML) sites and watersheds have been and continue to be limited. Few hardrock mining states receive substantial reclamation funds under the (coal) Surface Mining Control and Reclamation Act. EPA Region VIII (EPA8) has an estimated 90,000 abandoned mining, milling and smelter sites, mainly in Colorado, Montana, South Dakota, Utah and Wyoming. An estimated 13,000 of the sites may have metal releases causing Clean Water Act and CERCLA non-compliance. Results of inventories by states and federal land managing agencies, indicate it is plausible that only 3,000-4,000 of these sites may be causing significant environmental degradation.

The potential of controlling heavy metal ions in effluents from discontinued mining operations and waste rock piles has been investigated. A fresh water green alga, Cyanidium caldarium, was found to have the potential to remove Cut' from solutions while exhibiting high tolerance to acid conditions which are commonly encountered in copper-nickel mine drainage. The process has the potential for application as a low maintenance metal decontamination system. The growth requirements and copper removal characteristics of this microorganism are described.

Coal gasification solid residue (slag) contains unconverted carbon (char) which is considered an impurity for utilization applications of slag. Under this study, table concentration was used to process approximately 24,000 pounds of a nominal -3.4 mm gasifier slag (~85% ash) to separate high (~100%) ash slag from low (~50%) ash char. The results indicated a nearly ideal separation of the slag from the char for sizes coarser than about 1 mm. An overall slag yield of 71% was obtained. The slag was sufficiently clean to be used as feed material for the production of expanded lightweight aggregate. The recovered char had an ash content of about 47% and was a nominal -1 mm in size.

Although primarily cut-and-cover excavations are required for replacement of the existing elevated I-93 interstate highway through the heart of Boston for the Central Artery/Tunnel (CA/T) project, some mined tunnel construction was also undertaken. The mined tunneling conducted was the 22-m-wide northbound roadway structure which passed below a 20-m-deep operating underground subway station that was built in 1913. The innovative underpinning scheme used to support the subway station during construction resulted in the successful mining beneath the subway station with negligible vertical settlement. Two grouting galleries were carefully mined below the subway structure, and pre-grouting of the granulary, pervious glacial soils and weathered bedrock was carried out from these galleries. The reinforced concrete walls of the underpinning structure were constructed within three stacked drifts that were sequentially mined below each grouting gallery. After 11 cross adits were mined between the grouting galleries, cast-in-place post-tensioned girders that spanned between the stacked-drift walls were constructed to support the subway station. The stacked-drift walls also provided lateral support for the 22-m wide by 29-m long by13-m high opening beneath the girders.

(Matt. 23:23). I want to talk about "The Weightier Matters of Law." In a situation where big government is trying to have an effect on even small details of a work activity, otherwise simple situations become complex. Regulations are written to such detail that constant compliance with strict interpretations can be a nightmare--not to mention off the target of the intended purpose for the regulation. The Directory is funded by the U.S. Bureau of Mines and includes a sampling of computer usage in operating and manufacturing companies, consulting firms, computer companies, research organizations, universities, and various U.S. government agencies. General references to computer applications throughout the mining industry are discussed as well as the availability of programs to interested organizations or individuals.
