The Mine Safety and Health Administration’s Roof Control Division (RCD) evaluated the use of Shuttle Radar Topography Mission (SRTM) data to identify fracture traces on Earth’s surface. Results were compared to the analysis method employed by RCD for 30 years, which relies on LANDSAT-TM Band 4. SRTM elevation models are expected to provide a direct representation of bedrock surface, while LANDSAT-TM Band 4 represents reflected near-infrared radiation as an indication of moisture content and is only a proxy for possible structures. Three areas in southwestern Pennsylvania were chosen for ground-truthing lineaments derived from both methods, following a series of desktop comparisons in six areas of the contiguous U.S. Field studies that identified numerous instances in which SRTM lineaments corresponded with joints at the projected location, and were oriented within 10° of joint strike, indicating that those SRTM lineaments represented the structural grain of the area. In some cases, lineaments were associated with individual joint zones. Photo-lineaments derived from the existing LANDSAT-TM methodology appear to offer a higher coincidence with expected trends of joints on a regional scale when performing the desktop comparisons, while field observations indicated that SRTM-derived lineaments had a higher association with individual geologic structures in the case study field area. It appears that both methods can identify the structural grain of an area, and that both tend to identify linear segments of valleys where erosion has preferentially occurred along joint zones or other structures.

The physiocemical properties and industrial uses of the clay mineral montmorillonite are reviewed. Montmorillonite is the most abundant species of the smectite clay mineral group and is the predominant mineral composing bentonite deposits. The crystal structure, chemical composition, exchangeable ion type, and small crystal size are responsible for several unique properties, including a large chemically active surface area, a high cation exchange capacity and interlamellar surfaces having unsual hydration characteristics. The type of exchangeable ion Na, Ca and/or Mg has a major influence on industrial and chemical uses of montmorillonite because of their hydration characteristcs. Natural occurrences of Na montmorillonite in commercial quantities are geographically limited, but Ca-Mg montmorillonite deposits are known world wide. Foundry, well drilling, pelletizing and civil engineering constitute the major uses of montmorillonite, but the total array of uses of montmorillonite exceeds that of any other mineral.

Recently, a Maryland bank became the overnight owner of a toxic waste site through a foreclosure. The original property owners had operated a crash and garbage business on the site and obtained loans for their business venture through the bank. In 1980, their son purchased the property from his parents with mortgage monies obtained from the bank. Failing to make his loan payments, the son defaulted on the mortgage. The bank foreclosed on the property and eventually purchased the property at a foreclosure sale. Shortly after the bank's purchase of the site, toxic wastes were found on the property--the result of disposing solid wastes on the site for 10 years. The bank declined responsibility for contaminating the site and consequently for its cleanup. The Environmental Protection Agency (EPA) took corrective actions to clean up the site. EPA then handed the bill to the bank, citing the Comprehensive Environmental Response Compensation and Liability Act (CERCLA) of 1980 (more commonly known as "Superfund"). CERCLA imposes liability on the current owners and operators of hazardous waste sites.

The economic success and growth of any metropolitan region depends on mobility. Today, mobility between New Jersey and New York is threatened by a transportation system that cannot meet 21st century travel demands. The transportation bottleneck created by the Hudson River threatens the viability of one of the world?s great centers of commerce and culture. Fortunately, there is a solution: The Access to the Region?s Core Mass Transit Tunnel. The US$8.7-billion Mass Tran-sit Tunnel?s (MTT) new two-track line will double commuter rail capacity under the Hudson and create a new, state-of-the-art cavern station in Midtown Manhattan, with wide platforms, high-speed escalators and other features to improve riders? travel experience. The capacity and other benefits of the MTT project will launch a new era of prosperity for the region, just as the Pennsylvania Railroad did almost 100 years ago when it built the existing two, single-track rail tunnels that now form the sole commuter rail link between New Jersey and New York. The existing tunnels run from North Bergen, NJ, under the Hudson River to Pennsylvania Station at 33rd Street in Manhattan. Construction on the MTT, the largest public works project in the United States, is scheduled to start this year and continue through 2017. The MTT is ready to go to construction thanks to a major commitment of financial, engineering, project management and other resources from NJ TRAN-SIT, New Jersey?s statewide mass transit agency, and the Port Authority of New York and New Jersey, a bistate agency that operates the Holland and Lincoln tunnels, the George Washington Bridge and other major transportation facilities in New York and New Jersey. The project is also strongly supported by the state governments of New York and New Jersey, as well as that of New York City. The MTT is New Jersey Governor Jon Corzine?s number one transportation priority.

Environmental concerns and increasing mine development costs have created a need for early information on gold recovery from its host environment. The habit, association, and approximate abundance of minerals which contain unacceptable metallic ions which may be released during process of concentration of gold should be identified in exploration drill core. One case of a "clean" gold orebody is described to show that early petrographic studies contributed to a rapid decision to mine a small deposit by open pit and to custom mill the ore in an already restricted effluent environment. A second example describes identification of an undesirable mercury content and resulting action taken.

The Prairie Creek intrusion, near Murfreesboro, Arkansas, is the site of the only commercial diamond mine in North America. Three major lithologies are associated with the intrusion, a hypabyssal peridotite, a volcanic breccia in .which the majority of diamonds occur, and associated tuff. Previous studies, including mining history, geological, geophysical, petrological and whole-rock and mineral chemistry are reviewed. The recent suggestion, by other workers, that this intrusion may be more correctly called a lamproite is examined and supported. This has serious implications for diamond exploration in Arkansas and elsewhere in the U.S.

OBJECTIVES OF RADIATION MONITORING Monitoring is a tool used in the practice of radiation protection. The primary reasons for monitoring are to reduce radiation exposures to levels that are as low as reasonably achievable and to assure that no individual receives a dose exceeding the maximum individual dose limit. The documentation of radiation doses for legal, medical, or epidemiological reasons is a subordinate function of any monitoring program. The investment in radiation monitoring programs should be guided by four criteria: (1) the detection and avoidance of unnecessary exposures, (2) the magnitude of potential health risks, (3) the determination of combined doses and risks with adequate confidence, and (4) the verification of compliance with established limits. FIRST CRITERION: DOSE REDUCTION - DETECT AND CORRECT UNNECESSARY EXPOSURES The system of dose limitation advocated by the International Commission on Radiological Protection (ICRP, 1977), and subscribed to in a broad sense by various regulatory agencies, is comprised of three essential ingredients: (1) [justification] of any practice that produces radiation doses by some commensurate net benefit, (2) [optimization] of radiation control measures by reducing doses to levels that are as low as reasonably achievable, and (3) [limitation] of individual doses to preclude inequities and [moldistribution] of risks. All too often, only the third criterion - the limitation of individual doses to prescribed regulatory limits - is explicitly addressed in everyday radiation protection programs. The emphasis of most exposure control and monitoring efforts appears to be directed toward limiting and documenting individual doses that might approach the legal limit. The first two criteria, i.e. justification and optimization, should contribute to a rationale for allocating monitoring efforts. When applied to individuals, these criteria mean the detection and elimination of unnecessary exposures. This should be a high priority of any monitoring program. Measurements should be directed toward detecting inoperative or ineffective control measures, whether or not there is a risk of exceeding the individual dose limits. The ICRP recommends a procedure that can be used effectively to reduce unnecessary exposures. A n investigation level should be established at an exposure rate substantially lower than the regulatory limit, e.g. 30% of the limit (ICRP 26, 1977, p.33). Measurements obtained during routine monitoring that exceed the investigation level are evaluated with respect to cause and potential reduction. To be effective, the evaluation results should be formally recorded and conveyed both to management and to the workers involved. Although the investigation level recommended by the ICRP is based on a fixed exposure rate or derived air concentration, an equally effective evaluation program may be based on the investigation of a percentage of all measurements. For example, one might investigate the highest 5% or a random selection of all measurements. In any case, the objective is to detect and correct situations that are producing unnecessary exposures. SECOND CRITERION: MONITOR IN PROPORTION TO THE MAGNITUDE OF RISK The ICRP criteria apply generally to all radiation exposures. However, a second priority for monitoring programs should be established on the basis of the nature of the exposures and the magnitude of the health risks involved. Current practices in radiation protection are based on dose limits to specific organs and assessment of individual exposure pathways, with little consideration of the combined doses from various pathways. Although the intent of the ICRP recommendations was to limit the total dose to each critical organ, combined doses from external and internal sources are rarely determined. The recent recommendations of the ICRP (Publ. 26, 1977) are based on the limitation of total health risk from occupational radiation exposures. Implementation of this concept would necessarily require the measurement, calculation and summation of doses and concomitant risks to all organs of the body from all exposure pathways. The U.S. Environmental Protection Agency has taken the first step toward translating the ICRP recommendations into regulations. The proposed recommendations for Federal Radiation Protection Guidance for Occupational Exposures (USEPA, 1981) include provisions for summing the risk-weighted organ doses to determine compliance with an effective whole-body dose equivalent limit. Whether or not the proposed guidance is modified before final adoption, it seems clear that some version of dose summation and combined risk limitation will be included in future regulations. Willowstick has successfully employed a new Seismic Acoustic Resonance (SAR) method to improve seepage characterization through, beneath, and around dams. SAR is a passive seismic method that detects zones of higher permeability in the foundation and fill materials of a dam. Just as the ocean has tides, the earth’s crust experiences daily “Earth Tides” and is constantly in motion. Continual motion produces resonance signals that can be measured, interpreted, and modeled to identify zones of higher permeability within a dam and its foundation. The SAR results are analyzed in conjunction with the traditional Willowstick Method to better characterize seepage flow paths and patterns trough, beneath, or around a dam in three dimensions. When both methodologies, which use entirely different scientific principles, identify the same anomalous feature, a higher degree of confidence is gained in the results of the investigation. Willowstick has effectively utilized the SAR method on many successful dam seepage investigations. The two geophysical techniques when used in parallel have yielded complimentary results, with both methods providing beneficial information about seepage locations. This paper will detail seepage flow paths identified using both Willowstick and SAR methods for two case study tailings dams in Canada and the United States.

The procedure consists of collecting uncontaminated, water, sediment and rock chip samples of the appropriate quantity and/or dimensions to meet the needs of analysis.

The Coastal Water Authority's 2,740mm/2,590mm (108 in./102 in.) pipeline, known as the Northwest Lateral Project, will transport raw water from an existing pipeline over 14.3 km (8.9 miles) to the City of Houston's East Water Purification Plant. The new pipeline crosses under Houston Ship Channel and Greens Bayou in tunnels at approximately 30.5m (100 feet) and 25.9m (85 feet) depths, which present unique experiences in tunneling under open bodies of water in the Gulf Coast's soft ground conditions. An earth pressure balance TBM is being used for the deep tunnel sections where the ground demonstrates high overload factors and variable conditions ranging from clays to silty sands. This paper discusses the design approach for the tunnels and shafts, ground conditions, constructability, and selection of the primary lining system.

Rock bolting or anchoring are methods of stabilization which are not being fully utilized in California and probably in other parts of the world due to lack of understanding of the principles, or due to poor results in actual installation. The problem is greater in California because so much of the rock is either soft or badly fractured and broken. Almost any recognized type of rock bolt or anchor will perform successfully is hard, fresh rock, but the problems become many-fold when working in decomposed granites, shales, soft sandstones or other soft, highly-broken rock. There has been an enormous amount of research by manufacturers, consultants, private organizations, and governmental agencies on rock bolting. It would be impossible to discuss all the methods and philosophies of rock bolting in this paper. Therefore, with the indulgence of the experts, I will give only a very generalized coverage on rock bolting techniques. However, My main purpose is to point out some of the problems of rock bolting in soft rock.

For an industry that provides more than half of the nation’s energy needs, the U.S. coal industry still attracts negative publicity. However, the nation’s energy appetite continues to increase. And political leaders and the public are beginning to understand that alternative fuels will not be enough to keep up with that appetite. Does that mean the nation will now embrace the coal industry? No, according to speakers at the Rocky Mountain Coal Mining Institute (RMCMI) meeting. The industry still needs to sell the public on coal’s advantages over other fuels. And the industry must continue to develop technology that will allow coal to meet and exceed strict clean air and clean water regulations.

Tantalum (Ta) and niobium (Nb) are extracted from many different ore types. The major economic orebody mined for tantalum and niobium consists of tantalite ((FeMn)Ta2O5) and columbite ((FeMnNb2O5)) in a solid-solution mineral commonly referred to as “coltan.” The largest supplying region, The Democratic Republic of the Congo (DRC), is unfortunately also the most ethically compromised source for this critical mineral. Officially, the U.S. government has deemed coltan ore from the DRC a “conflict mineral” [1]. The lack of pragmatic and effective local mining regulation in Central Africa, when coupled with high levels of violence and corruption, has spawned a widespread, illegal, unethical and, most importantly, unsafe economy. This illicit economy is centered around first, illegally mining these valuable conflict minerals and second, smuggling these minerals into the global supply chain. Handheld spectroscopy devices could provide further transparency to these opaque supply chains, giving miners, traders and refiners the ability to authenticate the provenance of the minerals they encounter, and allowing companies to prove compliance with the regulatory agencies attempting to curtail illicit mining.

INTRODUCTION Heat stress continues to be a safety concern in underground mining. This is due to a number of reasons including increasing depths of mining, increased levels of heat generated from machines, ventilation systems being constrained from providing suitable levels of airflow and others. In order to assess if a thermal environment is safe for miners under normal or modified work arrangements, or to specify stop work conditions a heat stress index is used to guide decisions. Historically, a number of heat stress indices have been developed and applied in underground mines. These can be classed under three broad headings; single measurement, empirically based and rational indices. Do any of these indices perform better than the others? Which one allows simple determinations and decisions to be made in the mine? This paper aims to provide answers to these questions by comparing and contrasting three indices; effective temperature (ET), simple air cooling power (ACP) and Thermal work limit (TWL) for a range of typical mining wet and dry bulb combinations? The paper concludes with the identification of areas for future research. BACKGROUND Heat stress causes discomfort, increases physiological strain, decreases productivity and performance, and contributes to increased incidents [1]. Effective management and control of heat stress is particularly important in mining where hot working conditions are very common [2]. Heat stress index is a common indicator that is used by mine safety advisors and managers to guide decisions about safe work practices in mining under normal or modified conditions. According to Howes and Nixon [3] A safe heat stress control strategy for an underground mine has three elements: • Application of an environmental measure which reflects physiological strain with sufficient accuracy for the range of conditions encountered underground. • Acceptance of a functional relationship between the environmental measure and human performance which is used to optimise the environmental conditions achievable with either ventilation or ventilation and refrigeration. • A management control strategy based on the environmental measure which is designed to ensure that work in environments where excessive physiological strain may occur is prevented and corrective action is initiated. The link between these elements is an environmental measure that reflects the physiological strain a worker is subjected to. Since the turn of the twentieth century various indices of thermal stress have been developed (McPherson [4], Howes and Nixon [3], Brake [5]). In selecting a suitable environmental measure or index one problem that must be addressed is the ease with which it can be physically obtained relative to it accurately reflecting the physiological strain. No index can be universally applied and there is no single correct measure or index. However if an index has provided adequate control in a particular circumstance, then it can be regarded as correct for that situation.

Since the Buffalo Creek incident in February, 1972, Federal and state environmental agencies have had the pressure on the coal industry in the Appalachian area to close the coal processing plant water circuits. In an attempt to comply with this requirement, Eastern .Associated Coal Corp. decided to install a vacuum disc filter system at its Kopperston plant to eliminate the tailings pond and reduce the amount of plant make-up water. It was recognized at the time that the plant static thickener tailings would be a very difficult slurry to dewater because of its unusually high clay content. The following is a case history of the Kopperston installation and the refinements Eastern has made in its vacuum disc filter operation to increase efficiency.

Control of radiation hazards in mines is only one of many goals of the Bureau of Mines. Radiation research is only a small part of the Bureau's mine health and safety research program. In this paper I will describe the mission and programs of the entire Bureau of Mines, with emphasis on the mine health and safety program of which our radiation research is a part. The radiation program and its results will be described in detail by other speakers during this symposium. The Bureau of Mines was established in 1910 and is one of a number of agencies within the Department of Interior. Our mission is given by the Organic Act of the Bureau of Mines, last revised in 1913, which still accurately describes our work today. The amended Organic Act (Public Law 62-386) gives the Bureau authority "... to conduct inquiries and scientific and technologic investigations concerning mining, and the preparation, treatment, and utilization of mineral substances with a view to improving health conditions, and increasing safety, efficiency, economic development, and conserving resources through the prevention of waste in the mining, quarrying, metallurgical, and other mineral industries; to inquire into the economic conditions affecting these industries..." Since 1913 at least 52 public laws bearing on Bureau responsibilities have come into force. However, our basic role is still unchanged, i.e. improving health conditions, and increasing safety and efficiency in the mineral industries. The two principal activities of the Bureau are Minerals Information and Analysis and Minerals Research. The Minerals Information and Analysis programs provide the data base and the analytical capability to support the development of effective national mineral policies. Data on the availability, production, and utilization of minerals are collected, interpreted, and analyzed for some 100 commodities. Resources of the most important commodities are evaluated to support policymaking that influences utilization of the Nation's existing and potential mineral supplies. The President's budget for the Mineral Information and Analysis programs in fiscal year 1982 is $34 million. The largest activity of the Bureau is Minerals Research, which is divided into three major programs: Mineral Resources Technology, Minerals Environmental Technology, and Minerals Health and Safety Technology. The principal goal of the Mineral Resources Technology program is to help provide technology to maintain an adequate supply of minerals for the United States. The budget requested by the President for this program in fiscal year 1982 is $41 million. The goal of the Minerals Environmental Technology Program is to create mining and mineral processing operations that are more compatible with the environment. The budget for this program in fiscal year 1982 is $12 million. The largest program of the Bureau is Minerals Health and Safety Technology, which has the goal of providing the technology to protect the health and safety of mine workers. The budget for health and safety research for fiscal year 1982 is $55 million. Our radiation research is part of the health and safety research program. The Bureau of Mines has done research to improve health and safety conditions in mines since it was established in 1910. The research expanded greatly following the passage of the Federal Coal Mine Health and Safety Act of 1969 (Public Law 91-173) and the Federal Mine Safety and Health Amendments Act of 1977 (Public Law 95-164). These acts provided for increased health and safety regulatory activities, but they also significantly increased the funding available for mine health and safety research by the Bureau of Mines. Funding for the Bureau's health and safety research grew from $12 million in 1970 to $60 million in 1981. The funding in 1982 will be somewhat lower than that for 1981. However, the health and safety program funding is still approximately 40 percent of the total budget of the Bureau of Mines. Of the health and safety budget, 22 percent is spent on research to control health hazards in mines, including radiation hazards, which has a budget in 1982 of approximately $1.1 million. Other mine health hazards which the Bureau is doing research to control include respirable mine dusts which cause black lung and silicosis; excessive noise; toxic gases from explosives and diesel emissions; and excessive heat in deep hot mines. The other 78 percent of the budget is spent on safety research to prevent death and injury to miners from such causes as roof falls, fires, explosions, and accidents involving mining equipment. Over the past decade the majority of the Bureau's health and safety research has been done through outside contracts with private industry and universities. Our policy has been to do some research inhouse to maintain the expertise of Bureau personnel. Contractors are used to do research for which the Bureau does not have the necessary personnel available. The percentage of the program being done by contract has been gradually declining for the past few years, and in 1982 the program will be divided evenly between inhouse and contract research. The inhouse research of the Bureau is done at the 10 research centers located throughout the country. Our radiation research is done at three research centers, Denver, Spokane and Pittsburgh, and by contractors whose work is monitored by project officers at these centers. This study focuses on the amosite mining region in South Africa and associated health effects, compared to other mined asbestos fiber types. Historically, dust and fiber levels were high in the amosite mills and mines, and many miners and members of the surrounding communities were exposed to the fibers. Research has shown that amosite produces both benign and malignant disease. Nevertheless, the mesotheliomagenic potential of amosite is several fold lower than crocidolite. The risk of disease associated with amosite exposure is difficult to quantify. Reasons for this include the scarcity of available information, including fiber measurements, and case ascertainment, as well as the juxtaposition of the amosite and crocidolite asbestos seams in South Africa. © 2007 Elsevier Inc. The proposed Caldecott fourth bore will consist of a two lane highway tunnel along California State Route 24 near the City of Oakland. The proposed design and construction sequence for the 15-m-diameter tunnel are based on the New Austrian Tunneling Method (NATM). The initial support system incorporates combinations of shotcrete, rock dowels, lattice girders, spiles, and grouted steel pipe canopies. The final lining is cast-in-place reinforced concrete. A waterproofing membrane and drainage system are placed between the initial and final linings. State Route 24 is a lifeline route, required to be open to emergency vehicles within 72 hours after a major earthquake, defined as having a return period of 1,500 years and a peak ground acceleration of 1.2 g. Although the seismic design criteria are stringent, the design of the tunnel lining system is ultimately controlled by static ground loads in the weak rock along the alignment.

Increasingly, geotechnical data are being collected for various types of coal development projects. In many cases, a specific design concern is addressed. However, many data collection programs are not intended to immediately support mine design activities or to resolve a specific concern. The following discussion describes some current geotechnical approaches in mine planning, development of reserves, and peripheral activities. Types of Data Collection Programs Geotechnical data collection is increasingly becoming a part of standard coal exploration programs, performed along with stratigraphic evaluations and coal quality tests. The aims of such programs vary. The purpose of the exploration may be to fill out the portfolio on a block of reserves that is to be sold, leased, or held for potential future development. In such a case, a generic suite of geotechnical data are collected. The resulting engineering reports may touch on the more well known mining problems of the area, but detail may be lacking. The geotechnical data are mostly intended to enhance the saleability of the package. Mine design alternatives are generally not addressed.

In a recent speech in Pittsburgh, Dr. George Keyworth, the President's Science Advisor, made a statement which I believe deserves our very careful consideration. Dr. Keyworth said that there is no energy crisis. The crisis, he explained, is simply that people refuse to accept the solution. The solution which Dr. Keyworth has in mind is increased utilization of our abundant supplies of solid fuels and, in particular, uranium. I share his view concerning the solution to our energy needs. The use of uranium fuel is a safe, clean, and dependable means to generate our electric power. It is time that we addressed the real energy crisis: the refusal to accept the nuclear solution. The reason for the refusal is not difficult to find. It is nihilistic thinking about risk. Under this thinking, we assume the worst possible case and act accordingly, simply because we cannot prove to a total certainty that nuclear energy is perfectly safe. If this absolutist approach were generally applied throughout our society, there is no doubt all of us would soon be sitting around our campfires fearfully holding the wild animals at bay with our trusty spears. Today I am here to enlist your support in reversing the regulatory trend that threatens the very extistence of the nuclear power industry. As distinguished scientists, engineers and businessmen, you can use your influence to help bring rational regulation to the industry. Our industry supports strong safety and environmental protection programs. We understand the need for and do not object to reasonable regulation. Many anti-pollution measures can be practical to implement, cost effective and highly successful in minimizing environmental impacts. However, it is a fact of life that in the field of health and safety regulation, the law of diminishing returns operates with a vengeance. Absolute or near-absolute safety is impossible and any attempt to achieve it is intolerably costly. Fixation on absolute safety is particularly acute in the regulation of the nuclear power industry. Government Agencies, overly anxious to allay the irrational fears of those opposed to nuclear power, are literally regulating the industry to death - exactly the result sought by the anti-nuclear groups. Dr. Robert L. DuPont wrote in a recent issue of [Business Week]: "The nuclear power industry has been virtually stopped in the U.S. [because of fear]. This is true despite the fact that for more than 20 years the commercial nuclear industry has operated under unprecedented public health scrutiny and that to date there have been no radiation-related injuries, let alone deaths, suffered by any member of the public."1 I believe a useful way to convey the nature of the problem faced by the nuclear industry is to review an example of [unreasonable] regulation. While the example relates to our domestic industry, I am certain there are similar situations in other countries. For the example I will use the Nuclear Regulatory Commission's recently issued regulations governing the stabilization of uranium mill tailings.2 These regulations, known as the Uranium Mill Licensing Requirements, specify, among other things, that radon emanation from uranium mill tailings be limited to no more than 2 pCi/m2-sec. First, one must understand that this standard will have virtually no impact on the total amount of radon to which the public is exposed. Radon emitted from even completely unstabilized tailings piles is a tiny fraction--much less than 1%--of the amount of radon released from natural soils in the United States.3 In fact, it is far outweighed by natural variations in the background flux. For example, changes in the level of the Great Salt Lake in recent years have had [eight times] as much effect on the amount of radon released into the Salt Lake City regional air than the annual release from the Vitro Mill tailings pile located in that city.4 Nevertheless, NRC claims that the standard is required to protect the public. The Commission admits, however, that there are no studies which establish that exposure to radon at the low levels associated with uranium mill tailings will result in any adverse health effects.5 In the absence of actual evidence, the Commission assumes that some such effects will occur on the basis of the linear, non-threshold model.6 Employing this model, NRC calculates that the maximum hypothetical risk for the average member of the population is only about 1 in 70,000,000 from the radon that would be emitted from [three times] the number of mills now in existence, even if the tailings produced through the year 2000 are left unstabilized.7 NRC has elsewhere explained that this level of risk would be equivalent to the risk posed by "a few puffs on a cigarette, a few sips of wine, driving the family car about 6 blocks, flying about 2 miles, canoeing for 3 seconds, or being a man age 60 for 11 seconds." This level of risk is [de minimis] in comparison to other risks commonly and readily incurred in our society.9 Moreover, even this remote risk is overstated. A group of prominent health physicists, including experts from the Department of Energy, The Environmental Protection Agency, Britain, Canada and Germany recently published a study indicating that the risk to the public per unit exposure to radon can be no greater than one-third that suggested by the Commission, and [may in fact be zero].l0 Regulators routinely rationalize the need for their regulations. For example, NRC attempts to justify the radon flux standard because it is necessary to reduce the risk to someone who builds a house on top of a tailings pile. This possibility, however, is totally unrealistic because the Mill Tailings Act requires that stabilized tailings be transferred to
