"How Wall Street Darling Molycorp Undermined the U.S. Economy, Degraded our National Security and Distorted the Global Economic Balance and How These Falsehoods Continue to be Promoted Even Today INTRODUCTION & SUMMARY In 2007 the Molycorp Mountain Pass rare earth mine was resurrected from its desert-grave in California by its then-owner Chevron Mining. Responding to elevated rare earth prices Chevron began processing on-site rare earth concentrates left over from past mining operations that were terminated in 1998i. Chinese demand had sparked what was being described as a commodities super-cycleii. Commodity prices were on the move. Wall Street smelled opportunity. In 2008 Goldman Sachs, Pegasus Partners, Resource Capital Funds, Traxys North America LLC and Carint Group LLC acquired the mining assets from Chevron. In an environment of ever-declining ethical standards and regulatory consequences the private capital group and their investment bankers would bring Molycorp to market. Molycorp, with its high powered investment banking team of Morgan Stanley and J.P. Morganiii, easily dominated the contest. Molycorp promoted itself, largely based on its past operating history and proven reserves, as the best company to challenge China’s monopoly control over the production of rare earths: a group of elements critical to most advanced technologies and U.S. defense systemsiv. Most of Wall Street’s hottest investment sectors were dependent on these materials: alternative energy, green technologies, computing, personal communications, advanced electronics and defense systems. By late 2010 there were dozens of prospective rare earth start-up ‘mining companies’ seeking capital. Eventually the number of prospective rare earth mining companies seeking capital exceeded 400, despite the reality that supply requirements of this market were disproportionally small when compared to other natural resource sectorsv. In the world of finance ‘smart money’ picks the winners. Consequently just twovi projects attracted nearly all of the capital (Molycorp and Lynas). Wall street picked Molycorpvii. This paper will primarily focus on Molycorp. By early 2010 the words “Molycorp” and “Rare Earths” electrified many people in the mining industry, most non-Chinese manufacturing technology companies, U.S. & allied defense contractors, technocrats in the U.S. national security community and eager investors across most of the world’s stock markets. It was the hottest story of the yearviii. The financial, technology and defense press coverage verged on euphoric: heaping fuel on fuel until the highly combustible Molycorp-pyre cast a long shadow over all of its rivalsix. When the IPO match was lit the spectacular flaming pyre sucked all of the oxygen out of the rare earth spacex. Molycorp was ranked the most lucrative IPO of 2010, resulting in record breaking profits to its private investors and massive returns for its early stock holding investors."

"Early on Jan. 9, 2014, approximately 37,800 L (10,000 gal) of crude 4-methylcyclohexanemethanol (MCHM) leaked from a storage tank sitting on the bank of the Elk River near Charleston, WV (WVDEP, 2014; CSB, 2014). MCHM is a chemical commonly used in preparation of fine coal and is considered nonhazardous in terms of transportation, storage regulations and also toxicity (CDC, 2014a). Freedom Industries Inc., a producer and vendor of specialty chemical products, had acquired the storage facility from Etowah River Terminal, LLC just a few weeks prior in December 2013 (WVDEP, 2014; Freedom, 2005). The direct cause of the spill was ultimately determined to be two small holes in the base of the 76-year-old tank, which were created due to corrosion damage (Bauerlein and McWhirter, 2014).The spill site was located a little more than 1.6 km (1 mile) upstream from the intake of a municipal water treatment facility operated by West Virginia American Water (WVAW), which serves a population of 300,000 across nine counties in central West Virginia (CDC, 2014a). In a matter of hours, the leaked MCHM made its way through the treatment facility and into the water of nearby homes and businesses, where its strong smell was noticed almost immediately. On the evening of the spill, WVAW concluded that its conventional treatment processes, which include carbon filters to remove a variety of contaminants from water, were not capable of fully removing the MCHM and a "Do Not Use" order was issued for all customers (WVAW, 2014a).With little information readily available regarding the potential human health effects of MCHM, the U.S. Centers for Disease Control and Prevention (CDC) quickly issued an advisory ruling that set a maximum screening level of 1 ppm for safe drinking water (CDC, 2014a). Based on this recommendation, the "Do Not Use" order remained in effect for a total of eight days, until Jan. 17, when the WVAW distribution water was confirmed to have MCHM concentrations below the approved level (WVAW, 2014a). However, due to the pungent odor of the chemical, its presence was still recognizable in the WVAW facility and in consumers’ tap water after the order was lifted (Manuel, 2014). Recent studies have shown that the chemical can be detected in water at sub-ppb concentrations, a fact that undoubtedly added to growing public concern (Rosen et al., 2014; Gallagher et al., 2014). In response to numerous complaints and demands, WVAW continued flushing the treatment facility and pipes until Feb. 25 when MCHM levels were measured below 2 ppb (WVAW, 2014b), and eventually replaced the affected filter media (WVAW, 2014c)."

Introduction ASARCO's Ray Operations include an open-pit copper mine in the Mineral Creek Mining District of Pinel County. The district is located in east central Arizona, 132 km (82 miles) southeast of Phoenix, AZ, and 126 km (78 miles) north of Tucson, AZ. The mine lies 8 km (5 miles) north of the Gila River in Mineral Creek Valley, between the Tortilla Mountains to the west and the Dripping Springs Range to the east. The rich copper deposits of the Mineral Creek mining district were first noted by a US Army Officer in 1847. The Ray Copper Company was the first major operation in the area. The company was named after the Ray mining claim, which was one of the earliest recorded claims. After decades of sporadic and unsuccessful mining ventures, the Ray Consolidated Mining Company was formed in 1910. The company introduced one of the first successful block caving operations in the world. In 1933, the Kennecott Copper Corporation acquired the Ray Consolidated Mining Company and continued operation of the mine under the same name until 1943, when the property was renamed the Ray Mines Division of Kennecott. Underground mining continued until 1955, when the mine was converted to an open pit operation. In November 1986, ASARCO Inc. purchased the Ray Mines Division and related facilities from Kennecott. The purchase also included the Hayden concentrator and the Ray Smelter, located approximately 32 km (20 miles) from the Ray Mine. This paper summarizes the 54,400 tpd (60,000 stpd) in-pit crusher and overland-conveying system and the 24,200 tpd (30.000 stpd) copper SAG concentrator and tailings disposal system constructed at ASARCO's Ray Complex - Ray Operations. General description of facilities The Ray concentrator includes a sulfide SAG concentrator, a "relocatable" in-pit primary-crushing plant and overland-conveyor system, a concentrator tailings-disposal system and plant ancillary facilities, The major elements of the project include: • A relocatable Fuller-Traylor in-pit 1524-mm (60-in) x 2261-mm (89-in) primary gyratory crusher at the 442 m (1450 ft) mine elevation. The crushing plant has a nominal capacity of 54,400 tpd (60,000 stpd) of sulfide ore. • A 1524-mm (60-in) wide x 1253-m (4110-ft) long overland belt conveyor, which runs from the in-pit crushing facility to a transfer station serving both the Ray Concentrator and the existing Hayden concentrator railroad load-out facility. • A 1524-mm (60-in) wide x 152-m (500-ft) long stackerbelt conveyor, which delivers a nominal 27,200 tpd (30,000 stpd) of ore from the transfer station to a 23,600 t (26,000 st) live-capacity coarse-ore stockpile serving the Ray Concentrator. • A nominal 27,200-tpd (30,000-stpd) concentrator, including semiautogenous grinding, flotation, copper concentrate filtration and associated plant ancillary facilities. • A tailings disposal system. Flotation tailings are pumped from the Ray Concentrator to a 122-m (400-ft) diam. thickener, located 4.8 km (3 miles) southeast of the Ray Concentrator site. The thickener overflow is pumped to two 76.2-m (250-ft.) diam. concrete process-water reservoirs. The thickener underflow, at 45% solids, is pumped to a new tailings disposal site located at Elder Gulch. • An HDPE-lined temporary-containment area to collect material from Ray Concentrator plant upsets and local storm-water run-off from a 100-year, 24-hour rain event. •A reclaim-water system from the Elder Gulch tailing pond area to the Ray Concentrator. • A 610-mm (24-in.) diam. x 31.9-km (19.2 mile) long fresh-water pipeline from the Hayden fresh-water-well field system to the Ray Concentrator. The overall process design criteria for the new Ray Concentrator is based on a nominal throughput of 27,200 tpd (30,000 stpd) of ore at 90% plant availability. However, based on the maximum performance capacity of the installed grinding equipment, it may be possible to achieve a sustained operating level in excess of 36,300 tpd (40,000 stpd) when processing soft ores. The scrutiny given to model predictions of pit-lake water quality has focused attention on the uncertainty associated with long-term predictions. Although comparison of probabilistic predictive modeling of water quality in existing pit lakes indicates that short-term predictions can bracket most parameters, uncertainties in wall-rock reactions and the stability of groundwater composition and climate remain unquantified. This overview of the uncertainties associated with longer-term predictions is presented as support for those considering policy decisions that must be made in the absence of reliable estimates of future conditions.

During the 14 years since the last update to National Instrument 43-101 (NI 43-101), there have been many discussions between Canadian regulators and mining companies about mining disclosure deficiencies that arise from regulatory reviews. These discussions are not made public, and as a result, there has been some drift in how NI 43-101 is interpreted by the regulators, which in turn creates uncertainty for the mining companies trying to comply with the instrument. To reduce uncertainty in mining disclosure requirements, the Canadian Securities Administrators (CSA) has issued a notice to update the current NI 43-101 with a streamlined instrument and form. Changes and benefits are listed in the “CSA Notice and Request for Comment — Proposed Repeal and Replacement of National Instrument 43-101 Standards of Disclosure for Mineral Projects,” which is available on the Ontario, Quebec, Alberta and British Columbia Securities Commission websites. The public has been invited to comment, with the comment period ending on Oct. 10, 2025. The 43-101 Companion Policy (43-101 CP) provides an update to the views of the regulators on how the CSA staff interpret and apply certain provisions of the instrument. Collectively, some of the changes to NI 43-101, the form and 43-101 CP are likely to increase the financial and other burdens on the mining companies responsible for the disclosure, and the qualified persons (QPs) who create the disclosure. In other instances, there are missed opportunities to reduce the burden on mining companies and QPs without impacting the markets.

Trust in AI systems and the nature and amount of information about the system can influence decision-making. It is, therefore, crucial to understand how AI-powered monitoring systems (e.g., gas monitoring systems) influence miners’ trust and decision-making in emergency evacuation. This work focused on measuring the differences between how participants respond to a simulated underground mine emergency evacuation situation when warnings are represented as coming from a human or AI-based monitoring system. We also manipulated the amount of information participants received about the system, yielding a 2×2 between-participants survey design. The participants received an alert message about rising gas levels in a mine and provided a response on how they would react and reported their perceived safety. We also asked questions to assess their trust in, preference for AI over human-based gas monitoring systems, and whether they are willing to delegate the duties of underground gas monitoring to AI systems. The experiment results show the amount of information had a significant influence on miners’ trust and decision-making. The safety perception of participants based on age, number of children and ethnicity was significantly different from one category to another. This work provides valuable insights as the mining industry deploys AI systems to aid mine safety.

Data transmission, communication, tracking, and the connection of equipment such as gas detectors, cameras, and collision avoidance systems in today's tunnel industry are critical pieces of the constructor's infrastructure. Reliability, flexibility, redundancy, and cost-effectiveness are key in selecting and implementing inte- grated systems. Both wired and wireless components are used to deliver custom solutions and can involve interconnectivity between backbones. Systems integration is important as industry adopts proven technologies from other industries. Case stud- ies are given showing how tailor-made approaches deliver needed functionality, with varying degrees of com- plexity, in various classifications of environment, in order to meet a project need.

The Work Crew Performance Model (WCPM) is a method for designing, implementing, and evaluating? performance improvement strategies for machine operators and other mining personnel. The WCPM offers a practical approach for measuring job proficiency and identifying costly behaviors. It enables interventions aimed at performance improvement, especially training, to be assessed monetarily. Two interrelated elements of the WCPM are emphasized: observational techniques for establishing performance baselines and measuring performance outcomes and cost linkages between job competencies and measures related to profitability. Inter-and intra-subject differences in performance-related behaviors of regular and incidental shuttle car operators were detected during field validation of the WCPM. Downtime data were used as outcome measures to test linkages between performance error rates and cost consequences. Use of a simulation program for analyzing continuous mining face operations showed how common shuttle car operating parameters (e.g., payload, tram rate) can be used as cost-conscious indicators of performance variability and therefore as targets for performance improvement.

"Excavation and initial support of the New Irvington Tunnel presented significant challenges, including rapidly changing ground conditions, heavy ground loads, and squeezing. Such behaviors were anticipated from historic tunneling records of the adjacent Existing Irvington Tunnel, and extensive site investigation, but clearer understanding of their actual extent and causes has resulted from convergence measurements, observations of ground behavior, initial support monitoring and detailed geologic mapping. Time-dependent movements, documented hours to months after excavation in clay-rich rock and in moderately to intensely fractured rock, identified squeezing areas, allowed classification by currently-used predictive methods and added to the list of lessons learned in tunneling such ground. INTRODUCTION In March 2003 the San Francisco Public Utilities Commission (SFPUC) authorized funding for the $4.6 billion Water System Improvement Program (WSIP) to repair, replace, and seismically upgrade its water system. The program consists of 35 local projects located within San Francisco and 48 regional projects located in several counties from the Sierra foothills to the San Francisco Bay Area. The New Irvington Tunnel (NIT), a key component of the WSIP, is located east of Fremont in Alameda County, on the east side of San Francisco Bay. The NIT is a new 18,660 foot (5,689 m), redundant tunnel, 190 to 670 feet (58–204 m) offset from, and subparallel to the Existing Irvington Tunnel (EIT). Built between 1928 and 1932, the EIT was constructed with an unreinforced cast-in-place concrete lining and is vulnerable to damage in the event of a major earthquake along the two closest active faults. The Hayward Fault is located less than a mile west of the tunnel, and the Calaveras Fault is located half a mile east of the tunnel. Although the alignment does not intersect these faults, the shaking and sympathetic displacement along secondary faults that cross the tunnel alignment are potential hazards. The NIT provides a seismically reliable water transmission facility capable of withstanding earthquake damage and maintaining continuous water service after a major earthquake. The NIT also adds system redundancy and provides for operation flexibility of running water through both tunnels, or through one tunnel while the other is out of service for inspections and maintenance."

In the 1940's a top blown water-cooled oxygen lance was developed to inject oxygen into liquid iron. This process, the LD or BOF process technique, today is used in 65% of the world's steel production, and represents the largest oxygen market for temperature enhancement in steel and non-ferrous smelting applications. There are three major approaches to the use of oxygen in metallurgical processes: (1) general enrichment of the air supplied to burners or tuyeres, (2) under-flame enrichment or injection, and (3) the use of an auxiliary oxy-fuel burner as a heat source. With each of these techniques there are technical and economic trade-offs.

Separation of geochemical anomalies from the background using various methods for identifying areas of higher mineral potential is a critical first step in Greenfield and Brownfield programs. There are several methods for differentiating anomalous regions from the background. The U-spatial statistics is an effective technique that provides the opportunity of reaching this goal by considering the geochemical sample locations in the separation of geochemical anomalies. In this study, a developed form of the U-spatial statistics method is introduced, which not only considers the existence of anisotropic spatial variations in input data but also reduces the computational (CPU) time. While the previous method is based on the isotropic assumption in the study area and a set of search windows at different times, here, the geochemical anomaly is determined by pasting only one ellipsoid window, effectively combining the flexibility of the U-spatial statistics method with the advantages of geostatistical approaches. This paper compares various approaches (the previous and developed version of the U-spatial statistics method, concentrationarea (C–A) fractal model, and probability diagram modeling) for the separation of anomalous areas in the presence of heterogeneous spatial variations. This is done with an application to a Baghqloom porphyry copper deposit located in southeastern Iran. The high potential areas identified via different approaches show an anomalous region in central parts of the Baghqloom area, which partially coincides with an intense potassic alteration area. Compared to other methods, our algorithm separated the high potential areas at a greater spatial resolution.

Ground Freezing was used for excavation support and groundwater control of a 12.8m (42-foot) diameter, 61m (200-foot) deep drop shaft for the South Bay Ocean Outfall Tunnel in San Diego, California. Approximately half way through the excavation, excessive groundwater inflows from the base of the shaft resulted in suspension of excavation and evaluation of the frozen earth wall. This paper discusses the forensic methods used to identify the zone where groundwater intrusion occurred and the methods associated with evaluating zones of high groundwater velocity. The use of remedial grouting and localized liquid nitrogen injection are discussed and evaluated. Concepts of frozen shaft design are discussed, including a new method for permitting the launch of the Tunnel Boring Machine through the frozen earth wall and associated freeze pipes.

"Mineworkers are routinely tasked with making critically important decisions about whether or not a hazard presents an imminent danger. Researchers from the National Institute for Occupational Safety and Health (NIOSH) collected formative data to investigate mine safety professional perspectives on workplace examinations, which revealed a potential gap in how mineworkers are assessing risk. During interviews, participants indicated having processes in place for what should be done once an imminent danger situation is identified. Critically, however, they report having no systematic methodology for mineworkers to use to determine if a hazard is considered imminent danger. While this is important for all imminent danger situations (e.g., failure to lockout/tagout), it is especially important for those situations that are not immediately recognizable as imminent danger. In this paper, we identify and describe, three distinct categories of imminent danger complexity and discuss potential steps that could lead to improved identification of imminent danger situations. Finally, we identify potential practices to incorporate into risk management efforts, including feedback, communication, and specialized training to increase awareness of imminent danger situations. INTRODUCTION In recent years, the metal and nonmetal (M/NM) mining sector, as categorized by MSHA, experienced an increase in the number of fatalities occurring at mine sites. From 2013 to 2015, 69 mineworkers were fatally injured; that is twice the number of fatalities that occurred in each of the previous two years (MSHA, 2015a). As a way to address this increase, the Mine Safety and Health Administration (MSHA) issued a program policy letter (P15-IV-01) suggesting that “miners would benefit from rigorous workplace examinations conducted by experienced and trained examiners (MSHA 2015b).” The goal of workplace examinations is to find hazards in the field and mitigate them before they cause injury or death to mineworkers. While it is important to identify all hazards in the workplace, it is critically important to identify those hazards that are considered imminent danger because they require an immediate response to avoid a severe or even fatal injury."

This study tries to predict blast-induced flyrock using intelligent modelling techniques. Flyrock is a site-specific phenomenon. Design variables and rock properties highly influence flyrock throw distance. Site investigations were conducted in a sandstone quarry. Fundamental operational parameters, blast dimensions, bench face condition, and rock mass structure were monitored. Stepwise regression technique was applied for variable selection. Burden–hole diameter ratio, in situ block size, and powder factor were determined as the most significant parameters. Considering output of stepwise regression, artificial neural network, ANFIS, and Gaussian process regression techniques were applied to predict flyrock throw. A comprehensive validation was performed using twelve different performance indices. Pre-determination of input parameters supported development of successful soft computing applications. Rock block size was found to be an appropriate input variable for flyrock modelling. In addition to classical performance indices, standardized and symmetric accuracy metrics were quite useful in model validation process. The intelligent models predict flyrock range with an error less than 6 m. The mean percentage errors are lower than 10%. ANFIS seems to be the best model for flyrock prediction. The calculated mean absolute error is 5.36 for ANFIS model.

Within the metal/nonmetal mining sector, fall-related incidents account for a large proportion of fatal and non-fatal injuries. However, the events and contributing factors leading up to these incidents have not been fully investigated. To help provide a clearer picture of these factors, an analysis of imminent danger orders issued by the Mine Safety and Health Administration (MSHA) between 2010 and 2017 at both surface and underground metal/nonmetal mine sites revealed that most orders are associated with fall risks. Of these cases, 84% involved the workers not using fall protection, fall protection not being provided, or the improper use of fall protection. Fall risks for workers most frequently occurred when standing on mobile equipment, performing maintenance and repairs on plant equipment, or working near highwalls. In most cases, a single, basic, corrective action (e.g., using fall protection) would have allowed workers to perform the task safely. Overall, these findings suggest that a systematic approach is needed to identify, eliminate, and prevent imminent danger situations. Furthermore, to protect mineworkers from falls from height, frequently performed tasks requiring fall protection should be redesigned to eliminate the reliance on personal fall protection.

All persons and communities that have experienced strong-motion earthquakes are convinced of the importance and complexity of earthquake problems thatmust be solved in order to reduce the personal hazards and property losses to a reasonable minimum. It is also clear that absolute elimination of all risks is impossible. Reduction of existing hazards and precautionary measures which will minimize chances for disaster can be accomplished by realistic appraisal of the effects of recent earth- quakes on modern structures and installations. Localities that have reason to expect so-called strong- motion earthquakes can anticipate these effects by taking appropriate steps. Valid earthquake information can only be obtained from earthquakes. Each earthquake contributes to the body of knowledge by additional facts and by clarification of previous observations. Rational interpretation of the data followed by practical application of the conclusions can contribute greatly to the safety of persons and property. The general public expects the architectural and engineering profession to accept this obligation and render this service. Most earthquake hazards are man-made and arise from the imperfections of the works of man and his failure to anticipate the consequences when the natural characteristics of his environment are ignored. If it is not given to man to prevent such natural phenomena as earthquakes, it is sometimes within his power to control their destructive effects and to reduce to a minimum the toll of life and human suffering.

This paper outlines a unique case of the development of strategies to reduce ventilation and heating costs in Konsuln iron ore mine in northern Sweden. The mine, located just south of Luossavaara-Kiirunavaara Aktiebolag’s Kiruna iron ore mine, was developed as a test mine from 2018-2020 for the Sustainable Underground Mining (SUM) project. Besides functioning as a test mine, Konsuln also contributes to ore production. The existing mine ventilation system was designed for the current production rate of 0.8 million tons per annum (Mtpa). There is a plan to increase this rate to between 1.8 and 2.0 Mtpa.

Improving the mineral industry's tarnished image describes in a nut- shell the reason why the Speakers Bureau of the Tucson Subsection of the AIME was formed. Let's go back in time about 3 years to the fall of 1971. Literally thousands of bills detrimental to the mineral industry were being introduced into Congress and State Legislatures. Unfortunately, many were being passed and signed into law. Clean air and water, zero pollution, preserve the environment, ecology, biodegradeable, wilderness were the words that the self- styled ecologists and environmentalists were preaching. The mineral industry either sat mute or in place of acting, reacted in a way certain to attract a maximum amount of bad publicity with a minimum amount of rhetoric. A mining company president, for example, commenting on the primary air standards in Arizona was reported by the press as having said, "we'll shut all the smelters down and put thousands of Arizonans out of work if we have to meet the Arizona standards." Or another defending a poorly planned highly visible open pit nonmetallics operation, "we'll take the whole mountain down if we want to, and nobody can stop us" and still another manager of Operations, "the bottom line is all that counts, to hell with all of this environmental nonsense."

INTRODUCTION The increasing concern for the environment may well present far more opportunities than problems for those involved in all phases of tunneling. All too frequently in the past, environmentalists and their concerns have been cast in a negative light, as obstacles to be overcome. Often forgotten is the fact that these same environmental concerns have created a rapidly increasing demand for new tunnels. Tunnels for rapid transit projects, clean water supply, and sewage treatment have been given a boost because of environmentalists' concerns about overuse of automobiles, inadequate water supplies, and improper sewage disposal. Concurrent with increasing use of tunnels to help solve or alleviate some of our environmental problems is an obligation not to create new ones in the process. Concerns which we feel responsible tunnel owners, engineers, and contractors should address themselves to include: (1) Minimum energy consumption, both during construction and in operation of the completed project; (2) proper storage and/or disposal of the excavated material; (3) minimum disruption during the construction process - noise, traffic, unnecessarily unsightly work areas, and possible weakening of foundations of nearby structures; and (4) a finished project consistent with community and environmental goals. We are especially concerned about two things. First, the longrun implications of a project -- what's good for a few people in the short-run may be bad for most of the people in the long-run. Cutting corners to save a little money now is false economy. Second, the fact that ultimately we all share the same earth -- its water, air,
