Proper illumination is critical to a miner?s ability to detect hazards in underground mines. Moving hazards are often located in the miner?s peripheral field-of-view, while slip/trip/fall hazards are often located in the forward field-of-view. The objective of the research described in this paper was to determine if light-emitting diodes (LEDs) improve visual performance as compared to traditional incandescent (INC) cap lamps. The research presented focuses on comparative studies of a National Institute for Occupational Safety and Health (NIOSH) prototype LED, a commercial LED, and an INC camp lamp. Thirty subjects participated in these studies; ten subjects in each of the age groups: 18 to 25 years, 40 to 50 years, and 51+ years. Visual performance was quantified by the subjects? speed and accuracy in detecting hazards, while visual performance for disability glare was quantified by the use of contrast sensitivity tests. Results suggest that LEDs with a visible spectrum containing a higher concentration of the shorter wavelengths can enable visual performance improvements with respect to disability glare, the detection of moving hazards in the peripheral field-of-view, and the detection of floor hazards in the forward field-of-view. The NIOSH prototype LED cap lamp provided the best visual performance improvements for the older age groups in every test. Introduction Over the last five years, a large number of small- to medium-sized carbon-in-pulp treatment plants have been built in Australia, most designed to treat between 250,000 t/a and 1.5 Mt/a of ore. Because of the limited capital resources and tight cash-flow positions of these relatively small mining companies, the primary requirement was often to get a plant built and operating in a short period of time and at minimal capital cost. Therefore, since the inclusion of both pre-leach and tailings thickeners represents an obvious and significant capital cost, most of these plants were built without thickeners or even detailed, cost-benefit analyses on their inclusion. In some cases, the increasing use of High Rate Thickeners (HRTs) in the mineral processing industries has, however, resulted in a reassessment, because of their considerably lower cost. This reassessment was triggered primarily by the need to conserve water in arid mining areas where borefields are costly to install and water is limited. With the startup and operation of these installations, the resulting significant savings in cyanide consumption has been recognized, in many situations, as a primary justification for the installation of HRTs. Solution balances Degradation of cyanide occurs in the tailings water discharge to slime dams. The degree of degradation (cyanide loss) in the water recovered depends on a number of factors, but it is usually assumed to be about 90%. The most important mechanisms of CN loss are through HCN losses and oxidation by oxygen in the air, which also assists in the hydrolysis of CN. These mechanisms are supported by the large dam surface area and the long retention time of the tailings water in the dam. By thickening the CIP tailings at the plant and recovering as much tailings water as immediately possible, these losses are avoided. The retention time in an HRT is less than three hours, and the surface area is relatively small. Therefore, CN losses are negligible, which is not necessarily the case in conventionally-sized thickeners. Fig. I shows a block diagram of a 100-t/h gold plant without a thickener. In this example, 50% of the tailings water pumped to the tailings dam is recovered, and the CN concentration of the returned water is 10% of the tailings CN concentration of 150 ppm. Fig. 2 represents a plant with an HRT on tailings, thickening to 55% w/w solids. In this case, the thickened tailings are pumped to the dam, and 25% of the contained water is recovered. The recovered water and the mill make-up water are not sent directly to the mill; instead, they are added to the thickener feed and mixed with it prior to thickening. By doing this, the tailings are effectively washed, and the additional cyanide is recovered. Solution balances over these two circuits show cyanide recoveries of 5% and 65%, respectively. Thus, the thickener use increases cyanide recovery by 60%. Fig. 3 shows a two-stage HRT circuit in a countercurrent decantation (CCD) configuration. In this example, an additional 13% of cyanide is recovered through the use of the second-stage unit. This configuration can be justified when residual cyanide levels are high. The restoration of surface mining landscapes requires the (re)creation of ecosystems. In Lusatia (eastern Germany), large-scale open-cast lignite mining operations generated spoil dumps widely consisting of acidified, phytotoxic substrates. Amelioration and rehabilitation measures have been developed and applied to these substrates since the 1950s. However, it is still not clear whether these approaches are sustainable. This paper reports on collaborative research work into the ecological potential of forest ecosystem development on typical minesites in the Lusatian lignite district. At first sight, pine stands on minesites along a chronosequence comprising about 35 years did not show differences when compared with stands on non-mined sites of the general region. Furthermore, with some modification, conceptual models for flora and fauna succession in forest stands on non-mined sites seem to be applicable, at least for the early stages of forest ecosystem development. For example, soil organism abundance and activity at minesites had already reached levels typical of non-mined sites after about 20-30 years. In contrast, mine soils are very different from non-mined soils of the test region. Chemically, mine soil development is dominated by processes originating from pyrite oxidation. Geogenic, i.e. lignitic, soil organic carbon was shown to substitute for some functions of pedogenic soil organic matter. Rooting was hampered but not completely impeded in strongly acidified soil compartments. Roots and mycorrhizae are apparently able to make use of the characteristic heterogeneity of young mine soils. Considering these recent results and the knowledge accumulated during more than 30 years of research on minesite rehabilitation internationally, it can be stated that minesite restoration might be used as an ideal case study for forest ecosystem development starting at "point zero" on "terra nova".

The first phase of an investigation of the chemical composition of subsurface water and the hydrochemical processes in and near the abandoned Nordic tailings at Elliot Lake, Ontario, was conducted in 1979. The Nordic area, which covers 85 hectares with an average thickness of 10 m and overlies deposits of permeable glaciofluvial sand, contains 15 million tonnes of tailings with 4-7% pyrite. Nests of standpipe piezometers installed at three locations on the tailings indicate that seepage through the tailings is predominantly downward. The water table in the tailings slopes from the north side of the tailings dam, where it is within a metre of surface to the south side near the tailings dam, where it is approximately 10 m below surface. When they were deposited during the period from 1957 to 1968, the tailings contained pore water at a pH of about 8 resulting from neutralization treatment in the mill. At the three piezometer nests, the pH increases from 3 near the water table to 7 near the bottom of the tailings. The pore water in the tailings is gradually becoming acidic because of oxidation of pyrite in the zone above the water table. The concentrations of Fe, Mn, Ni, Co, Zn and Pb are high in the shallow acidic zone and much lower in the deeper neutral zone. Concentrations of 226Ra range from 30 to 230 pCi/L. At the three sites concentrations of major ions in the permeable sand a short interval beneath the tailings indicate 226Ra presence of tailings seepage, but Ra concentrations are only 2 to 8 pCi/L. Greater downward penetration of 226Ra probably occurs in the area closer to the tailings dam. Monitoring of a network of multilevel bundle piezometers installed in permeable sand that extends southward from beneath the tailings indicates the occurrence of a plume of tailingsderived water containing high concentrations of Ca, Mg, Fe and S04 that extend 400 m downgradient from the tailings dam. The total dissolved solids decline from 20,000 at the dam to less than 500 mg/L at the identifiable downgradient periphery of the plume. A much smaller but distinct plume of water with high heavy metal concentrations and 226Ra in the range of 10 to 130 pCi/L extends from beneath the dam for a distance of 15 m. The pH of the groundwater in this heavy metal-radium plume is 4 to 5, whereas elsewhere in zone of groundwater with high dissolved solids, the pH is above 6. The Peñasquito deposit in Mexico is one of the largest grassroots precious metal discoveries developed in recent years. Goldcorp Inc. acquired the gold-silver-lead-zinc property with the acquisition of Glamis in 2006. The Peñasquito property is located in the northeast corner of Zacatecas state, Mexico. The elevation of the property averages 1,900 m (6,200 ft) above sea level. It is situated in a wide east-west valley. Minera Peñasquito, S.A. de C.V., wholly owned subsidiary of Goldcorp Inc. has operated twin SABC-flotation lines since June 2010. Each line is capable of processing 50,000 tonne per day using a SABC grinding circuit followed by flotation to produce lead and zinc concentrates. The addition of a Polysius Polycom HPGR 2417 with dual 3,000 kW drives to reduce the crushed pebbles produced by the SAG mills was planned to increase production to 65,000 tonne per day per line. The production has been limited to 100,000 tpd due to operating issues in the grinding circuit. The operating issue has been the amount of pebbles generated by the SAG mills is significantly less than originally planned. This paper describes the planned installation of a crushed augmented feed to maximize utilization of the HPGR capacity. This coupled with full utilization of the SAG and Ball Mill available energies there is the potential to achieve a 50% total capacity increase from the grinding circuit.

The U.S. Bureau of Mines has completed a laboratory evaluation of exhaust emissions from a diesel engine using an oxygenated diesel fuel. The fuels tested were soy methyl esters in a neat (100%) form and low sulfur, petroleum number 2 diesel fuel (D2). The engine tested was a Caterpillar 3304, indirect injection, naturally aspirated, 75 kW, diesel engine that is typical of engines used in underground mining applications. The objective was to determine the extent to which oxygenated fuels, such as methyl esters, reduce diesel particulate matter (DPM), and their influence on upon gaseous emissions such as total hydrocarbons, CO, NOx, NO2, formaldehyde, and other exhaust emissions. Heavy- and light-duty transient tests were used to simulate load cycles typical of mine applications. The soy methyl ester fuel produced greater amounts of volatile DPM (organic material) but much less nonvolatile DPM (carbon soot) for overall DPM reductions. A diesel oxidation catalyst (DOC) typical of the type commonly used in metal and nonmetal mines was tested with both fuels. The DOC further reduced the volatile and total DPM when used with the soy methyl esters, but increased the total DPM for D2 due to sulfate formation. The soy methyl ester fuel reduced CO and hydrocarbon, and NOx emissions. The DOC further reduced CO and hydrocarbon emissions.

The Midvale Slag Site covers 300 acres in Midvale, Salt Lake County, Utah. Midvale (population 10,000) is part of the Salt Lake City metropolitan area (population 936,000). Between 1902 and 1971, United States Smelting, Refining and Mining Co. smelted ores on the site to produce copper, gold, lead, and silver. Figure 1 shows a picture of the historical Midvale smelter operations. [ ] When operations ceased, the site was estimated to contain 2 million tons of slag from these operations. The smelter no longer exists. In 1971, Valley Materials, Inc., acquired the site to process the slag into materials for railroad beds and asphalt highways. During the 1980s, the U.S. Environmental Protection Agency (USEPA) raised concerns regarding environmental impacts associated with the historical site operations. The Midvale Slag Superfund Site was listed on the NPL in 1991. The Site consists of two Operable Units (OUs): OU1 covering the properties north and adjacent to former ore smelting operations; and OU2 covering the smelter site itself. OU1 had historically been affected by wind blown slag dust and stack emissions occurring on OU2 and the Sharon Steel site further to the south. These emissions resulted in elevated levels of arsenic and lead in the native soils. The EPA issued the final Record of Decision (ROD) for the OU1 Site in 1995. The OU1 ROD required the implementation of institutional controls for the undeveloped portions of OU1 in order to restrict future land use to commercial/industrial purposes unless additional remediation was performed. Hence, the land comprising OU1 was originally considered in the ROD to be suitable for commercial or industrial purposes without the need for remedial action. However, development of OU1 for other land uses, including residential or recreational, would require additional assessment and probable remediation. The OU2 parcel was remediated by EPA to allow future land development, and the Sharon Steel site was remediated by EPA and deleted from the NPL. PROPERTY TRANSACTION AND REDEVELOPMENT In February 2006, a private development company, Mercer Bingham Junction, LLC. (MBJ) purchased 130 acres of the OU1 property for the purpose of performing environmental remediation, and developing mixed residential and commercial real estate. Development of the property was conducted in cooperation with USEPA Region 8 (EPA), the Utah Department of Environmental Quality (UDEQ) and Midvale City. The guidelines under which residential development could occur were defined by EPA. The 130 acres was to be developed for open space, residential and commercial use as part the Midvale City Bingham Junction development. Figure 2 shows the general layout of the proposed land uses. [ ] In May 2005, MBJ began pre-acquisition due diligence activities to purchase the 130 acres of OU1 north of 7200 South Street, which now comprises the Bingham Junction Development. This included the completion of Phase I and limited Phase II investigations. The Phase II investigations were performed to evaluate arsenic and lead concentrations in the planned residential areas of the site, and to explore the contents of the historic landfill on the property. The historic landfill area was on the far west side of OU1, adjacent to the Jordan River. Soil samples collected during the Phase II investigation showed that the planned residential parcels did not currently meet the criteria established in the Tech Memo and that additional placement of fill or soil excavation would be required for residential development in this area. An evaluation performed by the previous owner of the property, Littleson, Inc., showed similar results.

To the average mine operator, the implementation of environmental regulations are viewed as a drain on the profitability of the mine. Since the birth of environmental awareness in the late 1960's, which led to the passage of the National Environmental Policy Act (NEPA) in 1969, and through the publicity brought about by the discovery of Love Canal in 1978, the public are clamoring for increased environmental protection. It should be emphasized that the concern regarding the issues of the handling and disposal of nuclear and toxic wastes is not limited to a few overzealous environmental advocates. Toxic waste issues have "grass roots" interest and support. A reflection of this support has been the passage of key pieces of federal legislation. . Of particular interest are the following acts: Clean Water, Toxic Substances Control, Surface Mine Land Reclamation, the Resource Conservation and Recovery Act (RCRA) and the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). The last act is often referred to as "Superfund". Both RCRA and CERCLA have been re-authorized and amended, and in their re-authorization they have been substantially strengthened. Of the last two pieces of legislation, RCRA is the most powerful in that it governs the handling of hazardous wastes from "birth to grave". CERCLA was established to cleanup abandoned waste sites which are threatening human health or the environment. These cleanups can be undertaken by the government and then billed back to the previous owners or to the disposers at the sites.

There is an increasing requirement for geophysical surveys carried out during geotechnical investigations to provide direct information about rock quality or other geotechnical parameters. With the paucity of information to correlate geophysical results with actual rock properties, this is still difficult to achieve and additional research effort needs to be performed to address this issue. Nowadays, several researchers have been described detailed studies which designed specifically to investigate this matter. Generally, geophysical techniques which are used to estimate seismic velocities in the subsurface focus on the low strain levels that are not large enough to induce significant nonlinear, nonelastic stress-strain behavior (Luna and Jadi, 2000), which is normally evaluated when addressing liquefaction potential of soils in the shallow subsurface. Soil parameters relevant to seismic ground response (Rechtien, 1996) are density, relative density and void ratio, permeability, shear modulus, water saturation, soil fabric and stress history. Detailed characterization of elastic properties near a major construction site (e.g. a bridge) is useful for near field dynamic analysis of soil-structure interaction (SSI) effects. The coupled effect of the bridge foundation (piles, piers or abutments) and the soil immediately surrounding these substructure elements is essential for dynamic SSI analysis of these critical bridge structures. This paper presents a geophysical investigation performed along the under construction highway of Egnatia Odos, approximately 13 km west from the town of Xanthi in N. Greece. Twelve geotechnical boreholes, drilled at the maximum depth of 75 m, approximately located 20 m from the Nestos River. The objective of the survey was to obtain the high-resolution compressional and shear wave velocities of the shallow subsurface for computation of elastic engineering properties of the unconsolidated material interposed between the investigated boreholes. Joint interpretation of borehole logs and velocity images obtained by P- and S-wave traveltime inversions outlined shallow geological anomalies.

Nothing in Turkey is simple. Its his¬tory is long and convoluted, its culture fascinating, its metallogeny diverse, and its geology very complex. This article will focus on the geology of western Anatolia and the precious metals poten¬tial of this third of Turkey. Any gold produced by mines in Tur¬key since the early 1900s has been a by-product of the mining for other met¬als, such as copper from the massive sulfide deposits of the Pontics. Archaeological records, however, prove that gold was mined from the Pactolus (present day Gediz) River and refined by Croesus at Sardis in about 550 BC. Other records and legends make it possible that gold was mined before 1200 BC for the Homeric City of Troy (Priams treasure?) about 25 km (15 miles) east of Canakkale at Mad¬endag and Kartaldag. A final legend of antiquity suggesting gold in what is now Turkey relates to King Midas. And, indeed, the city-state belonging to a king of that name has been recognized near the city of Eskise¬hir. More recently, precious metals have been mined at Madendag-Kartaldag in the late 1800s. Arapdag, near Izmir, remains the only "authenticated" epith¬ermal precious metal deposit in Turkey (Mosier et al., 1985). With this spotty record, why the sud¬den interest shown by at least five Euro¬pean-based, three or four US-based, and several other international mining firms and their Turkish subsidiaries? Like other aspects of Turkey, the complete answer is not simple but, reduced to its basics, has three parts. Turkey, relative to many developing nations, has a stable, democratic form of government (although it also has a for¬midable bureaucracy) whose currency exchange rate is premised on the US dollar. New laws promulgated since 1983 have opened the country and welcomed foreign investment. Some have even provided investment incentives. The Mining Law of August 1985 made sweeping reforms of the old land tenure system. This law made it possible for a foreign-based company to have a wholly-owned Turkish subsidiary en¬gaged in mining. Equally important is the belated recognition that western Anatolia, while geologically compli¬cated, is today basically a province Neogene extensional tectonics having many of the geologic attributes of the leading gold producing province of the US - the Basin and the Range. Geologic rationale for precious metals exploration Tectonic/lithologic framework: Alle¬gorically and simplistically, Anatolia during early Neogene (middle Miocene) can be likened to a tube of toothpaste with the cap off. It is squeezed in the vise formed by the Arabian plate mi¬grating north toward the southwest end of a stable Asian platform. The "tube" was compressed. It could not expand to the east because it was sealed by what is now southern Russia and Iran. The filling of the tube escaped to the west, in the direction in which the cap was miss¬ing (Fig. 1). So developed during the middle to late Miocene the western-most struc¬tural province of Anatolia. This was done by a process aptly termed tectonic "escape" by Sengor et al (1985). This province is dominated by exten¬sional tectonics much like the Basin and Range of the western US and has an estimated extension of between 30% and 50%. The most striking manifesta¬tion of this extension is the 10 to 11 major east-west trending grabens (Ge¬diz, Buyuk Mendares, Kocuk Mendares, etc.) and intervening horsts, although a much greater number of smaller, gener¬ally northeast-striking grabens and half

Metallurgical testwork has been done to determine the response of this ore to several possible processing schemes. Tunnel damage from explosion and earthquake excitation is correlated with strain and particle motions. Critical strains and motions are then correlated with focal distance, which is so small that permanent strains are highly likely. The shaking process is then numerically modeled to investigate the effects of excitation frequency and joint orientation. The models confirm that near cavern blocks slide intermittently only at relatively high particle velocities during periods of low joint normal stress. Larger displacements occur with relatively small shear wave lengths or relatively high frequencies. Variation in joint orientation and rock mass dilation result in changes in displacement.

Semi Autogenous Grinding (SAG) circuit is the most common grinding circuit to day. In Europe and South Africa fully autogenous (AG) circuits are also popular. SAG circuit has a lower capital cost and simple operation. SAG circuit requires the use of grinding balls, which increases operating costs and decreases availability. An AG circuit may produce a higher Net Present Value to the investment. The AG circuit is more complex to design and operate. However, operating experience from AG circuits illustrates that an AG circuit can be as trouble free as a SAG circuit with the benefit of lower operating cost.

The electrostatic charge on spray droplets of ionic surfactant solutions and coal particles was measured and the results were correlated with the dust collection efficiency. When various surfactant were added, the magnitude of the droplet charge increased significantly and it was observed to be a function of surfactant type and concentration. The concentration of maximum droplet charge coincided with surfactant concentration where maximum collection efficiency was observed for these surfactants. Particles of coal also carried substantial amount of charge magnitude of which seemed to be a function of coal rank. Based on the results presented in this paper, it was concluded that ionic surfactant primarily act as a strong electrostatic charge inducer for droplets. Due to interactions between these highly charged droplets and naturally charged particles, the efficiency of droplet-particle collisions play a primary role when compared to the wetting and engulfment phenomenon which could only follow a successful collision. INTRODUCTION Water spray are widely used to suppress airborne dust in mine atmospheres (Walton and Woolcock, 1960; Kobrick, 1970; Hamilton, 1974; Jayaraman et al., 1986). Several investigators have considered the use of surfactants to enhance the effectiveness of water sprays especially for difficult to wet particles such as those of coal (Glanville and Wightman, 1979). The capture of dust particles by water droplets involves droplet-particle collisions, adhesion of particles to droplets, and engulfment of particles into droplets. Surfactants affect these sub processes through their influence on droplet charge, surface tension, and wetting. The last two mechanism have been thoroughly studied in recent years (Walker et al., 1952; Cohen and Rosen, 1981; Glenville and Haley, 1982; Chander et al., 1988; 1991). However, little attention has been paid to the role of electrical charge on particles and droplets on the collision and adhesion of spray droplets and dust particles. Airborne particles of dust have long been known to carry a significant amount of electrostatic charge (Hopper and Laby, 1941; Kunkel, 1948; Kunkel, 1950; Dodd, 1952; Liu et al., 1987; Kutsuwada and Nakamura, 1989). It is reasonable to assume that presence of charge on particles will effect their agglomeration and particle-droplet interactions. Polat et al., (1991) showed that virtually all freshly generated dust particles were agglomerated in air. They suggested that electrostatic charge and humidity were important factors responsible for agglomeration. Previous theoretical studies on the interactions between charged particles and collectors by Nielsen and Hill (1976) show that, the collision efficiency is a strong function of the particle charge. In addition to charge on particles, spray droplets might also carry substantial amount of charge (Chapman, 1937;1938; Blanchard, 1958; Iribarne and Mason, 1967; Jonas and Mason, 1968; Byrne, 1977; Bailey, 1988). In theoretical studies of interactions between a spherical collector and airborne particle, it was found that the collision efficiency was significantly altered depending on whether the collector and the particles were charged. If neither the collector nor the particles carried a charge, the collision occurred by inertial and gravitational forces. The collisions took place on the front part of the collector (the front capture). If either of the collector or the particles were charged, the collision was enhanced due to the induced image forces. If both the collector and the particles were charged, the collision efficiency was significantly affected by the sign of the charge as well as its magnitude. For oppositely charged collector-particle pairs a collision could take place on the rear of the collector even if the particle flied past the collector upon approach (the rear capture) (Nielsen and Hill, 1976; Wang et al., 1986; Chang et al., 1987). On the other hand, the columbic force became negligible as the particle size increased and the inertial force became dominant. The electrostatic attraction was predominant for particles of less than about 2.5 µm in diameter. For particles larger than about 8 µm the inertia of particles was sufficient to overcome the columbic force and inertial impaction became the dominant collision mechanism (Grover and Beard, 1975; Chang, 1987). Previous studies of dust suppression using charged spray droplets generated by applying high voltage to the spray nozzle showed significant improvements in collection efficiencies (USBM open file report, 1983; McCoy et al., 1985). Construction of Boston’s C11A1 Section of the Central Artery (I-93)/Tunnel(I-90) Project beneath the existing MBTA Red Line Subway at South Station required excavation to depths in excess of 33.5 m (110 ft) through permeable sand and gravel subject to almost 27.4 m (90 ft) of hydrostatic groundwater pressure. As tacked drift tunnel underpinning system was designed to provide positive support to the active station prior to mainline tunnel construction. As part of this system, a permeation grouting program was developed to facilitate tunnel excavation. This paper describes the design and implementation of the grouting program, in sit testing, and the overall performance of the grouted soil mass.

Rare earths were not mined in the United States in 2008. However, processing of intermediate rare-earth concentrates continued throughout the year at the Mountain Pass Mine in California. Consumption of refined rare-earth products increased. U.S. rare earth imports were primarily from China, with lesser amounts, in decreasing order, from France, Hong Kong, Japan, Austria and Russia. The United States imported 100 percent of its supply of yttrium metal and compounds primarily from China. United States In 2008, lanthanide concentrates were processed by Chevron Mining Inc. (previously Molycorp Inc.) at its mine site at Mountain Pass, CA. Chevron Mining sold its entire holdings in the rare earths mine to Molycorp Minerals LLC in September and operations continued at the site through-out 2008. Major uses for these mineral commodities were in automotive catalytic converters, petroleum fl uid-cracking catalysts, permanent magnets, glass-polishing compounds, ceramics, metal-alloying additives, phosphors and recharge-able batteries. Three domestic companies produced and sold lanthanide intermediate concentrates and refined products. Chevron Mining sold its interests in the Mountain Pass Mine to Molycorp Minerals LLC on Sept. 30, 2008. Molycorp Minerals LLC is an investment company owned by Resource Capital Fund IV L.P., Pegasus Partners IV, LP, The Goldman Sachs Group Inc., Traxys North America LLC, Carint Group LLC and Mark Smith. The Molycorp operation previously mined the rare earth fluocarbonate mineral bastnäsite by hard-rock surface methods, and the mine remained on care and maintenance in 2008. Molycorp maintained significant stocks of bastnäsite concentrates, intermediate concentrates and high-purity rare earth compounds at its operations at Mountain Pass. In October 2007, Chevron Minerals completed phase one of its three-stage plan and restarted the rare earth separation plant at Mountain Pass. The company also processed intermediate rare earth concentrates from existing stocks during the first three quarters of 2008. Molycorp Minerals LLC maintained production in the last quarter of the year. The mine at Mountain Pass has been closed since 1998. Future plans are to restart processing of stockpiled bastnäsite concentrates followed by reopening of the mine.

In this paper, the methodologies that should be applied by the progressive mining industry in order to fall within the frame of the sustainable development are summarized. As Edward E. Runyan, 1983 AIME President, in an interview excerpt in ME, June, p. 607, stated, "...the AIME Transition Committee has recom¬mended to the AIME Board that each Constituent Society be allowed the option of separate incorporation, whereby each could become its own separate legal entity." Background The American Institute of Mining Engineers (AIME) was formed in 1871 by 22 engineers in Wilkes-Barre, PA. Although originally a mining organization, it became a home for metallurgists, iron and steel industry people, and for the individuals in the expanding petroleum engineering profession. There are now four Constituent Societies: Society of Mining Engineers, located in Littleton, CO, 29,000 members; Society of Petroleum Engineers, located in Dallas, TX, 47,500 members; The Metallurgical Society, located in Warrendale, PA, 10,000 members; and Iron and Steel Society, located in Warrendale, PA, 6,500 members. Each of the four groups has grown and continues to serve the specific and/or diverse needs of its membership. As the needs and requirements of their industries and professions change, each of the Societies has perceived and initiated programs that serve their constituency rather than AIME as a whole. Therefore, each Society has recognized an increasing need for autonomy to better augment their own programs. An AIME Ad Hoc Transition Committee, with Robert Merrill, AIME Past President, as chairman, made a number of recommendations pertaining to AIME operations that were approved in October 1982 by the AIME Board of Directors. One of the recommendations was to endorse separate incorporation of the Constituent Societies on an individual-society-option basis. The AIME Board commissioned a task force of Constituent Society representatives to develop specific revisions to the AIME Certificate of Incorporation and the AIME Constitution and Bylaws. This was done to allow separate incorporation and to reflect the decentralized structure of the Institute. The SME-AIME Board of Directors subsequently approved the recommendation of SME Working Party #69 that SME pursue separate incorporation. Meanwhile, Working Party #69 continues to work with the other Constituent Societies and with the AIME Task Force on Reorganization to determine the form and substance of the separate incorporation. Why Incorporate? George Webster in The Law of Associations quoted Chief Justice Marshall's (1819) definition of corporation as: "A corporation is an artificial being, invisible, intangible, and existing only in contemplation of law. Being the mere creature of law, it possesses only those properties which the charter of its creation confers upon it, either expressly or as incidental to its very existence. These are such as are supposed best calculated to effect the object for which it was created." SME-AIME attorneys, Davis, Graham & Stubbs, have pointed out that the status of an organization operating as an unincorporated association is always unclear. At present, SME-AIME administers assets of almost $3.5 million (mainly property and inventory) but technical ownership and ability to enter into contractual relationships resides with AIME. However, the operation appears to outsiders (particularly those with whom SME-AIME does business) to be an independent operation which would be expected to be a legal entity in its own right. Advantages of Incorporation Liability. Because of legal ownership by AIME of all assets of the Constituent Societies, those assets are subject to the claims of any of the creditors of AIME or any of its constituent parts (i.e., the other societies). Liabilities can be those usually encountered in business but also encompass special risks, which could develop if there were a careless and erroneous publication of material that might be used in practice or if standards are improperly established.
