The $300 million West Side Combined Sewer Over?ow Project consists of over5.5 kilometers of soft ground tunnel, an 833-million liter per day (220-MGD) deep shaft pump station, 3 kilometers of micro tunneling, and other miscellaneous shafts and pipelines. The construction contract, underway since September 2002, is a reimbursable cost plus fixed fee contract that included a quali?cations-based contractor procurement process and has undergone some modi?cation since execution. This paper will describe the contractual issues addressed to date, dispute resolution, where improvements can be made, and how an Owner can evaluate whether this type of contract is the best approach for an underground project.

The City of Portland’s Westside CSO Project is constructing a deep tunnel system to reduce combined sewer overflows (CSO) from entering the Willamette River. Several kilometers of microtunneled pipelines connect the existing system to the new tunnel. The alignments encountered a variety of ground conditions, including fill, manmade obstructions (wood, steel piles, debris), fine-grained to dense coarse-grained materials, cobbles and boulders, all below groundwater. The KSS Lead Plant (Kivcet - SNAMPROGETTI - SAMIM) of Por tovesme, owned by Nuova Samim (the sector-head Company for non ferrous metals and derivatives owned by ENI), has been operating since february 1987. This plant is based on the Soviet Kivcet licence and testwork carried out on the pilot plant of VNIITSVETMET in Ust Kameno gorsk fed by the Nuova Samim's concentrates. The plant is com pletely automatized using the most advanced technologies and it is operated by nineteen people on shift work, including all ancillary units and lead decopperizing-casting. The expected performance of the plant has been confirmed and improves day by day in relation of the operating experience, thanks to the new conceptual design of the furnace. Due to the remarkable flexi bility of the process, the integration of the lead plant with the other plants of the metallurgical complex of Portovesme rro-#4 (Electrolytic Zinc Plant, Sulphuric Acid Plant, Imperial Smel ting) has shown all the economic advantages. The lead content in the ambient air, detected by the monitors, either in the working area and on the ground outside the complex, is widely Pb W" below the stricter new limits recommanded by the E.E.C. (Economic European Community) rules and by the Italian law. The whole process is carried out in equipment completely closed and under suction and it does not require manual operations with exposure to the lead. The production cost is much lower than that performed by the traditional technology. This advantage permits wide margin to consider investment to replace the traditional technology.

Introduction Of all Canada's mineral resources, its coal deposits have probably received the most continued attention by the Geological Survey since its inception ninety years ago. A casual review of the many geological maps of coal areas by the Geological Survey will show how geological and topographical detail on the maps has gradually increased to meet the ever urgent demands of the mining industry. In the early stages of exploration, the mapping done, especially in the coalfields of the Rocky mountains, was largely of a reconnaissance nature. On these maps the topographical relief, where shown, is indicated by form lines or by hachures, the boundaries of the coal-bearing formations are only approximately defined, and the geological structure of the coal seams is illustrated by one or more generalized cross-sections. Once mining development on a coal area began, there arose a demand for more detailed maps. To meet this need, topographical and geological maps on a scale of one inch to a mile were made, in which the ?topographical relief is shown by contour lines having generally an interval of 100 or 200feet. On the geological maps, the boundaries of the formations are accurately delineated, and the geological structure of the area is illustrated by one or more structure sections drawn across the area, which show the position and attitude of fault lines, the crests and troughs of folds, and the attitude of the various formations (See maps of Costigan Coal Field, 1905, and Cascade Coal Basin, 1907, by D. B. Dowling).

IN making comparisons of steel industries, one country with another, the convenient common denominator is annual capacity to make raw steel in the form of ingots. It is always necessary, however, to remember that there are different methods of figuring such capacity. For most countries no official figures on capacity are available, and the only authentic data on production are now six or eight years old. But in spite of those limitations on the accuracy of statistical comparisons, any flaws in the figures are probably not serious enough to alter materially the larger conclusions which may be drawn from them.

THE American producers of silver are keenly alive to the importance of the silver problem and its vital effect on the mining industry in Montana and other States where precious-metal mining constitutes a basic industry. There are so many ramifications to the subject that one is tempted, no matter from what angle an approach is made, to digress along lines that inevitably lead into a maze of social, economic and financial problems, through which no clear pathway is marked, and regard¬ing which no definite opinion can be expressed, as the ultimate solution is dependent upon the policies adopted and carried out by the more important Governments with reference to their fiscal requirements and currency systems. The situation may be summarized in two questions First, what, if any, plan have the silver producers, as being the most directly interested, to offer in meeting the situation which will confront the industry upon the termination of purchases of domestic silver under the Pittman Act? Second, what, if any, assistance can be extended by the Government in connection with the problem? In answer to the first inquiry, while the matter has been the subject of discussion among the principal producers, they have been unable to formulate a defi-nite plan, principally because they have been and are dealing with a subject embracing many unknown fac-tors; and second, it has been felt that before any plan is adopted there should be indicated the extent to which cooperation on the part of the Government may be depended upon to enable a proper study of the situation to be made. In order to explain these rather cryptic statements, a general review of the situation may aid. Whatever differences of opinion there may have been in the past upon the subject of bi-metallism or the establishment of a fixed ratio between the coinage value of gold and silver, it will probably be conceded that it would be neither wise nor expedient to attempt a revival of this discussion, nor to undertake to solve the question by the adoption of such a remedy. Issues of contro-versial economics must be avoided, if possible-political economics will destroy rather than assist constructive effort.

DURING the war, events moved with unprecedented rapidity. Situations, industrial, economic and financial, arose over night that stressed to the uttermost the ingenuity and ability of those who dealt with them. It was essentially a time demanding action rapid and concentrated, and not one for discussion, either academic or polemic. As a result, matters of importance were necessarily transacted without the desirable opportunity being afforded of enabling a general understanding to be gained as to the relative merit or demerit involved, and in some instances, legislation essential to enable the consummation of an important matter was passed without attracting the public attention then deeply engrossed in the larger aspects of the situation. The result was that so long as the public mind was occupied, little or no concern was given to questions that ordinarily would have invited immediate attention; and in some instances, only when as an aftermath of war a particular subject has become a matter of discussion, criticism not altogether fair is made without first obtaining accurate knowledge as to the conditions that prevailed, the purpose sought to be accomplished, or the results obtained by the action taken.
