Mineral property appraisers engaged in eminent domain actions on properties for which mining is the highest and best use must be fully competent in all phases of mineral resource estimation, mine project development, and mine operations (or retain the requisite competent assistance), as well as educated in eminent domain appraisal (USPAP Competency Rule). Failure to ensure such triggers the issue of appraisal competence and demonstrates a flagrant disregard of the myriad code(s) and guidelines to which the appraiser is subject. The cavalier assertion of some vague, undefined “latitude” in the valuation process does not exonerate the appraiser from a disregard of the USPAP Competency Rule. Lack of independence (i.e., “advocacy”) in mineral property appraisal is the usual result of a weak background in mining and/or appraisal theory. While it is readily apparent to those able to recognize it in reports and testimony, judges and juries cannot be expected to detect or recognize purposefully misleading (or even fraudulent) valuation concepts or testimony. Purposeful deception by the appraiser can lead to specious over-compensation of the property owner (thus victimizing the taxpayer); or, a failure to provide appropriate and just compensation to the property owner – yet, the purpose of an eminent domain proceeding is to leave the property owner no richer or poorer as a result of the taking. This paper highlights some of the deceptive practices encountered in litigation settings and raises issues of competency, professional ethics, and the effectiveness of the inherent enforcement capabilities within those institutions awarding professional certifications. INTRODUCTION The practice of eminent domain mineral property appraisal requires (particularly with respect to undeveloped mineral properties) that the appraiser possess the requisite level of competence in all phases of mineral resource estimation, mine project evaluation, mine development, and mine operation (through closure). To the extent the appraiser lacks such competence, it is incumbent on the appraiser not only to divulge this lack of expertise but also to seek competent assistance in the performance of the appraisal. This competence or expertise can only be obtained through a combination of appropriate and relevant technical education and direct mining industry experience. There exist a number of professional certification and/or credentialing authorities that speak to such competency. In a similar manner, eminent domain mineral property appraisal (as the term implies) also requires that the appraiser possess the requisite level of competence in the practice of eminent domain appraisal. This competence or expertise can only be obtained through appropriate and relevant education, direct knowledge of appraisal theory, particularly as it relates to the concept of eminent domain, and licensure.

Black: Bodies.-In the ordinary conception, a black object is an opaque object that reflects but little of the light that is incident on it. This means naturally that such an object is a good absorber of luminous radiation. The black body; which is so closely connected with high-temperature measurements, represents the limit in blackness of all black objects. It is a body that not only absorbs all visible radiations but also all other radiations in the infra-red and the ultra-violet regions of the spectrum which are incident on it. No substance is known that is completely black; platinum black, one of the nearest if not the nearest representative of the ideal, reflects 1 per cent. or so of ordinary visible radiation. The closest approach to the ideal is a small opening in the wall of a relatively large opaque cavity. Any radiation incident on this black body will be almost completely absorbed if the relative dimensions are properly chosen no matter what the material may be. The great difference between the blackness of such a cavity and of lampblack, for instance, will be apparent to one who makes the simple test. Non-black Bodies.-The field of non-black bodies covers all real bodies. Their characteristics are extremely varied. So far as absorption of radiation-is concerned, these bodies range practically from the almost completely black, platinum-black, and lampblack, which absorb all but a fractional part of 1 per cent. or so of the incident radiation, by an infinite variety of steps to freshly polished silver, which ordinarily absorbs only a few per cent. The exact percentage absorbed depends not only on the nature of the incident radiation, but also on the temperature of the body, the condition of its surface, the angle of incidence, the nature of the surrounding medium, and on certain other less important conditions. As consequences of these varied characteristics, we have not only the differences of color of ordinary objects, but also the changes of color that any one object undergoes on heating or when lighted front various directions. This complexity of the phenomena, in a way, is responsible for the meagerness of knowledge, regarding materials at elevated temperatures. Measurement of High Temperatures.-Excepting in cases where the thermocouple or the gas thermometer are applicable, in which case the temperatures obtained are true temperatures regardless of-the material" studied, high, temperatures are almost always, if not always, determined from measurements of radiation. In fact, determinations of temperature from this latter point of view are often so much more convenient than the thermocouple and especially the gas-thermometer determinations that, in the region where all of these types of measurements may be made, the radiation measurements are often preferred. This is true even though the temperatures usually thus directly determined are not the actual temperatures, a consequence of the sources of the radiation being non-black bodies; in other words, a consequence of being concerned with iron, or glass, or tungsten instead of small openings leading to relatively large-cavities uniformly heated. Coordination of Experimental Results.-In order that data on iron, glass, tungsten, or other non-black bodies obtained in one laboratory, may be, correlated with similar data obtained elsewhere, temperatures must be expressed on a common scale. The true temperature scale is the natural scale for this purpose it is ordinarily the scale to which all other temperatures can be most directly reduced. An experimental design has been developed to investigate the relative influence of distinct pulp and environmental properties on froth stability in the flotation of a typical porphyry copper ore. In particular, factors such as frother and collector type, feed particle size (P80), solids per cent, composition (chalcopyrite and pyrite content), as well as grinding environment (mild steel versus stainless steel, high and low pH) have been varied in a controlled manner, and the resulting froth stability evaluated. A previously developed froth stability column, based on the Bikerman approach, was used to measure the froth height and half-life in each test. The relative effect of each factor is presented here on a comparative basis. It is shown that frother type is the most important factor, with marked difference in froth stability when switching from methyl isobutyl carbinol (MIBC) to glycol based frothers. Solids per cent and particle size also play a significant role. The grinding environment had lesser effect on the resulting froth stability, although mild steel grinding gave higher froth stability compared to stainless steel grinding. The experimental evidence supports the hypothesis that in porphyry copper flotation the grinding environment influences surfaces oxidation, pyrite activation and the extent of hydrophobic particles reporting to the froth phase. This has an indirect effect on the resulting froth stability, which is however small if compared to the other factors. This work is still in progress, and extension to other mineral systems is planned. IGO Ltd’s (IGO) Nova Operation (Nova) is 160 km east-north-east of the town of Norseman in Western Australia (WA). Discovered by Sirius Resources NL (Sirius) in 2012 and acquired by IGO in 2015, the Nova-Bollinger Deposit (Nova-Bollinger) occurs within the Fraser Zone of the AlbanyFraser Orogen. Nova-Bollinger is a complex nickel-copper-cobalt (Ni-Cu-Co) magmatic intrusive sulfide deposit, which is characterised by high-grade folded and undulating breccia lodes that host the bulk of the payable metals. Significant sulfide mineralisation is also found in several magmatic intrusive styles including net-textured, disseminated and blebby styles. A smaller but material volume of sulfides has also been remobilised into the deposit’s footwall rocks as ‘stringer’ bands in metasediments, or as discrete massive sulfide lenses. When interpolating Mineral Resource estimate (MRE) block grades in the presence of locally varying grade connectivity trends, such as folds or undulations, the sample search neighbourhood, which is used to identify the composites subset that is used for each block estimate, should be oriented to match the local trends. In theory, the most robust method of estimation where locally varying angles (LVAs) are applied to search neighbourhoods, are techniques where the composites and the blocks to be estimated are transformed to an unfolded coordinate system (UCS). However, UCS methods can be tedious to implement and require subjective decisions to be made that cannot always be fully defended. An alternative LVA method commonly used in the industry is dynamic anisotropy (DA), which is much simpler to implement and is often assumed (but not that often demonstrated) to result in similar results to UCS-style estimation. In 2018, Nova’s Mine Geology team (MGT) estimated the grades and density of the Nova-Bollinger MRE using the UCS approach. For the 2020 MRE update, Nova’s MGT tested and compared the USC grade interpolation method with the DA approach. As applied to the Nova-Bollinger’s 2020 MRE, the comparison, advantages and disadvantages of the two estimation methods are the subject of this paper

PanAust’s Phu Kham copper-gold operation (Phu Kham) in Laos is currently limited by throughput in the Semi Autogenous Grinding (SAG) mill. The ability to accurately predict SAG mill throughput (throughput) is therefore critical to accurately forecast copper and gold production. During the fourth quarter of 2016 the proportion of hard unweathered rocks in the mill feed increased, resulting in a period of lower than expected throughput. These low throughput rates prompted a study with the aim of identifying a practical solution for throughput predictions. The study identified an empirical modelling approach based on actual SAG mill throughput rates. The empirical model was then optimised by linear programming to identify the ideal feed blend of unweathered rocks to achieve a maximum SAG mill throughput.Rock strength was the initial focus of the throughput study at Phu Kham because previous studies had identified a strong link between rock strength and throughput. It was determined that there was insufficient valid data to adequately model but sufficient data to qualitatively characterise rock strength. The data identified that the weathering and lithology had a controlling influence on the rock strength. Complicating throughput predictions were operational improvements (changes to blasting and mill settings) implemented in response to the lower than expected throughput. This created uncertainty with the throughput equations. A self-learning empirical modelling method was developed to predict the throughput by incorporating fundamental rock properties with operational practices and improvements. The method is based on the proportion of mill feed with similar weathering and lithology (a proxy for comminution performance) and the actual mill throughput using the SAG mill as the analytical instrument. The modelling method simultaneously incorporated the sum and interaction of unmodelled influences including blasting, crushing and mill settings. The empirical modelling method worked at Phu Kham because the lithology and weathering has an intuitive and observable controlling influence on SAG mill throughput. A great deal of effort is being expended by mineral processing engineers to acquire a basic knowledge of modelling and optimization techniques. Stimuli such as immediate process improvement, expanded process understanding, optimal flowsheet design and re-design, and the development of new and better control systems are goals which excite the imagination in terms of increased profits. To reach these goals, process models and efficient optimization strategies, regardless of their purpose, assume an important role. Consequently, few of us can argue that such efforts are of no value. The purpose of this paper is to review empirical modelling methods and optimization strategies which appear to be of value to mineral engineers.

Introduction America's workforce is the heart of the nation's economy. The health of its members is a matter of national priority. Statistics show that the most common cause of job difficulties is excess use of alcohol or other drugs. Up to 75% of these troubled employees can be returned to productive careers at little expense and with great benefit to their industries. Of the 1.5 million private corporations in the US, only about 500 have alcohol treatment programs. Even fewer have drug abuse programs. It is time that the myths and prejudices surrounding alcohol and drug abuse are dispelled and help is offered. Corporations and labor unions are now finding that programs to treat these diseases benefit both the employees and the industry. The employee derives health and job security. The company sees increased productivity and decreased costs in sick pay and absenteeism. Unfortunately, three-fourths of the nation's 90.5 million workers are employed in establishments of fewer than 500 employees. In these settings, it is unlikely that either management or the unions will take the initiative in developing programs. Alcohol alone affects the health and productivity of nearly 8% of any workforce. This translates to more than 5 million employees in small business. These workers present an opportunity and a challenge. Alcohol abuse costs the nation nearly $116 billion annually. Seventy billion dollars is attributed to lost production. Medical expenditures related to alcohol are estimated to be nearly $13 billion. The National Institute on Drug Abuse (NIDA) estimates the cost of substance abuse to industry to be in excess of $4 billion a year. In addition to its economic impact, substance abuse has serious personal and social consequences. The mining industry experiences the same exposure as other industries to alcohol, drug abuse, and other employee problems. However, the existence of these problems poses special hazards because of the unique conditions found in mining. Mining has many safety and health hazards. Employees must have full control of their faculties and give full attention to the tasks at hand. The aims of this study were to investigate the factors that influence women’s engagement in technical positions in the South African mining sector and to determine what could be done to promote their successful participation. A convergent parallel mixed-methods research design was used to ascertain the factors that facilitate, inhibit, and influence engagement. In the quantitative phase of the study, questionnaires were circulated to women employeees; and in the qualitative phase, semistructured interviews were conducted with employer representatives, most of whom were human resource personnel. Confirmatory factor analysis showed that the three-factor structure (vigour, dedication, and absorption) of the Utrecht Work Engagement Scale fit the sample data reasonably well. Although there is room for improvement, respondents demonstrated acceptable levels of engagement in their work. On the other hand, the qualitative findings showed that employee engagement is impacted by unfavourable working conditions, work–life balance, and the mining industry’s male-dominated work culture. The findings showed that employee engagement should be elevated to a core human resource function. To increase the participation of women in mining, human resource professionals are encouraged to collaborate with mine supervisors, managers, and employees to develop programmes that promote employees’ absorption in and dedication to their work.

THE present organization of Copper Queen employ-ees, known as the Employees' Conference Com-mittee, is really an outgrowth of the former Grievance Committee, which, in turn, had developed from the original Hospital Committee. The relatively small membership of these older organizations, the practical limitation of their activities to the presenting of grievances, and their lack of initiating powers, were the principal defects which the plan now in operation seeks to overcome. A somewhat parallel scheme was instituted in our Sacramento Hill division about four years ago; this gradually developed into the Ways and Means Committee, which, in addition to providing a forum for the discussion of operating problems, was instrumental in establishing an excellent and mutually satisfactory bonus system. Before recommending adoption of the plan now in force, we made extensive inquiries among those who have had any experience in such matters, and ended by proposing a modification of a scheme developed by John Leitch,1 which was characterized by its similarity to the constitution of the Federal Government. As finally remodeled, the. plan was submitted to vote of the entire working forces at the Copper Queen mines, and was adopted by them in May, 1920. Mining opera-tions since that date have been so interrupted that it is scarcely possible to state exactly what the results have been. The following quotations are from a printed pamphlet containing the constitution of the organization, as finally adopted. The first extract is from a letter addressed by the management to the employees: The plan submitted for your approval and adoption is modeled after the constitution of our own country, under which every individual is given an opportunity for advancement, according to his ability and determination, and every citizen is given a voice in the laws that shall govern him. So it is to encourage the individual employee in advancement, and to give him a voice in making the rules that shall govern his conduct, that we favor the adoption of the proposed constitution.

SUPPLEMENTING surveys of the engineering profession regarding salaries and advancement, based upon data from individual engineers, a survey through a questionnaire to employers of engineers has recently been made by a subcommittee of the Engineers Joint Council's Committee on the Economic Status of the Engineer. Its object was to learn directly from employers their attitudes and policies pertaining to the selection, training, placement, advancement, guidance, and professional activities of engineering graduate employes. The questionnaire was sent in May 1946 to 174 employers of engineers, including colleges. Replies were received from 104 employers in nineteen fields of industry, who employ about 2,000,000 persons, about 40,000 of whom are engineers. The following general observations are based on the questionnaires returned. Who Are Hired? Of the co-operators 96 per cent employ cadet engineers directly upon graduation from engineering schools, but only 4 per cent recruit their engineering staffs exclusively from the new graduates. About 43 per cent hire more than half of their new engineer employes after one or more years' experience with other employers. This is evidently a matter of necessity or expediency rather than preference, because more than sixty per cent of those reporting indicate that they prefer to hire the new graduate.

AT the present time we hear a great deal about organization of labour, collective bargaining, workmen's councils, and company unions; about C.1.0. with its principle of vertical unions and A.F.L., largely based on craft unions; and about provincial and federal laws for protection of labour's right to collective bargaining. What we perhaps hear too little about is corresponding organization of the employers, although it recently is mentioned more frequently. I will only mention W. H. Davis, Chairman of the United States War Labour Board, who has had and is having plenty of experience in this field and has also studied labour conditions in Europe-in Sweden for instance. He has repeatedly expressed the opinion that where employer-employee problems are involved, a thing badly needed in America is organization of employers as well as employees to get some order in the present chaos. With this I agree. I believe a strong organization on one side necessitates a correspondingly strong organization on the other side; that has at least been the experience in the industrialized countries in Europe. I happen to be fairly familiar with conditions in Norway, where they have struggled with these problems for fifty years, and a talk on the history, development, and present state of employer-employee relations in that country might perhaps be of interest as giving a general picture of the development of such relations in the northwestern European countries as a whole. The talk was originally given to the Fourth Year students in Mining and Metallurgy at the University of Toronto. I have changed it somewhat to fit a different audience, but I hope you will make allowances if you now and then are reminded of the school auditorium. I will try to be as objective and factual as possible, but it is probably unavoidable that some of what is said is coloured by personal opinion.

"The City of Ottawa’s Combined Sewage Storage Tunnel consists of two interconnected tunnels totaling 6.2 km with a diameter of 3m including access shafts and hydraulic structures which connect to the City’s most critical sewers. This tunnel will be built 15m to 30m below ground in the downtown core adjacent to, and crossing below, the Light Rail Tunnel, which introduces additional considerations in terms of sequencing and risk mitigation. The City embarked on a unique Procurement Process to address the risks involved with a large tunnel project and those associated with tunneling below downtown, underneath and adjacent to UNESCO World Heritage Sites, and connecting to live critical sewers. This paper describes the unique procurement approach employed and the contractual risk mitigation measures developed to provide the best value while minimizing risk. Specific features include Market Sounding, using a Fairness Commissioner, Contractor Prequalification and Risk Mitigation Measures in the Tender documents. INTRODUCTION This paper describes how the City of Ottawa (the City) and the project design team developed a strategic Procurement Process and Tender that incorporated industry best practices for technical and contractual risk management for the Combined Sewage Storage Tunnel (CSST) project. The process was unique in that, while it employed a systematic review of project risks, it also solicited input from industry, stakeholders and provincial and federal partners to develop the request for Tender for this traditional design-bid-build project. Key drivers for this approach were initiated from the City’s concerns for cost control, cost certainty and overall project risk mitigation. To address these concerns, the City implemented the risk review and mitigation process right from the project design team selection. It was critical that the project design team embraced this risk management philosophy and carried it through each phase of the project. This paper serves as an excellent resource for municipalities or other owners embarking on a similar tunnel project, on how to properly apply industry best practices and the benefits of using them."

The quality and durability of asphalted roads strongly depends on the final step in the road construction process; the profiling and compaction of the fresh spread asphalt. During compaction machine operators continuously make decisions on how to proceed with the compaction accounting for project specific aspects as: ambient conditions, road geometry, roller type, asphalt mixture characteristics and behavior of other machines. In discussions over quality improvement in road construction it is often suggested to robotize rollers. To operate such robots would of course require operational strategies and routines. The reality of this moment is that these operational strategies and routines are not documented. To identify the existing best working practices and, ultimately, to proceed with developing automated robotized compactors, the knowledge of machine operators should at first be explored and described in a formalized way. Unfortunately operators have difficulty verbalizing their expertise. Observation of behavior, as machine movement patterns, could be helpful to extract the operational strategies, but such observations are time and labor consuming. To overcome this burden we developed a Virtual Reality (VR) environment. In this VR environment operators perform compaction virtually, and their operational choices are traced and analysed. This paper describes this VR development and explains how it helps in following machine operators and extracting their (tacit) professional knowledge. The road geometry and the working conditions are visually represented; the operators show - rather than explain - how they would proceed with the compaction process in the given conditions. Movements of virtual machines are documented, analysed, visualised and discussed. This VR approach is expected to contribute to learning, to more formal description of operational strategies; stepping stones towards compaction algorithms for roller robotisation.

These same principles can be applied in most situations to streamline processes, improve operations and deliver value. As applied to mining, OpEx is seen as moving the needle on value creation by first identifying the value stream, then analyzing the areas that are not optimized. Once defined, these areas are ‘designed out’ of operational processes to create an automated operational flow. At a US coal mine, Joy Global was brought in to apply Joy OpEx principles to optimize mining and haulage to improve productivity and reduce costs. (written discussion?).¬Since the efficiency of the different phases of personnel work employed by industrial concerns, which are bringing about greater efficiency and lessening the labor turnover, the latter being intimately connected with "contentment of mind," depends on the individual workman, it is highly desirable, as far as industry is concerned, to keep the workman's mind and body in trim in order to lessen accidents and produce a higher grade of work. Prevention being better than cure, health supervision of the workmen during employment should be maintained by the employers in order that mental alertness and physical well-being may be obtained. I have long believed, from observation in many plants, that when any problem is dependent on the individual workman, what he believes and what he does is vitally dependent on his health. I will follow with much interest what is to be clone in the future in relation to the subject of health supervision during employment (as well as medical examinations at the time of employment), and I hope this idea will be generally instituted in personnel work. A workman with good health and a contented mind should be an ideal component of a progressive industrial concern. The contentment of the workman is fostered by a number of admirable phases of welfare work which are being still further developed. The mental and physical well-being of labor should be the issue in Labor vs. Capital in the new period of the industrial promotion of the United States into which we are now entering.

Introduction Examining the short- and long-term job prospects for engineers in the coal industry might include looking at coal tonnage projections, future export markets, federal regulations, and the decrease in overall graduates. But coal is the US most competitive basic industry. As such, why not go back to basics? That is, there are three basic challenges that need to be faced by students, faculty, and members of the coal industry. These challenges are counseling, career placement, and professionalism. Counseling Counseling can include elementary, high school, and college students, as well as individuals already employed. But what happens to students after they have selected a course of study at a particular university? As shown in Fig. 1, only 87,000, or 7.25% of our graduates have technical degrees. Generally, there is a strong market projected for these engineering graduates. However, many students who have majored in other nontechnical curriculums, have to scramble for jobs. This says something about our ability to make students aware of where the real job opportunities are. As a student spends four or five years pursuing a degree, he or she is looking for professional guidance. The student has the right to expect "real world" counseling - counseling that is not "the way it should be" but "the way it is." The influence of faculty members is significant. They should take this long opportunity to tell students not what they want to hear or what the problem's of academia or the industry are, but what the real job market is all about. If faculty do not use this opportunity, they in-advertently-through omission - mislead their students. Once a student graduates and is a working alumnus, faculty should take advantage of their relationship with the student and continue to stimulate conversation leading to a two-way exchange of ideas and information. Faculty should also encourage and solicit financial support for their mining departments from their alumni. These monies, in many cases, will be matched dollar for dollar or more, depending on the company the alumnus works for. In the private sector, the responsibility is to communicate with faculty and students. Alumni can be effective by participating in this two-way dialogue with their professors at meetings, technical seminars, and conventions. In many cases, alumni will employ summer or co-op students in their organizations. While getting to know these students, industry members should level with them on where the true opportunities are and what it takes to be successful. It is important to communicate with both faculty and students candidly on both the posi-
