"Environment and the economy are interwoven irrevocably. They need to be publicly discussed, and discussed often so that new approaches can be understood and developed - approaches which are complimentary, not confrontational.Discussion on the environment is timely, from the perspective of mining engineers and developers, from that of bankers and from their shared perspective as people concerned with enhancing the quality of life, the environment and the economy.This paper will touch on how what is called the ""environmental economy "" that has evolved has become entangled with regulatory and financial issues in a way that is dangerous for all of us. It will also look at some of the promising possibilities that a world-wide and continuing concern for the environment holds out for us.For many decades, British Columbia has provided some of the key examples of the intertwining of environmental and economic issues, and, very importantly, providing the people prepared to do something about them.Canada's first environment minister, the late Jack Davis, came from British Columbia. He led this country's delegation to the Stockholm Environment Conference in 1972, a conference that laid the groundwork of principles necessary to establish some international certainty as to the legal liability for causing trans-national environmental damage.Another British Columbian who was also a national environment minister, John Fraser - now the Speaker of the House of Commons - was one of the first to dramatize the importance of acid rain and force it into the international public arena.Some 20 years ago, British Columbians made Vancouver and their province one of the major centres of opposition to the Alaska Pipeline and Tanker System - with some justification, it now seems.That a British Columbian , then MP David Anderson, was given legal recognition to sue in a United States' court against a system that was either in U.S. territory or international waters was an important precedent in, and of, itself in terms of environmental law. That old controversy is now a very current case study - in terms of dealing with the question of liability.-"

Water is a most remarkable substance. It is essential for life of all kinds. Not only can no one live without water, but man has always needed water for farming, raising animals, manufacturing, transportation, and recreation. When our country was young and inhabited by few people, the streams, rivers, and lakes were able to provide all the clean water needed by man and take away all the wastes created by man. However, with our growing population and our ever-increasing demand for goods and services, the public, industry, and government at all levels have become aware of the need to more efficiently manage the water resources of this nation. Coal has helped this nation to become the greatest industrial nation in the world. Coal has generated our electricity, run our railroads, and helped arm our nation during wartime. The result has been the highest standard of living in the world, a time of widespread prosperity, and a national defense potential that has delivered the hardware during four wars in this century. The use of water in coal mining is somewhat different than in most industries. With the exception of the small amount of water used in cleaning plants and for fire protection, most of the water encountered in coal mining operations is unwanted since it serves no useful purpose. In other words, it must be removed, otherwise it will interfere with mining operations by flooding. In the past, removing water from working areas of most mines was usually a fairly simple matter. Pumps with piping were installed at sumps or low spots in the mine and the water was pumped to the surface. Ditches were often used to drain the water by gravity to the outside or to main sumps for pump discharge. In either case, the water was allowed to flow into the nearest stream or river. Environmental due diligence investigations, also known as Phase I Environmental Audits, are increasingly important to major investors, venture partners, or prospective purchasers or sellers of mineral properties. Knowledge of environmental risks associated with a property will allow better appraisal of a property's overall desirability prior to completing the transaction. It is possible that the cost of environmental cleanup could exceed the value of the property. Topics appropriately investigated include permit status, water quality, past use of the property, hazardous materials management, storage tanks, public records pertaining to the environmental character of the property, and environmental costs.

This paper presents an overview of recent developments in the Environmental Impact Assessment (EIA) process to provide the background for a more detailed analysis of environmental and social constraints that the Heavy Mineral Mining industry has encountered over the past decade. Four cases studies are reviewed to provide a context for further analysis and identification of cross cutting environmental and social issues that either resulted in the projects not proceeding, or in the Australian case study, places existing operations under significant pressure from anti-mining lobbyists. The Xolobeni project, from the Eastern Cape in South Africa, is presented as the primary case study because it is recent, topical, and accessible; and raised numerous issues related to mining in a sensitive environment. A proposal to mine an area adjacent to the Okefenokee swamps in 1997 was also met with strong opposition from various environmental groups in Georgia, USA. This case study is briefly reviewed to further understand what ultimately resulted in the project not proceeding. Opposition to mining at North Stradbroke Island is reviewed to identify current issues more applicable to a developed country. A further review of a strategic assessment undertaken at Wavecrest, Eastern Cape, South Africa is provided in support of possible solutions to the challenges identified in the case studies. Important common themes were identified, including in some cases unfortunate timing of the environmental studies, but in all cases opposition was due to ecological sensitivity, landscape quality and sense of place. In one case study limitations to the EIA process included inadequate detail in the specialist investigations and insufficient information on mitigation. In all cases public participation was a limitation. It was either insufficient; flawed through possible bias; too ‘top down’ and required engagement with mobilised, motivated lobbyists. There was also insufficient investigation of social impacts, particularly amongst rural communities directly affected by a project. Generally alternatives were inadequately considered, a recognised limitation of project level EIA. It is concluded that the EIA process should be started as early as possible (at prefeasibility), and that investigations should be expanded from a typical fatal flaw assessment to one that applies methodologies used in strategic assessment. In particular, opportunities and constraints of the natural and social environment should be assessed in the context of the mining option as well as other options, to allow for a more meaningful assessment of alternatives. Public participation must form an important part of this initial study, despite the potential risks associated with public engagement at an early stage in the project. The application of the IFC Performance Standards; and expanding the scope of the EIA into an environmental, social and health impact assessment will lead to a more rigorous procedure, and result in more defensible products which could successfully unlock the key to the resources in these sensitive areas.

"Over the last few years, a multi-faceted feasibility study has been evaluating the introduction of hydrogen fuel cell-powered equipment into underground mines to replaced diesel engine-powered equipment. The analysis has shown that under normal operating conditions fuel cells could at the very least be an environmental and health benefit by eliminating combustion engines and their unwanted by-products. However, they could also generate significant reductions in the amount of ventilation a mine needs to supply when compared to dieselized operations; this would further decrease a mine’s energy consumption, its associated greenhouse gas impact, and also reduce a mine’s significant ventilation-associated costs. Fuel cell-powered equipment also has the advantage of lower noise and heat production compared to its equivalent diesel-powered counterpart.The degree to which fuel cells can generate ventilation benefits in underground mines depends upon a number of operational parameters and mine specific qualifiers such as current ventilation control or management, mine depth, inherent dust conditions, and minimum velocity requirements.However, another major consideration in the introduction of fuel cells in underground mines will be the safety requirements associated with diluting and removing the potentially explosive hydrogen in the event of a gas leak. In outside surface applications, it is possible to use dispersion, buoyancy, time, and lack of ignition sources as mitigating factors in deriving a low risk of an explosion. However, in underground operations, these factors change, and dispersion and buoyancy are limited; time may not be available and, in non-coal mines, ignition sources are not typically controlled. When a hydrogen leak occurs, the availability of sufficient ventilation to dilute and effectively remove the gas will be critical. Consequently, ventilation may be the prime risk controlling factor. In this paper, the authors evaluate the potential benefits of replacing diesel engines with fuel cells in powered production equipment, discuss the mitigating qualifiers that could limit ventilation savings, and evaluate solutions to retain and maintain an additional ventilation capacity in the event of an emergency situation, such as a hydrogen leak from the fuel cell stack or its distribution system."

The requirements of today's and tomorrow's markets led to a new generation of facilities which handles large tonnages annually, loading them into larger vessels, at higher rates, efficiently and reliably, with minimum labor input, and significantly greater attention to the environment. A great variety of products are handled, including various grades of metallurgical and steaming coal, coke, iron ore in its many forms, shapes and moisture content, phosphates and fertilizer products, bauxite and alumina ores, limestone, sugar and grains, cement and many other products. When we examine the annual tonnages involved in these movements the economic value of handling these products on a bulk basis can be readily seen. Although nearly all these products have been handled by continuous bulk conveyors for many years, recent governmental response to environmental concerns require a re-evaluation of previous procedures. Most air pollution and emission control regulations and ordinances have recognized several specific sources of pollution. Detailed regulations and requirements have been developed concerning smoke emissions, emissions of visible air contaminants and particulate matter from power plants, heating plants, refuse burning equipment, coke ovens, steel furnaces, kilns, and other industrial installations. Although fugitive dust is also an environmental pollutant it is governed by regulations that are more general and therefore, more difficult to apply. A general definition of a "fugitive particle" is any matter which escapes or becomes airborne from an operation or which is emitted into the atmosphere without passing or being conducted through a flue, pipe, stack or other structure designed for the purpose of emitting air pollutants into the atmosphere. This paper deals with the aspects of fugitive dust emissions as they apply to shiploading. Fugitive dust emissions control is important not only because of environmental regulations but also to prevent the loss of valuable product, reduce housekeeping, and reduce breakdown and maintenance problems to land and vessel equipment. Environmental legislation is changing rapidly throughout Australia at the present time, and with that change comes additional responsibilities for the mining and petroleum industries. Among the many changes that are being made are increased penalties for both criminal and accidental environmental impairment. The defences for criminal offences are limited and for other offences the laws may impose strict liability - in effect the offender is guilty until proven innocent. Mines may be included under contaminated land legislation, creating additional liabilities for clean-up, rehabilitation and long-term management. It is not unknown in Australia for the value of a mortgaged property to be less than the amount of the environmental liability acquired by a mortgagor in possession due to contamination of the site. An essential part of the management program for resource projects is now the regular conduct of an environmental audit, the results of which assist in the management of the legal and financial liabilities facing company directors and managers. The audit can also assist with negotiations with government agencies, staff, unions, insurers, Aboriginal and other community groups. An environmental audit may also help to ensure that companies are claiming the maximum allowable deductions for environmental works under the tax laws, and provide evidence in support of such claims. Environmental legislation affecting resource industries Environmental legislation in Australia is changing rapidly and can impose massive constraints, substantial administrative costs, and considerable liability on directors, managers and the corporation. Pollution control legislation Every State and Territory of Australia has a range of pollution control legislation contained in either individual acts relating to air, water, noise and land, or embodied in a single environment protection act. Pollution control legislation provides a critical management baseline for resource industries throughout Australia, often requiring the full-time attention of an environmental manager or an environmental department. In general, it is an offence to discharge effluents into water, or emit gases into the atmosphere above prescribed limits, cause noise above a regulated level, or contaminate land without a licence. A licence determines how much of a substance can be discharged, the location, the receiving environment, the quality, and the time at which discharges can be made or noise can be caused. Planning legislation Planning legislation controls where a project is located, how it will be constructed and operated, how large it is allowed to be, and what will happen once the project is completed. Development consents or approvals will generally contain a range of conditions controlling the preparation of the site, the construction of the facility and the way it is operated throughout its expected life time. Resource projects may be regarded under legislation as scheduled or designated developments requiring special treatment during the decision-making process. Under planning legislation, it is usual for resource projects to be subject to an environmental impact assessment process. Resource legislation Resource legislation specifically covering mining and petroleum in Australia, also contains requirements regarding protection of the environment during exploration for and extraction of minerals and oil. A mining or petroleum production lease usually contains numerous conditions regarding protection of the environment and rehabilitation of the site during and after the life of the extractive process.

Continuous improvement in environmental management assists in the achievement of sustainability goals for the processing of minerals. The use of regular internal environmental audits (scored or unscored) which form an integral component of an Environmental Management System (EMS), provide demonstrable evidence of this improvement. Case studies are presented for a number of major coal mines in the Hunter Valley, where regular internal environmental audits have been undertaken every two to three months, over periods varying from 18 months to five years. Examples of the benefits of improved environmental performance (driven by the audit process) to sustainable development are provided.The auditing process as described here for coal mines, and coal handling and preparation plants, is equally applicable to the processing of other mineral ores, metalliferous mines, quarries, and oil and gas projects.

As the number of environmental laws continues to steadily increase and the economic penalties for contamination problems become more severe, environmental management represents an important management function within today's U. S. mining industry. The economic impact to a mining company for contamination is not only realized in legal fees and fines but also in the cost of doing normal business. For example, a mining company with contaminated property applying for a loan may be refused because of a lending institution's reluctance to finance due to liability concerns. Or, an insurance company may decide to greatly increase its annual premiums because of existing or potential contamination problems. One of the main duties of the environmental manager is to seek ways to reduce these types of problems by eliminating contamination or by knowing what problems exist and designing corrective measures to prevent the situation from worsening.

Environmental auditing has evolved rapidly over the last decade — first in North America, then Europe, and most recently in Asia — into a widely practiced discipline designed to provide senior management with assurance that operations are being managed in compliance with established governmental standards, internal company policies, and good industry practices. This paper first examines the evolution of environmental auditing, focusing in particular on three interlocking driving forces: company initiatives, collaborative industry initiatives, and government initiatives. Characteristics of effective audit programs, those that have emerged among the leaders, are discussed, including: objectives, scope, coverage, approach, staffing, and organizational considerations. The author then addresses important future trends and developments for environmental audit program design, content, and coverage.

The tolling, or processing for a fixed fee, of aluminum drosses to recover the metal units is a common practice in the Aluminum Industry. The Dross Toller is acting for the owner, and since most dross processes result in material going to landfill, it is important for the owner of the dross to insure that the toiler is processing the material and handling waste disposal in an environmentally responsible manner. The paper discusses the Dross Toiler Audit Program, first from the Reynolds Metals Company perspective. As environmental laws and regulations become more complex and the economic cost of non-compliance becomes greater, periodic assessment of environmental compliance, identification of potential liability and implementation of any necessary remedial action should be a standard part of the operational methods of any successful business. The title of this paper "Environmental Audits, A Shield, A Sword or A Trojan Horse?" is intended to draw attention to the fact that environmental audits can be used positively to shield a business operations from actual or potential environmental liability; can be used proactively as a 'sword" in both a marketing context ("do business with us because we conduct our business safely and professionally?) and as a mechanism for developing positive relationships with environmental regulators; and, used negatively, as a "Trojan horse", by developing information which those same environmental regulators (or the public) use in an enforcement context against your business or that of your clients. This paper will discuss the concept of environmental audits in general; the pros and cons of conducting the same; and the role of the attorney, as part of the "audit" team, to insure, to the greatest extent possible, that the audit process is productive from both a managerial and legal perspective.

This project will report findings on the establishment of a new surface test site at the Colorado School of Mines Edgar Mine. Concerns over the blast effects on site neighbors prompted the study to be conducted. The current maximum charge weight of 20-lb was studied to ensure that all environmental effects were within the range prescribed by state and federal regulations. Geophone locations were surveyed using GPS and monitored using Instantel Minimate Plus instruments. Distances and orientation of measurement sites to the test site were varied according to the local geography and geology. Weather conditions were also observed and recorded during all tests. Neighbor complaints were recorded and taken into account during analysis. Current results show that the current charge limit results in a safety factor of over 200 for all blasting activities at the site. Data collection is ongoing and a review is to be conducted annually. A popular perception by the public and many mining claimants, is that the 1872 Mining Law provides a statutory right to mine and extract minerals from the public lands. This perception in reality, is both true and false, depending on the mining claimants' ability to meet federal and state environmental, cultural and endangered species laws. Land use decisions and proposed legislation affect exploration and development opportunities in California. It is imperative that the mining industry involve itself in the planning process to ensure that BLM decision makers are fully informed of industry's knowledge and concerns. STATUTORY RIGHTS AND ENVIRONMENTAL CONSTRAINTS "No other problem has such a sense of urgency and poses as profound consequences to the quality of life and the creation and distribution of societal wealth as how we protect the environment. Certainly, the environment is the single biggest issue facing mining and mineral activities in the new decade. David S. Brown The 1872 Mining Law was passed, ironically, the same year the nation's first National Park was established. It is a perception that the establishment of Yellowstone National Park was the beginning of the United States' earliest environmental movement; brought on, perhaps, by the rapid clearing of land for homesteading purposes and, the concern that many acres of the public domain were being disposed of through a multitude of public land laws. While there was an effort being made to designate some special and unique public lands as parks for preservation purposes, environmental concern and awareness did not lead to mandatory identification of environmental impacts and appropriate mitigation until the passage of the National Environmental Policy Act in 1970. Consequently, it is not surprising that the original United States Mining Laws of 1866, 1870 and 1872 had no mention of environmental protection. There have been numerous attempts to repeal the 1872 Mining Law over the last 50 years for a variety of reasons. Currently, there is a perception by the general public, media and even some in congress, the mining industry and BLM that a change is needed. The environmental organizations want the industry to be more accountable for reclamation and post mining uses. In Tn nEnvironmental Agenda for the Future," leaders of America's foremost environmental organizations state that the mining law "includes no protection for the environment," and therefore, should be reformed. We can all acknowledge, as stated above, that the mining law, per se, requires no "protection. However, the Bureau of Land Management (BLM) clearly has the authority and the responsibility to fully "protect" non-mineral resources while providing for the extraction and processing of mineral resources by private industry. There are about 13 major federal laws that have indirectly or directly amended the mining laws to require Environmental, Historic and Cultural Protection." There have been many mining law case decisions about the statutory and constitutional rights of miners to explore open federal lands, "stake a claimg" and extract minerals. In-situ uranium mining is a relatively new and innovative method utilized for the commercial extraction of uranium. As with any mining method, however, significant environmental concerns will be evident and must be addressed in a rational and far-sighted manner. Experience has shown that radiological and non-radiological environmental problems may not manifest themselves until after the in-situ methodology has become established and matured to some degree. It is important, therefore, to recognize potential environmental concerns and incorporate them into an environmental program that spans the premining, mining, and post-mining phases of an in-situ operation.
