The decade of the 70?s saw a series of landmark environmental resource programs enacted by the Congress. Many states followed suit, so that by the end of the decade air quality, water pollution, and the conservation of other natural resources, including minerals, were the subject of a wide-ranging body of laws, policies, regulations, and procedures. Many of the actions required or permitted by this rule-making involved areas for which adequate information and substantial experience were not available. Moreover, goals and objectives were sometimes established which were enormously difficult to achieve technically, or of such formidable expense as to cause concern about their consequences in the marketplace. It is therefore hardly surprising that one product of all this activity has been a mass of litigation. Court dockets are crowded with suits and counter-suits involving both substantive and procedural aspects of environmental protection. Indeed, it is probably fair to say that the volume and range of environmentally-related disputes brought before the courts parallels that generated by the civil rights movement a decade ago. There were also some new dimensions to the environmental movement. For the first time, the national environmental policy act required agencies to prepare environmental impact statements when proposed projects or activities would have substantial impacts on environmental resources. Another requirement of many of the new programs mandated meaningful citizen participation in public decision-making. Here, as elsewhere, the purpose was admirable, but guidelines were vague, and the result often was inaction, polarization, and litigation.

The intensity of environmental conflict, the delays and legal battles that have marked the 1970's suggest the need for additional processes to resolve environmental disputes. Our present means frequently fail to address the real issues separating individuals and institutions. They are primarily adversary processes that foster polarization and reduce cooperative efforts. At the Office of Environmental Mediation, we have no quarrel with adversary processes nor with polarization, for both serve as important spurs to necessary change. We do seek cooperation among parties at a point where there can be a realistic expectation of success in facilitating a resolution of their mutual differences.

"The level of scientific knowledge about the effects of contaminants is increasing and changes in environmental monitoring are likely to allow for the assessment of environment effects particularly to the aquatic environment. This paper provides an overview of recent developments in this area which include the environmental effects monitoring program for pulp and paper operations, the assessment of the Aquatic Effects of Mining (AQUAMIN) program, the Aquatic Effects Technology Evaluation (AETE) program, and the review of the federal Metal Mining Liquid Effluent Regulations (MMLER). The paper also provides a look forward at the direction of environmental monitoring of mine projects in Canada. IntroductionEnvironmental monitoring programs provide a wide range of data to environmental management systems, regulatory authorities, and stakeholders. The data obtained are used to demonstrate that operations are in compliance with regulatory environmental protection requirements, and provide the scientific basis for assessing the effectiveness of environmental protection measures. Environmental monitoring requirements for mine projects are established based on the type of operation, site specific issues and concerns, and the requirements of regulators and mine proponents.The level of scientific knowledge regarding the potential effects of contaminants on the receiving environment is increasing, and in particular with regards to the receiving aquatic environment. Regulatory controls regarding the protection of fish, fish habitat, and fishery resources are being reviewed with regards to their adequacy, and the environmental effects monitoring program on the pulp and paper industry is expected to provide useful data relevant to those types of operations. These developments are of interest to mine proponents as it is presently expected that an environment effects monitoring program will be developed specifically for the metal mining industry under a regulated environmental effects monitoring program as part of the Fisheries Act. This paper reviews recent developments in this area, and provides a look forward on the future directions of environmental monitoring programs."

Environmental monitoring plays a key role in coal mine safety. In recent years, significant advances have been made in the development of systems suitable for monitoring air in underground coal mines. Because of intensive mining and large capital outlay, the need for higher productivity consistent with safety is well recognized and it appears that environmental monitoring may help achieve this objective. This paper reviews the state-of- the-art in the monitoring technology with particular reference to hazardous gas detection in underground coal mines. The preliminary results obtained from ongoing studies, with regard to continuous monitoring of methane and carbon monoxide in mine air in some of the operations in Western Canada, are discussed. The inadequacies of the methods using spot samples are examined and the need to supplement the present practice with continuous monitoring systems is emphasized.

The impact of recent legislation on Florida phosphate industry operations has been dramatic. The most significant influences are described: the National Environmental Policy Act of 1969; the Federal Water Pollution Control Act Amendments of 1972; and implementation of the Florida Environmental Land and Water Management Act of 1972. Further discussion includes: critical examination of the recently completed EPA Areawide EIS; potential effects of the Resource Conservation and Recovery Act of 1976; the Surface Mining Control and Reclamation Act of 1977; current local and state laws; and summary of studies on radiochemical effects of mining, seepage from gypsum ponds, and dewatering of waste clays.

In July 1986, Cable Sands (W.A.) Pty Ltd commenced mining for mineral sands at Minninup, approximately 16 km south of Bunbury, Western Australia.The area being mined is from the heel of the foredune to the rear of the hind-dune. The vegetation is mostly native vegetation with some old degraded pasture.The mining operation will be by suction cutter dredge, with continuous dredging, mineral separation and re-depositing of the sand.

These encompass all adverse effects of oil shale mining, processing, and ancillary developments on the environment. Specific problems concern: land, vegetation, wildlife, water, air, population growth, aesthetics and public emotion; and fall into four categories of: land, water, air and emotion. Land includes excavations, spent shale disposal, loss of vegetation and impact on wildlife and domestic grazing, plant sites, buildings and roads, necessary urbanization and the total aesthetic or visual Impact. Water considerations are: requirements for Industrial and domestic supplies, adverse effect of underground water on mining, avoidance of pollution or adverse effect on surface or near-surface water, and the utilization or safe disposal of liquids. Air problems include dust, smoke and stack gas, Public emotional problems include reaction to the above problems, and misconceptions of oil shale country and an oil shale Industry. Government and industry are aware of the problems, and are seeking solutions. Last year, the three affected states studied oil shale environmental problems and solution costs. Colorado estimated environmental costs would add approximately 7% to construction and 7% to operation. The report suggested research in: (1) Water availability and impact; (2) Disturbed lands revegetation and rehabilitation, including spent shale; (3) Environmental inventory and impact; and (4) Regional development and land use planning. Governor Love appointed a 47-person committee representing Industry, government and environmentalists to attack the problems. Research pro-posals were prepared to focus on each problem. $715,000 state, federal and industry money is being committed. Results should provide data for industrial solutions and equitable agency administration.

INTRODUCTION The Scope of the Chapter This chapter discusses environmental regulation and closely-related public policies associated with mineral development in the United States. This chapter outlines the nature, extent, and amelioration of secondary effects of mineral development. It sketches the policy foundations of regulation; discusses the implementation of environmental law; describes land use conflicts and land management regimes; and surveys the costs and benefits of environmental regulation. Since regulations are subject to frequent change, the chapter emphasizes basic factual and conceptual material, rather than specific regulations. The goal is to familiarize the reader with the general nature of environmental impacts and mitigation which arise in the minerals industry, and with the issues surrounding the regulation debate. The chapter is organized as a series of sub- chapters. The first of these is a discussion of the conceptual foundations of regulatory policy. The second section summarizes the principal federal environmental statutes, and the implementation of such regulation. Following that, the third section summarizes the current state of knowledge regarding the types of environmental impacts associated with mineral development. This discussion, organized in a format similar to that used in environmental impact statements, can be thought of as a guide to reading and understanding such statements. Next, the fourth section surveys studies of the costs and benefits of environmental regulation. 'These empirical studies are evaluated in terms of the framework developed in the first section of the chapter. In the fifth section, the discussion turns to federal, state, and local approaches to land use control and siting, and the economic analysis of such conflicts. Included are discussions of the two principal forms of public lands mineral entry, the 1872 location patent system and the 1920 leasing approach. CONCEPTUAL FOUNDATIONS OF REGULATORY POLICY David A. In a market society, the private sector is presumed to be the most appropriate economic agent. Given this presumption, regulation generally begins with a demonstration of persistent problems under laissez-faire in a given context. Environmental and related regulation occurs because the public believes the free market does not properly value environ- mental quality. In this section, concepts are advanced to aid the reader in understanding the government's role in this respect.

Genesis 1:28 "And God blessed them and God said he fruitful and multiply and replenish the earth and subdue it and have dominion over it." Genesis 2:15 "And the Lord God made man and put him in the garden to dress it and keep it." Depending on one's perspective, these two verses from the Book of Genesis either complement one another or are in conflict. I believe that they are complementary. What they imply is that where there is privilege, there is responsibility. Privilege comes from the fact that the Lord created the heavens and the earth and he placed man on the earth to have dominion over it. The responsibility that accrues to us comes when the Lord also said that we are accountable for how we handle that which he has given us. The very nature of our responsibilities in resource utilization or, more appropriately, resource management, has changed over time as the nation's needs and priorities have changed. Thus, I have attempted to examine, from a historical perspective, how natural resource policy has evolved, where we are now and what may lie ahead.

The amount of waste generated in any of the mining processes is large, in fact, the mining industry is the largest generator of solid waste in Australia. In order to minimise the waste generated within the industry it has become of interest to handle the particulate fluid wastes, or suspensions, at high concentrations, thus removing water and some of the reagents which may be harmful to the environment. The resultant highly concentrated suspension is a non-Newtonian fluid. Rheology deals with the flow of non-Newtonian fluids; therefore a combination of rheological understanding of high density suspensions, in conjunction with an understanding of the environmental problems being faced by the mining industry, can and has led to improved methods of waste disposal in the industry, ie waste minimisation. This paper describes the progress that has been made in the development of dry disposal technology in the mining and minerals industry in Australia.

The sorptive and impervious nature of clay materials was recognized long before modem technology allowed us to understand the physiochemistry of clays. In Cyprus, around 5000 BC, sorbent clays were used for fulling woolen cloth. One of the earliest recorded uses of clays as an impervious liner was more than 3200 years ago in the construction of a bitumen-sand-gravel-clay liner built along the embankment of the Tigris River at Assur. Today one of the most common applications for clay minerals in the environmental industry is for use as impermeable barriers to fluid transport. Clay minerals are fine in particle size and thus have large surface areas, which, as a result of intermolecular forces and ionic substitutions, make them excellent materials for both ion exchange and ion sorption. Therefore it was logical to consider certain clay materials for applications in the environmental industry, where they can act as physical and chemical traps for potential contaminants. Certain bentonites have historically been used as sealants for fluids (Grim, 1962), and other clays have been used as sorbents for both water and oil (Haden, Jr., 1972). Prior to the 1980s, disposal of the nation's municipal, commercial, chemical, and nuclear wastes was largely indiscriminate and poorly regulated. This created environmental pollution problems, especially with respect to groundwater contamination. Promulgation of federal regulations like the Resource Conservation and Recovery Act (RCRA) and the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA - commonly known as Superfund) have forced a more careful and costly approach to waste disposal. The US Environmental Protection Agency (EPA) is the government body charged with enforcing and ensuring compliance with federal regulations governing toxic waste production, storage, and disposal. Widespread application of geotechnology to the design and construction of waste containment systems and to pollution remediation has become necessary due to such laws and because of increasing use of the subsurface environment for the disposal of hazardous wastes. In the United States nearly 1.8 kg of trash is disposed of per person per day, which amounts to nearly 181 Mt per year. This amount is more than double the waste produced in 1960, and these numbers are expected to continue to increase. Canada produces approximately 1.68 kg of waste per person per day. The EPA estimates that in the United States 64% of our garbage is landfilled, 18% recycled, and 18% incinerated. Even with continued increases in recycling and incineration efforts, the EPA projects that the United States will still need 82% of today's landfill capacity in the year 2000. Data on the exact number of landfills in the United States and Canada is conflicting in part because of changing definitions of what constitutes a landfill and because of inadequate record- keeping by some states and provinces. An estimate of the number of municipal solid waste (MSW) landfills in the United States in 1990 to 1991 ranged from 4 462 to 10 467 with an average estimate of 6 600. In Canada the number of MSW landfills reported varied from 5 493 in a 1982 survey to 1 766 reported in a 1991 National Solid Wastes Management Association (NSWMA) survey (Repa and Sheets, 1992b). A properly operated MSW landfill on average requires 1 hectare of land per year per 25 000 people (Coates, 198 1). In addition to MSW facilities, there are also waste disposal facilities needed for hazardous waste and low level and high level radioactive waste. In 1983, approximately 266 Mt of hazardous waste was generated in the United States, almost 50% of this by industrial production. About 68% of the hazardous waste generated in the United States and Canada and almost 50% generated in Europe are still landfilled (Egger, 1987). In 1985, approximately 51 000 m3 of commercially produced low level radioactive waste was disposed of in radioactive waste disposal sites across the United States (Jungling and Greeves, 1989). By 1987, the US defense program had produced approximately 10 000 t of high level nuclear waste. In addition, there were approximately 14 000 t of spent fuel assemblies from commercial nuclear power plants in temporary storage; the amount is expected to nearly triple by the year 2000. Presently most commercial spent fuel assemblies are stored in water-filled pools at nuclear power plants. Defense waste is stored on federal reservations in surface and underground steel tanks (Anon., 1987). Under federal law nearly all waste disposal and containment sites are required to have a liner or barrier and a cover system design that meets federal- or state-approved hydraulic conductivity requirements for the type of waste that the site will receive. When approved materials, necessary for constructing the waste containment structure, are not available on site, one of the most economical ways to meet these requirements is through the use of clay, soil/clay, or clay/geotextile materials. In a 1991 survey by NSWMA of its members and other select private sector facilities, 81% of the surveyed landfills had some type of liner system. About 75% of these liners were clay materials (either recompacted or natural). The remaining 30% were using flexible membrane liners as part of a liner system. Clay liner materials are most commonly used in the South, Midwest, West-central, and South-central regions of the United States. About 93% of the landfill facilities had closure plans, and of these 91 % were using clay materials in some way for the final cover material (Repa and Sheets, 1992a). Waste barriers and containment structures take several basic forms, and they are used in a variety of different applications: 1) cutoff walls, 2) soil or soil/clay-admix liners, 3) geosynthetic bentonite-clay/geotextile membranes, 4) radioactive waste containment barriers, and 5) synthetic geomembranes. "Brazil is the sixth worldwide producer of aluminum and Votorantim (Metals) has been operating three bauxite open pit mines in a particular way of working. In those the deposits occur on the top of hills, under forest, coffee, eucalyptus plantation or pasture area.The deposits are not large and normally mining takes an average of two months to be completed before starting the rehabilitation process, which demands a good strategy in mining planning to achieve the production goals.The benefit function developed to select feasible areas uses, beyond production costs, fees from the owner by using their area and rehabilitation cost. Both are based on land use and occupation field survey data. In this process each area with different land use receives a specific rehabilitation cost as input into a block model.Once the selection is made the mining schedule begins, taking into consideration the following premise: the orebody needs to be mined in a short period of time because during this time, the surface owners receive from Votorantim a compensation based on the expected profits from their plantation or pasture, plus royalties related to the ore amount existing in their area.Not all operations have waste dumps. Waste is pushed down by bulldozers to the lower part of the ore border. After loading and transporting ore, the waste is handled back to the mined area to fit the topography. With this step concluded, the mined area is directed to the environmental team who, alongside university partners, develop land reclamation to return them to their owners, eg in 2011, 110 ha were rehabilitated of which 29 per cent is native forest.Votorantim closes many mined areas a year and currently the entire mine planning considers this particular way of operation, making profit with minimum interference with the community and the environment.CITATION:Artioli, P, Kato, M S, Romanel, A and Piermatei, M P, 2012. Environmental, social and governance issues (ESG) have become a defining feature in the marketplace to differentiate preferred investments. With the sustainability commitment and reporting landscape anticipated to evolve exponentially, it is now imperative to rapidly develop the approach taken by mineral companies to adequately identify and address ESG risks and opportunities in the reporting of Mineral Resource and Mineral Reserve (MRMR). MRMR cannot be effectively reported as technically and financially assured and realistically executable, if ESG is not integrated into the strategy, business model, input assumptions and process that defines and drives robust MRMR public reporting. Regulatory reporting codes across the globe are presently in various stages of being updated and modified to ensure ESG factors are appropriately covered as a key part of diligent and transparent disclosure. Security exchanges are making it clear that companies must not omit ESG risks from reports to investors. This paper discusses associated challenges for MRMR reporting and suggests avenues for improvement. Key themes include: the importance of procedure rather than prescription and checklists; how ESG criteria impact Modifying Factors and determination of Reasonable Prospects for Economic Extraction (RPEE); the need for financial models to account for material ESG commitments; the uniqueness of each mineral asset; the need for education, upskilling and accreditation of both ESG experts about MRMR reporting and equally Competent Persons in ESG matters; and the need for clear and balanced reports that meet the needs of end users. (RPEE is adopted here for simplicity and consistency, recognising that some reporting codes still include ‘Eventual’ in the term (ie RPEEE). Whilst RPEE and RPEEE are subtly different the intent is to point to the process of assessing ESG factors in determining reasonable prospects.) The principles of transparency, materiality and competence remain paramount when considering the impact of ESG matters on MRMR reporting, and this necessitates an inclusive, cohesive, and integrated approach to assessing ESG issues to ensure the necessary expertise and diligence is applied.

In operations that use the sublevel stoping mining method, production scheduling takes into account factors, including ore reserve envelopes, ore grade averages, equipment capacity, feed controls to the mill, and geotechnical restrictions, across the scheduling horizon. Mathematical programming is one of the most effective methods for enhancing the decision-making process in regard to the most viable production schedule in light of a given set of limitations. The majority of research on sublevel stope mining focuses primarily on a single objective of optimisation, which is to maximise the net present value (NPV). Environmental, social, and governance (ESG) considerations are becoming more prevalent in the mining industry. This includes aspects relating to deforestation, land disturbances, gas emissions, community relations, and water usage, among many others. Institutional and other kinds of investors are becoming more interested in the work that resource companies do regarding their ESG obligations. This review article identifies the gap in the existing literature and proposes to simultaneously optimise the production schedule around three objectives. Two of these relate directly to ESG aspects.

"The gold ore zones of the Campbell and Dickenson mines occur within a km-wide, 2 km-long zone of highly altered and anomalously fissile and deformed volcanic and subvolcanic intrusive rocks, cut by a series of mainly post-deformation mafic and quartz-feldspar porphyry felsic dykes.Three main periods of gold ore-forming hydrothermal activity are recognized. In the first, the mine rocks were extensively altered and gold and arsenic enriched; syn-volcanic auriferous veinlet and low-grade chemical sedimentary ores were deposited in what was a major discharge zone of a submarine hydrothermal system. The chemical sedimentary ores are closely associated spatially and temporally with domal rhyolitic extrusions. Because of its mechanical and chemical properties, this synvolcanic alteration zone became the locus of later deformation, and the site of the generation of auriferous hydrothermal solutions, perhaps by pressure solution processes at depth. These solutions deposited, synchronously with deformation and metamorphism, the second and most economically important type of ore zones in the mine: large foliation-parallel and foliation-oblique banded carbonate- 'chert' Rssure-filling veins.In the third and final mineralizing event, high-grade, pipeshaped zones of siliceous replacement-type mineralization, and quartz-arsenopyrite-gold veins, were superimposed on the previous mineralization types after most of the deformation, but before the emplacement of the late dykes. The source of heat and also possibly the fluids for the third mineralizing period may have been the dyke-forming igneous activity. The textures and mineralogy of the banded carbonate- 'chert' veins suggest a near-surface (<3 km) environment of deposition, but their relationship to the fabric of their host rocks indicates they were emplaced in an environment, presumably at considerable depth (5-10 km?), in which the rocks were undergoing intense penetrative deformation. This anomaly is unresolved."

As we strive for a sustainable and resilient future, repurposing assets has become a top priority. In Australia alone, we have a significant number of mineral projects in the pipeline, extensive existing operations, and over 50 000 legacy sites. Collectively, this presents a unique opportunity to be a world leader in mine rehabilitation. Complex stakeholder landscapes, inflexible policies, aged regulatory frameworks, technical uncertainties and increasing liabilities are all barriers hindering effective transition of legacy assets. The impetus for change is further catalysed by shifting consumer preferences, workforces in flux and regional Australians questioning what the transition means for their local community. We need innovative approaches to take a leading role in the industry and support global efforts more broadly. Co-designing an ambitious, shared vision spanning projects, operations and legacy assets with all key parties is a fundamental step to unlock and realise maximum societal, environmental, economic and reputational value. Serious play and gamification can further enhance this visioning process.

A multi-element geochemical response, with contrasts of up to 29 times background, was obtained in soil above the Mountain Lake Diatreme, northwestern Alberta. The overall geochemical signature is indicative of an ultramafic source; geochemical responses contain elevated concentrations of Co, Cr,O, Cu and Ni with the presence of high Ba, Ga, HI, PO,, Rb, Ta, Ti and light rare earth elements suggestive ofa kimberlite or lamproite body. The shape, or morphology, of the enzyme leach-based geochemical signature over the Mountain Lake Diatreme combines moderately strong to strong oxidation halos, or a rabbit's- ear geochemical profile, with a sharply-defined apical geochemical profile. Because some Alberta diatremes discovered to date form positive topographic highs, the resultant geochemical signature may express the soil development profile that forms directly on top of kimberlitic and lamproitic bodies. The enzyme leach technique, which has proven to be a useful tool in base metal, precious metal and petroleum exploration, may have a significant impact on exploration for kimberlite, lamproite and related rocks in Alberta by providing industry with a useful and cost effective tool to probe blind and/or buried anomalies identified by airborne and ground magnetic surveys in areas of glacial overburden.

The Environmental Protection Agency (EPA) is in the early stages of developing a national mining waste program. Our goal is to develop a mining waste program that will be state implemented, multimedia in nature, flexible, utilize and enhance existing state programs, and protect the environment. The Agency appreciates the cooperation the mining industry is providing through its participation in the Policy Dialogue committee on Mining and by providing the Agency with technical data. The following is a discussion of what led to the development of a national mining waste program, the agenda initiative to evaluate Toxic Substances Control Act authority in phosphate manufacturing, and the important steps being taken through the Policy Dialogue process to frame and discuss issues. EXTRACTION AND BENEFICIATION OF ORES The Resource Conservation and Recovery Act of 1976 (RCRA) and subsequent amendments created a framework for the regulation of hazardous wastes under Subtitle C and nonhazardous waste under Subtitle D. In 1978, initial regulations were proposed for hazardous waste management units under RCRA. These identified a universe of special wastes that were large volume, low hazard and less amenable to Subtitle C control techniques. EPA noted that waste materials from the "extraction, beneficiation and processing of ores and minerals m fit these criteria. In October 1980, Section 3001 of RCRA was amended. This Bevill amendment excluded solid waste from the extraction, beneficiation and processing of ores and minerals from regulatory control under RCRA&apos;s hazardous waste Subtitle C. This was done pending a report to Congress and a regulatory determination regarding the Subtitle C status of these wastes. Thus in November 1980, EPA published an interim final amendment to the RCRA Subtitle C regulations to reflect the Bevill amendment. RCRA requires EPA to perform studies and make reports to Congress regarding the management methods and potential hazards of managing waste. RCRA also calls for a regulatory determination regarding whether Subtitle C (hazardous) or D (non- hazardous) controls are warranted for these wastes. In December 1985, EPA submitted a report to congress entitled, “Wastes from the Extraction and Beneficiation of Metallic Ores, Phosphate Rock, Asbestos, Overburden from Uranium Mining and Oil Shale." In that report, EPA found that some mining wastes exhibit hazardous characteristics, that the range of risk from mining waste is broad, and that waste management practices have caused environmental damage. In July 1986, EPA published a regulatory determination based on information gathered in the 1985 report to Congress and comments from interested parties. In the report, EPA concluded that RCRA Subtitle C regulation of extraction and beneficiation wastes was unwarranted because mining wastes tend to be disposed of in arid climates, waste volumes are high, and facilities and wastes are located in sparsely

EPA&apos;s Office of Solid Waste (OSW) is developing a program, under Subtitle D of the Resource Conservation and Recovery Act (RCRA) to regulate the management of non-coal mining wastes. In May 1988. OSW produced a "Strawman", which is a working document that is precursor to a proposed rule. OSW has been working closely with environmental groups, industry, and States to solicit comments and feedback on the mining waste program. OSW currently plans to release a second "Strawman" in early 1990. A proposed rule is tentatively scheduled to be published in the spring of 1991.
