The Court rejected the suggestion that CRAE had actively misled DMR concerning the worth of its tenements. The Court agreed that CRAE remained silent about certain significant information concerning CRAE's own tenement area. It was a significant question as to what duties CRAE'was under, given that it was in joint venture with DMR in respect of one of the tenement areas. Did that joint venture create an obligation on CRAE to disclose everything it knew? The Court said no. The Court said that the fiduciary duties were defined by the terms of the farm-in agreement between DMR and CRAE. When the Court examined the disclosure obligations within the confines of the contract, it held that CRAE had not breached those terms.

The mineral wealth of pre-Cambrian rocks in Canada has been the subject of much study by geologists and engineers (members of this Institute), particularly so in the past few years, following discoveries of mineral deposits in areas far a part. This interest is well worth sustaining knowing the numerous rich producing mines within the pre-Cambrian formations, and the vast area covered by its rocks throughout this country. The pre-Cambrian has yielded minerals, both metallic and non-metallic; of these a much diversified list could be made. In more than one district we can point to mining as being responsible for the opening up of new sections, attracting a population into regions which otherwise would have remained virgin land of little commercial value. In these pre-Cambrian formations are found the rich copper deposits of Michigan, producing without interruption since 1845, and from which seven billion pounds of copper has been won; while in Minnesota and the adjoining district, at the head of Lake Superior, are mined iron ores which have rendered possible the great steel manufacturing industry of United States, the base of the economic structure of that wealthy country. The pre-Cambrian has given Canada the nickel-copper mines of the Sudbury district, the silver deposits of Cobalt and the gold camps of Porcupine and Kirkland Lake. With all of these our members are familiar; and it suffices to mention them to bring to mind pictures of the wealth and 'the growing population, in a word the importance of mining in?those sections of the country.

IT will be recalled that the first professor of metallurgy in the United States, appointed in 1855, never really gave any instruction in metallurgy and gradually turned into a professor of mineralogy. Metallurgy was included with. mining in the early curricula, two students who took the B.S. in mining engineering from the Polytechnic College of Pennsylvania in 1862 wrote their graduation theses on the metallurgy of copper and zinc, respectively. Even after Columbia School of Mines established, in 1868, a separate curriculum leading to the Ph.B. degree in metallurgy, very few students elected it,* preferring to take the mining degree, since they received in its curriculum nearly all the metallurgical instruction they would have in the metallurgical curriculum. For many years a large proportion of the men who attained prominence in metallurgical enterprises had taken mining rather than metallurgical degrees. METALLURGY Clifton Sorby's study of thin sections of rocks under the micro¬scope, beginning in 1850, and its subsequent development by Zirkel and others, had made microscopic petrography a recog¬nized department of geological research as early as 1873. . It was inevitable that the idea of studying polished metal surfaces-¬under the microscope by reflected instead of transmitted light would occur to investigators. The Central Manitoba mining district, as spoken of in Manitoba, refers to that portion of the country lying between lake Winnipeg on the west and the Ontario boundary on the east, and from a few miles north of the Wanipigow (or Hole) river on the north, to a few miles south of the Bird river. It embraces two known mineralized belts; the gold area in the north, extending from the shores of lake Winnipeg almost to the Ontario boundary (in a slightly southeasterly direction) a zone some eight or ten miles wide and perhaps forty miles long, lying (for the most part) north, and parallel to, the Manigotagan river; and the Bird river copper and coppernickel deposits, an area not yet clearly defined, but in general lying immediately north of, and roughly parallel to, the Bird river. To the south of the Bird river is a somewhat differently mineralized area, numerous pegmatite dykes being found, with minerals typically associated with such rocks. More specifically, the known gold deposits are largely segregated in the above belt; (1) around English brook; (2) along the north shore of Wanipigow lake; the Rice lake area (about midway of the belt); and the Long Lake-Bulldog lake area, at the eastern end of the belt. Not all the known gold occurences are found in these segregations, but the density of claim staking in these areas is perhaps an indication of the greater number of prospects found in them to date.

FOR a number of years up to the economic setback of the 1929-1931 period, the greatest proportional advances in the mineral industries in California were made among the substances in the nonmetallic groupings, particularly among the so-called industrial minerals and the salines. During the past year or two, although these have not regained the stride that marked their progress in the preceding decade, we can still record, -some new developments. California produces annually between 55 and' 60 different minerals on a commercial scale. A new larger, more efficient and economical Mitsubishi furnace line at Naoshima was put into operation in May 1991. Naoshima Smelter had produced previously about 230,000 mtpy anode copper with two smelter lines, i.e., a conventional reverberatory furnace line and Mitsubishi furnace line, which had been shutdown at the same time of the start up of the new smelter. At the beginning of the operation, there were several initial problems at the area of off gas trains and feeding system. By overcoming them now the process has been continuing satisfactory operation at the design rate. The paper describes about the design concepts and the actual operation of the new smelter.

SOME idea may be gained of the tremendous consumption of refractories by the open-hearth steel manufacturers from a statement made by A. T. Green at a meeting reported by T11.e Industrial Chemist of London, as follows: "At a very progressive steel plant in the Midlands, with a battery of five open-hearth furnaces working. twelve months and making 3000 tons of steel per week, the cost of refractories per ton of steel produced averages about $0.50 for the actual open- hearth casting and $0.12 for those operations incidental to the rolling of the metal." .These figures, when translated into the annual tonnage of steel, represent a very considerable expenditure.

World wide applications for nickel use will be summarized and examples of those uses given. Nickel products are critical to many important aspects of modern society. These products are just as important for modern China as they are in other parts of the world. It is argued that future pattern of nickel use in China should be expected to be very similar to that in the rest of the developed world. Total use of nickel in products in China is already very large. In 2004, it was the largest market for stainless steel (nickel containing) in the world. A survey of Chinese stainless steel applications will be presented. Current high nickel prices have revived speculation about substitution, particularly for nickel containing stainless steels. The presentation will discuss some of the complicating factors that need to be taken into account when considering substitution. These factors are as valid in modern China as they are in other developed economies. Recent substitution efforts and the reaction to them will be examined. The Nickel Institute position regarding appropriate application of the various grades of stainless steel will be discussed. Price-motivated substitution in China, and elsewhere, will occur but it is argued that the extent will probably be limited.

Coal was discovered in South Africa in the mid 1830's. The earliest exploitation of modern times was probably in Natal where, in a letter dated 20 August 1842, a Captain Smith mentions that a wagonload of coal brought to Pietermaritzburg, was sold. Until the discovery of diamonds in 1867 and the Witwatersrand gold in 1886, coal mining satisfied a very small domestic demand. By 1889, at least four collieries were operating in the Middelburg-Witbank district, some 120 kilometres East of Johannesburg, and mining had star- ted at Vereeniging, about 50 kilometres to the South of Johannesburg. "During the summer of 1968, the author was employed in the Research Department of Dominion Foundries and Steel, Limited, Hamilton, Ontario. Over the years, Dofasco has been conducting a program for developing more efficient control of its basic oxygen steelmaking process. The author was thus able to obtain a variety of viewpoints from both research engineers and furnace operators. He also had access to extensive literature dealing with BOF control schemes underway at other major steel producers. This paper describes the present state of developments in BOF steelmaking control.The necessity for efficient BOF control is pointed out. To appreciate the variables to be controlled, a brief outline of process fundamentals is included. Technical aspects of present methods of practical control are examined in detail; the relative merits of dynamic over static control models are emphasized. Finally, it is shown how an effective dymic-optimizing control scheme serves as the basis for closed-loop computer control of the process."

THE subject assigned is rather a broad one but it, is doubtless expected that it will be dealt with as applying to metals and alloys and not to the ob-taining of metals from their ores. The liberty will further be taken of confining the matter discussed to copper and some of the copper alloys. Everyone is familiar with copper, at least everyone who attends the meetings of the A. I. M. E., so no gen-eral description of the metal is necessary. There are still to be recognized two classes of copper and each of these has some sub-divisions. The two general classes are electrolytic and fire-refined copper. Since there is some misunderstanding about these materials, definitions are in order. Electrolytic is just what the name implies. It may and it should be very pure but with high current densi-ties or very impure anodes, or both, impurities such as antimony, tellurium and lead may be carried over to the, cathode. Any one of these, or a combination in which they occur, are alike fatal to good working quali-ties in the resulting metal. Of course, these metals are not supposed to be deposited with copper, but slimes containing them may be 'occluded. in the deposited cop-per or held in rough cathodes if not washed with suffi-cient thoroughness.

STRIKING new developments in the field of industrial minerals include the employment of lime, salt, coal, and air for the manufacture of stockings, and the substitution of paper for granite and marble in making tombstones. Certain minerals that have heretofore been regarded as valueless except as museum or laboratory specimens, are now being applied commercially. Serpentine, in forms neither fibrous nor ornamental, massive topaz, pinite, and zoisite are examples. For certain other minerals, notably pyrophyllite, bentonite, vermiculite, and sulphur, extension of established uses into new fields has occurred. Substitution takes a toll in many industries, but producers of industrial minerals as a class have gained more than they have lost in recent years. SINCE 1934 there has been a marked revival of interest in the Porcupine district, especially in the eastern portion of the area, where exploration on the property of Pamour Gold Mines has indicated the presence of extensive gold-bearing deposits. Owing to the prevalence of overburden and the limited amount of exploratory work that has been done, little information is available as yet concerning the distribution and structural relationships of the rocks in the area to the east of Porcupine lake. In order to throw some light on the structural conditions in this section, a brief discussion of the sequence and character of the formations in the better known, producing section of the camp has been included. It should be emphasized that this paper is a preliminary study and that, consequently, the conclusions expressed should not be regarded as final. The writer wishes to acknowledge his indebtedness to P. C. Benedict, whose study of the geological relationships on the Foley-O'Brien property has made possible a fuller understanding of the structure in the central portion of the area. With increased interest and urgency for coal mine safety and the passage of the Federal Coal Mine Health 'and Safety Act, the Bureau's research effort in roof control has been greatly expanded. One new project, the subject of this paper, concerns improving conventional roof bolting and has been involved with the effects of different variables on the performance of roof bolt expansion anchors. These include types of expansion anchor, rock type at the anchorage horizon, borehole roughness, rate of torquing a roof bolt to set the anchor, installed tension, bolt length, and relative humidity fluctuations. For this work, two types of experiments were carried out. One was concerned with tension loss in bolt-anchor assemblies and simulated anchor performance in a static roof. The other dealt with anchor slippage as tension was increased and simulated anchor performance in an active roof. Trials were made in the laboratory under controlled conditions so that factors suspected of affecting expansion anchor performance could be selectively studied. Because of the natural variability in rock and the fact that most expansion anchor components are essentially rough castings or forgings, the experiments were designed to permit using analysis of variance techniques for analyzing data. Thus, in this paper, "significant" means statistically significant.

The productivity of the underground driller has increased 500-600% during the past 20 years. This increase is not due so much to improved percussion drills as it is to improved drill support equipment and modernization of mining methods, Efforts to mechanize drilling in mining operations were made as early as the late 1800's; and, patents on rock drill manipulating machinery date back to 1906. However, the great rush to mechanization began in the 1950's when the development of trackless mining methods gave mining engineers and equipment designers their first opportunity to create improved operating conditions for the equipment and to match the equipment with these conditions. Accordingly, this paper will summarize the developments of the past 20 years and will attempt a forecast of developments that can be expected during the next few years.

Scrap electrical and electronic appliances, so called "E-waste", are not a present target to be collected and recycled under Japanese regulations. This material, however, contains considerable amounts of base, precious, and rare metals and it is necessary to recover these elements for maintaining stable supply and establishing "the society of environmentally-sound material-cycle". This paper describes recent trends of rare metals recycling in Japan and technological approaches to achieve the above objective. Also a research work to concentrate rare metals from the printed wiring boards by combining brand new comminution and physical separation methods is discussed.

One of the most frequently asked quesitons is: "Where is copper (price and usage) going?" I will not attempt to forecast either the future price of copper or the future growth of the copper industry; rather I would like to discuss the current trends experienced in the smelting and refining terms and conditions for sales and/or purchases of copper concentrates. A brief review of contract language and terms, together with a review of the common jargon, I believe, would be helpful. To accomplish this review, I will first list what I consider the four basic parts or sections of a basic ore contract and then illustrate basic terms with calculations.

The various copper-cobalt ores mined by Gecamines, together with typical plant applications and results, are briefly described. Intensive laboratory investigations have been undertaken in recent years to improve the metallurgical performances of the various concentrators. As a result of these tests, it was shown that the flotation of the siliceous oxide ores could be improved by increasing the efficiency of the palm oil collector (energetic conditioning, chemical emulsifier, petroleum sulfonate addition) and by varying the froth depth in the cells. A new flowsheet incorporating these modifications and a regrinding stage has been approved for the rehabilitation of the Kolwezi concentrator. For what affects dolomitic oxide ores, hydroxamates were tested as secondary collectors and, based on successful laboratory results, plant trials were run but failed due to excessive frothing. In other plant tests, xanthates were replaced by a xanthate- fatty acid mixture; plant trials over more than one year proved successful for copper, but not for cobalt. Mercaptans were tested as secondary collectors for the sulfides flotation from sulfide or mixed oxide-sulfide ores; laboratory results proved successful but, to date, no plant test has been run.

THE gypsum industry of Canada, like all others connected with the construction business, has felt the full effect of the depression during the past few years, and sales of its products have been greatly curtailed. The year 1934, however, saw a decided turn for the better and a gradual but steady improvement is noticeable in all its branches. In many ways the depression has been a blessing in disguise to the gypsum industry; during the years from 1926 to 1930, demand increased so rapidly that companies were forced to expand and often new apparatus and machinery were placed in operation regardless of expense, or plants already existing were taxed to their limit and forced to keep running with the minimum amount of repairs. The depression, therefore, has really given the industry what might be called a breathing spell, in which it has had time to take stock of its position, to reduce its costs of production, to devote more serious attention to the quality of its products, and to con-solidate its operations into a smooth working whole, which as conditions improve will enable it to meet the demands of the trade with more varied products of a quality hitherto unattained. Progress in the gypsum industry, however, has not been confined to the years of the depression, for some of the greatest advances occurred under the spur of increased demand for its products by the building trade. The purpose of this paper is to review briefly some of the out-standing trends in the development of the gypsum industry in Canada during the past 10 or 12 years.

The Bureau of Mines has been investigating several techniques, including the use of horizontal and vertical boreholes, to remove gas from coal in advance of mining. Horizontal boreholes drilled from underground workings as part of the mining cycle have been shown (Finfinger, 1980; Hagwood, 1983; Perry, 1978; Prosser, 1981; Thakur, 1980; VonSchonfeldt, 1982) to be very effective in providing short-term, immediate relief from high methane emissions. This technique has been widely accepted in the coal mining industry, but it does require close coordination to integrate the drilling and subsequent gas drainage and disposal into the projected mine development plan. Vertical boreholes can be placed several years in advance of mining to predrain gas from coalbeds over relatively large areas (Dunn, 1984; Elder, 1975; Lambert, 1980; Steidl, 1978; Stubbs, 1979). The vertical borehole technique has the additional advantage over horizontal boreholes of allowing work to be performed on the surface instead of in the more restrictive underground environment. However, except for the relatively large scale vertical borehole programs for both mine safety and commercial production in the Black Warrior Basin of Alabama (Dunn, 1984; Lambert, 1980; Stubbs, 1979), the technique has been underutilized. The primary reason for this seems to be a combination of the current economic climate in the coal industry, legal questions as to the ownership of coalbed gas, and potential roof damage from the stimulation treatments required to increase the characteristically low permeability of coalbeds to enhance gas production. The question of potential roof damage is the subject of this paper.
