Introductory.—There are many interesting and important events connected with the petroleum problem. The remarkable men who conceived 'the thought of transporting petroleum by pipe line, conserving the byproducts of the commodity, and conducting extended investigation and research whereby the flash point of the oil was raised, its cost reduced and its supply assured, are deserving of the gratitude of this nation. It was primarily the success attained by Captain Lucas, after his comprehensive search for oil in Texas and Louisiana, that was the impelling cause which prompted the Navy Department to conduct the extensive series of liquid fuel-oil tests that were made from 1901 to 1903. The sensational discovery of oil at Spindle top made a deep impression upon Rear Admiral George W. Melville, then Engineer-in-Chief of the Navy, and the discovery of the vast oil field in Texas convinced him that, within a generation, if not within a decade, crude petroleum was going to play a very important part in warfare, and that the commodity might possibly develop into a necessary munition of war. The United States' Commanding Position as a Petroleum Producer.— In the study of the various problems relating to the world's production of crude petroleum, the position of the United States is one of commanding importance, whether viewed from the industrial or the military aspect. The present yield of this country is practically double that of the rest of the world, and, in view of the productive and prospective fields possessed by various countries, together with the comprehensive and exhaustive search that has been made throughout the world for petroleum, it is extremely probable that this lead will be maintained for the next decade. As regards the character of the crude-oil yield of different countries, America possesses the greater part of the supply that contains a paraffine base, and therefore a considerable portion at least of the American product produces the best illuminant. Of all the crude-oil distillates, kerosene is in many respects thc most important, and the Appalachian product for this purpose is favored, particularly in the Far East, above that of any other petroleum yield of the world.

Some of the investigations conducted by the Bureau of Mines have for their object the collecting and disseminating of information regarding methods by which the fuels of the country may be most efficiently used. As the analysis of flue gases tends to develop better methods of firing, which in turn reduces waste of fuel, the Bureau of Mines in this bulletin presents for the benefit of those in charge of boiler plants and all other persons interested detailed information on methods of sampling and analyzing flue gases, and on the utilization of the analyses in promoting boiler-room economy. This bulletin is intended to be a companion to Technical Paper 80,a and is written in plain and nontechnical language, as far as possible, so that it may be readily understood by persons who have not had the advantage of a technical education. Whenever possible, illustrations of apparatus and methods of handling have been used rather than elaborate descriptions.

Most metallurgists appreciate the great need of a process for the extraction and recovery of valuable metals from complex ore, where the presence of one metal increases the cost of extracting the other rnetals to such an extent that not any of the metals can be extracted at a profit. We need only refer to some of the mines in Colorado, Utah, and New Mexico, where oxidation has taken place and the sulphur, zinc, copper, and some of the iron and other metals have been leached out, large bodies of oxidized ore remaining, rich in lead, silver, and sometimes gold. These metals have been concentrated by the removal of the other metals, leaving a very desirable ore for treatment in the blast-furnace for the production of lead bullion, and recovery of the silver and gold. If lead is not present, the gold and silver metals are usually recovered by some method of milling, or the ore is shipped to a smelter, where it is mixed with lead ore or copper-iron sulphide ore from some other mine. In these same mines, when developed to greater depth below the leached or oxidized zone, the ore is found to contain the original mixture of sulphur, zinc, copper, etc., added to, or I should say left with, the lead, silver, and gold values; but instead of adding to the value of the ore, the presence of these elements, especially zinc, makes the copper, silver, and gold of less value, and often worthlees. Such was the experience of the oldest mines in Leadville,.Colo., until methods of mechanical separation of the lead from the zinc were developed sufficiently to allow of some profit by the making of a concentrate rich in zinc to be shipped to the zinc smelter, and sometimes a lead concentrate which could be shipped to the lead smelter; but even in these cases the waste of the different metals is a very serious matter. In the very best concentrating plants some zinc will be left in the lead concentrate, to be lost and to give considerable trouble in the lead-smelting furnace. On the other hand, some of the lead, with a large percentage of the copper and silver, will follow the zinc into the zinc concentrate, to be, perhaps, recovered by smelting the cinder or clinker left in the re-

The first steam shovels used in this country were built by the Otis Company, of Boston, about 50 years ago, but as they were of very crude construction and rather unsuccessful only a few were built. For possibly 10 years prior to 1884 successful steam shovels were made and used on certain classes of work, but it was not until that time that they were manufactured in quantities and began to play an important part in all classes of excavation. From that time up to the present day there have been gradual but continuous improvements on the original shovel, not only in the mechanical construction, but also in the design of boilers and engines which are best adapted to this class of service. In proposing a change from steam to electric operation we have to deal with a steam equipment which has not only proved its worth but has probably reached its highest stage of development and efficiency. That the electric shovel is a possibility cannot be denied, as at present from 12 to 18 shovels are in operation in this country. These shovels may be divided into three classes: the friction electric, which is operated by a single constant-speed motor with friction clutches; the three or four motor direct-current equipment, and the three or four motor alternating-current equipment. It is the second and third classes that I wish to deal with, as the first class does not compare favorably with the steam shovel so far as speed is concerned, although it may be operated as cheaply. There is probably no other class of machinery that presents a duty cycle as severe as that of the shovel, which is very short, varying from 7 to 12 sec. on the hoist, from 7 to 12 sec. on the thrust, and from 10 to 18 sec. on the swing, making a complete cycle in from 17 to 30 sec., and the motor to meet these requirements must have a sufficiently low armature inertia to permit of rapid acceleration and quick reversals under small power. It should also be a motor of rugged design, as it must be subjected to severe overloads and shocks and frequent reversals. This is especially true of the hoist motors and, to a lesser degree, of the swing motor; the thrust motor being practically stalled during the digging operation, although it may revolve or overhaul, according to conditions, and is operated at full speed only after the hoisting operation is completed.

The active mines in the Park City district at the present time are the Silver King Coalition, Daly-Judge, Daly West, and Silver King Consolidated. Several other companies, such as the Daly, American Flag, Ontario, etc., are doing considerable development work. In the Silver King Coalition mines the ore is a replacement of a dark siliceous limestone bed, varying in .thickness from 18 in. to several feet. In places the ore has reached a thickness of 25 ft. This limestone bed lies within 100 ft. of the underlying Weber quartzite. There are other lime beds, similar in appearance to this one, in the Park City formation, which is approximately 700 ft. thick; but not one of them has been found to contain any traces of ore. Directly under and in contact with the ore-bearing bed is another, composed of gray lime well studded with dark concretionary nodules; and this one is an unfailing indication of the proximity of the ore-bearing bed. These ore deposits make out from or have connection with some one of the ore-bearing fissures, which were undoubtedly the channels for the circulation of mineral-bearing solutions. It is therefore proper to run prospecting drifts in the fissures, although they seldom contain much ore. As a general rule, drifting in the fissures is not costly. Mining and mucking cost from $2.50 to $4 per foot, and very little timber is required. There are instances, as in the Daly fissure in the Daly-Judge mine, where the expense of keeping drifts open in the fissure is so great that it has proved economical to make the drifts in the foot-wall rock and run crosscuts into the fissure at short intervals. In the Park City mines it is not easy to determine beforehand the best method fir extracting the ore from a newly discovered ore shoot in the bedded deposits. While we may get one dimension from the drift run in the fissure, that will not give us a correct idea as to the other dimensions of the orebody. The fissures here referred to have a N. 35" E.

I fear most of the Institute members are already weary of the perennial controversy about the apex law. I feel that way about it myself now, though I have been guilty of considerable contribution- to the discussion in the past. The discussion does not seem to perceptibly influence previously held views and I would not again break into print on the subject but for the urgent invitation of the Chairman of our Law Committee. This energetic and able member has firmly determined to secure a revision of the mining law and among other things to eliminate the so-called apex provision from the U. S. mining statutes. He is, however, fair about it and has invited me to make ((the strongest possible argument in its favor." I am suspicious that he is acting on the psychological principle that it is usually easier to convince an audience against a cause vigorously but unsuccessfully defended than against one wholly mute. Nevertheless, I realize that personally he wishes me no harm, much as he hates the apex law, and so am willing that the Institute have whatever benefit may accrue from my taking up again the unpopular side of the discussion. I say this because the attitude of a large part of our "articulate" membership seems irreconcilably hostile; their minds are made up; favorable consideration is foreclosed; and they become impatient and even sarcastic at any attempt to elucidate a favorable view of the apex law. The exact question for discussion at the present time is not whether on abstract, or any other considerations, the apex law is the best possible rule, but the very different proposition whether, after nearly 50 years of statutory life and much longer as a practically universal miners' custom, it is now just and expedient to repeal the apex law. At this point it seems to me that we may profitably devote a paragraph or two to the subject of the origin of law in general, as we are presumed to be considering the subject from the high viewpoint of the general welfare of the nation. The most comprehensive and accurate definition of law in the legal sense is, that it is the body of rules for the regulation of human conduct which is enforced by the State, that is, by the nation.l Legal

Oil burners, oil furnaces, and methods of installation, have been the subject of many articles, but information concerning oil-burning systems, based upon scientific principles, is still in great demand, especially in the manufacturing districts of our country. Fuel oil, as it is termed (this being the residuum from oil refineries), has for many years been of great service to our manufacturers, and has justified its popularity not only by producing a superior manufactured product, but by turning out approximately 50 per cent. more product than can be made with coa1 fuel under like conditions. To install a system requiring only an oil-storage tank, a small pump, and an oil-supply main with numerous laterals leading to the various burners, furnaces, boilers, etc., is a comparatively simple matter; and, because fuel oil is very volatile, it is not necessary to heat it, even during the winter months in a very cold climate. Furthermore, only a small amount of power is required to atomize fuel oil, this often being done by a positive pressure blower, or by a mechanical burner. An analysis of fuel oil, together with that of various other liquid fuels, is given in Table I.

Continuing the discussion of the paper of James Johnston, presented at the New York meeting, February, 1914. See Trans., xlviii, 3 to 32 (1914). This paper cannot fail of being of great interest and value to all who are interested in the cyanide process, on account of the important developzn~ents which it records. Mr. Johnston is to be commended for the large amount of detail which he gives, and the company and its management for permitting the publication of data of this character, which while of great value to others could well be considered private property. It might be discussed from a number of standpoints: First, as an example of recent practice in mill and cyanide plant construction; second, the mill practice; third, the cyanide practice; and fourth, the new features in cyanide treatment involved. Perhaps a more vivid way of expressing it would be: First, the equipment or tools with which the various operations are carried on, are they the best and most efficient which could have been selected for their respective uses; and, second, is the best use in every case made of these tools? It may be well inquired is the highest possible recovery of silver made at the lowest cost per ounce recovered? For after all, the making of the greatest ultimate profit is inseparably associated with successful metallurgical practice; there must therefore be at all limes a careful balance maintained between recovery and cost of obtaining it. I wish to call attention in a very general way to the equipment used and to an anticipation of questions which are bound to arise in this connection. However, the bulk of my discussion will be confined to the presentation Of certain additional data, together with a more or less general discussion showing the line of development which leads up to the present practice and the applicability of certain features of it to similar problems elsewhere. There are a number of vital points of broad general interest involved in Nipissing low-grade practice upon which metallurgists will by no means be agreed to which I wish to call particular attention in the hope that it will lead to the presentation by others of data of practice in other districts which will assist in reconciling this divergence of opinion.

ThE Coalinga oil field is located on the west side of the San Joaquin Valley, California. The structure is in general a monocline, the edges of the oil horizon resting on the foot hills and dipping gently toward the east. One prominent anticline occurs plunging southeast. The earlier drilling was done in the foot hills comparatively near the outcrop and the wells were shallow. The sands were followed eastward and, in the case of the anticline, along the plunge, the wells becoming deeper and deeper until the depth of 4,000 ft. was reached and passed. There is nothing to show that the oil will not be found in quantity at still greater depth. In fact, some of the best producers have tapped the sand at close to 4,000 ft. The recovery of oil still farther to the east, and therefore at greater depth, seems to be mainly a question of drilling. In this territory the formations drilled through are chiefly sands and shales; they will not "stand up" in an open drilling hole; the casing has to be carried close to the bit, and it is always difficult to keep the casing free for any considerable distance. Ability to carry casing of comparatively large diameter without conductor pipes for distances of 2,000 or 3,000 ft. or over is desirable in such territory chiefly for two reasons. It makes it possible to enter the oil sand with a pipe of ample diameter; it eliminates one or more expensive strings of casing which act only as conductors for the water string, and furthermore, in territory where waters are encountered which corrode steel rapidly, it makes possible the construction of a rust- and alkali-resisting water string. It is always desirable to shut off top waters, which may lie within 100 ft. or less of the oil sand, with 10-in. pipe. Where the depth is so great that a practical weight of 10-in. pipe will not withstand the probable collapsing pressures, 81/4 in. at least is desirable. About the limit of rotary drilling to date in California seems to be the setting of the 10-in. string at 3,200 ft., although the rapid advance in rotary work during the past year seems to indicate that this depth may soon be increased. The advance made in recent times in this branch of metallurgy is indicated by the attention the subject is receiving from important American copper-producing companies. Reference to the files of publications devoted to the mining industry discloses that some 20 American companies are actively investigating the amenability of their ore, or other material, to leaching methods, and that plants of varying capacities up to 10,000 tons per day arc under construction or are projected. Several leaching works are in commercial operation. It has been frequently pointed out that no method of leaching is universally applicable, for the reason that each ore differs in some particular from apparently similar ore found elsewhere, and also because local conditions are rarely the same even where the ore closely approximates in character that being worked at some other point. For this reason the older companies are approaching the matter in a conservative manner, experimentally determining for themselves the salient features in each instance. In considering a leaching proposition three factors at once fix the attention: (1) disengaging the metal from mineralized forms in which it is found in nature; (2) recovering the metal in a commercial state after it has been dissolved; (3) the apparatus best adapted to carrying out the several operations. Bringing the Metal into Solution This feature.has been found to present no serious difficulties. Numerous solvents for copper are known, and it has been repeatedly demonstrated on a commercial scale that from 80 to 90 per cent. of the metal contained in an ore can be rapidly brought into solution. It is interesting to note, however, that all of the companies above referred to have selected sulphuric acid as the basis for a lixiviant. The object of the construction and operation of the 80-ton leaching plant was to test out the leaching of sand tailings on a large scale and, if possible, determine a definite method of operation, and the best construction for the larger unit which is now being built. It was also of importance to obtain some practical data as regards cost items. The 80-ton plant was not expected to be a commercial success. A leaching process on such low-grade material necessitates the treatment of a very large tonnage. Such a cost item as labor, for instance, is entirely out of proportion in such a small plant. The amounts of acid, salt, scrap iron, and fuel for roasting, however, are the same per ton in an 80-ton plant as in a 2,000-ton plant. These costs were definitely established. Also the percentages of extraction and grade of tailings were definitely determined for a large-sized unit. Following will be found the description of the plant, the method of operation and the- results obtained. A general view of the plant is given in Fig. 1. The bins consisted of one coal bin with a capacity of 30 tons, one salt bin with a capacity of 20 tons, and a "mill tailings" or feed bin which held 70 tons. The coal and salt bins were placed with their floor level even with the firing floor of the roasting furnace. The feed bin, to give it greater capacity, discharged about 12 ft. below this point, to a 12-in. conveyor belt, which in turn discharged into a pug mill. This fed another conveyor belt, which discharged into the top hearth of the furnace. The furnace was an ordinary six-hearth MacDougall roaster, 20 ft. in diameter. It was equipped with two fire boxes, on opposite sides, the flames entering on the third hearth. An induced draft was obtained with a Buffalo blower, worked as an exhaust fan. Just above the top hearth was an annular flue around the whole circumference of the furnace. Slots at intervals of about 18 in. led from this flue down into the top hearth. The slots were 2 in. wide by 6 in. long. This annular flue proved rather unsatisfactory, as it tended to fill up with flue dust and choke the dots, thus cutting down the draft. I Herewith present some notes on the use of Portland cement to cement in the casing, and for plugging, to exclude water from oil and gas wells, and the methods employed. I have used my best efforts to. make each step of the operation of cementing wells perfectly clear. The information is the result of actual experience and observation. The illustrations are from original drawings made especially for this paper. Portland Cement It is not necessary to discuss here the manufacture of cement. Any established brand of the slower setting Portland cements may be purchased with the confidence that it will harden, if properly used, and exclude water from and plug wells efficiently. Setting.—By the setting of cement is meant its initial change from a soft or plastic mortar to a friable solid. After the cement has become thoroughly set it is still very weak and can be readily pulverized in the fingers. Setting is thought to be effected by the crystallizing out of the silicate and the aluminate of lime, which are soluble in water in their anhydrous form. After dissolving in the water they pass to the hydrated state, in which they are insoluble, and hence are precipitated in a crystalline form. Ordinarily neat Portland cement mortar remains perfectly plastic for from 1 to 1 1/2 hr. after mixing with water at about 70" F. A higher temperature accelerates and a lower retards setting.. Hardening.—This is due to a continual crystallization of salts from solution, and to further chemical and physical changes which develop slowly, but which continue for long periods of time. Testing.—It is no more necessary for an operator to go into the scientific testing of cement to be used in a well than to so test the pipe used. Early in 1912, from information received by the Bureau of Mines, it became evident that quantities of valuable radium-bearing ore from Colorado were being exported for manufacture in foreign countries and that at least part of the manufactured product was being returned to this country and sold at a price entirely incommensurate with that received by the miner and the prospector. Consequently, in line with its efforts to increase efficiency in the mining and treatment of mineral resources, the Bureau of Mines undertook an investigation of conditions. Results of this preliminary investigation were published, in the summer of 1913, as Bulletin 70,a which gave an outline of the radium deposits of the West, the conditions of mining, the wastes involved, and the status of the production of radium from its ores. At about this time newspapers and medical journals were publishing statements regarding the value of radium in cancer therapy. These reports, although many of them were exaggerated, brought out clearly the remarkable virtue of the gamma rays for the treatment of cancer and other malignant growths. In view of the fact that the largest known supplies of radium ore in the world are in the States of Colorado and Utah and on the public lands of the United States, it was deemed highly important for the Bureau of Mines to study the production of radium in detail. Such study, it was hoped, would enable the prospector and miner to obtain a fairer price for the ores and would furnish information necessary in case Congress appropriated funds to develop methods for extracting radium from ore on the public lands under Government supervision, to be supplied at cost to the hospitals of the Army, Navy, and Public Health Service.

The object of this report is to give briefly information of present value relating to the manufacture and uses of the various commercial alloy steels, with the hope of stimulating the demand for such steels and extending their practical use. The report is issued by the Bureau of Mines as a contribution to the increase of efficiency in the preparation and utilization of the mineral resources of the United States. Alloy steels are included in the so-called special steels, but as the latter term is often used in the mills to designate broadly any steels intended for purposes other than those served by the regular product, it has seemed best to use the more specific term of alloy steels in this report. Alloy steels are bringing about a series of revolutions in various in- dustrial fields in which steel plays an important part. Most elements that could be procured in sufficient quantity have been alloyed with iron in various proportions, either alone or in combination with others, in the search for useful alloy steels. Those steels that have gained and maintained for themselves a place in current use are discussed in this report. Some of them have had an ephemeral life of usefulness which would no doubt have been prolonged had not some other more satisfactory steel been developed. Probably the first useful alloy steel was Mushet's self-hardening tungsten tool steel, patented in 1868. Fifteen years later chromium steel, really containing chromium, was struggling for recognition for some purposes, the chief of which was for the manufacture of solid shot for piercing armor. In both of these steels the effect of the alloying element as used was in a way proportional to the amount contained. In 1882 Hadfield made his epoch-making discovery of manganese steel and demonstrated that in iron metallurgy it is not safe to take for granted anything as to the properties of an alloy of iron with other elements, basing one's opinion on past experience and knowledge, and that the effect of an alloying element may not be proportional to its content. This report aims to discuss, from the viewpoint of the mining geologist, the bearing of topographic and geologic conditions on cer- tain problems that arose in the construction of the Panama Canal. T+ is published by the Bureau of Mines as a contribution to engineer- ing liters ure because it presents information that shows how geology and topography must be considered by the mining engineer in plan- ning excavations and in removing loose material and solid rock in the safest and most efficient manner. The printing of this bulletin has been approved by the governor of the Panama Canal, as it was impracticable for the Panama Canal to give this information to the general public in any of its publications. The "sword cut" of Goethals and his men did not sever the Isth- mian barrier; it merely clove the hills to a depth of 40 feet above sea level. This cut and the great areas of low valleys at both ends of it have been covered with fresh water to the 85-foot level. This high-level lake held by dams at either end, the 85-foot locks, by which ships enter it, and the dredged approaches from the two oceans constitute the Panama Canal. In the preparation of accurate estimates concerning the cost of large excavations information regarding the geologic conditions, as obtained by a study of natural features, is necessary. Drill holes and test pits will furnish supplementary geologic information, but without a gen- eral knowledge of the geologic conditions it will not be possible for the constructing engineer to answer such questions as the following: (1) What rock units will be encountered in the excavation and in what proportion? (2) What will be the cost of drilling each for blasting (3) How far apart and how deep must the drill holes be to efficiently break the rock of each to the proper size-not too fine nor yet too coarse? In this connection jointing, fissuring, bedding, toughness, and other physical characteristics must be considered (4) How steep will the slopes of the excavation stand, and to what extent will they wash and trench on exposure to the atmosphere? (5) What proportion of the material to be excavated is of such physical character that it may be utilized in any other part of the project, such as in concrete construction, road making, wharves, breakwaters, riprap work, etc.

One of the first matters to receive attention from the Bureau of Mines when it was authorized to undertake investigations relating to wastes in the mineral industries was the smoke problem at smelting and ore-roasting plants. This bulletin is published by the bureau primarily for persons who seek information on the subject of metallurgical smoke but are unacqllainted with the technical language of metallurgy. It is, of course, not possible to free a techniCal subject entirely from teclmicalities, but, 80 far as possible, statements are made in plain and simple English. Metallurgical smoke causes considerable friction between the metallurgical industry and agriculture in certain parts of the country. Owners of smelting plants are making every effort to devise ways and means to do away with possible damage and annoyance from smoke and are meeting with success. The problem is peculiarly difficult in this country because of the large tonnages of material that must be handled. The solution of the problem is not yet at hand and much work still remains to be done. As the mineral industry is one of the great basic industries of the country and of necessity is entitled to full consideration, it should be accorded freedom to work out the smoke problem to the benefit of all concerned. The effort is made in this paper to present the problem of metallurgical smoke as it actually exists, without bias of any kind. The writer takes this opportunity to express his indebtedness to the sources of information on which he drew, many of which are enumerated in the selected bibliography at the end of this paper. In connection with the author's use of the present tense in describing plants and methods, the reader should note that none of the references in that bibliography is of later date than 1913. Much information was obtained by personal visits and by correspondence, and thanks are hereby tendered to all persons who kindly furnished data. The writer desires to thank particularly F. G. In this report an attempt is made to discuss the first cost of each of several types of mine-ventilation stoppings, as well as the total annual expense of maintaining a stopping during its required period of service. Such data furnish a basis for comparison of the efficiency of the different types, and are of great importance to an engineer planning the development of a mine. The data given were obtained through an investigation conducted under a cooperative agreement between the Bureau of Mines, the Illinois State Geological Survey, and the department of mining engineering of the University of Illinois. The report itself is published by the Bureau of Mines as a contribution to the literature on safety and efficiency in coal mining.

When a gasoline locomotive is used in a mine there is danger of the noxious gases of the exhaust vitiating the air, but if enough air is circulating in those parts of the mine in which the locomotive is used, these gases are so diluted that they are rendered harmless, and the health of the workmen is not affected. In some mines the use of gasoline locomotives is impracticable, though in the majority of mines where they have been tried they have proved to be safe and economical. To determine the limitations that should surround the use of these machines in mines so that they shall not be detrimental to health and so that their economic advantage may be retained, it is necessary to ascertain the volume and the character of the exhaust gases and the amount of these gases that may be safely allowed in the mine air, and also to determine safe conditions of operation. The problem is primarily one of ventilation and like all ventilation problems must be intelligently computed to meet the conditions of each mine. The investigation described in this bulletin was undertaken 'by the Bureau of Mines in an endeavor to obtain exact information on some of the basal questions involved in the use of gasoline locomotives in mines, this investigation being one of many that the bureau has been conducting in its efforts to increase safety and efficiency in mining.

The Bureau of Mines is conducting a series of investigations with the common aim of minimizing the losses that occur in the mining and treatment of mineral substances. The results of the investi- gations are being published in reports of the bureau. This report treats of a method of preventing some of the waste of the natural gas incidental to oil mining. This method, the condensation of gasoline from natural gas, offers to the oil operator and others a profitable means of utilizing some of the oil-well gas now being wasted. The most desired constituent of crude oil is obtained, the production of oil is not hindered, and the gas, after the extraction of gasoline, can be returned to the leased area to drive pumps or into pipe lines for uses to which natural gas is ordinarily put, usually with its fuel value lessened only in slight degree. Publications already issued briefly discuss the subject. In this report the work is treated in greater detail, and the results of many additional tests are shown.

ORES PROCESS OF ORE CONCENTRATION-PATENTABILITY. The patent issued to Sulman, Pickard, and Ballot, November 6, 1905, and assigned to Minerals Separation and Minerals Separation American Syndicate, for new and useful improvements in ore concen- tration, its object being to separate metalliferous matter from gangue by means of oils and fatty acids that have a preferential affinity for such metalliferous matter, the principal feature of which is "agitat- ing the mixture to cause the oil-coated mineral to form a froth," was clearly anticipated by other patents, and each step in the process described in the Sulman, Pickard, and Ballot patent is fully described in more than one of the prior patents, with the single exception of the reduced quantity of oil used; but the discovery that the small fraction of oil is sufficient to produce flotation of the metalliferous matter can not be made by itself or in combination, the subject of a patent. In an action by the grantor of a certain mine and mining property against his grantee to recover damages for the conversion of a quantity of ore that the grantor before the conveyance had mined and extracted from the mine and placed on the dump near the mine, the plaintiff is not entitled to recover where it appears that at the time the ore was placed on the dump the mine was owned and operated by a mining company and that at the time the ore was taken out of the mine the company had no intention of doing anything with it but simply deposited it on the dump as waste and to give an opportunity to develop the mine and get better ore to send to the smelter, and that
