(San Francisco Meeting, September, 1915) THE lead department of the El Paso Smelting Works at El Paso, Tex., is operated strictly oil a custom basis. The ores treated are drawn from the surrounding territory, comprising New Mexico, Arizona, western Texas, and northern Mexico. Ores received from the last-named section originally amounted to a very large tonnage, but of recent years have dwindled into comparative insignificance so far as this plant is concerned. This has been clue partly to the establishment of a lead-smelting plant at Chihuahua, which is much closer than El Paso to most of the important mines, and partly to the recent revolutionary troubles in Mexico. There are no mines of either lead or copper in the immediate vicinity of El Paso. In general, it may be said that the lead-ore supply of recent years has been uncertain and precarious, with a general tendency toward an excess of silica and a shortage of iron. This latter requirement has been met in large part by the use in El Paso lead furnaces of considerable amounts of roasted heady copper matte from the Chihuahua smeltery and of converter slag from the El Paso converters. These two materials, coupled with complex lead-copper ores from Bisbee, Ariz., have introduced into the lead-smelting operations a most unusual amount of copper, which has had an important bearing upon the smelting practice of the plant. This matter will be discussed later. The ore, loaded in either box cars or gondolas, enters the storage yard on four tracks elevated about 8 ft. above the ground. As all unloading is clone by hand, unloading platforms at the height of the car floor parallel the tracks on each side to afford a runway for wheelbarrows. At frequent intervals these lengthwise platforms are joined together by others running crosswise to facilitate the distribution of the ores evenly over the beds, which are located below and between the tracks. At present much of the bedding space formerly used for lead ores is given over to the copper department, but 20 bins of various sizes are retained for the use of the lead furnaces and the Huntington & Heberlein roasting plant. I. INTRODUCTION THE smelting plant of the British Columbia Copper Co. at Greenwood, B. C., now closed because of the decline in the price of copper due to the European war, is of special interest to metallurgists for several reasons. It was successfully smelting in blast furnaces the lowest grade copper ore of all plants in America. In order to do so, it had to run at' very high efficiency, which necessarily required a large tonnage per square foot of hearth area, together with the minimum amount of labor and other costs. The furnaces smelted daily 2,250 tons of ore (6.62 tons per sq. ft. of hearth area), carrying 0.85 per cent. of copper, at a smelting cost of $1.18 per ton. The entire plant required 130 men to operate it and keep up repairs, showing a labor efficiency of about 17.5 tons per man per day. In the present paper, the method of obtaining these results is shown. Most of the information contained in this description I obtained as Assistant Superintendent, during the two years preceding the present shutdown. Location THE hydro-electric plant of the Peninsular Power Co., is located at what is commonly known as Lower Twin Falls on the Menominee River. This location is about 33 miles north of the city of Iron Mountain, Mich. The principal points of delivery of electric energy from this plant are in the mining regions adjacent to Florence, Wis., and Iron River, Mich., and in the cities of Iron River and Iron Mountain. The hydro-electric plant at Twin Falls and the substation of the Iron Mountain Electric Light & Power Co. are connected by a 6,600-volt transmission line carried on steel towers and steel poles, the latter being used within the city limits. The plant at Twin Falls and the substation at Iron River, about 36 miles distant, are connected by a 66,000-volt, duplicate, three-phase transmission line, supported on steel towers. At Iron River, are located a 1,500-kw. auxiliary steam plant, and the substation, from which the current is distributed to the mines in this vicinity. A description of the auxiliary plant, main and customers' substations, and of the main and secondary transmission lines, follows later in this paper.

The laws here referred to are those which define the status of the prospector for mineral deposits in the soil or beneath it, establish his methods of procedure, protect him in his possession while searching for the subterranean treasures, and give him assurance of title when all required conditions have been fulfilled and valuable minerals discovered. Regulations for the operation of mines and the safety and health of mine employees are likewise subjects of Federal and State legislation, but are not within the scope of the present program. Various features of our present laws will be discussed in detail by able students of the subject, and specific remedies will be proposed for the most glaring defects. It is my purpose to present in this paper a summary review of the reasons why revision is needed and demanded by the great majority of those in daily contact with the industry. Reason Number One The first objection to the continuance of the present law is that it was not planned by its framers and the Congress which passed it to apply to many of the kinds of mineral deposits, nor to the mining conditions, which are controlled by it to-day. In 1866, under the title, "An Act granting the right of way to ditch and canal owners over the public lands, and for other purposes," was surreptitiously smuggled into existence our first mining law (14 Stats. at Large, Chap. 262, p. 251). This law provided that "whenever any person or association of persons claim a vein or lode of quartz or other rock in place, bearing gold, silver, cinnabar or copper, having previously occupied and improved the same according to the local customs or rules of miners in the district where the same is situated," etc., a patent might be granted an certain conditions. This was evidently an Act intended to validate claims already initiated, and to accord Federal recognition to mining locations made in

When the National Forests were created, all lands embraced in their boundaries were exempted from all forms of entry, except mineral claims. Later, by Act of June 11, 1906, and as amended by Act of Aug. 10, 1912, provision was made allowing homesteads on areas chiefly valuable for agriculture and not necessary for the public use. Patents to mining claims in the Forests are granted the same as on land not in the Forests, irrespective of timber or other values. It is the policy to encourage the highest use of the Forests. As a business proposition, it is a good policy to have mines developed in the Forests. Their development in remote or inaccessible regions causes the country to be opened up and, in addition to the local market which the mines create, means of transportation are afforded to outside markets. No examination of mining claims is made until patent has been applied for, unless they are actively interfering with the administration of the Forest. In this case, an examination is made, and if there is evidence that the claims are being held in good faith they are in no way interfered with. Timber is never sold from a mining claim except with the consent of the claimant, or unless it is clearly shown, after an examination, that the claim is abandoned. In the case of fire-killed timber, which rapidly deteriorates by standing, a contract bond arrangement can be made for the sale of the timber which protects the interests of both the mining claimant and the government. The promiscuous locating of mining claims has in the past caused considerable trouble. It has been, and still is, the custom in some parts of the West to locate a mining claim when the surface rights of any particular area are desired, irrespective of the mineral character of the ground. This has been done to hold power sites, town sites, summer residences, springs, etc. When the ground is desired for any of these purposes, what is known as a Special Use Permit will be issued at a nominal sum, to legalize the occupancy. In most instances, it is far cheaper to take out one of these permits than to do the annual assessment work on a mining claim, but, of course, patent to the ground cannot be obtained in this manner. If mineral were discovered on the land covered by a Special Use Permit, it would ordinarily be the policy to cancel the permit if it were clearly

I fear most of the Institute members are already weary of the perennial controversy about the apex law. I feel that way about it myself now, though I have been guilty of considerable contribution- to the discussion in the past. The discussion does not seem to perceptibly influence previously held views and I would not again break into print on the subject but for the urgent invitation of the Chairman of our Law Committee. This energetic and able member has firmly determined to secure a revision of the mining law and among other things to eliminate the so-called apex provision from the U. S. mining statutes. He is, however, fair about it and has invited me to make ((the strongest possible argument in its favor." I am suspicious that he is acting on the psychological principle that it is usually easier to convince an audience against a cause vigorously but unsuccessfully defended than against one wholly mute. Nevertheless, I realize that personally he wishes me no harm, much as he hates the apex law, and so am willing that the Institute have whatever benefit may accrue from my taking up again the unpopular side of the discussion. I say this because the attitude of a large part of our "articulate" membership seems irreconcilably hostile; their minds are made up; favorable consideration is foreclosed; and they become impatient and even sarcastic at any attempt to elucidate a favorable view of the apex law. The exact question for discussion at the present time is not whether on abstract, or any other considerations, the apex law is the best possible rule, but the very different proposition whether, after nearly 50 years of statutory life and much longer as a practically universal miners' custom, it is now just and expedient to repeal the apex law. At this point it seems to me that we may profitably devote a paragraph or two to the subject of the origin of law in general, as we are presumed to be considering the subject from the high viewpoint of the general welfare of the nation. The most comprehensive and accurate definition of law in the legal sense is, that it is the body of rules for the regulation of human conduct which is enforced by the State, that is, by the nation.l Legal

The Huff electrostatic plant of the United States Smelting CO., operated in conjunction with its wet concentrator at Midvale, Utah, was the second plant of substantial size installed using the Huff process, and the first plant to be put in operation on the so-called Western complex ores. , In spite of the machinery being of early design and consequently embracing many of the mechanical weaknesses incident to a pioneer plant the mill has operated steadily and uniformly since the summer of 1909, about five years now, without any material change other than some rearrangement of the machinery for better handling of the sizes. The ore, at present coming almost entirely from the company's mines in Bingham, is of practically the same composition as that upon which the plant was first put in operation. The crude ore, consisting of the sulphides of copper, lead, zinc, and iron, and containing small amounts of gold and silver, is brought by train and delivered to the hoppers of the wet concentrator, where by jig and table treatment, there are produced a shipping lead concentrate, a tailing, and a middling product, the latter being conveyed in push cars to the adjoining electrostatic mill. The crude ore delivered to the wet concentrator contains from 6 to 9.5 per cent. zinc. At times the plant is used also for the treatment of custom ores from the Bingham district and elsewhere, and at such times the results of the plant vary according to the material in use, but as by far the larger portion of the product is that from the company's own mines, the results given below are fairly indicative of the general work obtained. The diagram, Fig. 1, illustrates graphically the flow of the ore through the electrostatic mill. The middling coming from the wet mill, containing from 15 to 18 per cent. moisture, is hoisted while on the cars by an elevator, and delivered from the top of the elevator to a hopper over the drier. The drier first installed was of too low capacity to take care of the moisture present in the tonnage to which the mill was later

General Layout The relative location of the dam, forebay, and power house will be understood by referring to Fig. 1. The dam is constructed on a ledge of solid rock which forms Lower Twin Falls. This rock ledge offers an excellent location in that the height of the dam, and therefore the amount of concrete, are thereby reduced, and also in that practically no pumping was required in unwatering the dam site. THE use of coal-dust fired reverberatory furnaces, or indeed of reverberatory furnaces of any description, was for the Canadian Copper Co. a matter of necessity, and not of choice. For 20 years smelting had been done in blast furnaces alone, and with the Herreshoff furnaces used prior to 1904 there was no trouble in treating fine ores. But little flue dust was produced, and this, following the time-honored custom, was wetted down and put back with the charge. Whether the flue dust really smelted, or whether it was worn out by being chased around in a circle, was a problem that troubled no one. With the installation of modern blast furnaces and high-pressure blowing engines, in 1904, flue dust commenced to assert itself. Evidently more dust was made than could be smelted, but so many vital problems engaged our attention at that time that this minor question was pushed to one side. In 1906, the details of blast-furnace smelting and the conversion of matte had been worked out to a satisfactory conclusion, and the ever-increasing piles of flue dust and fine ore on the stock yard demanded serious consideration. Numerous experiments in sintering, briquetting, mixing with converter slag, forming blocks of flue dust with green-ore fines and cement, and so on, were undertaken. None of these showed much promise. Our problem, was still further complicated by the question of treating converter slag. The ore was basic, the slag was not needed as a furnace flux, and it was felt that under these conditions the old method of pouring slag in molds and resmelting in the blast furnace was an unnecessary expense. If the converter slag could be settled in basic-lined reverberatory furnaces, in which at the same time flue dust and green-ore fines could be smelted, two problems might thus be solved.

One of the first matters to receive attention from the Bureau of Mines when it was authorized to undertake investigations relating to wastes in the mineral industries was the smoke problem at smelting and ore-roasting plants. This bulletin is published by the bureau primarily for persons who seek information on the subject of metallurgical smoke but are unacqllainted with the technical language of metallurgy. It is, of course, not possible to free a techniCal subject entirely from teclmicalities, but, 80 far as possible, statements are made in plain and simple English. Metallurgical smoke causes considerable friction between the metallurgical industry and agriculture in certain parts of the country. Owners of smelting plants are making every effort to devise ways and means to do away with possible damage and annoyance from smoke and are meeting with success. The problem is peculiarly difficult in this country because of the large tonnages of material that must be handled. The solution of the problem is not yet at hand and much work still remains to be done. As the mineral industry is one of the great basic industries of the country and of necessity is entitled to full consideration, it should be accorded freedom to work out the smoke problem to the benefit of all concerned. The effort is made in this paper to present the problem of metallurgical smoke as it actually exists, without bias of any kind. The writer takes this opportunity to express his indebtedness to the sources of information on which he drew, many of which are enumerated in the selected bibliography at the end of this paper. In connection with the author's use of the present tense in describing plants and methods, the reader should note that none of the references in that bibliography is of later date than 1913. Much information was obtained by personal visits and by correspondence, and thanks are hereby tendered to all persons who kindly furnished data. The writer desires to thank particularly F. G. A complaint in an action to quiet title to minerals and to the min- eral rights in certain land is insufficient in the absence of a direct allegation of possession, although it avers that the plaintiff from the time of receiving the conveyance assessed the mineral interest for taxes each year and paid the taxes thereon and exercised various acts of ownership of such mineral interests, in that he caused test pits to be dug on the land for the purpose of exploring the minerals and ascertaining their quality and extent, in going upon the land and looking after them from time to time, and that he accompanied or caused his agents to accompany prospective purchasers of such mineral interests and exhibited the same to such prospective pur- chasers in efforts to sell them. ORES PROCESS OF ORE CONCENTRATION-PATENTABILITY. The patent issued to Sulman, Pickard, and Ballot, November 6, 1905, and assigned to Minerals Separation and Minerals Separation American Syndicate, for new and useful improvements in ore concen- tration, its object being to separate metalliferous matter from gangue by means of oils and fatty acids that have a preferential affinity for such metalliferous matter, the principal feature of which is "agitat- ing the mixture to cause the oil-coated mineral to form a froth," was clearly anticipated by other patents, and each step in the process described in the Sulman, Pickard, and Ballot patent is fully described in more than one of the prior patents, with the single exception of the reduced quantity of oil used; but the discovery that the small fraction of oil is sufficient to produce flotation of the metalliferous matter can not be made by itself or in combination, the subject of a patent. In an action by the grantor of a certain mine and mining property against his grantee to recover damages for the conversion of a quantity of ore that the grantor before the conveyance had mined and extracted from the mine and placed on the dump near the mine, the plaintiff is not entitled to recover where it appears that at the time the ore was placed on the dump the mine was owned and operated by a mining company and that at the time the ore was taken out of the mine the company had no intention of doing anything with it but simply deposited it on the dump as waste and to give an opportunity to develop the mine and get better ore to send to the smelter, and that

This work is a codification and annotation of the Congressional enactments relating to minerals, mineral lands, and mining. It covers every enactment of Congress from the original ordinance of 1785 to the present time, as well as all sections of the Revised Statutes of the United States relating to these subjects. These laws are grouped according to their general subject matter, and are arranged thereunder in numerical or chronological order. Many of the mining statutes include matter not pertinent to the subject, and only those parts of such acts are quoted as will properly show their relation to minerals and mineral lands and indicate how they should be construed. Some mining acts have been repealed or have become obsolete, and others have become incorporated substantially in sections of the Re- vised Statutes; but these are retained in order to show the changes made, and the constructions placed thereon by the courts are given as aids in construing the new or repealing acts. The annotations consist of legal propositions abstracted from the decisions of the various courts and executive officers of the Govern- ment that have interpreted the sections and statutes so codified. These legal propositions are arranged under the different sections and acts with appropriate headings, titles, and subtitles, in logical order, exhibiting the present status of each particular section or act and its application to the subject of mines and mineral lands. The annotations do not purport to be abstracts of decisions on the sub- stantive law of mines and mining generally, but are limited strictly to the interpretation placed on a given section or act definitely re- ferred to by a court or executive officer by the number of the section of the Revised Statutes or the volume and page of the Statutes at Large in which the Congressional enactment is found. It may be observed that the legal propositions stated are not always pertinent to the particular section or act under which they are classed and of which they purport to give a construction. The arrangement, however, is not an arbitrary one, but is so made for the reason that the courts or officers in the construction of a particular section or act definitely referred to by number or volume and page incorporated in the decision matter not strictly pertinent to the par- ticular section or act so designated. This statement applies especially to the interpretations placed on the sections of the Revised Statutes. The commission may be permitted to express its earnest hope that the litigation which comes to an end with the findings and recom- mendations herein set forth will be considered by both parties to the action as definitely and equitably decided. The commission trusts that its work will show the value of the commission form of settlement and that its work will serve as a prece- dent to be followed in disputes relative to technical subjects. If the work of the commission is productive of a tendency on the part of technical litigants to avoid the use of the courts for the settlement of disputes it will not have been done in vain. Such tendency will surely grow and ultimately such differences will be arbitrated by technically trained men without recourse to the courts of law. Appended to the report of the findings of the commission are to be found the detailed reports covering the several lines of inquiry and investigation carried on by the commission and upon which its findings are based, and also a detailed statement of the fiscal affairs of the commission. A word of explanation is necessary in regard to the fiscal statement. While each party to the litigation has agreed to bear one-half of the expense of the investigations of the commission, it will be noted that the Selby Smelting & Lead Co. is credited with $21,000, while Solano County is credited with but $6,000. In order that the investigations of the commission might go forward without interruption the Selby Smelting & Lead Co. has generously supplied funds at the times they were needed. The promiscuous locating of mining claims has in the past caused considerable trouble. It has been, and still is, the custom in some parts of the West to locate a mining claim when the surface rights of any particular area are desired, irrespective of the mineral character of the ground. This has been done to hold power sites, town sites, summer residences, springs, etc. When the, ground is desired for any of these purposes, what is known as a Special Use Permit will be issued at a nominal sum, to legalize the occupancy. In most instances, it is far cheaper to take out one of these permits than to do the annual assessment

I FEAR most of the Institute members are already weary of the perennial controversy about the apex law. I feel that way about it myself now, though I have been guilty of considerable contribution to the discussion in the past. The discussion does not seem to perceptibly influence previously held views and I would not again break into print on the subject but for the urgent invitation of the Chairman of our, Law Committee. This energetic and able member has firmly determined to secure a revision of the mining law and among other things to eliminate the so-called apex provision from the U. S. mining statutes. He is, however, fair about it and has invited me to make "the strongest possible argument in its favor." I am suspicious that he is acting on the psychological principle that it is usually easier to convince an audience against a cause vigorously but unsuccessfully defended than against one wholly mute. Nevertheless, I realize that personally he wishes me no harm, much as he hates the apex law, and so am willing that the Institute have whatever benefit may accrue from my taking up again the unpopular side of the discussion. I say this because the attitude of a large part of our "articulate" membership seems irreconcilably hostile; their minds are made up; favorable consideration is foreclosed; and they become impatient and even sarcastic at any attempt to elucidate a favorable view of the apex law. The exact question for discussion at the present time is not whether on abstract, or any other considerations, the apex law is the best possible rule, but the very different proposition whether, after nearly 50 years of statutory life and much longer as a practically universal miners' custom, it is now just and expedient to repeal the apex law.

This paper will be confined to the treatment of methods as applied in the laboratory of the Boston and Montana Reduction Department of the Anaconda Copper Mining Co. at Great Falls, Mont. As the electrolytic plant of this company operates at a current density of approximately 35 to 40 amperes per square foot when running up to capacity, the arsenic and antimony content of the anodes delivered to the plant is of considerable importance as bearing on the purity of the refined cathodes turned out. Owing to the rather high relative percentage of antimony, it has always been the custom to determine antimony as well as arsenic in all forms of copper. Thus, anodes have been analyzed in which the antimony was about equal to the arsenic, although the average shows about 2 parts of arsenic to 1 of antimony. In the refined copper the relative proportions of the two impurities vary considerably, but probably in the average are about equal. In this latter case, the percentage of the two is SO small that ordinarily no attempt is made to separate them, the report of analysis showing percentage of As and Sb combined. Although rapid and exceedingly accurate determinations of arsenic may be made by means of various distillation schemes, the determination of antimony, either by itself or together with arsenic, has always been more or less cumbersome and has required a considerable amount of time. By the methods, details of which follow, the determination of arseluic and antimony, either separated as in the case of anodes or together in case of refined copper, is accomplished in 24 hr. from the time the sample is received by the chemist. As to the accuracy of the results obtained, it can be quite positively stated that in this respect these methods are very satisfactory, much more so than any heretofore employed in our work, and when the rapidity of determination is considered, the results are very accurate.

A discussion at a joint meeting of the New York Section of the American Electrochemical Society and the American Institute of Mining Engineers, Nov. 20, 1913. Chairman Lawrence Addicks:-Our program this evening represents an attempt to set before you the present situation and outlook in the metallurgy of zinc. It is a time-honored custom to throw bricks at the zinc man. The accusation is that he has borrowed a lime kiln and a gas retort and part of a sulphuric acid plant, hitched them together, and spent the last 50 years in regarding with holy veneration the reactions which take place in that retort. The copper man, who thinks of zinc as something with which copper is adulterated to make brass, and the iron man, who regards it as a sort of paint for corrugated sheets, and the lead man, whose opinion as to zinc is not fit for publication, have long felt that, when two or three of the minor details of their respective metallurgies were put in order, they would take a few clays and fix up zinc on a modern basis. But somehow there still seem to be some unsolved problems at home, and while we are waiting it seems only fair that the case for the defense should be adequately presented. There is probably no man in this country to-clay better able to do this than Mr. George C. Stone, of the New Jersey Zinc Co., on whom I have pleasure in calling to talk to us on "Progress in the Metallurgy of Zinc." George C. Stone:-It is frequently stated that there has been no change in the metallurgy of zinc since the first Belgian furnaces were built in the early part of the last century. It is true there have been no such spectacular and radical changes as were worked in the metallurgy of copper and iron by the introduction of converters; but, in the essentials, I believe the progress in zinc metallurgy has been as great as in that of the other common metals. The main reason that there have not been revolutionary changes is that the chemistry of zinc differs radically from that of the other metals and these differences control the type of apparatus that can be used. The differences are: 1. The temperature at which zinc is reduced by carbon is much above the volatilizing point of the metal and it is therefore always produced as a vapor.
