This interpretation of the laws of Japan has been prepared from the best available information in Washington but is released subject to correction and amplification , if necessary , by the proper American diplomatic and consular officers to whom it is being referred through the courtesy of the Department of State . It is based on the law and regulations of 1905 as revised in December , 1915 , and translated by J. de Becker , LL.B. Occasional words and phrases quoted herein are accordingly taken from this translation and have not been checked against the original . The references are to the law ( as distinguished from the regulations ) unless otherwise stated .

The work of the electrical section of the Bureau of Mines may be considered to have had its beginning in April , 1909 , when H. H. Clark was , appointed electrical engineer in the U. S. Geological Survey. The first manuscript prepared by members of this section was Miners Circular 5, which was issued in October , 1911. During each succeeding year additional papers have been published dealing with questions relating to electrical safety. Since 1916 the electrical section has also conducted laboratory investigations on flame safety lamps and gas- detecting devices and has published reports relating thereto . The following selected list of publications covering safety studies and activities of the electrical section has been prepared for the convenience of those who wish to keep themselves advised concerning electrical safety matters . The list includes only such publications as are applicable to present-day prac tices .

Since the introduction of electricity into the mines of the United States , the hazards incident to the industry have increased materially in both coal and metal mines . For economic reasons the tendency at present , particularly in coal mining , is decidedly toward the adoption of electrical mine machinery , including alternating current machinery , on a more extensive scale than ever before . Obviously, the growing use of such equipment will result in an ever -increasing number of underground transformer stations . The principal electrical hazards in mines are threefold ; fire , explosion, and contact . Of these , fire is the greatest hazard involved in the use of electricity underground , and several fires have originated in underground transformer and motor generator set stations . The fire hazard due to improperly installed and poorly maintained underground transformer stations is an ever-present one , and failure to take the necessariman remedial action is likely to result , sooner or later, in the destruction of life and property . Upon suggesting the necessary corrective measures with respect to such installations , one is often confronted with the statement to the effect that even though this particular hazard has existed over a period of years , there have been no unfavorable results therefrom thus far . Frequently , the desirability for action is not apparent to the mine management until it is too late . Because a mine has a record free from fires , explosions , etc. , over a number of years of operation during which these hazards existed , such good fortune should not be taken as a guarantee that this or any other mine is immune from these common dangers . When the elements of an existing hazard are properly balanced or in the right proportion, the unfortunate combination must of necessity culminate in misfortune of one kind or another. The fire hazard due to underground transformer installations can be very definitely minimized by proper installation and maintenance . In coal mines the transformer banks , connected to 2,300 and occasionally to 4,400 volt circuits , are often found located in open- ended crosscuts , mounted on concrete or timber foundations , and in nonfireproof surroundings .

Protection against fire is a greater problem at a coal mine, than at an ordinary industrial plant. Generally mines are located in isolated districts and do not have the protection of city fire departments; consequently fire fighting aquipment must be installed by the mining company. Fire protection around a mine is just as essential as it is in the city.. and undoubtedly is more important if the fire should be underground where many lives would be endangered and all means of escape cut off. A surface fire can generally be attacked from any angle, but an underground fire can be attacked only as conditions will permit.. U. S. Bureau of Mines engineers have investigated many serious mine fires that undoubtedly could have been extinguished in incipiency if a fire extinguisher or fire hose and water had been readily available. In past years very little attention was given..to fire fighting equipment and organization around mines, but in recent years three gen a derde hange of opinion among many of those engaged in mining, and nearly all up-to-date mining companies now have some kind of fire protection about their mine Probably the first company in Illinois to install regular fire fighting equipment and effect a fire fighting organization at its mines, was the Madison Coal Corporation, which operates several mines in Illinois. The main office of this company is in Chicago and the general field office is at Glen Carbon, Ill.

Mining companies are usually held responsible for accidents occurring to the public around their operations . Safeguards are provided by progressive mining companies to prevent the public from getting into danger from wandering unattended about the properties . At abandoned operations , where little or no supervision can be maintained , persons are often injured through the negligence of the operator in leaving the property in unsafe condition . After a mine is abandoned or a lease is given up by a mining company , the responsibility for the safety of the property rests sometimes with the State to which the property ownership reverts or with the owner of the land ; either is usually quite unwilling to spend any money to remedy unsafe conditions due to the carelessness of the mining company . The land owner or the State , or both , should see that the work of leaving safe conditions behind is done by the operator before he abandons the mine or gives up the lease . Some of the worst hazards to the public at abandoned mines are from old test pits , abandoned shafts or tunnels , open pits , caved ground , and bodies of water in abandoned open pits . Hazards exist from some of these sources during the active operation of a mining property as well . In the early stages of mining operations test shafts are often sunk from 50 to 100 feet deep through the more or less loose material overlying bed rock . When these shafts are left unprotected , they are a serious danger for many years to come . In the course of time they become largely concealed by brush and grass , and thus are a deadfall to anyone who might happen to step into them . This condition will hold true for any part of the country, but to a much less degree where it is not necessary to sink through a great amount of cover . Many progressive operating companies have adopted the practice of filling in test pits after securing the information desired . Some nonresident landowners and exploration companies , however , have left such pits open , and it is extremely difficult for the mine inspector to get into communication with the owner . The mining ordinance of Costa Rica dates from 1830. In spite of the numerous attempts to enact a new ordinance , it has been so much amended and reamended during the hundred years of its existence either expressly or , more often , by implication , and sometimes by Executive Decrees of which the validity has been called in question - that in most cases no one but a lawyer thoroughly conversant with Costa Rican mining practice could properly advise with reference to it . The present attempt at a digest of these laws is based on the 1929 edition of Bolandi and Johanning - the only source available in Washington . Apparently this edition has no official character , and the editors themselves often made surmises although one would think that definite facts would be available in Costa Rica where it was published .

This interpretation of the laws of Latin America has been prepared from the best available information in Washington, but is released subject to correction and amplification, if necessary, by the proper American diplomatic and consular officers, to whom it is being referred through the courtesy of the Department of State. Individual abstracts of the laws of each of the countries herein discussed have been prepared and published separately. This general summary is presented for the use of mining engineers and investors whose interests extend over the borders of a single country. It is also designed to bring out certain general principles of mining law and, so far as feasible, to indicate the trend of mining legislation in South and Central America. In order to gain perspective, the details of legislation are not com- pletely covered in this paper, but an effort has been made to bring out essential differences as well as points of similarity in the laws of the various countries. The course of legislation is first traced chronologically and the points discussed are then arranged in tables in somerhat greater detail. .Si. With a very few exceptions the existing mining legislation of Spanish America is a development, of the Spanish "Law Decree of Bases" (more briefly referr- ed to as the "Decree-Bases") of 1868. This in turn was influenced, particularly in its classification of minerals, by the French law of April 21, 1810.

"The daily sulphur dioxide content of the air at the Pittsburgh Experiment Station of the Bureau of Mines was determined by the bureau at the request of Committee D-14 on Screen Wire Cloth of the American Society for Testing Materials. The purpose of the investigation was to obtain data for use in interpreting screen-corrosion tests, which were conducted simultaneously and jointly by the committee4 and the Bureau of Mines.The plan of this investigation was to vale a single daily determination, except on Sundays and holidays, of the SO2 content of the atmosphere at the exposed test screens, for a period of one year. No attempt was made to determine the variation during the day, except on the morning of October 15, 1927, when the atmosphere was unusually foggy and smoky. Several successive determinations were made on that date to ascertain changes in the SO2 as the morning haze disappeared. The SO2 determinations were begun on August 11, 1927, and continued until August 11, 1923.The Pittsburgh Experiment Station of the Bureau of Mines is in a residential section about 3 miles east of the central or main business district of Pittsburgh. The air samples were taken on the roof above the auditorium, or the center rear of the building. This was also the place where the pieces of screen were placed for corrosion tests. The height was about 40 feet above ground level. Several sources of considerable smoke and SO2 are in the immediate vicinity. On the west side of the building is a double-track railroad. At this point the line runs through a cat below the level of the building. The horizontal distance between the air-sampling position and the railroad tracks is about 400 feet, and the vertical distance about 70 feet. The power plant for the Bureau of Mines building is about 250 feet south of the sampling position. About 1000 feet farther to the south are the engineering building and power plant of Carnegie Institute of Technology, and 1/4 mile to the southwest is the power and heating plant for the Carnegie Library and Museum. "The discovery of large deposits of polyhalite (K2S04.MgS04.2CaSO4.2H2O) in Texas has led to an investigation of possible industrial proecsses for the extraction of potash from this material. This mineral was first discovored in small quantities in the European potash deposits in or about the year 1800. Chemists fire thought it to be a form of calcium sulphate, but a more accurate analysis by Strohmiyer indicated the composition as given by the above formula.The decomposition of polytalite by aster is very slow and results in the formation of a layer of gypsum at the surface of the polyhalite which retarts the solution of the potaseium and magnesium sulphates. To obtain a substantial yield of K2S04 in solution it is necessary to use large amounts of water at room temperature, for he concentration of K2S04 is limited by the low solubility of syngonite (K2S04.CaS04.H2O) whereas at 100º C. several days boiling are necessary to obtain more than a 6 per cent K2S04 solution even when finely powdered polyhalite is employed.In 1854 H. Rose discovered that calcination, followed by leaching with water, resulted in a larger extraction of the potassium and magnesium sulphates, as compared with leaching without precalcination. During the course of a series of investigations concerning formation of oceanic salt deposits, Van't Hoff and his pupils obtained sufficient data to construct the equilibrium diagram for the system K+Mg+SO4--Ca++.H2O for 25° C. and for 83° C. These data are very well summarized. in the International Critical Tables' and by Boeke and Eitel. From a consideration of the diagrams for 83º C. one would conclude that an extraction of polyhalite with moderate amounts of water at 33º C. would result in a solution whose maximum concentration of K2So4 would be about 3.6 grams per 100 grams of water and of M2SO; about 4.0 grams per 100 grams of water, corresponding to equilibriumwith the solid phases: Polyhalite potassiam-calcium pentasulphate and anhydrite.The fact that it has been found possible to obtain as high as 11.4 grams of K2S04 per 100 grams of water (see table 6) and an equivalent amount of MgSo4 (8.1 grams per 100 grams of water was obtained corresponding to a ratio K2/Mg of 0.98; indicates that the formation of these complex salts is very slow. To be sure, this results was obtained at 100° C. instead of 83º C. However, the work of Anderson and Nestall 9 on the double salts of calcium and potassium sulphates at 100º C. indicates that the diagram at 100º C. C. would not be greatly different from that at 83º C. This slow rate of approach to equilibrium when combined with precalcination of,of polyhzli-,a is the 17,asis of some of the more p:olisinE methods of extracting potash from polyhalite."

"Statistics show3 that in 1927 the United States consumed 60 per cent of the world's production of chromite and produced none. The uses of chromium are rapidly expanding, and a dependable supply is essential to our industries. Since the political and commercial control of our supply of chromite is now in foreign hands it is prudent to determine how this nation can best prepare to supply its need for chromium if the imports were cut off or restricted and whether it is now possible and desirable to stimulate production of chromium from domestic deposits. We have only small amounts of chrome ore of high enough grade to meet present trade requirements. Therefore the Bureau of Mines is making a study of methods for beneficiating our low-grade ores.Chromite (Cr203.Fe0), is the only commercial source of chromium. For refractories, a minimum of 40 per cent Cr203 and a low silica content (5 to 8 per cent) is usually specified. In most instances bricks or lumps having a physical structure that will not crack when heated are required. The only way an inferior ore could be adapted to this use world be to concentrate it and develop a satisfactory binder to make bricks out of the concentrates.For making ferrochrome the requirements are a minimum of 45 per cent Cr203 and an iron content not exceeding one-third of the chromic oxide. On some low-grade ores gravity concentration will give a product meeting these requirements; other ores yield concentrates containing too much iron or other impurities to be saleable."

"The detection of leakage is a recognized problem in the safe and economic distribution and use of natural gas. Natural gas is practically odorless and therefore lacks he property of indicating significant leakage by the sense of smell, the means most widely used by gas employees and consumers for detecting leaks of the more odorous types of fuel eases. In view of the recognized value of the odor of gas for indicating leakage at the time of occurrence the Bureau of Mines has studied' the possibility of adding small amounts highly odorous substances to types of fuel gas (such as blue water gas and natural gas) that lack warning properties. These studies revealed that the mercaptans were promising substances to accomplish this purpose, not only for odorizing fuel gases but for other purposes° where it was desired to give warning through the sense of smell.Since completing the studies mentioned, the Bureau of Mines jointly with the American Gas Association has conducted further investigations dealing with the use of warning agents for fuel gases. The results of this work will be published later.The Bureau of Mines had been desirous of observing the practical use of ethyl mercaptan for detecting leakage of natural gas, particularly to determine whether the odor would permeate the ground and give indication of lea's in underground pipes. Opportunity for making these observations was recently given by E. A. Munyan, manager, gas department, Union Gas t Electric Co., who requested the bureau's cooperation in making leakage surveys of the company's distributing systems at Franklin and Middletown, Ohio."

"The purpose of the investigation described herein was to determine how closely different laboratories can check one another in making determinations of fusibility of coal ash with the De Graaf electric coal-ash fusion furnace: how well duplicate determinations by the same laboratory will check, and how the results with the De Graaf furnace compare with those of the standard gas-furnace method of the American Society for Testing Materials.4Thanks are due the following laboratories who cooperated in this study by making fusibility tests with the Do Graaf electric coal-ash fusion apparatus: J. J. Brennan, testing engineer, Northern States Power Co.; R. E. Gilmore, superintendent, Fuel Research Laboratories, Canadian Department of Mines A. T. Leavitt, president, and W. Mueller, chief chemist, Hamilton By-product Coke Ovens. Ltd.; Edgar Stansfield, chief chemical engineer, Scientific and Industrial Research Council of Alberta. Canada; and H. S. Vassar, laboratory engineer, Public Service Electric and Gas Co.The ash-fusibility determinations by the standard gas-furnace method were made in the Coal Analysis Laboratory of the Bureau of Mines at Pittsburgh under the direction of H. M. Cooper, associate chemist. The investigation was made at the suggestion of A. C. Fieldner, chief engineer, Experiment Stations Division of the Bureau of Mines.Routine determinations of the fusibility of coal ash are made in the laboratories of the United States Bureau of Mines by the gas-furnace method. This method was standardized after considerable experimentation5 on the nature of the fusion of coal ash and the various factors which affect its determination. The method was subsequently adopted by the American Society for Testing Materials as one of its standard tests."

"In flotation concentration, various machines are employed for agitation and aeration of the ore pulp in the operation of frothing. The power required in the operation of these machines varies considerably with the type and make of machine used. The object of this investigation was to determine the effect of certain physical properties of the pulp particularly viscosity, density, and temperature - upon the power required by certain forms of pulp agitators.The viscosity factor is most involved because it is affected by temperature and by density. Viscosity of liquids and suspensions has been extensively studied and the physics and mathematics of the subject are much enlarged upon in books and in the literature. It is not, however, the intention of this study to become involved in the intricacies of these phases of the subject.The agitation of the various mediums in the experimental work did not last long enough to cause a measurable rise in temperature from the ""beating"" of the medium, hence no cognizance is taken of this factor.No attempt has been made to correlate the data obtained with the impeller with any information regarding centrifugal pumps. The object sought here is quite foreign to the problems of pumping. The impellers used are ""open"" and air is involved.The experiments performed and the data obtained are presented. Only that amount of discussion necessary to make the results understandable is given.Tap water was used in all experiments. A comparison of distilled water and tap water showed no measurable difference. In the experiment in which sodium chloride was needed, the commercial salt as used in fire assaying was taken. The quartz was of the ""bull quartz"" variety, thoroughly washed free of iron oxide."

"In September 1923, a proposal was made through official diplomatic channels by the British Safety in Mines Research Board to the United States Bureau of Mines for ""closer cooperation between the two countries in investigations into the causes and means of prevention of mining dangers."" This proposal was cordially accepted by the Bureau of Mines and was officially approved.In the spring of 1924 cooperation was .formally begun. It contemplated, as stated officially, ""full exchanges of information, a joint program of research, and periodic exchange of personnel so as to assure concordant results. By making the resources of both organizations available it will hasten the attainment of results, will secure better: checks for, accuracy, and in the end will save money for both by avoiding duplication and repetition.""This joint work has been carried-on successfully since that time and has developed valuable results, reports on which have been issued from time to time. The progress report which follows gives the results of the studies and work carried on in 1929.During 1929 all the phases of our cooperative research, begun in previous years, have developed normally. The exchange of formal monthly reports on all programs of mutual interest has been continued and has proved an invaluable, means of maintaining contact between the investigators of both organizations. There has been no diminution in the exchange of routine progress reports on specific subjects or in direct correspondence. The interchange of personnel has been maintained, and we can say that the mutual benefits to be derived from this form of cooperation are so great as to be difficult to overestimate. It leads to an appreciation of methods of research and modes of thought in the interpretation of results obtainable in no other way, and engenders a frankness and intimacy which must continuously enhance the value of future cooperation.Dr. S. R. Katz, who was assigned for service with the Safety in Mines Research Board in April, 1928, returned to America in May, 1929. During his stay in England he completed, in cooperation with members of the board's staff, the equipment of a gas-mask laboratory and designed and tested a new form of gas-mask canister. A publication of the Safety in Mines Research Board dealing with this investigation has been prepared and approved and will .be .issued in the near future. In additions Dr. Katz imparted to those with whom he was associated much of his knowledge and technique regarding his particular subjects. He delivered two lectures to the board's staff, the subjects be ""Gas Masks"" and ""The Intensity of Odors"", and gave papers before the Midland Institute of 'lining Engineers and the Birmingham University Mining Society on the subject of ""Industrial Gas Masks""."

"The Marvel mines 1 and 3 of the Roden Coal Co. are located in the Cahaba field in Bibb County, Ala., nearly southwest from Birmingham, an airline distance of roughly 30 miles. The coal of the Clark seam at this point has some coking properties, but at present it is sold exclusively as a domestic and steaming coal.This paper, which is the second of a series on the washability of Alabama coals, like its predecessor dealing with the Mary Lee seam,5 contains screen-sizing and float-and-sink tests of a representative sample of the raw slack, and slotted-screen tests showing the proportions of flaky particles in certain selected sizes; inasmuch as this coal is not used for coke manufacture, no crushing tests have been made. These data have been obtained in connection with an exhaustive study of coal preparation in Alabama, now being conducted by the United States Bureau of Mines and the University of Alabama with the cooperation of the different coal operators. As the work progresses, other papers will follow containing further data on Alabama coals and giving results obtained in preparing these coals by various methods.The only published investigative work on the Clark seam is that of Forbes,6 who gives a number of sections of this seam in Marvel No. 3 mine with proximate and ultimate analyses of face samples taken in the mine and also some analyses of delivered coal.The available information on this coal indicated that the preparation problem was one of ash reduction. In order to substantiate this information a complete analysis of the 3/4 by 3/16 inch size, and sulphur determinations and ash-fusibility tests of the float-and-sink fractions have been made; these results are given in Tables 1 and 2. As these results also indicate that the preparation problem is one of ash reduction, the tests and discussion have been devoted to that subject."

"The Lewisburg No. 2 mine of the Sloss-Sheffield Steel & Iron Company is located in Jefferson County, Alabama, about 7 miles due north of Birmingham. At this point the coal from the Mary Lee seam when coked in by-product ovens yields an excellent quality of metallurgical coke suitable for use in the iron blast furnace; it is also an excellent steam coal. In mining, all three benches are worked. Coarse impurities are largely gobbed by the miners underground.In addition to giving the data obtained from screen-sizing and float-and-sink tests of a representative sample of the raw coal, this report presents the results of slotted-screen tests to show the proportions of flaky particles in selected sizes, and the results of tests to show how much coal is liberated from impurities by crushing the coarsest sizes. These data have been obtained in connection with an extensive study of coal-washing now being conducted by the U. S. Bureau of Mines and the University of Alabama, with U. cooperation of the different operators of Alabama. As the work progresses other reports will follow containing furtner data on the washability both of the Mary Lee seam and of other seams in Alabama and giving the results obtained in preparing these coals by various methods.Although a great amount of investigative work on the preparation of the Mary Lee scam was previously carried on by the various coal companies of the district, comparatively little of this information has been published. In governmental publications three references have been found. Forbes5 gives a number of sections with proximate and ultimate analyses of face samples taken in the mines. Gandrud and Britton'' show sections of this seam at Flat Creek and New Castle; they also give the specific gravity and ash contents of the partings of coal and impurities. In their paper Yancey and Fraser7 include washability studies and washing data from the Sayreton mine of the Republic Iron & Steel Co."

Many coal companies have a system for checking men into and out of the mine , and generally such systems appear to be perfectly sound and adequate . However , when the real test comes at the time of a mine disaster , too often the system is found to have failed , and hours and sometimes days pass before it is known how many men are in the mine and who they are . Most of the systems in use , when properly maintained , are adequate for the routine work of the mine , and some of them may prove adequate at the time of a mine disaster . All systems , however , depend upon proper supervision and strict adherence to the system .

Industry must be made to realize that "Safety First" means just that - safety first. The miner must realize that safety first takes precedence over earnings. The employer must realize that safety is the first consideration, and is not to be subordinated to profit-making. Neither employee nor employer is justified in adopting the principle of safety first with reservations; that is they will practice safety first only so long as they think that it does not interfere with earnings or profits. This paper proposes to demonstrate that suberdinating safety to possible profit is short-sighted and that over an ex- tended period of time it dres not result in increased profits or earnings. An employee through disregard of safe practice may receive an injury that will cause him a loss of earnings if, indeed, he is net killed or permanently in- capacitated. If permanently incapacitated any compensation he may receive is very likely to be wholly inadequate as compared with probable earnings if the accident had not cccurred. The employer, upon his part, will find that the burden of compensating his injured employse will far exceed the outlay of money necessary to maintain a reasonable program of safety in his mine or plant. The mine foreman is one of the most important factors in the matter of mine safety. A vigilant and competent mine foreman, once he has established the confidence of the employees in his ability as a foreman, can be of invalu- able assistance in promoting mine safety, for through him and his assistants the employees may be made to cooperate. Every employer should remember, then, that the soluction of the foremen and their assistants is one of the most important matters connected with the work of establishing the maximum amount of safety in his mine. Everyone connected with the mining industry must be made to realize that there is to be no back-sliding and no let-up in safety work; that no matter how dry and tedious the routine may seem it is absolutely essential and justi- fied for both humanitarian and economical reasons. Efficient safety effort pays dividends in actual cash to both employer and employee. About 50 per cent of underground accidents in coal mines take place at the working face where the miners dig and load the coal. Approximately 17 per cent of coal-mine fatal accidents are the result of underground haulage. Face and haulage accidents can and will be reduced materially if the individual miner takes all precautions necessary to protect himself and if the management

Unusual mining conditions prevail in the State of Washington because the majority of the coal seams lie on extra steep dips, and the roof and floor of the seams are of such a character as to require an excessive amount of timber- ing. The seams as a rule give off a considerable amount of methane, which makes good ventilation imperative. Due to physical conditions, supervision is costly and travel about the workings is difficult. Because of the facts stated, the accident rate has been above the average, and for some time considerable thought has been given the idea of making promotion of safety in and about the mines a responsibility to be shared equally by the employees and the management. With this idea in mind the legislature of the State of Washington, turing March, 1927, passed laws providing that safety committees be selected to function at the coal mines of the State and at the same time recognizing the fact that first-aid education is an integral part of any safety movement; legislation was passed making it mandatory to have all persons in and about the ines trained in first-aid administration. The provisions of the State mining law3 are as follows: "In every mine a general safety committee shall be selected, composed of the mine superintendent or manager of mines, one man selected by the employees or any association of employees in or around said mine, and a third member selected by these two. "The general safety committee shall elect one of the members to act as chairman and one to act as secretary. The duties of the chairman shall be to preside at all meetings of the general safety committee, enforce its rules and regulations and see that its business is conducted in a prompt and business-like manner. The secretary shall keep an accurate written record of the proceedings of all meetings, conduct its correspondence and post notices of regular and special meetings and other matters pertaining to safety. The duties of the general safety committee shall be to investigate all serious and fatal accidents; make bi-monthly.
