The Inspiration Consolidated Copper Co. had an orebody at Miami, Ariz., of close to 100,000,000 tons of low-grade copper ore, and the method of mining this ore most profitably was of great importance. The selection of a method was practically limited to a "top-slicing," a "shrinkage-stope" or a "caving" method. The "top-slicing" method would give a high extraction of the developed ore, at a high mining cost, and the "shrinkage-stope" or "caving" methods a lower extraction of the developed ore, at a lower mining cost. Ore-Drawing Tests To decide on the method to be used it was necessary to know about what extraction of the ore could be obtained by the "shrinkage-stope" or " caving " methods. As no definite information regarding the,question was available at the time, C. E. Mills, the general manager, thought that some information could be obtained by experimenting in drawing ore, covered with capping, from an experimental box. Some work had already been done along these lines by W. C. Browning for the Inspiration Copper Co. and by myself for the Live Oak Development Co. The idea was to represent as nearly as possible, in the experimental box, the conditions within an area of caved stopes of caved ore all ready for drawing. That is, the area was supposed to represent a semibroken mass with the capping above it in the same condition and ready to follow the ore downward as it was drawn out of the chutes under the ore. To represent the above condition, in the experimental box, crushed ore from the mine was placed in it to a given height, and red barren capping from the mine was placed on top of the ore. The Experimental Box The experimental box shown in Fig. 1 was made of wood and glass. The glass was used for the sides so that the drawing action of the outside row of chutes could be seen and noted, the latter being cut in the center by the glass sides. The observations here presented are not those of an expert accountant, but of one who, while he has seen considerable service in the accounting departments of large companies, has spent more time in engineering and operating. This paper is intended to cover, in a measure, mine accounting for small mines, as distinguished from the elaborate systems, requiring many persons in the accounting department. I shall attempt to outline a system embracing the essentials of accounting, and simple enough in form to permit one or two persons to carry it on from month to month, in sufficient detail to be able to tell quickly the grade of ore, the prices received for metals, costs per ton for mining and milling, costs per foot for development, upward or downward tendencies in costs, ore settled or in transit, cash on hand, stocks of supplies on hand, efficiency of labor, etc. As in all accounting, there are two main divisions: that of revenue received for what is sold, and that of disbursements made for what is bought, so in mine accounting we have to consider chiefly the income derived from sales of ore or concentrates, and the expenses incurred in producing the said ore or concentrates in a marketable condition. I. Income The revenue of a mining company from the sale of ore or concentrates comes in the form of remittances, accompanied by settlement sheets made out by the buyer of the mine product, such as a smelting company. It is the duty of the mine accountant (or the person to whom this is assigned in connection with other work) to check these settlement sheets, against both the mine weights and assays, and the schedules of prices arranged between the mine and the smelter. As a rule, quotations for silver, lead, zinc, copper and other metals enter into the settlements, and require checking, as do also bills of lading. Each step of the arithmetical calculation is also checked.

ChaRles William HenRy Kirchhoff was born March 28, 1853, at San Francisco, Cal., where his father, Charles Kirchhoff, was at that time consul for his native country, Germany. A few years later, the family moved' to Hoboken, K. J., in which city the son received his preliminary education at the Hoboken Academy, proceeding later to Germany, where he was graduated in 1874 as mining engineer and metallurgist at the Prussian Royal Mining Academy of Clausthal, in the Harz. Upon his return to the United States, he became chemist of the Delaware Lead Refinery at Philadelphia, and retained that position for three years. But in 1877 he began what was to be an almost uninterrupted life-long association with David Williams, the publisher of The Iron Age, of New York, who established in that year, and continued for a brief period, a journal entitled the Metallurgical Review, on the editorial staff of which Mr. Kirchhoff received a place. The enterprise was doubtless an attempt to cover a wide metallurgical field outside of that which properly belonged to The Iron Age. But it was soon abandoned, and Mr. Williams wisely concentrated his energies upon the older journal, which, under his vigorous and skillful management, and the labors of the able editors and correspondents whom he selected, became one of the greatest institutions of its class in the world. From 1878 to 1881, Mr. Kirchhoff was assistant editor of The Iron Age. From 1881 to 1884, he was managing editor of the Engineering and Mining Journal; in 1884 he returned to The Iron Age, to become for five years its associate editor, and in 1889, on the retirement of James C. Bayles, editor-in-chief. This list of dates and employments, without further comment, sufficiently indicates, at least to the eye of an expert, that Mr. Kirchhoff had found his congenial career in trade journalism. His qualifications for this profession were somewhat exceptional. He possessed the scientific training, the knowledge of foreign languages and literatures, and the power of making and keeping friends, which enabled him to get early notice of technical novelties; he had the taste for statistics which made him both industrious and intelligent in their collection and use; and to these traits he added a mastery of the meaning of such accumulated data, and a sane, critical judgment of the situations which they represented, as well as of the sources and the figures themselves, which made his opinion weighty

Before the year 1909, no measurements of dust losses and flue gases had been made at the Copper Queen Reduction Works, at Douglas, Ariz. At that time the "unaccounted" loss of the smelter had reached a figure that drew attention to the possibility of large stack losses. The measurement of dust losses had not been studied much at that time, and estimates of dust losses, with a few exceptions, were the results of tests by what has been termed '(chemical methods," that is, the aspiration and filtration through cotton, wool or some similar medium of a few liters of gas, the dust being weighed on a chemical balance, and the volume of gas computed from the volume of aspirator water. The possible error of this method is enormous, and the probable error much too large for reliable results. Since the object of these tests was to discover not only the extent of the dust losses, but also the possibility of profitably reducing them, it was decided that the method adopted must have the following characteristics: 1. The sample of gas taken for filtration must be representative of the whole volume of gas, that is to say, it must have the same dust content. This condition will be fulfilled in all cases if the gas sample is drawn off without change of rate of flow. Then it will contain the same proportion of entrained or suspended particles of dust as the original gas. In the case of flue gases which contain only fume, at a temperature above or near the sublimation point, this condition need not be adhered to since the fume will not behave as entrained particles, but more nearly as a true gas. Consequently the gas sample in this case only may be drawn off at any rate of flow. 2. The gas sample taken must be large enough (a) to yield sufficient dust to permit of accurate chemical and physical examination; (b) so that the ratio of the total volume of gas passing through the flue to the volume of gas sample taken shall not be too large.

The orebody described below has been rediscovered and developed within the last 3 years. It has, however, been known and worked by the Chinese for hundreds of years. When assay values and size are considered, it contains what is probably one of the largest single bodies of zinc and lead sulphides yet found. The tonnages developed at other places, as at Broken Hill, are much greater but the average zinc and lead sulphide contents are considerably lower than at Bawdwin. Bawdwin is situated in the semi-independent State of Tawng Peng, one of the numerous units which make up the Northern Shan States. These States are under British rule and are generally considered as a portion of Burma. They are governed as a separate administrative unit, however, under the Lieutenant Governor of Burma. Each State is under its own chief, or Sawbwa, who has considerable power over his own subjects. Bawdwin is approximately in latitude N 23°6', longitude E 97°201, about 50 miles south of the nearest point on the Chinese border and 450 miles north of Rangoon (Fig. 1). The period at which mining was first begun at Bawdwin is unknown. The most reliable records have been obtained by deciphering local Chinese inscriptions and from these it is concluded that the work dates back to at least the beginning of the 15th century. The first undoubted reference to the mines by a European is by Syrnes in 1795. Crawford in 1827 estimated the output of silver from the mines at $600,000 anually. At about the middle of the 19th century the rebellion of the Chinese Mohammedans in the neighboring Chinese province of Yunnan so weakened the power of the Chinese that the incursions of hostile tribes (Kachins) made work extremely dangerous. The mines were finally abandoned by the Chinese about 1868. The . closing down of the mines was probably not entirely due to outside causes but may have been influenced somewhat by the increasing difficulty of handling the water, as the workings gradually descended below the water level of the district. The experimental work on the oxidized copper ore at the New Cornelia mine at Ajo, Ariz., ended on Jan. 12, 1916. On that date final decision was made on the general nature of the process to be used in the 5,000-ton leaching plant, and on many of the details, as far as experience on a 40-ton scale could decide them. With the approval of the Board of Directors and the General Manager, John C. Greenway, we have compiled what seem to be the most interesting data on the results obtained during the experimental period. The most important part of the data resulted from the operation of a 1-ton and a 40-ton plant at Ajo. Experimental work on Cornelia oxidized ore dates back to April, 1912, and has been going on nearly continuously since that time. A good many variations from the original idea have been tried, but the process finally decided upon is in principle and in all of its details a simple one. The history of the leaching work on this ore has been brought down to about a year ago in papers presented to this Institute by Stuart Croasdalel and Dr. L. D. Ricketts.2 The present paper will, therefore, deal principally with the results obtained during the last year of the work. Preliminary Tests by Mb. Croasdale Preliminary tests were begun by Stuart Croasdale in July, 1912. A number of important points were definitely decided by his work. Among these were: 1. New Cornelia oxidized ore, not very finely crushed (to about 2-to 3-mesh) showed good extraction with 5 per cent. sulphuric acid. It appeared that better than 80 per cent. extraction could be expected. 2. The consumption of acid for this extraction was not prohibitive. It was apparently 3.5 to 4 1b. gross per pound of copper recovered.

During the search for deposits of soluble potash salts in the United States, carried on by the United States Geological Survey, much information was collected on the salt resources and industry of the United States. The more important features of the information thus gathered, compiled, and digested may be classified under five headings, as follows: 1. Geology of the salt deposits of the United States. 2. Theories relating to the origin and formation of salt deposits. 3. Chemical composition of saline materials in the United States, principally rock salt and natural and artificial brines. 4. Statistics of salt production in the United States. 5. Technology of salt production. The first four items are not discussed in this report, but their treatment will comprise a separate report published by the Geological Survey,a which will supplement this report, relating to salt-making processes, and will describe comprehensively the salt resources of the United States. Probably no year in the history of the United States showed greater progress in the mineral industries than 1916. Although this progress was undoubtedly stimulated by the war in Europe, which caused extremely high prices for some of the metals, yet the fact remains that mining is being regarded more as a business and less as a speculation, and the benefits of business methods are becoming evident. Practices that were almost universal a few years ago have been largely abolished, the mining public has been brought to recognize the folly of wasteful and dangerous methods, and there is a gratifying unanimity of opinion in regard to the conservation of life and health, as well as of our mineral resources. The people of the United States realize more fully than ever before the extent and value of the country's mineral resources and the possibilities that await intelligent and well-directed efforts at utilization. In the past, economic reasons caused deposits of valuable metals and industrial materials to lie idle; commercial reasons, many of them not truly economic, led to the waste of valuable constituents in many ores; the recovery of minerals from the ground was too often incomplete and accompanied by uncalculated loss; and the treatment of ores in mills and smelters saved altogether too Iowa proportion of the metals sought. Now better methods are being tried on every hand, and the unparalleled record of the year is largely due to the success of these efforts. According to the preliminary estimates of the United States Geological Survey the output of metals and minerals in this country in the calendar year 1916 had a total gross value of slightly more than $3,000,000,000. For many metals and minerals the figures broke all previous records, the new records of some products, as compared with 1915 figures, being as follows:

This publication is the third of a series of reports on hazards and the prevention of accidents at blast-furnace plants that is being published by the Bureau of Mines, Technical Paper 106a being the first and Technical Paper 136b the second of the series. This bulletin, which is arranged in three parts, treats of the causes and prevention of blast-furnace breakouts, explosions, and slips. The first part discusses blast-furnace breakouts, the hazards therefrom, causes, and features of furnace design and methods of operation that tend to prevent breakouts or lessen their number, and points out safety measures to be adopted. The second part takes up the theory and causes of gas explosions at blast-furnace plants and reviews the better methods in use for handling gas. The third part analyzes the causes of hanging and scaffolding in blast furnaces, with the resulting slips that frequently cause injury to the plant and danger to the workmen, describes features of construction and furnace design and methods of operation employed to prevent hanging and slipping, and suggests precautions and safeguards.

A critical study of the wet Thiogen process for extracting sulphur from the smoke of smelters is one of several investigations related to the general smelter-smoke problem that are being conducted under the direction of the Bureau of Mines. Part of the work done in the pyrometallurgical section of the cooperative metallurgical exhibit of the Bureau of Mines at the Panama-Pacific International Exposition during 1915 related to this investigation, and at the expiration of the exposition, the work was continued in the labora- tories of the Bureau of Mines in the Hearst Memorial Mining Building of the University of California, Berkeley, Cal., where a mining experiment station of the bureau has been established under the cooperative agreement with the University of California. Early in the spring of 1915, when plans were being made to co- operate with several metallurgical interests, the Thiogen Co. proposed to the Bureau of Mines that, along with the studies of various pro- posed methods for eliminating sulphur dioxide from smelter smoke, there should be included a study of the wet Thiogen process. In the study as outlined it was proposed to determine whether it would be technically and commercially feasible to use the, process for the recovery of elemental sulphur from the sulphur dioxide in waste smelter gases. Although there had been no large-scale work with the process, either in the laboratory or at a smelter, representatives of the metallur- gical and mining industry had shown considerable interest in the proposed method, and the desire had been expressed that a better knowledge of the possibilities of the process should be obtained. Thus, cooperation with the Thiogen Co. seemed justified by the in- terests of the metallurgical industry, and by the conservation promised by the recovery of a product of market value from what is otherwise a waste, and in some instances a serious nuisance. In accepting the responsibility for directing this investigation, the officials of the Bureau of Mines were necessarily free to conduct the work in the manner they considered necessary to determine the facts. It was also understood that any information obtained was to be made available to all who might be interested and might be printed in a Bureau of Mines report. To cover the cost of laboratory equipment and supplies, and the payment of salaries of assistants, other than Bureau of Mines employees, the Thiogen Co. in May, 1915, deposited with the cooperative metallurgical exhibit fund a sum considered sufficient to warrant starting the laboratory investi- gation. The origin and organization of this fund has been described by Clevenger and the author." In outlining the program for this investigation it was hoped that ultimately a small complete plant would be erected and the investi- gation center around the operation of the plant. However, pre- liminary to the erection of the plant, a laboratory study of the proc- ess was considered necessary, as the technical features of the process could be determined, it was believed, as satisfactorily on a smaller scale as on the scale first proposed. However, it was realized at the time that it would not be possible to determine so satisfactorily or definitely the commercial possibilities of the process on the scale of work adopted as in the larger operating plant. With this fact in mind it was planned that, if the study of the technical features on a laboratory scale gave sufficient promise of the process being commer- cially feasible, an operating unit should, if possible, be constructed later, and that more definite information concerning the commercial prospects should be determined. The investigations were started in June, 1915. In June and July work was confined entirely to small-scale laboratory tests, in which a careful study of the chemical reactions involved was made. In August, tests on a larger scale were started, and these were con- tinued until December, small-scale tests being made at the same time. On December 1, 1915, all work on the Thiogen process was discon- tinued temporarily, as the close of the exposition necessitated moving the laboratories. Work on the Thiogen process was started again in January, 1916, in the laboratories of the new mining experiment sta- tion at Berkeley, Cal., and was continued during the spring of 1916 until a point was reached where it was felt that the essential parts of the process had been carefully covered, and that some definite state- ments concerning the technical features and possibilities of the process, as given in this report, were warranted.

Mine inspection in Alaska by the Federal mine inspector was somewhat handicapped during 1915,the inspector having to spend a large part of the summer and fall in examining the Matanuska coal field in connection with the designation of the Government reservations and the leasing units in that field. However, in addition to>this work, the mines in southeastern and southwestern Alaska were inspected by both Federal and Territorial inspectors, a considerable number of men near the Federal inspector's officeat Juneau were trained in first aid to the injured and in the use of mine rescue apparatus, the mines of the interior and of Seward Peninsula were inspected by the Territorial inspector, and a suit was brought in the name of the Territorial inspector for the nonreporting of serious accidents under the Territorial inspection law. The work of the Federal inspector was handicapped also by a lack of field assistants. This condition is likely to be serious, as preparations have been made for opening the Matanuska, Bering River, and Nenana coal fields, and a number of permits granting the free use of 10-acre tracts in other fields throughout the Territory have been issued. The need of a comprehensive inspection law and experienced engineers to safeguard the opening of coal mines by operators who are not familiar with coal mining and are using inexperienced help is obvious.

In its efforts to reduce waste, and increase efficiencyin oil production, the Bureau of Mines is investigating methods of increasing the recovery from the underground sources of supply, which are the foundation of the petroleum industry and the many allied industries wholly or partly dependent on it. In the face of a demand that is increasing faster than the production and that, in the consensus of opinions of well-informed authorities, is soon likely to outstrip the productive capacity, it is well to consider whether it is not possible to extract more oil from the known sources of supply. It is universally acknowledged that by the usual production methods much oil is left underground, the general opinion being that at least 50 per cent of the oil in a field remains unrecovered when the field is abandoned as exhausted. From the writer's own investigations he believes the average recovery is even less, and if any considerable portion of this oil being left underground could he made available it would have a tremendously favorable influence on the petroleum industry and all the industries dependent on it. In this publication are considered the principles involved in increasing recovery and methods of extracting more oil from the oilbearing formations than by the usual ways of producing. These methods are: The use of gas or vacuum pumps, forcing compressed air or gas through the oil-bearing formations, displacing the oil by water, and better utilization of the natural pressures in the oilhearing formations. Especial attention is being given to a processcommonly known as the Smith-Dunn-for forcing compressed air through oil-bearing formations because it is believed to hold most promise for the future.

The term" sandstone" is applied to a rock composed of mineral grains smaller than pebbles, cemented together more or less firmly. "Conglomerate" is the name given to a rock composed of pebbles, or pebbles and bowlders, of various sizes cemented together. If the pebbles are large and well rounded the rock is sometimes called " pudding stone." Although the term "sandstone" includes all varieties, certain specific terms are applied to types characterized by particular compositions, colors, or uses. "Quartzite" is a variety in which the individual grains are so firmly cemented together with quartz that the rock will fracture as easily through the grains as through the cement; "ferruginous sandstone" is one rich in iron as cementing material, or as grains, or both; "micaceous sandstone" is one in which mica is prominent; " arkose" is a feldspathic or granitic sandstone composed of angular grains; "calcareous sandstone" is one containing considerable calcium carbonate; and" argillaceous sandstone" is one containing considerable clay. The term "flagstone" is used for a rock that splits readily into sheets suitable for flagging; "freestone" for rock than can be cut or carved readily, and with equal ease in all directions; and" ganistel'," in the United States, for sandstone suitable for the manufacture of refractories. Others are named from their characteristic colors such as " bluestone," " redstone," or " brownstone."

The Bureau of Mines is conducting a series of investigations, with a view to ascertaining the most efficient methods of obtaining gasoline from petroleum and natural gas. This report deals with a method of extracting gasoline from natural gas by absorbing the gasoline in oil and subsequently separating it from the oil by distillation. The process is quite different from those of compression and condensation which have been used for a number of years for extracting gasoline from casing-head natural gas, and has not heretofore been described in the literature. MANUFACTURE OF GASOLINE FROM CASING-HEAD GAS. The extraction of gasoline from casing-head natural gas by compression and condensation methods has become a large and lucrative industry in this country. In the year 1915 about 65,000,000a gallons of gasoline prepared by these methods was placed on the market. In addition, in marketing this gasoline, at many plants an equivalent quantity of naphtha was blended with the gasoline, thereby utilizing for automobile fuel and other purposes a large quantity of naphtha that otherwise would have been unsuited for these purposes. The increase for the year 1915 over 1914 was about 22,000,000 gallons. For the year 1916 the production should be more than 100,000,000 gallons. The quantity of casing-head gas treated in the year 1915 by compression and condensation methods amounted to about 24,000,000,000 cubic feet; the average yield of gasoline was 2.57 gallons per 1,000 cubic feet. b This casing-head gas represents natural gas that formerly went largely to waste; hence the process represented a distinct and important step in the utilization of the natural gas produced in this country.

Under its organic act the Federal Bureau of Mines is directed to conduct investigations relating to the improvement of health conditions in the mineral industries. This report describes the lead and zino deposits and the mining methods employed in the sheet-ground area of the Joplin district, Missouri, and discusses the causes and the methods of abating rock dust in the mines, the chemical and physical characteristics of the dust, and the quantities present in mine air. Although the preliminary investigation included a number of the "soft-ground" mines, the writer spent the larger part of his time in the sheet-ground mines, for in them alone was siliceous dust found in appreciable quantities. Some results of the preliminary investigation have been published by the Bureau of Mines in Technical Paper 105.a The territory covered in t~lCpreliminary investigation, during the period between November 7 and December 6, 1914, embraced parts of Jasper, Lawrence, Newton, and Greene Counties, Mo., and outlying districts in Kansas and Oklahoma. The remainder of the field work, to which 84 days during the period from February 9 to July 19, 1915, were devoted, was confined to the sheet-ground mines, the most important of which are situated in the vicinity of Joplin, Webb City, Carterville, and other smaller near-by towns in Jasper County, Mo.

In its endeavor to promote a more efficient use of coal the Bureau of Mines, in cooperation with the Illinois State geological survey and the University of Illinois, has undertaken an investigation of the coking of Illinois coals. The investigation was started by collecting from various sources the data regarding experiments already made by others; these data have been compiled and are presented herein. The present methods of using coal seem wasteful. When coal is burned in furnaces for the generation of steam, only the heat gener- ated by the fuel is utilized; possible by-products are not only lost but frequently are the source of the smoke nuisance. The volatile matter containing the tar and heavy hydrocarbon gases is difficult to burn completely in many furnaces, and its decomposition produces black smoke. When coal is coked in a by-product oven, the volatile matter is no longer a nuisance but, on the contrary, is the source of many by-products, including benzol, toluol, gas, tar, ammonia, and cyano- gen, all of which increase the value that may be obtained from coal. The coke that remains after the volatile matter has been driven off is a valuable fuel that can be used for almost all purposes for which bituminous coal can be used, and it is necessary for some metallurgical work. It has about the same heating value as anthracite coal. Because of its cleanness and its burning without smoke, it is well suited for domestic heating and the generation of steam in plants where smokelessness is demanded. The use of coke for these pur- poses would do much to eliminate smoke in cities. The best grades are regarded as essential in many metallurgical processes for reduc- ing ores to their metals. By-product coking in the United States during the past three years has increased greatly. When the ovens now in course of construction are completed, the total capacity of by-product ovens will be more than double what it was in 1913. This increase has led to a search for coals other than those now known to be available for use in by- product ovens. Tests with coals from the southern part of Illinois have indicated that coke from Illinois coal unmixed with other coals can be used for fuel purposes and that coke from mixtures of Illinois coal with low-volatile coking coal might be suitable for some metal- lurgical work. In the tests the yield of ammonia was larger than is obtained from Eastern coal. Evidently the development of methods by which good coke can be made from Illinois coals and the by-products recovered is a matter of high importance. Any investigation that will indicate how, by proper treatment, these coals can be made available to supply the market for coke and gas in the Middle West will increase efficiency in their use, and will aid in conserving the country's supply of high-grade coking coal.

A purchase of land where no exceptions or reservations of minerals were made and the land was bought as property, when nothing is excepted and no qualifications or reservations are embodied in the agreement, was presumptively and by common understanding a purchase of the property in its entirety; and the insertion in the deed of a reservation of mineral rights in violation of the contract of purchase and without the grantee's knowledge or consent was fraudulent. RESERVATION OF MINERALS--EXTENT AND EFFECL A reservation in a conveyance of land excepting and reserving to the grantor all coals and mines beneath the surface with the sole right and privilege to remove the same, is not as broad as the grant itself. A contract for the purchase of a mine recited that a deed had been executed by the owner and placed in escrow to so remain until the sum of $30,000 should be paid. The contract provided that $1,200 of the purchase price was to be paid in cash, $800 in 60 days, and the remainder out of 20 per cent of the gross output of the mine, such per cent to be paid in five years unless the vein and value of ore should not continue in depth, in which event the purchaser was to have two years longer to complete the payment of the purchase price. The contract contained other covenants to the effect that the purchasing corporation would fit up a certain specified mill and would continue development work at such rate as to keep the mill in operation if ores sufficiently valuable should be found and in the absence of unavoidable accident. The contract also provided 1/ that abandonment of work for a period of six months at anyone time, except as above, on said property," should operate as a forfeiture of the purchaser's right. In an action by the vendor to quiet the title to the land and to have the contract declared void, the court found that the purchaser failed to perform the work on the property and failed to place thereon the improvements as required by the contract and permitted debts to accumulate against the property, taxes to be levied thereon, and that for more than a year the purchaser had not done any work or labor of any sort upon the mine or premises, and that the contract contemplated development work from the time the purchaser took possession of the property, or at least promptly thereafter, and the fact that no machinery was in place for a year or more after the execution of the contract was a breach of the covenant of continued development, and that the clause in the contract" except as above" does not contemplate a delay in the development resulting from a failure to install machinery, but it means that unless prevented by unavoidable accidents the purchaser shouLdhave no valid excuses for neglecting the work for a period of six months or more.

OWNERSHIP OF ORE-CONSTRUCTION OF CONTRACT. A contract between the Republic Mines Corporation and the Quilp Gold Mining Co. provided that upon forfeiture of its rights under a contract the Republic Mines Corporation was required to give a good and sufficient deed conveying to the Quilp Gold Mining Co. all ore bodies of every description lying east of the west line of the Quilp Mining Co. claim extended downward vertically and lying south of the north end line of the Quilp claim extended downward vertically and which may apex within the lines of the Surprise, an adjoining mining claim. It must be presumed that the contracting parties under such circumstances had in view their statutory rights as provided by the mining statutes of the United States, and that both were familiar with the provisions as to extra- lateral rights granted by the statute to locators of mining claims. This contract means to include all ore bodies of every description lying east (or easterly) of the west (or westerly) line of the Quilp claim extended downward vertically and south (or southerly) of the north end line of the Quilp claim extended downward vertically within the Quilp claim excepting the part that was overlapped by the Surprise claim, owned by the Republic Mines Corporation. Quilp Gold Min. Co. v. Republic Mines Corp. (Washington), 165 Pacific 57, p. 61. PURCHASE OF GAS-REFUSAL TO DELIVER SALE TO OTHERS. A gas company that had entered into a contract to purchase a quantity of natural gas refused to receive and accept the gas that was tendered on the ground that it did not conform to the requirements of the contract; subsequently the company refused to sign a writing by which it was asked to consent to the sale of such gas to other persons. But the refusal of the purchasing company to sign such a writing giving its consent or its refusal to consent to such sale did. not affect the rights of the seller to dispose of the gas elsewhere and to other persons. OWNERSHIP OF MINERALS IN HIGHWAY. All mineral deposits within the limits of a highway belong to the owner of the fee and he is entitled to remove them so long as he does not interfere with the public use of the highway. City of Scranton v. Scranton Coal Co. (Pennsylvania), 100 Atlantic 813, p. 819. SALE AND CONVEYANCE. SALE AND CONVEYANCE EXCEPTION AND RESERVATION. The owner of an undivided interest in oil and gas lands conveyed the same to certain named grantees by deed containing a clause excepting and reserving all the oil and gas produced from the undi- vided interest in the land described. The language is not apt for the creation of either an exception or a reservation, but is rather that of a layman unfamiliar with legal distinctions. Strictly and literally construed, it affords a basis for a contention that that which was excepted and reserved was not realty in any form or anything inci- dent thereto, but personalty produced from the land. Immediately following the description of the tract, the grantor excepted and reserved something from the land described. What he excepted and reserved, he excepted and reserved then, and it was from his interest in the land. The clause expressed according to the evident intention of the grantor would read: "Excepting and reserving from the above all oil or gas which may hereafter be produced therefrom." No other construction can reasonably be placed upon the language used. The carving out of a separate estate in the oil and gas in land is a common occurrence in oil and gas producing fields. Mandle v. Gharing (Pennsylvania), 100 Atlantic 535, p. 536. RESERVATION CONSTRUED AS AN EXCEPTION. Where apt words of reservation are used in a deed they will be construed as an exception where this is the evident intention of the parties to the instrument. Although an exception and a reservation differ in legal effect, yet in their creation there is no magic in words, and if the meaning is clear either expression will operate for the purpose designed. The technical distinction between an exception and a reservation is frequently disregarded in the ordinary use of the word, and whether the language used creates an exception or a reservation must be determined from the intention of the parties ascertained from the entire instrument.

Prior to the actual development of an oil property it is difficult to determine the quantity of oil under the property and the rate at which this oil can be brought to the surface-factors that determine the ultimate value of the property. Consequently, there has been much confusion in devising accounting systems that, during the entire life of a property, will show costs and profits from which the producer can determine whether his property is being worked at a profit or otherwise. The Bureau of Mines publishes this report in recognition of a distinct need for a simple treatise on accounting methods adapted to the peculiarities of the petroleum industry. Probably many companies operating oil wells are not fully acquainted with details important to the welfare of their business, because their account books fail to furnish them with exact and adequate data. With the accountant rests the responsibility of providing the management with reports setting forth the details of the business expressed in fitting terms as well as in dollars and cents. These reports are a means whereby efficiency may be maintained, waste prevented, oil obtained and sold, and money suitably reinvested. They also enable a concern to study the progress of its business in order to conserve to the utmost the possible benefits from an exhaustible deposit of mineral wealth. When managements realize the extent of the waste at their properties more attention will be given to the character of the accountancy records. Herein are presented descriptions and discussions of balance sheets, profit-and-loss statements, and bookkeeping methods peculiarly adapted to the oil business. As far as possible, technical phrases have been omitted in order that those not familiar with accounting terms may be able to follow the subject matter. The systems of keeping books outlined in Chapter X have all been found practical. For brevity as well as clearness the major part of the work refers to the company operating only one property.

The following report is made through the Bureau of Mines as a result of the work under the cooperative agreement with the State geological survey and the engineering experiment station of the University of Illinois. It deals with the use of permissible explosives in the coal mines of Illinois, and is intended primarily to present to mining men the possibility of assuring safer conditions in mining through the use of these explosives. Twenty coal mines in Illinois were using these relatively safe explosives at the time this report was prepared. Of these, seventeen were in Franklin County, two were in Saline County, and one in Montgomery County. In these various fields experience had shown that although black blasting powder was a useful agent in breaking down the coal at the working face, yet it had given such conclusive evidence of its danger to life and property in causing explosions and mine fires that a substitute was sought and has been found in permissible explosives. Each coal mine in Illinois in which permissible explosives are used was visited and a study made of the problems involved. The report deals briefly with the dangers of black blasting powder now in such common use in coal mining. It discusses the development of permissible explosives and their introduction into Illinois coal mines and points out the characteristic differences between permissible explosives and black blasting powder. The present system of blasting and the most approved methods of using permissible explosives are described. Data are given to show that not only has safety and efficiency in these mines been greatly improved, but that the cost of explosives to the miner per ton of coal has been reduced, and that sizes of coal produced from permissible explosives compare favorably with those previously obtained at the same mines with black blasting powder. The successful use of permissible explosives in these Illinois mines as well as in many other mines throughout the country should aid in their introduction into a larger number of mines and bring about that degree of freedom from explosions and fires which should be attained in mining.
