This name is applied to the present mining law, as enacted in 1872 and since, to indicate its leading characteristic—in which it differs from all previous mining laws of this or any other country. The earlier act, passed in 1866, was practically the first attempt of Congress to deal with the question of mining titles upon the public domain. It was framed after nearly twenty years of acquiescence on the part of the Government in the self-constituted tribunals, officials, rules, and customs of the mining districts. In its recognition of these, and in several other particulars, the act of 1866 was open to serious criticisms. It is the purpose of this paper, not to trace the history of legislation on this subject, or show in detail what were the faults of the earlier law, but rather, by a discussion of certain aspects of the present law, to point out how great a revoluition it has effected in the rights of mining locators, and to indicate some of the difficulties attending its application. In the attempt to correct the vagueness of the act of 1866 an entirely new elernent was introduced into the law, bringing with it a new set of difficulties. Under the act of 1866 and the miners' customs which it followed, the lode was the thing claimed and subsequently acquired by patent. And the claim to a given number of feet on the longitudinal course of the lode was rooted in 'a discovery of any part of the lode in any part of the claim. ("Extensions" could in many districts—perhaps universally—be located and claimed on the strength of the discovery in the principal claim to which they referred; but this is a point not essential to the present discussion.) It was not necessary to find the outcrop or the upper edge of a lode in order to lay a valid location upon it. Any process which has for its object the preservation of iron and steel from rust, and which will make these metals more applicable than they now are to the requirements of mankind, will be sure to meet with attention from members of this association, and from all those who are either engaged in the extraction of the ore, its reduction to metal, or the subsequent application of the metal itself. It is, perhaps, not too much to say that when iron and steel are rendered secure against corrosion and decay, they will be used to an indefinitely greater extent than they now are. The whole realm of science has, therefore, been explored in the attempt to discover some method by which the formed article may be preserved, leaving its strength undiminished by the destructive action of rust. Paints, oils, varnishes, glazes, enamels, galvanizing, electro-depositing and what is called "inoxidizing" are among the many systems now in vogue to effect the preservation of iron and steel from the corrosive action of air and water. The object of this paper is to show what may he done in protecting iron and steel from rust by forming upon their surfaces a film of magnetic oxide by an inexpensive process. It is no new thing to be told that magnetic oxide of iron is unaffected by exposure to the atmosphere or to salt water for any length of time. The black sand of Taranaki, in New Zealand, is a sufficiently good example of this. Dr. Percy has pointed out that the reason why Russian sheet iron is less affected by exposure than ordinary sheet iron is because of a coating of magnetic oxide; but this was not known

Coal was mined to a small extent near Tuscaloosa, in Alabama, and even carried by boats to Mobile, half a century since. Professor Porter, and later, Professor R. T. Brumby, occupied themselves with the geology of the region, and it attracted the attention of Sir Charles Lyell, who visited the region. It is, however, to the two reports of Professor Tuomey, geologist to the State, published in 1850 and 1858, that we owe our first clear notions of the geology of the Alabama coal-fields. His work has, since 1873, been continued by Professor Eugene A. Smith, of the University of Alabama, whose valuable reports, extending and completing the work of his predecessor, are indispensable guides to the geological inquirer in this region. Mention should also be made of the investigations of Mr. R. P. Roth well, who, after three years of studies in parts of the Alabama coal-fields, read before the American Institute of Mining Engineers, in October, 1873," a brief but important paper calling attention to the great deposits of coal and iron-ore found therein, and to their economic importance. Having myself, during the past year, had an opportunity of visiting parts of this region, I have thought that it might be well to bring before the Institute some facts and considerations as to its geological and geographical characteristics, and the value of its mineral resources. It is well known that the great Appalachian coal-basin, stretching southwestward through western Tennessee and the northwestern corner of Georgia, terminates in northern Alabama in what is called the Warrior coal-field, which there covers an area of about 5000 square miles. In the latter part of December a batch of amalgam was retorted and the tin in the retort uncovered while at a low red heat, and allowed to cool slowly to a temperature more suitable for ladling into moulds. It was then ladled and made what appeared to be nice, white, malleable block tin. On February 15th our attention is called to the fact that the tin is brittle, and on examination we find that the molecular condition of the pigs has changed to the extent of one-half its material. The change shows itself by an enlargement appearing on the surface something like crystallization, and comes in spots. The condition of the metal in these spots is very peculiar. It has changed from a malleable metal to a brittle one, with a structure somewhat resembling stibnite, and a color very considerably darker gray than tin. The '(author's edition" of the following paper, "subject to re vision," was received by him, and copies sent to Professor Geikie and others about two weeks before the date of the meeting at which it was to be read. A telegram, and subsequently a letter (both of which unfortunately arrived too late), apprised the present writer that the Director General objected to certain views ascribed to him as the reverse of those which he really held. These views, however interesting, had no very important bearing on the object of the fol lowing notes, which, as must be evident, are devoted to the conside ration of the close analogies between the Welsh and American rocks. Without being able, therefore, to account for the circumstance which Professor Geikie has mentioned, it is thought better in the present revised edition to omit all allusion to Professor Geikie, or Mr. Peach, or their views, except in this place, where I desire to thank them for their courtesy during the time which I had the pleasure of spending in their society. It appears sufficiently throughout the body of the paper that the writer had not the slightest intention of entering the controversy, which was about to commence, concerning the proper horizons of the St. David's rocks, for many reasons; and amongst others because he did not feel that a sojourn of a few days in a difficult region, which had been already studied by many of the foremost geologists of England, would warrant him in adding to the literature on the sub ject. The discussion of the analogies between these rocks and those of the Eastern Appalachians, which he has studied for twelve years, of which eight were spent in the service of the Second Geological Survey of Pennsylvania, was much more to his taste as it was more within his ability, and if he has added anything to the evidence of these analogies, the paper, however imperfect, will not have been written entirely in vain. Right or wrong, he assumes the entire responsibility of what follows.

At the Philadelphia meeting of the Institute, held in February, 1881,I had the honor of reading a paper on "A New Method of Mapping the Anthracite Coal Fields of Pennsylvania."* At that time the State appropriation for the Second Geological Survey had just expired, and, as a new appropriation was not assured, no detailed plan had been adopted by Professor Lesley, State Geologist, for the practical examination of the mines, and the solution of the geological structure of special localities, or the representation in sections, vertical and columnar, of the general structure of the coal basins and coal beds. I had merely proposed a plan of mapping, as the material for the construction of maps was most available, and it was at that time uncertain what money the Survey would have to enable it to extend the surface and underground explorations, in order to make the examinations complete. After a continuation of the Survey was authorized until January, 1884, by the legislature, in May, 1881, the Anthracite Survey was regularly organized, and a plan adopted for a systematic and exhaustive geological and mine examination of the region. This plan provided for such work, other than that of mapping, as was necessary for a complete and practical geological and mining survey of a coal field. To do any geological work, of however general a character, it was absolutely. necessary that the members of the Survey Corps should obtain unrestricted access to all the mining records of the operators, which have been made with great care and accuracy and at an enormous expense during the past thirty years and more. The unanimous and generous support of the individual and corporate coal operators, of the plan of carrying on the Survey, was promptly assured, on condition that the results should be of such a character as to render them of practical utility to the property-owners and those directly interested. The perusal of Mr. Willard P. Ward's " Notes on the Behavior of Manganese to Carbon," presented at the Washington meeting of the Institute in February, 1882, has suggested further reflections on the same general topic, and has led to the preparation of the present paper. The same observation that Mr. Ward has put on record in his "Notes" was also made by myself at about the same time (in August, 1875), and under almost the same conditions. From a blast-furnace that was very hot, as was the furnace mentioned by Mr. Ward, I obtained a pig-iron containing about fifteen per cent. of manganese, gray in color, and very tough. It could be pulverized, but could not be cut with the chisel. I analyzed this iron and found that it contained, as I had suspected,a large amount of silicon. From this fact I drew the conclusion that the silicon had deprived the manganese of its power of dissolving carbon, since the latter, instead of occurring in the pig in combillation, appeared as graphitic carbon. I thus saw reproduced on a large scale, and demonstrated in a visible way, the property that Colonel Caron, a French scientist, had discovered in silicon,—the property of obstructing the process of hardening in steels by keeping the carbon in the graphitic condition. An attentive study of the conditions under which the phenomenon observed by Mr. Ward takes place led me to go back to operations of synthesis, and to make as I wanted them pig-irons containing varying quantities of silicon, manganese, and carbon. An iron, thus prepared, was intended to serve me as a chemical reagent in the production of steels cast without blow-holes, such as my lamented friend, Mr. A. L. Holley, has introduced and made known to the United States. During the last year I had occasion, on behalf of our New York copper works, to send to various chemists samples, intended to he accurate, of material which we were buying and selling, and I was astonished to find what differences were reported. After talking over the probable reasons for this with a number of chemists and metallurgists, it was suggested that it would be of real use and some scientific interest to send samples to the different chemists, and take such care in making up the samples that we could feel sure that each chemist had as nearly identical a sample as it was possible to make. WET processes for the extraction of copper from its ores have of late attracted much attention, especially in Europe, where the use of oupriferous iron-pyrites as a' source of sulphur prevails. These processes present an additional interest, when, as is often the case, the copper-ore's to be treated contain one or both of the precious metals, since the complete separation of these from copper, either in the dry or the moist way, is, as is well known, one of the difficult problems of metallurgy. The principal wet processes hitherto in use for the extraction of copper from its ores, may be included under three classes : I. Those in which the copper in snlphuretted ores is rendered soluble in water by calcining them, after a preliminary roasting which removes the greater part of their sulphur, with a portion of common salt, by which the copper is converted into a chloride (Long-maid and Henderson), or with sulphate of soda, by which sulphate of copper is formed (Monnier). Allied to these is the method by which a portion of the copper is got as soluble sulphate by roasting without addition, a process which is sometimes modified and rendered more complete by re-roasting the lixiviated residues with the addition of a portion of raw sulphuretted ore (Bankart). II. Those methods in which free chlorhydric or sulphuric acid is used to dissolve the copper- from oxidized or roasted ores. These, while simple and efficient, are too costly, except in certain localities where chlorhydric acid is a waste product. Related to them is the plan which consists in exposing the oxidized and moistened ores to the slow action of sulphurous acid mixed with air, by which a soluble sulphate of copper is formed. It has been proposed to decompose the solutions of sulphate or chloride of copper by sulphuretted hydrogen, thus separating the copper as sulphide, and using the liberated acid to dissolve fresh portions of oxidized copper. It is, however, the almost universal practice to throw down the copper from its solutions, however obtained, in the metallic state by the use of iron, either scrap-iron or iron-sponge; although in some instances

PRESIDENT AND GENTLEMEN : I have been invited to meet you here this evening to extend to you the cordial greeting of the regents of the Smithsonian Institution, and to assure you that they are most happy to have it in their power to place at your disposal this beautiful hall, dedicated to science and art. This National Museum is the property of the United States, of which the regents of the Smithsonian are simply the custodians, and the board has delegated to its secretary, Professor Baird, the right to extend its use to the National Academy of Sciences and like kindred societies, among which we are glad to class the Institute of Mining Engineers. It is eminently fit that you should meet here at this, the nation's capital, under a roof partly your own, devoted to natural sciences, and in the shadow of the Smithsonian, founded for the exclusive purpose of collecting and diffusing knowledge among men. Of all the workers employed on earth no single class seem to me more worthy the respect of their fellows than those who seek beneath the surface for the useful minerals and metals which contribute so largely to the wealth and comfort of mankind. SINCE the discussion On steel rails in America has forcibly drawn attention to the value of chemical analysis, if not as a necessary stipulation, at least as a guide to control the usual mechanical tests, some doubt has been thrown upon the accuracy of the analytical results Obtained by different chemists. To any One having the least acquaintance with chemistry., it is quite clear that if exactly similar results are to be obtained from the same borings of steel, exactly the same methods must be used by the different analysts. Hence the necessity (if complications are to be avoided) of establishing what I may call standard or normal methods, to be used both by the inspectors and by the chemists at the works. Remembering that the application' of chemistry to steel-rail inspection is yet in its infancy, it is of great importance to possess a perfect acquaintance with the best methods in use. Being myself a grateful pupil of Professor Eggertz, of the School of Mines in Sweden, it Occurred to me, two. years ago, that I could not do better than start a laboratory of my. own, and engage One of his pupils, Mr. Troilius, for the purpose of analyzing the steel borings from mechanically-tested rails, so that I might thus Obtain without delay thoroughly accurate determinations. Moreover, in Order to carry on the, operations in perfect accordance with the methods used at the steel works in England and Germany, where I had to control the manufacture, I deemed it desirable to allow Mr. Troilius to go through a course of training at these works; and I gladly seize this opportunity of expressing my grateful acknowledgments to several works in England and in Germany for affording every facility for such an exchange of information as was found necessary in arriving at the best analytical methods to be used.

THE question of the proper valuation of mines of iron ore was suggested to me by the difficulties experienced in getting answers for the United States Census Office, while I was engaged in the work of collecting the statistics of mines in New Jersey and New York The answers to the questions relating to values of real estate of mine properties varied so greatly that it was necessary to revise them according to some general principles of valuation. Generally the returns of mine proprietors Seemed to be too low. There were, however, examples of what would be termed excessive valuation. The Subject appeared to be of practical importance, and led to the paper here presented. The following table of selected mine statistics is given, prefacing the discussion of the principles of valuation. It is in part made up of census returns and partly of data obtained directly from mine owners and managers. The mines which were Selected for the Several groups and mining districts include nearly all of those from Which the more full and carefully filled returns were received, and are also representative of their respective districts. Hence the averages obtained from them become good types of these groups or districts. The mines of New Jersey appear in Six groups, each containing from three to eleven mines, or, in all, thirty-four mines. The magnetic iron ores of New York are in four well-marked groups, and there are twenty-six mines in them. Then follow the red hematite mines of St. Lawrence and Jefferson counties; and, lastly, the brown hematite groups of Dutchess and Columbia counties, and those of the adjacent parts of Connecticut and Massachusetts. The whole number of mines represented by the table is eighty-eight, of which twenty-eight are hematite mines. The first column gives the value of the real estate; the second that of the plant; the third is the sum of these two, or the capital invested. Then follow the number of men employed, the amount of wages paid during the census year, and the value of materials used in mining and preparing the ores for market.* The seventh column gives the total expendi- * The value of materials is somewhat uncertain in many cases, as royalties are included under this head.
