This chapter deals with the systems of laws by which governments regulate the exploration for and production of the minerals within their jurisdictions. It is a summary, restricted by necessary space limitations, of material assembled by the author for a forthcoming publication of the United States Bureau of Mines, "Summary of Mining and Petroleum Laws of the World." (Information Circular, 1959.) The present study is organized in three parts, dealing with (1) the historical background of these legal systems, (2) laws of the United States, and (3) laws of other countries of the world. The reader's attention is invited to the acknowledgments at the end of the chapter, which inadequately express the appreciation due those who have assisted in the collection of this material. Part I. Historical Development of Major Western Systems of Land Tenancy with Respect to the Ownership and Control of Minerals The use of metals in primitive societies was largely confined to the manufacture of weapons for self-preservation. The ruler's control over copper, then brass, then iron, was essential to maintenance of his own ascendancy at home and his group's position against neighbors who had access to similar metals. Ancient societies were thus characterized by the ruling group's ownership of minerals and metals. The Egyptian civilization, which emerged in the fourth millenium B.C. upon the agricultural subjugation of the lower valley of the Nile, was responsible for extensive development of the upper valley as a source of mineral wealth. The production of gold during the height of that civilization has been estimated at $30,000,000 per year, thus equaling the early placers of California and Australia. The mines of Egypt were the property of the Pharaohs and were controlled at their direction. Greek mining developed a different scheme of land tenancy which more closely resembled modem concepts. The placing of much, sometimes practically all, of the burden of the expense of mine accidents on the shoulders of the mine operator by compensation laws, and the fact that the problem of protecting the life end limb of workers is now by public opinion largely if not wholly passed to each industry to solve (and present-day thought strongly supports the justice of both of these propositions), are forcing industrial organizations into accident-prevention. Work. This policy is being adopted not alone to protect the companies; in addition, executives alert to their opportunities and obligations are taking part in this work personally to protect themselves. The functions of industrial executives in accident-prevention work are becoming numerous and complex. Executives who are logical in their reasoning, quickly see that before a company can constantly ask or expect the workers to heed safety suggestions, the company and its officials must "put their house in order" by laying down a concrete, definite safety program. For mines this includes primarily adoption of a to a logical mining method, the installation of safe miming equipment and practice the netting forth in definite form (preferably do a printed pamphlet) of the company's minimum safety requirements, and the organization of its operating officials into an accident-prevention body. After the company has its own affairs so arranged that it can go to its workers with "clear, hands" in promoting a safety program, the real work begins; and this is especially applicable in mining.

New Mexico Bureau of Geology and Mineral Resources (NMBGMR) has been collecting data on uranium mining districts, mines and mills since it was created in 1927 and has converted years of historical data into a relational database that can be imported in ArcMap. The database includes information on mining districts, mines, mills and geochemistry, as well as photographs and bibliographic resources. The available data includes location, production, reserves, geologic, geochemical, resource potential and other data. The National Uranium Resource Evaluation (NURE) stream-sediment data provides geochemical analyses for >27,000 samples collected in New Mexico during the 1970s. The NURE hydrogeochemical data provides analyses of water samples. ArcMap includes the location of individual ore bodies as polygons and incorporates the mines and NURE data as individual site locations. The purposes of these databases are to provide computerized data that will aid in identifying and evaluating resource potential, resource development and management, production and possible environmental concerns, such as physical hazards (i.e., hazardous mine openings), indoor radon, regional exposure to radiation from the mines, background geochemical data and point sources of possible pollution in areas of known mineral deposits.

The Bureau of Mines Solid Waste Program is directed toward three main areas of research: (1) Extraction of mineral, metal, and energy values from urban refuse; (2) recovery of mineral and metal values from wastes generated in the industrial extraction, processing, and utilization of raw materials and mineral-base products; and (3) upgrading and utilization of automotive scrap. The Bureau also has a contract and grant program which supplements the in-house research and aids in the training of personnel in the proper management of mineral- and metal-based solid wastes.

The process of sampling blasthole cones utilising personnel to manually shovel material into sample bags is a long-standing industry accepted process. However, this method has several drawbacks, including the safety issues around having personnel performing manual sampling in a harsh environment and the variability involved in getting a human to repeatedly get a ‘shovel full of dirt’, and make it always representative. Geophysical blasthole sampling, or utilising a Downhole Assaying Tool (DHAT) has been tested and has now begun implementation at many iron ore sites throughout the Pilbara region, Western Australia. This method uses a geophysical tool to capture data within blastholes, and together with a semi-autonomous logging platform to minimise risks around manual handling, delivers a multielement proxy-assay which can be utilised by the mine geology team to accurately domain the orebodies. Logistically, the combination of a specially designed tool and semi-autonomous truck are the way forward for a safer and more data-robust blasthole sampling practice. The method utilises a neutrongenerating geophysical tool and linked elemental spectroscopy sensor, which measures the response of the material surrounding an open hole. This delivers results at submetre intervals. These results are then utilised, similar to blasthole sample results, to map out areas within the blast pattern that are ‘ore’, ‘waste’, or ‘other suitable grade’. This paper outlines a project that has been in ‘proof of concept’ at selected Fortescue sites over the last few years with testing of these tools carried out on reverse circulation (RC), diamond drill and blastholes. The method is now being implemented at operational hematite mine sites. Fundamentally, the method adds more than enough value to justify its implementation. The aim is that these learnings will enable the greater industry to adapt, implement and improve their mining practices. Ultimately, the outcome will be greater value in mining for the industry by having a larger volume of good quality data to make reliable decisions on material movements, minimising ore-loss and dilution, and maximising the value of our current and future orebodies.

Few efforts have been undertaken to date to assess the quality of mandated coal mine health and safety training for new miners and for experienced miners. This study was concerned with the quality and effectiveness of existing classroom health and safety training programs. The study involved field data collection through pre- and posttesting of trainees, audio-taping class sessions, and administering short feedback forms with trainers and trainees at 14 sites in West Virginia, Maryland, Kentucky, and Pennsylvania. Results indicate that goals, methods, materials, and outcomes of existing training programs vary widely among trainers and sites. The report provides less by way of solution to problems, than it highlights the breadth of issues that relate to the question of training effectiveness and quality. The report concludes that additional work by industry, labor, government, and academia is necessary in order to improve health and safety training programs. Recommended steps are: (a) to develop performance standards and measurable criteria in each of the types of mandated training, (b) to develop better training of trainers, (c) to develop expanded training support services. and (d) to undertake further research and development in health and safety training in the mining industry

"India’s economy is expanding with rapid urbanization. Improvement in infrastructure is a keystone to the Indian government’s economic plans, including expansion of transit systems. Most of these systems are designed with elevated and underground sections. New Delhi, a city of 23 million people, suffers from heavy traffic congestion and pollution. The transit (metro) system is seen to be of critical importance. Phase 3 of the Delhi transit system project is 140 kilometers (km), with 40 km of twin-bore tunnels requiring 35 tunnel boring machines (TBMs) for construction. Transit systems are also under design or construction in Chennai, Bangalore, Kolkata, Hyderabad, Jaipur and Mumbai. Most have twin-bore tunnels. At present, 55 TBMs are operating on underground metro construction, and future projects will increase this number. This paper highlights the unique challenges of construction of underground metro systems in highly congested urban environments, using Kolkata and Delhi systems as examples. INTRODUCTION The first transit system in India was constructed in Kolkata (India’s third-largest city by population.) This line is 28 kilometers (km) in length, has underground and at-grade sections, was built in phases, runs north/south, and has 24 stations. This project was sanctioned in 1972, started construction in 1984, and was completed in 1995. The tunnels were constructed primarily by cut and cover methods with some open-face, compressed air shield tunneling. In 2006, the urban transport policy recommended construction of transit rail systems in all urban cities with a population exceeding 2 million. Further, in 2014 the central government stated that it would assist in financing transit systems in all cities with a population of over 1 million. In 2015, the central government approved the development of transit systems in 50 additional cities across India with a budget of $75 billion (see Figure 1). Transit development is just part of a huge expansion in planned rapid transport systems, which include metro, bus, high-speed rail, and monorail systems. Metro systems will include elevated and underground sections with twin-bore tunnels and underground stations. In the Delhi/National Capital Region (NCR), now the largest city in India by population, Delhi Metro Rail Corp (DMRC) was formed in 1995 as a joint venture company between the central government and Delhi state. DMRC operates the Delhi metro system. (see the case studies described later in this paper). DMRC has developed an external function to carry out studies and to offer consultancy to other cities planning transits. Since its inception, DMRC has produced Detailed Project Reports (DPRs) for every metro and monorail project in India. In 2012, DMRC became a partner in the management consultancy for Jakarta Mass Rapid Transit System, its first project overseas. DMRC became a model organization for other cities to follow. These cities have included Chennai, Hyderabad, Kolkata, Bangalore, Jaipur, Mumbai, Ahmedabad, and Nagpur. Other cities (e.g., Lucknow and Patna) are in the metro planning phase. Metro systems are under construction or partially operating in Hyderabad, Bangalore, and Jaipur."

Prier to the date of this contract, Ocean Energy had developed and demonstrated a high efficiency fluorescent caplamp which operated from a standard 4 volt miner's caplamp battery. This unit produced about five times the light output of the standard incandescent miner's caplamp. The Company believed that the major market for this unique caplamp was in the industrial and municipal applications. Because of the additional safety requirements for coal mining use, and in conjunction with the much smaller market in the mining industry, the additional expense and difficulty of modifying this caplamp to comply with the Federal and State coal mine regulations were not considered at that time. Recognizing the potential of this lamp for improving illumination conditions for underground coal mining, the US Bureau of Mines contracted with Ocean Energy to make the required modifications to this lamp to bring it into compliance with the Federal and State of Pennsylvania regulations, and thereby, make this lamp available to the anthracite and bituminous coal mining industry. At the outset of the contract, the injection molds for the caplamp housing were being completed, and only prototype, hand fabricated, units were available for tests. The Bureau evaluated these prototype units and formulated a performance specification for the miner's version. Light level and distribution, weight, size, angle of tilt, and operating duration were all specified. In addition, it was required that the caplamp be com¬patible with existin charging equipment at the mines and that the final design be in full compliance with MESA Schedule 6D and he ultimately approved by MESA, Approval and Testing, as well as by the Pennsylvania Bureau of Deep Mine Safety. The scope of this contract covered the modifications required to achieve these objectives. It was agreed by the Bureau that all rights to the lamp, including design, material combinations, circuitry, etc. would remain with Ocean Energy. The charger/adapter system and components, which were developed under contract funds, are disclosed hero and become public knowledge and property. Patent applications have been filed by Ocean Energy to protect the mechanical and electrical design aspects of the lamp. It should be noted that this report contains details, designs and data which may be covered by one or more Ocean Energy patent applications, and disclosure herein is made only to provide better understanding of the contract results.

Open cut coal-mining has been conducted in the Bowen Basin region of central Queensland for almost five decades, and has disturbed an estimated area of 140 000 ha of agricultural land until 2011. Approximately one-third of the area disturbed by mining has been rehabilitated to pastures or bushland. However, none of the rehabilitated land has yet been assigned a specific end-use. This research project develops an approach for assessing end-use risks for the regionÆs mined land, and develops risk assessment models for selected end-uses. First, a web-based survey of stakeholders was used to identify risks to be assessed. The risks identified were surface erosion, subsurface erosion, bushfires, weeds and feral animals. The survey also identified possible end-uses of bushland and grazing. Second, conceptual risk models were developed based on the risk assessment concepts of likelihood and consequence specified in the Australian and New Zealand risk assessment standards. Likelihood was modelled using site characteristics and management factors that influence the occurrence probability of risks (eg surface erosion), while consequence was modelled using a set of site condition indicators and condition thresholds (changes in root-zone water-holding capacity, soil erodibility, vegetation ground cover and soil organic matter and transition probability to a non-preferred ecosystem type).The factors influencing likelihood and consequence for each risk have been integrated using Bayesian networks. The next step in model development is to parameterise the Bayesian networks using existing equations, empirical datasets, or expert opinion where data are not available. The parameterised models will be used to assess grazing and bushland end-uses against erosion, bushfire, weed and feral animal risks for rehabilitated mined land sites, with the purpose of identifying the relative risks associated with each end-use, and the landform design specifications and land management practices under which end-use risks are minimised.CITATION:Maczkowiack, R I, Smith, C and Erskine, P D, 2012. The rare-earth group are among the least familiar of the 92 known elements. Moreover, the relatively few people who have even heard of the rare earths ordinarily regard them merely as very rare elements having unusual names but doubtful commercial application. This typical attitude can be attributed partly to the fact that no commercial uses have been developed for most of the members of the group and partly to the fact that those which do enter into useful articles do so anonymously. Most people speak with a degree of familiarity of the "chromium" plating on their automobiles or household appliances; "antimony" ash trays and cigarette boxes are on sale in many department stores; and "tungsten" lamps and even "molybdenum" steels are advertised in popular magazines. However, the average user of a pocket cigarette lighter is not conscious that the important sparking element is a "flint" made from ferrocerium, and if he does chap on to inquire about the composition he is likely to be told that it is "sparking alloy", "misch metal", or 'pyrophoric alloy." Similarly, the wearer of spectacles made of "Crookes" or other tinted glass probably is not aware that the light softening effects are due to the presence of rare-earth oxides, or that the arc light on his street may owe its brilliance to cerium fluoride in the carbon electrode. Despite a variety of practical applications, however, most of the rare-earth metals still must be listed as scientific curiosities. In fact, little is known as to the properties which may make them useful products at some future date. Meanwhile it is important to note that Nature has been relatively generous in her distribution of the rare earths and that adequate supplies of most of them will be forthcoming when these elements have proved their worth as commercial products.

The Bureau of Mines, in its effort to promote greater utilization of domestically abundant materials, conducted reasearch on an alternate mold material that has commercial potential for titanium investment casting. Using variations of the conventional lost wax molding process, investment shell molds were formed entirely of fused, calcia-stabilized Zr02 and a Zr02-forming binder. Optimization of binder/slurry properties', stucco grain size and dis¬tribution, and curing practices resulted in a structurally sound investment shell that was distortion free and thermally stable. Small titanium castings, weighing up to 10 pounds, were prepared in unheated molds by both static and centrifugal casting techniques. Microstruc¬tural examination of the castings revealed that mold fill and surface quality were enhanced by centrifugal casting, although good results also were obtained from the statically poured molds. Microstructural and electron microprobe examinations showed that excessive, brittle case formation could be avoided by curing the dried shell molds in air for at least 2 hours at 1,400° C. Increasing curing temperature and time above these levels yielded added bene¬fits. Molds fired in vacuum at 1,500° C for 4 hours yielded castings essen¬tially free of case formation. The tensile properties of as-cast test specimens (no surface conditioning performed) id the chemical composition of representative metal samples showed that castings produced were comparable to Grades C-1 and C-2 unalloyed titanium This indicated that no sifnificant degradation of metal properties resulted from mold/metal interaction.

The Weber pool in Washington County, Okla. (fig. 1), covers an area extending from 2 miles east and slightly north of Bartlesville, Okla., to a point approximately 2-1P tiles northeast of Dewey, Okla. The pool is a part of the area designated by the Standing Committee on Oil Field Nomenclature, Kansas-Oklahoma Division, Mid-Continent Oil & Gas Association, as the Bartlesville-Dewey field. In the following discussion of the geology, development, and exploitation of the Weber pool, the writers, by means of structure maps, cross sections through various parts of the reservoir, and tabulated development data and production statistics, have recorded salient information on a field that was developed before .1910 in an Area that has been repressured since 1926. The total oil production to January 1, 19.0., from the 2,639 developed acres considered in this report, was approximately 14 million barrels, or a recovery of about 5,3;2 barrels per acre, or 227 barrels per acre-foot. The production of the estimated 18 million barrels of recoverable oil remaining in the Bartlesville sand reservoir will require the initiation of additional secondary-recovery practices on some of the leases and the application of a more systematic repressuring program on others.

The U.S. Geological Survey estimate of the total remaining reserves of lignite in this country as of Jan. 1, 1967 was about 448 billion tons. This represents 27 percent of the total coal reserves on a tonnage basis and about 17 percent on a thermal basis. Approximately 98 percent of these reserves are in a vast lignite field located in western North Dakota and eastern Montana. This field also extends north into the Canadian province of Saskatchewan. Despite these large reserves and relative ease of mining by stripping operations, lignite production historically has accounted for less than 1 percent of the national total. This is largely due to the fact that the lignite deposits are located in an area that has no large centers of population and the economical radius of transportation is limited by its relatively high moisture and low heating value. Commercial utilization of North Dakota lignite for power production became firmly established in the mid-1920's with the development of the first successful lignite-burning equipment. Most of the early lignite-fired boilers were equipped with spreader stokers, but as the size of the plants increased, pulverized-coal firing became the more popular method, and with few exceptions, the plants built during the past 15 years are pc-fired.

"The environmental effects of the mining and mineral industry include destruction of natural habitats, changes in river regimes and water tables, and other serious ecological impacts. In this century, it is likely that water will become a critical resource, and in most countries the mining industry competes for a share of this resource. The Kyoto Protocol may at first seem only relevant to the coal mining and power industry, however, it should not be forgotten that the mining and mineral industry is a significant consumer of power. Therefore the ratification of the Kyoto Protocol by most developed countries and the introduction of a carbon credit trading scheme will impact on the industry by potentially increased costs in utilities and waste discharges. It is clear therefore that the mining industry faces many challenges in the coming years. The mining industry?s commitment to sustainable development needs to continue to evolve, in order to meet these challenges effectively. With the advent of globalisation of the industry, it is now an opportune time for the industry to gain international agreement on how they want the industry to achieve sustainability in future years; such a progressive approach is necessary, otherwise government will force the industry to change, which may not necessarily be the best outcome for the industry.INTRODUCTIONThe Earth Summit in Rio de Janeiro in 1992 was an opportunity for world leaders to assemble and discuss strategies and initiatives that provide for further industrial growth without adverse effects on the environment. The World Summit on Sustainable Development held last year in Johannesburg, South Africa, was an opportunity to evaluate those initiatives implemented over the past 10 years, and to set a new and sustainable direction for the future. It is clear that industrial and technology development will continue at a rapid pace in order to serve the needs of a growing world population, but it is essential that the course of this development is well planned, well executed, and that it is sustainable. In reality, while government officials and politicians continue to debate policy and international protocols, the environment continues to suffer and the effects of climate change and global-warming become more real each day."

The U.S. Bureau of Mines has developed an electrorefining process to recover Ni, Co, Cr, and other metals from mixed and contaminated superalloy scrap. The superalloy scrap is cleaned then directly electrodeposited as a Ni -Co deposit. The process recovers approximately 90 pct of the Ni-Co available from the scrap as a 99t pct pure Ni-Co alloy. During electrorefining the electrolyte undergoes a purification process which results in Cr and other refractory metals reporting to the purification residue. Operating data is given for a 3-L compartmented electrolytic cell. Techniques for the removal of Fe, Cr, and trace impurities from the recycled electrolyte are outlined. The economics of a facility producing 15 mt/d of a Ni-Co alloy are also discussed.

The international theme is particularly appropriate, for in addition to the annual SME session, the Third MMIJ-AIME Joint Meeting will be held.

To analyze zinc vaporization kinetics of zinc smelting slag in the ISP furnace, reduction reaction rate of zinc oxide from ZnO-FeOx-CaO-SiO2 slag system with CO-CO2-Ar gas mixtures has been measured by a therm o-gravim etric apparatus at various ZnO content, Pco, and temperature. The reduction rate was measured under a chemical reaction control in the initial three minutes where surface zinc content can be assumed constant. Through the reaction rate dependency analysis on ZnO contents, Pco and temperature, discussion has been made on its reaction mechanistic information in terms of rate coefficient, adsorption/desorption mechanism and activation energy.

Between cross currents of economic factors and international expediencies the iron and steel industry in 1948 made an outstanding contribution to the general economic picture. Were it not for an unfortunate episode during the month of April involving a temporary shortage of coal, 1948 would have been an all-time record year in output. Exceeded in no previous peacetime year, the production of iron and steel in 1948 totaled some 88,500,000 tons. That it was a worthwhile effort of no small magnitude is evidenced by the fact that in three and one half years following the war, this nation has produced as much steel as in the five years preceding the war. This figure of 88,500,000 tons is 68 per cent greater than that for 1939.
