Before the World War the use of zirconium and its compounds was largely experimental and confined almost wholly to Germany and Austria . Occasionally small lots of zirconium ore had been produced in the United States ( 1,000 pounds in 1869 , 26 tons in 1883 , and 3,000 pounds in 1903 ) and used (with monazite ) in the manufacture of various lighting devices , especially incandescent gas mantles ; but it was not until 1906 that the discovery of the natural zirconium oxide in large quantities near Sao Paulo , Brazil , first gave promise that a zirconium industry eventually might be developed . Edward Rietz , who worked the Brazilian deposits , interested German chemists in extending the use of zirconium , and by 1911 trade journals were listing German firms as manufacturers of compounds or products derived therefrom . For a time zirconia was one of the various oxides used in the Nernst lamp . It was used also for crucibles and hearths as refractory material ; in the manufacture of chemical utensils ; in enamels ; in the place of bismuth subnitrate for defining Röntgenray pictures of the stomach ; as a pigment ; in medicine ; and in a number of other ways . The Germans were credited also with producing a remarkable zirconium steel , which , it was claimed , was much superior to other alloy steels . During the World War the United States Government investigated the possibilities of zirconium , as well as those of other steel -hardening elements , and a large automobile manufacturer actually purchased a substantial quantity of ore with the purpose of employing zirconium in automobile steels . Immediately after the armistice the Government ceased its investigations ; but despite the difficulties experienced by various investigators in reaching concordant results , interest in the use of zirconium as a steel -hardening agent , as well as in other uses of the element and its compounds , continued . In 1918 the Foote Mineral Co. , which had been interested in zirconium for several years , was exploiting the deposit in Brazil formerly worked by the Germans and was supplying zirconia in the form of ore , brick , and cement for refractory and other purposes . About the same time the Electro Metallurgical Co. , which before the entrance of the United States into the war was experimenting with zirconium alloys , supplied in tonnage quantities the demand for these alloys . In 1919 it was reported that American manufacturers , after several years of research, were producing in commercial quantities pure zirconium oxide , which was finding a place in the manufacture of small refractory articles , scorifying dishes , crucibles , tubes , and one- piece furnace linings . In 1920 the lowering of the price of zirconium metal powder ( because of improved metallurgical methods ) promised the production of the metal on a semicommercial scale . In 1924 the Titanium Alloy Manufacturing Co. introduced a new opacifying agent , " Opax , " made from zircon . A year or two later some of the large pottery manufacturers became interested in the use of zirconium oxide as an opacifying agent , the increased production of titanium pigments having resulted in the production of zirconium as a by-product at a price that could compete with tin oxide . In 1928 it was reported that the industrial use of zirconium oxide was increasing steadily in the manufacture of brick , crucibles , and other refractory products , such as high- temperature cements . To those concerned in attaining greater safety to life and incidentally to property in coal mining, the meeting of representatives of the national mine safety research organiza¬ tions of the principal coal-producing countries, which was called by the Safety in Mines Research Board of Great Britain at its experimental station near Buxton, should have deep significance. It is notable, first, because it meant the friendly cooperation of countries not many years ago engaged on either side in the great World War; and second, because of the remarkable degree of agreement in the essential fundamental factors and methods of attaining greater safety in coal mines when it is considered that the questions were approached by different paths and that the applications dealt with widely differing natural conditions and national points of view. Varying views, of course, were held as to the relative importance of certain factors, but the differences were of detail rather than of principle. When the meeting adjourned it was unanimously agreed that such meetings should be continued annually and that the greatest benefit was to be derived by close cooperation in the exchange of data. Belgium, France, Germany, Great Britain, and the United States were represented by one or several members of the respective national research organization. It is of interest to note that this research work in Belgium, France, and Germany is supported directly by na¬ tional organizations of mine operators or owners but placed under a scientist appointed by the respective Government, thus giving the work official standing. In Great Britain the work is carried on by a Government board, consisting of persons connected with the coal¬ mining industry or in mining research, appointed by the Secretary for Mines, to direct the work of research of the Mines Department. It does not, however, come under its inspection service. Its work is supported by a penny-a-ton tax on output of coal. In the United States the mine-safety research work is directly supported by the Federal Government.

Molybdenite is the world’s principal source of rhenium (Re), a critical element in multiple high-tech applications. However, the Re contents in molybdenite vary by orders of magnitude on scales ranging from single grains to whole deposits. In order to better understand the systematics of this variation and what geochemical factors control molybdenite Re concentration, and hence overall Re resources, we examine global patterns in molybdenite Re contents through a compilation of > 3000 measurements of Re in molybdenite from > 700 mainly ore-bearing moderate- to high-temperature hydrothermal systems of different types. Our results are similar to but expand on those of earlier studies. Rhenium concentration in molybdenite has a lognormal distribution and varies systematically with type of geologic system, intrusive lithology, and Mo grade. The lowest-Re molybdenite occurs in greisens (geometric mean 1 ppm ± a multiplicative standard deviation of 9), quartz vein-hosted W-Sn deposits (2 ± 5 ppm), unmineralized granites and granodiorites (12 ± 8 ppm), intrusion-related deposits (24 ± 8 ppm), and porphyry W-Sn deposits (16 ± 11 ppm). Rhenium is most enriched in molybdenites from volcanic sublimates (23,800 ± 5 ppm), with skarn Fe and Au (560 ± 5 ppm and 540 ± 3 ppm respectively) and porphyry Cu and Cu-Au deposits next (470 ± 4 and 430 ± 7 ppm respectively). Among porphyries, skarns, and quartz vein-hosted deposits, Re is most highly concentrated in molybdenites from Cu and Au systems and its concentration decreases systematically through Cu-Mo, Mo, Sn, and W deposits. In nearly all cases, molybdenites from systems associated with intermediate igneous rocks contain more Re than molybdenites from systems of the same type with more felsic rock associations. The disparity between Re contents of molybdenite in felsic and intermediate systems is largest for porphyries, quartz vein-hosted, and skarn deposits and is near zero for subeconomic or barren granite and granodiorite Mo systems; felsic intrusion-related deposits have slightly higher molybdenite Re than their equivalents associated with intermediate intrusions. In most systems, molybdenite Re content does not correlate with metal grade, but may have an inverse correlation with Au grade in intrusion-related deposits (based on a small number of data points) and does exhibit a strong inverse correlation with deposit Mo grade. Dilution of Re through larger amounts (higher deposit grades) of molybdenite explains about 40% of this correlation, but the relative enrichment of Re in molybdenite from low-Mo deposits must also reflect some selective enrichment of Re/Mo in porphyry Cu systems compared to porphyry Mo systems. We found no evidence for secular increase or other systematic temporal variation in molybdenite Re content. The data regarding the use of molybdenite Re content as a proxy for mantle influence are ambiguous. Nearly all observed empirical correlations can be traced back to differences in redox state and sulfide concentration, the two geochemical factors identified here and by previous experimental work as the controlling influences on Re mobility under hydrothermal conditions. Hydrothermal systems with reducing conditions (W- and Sn-rich) tend to have low molybdenite Re even though compiled whole-rock data indicate that their source rocks have as much or more Re as those of more oxidized systems (e.g., Cu-rich). Vapor-phase exsolution, crustal assimilation, and mixing with external fluids may all enrich molybdenite Re concentrations in individual deposits and deposit types, but their extent and importance in overall hydrothermal concentration of Re is uncertain. Thus, it appears that the available molybdenite Re resource in an ore deposit largely depends on how the deposit’s redox and sulfidation conditions have varied over time and space during the timespan of hydrothermal activity. Oxidized, high-sulfide conditions tend to concentrate Re in molybdenite, whereas reducing conditions tend to leave Re dispersed at low concentrations in the bulk rock.

Field evidence for current hypothe e about age and kinematic ignificance of gold-bearing hear zones in the Archean Yellowkni fe greenstone belt is reviewed , and it is concluded that major disagreements between previous workers are a direct result of differences in stratigraphic and tructural in terpretations of the Yellowknife Supergroup. Although goldbearing hear zone appear to be confined to the mafic volcanic pile of the Kam Group. it can be shown that shearing affected all supracru tal rocks, including the Jackson Lake Formation. now con idered to represent the youngest unit of the Yellowknife Supergroup. tructural ob ervations are incompatible with the hypothe is that the hear zones represent loci of ynvolcanic gravity sliding but are consistent with earlier conclu ions that shear zone development commenced with rotation of the volcanic pile and continued as re ult of lateral shortening broadly overlapping with the emplacement of granitoid batholiths. Shear Zones are common throughout the entire green tone belt. yet productive zone are confined to the Yellowknife Bay Formation of the Kam Group and localized where flow abut with a high angle again t the contact of the We tern Plutonic complex. However. no obvious tructural and lithological features have been recognized that are more favorable for gold deposition and distinguish the shear zones and flows of the area around the mines from those of other parts of the greenstone belt. The model that gold wa transported by metamorphic solutions and that hear zones were the firs t-order control for gold deposition provides no explanation for the trong localization of the depo it . As porphyries with elevated gold contents are present in and near ome of the mines. the possibility that gold was deposited from hydrothermal system around fel ic intrusion representing early phases of the Western Plutonic complex should be given erious consideration.

G.M. Philip and D.F. Watson The article cited above reflects the difficulty that is often encountered in interpreting different aspects of kriging. Baafi et al. write : "Due to negative kriging weights, negative block grades may be obtained in some extreme situations, which makes no practical sense." Their solution to this particular problem is to constrain the kriged estimates to data values that have positive weights, i.e., reduce the subset size contributing to the estimation. As Journel (1986, p. 133) has already observed, "Negative weights are no evil." Indeed, they are an ineluctable result of the Lagrangian multipliers in the system of simultaneous equations. The fact that data distant from the estimation point may be given negative weights simply means that the influence of such distant values must be negated because their influence is contradictory to closer values (as illustrated by Baafi et al. in their Figs. 3 and 4). Of course negative kriging weights applied to distant grade values will not in themselves induce negative grade at some central interpolation point. Negative grade values, rather, seem to be a particular artifact of automatic methods of estimation involving accu¬mulations (Philip and Watson, 1985a, 1985b, 1987b). The elimination of negative weights, suggested by Baafi et al., is likely to exacerbate a quite different problem of kriging and piecewise spline interpolation discussed elsewhere (Philip and Watson, 1987a). In interpolating large data sets of scattered observations, changing local subsets or neighborhoods must be selected automatically. Because of the mathematical formulation of kriging and spline interpolation, discontinuities then occur between closely-spaced estimation points as the subset used in the estimation changes. If this subset is reduced in number and size, the discontinuities will be amplified and more common. ? Kim Before replying to the comments by Philip and Watson, it is desirable to establish the original perspective of our paper, which was intended primarily for the practitioners of mining who possess a working knowledge of ordinary kriging. The paper tried to convey the following practical points: (1) there are circumstances in which one observes negative weights, (2) illustration of circumstances under which one can expect negative weights, (3) should one obtain a negative estimated grade, one can resort to elimination of negative weights using the technique outlined in the paper, and (4) one could normally select only the first layer of surrounding assays to estimate the block grade. Under such a perspective, most of the comments by Philip and Watson are irrelevant and misdirected. For example, the practitioners do not find it difficult to "interpret" the results of ordinary kriging, as evidenced by the fact that they have been using the results for nearly a decade. Nor are the practitioners concerned with discontinuities in estimated block grades due to changing neighborhood of assays during kriging. What matters to the practitioners is the fact that kriging does provide the best estimate among all the estimation tools available to them as of today. ?

"Kinross’ Fort Knox Gold mine, near Fairbanks, Alaska has successfully implemented two major metallurgical continuous improvement projects resulting in growth of gold production and an extension of mine life. In 2009, Fort Knox produced 263,153 oz of gold at a cash operating cost of $543/oz. In 2010, approximately 63% of the gold will be produced from the CIP circuit, 15% of the gold from the gravity circuit and 22% of the gold from the heap leach.In 2009, a 44,000 ton per day run-of-mine valley fill heap leach facility was constructed and commissioned as a cost effective treatment option for low grade ores to supplement the higher grade mill. The heap leach facility will produce approximately 100,000 ounces of gold per year under severe winter conditions. Heap leach gold recovery, based on test work shows 30% after a 55-day leach cycle, with long term ultimate gold recovery targeted at 65%. The paper presents the heap leach design concepts and production data.Additionally in 2009, installation of a Knelson gravity concentrator unit (XD70) was completed. This together with an Acacia intense leach reactor (AILR) has increased overall mill gold recovery from 79.3% to 80.7%. A manual shaking table gold recovery operation has been replaced by batch intensive cyanidation of the high grade Knelson concentrates. Increased removal of coarse gold and difficult-to-leach gold species from the grinding circuit, via the gravity circuit, has improved gold leach recovery in the conventional whole-ore tank leach CIP circuit. The paper presents plant operating data, showing the improvements over the old flowsheet.Focus on the metallurgical properties of the high grade and low grade end components of the Fort Knox ore has resulted in significant improvement to gold recovery."

Industrial minerals play a central and dual role in the sustainable development (SD) of natural resources. Over the past decade the mining industry has increasingly focused on sustainably extracting and processing industrial minerals. This trend has been driven by higher energy costs, diminishing water resources and sensitivity towards environmental stewardship. Industrial minerals have been used throughout human history as low cost, naturally occurring, materials. Today they are critical components of recycled packaging, energy efficient building materials, light weight paper coatings, and other products critical to the responsible utilization of global resources. As industrial minerals become more widely used in ?green? products, mining companies have established best practices for the sustainable management of industrial minerals mining and processing. These management practices include reducing energy consumption, minimizing water usage, increasing waste recovery through recycling and process optimization, and maximizing the amount of ore extracted per acre of disturbed land. With the commitment to SD principles, quantitative methods for objectively measuring SD performance have become increasingly important. Measuring sustainability impact is a valuable tool for effectively applying SD principles and for making choices that balance sustainable development against other business objectives. SUSTAINABLE DEVELOPMENT AND MINING Sustainable development is a term that has become a common part of our lexicon; however, it has multiple meanings and interpretations leading to a sometimes confusing and contradictory array of definitions. The absence of a single, precise definition reflects the fact that SD is a broad concept or paradigm that offers guiding principles as opposed to a specific set of criteria or regulations enforceable by government or other oversight agencies. While a principle based conceptual approach allows businesses to broadly apply SD practices that are tailored to their specific situation, it has also led the public to sometimes view voluntary corporate SD programs with a degree of skepticism (Walker and Howard 2002). This is particularly true in the mining industry. One reason for this skepticism is that the relationship between SD and mining is misunderstood and to many, sustainably developing non-renewable mineral resources is a contradiction (Rajaram et al. 2005). However, this view takes a very narrow interpretation of the tenets of SD. The second is that mining carries a legacy of poor environmental stewardship that does not accurately reflect current corporate environmental practices Many minerals companies have adopted the Brundtland Comission?s definition of SD (United Nations 1987): ?? development that meets the needs of the present without compromising the ability of future generations to meet their own needs?. This definition is very broad and can be interpreted in a number of ways. It provides a general context for sustainable development and is not intended to provide detailed guidelines addressing specific aspects of sustainable development. To fill this gap the following SD principles were drafted by the international minerals community in 2003 (ICMM 2003): 1. Implement and maintain ethical business practices and sound systems of corporate governance. 2. Integrate sustainable development considerations within the corporate decision-making process. 3. Uphold fundamental human rights and respect cultures, customs and values in dealings with employees and others who are affected by our activities. 4. Implement risk management strategies based on valid data and sound science. 5. Seek continual improvement of our health and safety performance. 6. Seek continual improvement of our environmental performance. 7. Contribute to conservation of biodiversity and integrated approaches to land use planning. 8. Facilitate and encourage responsible product design, use, re-use, recycling and disposal of our products. 9. Contribute to the social, economic and institutional development of the communities in which we operate. 10. Implement effective and transparent engagement, communication and independently verified reporting arrangements with our stakeholders. These guidelines insure that SD concepts are applied equally across the industry while setting a clear performance standard and benchmark against which to evaluate success. By adopting these principles and issuing the Milos Statement (http://www.sdimi.org/milos_decl_October%206_2003.pdf), which provides a more detailed vision for integrating SD into everyday business operations, the minerals industry has embraced SD as a core corporate value. The unifying and holistic approach embodied in SD principles impacts the entire mine to market life cycle and addresses the economic, environmental and social consequences of mining. INDUSTRIAL MINERALS The world economy relies heavily on minerals; they are essential to economic prosperity and the quality of life. Industrial minerals are non-metallic, non-fuel minerals that provide the raw materials for a vast range of products used in most every aspect of daily life. They are mined and processed worldwide and they span the spectrum from relatively low value, high volume commodities (e.g. common clay, crushed stone) that are usually mined locally to high value, low volume specialty materials that are sourced from unique one of a kind deposits (e.g. barite, talc, mica). High volume commodity mining operations are often located near the end use market which, in most cases, means areas of high population density where construction and other urban activities drive demand. In these situations the strict adherence to SD principles is particularly critical as these are highly visible operations that must meet the public?s demand for good corporate citizenship. These operations are similar to chemical or other manufacturing facilities that operate near population centers. The present final report constitutes the total productivity of a series of contracts from the U.S. Bureau of Mines and the Institute for Telecommunication Sciences over the period 1971-1979. The emphasis on the research has been analytical. In this "executive summary" we give a succinct description of each phase of the investigation. In the first phase of the investigation that was stimulated by the National Academy of Engineering, we concentrated on the analytical studies of techniques relevant to mine rescue. Several specific procedures for locating a buried source were analyzed. In the next, but overlapping phase of the investigation, we dealt with the fundemental character of how electromagnetic waves propagate in mine tunnels. At the outset we allowed for the finite conductivity of the tunnel walls and the presence of axial conductors such as cables, pipes, and tracks. The third phase of the investigation was devoted to the analyses of various specific geophysical engineering problems. The related fourth phase dealt with the general subject of non-destructive testing of wire ropes such as used for mine hoists.

Injury experience in the coal-mining industry was worse in 1965 as both the frequency and severity rates of injuries increased 2 and 6 percent, respectively, over comparable data for 1966 (tables 1-8). The retrogression in the safety record during; 1965 resulted frog the less favorable record at bituminous-coal mines, which more than offset the improved injury experience at anthracite mines. The 259 fatal and 11,138 nonfatal injuries occurred at a rate of 45.77 per million man-hours of exposure and resulted in a severity rate of 8,960 days lost per million man-hours. Although the number of fatalities was the second lowest annual total in the recorded history, it was 17 higher than in 1964. At anthracite operations the total of 6 fatalities in 1965 was the lowest annual figure in statistical history. The annual numbers of nonfatal injuries at ill coal mines and the resulting rates of occurrence have varied little in the past 5 years (table 1). The total days lost from all injuries rose from 2.1.3 million in 19b4 to 2.23 million in 1965 (table 5). Fatal and permanent total injuries, with a standard time charge of 6,000 days each, accounted for 1,650,000 days; Permanent partial injuries, 191,932 clays; and temporary total disabilities, 383,911 days. The severity rate for fatal injuries was 6,241, 8 percent higher than in 1964, and the nonfatal severity rate of 2,718 days lost per million man-hours was 2 percent higher than in the preceding year. The average severity of permanent partial injuries ire; 730, or 48 days fewer per injury than in 1964. The average days lost for each temporary total injury was 36 days in each year.

In order to determine the recovery functions in an oil sand circuit it is necessary to have more than a minimal determination the mass flows in the network. This over-determination is essential in order to allow for measurements within the flow matrix "to flex" according to an error function. It is then possible to identify the flows and composition at all points with maximum likelihood. These so-called full mappings are not easily obtained. However, in order to obtain an unequivocal determination of all the unit operations recoveries such a balance is needed. When databases are constructed exclusively with coherently balanced sets of data it is possible to obtain a maximally accurate process model by maximizing the probability of correctly identifying the process causality. Indeed, it is doubtful in cases of normal complexity that any sense can be made of data that is not so balanced. Coherent mass energy balancing is a tool developed by mineral processing scientists and engineers. Its rigorous application to oil sands is the subject of this paper. The additional element associated with hydrocarbon requires special considerations. It is shown that at least one currently available mineral processing tool will solve the full-mapping problem for an oil sand operation. Experimental design constraints are discussed in this paper relating to the development of databases for the development of effective process models.

NO MORE important question has come before the coal-mining industry in many places, especially in the anthracite region of Pennsylvania, than prevention of stream pollution by mine drainage. Available information on acid mine drainage in the anthracite region of Pennsylvania indicates that a pollution problem must be solved in any program of anthracite mine drainage. The major problem concerns satisfactory disposal of the daily average mine-water discharge of 327,000 gallons per minute (g. p. m.), or 472 million gallons per day (g. p. d.), containing a free-acid load of 431 tons or a total acid load of 934 tons a clay as H2S04. This report indicates the scope of the problem and gives some suggestions concerning its solution.

This report describes a research and development program sponsored by the United State s Bureau of Mines. The purpose of the program was to develop reusable explosion-proof bulkheads for a cross-cut emergency shelter, and to study the implementation of such bulk-heads, and the resulting shelters, as part of an emergency escape plan in a normal coal mining environment. The first part of this report reveals a number of significant conclusions regarding the application of emergency shelters. A study of the cause s of, and the conditions prevailing during a mine emergency indicate s that ideal placement of the shelter s would be midway along developing entries, and at the inter section of butt and main entries. The proper spacing of shelters is based on the travel capability of trapped miners, which is in turn dependent on the height of coal. The life of a given emergency shelter, based on an analysis of the above information, will be anywhere from 6 months to 10 years. Consequently, some shelters are regarded as "temporary?, while others "permanent?.

The value of processed materials of mineral origin was estimated to have exceeded $297 billion in 1991. U.S. raw non fuel minerals production in 1991 was estimated at $30.8 billion, a 5.8% decline from that in 1990. This estimate was based on data for the first quarter of 1991 (in some cases two quarters) for most of the 21 minerals that for many years have accounted for more than 95% of the industry's production value. The value of minerals production has increased in all but 4 of the last 30 years. The metals component of production value has fluctuated much more than the industrial minerals component, reflecting the greater volatility of metal prices. Employment in metal mining rose slightly in 1991, but this gain was more than offset by a decline in employment in industrial mineral mining, resulting in an overall decline of 3.0% to 164,600 workers in 1991. Prices of several major metals declined during 1991, reflecting weakness in the economy, causing some metal mines to shut down or reduce operations.

The U.S Bureau of Mines conducted a five-year mineral resource assessment of the 16.6 million acre Colville Mining District in northern Alaska, which includes part of the National Petroleum Reserve in Alaska. The study was initiated at the request of the Bureau of Land Management, which administers the majority of the region. The study was done in cooperation with the Alaskan Division of Geological and Geophysical Surveys, the U. S. Geological Survey, and the University of Alaska. During fieldwork, 1593 rock, soil, and stream sediment samples were collected and four bulk samples taken for beneficiation studies. A total of 40 mineral occurrences were documented, including 27 which were previously undescribed. No mining has occurred within the district. Mississippian carbonaceous shale and siliceous mudstone contain stratiform exhalative lead-zinc-silver occurrences. Grades average 8.0% combined lead/zinc and 51 gm/mt silver. Upper Devonian to Lower Mississippian sandstones host breccia veins, containing up to 29% combined lead/zinc and 274 gm/mt silver. Mineralized quartzites of similar age have potential for disseminated-type lead-zinc deposits. Samples from Lower Cretaceous mudstone and shale beds up to 6.5 meters thick, contain as much up to 12% manganese. Upper Mississippian carbonaceous shale and limestone beds contain up to 23% phosphate. Stratiform barite deposits hosted by cherts, are up to 27 meters thick with an average specific gravity of 4.16. Vein-type fluorite occurrences are associated with Mississippian limestone. Moderate potential exists for development of zinc -lead-silver, barite, and phosphate deposits.

To demonstrate the feasibility of unwatering ore reserves previously indicated in the virgin Melrose zinc-lead field in Kansas and Oklahoma, the Bureau of Mines .carried through a pumping project on the Park Walton farm in 1943. Due to success of the undertaking, attention was turned to exploration of other indicated ore deposits and promising areas within that part of the field benefited by .the drainage project, By the middle of 1946, four private mining companies were active in the field; and a considerable output of lead and zinc concentrate had been obtained from the new Park Walton mine and mill. The Park Walton Ore deposit was unwatered by installing deep-well pumps in three holes previously drilled by the lessee. Pumping was continued by the Bureau of Mines at a rate of 2,500 to 1,000 g.p.m. for about 6 months; during this time the local static artesian water-level, originally averaging 108 feet below the surface in the old drill holes was lowered to the 316-foot level, which justified beginning the initial shaft sinking and mine developments. In all, about 750,000,000 gallons of water was pumped by the Bureau of Mines at an operating cost averaging $0.024 per 1,000 gallons.

A mining company for a period of 12 years bad been selling its ore to a certain smelting company for the purpose of obtaining a continuous and steady market for its ore and for the purpose on the part of the smelting company of obtaining a continuous and steady supply of ore for smelting; an agreement was entered into by which the mining company agreed to eell and the smelting company agreed to purcshase at ruling prices all the ore produced by the mining company of certain' stated grades, and to this end the mining company agreed to actively operate its mines. It is no longer the rule that a suit will not lie for the specific performance of a contract relating to personal property ; but the question for determination in such a case is whether the complainant has a plain, speedy and adequate and complete remedy at law, and if he has no such remedy, specific performance will be granted. In an action by a smelting company for the specific performance of a contract of sale it appeared that the ore produced by the mining company bad a peculiar value for smelt. i.ng purposes and was not readily obtainable elsewhere, and it would be practically impossible to measure the value for determining the loss the complainant would sustain· if the smelting company were not ,able ,to obtain the ore under the contract. It is comparatively simple for a court of equity to enforce the agreement as it pertains to the normal product of the mine and there is no plausible reason why a court may not require a performance on the part of the mining company where the mining company obligated it:Belf to operate all its mines. There is no delicate or complex condition involved in the production or delivery of the ore 'or in obtaining_ the stipulated prices agreed upon, and there is nothing apparent that will necessitate supervisory· control in requiring performance on the part of the mining company. A decree for specific perfoi:m,ance would require no supervision by the court either for the operation of the mines or for ascertaining and fixing the prices the mining company is to receive for its ore.
