Indonesia holds a significant role in the utilisation of coal resources in the world. Although the number of Indonesian coal resources and reserves do not fall into the world’s top ten, according to 2009 statistics, Indonesia is the seventh largest producer of coal with a production of 256 Mt. More than 80 per cent of this amount is sold in the export market, making Indonesia the world’s second largest coal exporter. Most of the exported coal from Indonesia is used to fulfil the needs of the Pacific market, such as Japan, Taiwan, China, among others. It is also possible to reach the Atlantic market.Along with Indonesia’s development program, until 2025 the Indonesian government has adopted a National Energy Policy that aims to reduce the role of petroleum in electricity generation and replacing it with coal. As a follow-up of the policy, since 2009 PT PLN, the state electricity company has built steam power plants throughout Indonesia as an implementation of the first stage of the Electrical Acceleration Project with a capacity of 10 000 MW. Moving forward, in 2011 PT PLN will also build the second stage of the project with a capacity of 10 000 MW. As a result of the program, the domestic need for coal is expected to increase as much as 44.8 Mt.With the increase in domestic need and decrease in the number of reserves, the Indonesian government has adopted policies to secure the domestic coal supply. A policy that may potentially be adopted by the government is the limiting of coal production, seeing the high rate of increase in Indonesian coal production. The adoption of such a policy will change the distribution map of coal in the Pacific market. Thus, this paper will evaluate the change of coal distribution patterns in the Pacific market along with the increase in Indonesian domestic needs and Indonesian adoption of policies regarding the securing of coal supplies.

This paper is an attempt to place Canadian Precambrian volcanogenic deposits in perspective, by examining and compiling data regarding certain neglected fundamentals of size, grade, value, frequency distribution and spatial density. The discovery roles played by various exploration methods are compared and contrasted, and. using empirical methods, the probabilities of discovery are discussed, combined with the use of an effective 'cost-per-target' program. From these basic observations, realistic exploration judgments may be made. Using similar methodology, this format may be applied to other types of deposits. Precambrian volcanogenic deposits occur in a natural geometric progression in size. They number 110, of which 70% are pre-producers, producers or past-producers. These deposits are bonanzas and generally have a 'net pre-smelter' value of between $43 and $62 per ton. The statistically typical deposit is that which occupies the modal position, has 400,000 tons of ore, a value of $20 million and occurs with a frequency of 40%. A median deposit has 1.4 million tons of ore, a value of $70 million and occurs with a frequency of 15%. An upper-decile deposit ha s 13.3 million tons of ore. a value of $750 million and occurs with a frequency of 6.5%. The major, mid-upper-decile deposits have a minimum of 50 million tons of ore, a value of $3 billion and occur with a frequency of 4%. Five major volcanogenic deposits occur in the Precambrian and account for 54% of production. This contrasts with 55 deposits (all below the median) which account for 3.9% of production.

The CO2 footprints in the production of Mn-ferroalloys and silicon/ferrosilicon are correlated with the fossil carbon consumption. The CO2 emissions may be reduced in the Mn-ferroalloy process by increasing the degree of prereduction and reduction of carbonate materials, while the silicon/ferrosilicon process is optimised based on silicon yield. By changing the fossil reductant into biogenic reductants, the global warming potential will be decreased even more. Even if the reductants are biogenic reductants, there will still be a global warming potential (GWP) in eg the electrode consumption and the CH4 emissions in the charcoal production. To reduce the use of fossil reductants there are also more disruptive technologies like the use of H2 that at least for the silicon production is on a very low technology readiness level (TRL). Using metallothermic processes will reduce the use of carbon but requires carbon neutral metal reductants. Electrowinning can have low CO2 emissions, and the electrowinning of pure Mn is a technology of high TRL. Salt and oxide electrolysis is under investigation for both Mn and Si production however the research is still on a low TRL. The use of CCS/CCU (carbon capture storage/utilisation) is a part of obtaining carbon neutral processes. Last, the energy mix used for these energy demanding processes is discussed.

"The Acheson D-3 Pool was discovered in August 1950, and contains 88 producing oil wells on 40 acre spacing. Initial oil-in-place was 118 million stock tank barrels and initial well potentials averaged 2,000 barrels per day.In early 1956 studies of hydraulic interference between the Acheson and Leduc D-3 Pools were conducted on the Carter Petroleum Reservoir Analyzer. These studies indicated that the natural water drive to Acheson would be incapable of replacing reasonable withdrawal rates over the life of the pool. To avoid shrinkage losses a scheme of pressure maintenance by water• injection was therefore instituted in March 1957.This pressure maintenance scheme is notable because pressure is being effectively maintained by high volume injection through one well located on the flank of the pool. Close control on reservoir behaviour is maintained by regular bottom-hole pres-sure surveys and observation of water cuts on producing wells. No evidence of pressure gradients or channelling of the injected water has been observed to date, and the water-oil contact has remained level over the whole field. It is possible to control the average reservoir pressure within very close limits by varying the rate of fresh water injection.Ultimate recovery estimated from the rise of the oil-water contact and calculated water influx to December 31, 1958, is 335 barrels per acre foot, or a total of 91.4 million barrels from the pool. This compares to 217 barrels Per acre foot or a total of 59.4 million barrels indicated from laboratory test data."

The Bushveld platinum group metal deposits are two distinct, shallow-dipping stratiform tabular orebodies which strike for many hundreds of kilometres. Mining is extensive, with depths ranging from close-to-surface to 2 300 m. The mining method is a variation of planar open stoping. Pillars are widely employed to support the open stopes. In the deeper levels, in-stope pillars are required to fail in a stable manner soon after being cut, and the residual pillar strength is used to stabilize the hanging wall. These pillars are commonly known as crush pillars. Little work has been done in the past to determine pillar peak and residual strengths, and pillars have been designed using experience and formulae developed for other hard-rock mines. This has led to over and undersize pillars with consequential loss of ore, pillar bursts and potential collapses. This paper describes a crush pillar design methodology, and provides design charts. Three mining environments were incorporated in the investigations, which included underground and laboratory measurements, analytical solutions, numerical model sand back analyses. The results of the study are suitable for the areas where the research was carried out, and may also be applied with caution in other similar environments.

With the continued deep drilling of today, increasing numbers of high pressure and high temperature gas-condensate reservoirs are being discovered. Correspondingly, the ranges of properties of gas-condensate reservoir fluids are also being increased. The literature1*'." contains several excellent reviews of the property ranges in presently known condensate reservoirs. When one examines these property ranges, it becomes apparent that the need for reliable data is great if the engineer is to evaluate properly or appraise a gas-condensate reservoir. It is the purpose of this paper to present phase-behavior data that will point out some of the important variables that influence recovery from gas-condensate reservoirs produced by pressure depletion. All these variables may be resolved into two major categories: the hydroc:arbon composition of the reservoir fluid and the physical properties of the reservoir. But the variables which we will consider are those which are usually determined from well tests shortly after discovery and are, consequently, readily available to the engineer. They are as follows: (1) the producing separator gas-stock-tank liquid ratio, (2) stock-tank liquid gravity, and (3) reservoir temperature. Laboratory depletion studies have been performed on several reservoir fluids to illustrate the effect of changes in the cronsidered variables upon ultimate recoveries. The deviation factors, Z, of a series of reservoir fluids were determined experimentally to illustrate their order of magnitude and their effect upon the calculation of in-place reserves existing at high pressurcs and temperatures. The procedures followed in conjunction with the performance of these studies and their associated calculations are illustrated in Fig. 1. For the purpose of this paper, the depletion recoveries are expressed only in terms of pcr cent of initial stock-tank liquid, with the abandonment pressure assumed to be 500 psig. VARIATION OF RECOVERY WITH INITIAL PRODUCING SEPARATOR GAS-STOCK-TANK LIQUID RATIO The producing separator gas-stock-tank liquid ratio has long been one of the principal criteria in assumptions and generalized correlations' used for the estimation of ultimate recovery from gas-condensate reservoirs. Fig. 2 presents a plot of the cumulative recovery of stock-tank liquid at abandonment as a function of the initial producing separator gas-stock-tank liquid ratio. The graphical illustration represents the results of 44 laboratory depletion studies performed on actual gas-condensate fluids. These data are presented not only to illustrate the general trend of ultimate recovery increase with initial producing ratio increase but to emphasize the considerable variation in possible recovery at any given producing ratio. Table 1 presents the properties of two actual reservoir fluids chosen to illustrate the approximate extremities of producing ratios for gas-condensate systems. The fluids designated as A and B exhibited initial producing ratios of 3,400 and 114,000 scf/bbl, respectively. Fig. 3 presents a graphical comparison of the cumulative stock-tank liquid recoveries, calculated from the well-stream compositions and produced volumes for each fluid during depletion. It is to be noted that Fluid A exhibited a recovery of only 16.5 per cent when produced to an assumed abandonment pressure of 500 psig while the corresponding recovery for Fluid B was calculated to be 62.2 per cent. In the absence of values for each influencing parameter and a known relationship of input-output space, novel approaches should be implemented as proxy solutions to mathematically complicated problems. Proxy solutions can be in the form of linear or non-linear multiple regression equations. Predicting the performance of gob gas ventholes is one of these mathematically complicated problems as it is difficult to know the exact relationships between various parameters influencing gob gas venthole (GGV) performance from active and sealed (completed) longwall panels. In this paper, a discussion of the NIOSH-developed software suite for methane control and prediction (MCP) based on an artificial neural network (ANN) is presented. The application of the ANN-based software suite to develop algebraic relationships for gob gas venthole performance prediction in sealed and active longwall panels is sought. Output information obtained from the NIOSH-MCP software as a response to various input parameters were used to create an input-output database for total flow and methane percentage from GGVs operating in active mines during completed and sealed panel situations. Due to the multi-variable nature of the software, outputs generated using the software for various inputs were used to develop analytical equations first using linear and then second using non-linear multivariable regression techniques. The advantage of this method is its ability to better understand the significant parameters of the relationships between the inputs and outputs for gob gas venthole production in active and sealed panels and to be able to predict their performances using relatively simple analytical functions.

"INTRODUCTION In accordance with the outline of investigation described in a previous report 5 of the Bureau of Mines dealing with the use of acrolein for detecting leakage of methyl chloride from unit--type refrigerating systems, the work has been extended to include an investigation of its use in a multiple system, This report gives the results of analysis of samples of the gas from representative units of a multiple system charged with methyl chloride containing approximately 0.9 per cent acrolein by volume, The results furnish a basis for estimating the Warning that would be given in event of leakage. A Peer Review Panel for the Golden Cross Mine in the upperWaitekauri Valley, Coromandel was initiated in December 1989, before mining, as a requirement of the conditions of the Mining Licence and Water Rights. The panel's function is as a technical audit and advisory team - to provide independent technical review of design, construction, and execution of mining operations, slope remediation works, and reclamation/mine closure activities. The primary role of the panel is to act in the public interest by providing assurance to regulating authorities that the design and application of on-site mining operations accords with 'good industry practice'. Panellists are not involved in design nor as advisers, although until 1997 when explicit terms of reference were written, the panellists were a sounding board for some operational proposals. The panel functions to ensure that best mining industry technical standards are met. The costs of the peer review process are met by the mining company. Review of mining operations includes environmental matters such as land rehabilitation and water quality. The focus of this paper is on the process of peer review for environmental management factors rather than for structural and mine engineering.

BALL wear in wet grinding mills has been the subject of considerable discussion in the last few years. Its importance to millmen is obvious in view of the fact that ball wear may cost from 2 to 4¢ per ton of ore for the more fortunate operators and many times this cost when a refractory ore must be reduced to a fine state of comminution. Consequently, any factual information that may be obtained on the nature of ball wear may be applied to introduce changes leading to lower ball consumption and therefore also to lower costs. In 1940, while employed with the Britannia Mining and Smelting Co., Britannia Beach, B.C., I had occasion to investigate factors that might affect ball consumption. We performed a number of tests, which will be briefly described. These tests originated as a result of changing from a 3 1/2-in. ball to a 2-in. ball of different type of manufacture and were motivated by the desire to obtain the best possible type of 2-in. ball. Our testing was helped by the fact that the company operated a one-ton electric furnace, so that it was quite easy to make steel changes. It should be emphasized at the beginning that these tests produced results that in their general application to milling should be interpreted qualitatively rather than quantitatively. As will be evident in the description of the method used in testing, the balls were subjected to an intermittent batch grinding treatment, which may have produced results in rate of steel wear that may not have an accurate correlation with steel consumption in full-scale mill operation. However, with this fixed and rather arbitrary method of testing, results were obtained that may be of some interest and may stimulate further work on this subject. Unfortunately, owing to pressure of war work, our tests, which we had intended to repeat on a continuous grinding operation, had to be discontinued. METHOD OF TESTING Tests were made in a small cylindrical mill, rotating at 72 r.p.m. Internal dimensions of the mill were 10 1/2-in. dia. by 9 in. The cylindrical inner surface was lined with rubber and the two ends were formed by steel plates. A charge of 2000 grams dry feed and 2000 c.c. of water was added every 2 hr., the mill being drained of pulp before the addition of each charge, by tilting and sluicing with water. The mill was run on afternoon and night shift for daily periods of about 15 hr. total grinding time, and each test lasted from 60 to 150 hr. This batch method of testing involved a higher average pulp temperature in the mill, which undoubtedly affected comparative results in some of the tests. HARDNESS OF BALL VS. WEAR In these tests, special "eutectoid" steel balls were used, some of which were chill-cast and quenched, some sand-cast and quenched, and some sand-cast and annealed to a dead soft condition. To demonstrate the feasibility of unwatering ore reserves previously indicated in the virgin Melrose zinc-lead field in Kansas and Oklahoma, the Bureau of Mines .carried through a pumping project on the Park Walton farm in 1943. Due to success of the undertaking, attention was turned to exploration of other indicated ore deposits and promising areas within that part of the field benefited by .the drainage project, By the middle of 1946, four private mining companies were active in the field; and a considerable output of lead and zinc concentrate had been obtained from the new Park Walton mine and mill. The Park Walton Ore deposit was unwatered by installing deep-well pumps in three holes previously drilled by the lessee. Pumping was continued by the Bureau of Mines at a rate of 2,500 to 1,000 g.p.m. for about 6 months; during this time the local static artesian water-level, originally averaging 108 feet below the surface in the old drill holes was lowered to the 316-foot level, which justified beginning the initial shaft sinking and mine developments. In all, about 750,000,000 gallons of water was pumped by the Bureau of Mines at an operating cost averaging $0.024 per 1,000 gallons.

"This paper presents the performance of the flotation circuit of Minera Fresnillo PLC, Mexico. A plant survey was carried out on the lead banks and a size-by-size assay on the samples was conducted. The results indicate that the plant is treating fine particles in the flotation circuit. At least 30% of the particles in the feed are finer than 8 microns and that high amounts of Pb, Au, Ag and insolubles are in this particle size. It was also found that higher percentage of insolubles in the -8 micron particles are recovered in the final concentrate rather than being rejected in the tails. The presence of high amounts of insolubles in the concentrate is an issue of the company. The result of the plant survey provided valuable information for effective reduction of the insolubles in the concentrate and for plant optimization. The work conducted is part of the training of the students involved in a mine placement in the Alban Lynch Student Venture. INTRODUCTION Minera Fresnillo is one of the operating mines and the main contributor to the silver production of Fresnillo PLC group, the world’s leading producer of silver from ore. It is located in the mining district of Zacatecaz, Mexico, approximately 650 kilometers from Mexico City. The major minerals that make up the ore are galena, sphalerite, tetrahedrite, pyrargyrite, proustite, polybasite, pyrite and pyrrhotite. Minera Fresnillo has a capacity to treat 8300 tonnes of ore per day. The plant consists of semi-autogenous mill - ball mill – hydrocyclone circuit for primary grinding followed by silver-lead flotation then zinc flotation circuits. This paper reports the plant audit conducted in the silver-lead flotation circuit (Figure 1) of Minera Fresnillo. The circuit includes rougher, scavenger and two stages of cleaning. The tails from the scavenger goes to the zinc flotation circuit while the second cleaner yields the final silver-lead concentrate. The feed to the circuit has a particle size of 90% finer than 75 microns and generates a concentrate with grade of about 35% Pb, 5700 g/ton Ag, 16 g/ton Au and recoveries of 90% Pb, 90% Ag, 64% Au, respectively. Although the plant achieves their target concentrate grade and recovery, the concentrate also contains significant amount of insoluble materials which is about 18%. These insoluble materials consist of gangue minerals. The plant audit was conducted primarily to determine the possibility of further reducing the amount of insoluble materials present in the silver-lead concentrate."

"Kidd Creek Mines places approximately 10 000 tonnes of consolidated rockfill (CRF) daily. Consolidated rockfill comprises sized aggregate mixed with different ratios and amounts of binders. Consolidated rockfill is employed to simplify subsequent pillar recovery and provide improved passive/active ground support.The consolidated rockfill is designed to sustain not only the gravitational loading of the overlaying fill material, but also to some extent the dynamic loading applied during blasting of the adjacent stopes and/or pillars. This paper describes the steps taken to optimize the pre-sent fill system at Kidd Creek Mines.The emphasis is on four areas which have high saving potential: lower cost alternative binders, structural design, quality control measures, in-situ testing techniques for back analysis. A consolidated rockfill design optimization chart was developed from these investigations."

Kimberlite pipes, as opposed to dykes, sill and secondary deposits, are the primary target for diamond exploration companies because they have simple geometries and can contain large volumes of potentially diamond-bearing ore. Once discovered, important decisions have to be made regarding the sampling of these geological entities to establish the total volume of ore present, and to define the internal geology, which can be complex in nature and controls the distribution of diamond grade. It is essential that as part of this process the uncertainty in constructed geological models are assessed. In this paper the Orapa AK1 kimberlite pipe in Botswana is used as a case study to explore a potential methodology for defining this uncertainty. The uncertainty of the rock volumes of different types can be characterised by a geostatistical approach. Geostatistical simulations, based upon a plausible representation of the geological bodies, provide different possible images of the orebody that can be considered as different realities. By testing different borehole layouts and drilling the orebody virtually on the computer, many different, but equi-probable realisations of the pipes can be produced. It is then possible to estimate the rocksÆ volumes and compare them with the actual ones. A statistical analysis of the relationship between estimation error and the number of boreholes can then be used to optimise the next sampling campaign. The rock volumes are obtained from a two-step simulation process. Firstly, the pipe geometry is simulated by means of introducing variations around the geological block model, by an original method called centre point simulation (CPS), which has been developed for this purpose. Secondly, the internal geology is then simulated within the pipe. The methodology for simulating the internal geological zones has to be adapted to the level of information and to the geological structure itself. The upper portion at Orapa AK1 is filled with sedimentary crater facies. Here plurigaussian simulation techniques can be applied that are adapted to the simulation of sedimentary facies. The central zones of the pipe are typically subvertically-oriented massive volcaniclastic deposits and breccias and the lower regions comprise a complex root zone. CPS is appropriate for these zones.

A Life Cycle Assessment (LCA) of stainless steel production, including that of the nickel, ferronickel, ferrochromium and iron feedstocks was carried out using inventory data derived from the literature. The environmental impact categories considered in the study were Global Warming Potential (GWP), Acidification Potential (AP) and total (or full cycle) energy consumption. The effects of different sources of electricity (black coal, natural gas and hydroelectricity) were also examined in the study. The results of the LCA showed that when ferronickel is used as the nickel source, the total energy consumption for stainless steel production is approximately 50% higher than when nickel metal is used as the nickel source (75 MJ/kg cf. 49 MJ/kg). This result comes about largely because the Fe units in ferronickel have a much higher energy intensity than do the Fe units in pig iron, and the greater the use of the former at the expense of the latter, the greater is the total energy consumption. The results also showed that the production of ferronickel made by far the largest contribution (59%) to the total energy consumption for stainless steel production when this feedstock is used as the nickel source, but when nickel metal is used as the nickel source the contributions of the various stages are more evenly distributed. It was also observed that the electricity consumption of the electric furnaces used in the production of ferronickel, ferrochromium and stainless steel contributed approximately 50% to the total energy consumed in stainless steel production. Given the relatively low efficiencies associated with electrical power generation, significant reductions in the total energy of stainless steel production could be anticipated if more direct use of thermal energy was made in the ferronickel, ferrochromium and/or stainless steel smelting stages, for example by utilising bath smelting processes.

Noise Induced Hearing Loss is the most common occupational disease in the U.S. and of paramount importance in the mining industry. According to data for 2006 from the Mine Safety and Health Administration (MSHA), Continuous Miner operators accounted for 30.2% of underground mining equipment operators with noise doses exceeding the Permissible Exposure Limit (PEL). This figure becomes more significant considering that 49% of the 2006 national underground coal production was extracted using continuous mining methods. Thus, there is a clear need to reduce the sound radiated by Continuous Mining Machines. The first step towards efficient noise control of a Continuous Mining Machine requires identification of the various noise sources under controlled operating conditions. To this end, a 42-microphone phased array was used in conjunction with 4 reference microphones to sample the acoustic field of a machine in the Hemi-anechoic chamber of the Pittsburgh Research Laboratory. These data were processed using a frequency-domain beamforming algorithm to obtain acoustic maps of 5 sides of the machine. The focus of the test was on the conveyor noise since previous studies showed that operation of the conveyor is the most important contributor to the sound radiated by the machine. From the acoustic maps, the following potential areas for noise control were identified, and included: chain-tail-roller interaction, chain flight tip-side board interaction, and chain-upper deck interaction.

Less than 100 years ago the first major federal regulatory agency, the Interstate Commerce Commission was established (in 1887), and since that time literally hundreds of other federal agencies have been created. The regulations set by these agencies tremendously affect the individual citizens of this country as well as U.S. institutions. A few examples of the myriad agencies established include the Food and Drug Administration. (1907), the Bureau of Mines (1910), the Federal Reserve System (1913), the Federal Trade Commission (1914), the Tennessee Valley Authority (1933), the Securities and Exchange Commission (1934), the National Labor Relations Board (1935), the Small Business Administration (1953), the Federal Maritime Commission (1961), the Equal Employment Opportunity Commission (1965), the Farm Credit Administration (1971), etc., etc. Eight years ago, on December 2, 1970, still another federal agency was established by the reorganization plan of President Nixon -- the Environmental Protection Agency (EPA). The Administrator of EPA was given authority to regulate certain activities affecting the environ-ment, which were formerly within the jurisdiction of the Department of Interior, the Department of Health, Education and Welfare, the Federal Radiation Council, the Atomic Energy Commission, the Department of Agriculture, etc. Within weeks after the formation of this Agency, Congress began to enact legislation which would be administered by EPA. Over the last eight years a considerable number of such laws have been passed, a few of which include: the Clean Air Act (1970), the Noise Control Act (1972), the Federal Water Pollution Control Act (1972), the Marine Protection, Research, and Sanctuaries Act (1972), the Federal Insecticide, Fungicide and Rodenticide Act (1973), the Safe Drinking Water Act (1974), the Toxic Substances Control Act (1976), the Resource Conservation and Recovery Act (1976), the Clean Air Act Amendments of 1977, etc. It may be helpful to review, in a summary fashion, the major provisions in some of these statutes, and accompanying regulations, as they relate to water quality control in the mining industry. The Safe Drinking Water Act and the Federal Water Pollution Control Act contain provisions to be examined, as well as the Resource Conservation and Recovery Act and the Toxic Substances Control Act. One other law, the Surface Mining Control and Reclamation Act (1977), is not administered by EPA although it does contain many provisions related to environmental control, and it will also be dis-cussed because of its importance to the mining community.

As the resources sector becomes tougher with rising costs and cyclical metal prices, mining companies need to continue to reduce their costs and do more with less. Many new resource projects fail to come in under or on budget based on Feasibility Studies. Particularly, capital expenditure (CAPEX) proves difficult to achieve for resource projects. A number of resource projects have failed because of aggressive plant CAPEX cost cutting resulting in projects with no surge capacity and are unable to achieve design throughput. In addition, the plants are not operable because of the omissions. In recent times many businesses have also experienced the "costs" of simply implementing aggressive operating "cost cutting” measures as a strategy for solving business performance problems. This paper looks at technology driven, employment related, luxury cuts, department cuts and restructuring cuts. In the past companies used an incremental approach based on the use of past budget information as an integral part of the budget construction process going forward. The use of performance reports and Management Information Systems (MIS) is examined along with the role of continuous improvement in achieving sensible cost cutting.

The midwestern area referred to is the Illinois basin. The coals presently worked are mainly the No. 5 and No. 6 coal seams which vary in thickness from five to eleven feet. Present average of the more important No. 6 id about nine feet. The coal can vary considerably in toughness within the same mine with some coal perhaps rashing very easily and other coal being extremely difficult to cut. Top is generally well laminated shales with some fortunate areas having limestone roof. There are local areas with troublesome top of poorly laminated shales, shale with slickensides and shale intermingled with small partings and traces of coal. The bottoms are generally one to three feet of clay which softens readily on exposure to moisture. The mines are dry although some water is released and collects from rapid penetration of the seam by continuous miners. However, there are locally wet areas. Most of this material refers to mines of the Freeman Coal Mining Corporation. The mining operations written about are underground mines in southern and central Illinois.

Many, if not most, of today's pollution liability claims are related to events ("occurrences") that happened in the past. This fact creates an opportunity to obtain a large amount of insurance coverage at essentially no cost. Furthermore, in many cases, this insurance coverage is readily available. Scenario #1 For some 15 years, an underground gas tank has had a slow leak. The leak has now been discovered because the gas has contaminated nearby wells. As a result, an expensive $1 million cleanup is required. In addition, a liability suit has been filed for damages due to the contamination of nearby wells. Consequently, legal expenses are being incurred. Are all of these actual and potential costs insured? Obviously, if you have a pollution liability policy in place, the above costs will probably be insured. I say probably because business liability policies are not uniform. But, what if you don't have a pollution liability policy and what if your current general liability policy excludes all pollution liability (as most of them do today)? Under these circumstances, it first appears there is no insurance for this $1 million cleanup and liability suit. But this is probably not the case. You may well have insurance coverage, and you may well have much more insurance coverage than you ever expected. And, the insurance that I'm referring to is already in place. You simply need to find it and learn how to use this insurance - I'm referring to your old policies. In many cases, old liability insurance policies provide coverage for claims made today, because these policies were written on an "occurrence" basis of coverage. In fact, most still are written this way. This means that the insurance policy covers bodily injury or property damage liabilities (as defined in the policy) arising out of' "occurrences" or accidents that happen during the policy period regardless of' when the claim for damages is made. Therefore, for insurance purposes, the key question is: when did the "occurrence" take place? If someone falls and breaks a leg, that is clearly an "occurrence." The broken leg occurrence is, therefore, insured by the liability policy that was in existence at the time of the fall - regardless of when the claim or suit is filed, if ever. However, the answer to this question is seldom an easy one when you are looking at a pollution claim. In our scenario, the tank had a slow leak over 15 years, but property damage was not discovered until now. The question of when the "occurrence" (as defined in the insurance policy) took place has been litigated and continues to be litigated in many courts across the country. But, most often the answer has been that, for insurance purposes, the "occurrence" is the entire period that the tank was leaking (15 years), even though the contamination to the water was not discovered until 1987. This means that the person or company that is insured can potentially use all of its general liability policies (if they are "occurrence" policies, and most were), which were purchased during the 15 years from 1972 until 1987. And, these policies will potentially insure all of the claims and related exposures that arise out of this leaky underground gas tank. Scenario #2 In our first scenario, the claims and expenses were insured by past general liability policies because the claims arose out of events in the past, which, in turn, caused damage. Let's look at another example. In this scenario, Company XYZ has received a request to help clean up a landfill site because 10 years ago, XYZ dumped some toxic substances at the site, which was totally legal at the time. XYZ has not dumped anything at the site since this time. Nevertheless, XYZ is now being required to contribute $2 million to the cleanup of this site. In this scenario, if you had purchased "occurrence" general liability policies 10 years ago, these 1977 policies would (potentially) apply to the current $2 million cleanup claim. And, the reason is that the "occurrence" leading to the 1987 claim took place in 1977.
