3.2-1. Introduction. Much has appeared in the technical literature on theory of sampling (18, 37), weight of sample required in relation to particle size (28), probability of error in sampling (3), and statistical analysis of sample data (20). Each industry, whether it be copper, iron ore, or coal, has its own standards and methods. All of the rather extensive theoretical treatments appearing in published literature on sampling apply to material already on hand such as coal, iron ore, or copper concentrates in rail cars, or in moving streams such as on conveyor belts. The attempt usually is to apply statistical techniques in order to improve reliability and precision in sampling, and to reduce differences between the analyses of seller and buyer. In contrast to this type of sampling, very little has appeared in the literature on sampling a virgin deposit from the metallurgical point of view. Perhaps it would he more descriptive to designate this point of view as "Gm-metallurgical," since geology is inextricably interwoven with metallurgy in gaining an understanding of the complexities of a deposit, eventually leading to a definition of mineable reserves, with the development of a flowsheet and engineering criteria for the planning of a successful and profitable operation. The degree of cooperation between these two departments often determines whether the processing plant is a success at the inception of operations, or whether expensive changes and modifications must he made, with the plant finally reaching rated capacity at some later date. The first concern of the metallurgical department should be to establish proper accreditation of the samples which will be used in any ore-testing campaign. It should he made mandatory, as part of operating management policy, for the responsible metallurgist to he aware of the significance of the samples and to become intimately knowledgeable in all aspects of metallurgical behavior and response to treatment of all varieties of ore in the deposit under consideration.

Many methods for the determination of gold or silver, or both, in cyanide solutions have been published, which with care in manipulation, and modification in some cases, will give results that are satisfactory. It is possible to classify or group these methods as follows: 1. Evaporating the solution in a porcelain or agate-ware dish containing litharge,l or in a "boat" made of lead foil. 2. Forming a lead sponge containing the precious metals by means of zinc shavings,2 zinc dust,3 or a piece of aluminum.4 3. Decomposing the cyanide solution with an acid and precipitating the precious metals by the use of one or a combination of some of the following: Copper sulphate,5 sodium sulphite,6 hydrogen sulphide,' cement copper.ll 4. Precipitating the silver by zinc dust held in a Gooch crucible and determination with a standard solution of sulphocyanate.9 5. Electrolysis.l0 . 6. Colorimetry.ll

La permanente exposición y concentración de polvo en la zona minera, han sido materia de múltiples enfermedades mortales para el personal que labora en ella. Tal ese así que el polvo de sílice libre es la causa fundamental de la alteración pulmonar llamada silicosis. Por tal motivo, el objetivo del trabajo revisa las propiedades de los polvos, los medios para detectarlos, indemnizaciones y los sistemas eliminadores de los mismos. En cuanto al sistema de producción, el polvo se extiende a través de laventilación, humedad, cargas eléctricas, entre otros, influenciando en el muestreo cuantitativo y en la creación de un método cualitativo de estudio, para complementarlo.Asimismo, se determina que el desarrollo de la silicosis se relaciona en el cuarzo como causa principal de dicha anomalía, aumentando el peligro de infección y la capacidad pulmonar. Para contrarrestar dicha enfermedad se busca soluciones alternativas como el uso del agua, aceita, una ventilación adecuada, los buenos hábitos en el trabajo, la floculación, el método porofliáctico de aluminio, concluyendo que el Hematocímetro es el más exacto y práctico de los anteriormente usados, dado su costo como su requerimento de instrumental menos complicado.

Burst-prone conditions are a significant hazard in deep hardrock mines, elevating the risk to excavation stability and, more importantly, to worker safety. As mining progresses deeper, induced stress changes may trigger the initiation of rock failure processes which can be detected and recorded as mine seismicity. The implementation of seismic monitoring and routine seismic data analyses enables mine seismicity to be quantified spatially, temporally and on scale. The ability to quantify and characterize mine seismicity offers the opportunity to gauge seismic hazard, identifying high risk zones for mitigation against burst-prone excavation failure. Over the last decade, the Mines Technical Services (MTS) group at Vale Canada Limited’s Garson Mine assessed seismic hazard with the objective of assigning practical mitigating controls to zones identified as having a high rockburst potential. Initially, seismic hazard was computed using the Seismic Excavation Hazard Mapping (SEHM) software developed by the Mining Innovation Rehabilitation and Applied Research Corporation (MIRARCO) at Laurentian University, Canada. More recently, Vale Sudbury Operations partnered with the Australian Centre for Geomechanics and the University of Western Australia’s mXrap consortium. Through the consortium partnership, MTS at Garson Mine implemented the mXrap seismic data analyses platform, including the grid-based seismic hazard assessment tool. Building on 10 years of seismic hazard assessment experience at Vale Garson Mine, this paper summarizes a comprehensive case study, comparing the two tools (SHEM and mXrap) used at Garson Mine to assess, quantify, and represent seismic hazard. Subsequently, results of the Garson Mine comparative seismic hazard study will be discussed, emphasizing the need for an all-inclusive hazard assessment tool, focused on delivering practical mitigating controls that further enhance the overall safety of seismically active underground mines.

The milling of silver ores has arrived at a great degree of perfection in the mining districts of our Western States and Territories, and I hare thought the record of the practical results obtained at the present time, in a few of the principal districts, would prove of value arid interest to many of our members, both at home and abroad. An American silver mill is composed, in descending order from where the ore is dumped, of: 1st. A rock-breaker, usually of the Blake or Alden pattern; 2d. The battery of stamps, the number of which varies from 5 to 120, generally in batteries of 5 or 10 heads, so arranged that a single battery may stand while the others are running; 3d. The tanks where the crushed ore settles (if it is a met stamping-mill), or of a drying-floor if the crushing is done dry; 4th. Amalgamating pans ; 5th. Settling pans ; 6th. Agitators or pans in which mercury escaping in the tailings is caught; 7th. Blanket sluices, over which the tailings run, and where mercury and unamalgamated sulplides are saved. A reference to the engravings (see plate), which show one of the latest forms of an 80stamp silver-mill run by a turbine water-wheel, will show clearly the arrangement of the several parts. THE ONTARIO, UTAH, SILVER MILL. One of the best examples of a silver-mill, and at the same time one of the most successful concerns in the West, is the mill of the Ontario Silver Mining Company, near Salt Lake, in Utah. This mill treats the ore from the Ontario mine, ore which at present is very base, being composed of zinc, lead, and silver sulphides and silver chloride in a quartz gangue. This ore has become baser as the mine attained greater depth, though the vein holds its own, or rather increases, both in thickness and richness. Geotechnical investigations for the Mid-City Extension of the Los Angeles Metro revealed high concentrations of toxic hydrogen sulfide (H2S) gas as well as methane. Testing techniques employed to determine the extent of gasses, and to identify potential treatment measures, included gas sampling with cone penetrometers and soil-gas extraction with air injection testing. A gas reservoir model was developed to predict inflows into excavations. Other studies included a hazard evaluation and a general data search for other H2S occurrences and geologic conditions that could facilitate the accumulation of H2S. The paper describes the investigations and proposed design and construction alternatives.

The current most common method of hydrogen production for fuel cell systems, including SOFC systems, is autothermal reforming. Autothermal reformers have a number of advantages including fast start up and load following and ease of control. However, there are a number of problems inherent with the addition of air into a system connected to the anode feed such as dilution of the fuel with nitrogen and the potential for oxygen to reach the anode chamber directly. Pure steam reforming, which does not involve air addition, provides a richer fuel mixture to the SOFC anode and is inherently safer than autothermal reforming. Although in theory pure steam reforming can be shown to provide these advantages, a number of technical problems need to be overcome before such a system can be practical. In particular, issues such as catalyst degradation due to poisoning and thermal sintering, coking, as well as fuel-steam mixing need to be addressed. Experimental results from a prototype reformer will be presented to illustrate a number of these points. This paper will compare differences in system efficiency, safety and complexity between autothermal/SOFC systems versus a steam reformer/SOFC system. A system simulation will be utilized that is able to account for material and energy balances for a SOFC power generator operating on diesel fuel. The requirements for improved catalysts will be discussed and an analysis of the potential benefits of sulfur tolerance and lower temperature activity will be considered.

THE heats of formation at 273°K of the compounds InBi, In2Bi, and TIBi2 have been determined by metal solution calorimetry with bismuth as solvent. The published information on the thermody-namic properties of these compounds is limited. The structure of the compound InBi (mp, 383°K) is tetragonal of the PbO (B10) type.1 The compounds In2Bi (mp, 362°K) and TIBi2 (mp of highest-melting composition, 486°K) are now believed to have structures of the NizIn (B8) type273 and not the A1B2 (C32) structures reported earlier.4, 5 The compounds In2Bi and TIBi2 have limited homogeneity ranges at room temperature, while the compound InBi has no detectable homogeneity range.' Samples of the compounds were prepared from 99.99 pet Bi (Mallinckrodt Chemical Works), 99.999 pet in (American Smelting and Refining Co.), and 99.99 pet Tl (Amend Drug and Chemical Co.) by melting the components in sealed, evacuated Vycor tubes. The compounds InBi and in2Bi were of the stoichiometric compositions. The compound TIBi2 contained 40 pet T1; this composition was chosen because at room temperature the alloy of stoichiometric composition does not lie within the homogeneity range.' The melts were held approximately 50°C above the liquidus for 8 hr and then quenched into iced brine. The samples were homogenized for 48 hr at temperatures 20°C below the temperature of complete solidification. Metallographic examination of sections taken from the center and the ends of the ingots did not reveal second phases or segregation . The heats of formation were determined as the difference in the heat effects on solution of a compound and of a mechanical mixture of its components added from the reference temperature of 273°K to liquid bismuth at 623°K. The details of the calori-metric procedure and method of calculation have been described elsewhere? The calorimeter was calibrated by adding bismuth at 273°K to the bismuth bath at 623°K. The calculated values of the heats of formation of the compounds, listed in Table I, are based on a value of 4.96 keal per g-atom for the difference between the heat contents of bismuth at 273" and 623oK7 No published values are available for the heats of formation of the compounds InBi and In2Bi. Hultgren et a1.7 have calculated a value of -0.50 i 0.10 keal per g-atom for the heat of formation at 423°K of the compound TIBi2 containing 40 at. pet T1 from heat-content measurements in the range from 398" to 700°K and the heats of formation of the liquid alloy. The difference between this value and the value of -0.66 * 0.01 keal per g-atom at 273°K is too large to be attributed to a difference between the heat capacities of the compound and the components over the temperature range 273o to 423oK7 However, the direct determination of the heat of formation by a calorimetric method should give a more accurate value. The heats of formation at 273°K of the compounds InBi and In2Bi lie on a straight line when plotted as a function of composition, Fig. 1. The compound In2Bi, therefore, appears to be barely stable with respect to its neighboring phases. In order for the free energy vs composition curve to be concave towards the composition axis, the entropy change on formation of In2Bi must be more positive than that on formation of InBi. As the compounds are ordered,2, 3, 8 there is no configurational entropy change on formation. The difference between the entropy changes on formation of the two compounds, therefore, is probably associated with the vibrational entropies. In view of the low heats of formation, the changes in vibrational entropy, due to changes in bond strength on formation of the two compounds, are likely to be small. Owing to the volume contractions on formation of the two compounds,5 the vibrational entropies probably decrease slightly but the decrease of the vibrational entropy of InBi is expected to be larger than that of In2Bi.

"Arsenic contained in minerals sulphides such as enargite and tennantite can represent not only a significant penalty element in base metals production, but also a disadvantage to the environment through producing the toxic emissions to the atmosphere. The achieving separation of arsenic bearing minerals either at an early stage in floatation or from the floatation concentration is significantly beneficial to the economic. However, there was no feasible commercial method of separation at the flotation stage because of its similar flotation properties with many other copper sulphides. In this work, the selective floatation of enargite from copper sulphide concentrate containing maily covllite, chalcoctie, bornite and enargite was investigated. A low arsenic concentrate with As 0.2%, Cu 22% and a high arsenic bulk concentrate with As 7.65%,Cu 33.65% were obtained. It was indicated that Ca(ClO)2 is the effective depressor and the optimum floatation condition was obtained. Most enargite could be floated at pH 11 and controlling the pulp potential at 290 mV SHE. Furthermore, the arsenic removal from the high arsenic bulk concentrate by hydrometallurgy methods was study. The results showed that the reaction temperature and the concentrations of NaOH were the most important variables affecting the rate of arsenic removal. A low arsenic concentrate with As 0.24%, Cu 37.80% was obtained in the optimum leaching condition.INTRODUCTIONArsenic is mainly produced as a by-product of base metals smelting, in particular copper concentrate. China has imposed an upper limit of 0.50% arsenic for concentrates entering (Long et al., 2012). Arsenic amount of copper concentrate within 0.40% has also been imposed in China, and above which will be introduced about 50 RMB penalties per ton for each 0.10% increasing by smelters now. Therefore, it is necessary to remove arsenic from the copper concentrate.In copper concentrate, arsenic is mainly in the form of arsenopyrite (FeAsS), enargite (Cu3AsS4) or tennantite (Cu12As4S13). There are two types of arsenic in the separation of copper and arsenic: arsenopyrite and arsenic bearing copper mineral. It is easier to separate arsenopyrite from the copper sulphide by flotation in comparsion with the separation of enargite or tennantite from non-arsenic copper minerals (Pineda et al., 2015). The main difficulty in the separation of arsenic copper mineral from non-arsenic copper sulphides is their extremely similar floatability, which depends on the fact that tennantite and enargite contain high copper content (Pineda et al., 2015)."

"The DIOS process has been developed for eight years since 1988. The research project was started with the element studies carried out by each of the five integrated steel making companies in Japan, the final two and half years were spent for the pilot plant studies. Operation were conducted in the entirely closed and pressurized system successfully as planned. From the result, the DIOS process was proved to be viable as a future iron-making process substitutable for the conventional blast furnace. In addition, a lot of findings were obtained. Hot metal productivity was primarily determined by a oxygen flow rate, and a coal consumption varied depending on the productivity. The post combustion ratio was a little lower than expected from the result of the element study. It was supposed to relate the gas-reforming with coal or volatile matter in the free space of the furnace. Hot metal carbon content seemed to depend on the char content in slag.INTRODUCTIONThe JISF's DIOS pilot plant (DIOS=Direct Iron Ore Smelting Reduction Process) has finished its last campaign of the operations in January 1996. The project was started in 1988 as a joint research of the Center for Coal Utilization, Japan and the Japan Iron and Steel Federation (JISF) with a subsidy for promoting coal productions and utilization technologies from the Agency of National Resources and Energy, the Ministry of International Trade and Industry(MITI). Throughout the pilot plant test, a total of over 20,000 tons of hot metal was produced for more than 2,000 hours of the operation. Recorded production rate was 538 ton/day for 3 days at a specific coal consumption of approx. 1,000kg/hmt. Long-term operation was carried out in the fifth campaign for 18 days, which has proved that the entirely closed and pressurized DIOS process works well as planned. In Figure 1 is shown the representative operational performance obtained in the first five campaigns. The project is going to be finished by the end of March this year after investigating the technical viability and economic potential of the process, and completing the conceptual design of the DIOS commercial plant. In this paper, the system and facilities of the DIOS process are first introduced and some of the results of the pilot plant test are detailed later."

It was with humility that I accepted the invitation of the Board of Directors of our Institute to deliver the Twentieth Howe Memorial Lecture. Many previous lecturers could speak from personal experience of the great work done by Professor Howe. It was not my privilege to be one of his students but, indirectly, I came under the influence of his work many years ago. My mentor in Metallurgy at Carnegie Institute of Technology, Prof. Fred Crab tree, was an ardent admirer of Professor Howe and his work. Professor Crabtree taught me early to appreciate Professor Howe's love of truth and keen desire to find a scientific reason for every metallurgical phenomenon. In this early search, Professor Howe encountered many unexplainable facts. Nevertheless, in the classic text, "The Metallurgy of Steel," published in 1891, he indicated that he believed Research could light the way. Under the heading of "The Treachery of Steel" he said: "In the early use of Bessemer and Open Hearth Steel, many then unexplained and hence mysterious failures occurred. With our present knowledge, an easy explanation of most of them would probably have been seen. But even today certain unexplained and apparently inexpli- cable failures occur in steel; inexplicable in spite of full and intelligent investigation." Then Professor Howe continued to talk about "the trustworthiness of steel" in the following manner: First, the steel-maker has learned by experience. He knows today far better the effects of a high percentage of carbon or of phosphorus; of cracks, pipes and blow-holes; of segregation and imperfect mixing; of over-heating; of finishing too hot or too cold. Knowing, he guards against them more effectually, and keeps at home much steel that he would formerly have sent into the market. Those who would not, or could not learn and do, have been driven out of the business; the conditions necessary for producing good sound steel by the acid Bessemer and the acid Open Hearth processes have been mastered. By and by, the basic process came along with new conditions, new liabilities to unsoundness, a great hue and cry about mysterious fractures followed, and Lloyd's register provisionally forbade the use of basic steel. Much basic steel was irregular and brittle throughout; too much carbon, too much phosphorus, too cold teemings—imperfect mixing. Still there was little doubt that, with further experience, these difficulties of the basic process would be mastered as those of the acid process had been. This shows that Professor Howe could not take anything for granted. Believing that careful research would find the answer to all mysterious phenomena, he was several generations ahead of the practical acceptance and adoption of this principle.

For many years line-of-sight (LOS) issues for underground mobile equipment is a growing focus of research. This research is a result of the numerous fatalities and injuries which occur in the mining industry and which are related to poor operator LOS. Three assessment methods are currently used to assess operator LOS of underground mobile equipment. The light filament (LF) method is a hands-on assessment method that is performed in the field. This method is not evaluated in this paper. The laser scan (LS) method of assessing equipment is a quick and reliable method that comes from the need to evaluate vehicles already located in the field. The computer simulation (CS) method can assess LOS issues using a computer aided drawing (CAD) model, which is useful for assessing current or prototype models. The purpose of the current research is to compare and validate different operator LOS assessment methods. Comparison of the results of the LS and CS visibility plots yielded similar quantifiable results. A visual comparison of the results further illustrate that the LS and CS methods are acceptable assessment tools for mobile equipment operator LOS evaluation. The visibility assessment methods are now being prepared as guidelines for the mining industry to assess current and potential designs.

O desempenho balístico de compósitos de matriz de poliéster reforçados com tecido de juta foi avaliado como segunda camada em um sistema de blindagem multicamadas (MAS – Multilayered Armor Systems). Diferentes frações volumétricas de tecido de juta, até 30% vol., foram misturadas com poliéster ortoftálica para se fabricar as placas compósitas. Estes compósitos foram ligados a uma camada cerâmica de alumina dianteira e seguidos por uma placa metálica de liga de alumínio como terceira camada do MAS, os testes balísticos foram conduzidos usando munição comercial de alta velocidade de 7,62 mm. A profundidade de penetração causada pela bala em um bloco de plastilina, que simula o corpo humano, foi usada para avaliar o desempenho balístico do MAS de acordo com o padrão internacional. Os materiais fraturados após testes foram analisados por microscopia eletrônica de varredura (MEV). Os resultados indicaram que os compósitos de tecido de juta apresentam um desempenho semelhante ao do tecido de aramida comercialmente utilizado como segunda camada para MAS com mesma espessura, o Kevlar™. O mecanismo que explica este comportamento balístico semelhante, bem como as vantagens econômicas comparativas dos compósitos de tecido de juta foram discutidos.

Stage open stope mining (SOSM) maintains the stability of excavation openings by leaving a large number of rib pillars. Affected by the strong unloading due to stage mining and the low width-to-height (w/h) ratio of the pillars remaining, largescale destabilization disasters of rib pillars or excavation openings easily occur when the distribution of ground stress or the size of rib pillars is unreasonable. In view of these problems, a physical SOSM model test was carried out based on an underground metal mine in Chifeng City, China, revealing the deformation and failure characteristics of the SOSM pillar group by overloading. The physical model test results of SOSM and room-and-pillar mining (RPM) with a weak pillar were compared, and the failure process of the SOSM pillar group showed the characteristics of rapid and severe damage. The strength difference between a weak pillar and the adjacent pillars enhanced the stress rebalancing effect and extended the failure process of the pillar group. Similar to the SOSM pillar group with a low w/h ratio, some high-strength pillars can be used to avoid large-scale destabilization disasters caused by the synchronous failure of pillars.

Gold-bearing quartz veins and replacement chalcopyrite deposits are the two important types of metallic mineral deposits of the east central Manitoba mining district. The gold-bearing veins occur along Manigotagan valley, northwest for 25 miles from Beresford lake, and the copper deposits along Oiseau valley, between Oiseau lake and the east end of Lac du Bonnet. Lithium-bearing minerals of possible commercial value have recently been discovered in pegmatite along Winnipeg river about 10 miles east of Point du Bois. There are also prospect pits with showings of galena, sphalerite, cobaltite, pentlandite, nickeliferous pyrrhotite, arsenopyrite, pyrite, molybdenite, cassiterite, and other minerals, but the various occurrences of these minerals, as exposed, are small. The bedrock and mineral deposits of this mining district are Precambrian and resemble in many respects the formations and mip.eral occurrences of western and northern Ontario. Although prospectors visited eastern Manitoba at intervals during the last fifty years, effective prospecting did not begin until 1913 or 1914, and not until 1923 were skilfully directed, systematic explorations undertaken. It is true, that between 1913 and 1923 considerable sums were expended in a number of attempts at mining and milling the gold-quartz ore, but these enterprises failed partly through poor management or attempts to develop veins that were too small or too low-grade to be worked at a profit under the existing conditions of transportation and power supply.

"Carbon dioxide has been used for extinguishing electrical fires of many kinds (1, 3, 4) 3/ and more recently has been applied to some extent in fighting coal-mine fires (5). This report is concerned with the possibility of an electric current being conducted from a live power source, such as a trolley wire, across the impinging spray of carbon dioxide gas, to a metallic discharge nozzle, and then being grounded through the body of the person holding or touching the container. Rose and. Skinner (5) have described a case in which a fall of roof coal had brought down the trolley without creating a dead shot. The current was conducted in part through the loose coal to the rail, causing ignition of the coal. The fire was successfully extinguished with carbon dioxide.Dielectric data on pure carbon dioxide gas and liquid have been reported by Quinn and Jones (2). For the gas, the dielectric constants range from 1.00971 (35°C., 10 atmospheres) to 1.3072 (70°C., 151 atmospheres); for the liquid, 1.6016 (0°C., 50 atmospheres). Compared with the dielectric constant of air (1.0006, 1 atmosphere), these data, indicate that carbon dioxide in both gaseous and liquid forms is a very poor conductor of electricity, of the same order as air. 4/"

The ventilation of metal mines is becoming more of a fundamental requirement than it was 10 or even 5 years ago. There are many reasons for this, and in general they are based on economy or efficiency rather than health or safety, yet the latter enters into the picture in at least some instances. One Montana metal mine which had installed mine fans and a general ventilating system shut down the fan when there was a period of cessation of work; within a few weeks it was found that the underground timbers were becoming so covered with fungus that the fans were put into operation and thereafter continued in operation whether the mine was worked or not. The fungus soon disappeared and the cost of operating the fans was held to be far less than would be the numerous losses from timber decay which quickly started when cessation of air flow was encountered. A large iron ore mine in Michigan had much difficulty in holding men in a slicing region due to foul air under certain surface conditions as to direction of wind. Upon the placing of a moderate sized fan on the surface with some doors, stoppings and regulators underground, not only was the bad air condition removed but there was found to be a decided increase of tonnage per man per shift and timber decay was retarded to a very considerable extent. This particular mining company was rather inclined to be angry when I called attention to some of the what I considered very bad working conditions underground, and the mine superintendent for about a year and a half was on anything but friendly terms with me. Later on when the effect of the placing of the fan was found (the fan had been placed over his protest), that, man came through very nicely with a letter and congratulated me on the recommendation made and congratulated himself and the company on the conditions obtained after the installation of the fan. INTRODUCTION Landowners in Texas for many years have freely granted, reserved and leased "oil, gas and other minerals" or interests therein. In recent years we have witnessed much litigation concerning what sub- stances should be included as "other minerals" within the phrase "oil, gas and other minerals," and this question has received the attention of numerous legal scholars. At the South Texas Uranium Seminar held in Corpus Christi, Texas, in September, 1978, Mr. William R. Dodson presented a paper dealing with this very subject and entitled "Uranium - Mineral or Surface? Who Owns It?" In his paper, Mr. Dodson reported on two recent Texas Supreme Court decisions, Acker v. a, 464 S.W.2d 348 (Tex. 1971) and Reed v. Wylie, 554 S.W.2d 169 (Tex. 1977). which held that the particular substance in question in each case is not a mineral within the phrase "oil, gas and other minerals" if substantial quantities of the substance lie so near the surface that production will entail the stripping away and substantial destruction of the surface. Since that time another chapter has been written in the Texas saga of "When is a Mineral not a Mineral?" and it is the intent of this paper to present an update of the Texas law. A review of the early Texas cases so ably covered by Mr. Dodson in his paper will not be repeated, except as is necessary to illustrate the evolution of the legal doc- trine which has been so aptly named "The Surface Destruction Test". BACKGROUND In order to appreciate the genesis of the problem, one must consider that oil and gas production commenced in Texas many years ago, Spindletop came in in 1901. As oil and gas became more valuable, land- owners with considerable frequency sold interest in the oil, gas and mineral estates in their lands, and reserved interest in the oil, gas and mineral estates in their lands when they disposed of their property. Due to the oil and gas background, and perhaps be- cause oil and gas was paramount in the minds of the parties, the traditional language employed in these grants and reservations was "oil, gas and other minerals" or variations thereof. There are literally hundreds of instruments employing this language constituting a link in the chains of title to thous- ands of acres of Texas land. In addition, there are thousands of acres of Texas land held by oil, gas and mineral leases, the primary terms of which have been perpetuated by production, containing similar language in their granting clauses. The severance of the mineral estate from the surface estate results in two separate and distinct estates, each having all of the incidents and attributes of an estate in land. with the surface estate being the serviant estate, and the mineral estate being the dominant estate and having certain easements in the surface estate to explore. produce and remove the minerals. Harris v. Currie. 176 S.W.2d 302, 305 (Tex. 1943). As observed by the court in the Harris case, this is because a grant or reservation of minerals would be wholly worthless if the grantee or reservor co~lld rwt enter upon the land in order to explore for and extract the minerals granted or reserved. Although the Texas law has recognized that an oil and gas lessee has the right to use so much of the surface as is reasonably necessary to produce the minerals. Warren Petroleum Corporation v. Monzingo, 304 S.W.2d 362, 363 (Tex. 1957), recent decisions of the Court have qualified this doctrine. In Getty Oil Company v. Jones. 470 S.W.2d 618 (Tex. 1971). Getty's pumpine, units were interfering with ones self-propelled sprinkler system utilized for irrigating the premises, and Jones sought to require Getty to install the-pumping units in cellars so that the sprinkler system could pass over them. In an effort to accommodate both the surface estate and the mineral estate, the court held (page 622) "...where there is an existing use by the surface owner which would otherwise be precluded or impaired, and where under the established practices in the industry there are alternatives available to the lessee whereby the minerals can be recovered, the rules of reasonable usage of the surface may require the adoption of an alternative by the lessee". Bearing in mind that the "reasonable use doctrine" grew up in the oil and gas industry involving sub- stances which can be produced by methods that do not destroy or deplete the surface estate, the question presented is whether the Texas courts will extend this doctrine to situations where claimants of "other minerals" seek to produce shallow deposits of iron ore, coal, lignite and uranium by surface mining methods which do destroy or deplete the surface estate? The surface destruction test has answered this question in the negative, at least as to iron. coal and lignite. However, the multitude of mineral estates in Texas which have been created by a grant. reservation or lease of "oil, gas and other minerals" will, doubtlessly, continue to fuel the fires of litigation.
