AN ACT prescribing the mode of maintaining and defending possessory actions on lands belonging to the United States. The People, etc. SEC. 1. Any person now occupying and settled upon, or who may hereafter occupy and settle upon any of the public lands belonging to the United States, unoccupied, except upon lands containing mines of any of the precious metals, may commence and maintain any action for interference with, or injuries done to his possession of said land, against any person or persons so interfering with or injuring such land or such possession. SEC. 2. On the trial of any such cause, the possession or possessory right of the plaintiff shall be considered as extending to the boundaries embraced by the claim of such plaintiff, so as to enable him to have and maintain any action as aforesaid, without being compelled to prove an actual inclosure; provided, that such "claim" shall not exceed in any case one hundred and sixty acres of land. SEC. 3. Every such claim, to entitle the holder to maintain any action as aforesaid, shall be marked out, so that the boundaries thereof may be readily traced, and the extent of such "claim" easily known, and no person shall be entitled to maintain any such action for possession of, or injury to, any claim, unless he occupy the same, or shall have made improvements thereon to the value of $100. SEC. 4. A neglect to occupy or cultivate such "claim," for the period of three months, shall be considered such an abandonment as to preclude the claimant from maintaining any action as hereinbefore mentioned. Sec. 5. Any person or persons claiming the right of possession to land under this act shall have the right to defend said possession and the claim thereto, and all the rights and privileges given them by this act.

OIL AND GAS AS MINERALS. Oil and gas within the ground are minerals and the fact that they have attributes not common to other minerals because of their fugitive nature or vagrant habit, and the disposition to percolate, and the possibility of their escape from beneath one part of the surface to another, does not remove them from the class of minerals. Texas Co. v. Daugherty (Texas), 176 Southwestern, 717, p. 719, May, 1915. OWNERSHIP OF TAILINGS-ABANDONMENT. A corporation engaged in milling- and the reduction of ores deposited the tailings therefrom upon a portion of its own land lying in a gulch through which water flows at times in great volumes and with great force' and notwithstanding all reasonable efforts by dams and otherwise to retain its tailings, the tailings eventually were forced upon the lands of an adjoining owner; these tailings were valuable and their retreatment, intended by the mill owner, profitable; and the fact that the tailings were so washed down upon the lands of the adjoining owner and permitted to accumulate and remain for some considerable time is not sufficient to show an abandonment on the part of the owner of the tailings, where it is clear that the owner had no intention of so doing, but on the contrary, always intended to conserve and retreat the tailings.

With the ever-increasing demand for energy in all forms, electrical energy generated from geothermal resources could become an important energy source in the next few decades. Geothermal fluids, which contain appreciable quantities of dissolved salts and gases, are generally corrosive to materials of construction. Since data on corrosion of materials in geothermal brines is limited, the literature was surveyed through February 1972 to obtain a compilation of information on corrosion resistance of aluminum and its alloys, copper and copper-base alloys, carbon steel and cast iron, stainless steels, chromium-iron alloys, nickel-and cobalt-base alloys, and titanium in heated brines including sea water.

CONSTRUCTION OF STATUTE-SALE BY ENTRYMAN. The timber and stone act (20 Stat., 89) does not forbid an entryman from alienating his interest in his claim; but the act makes illegal any prior agreement by which the entryman acts for another in the purchase. A grantee of a mine who agrees to pay the grantor's debts in part payment of the purchase price of the mines becomes to that extent the principal debtor, and the grantor becomes the surety, and the grantor's creditor may in equity enforce his claim against the grantee of the mine, and the grantor in such a case is not a necessary party. A cotentant in exclusive possession' of mining property who extracts and sells ore is entitled to charge against the proceeds of the sale the reasonable and necessary expense of its extraction and marketing, as in such case the cotenant is not a trespasser.

The Bureau of Mines is responsible for a broad spectrum of programs for meeting the diverse and changing mineral resource needs of the Nation. These programs are managed by the Director and two Deputy Directors, who formulate general policy and program direction from the Washington, D.C., headquarters. A senior advisory staff, consisting of the Chief Staff Officer, Chief Scientist, and Chief Mining Engineer, provides advice and consultation to the Director on a wide range of scientific and technical matters and acts on behalf of the Director to maintain liaisons with other government agencies, mineral industries, and professional societies. Bureau program activities are classified into two major functions: (1) Developing new and improved technology that will make the production and processing of minerals more efficient, safer and more healthful for mineral workers and the public, and more compatible with a quality environment.

The first major evaluation of the nation's raw materials prospects after World War II was completed by the President's Materials Policy Commission (Paley Commission) in 1952 and submitted to the President in June of that year, as a five-volume study entitled Resources for Freedom. The bulk of the report was devoted to an analysis of the past, present, and probable future of the Nation's mineral supply industries. The Commission's evaluation of the future situation regarding minerals was derived from its forecasts of the probable domestic demand for the major minerals in the 1970's. This demand analysis was made in the context of probable worldwide demand. Several crucial assumptions were made by the Commission's fore-casters. It was assumed in 1950 that the next 20 to 30 years would see no major wars and be a period of sustained economic growth. Another assumption was that the anticipated demand for raw materials must be supplied at essentially no increase in real cost in order to avoid crucial supply problems. The Commission's forecasts were derived within the context of the country's expected future rate of economic activity. The gross national product (GNP) growth to 1975 was derived from projections of the number of people in the labor force, hours of work, and an index of probable production measured per unit of labor input. It was believed labor hours would decrease and labor productivity would increase. The result was a forecast GNP growth rate of 3 percent.

BURYING DEAD MINERS. BURYING BODIES OF DEAD MINERS. REVISED STATUTES (HURD) 1874, P. 263. SEC. 22. LIABILITY OF RAILROADS, ETC., FOR BURIAL EXPENSES.-When any railroad company, stage or any steamboat, propeller, or other vessel engaged in whole or in part in carrying passengers for hire, brings the dead body of any person into this State, or any person dies upon any railroad car or in such stage, steamboat, propeller or other vessel in this State, or any person is killed by cars, or machinery of any railroad company or by accident thereto or by accident to or upon any such stage, steamboat, propeller, or other vessel, or by accident to or in or about any mine, mill or manufactory,* the company or person owning or operating such cars, inachinery, stage, steamboat, propeller, or other vessel, mine, mill or manufactory shall be liable to pay the expenses of the coroner's inquest upon and burial of the deceased and the same may be recovered in the name of the County in any court of competent Jurisdiction. NOTE--The original Act of February 15, 1855 (Laws 1855, p. 170), makes no reference to the dead bodies of persons killed" by accident to, in or about any mine."

ABSTRACT Electricity production by the Electricity Supply Commission of South Africa (Eskom) is the most important beneficiation process for South African coal. As one of the world’s lowest cost producers, energy-intensive industries such as ferroalloys and aluminium were introduced. However the poor were neglected. The white paper on energy policy (Department of Minerals and Energy, 1998) sought to redress this. Also, chasing economic growth to generate jobs resulted in high electricity demand and interruptions. Lifespan estimates of South African coal reserves based upon peak theory vary widely. Approaching peak, coal production in the future will be more expensive and, thus, contribute to more expensive electricity, which could inhibit industrial development unless South Africans work smarter.

The availability and reliability of large grinding mills and their Gearless Mill Drives (GMDs) are of paramount importance for the grinding process. Although GMDs have been in service for decades, and are known for their operational efficiency (reliability and robustness with reduced operating cost per ton), compared to conventional drives, in the last decade due to certain reasons some failures led to serious unscheduled shutdowns and significant insurance events. The majority of these notable "insured" failures have happened on GMDs installed on relatively large mills, as the financial impact of a failure is proportional to the through-put of the mill. Despite the occurrences of these events, as mining operations are driven by lower ore grades and the ability to continue reducing operating costs per ton, the trend for having larger mills is still very present and there is no reason why this trend should not continue. It is obvious that if not handled correctly, the possibility of large value GMD loss events, coupled with the continuing increase in mill size or required availability and reliability targets, could potentially lead to major conflicts as it becomes difficult for the insurance companies to judge the risk and hence may result in hesitation to insure these grinding circuits. This paper will not only describe the conflicting situation from both an insurer's perspective and from an equipment supplier's perspective, but also how these conflicting challenges can be successfully mastered. It has to be noted that not only the mining companies themselves, but also their insurance companies and the involved equipment suppliers have a common interest: to reach the highest availability and reliability in order to avoid or at least minimize unscheduled shut down times, and most importantly prevent unplanned events that result in extended production stoppages or reductions in through-put of GMD driven mills. From the very beginning onwards, the complete service concept together with emergency plans must be integrated on every level in the design of the grinding circuit. This approach must be implemented continuously and without compromises by all involved parties during all following stages, such as basic design, detail design, manufacturing, quality inspection and testing, packing, transportation, storage, installation, commissioning, operation and maintenance. The concept of formal risk analysis related to mill operations, maintenance and spare parts strategies must be an integral part of mining companies? decisions related to the selection for installation and continued use of large mills powered by GMDs. The service concept in place for operating mills shall also have a clear focus on very early detection of any abnormalities, so that the risk can be mitigated and unscheduled shutdown times avoided. However, if a major failure occurs, then procedures and tools shall already be available in order to ensure that production impact is minimized.

In 1970, the U. S. Bureau of Mines contracted with Theodore Barry and Associates, a management consulting firm, to perform a one-year industrial engineering study of working-face hazards in underground bituminous coal mines. The field data was accumulated from industrial engineering observations in fifty underground mines. Supporting data for the analysis was derived primarily from the Bureau's fatal accident reports for the years 1966 through 1970. This report, Industrial Engineering Study of Hazards Associated with Underground Coal Mine Production, consists of three main parts: 1) The Fatal Accident Reports Analysis, 2) The Industrial Engineering Analysis, and 3) Multiflow Process Charts and Standard Time Data. The Fatal Accident Reports Analysis (Volume I, Section II) is based upon individual USBM fatal accident reports for 1966-1970. These were read, coded and computerized in terms of 84 significant variables. Cross-tabulations of these variables have been used to identify major underground hazards and to quantify significant causal factors. A very strong relationship was found to exist between fatal accident occurrences and low task experience. This led to a recommendation for formalized training, certification and supervision programs for miners. Victim compliance with federal regulations, mine regulations and supervisor instructions was analyzed, indicating that supervisors provide the most crucial communication link to workers. Thus, every attempt should be made to ensure the competence of immediate supervisors in the industry. Analysis of roof fall variables revealed a fatal propensity on the part of the miners to work under unsupported roof or under support conditions that are marginal. The technical approach to the problem is to make it physically impossible for a miner to work under these conditions; the behavioral approach is to ensure adequate training and develop proper safety attitudes among the miners. The Fatal Accident Reports Analysis revealed a need for normalizing data to interpret the results more accurately.

Mine drainage and mine reclamation are topics of major interest to the mining industry, federal and local governments, and the general public. This publication and its companion three volumes are the proceedings of a conference held in Pittsburgh, Pennsylvania, April 24-29, 1994. There were twelve sessions (69 papers) that dealt with mine drainage, including modeling, geochemistry, prediction, treatment, control strategies, characterization, hydrology, and case studies. These sessions comprise volumes 1 and 2. The six sessions (34 papers) that dealt with reclamation and revegetation of disturbed lands are included in volume 3. Volume 4 includes the six sessions (34 papers) that dealt with such topical issues as fires at abandoned mine sites, subsidence, hydrology, mine wastes, and policy. Poster session presentations are represented by 49 papers and 92 abstracts that have been placed in the back of volumes 2, 3, and 4, consistent with the subject of that volume.

This Bureau of Mines report is an expansion and update of Information Circular 8719 and comprises maps and tables listing the name, location, and other pertinent data concerning certain fuel-related projects. The maps show the locations of the planned or proposed facilities. The tables include information on projects involving the proposed or planned development of fuel resources, as well as the development of storage, transportation, and conversion facilities. The report covers the 24 States west of the Mississippi River including Alaska and Hawaii. Of the 808 projects for which information is provided, 219 concern coal mines, 246 concern electric generating plants, and 115 concern uranium mines; Energy Supply and Environmental Coordination Act coal conversion notices are also included. Because of the dynamic nature of the energy industry, many uncertainties exist and some of the listed projects may never become realities. Also, no attempt has been made to determine the degree of certainty or viability of each project.

Fire hazards can cause severe and irrecoverable damage to reinforced concrete (RC) tunnel linings, threatening the serviceability and resilience of transportation networks. This paper first examines the existing methodologies that are used to classify damage to tunnel linings from fire. These approaches are then supplemented with the results of advanced modeling and inputs from industry experts to propose new fire damage/ repair classifications with the associated thresholds. The results of the presented research can be used to guide fire risk assessment as well as the performance-based design of tunnel fire protection.

If a conductor traversed by an electric current is broken, a conduction forms in the air between the two broken ends of the wire. This conduction manifests itself in an initial phase by an electric spark and, in a second phase, by an arc if the the circuit continues to supply sufficient power. This arc goes out when the distance between the two ends of the conductor becomes sufficiently large. If the break occurs in an explosive atmosphere, the energy contributed by the arc can cause an explosion. To avoid such accidents, electric circuits that may be utilized in hazardous atmospheres can be made "intrinsically safe". The investigation which we conducted is part of a research project on the intrinsic safety of arcs of high intensity but short duration, in the case of resistive circuits. We developed an electronic system which makes it possible to limit the duration of an arc at the level of the break of a conductor traversed by a current with a possible maximum intensity of 80 amperes. This experimental device for monitoring and measuring the parameters of the arc has shown that arcs of high intensity but with a duration limited to a few microseconds do not ignite an explosive methane-air mixture.

For the last decade, we have read about the great technical innovation that is coming to the mining industry that will increase safety and productivity. There is consensus that it will be a technical innovation that will produce a step change in mining costs and outputs (as opposed to bigger machines or less people); however, this innovation (while freely available) has not taken hold in the industry. While there are a few mines that have embraced technology, the majority of underground mines simply do not have the expertise or technical capability to implement innovation and automation.With unexploited mineral deposits becoming deeper and more remote, and thus more hazardous to mine, telepresence offers the ability to remotely execute production tasks while separating personnel from hazards. As the technologies required to deliver telepresence mature, the potential for there to be no personnel underground during production activities is becoming a reality (the ‘dark factory’). So significant is the capacity of telepresence to mitigate risk, it is proposed that it be included as a separate entry in the hierarchy of hazard mitigation controls.Technical innovation such as the optimised short-term interval control of the production process and the automation of underground mobile fleets offer significant increases in production along with lower operating costs. This paper explores the most critical components for the successful implementation of technology in underground mining; redundant, robust and high-bandwidth communications networks to carry data from distributed networks of smart sensors and to convey teleoperation commands; and high-definition video to provide operators with detailed, real-time data. The days of analogue ‘leaky feeder’ as a base case for communications are over. The human resources required to support the expected wave of innovation are significant and will be difficult to maintain in remote areas as the same skills and expertise are in demand in other industries.The paper highlights barriers to innovation in the mining industry, and a lack of technical and scientific expertise within the industry to be able to identify, implement and manage technologies that can increase safety and productivity. As well, an over-reliance on basic net present value (NPV) financial analysis that is used in the industry punishes investment in technology (capital expenditure; CAPEX) and accepts higher operating expenditure (OPEX) due to the discounting of future savings in operating costs.CITATION:Cronin, J, 2017. The deep ocean mining industry is in a pre-commercialization stage of development. In the context of a proper legal/regulatory regime, deep ocean mining system design, site survey, and operation technologies are capable of rapid evolution. The report recommends that the regulatory framework develop in parallel with the industry and presents a rationale for implementing this approach. The Government has several interests in deep ocean mining technology: (1) as a potential regulator, sound regulations should be based on an understanding of the technology; (2) as a potential monitor, survey technologies are relevant; and (3) as an estimator of strategic minerals supplies, it is important to understand the technology which allows economic access to deep ocean minerals. Thus, the major portion of the report presents an in-depth review of systems design, operations, and survey equipment and techniques.

In the opinion of these authors, technology alone can never give an organization an edge over competitors or provide an industry step change. However, history has shown that technology applied with correct logistics and strategy makes a significant difference. Never has the minerals industry faced such daunting challenges and been in such need of a step change. Application of autonomous systems has been steadily increasing in the minerals industry. Automation technology has changed the mining value chain from exploration to mineral processing and refining. The future state will only see additional in-roads of automation into more processes and the whole system design. To better understand the near-future potential of automation, it is useful to explore and review the current state of automation in minerals development. A review of the state of automation research is given. The review will consider three critical areas: automation technology, system’s engineering and management processes around automation, and the role of human factors engineering in automated and semi-automated systems. The review ends with a discussion on the social and political risks of automation in terms of shared value and sustainable development.
