In this time of market globalization, many industrial companies are including detailed arbitration clauses in their international contracts, in order to avoid the potential costs, delays, and uncertainties of litigation in foreign courts. Arbitration is less expensive and more flexible, procedurally, than court proceedings, and arbitral awards enjoy much greater international recognition than judgments of national courts. More than 134 countries have signed the 1958 United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards, known as the "New York Convention", which facilitates the enforcement of arbitral awards internationally. There are several other similar arbitration conventions that provide for the enforcement of cross-border arbitral awards. Additionally, arbitral awards are not subject to appeal, whereas judgments of national courts are routinely subjected to a lengthy appeals process, and there are very few viable bases to challenge arbitral awards. This discussion will review key considerations in drafting arbitration clauses, including choice of law and choice of forum considerations; issues surrounding the selection of arbitrators; the discovery process; presentation of evidence; and enforcement of arbitral awards.

The Greymouth Coalfield contains New Zealand's greatest known resource of bituminous rank coal. The coals are of very high quality, with low ash and sulphur contents and a range of other properties that makes them desirable for a wide range of uses. In fact only a few producers around the world today can offer coals with such exceptional properties. This suggests that Greymouth coal has potential as a premium export trading commodity. These assertions have been largely confirmed by a comprehensive exploration drilling programme funded by Mines Division û Ministry of Energy between 1979 and 1984. The program, forming part of the NZ Coal Resources Survey, was carried out under contract by Lime and Marble Ltd. The drilling of 49 deep, predominantly cored, holes at 1000 m intervals over the coalfield has generated a vast amount of data. It has shown the existence of three major potentially minable coal deposits containing 233 x 106, 33 x 106 and 15 x 106 tonnes of coal in ground. Investigations have at this stage only identified targets and these estimates represent 'in ground' resources, not recoverable reserves. Recent geological studies as well as past and present mining have clearly highlighted the problems posed by the complexity of the coalfield geology. The coalfield lies within a mobile zone in the earth's crust known as the Paporoa Tectonic Zone, which has been active from at least mid-Cretaceous to the present time. Currently this factor poses the greatest obstacle to the determination of mining possibility of the, defined deposit and ultimately will strongly influence any future mining development. The Greymouth Coalfield has, however, had a long and eventful mining history spanning the last 120 years, where 32.5 x 106 tonnes of coal has been won from over 100 mines. In spite of the problems facing development, the large quantities and exceptional quality of the remaining coal will act as a strong inducement to persevere with this difficult but potentially valuable resource.

ISOLATED alloys of copper and silicon were prepared and examined by chemical methods more than one hundred years ago, but it was not until the work of Rudolfi1 that the equilibrium relations. were studied. During the recovery of copper, nickel, zinc, and lead from their sulfide ores, large amounts of sulfur dioxide are generated. A fraction of this gas is captured and transformed into sulfuric acid and liquid SOl and the remainder is emitted to the atmosphere. Numerous proposals were made to solve this problem. Hydrometallurgy offers the only valid solution by which elemental sulfur instead of sulfur dioxide can be produced. Sulfur can be easily stored, transported long distances, or transformed into S02 and H2S04 when desired.

SINCE the installation at Kropfmuehl, Bavaria, of a modern flotation concentrator in 1938, the flake and fine graphite from the Passau area can now be delivered in about any normal specified carbon content of any size range up to a flake averaging about 0.7 mm. The graphite finds a wide German and export market for crucible manufacture, pencil leads, dry cells and other uses.

Mining engineering, metallurgy and minerals-related geology have proud traditions and are essential professions to support a safe and sustainable minerals industry. However, the future of these professions is under threat. The courses that produce such graduates are disappearing worldwide and the number of graduates available to enter the industry has been falling in English speaking countries for at least a decade. It is unlikely that this problem will be remedied by æsupply and demandÆ. Instead, some active intervention is required.

With a price slowly rising above US$35 per ounce gold became a mineral worthy of prospecting and mining endeavour in the early to mid 1970s. Fortune therefore appeared to smile onNew Zealand with its favourable geological environment for gold and past record of major gold production from both hard rock and placer deposits. This was a particularly welcome development as the post war years, including both the base metal exploration boom of 1967/1971 (which produced major nickel, iron and bauxite mines in Australia) and the earlier period of uranium exploration failed to produce any mines in New Zealand with the exception of the small Tui Mine and iron sand mining. Whilst hard rock mining now appears imminent it is 15 years further along the track since the 1967/1971 exploration boom and eight years since the upsurge in prospecting for gold in 1978. New Zealand still has no hard rock base or precious metal mining. This is not for want of proven or potential gold mining situations for these clearly exist at Waihi, Monowai Reef, Golden Cross, MacRaes Flat and elsewhere.

The Hauraki goldfield is located east of Auckland in the North Island of New Zealand. It includes Great Barrier Island, the Coromandel Peninsula and the Coromandel and Kaimai Ranges as far south as the town of Te Aroha and south east to Te Puke. It has a total north-south extent of about 180 km and an area of 3000 km2. The goldfield is the most productive in New Zealand, and while production at present is negligible, the area has undergone continuous exploration over the last seven years.

In the past two years recent increases in silver prices over levels that prevailed for many years have changed supply/demand patterns. On the supply side, a silver mining boom is in progress in the United States and elsewhere. On the demand side, traditional uses of silver by individuals are dropping while industry is conserving. These changes will alter the supply/demand balance and bring about more moderate rises in silver prices, which in turn will impact the mining industry.

Mechanical mining is steadily gaining in usage in the mining industry. A variety of machines are now being used, including tunnel boring machines, roadheaders, continuous miners, surface miners and augers. These machines have advantages compared to drill-and-blast mining methods, including increased safety, lower cost, uniform muck size and accurately sized openings. A century of experience with mechanical methods has paid dividends to the coal industry. Current trends guarantee eventual development of true general-purpose hard-rock mechanical mining machines. When several significant challenges have been met, mechanical miners will become integrated mining systems and will determine the design of mines.

In recent years the trend in copper smelting has been to expand existing smelters to increase their throughput. New smelters under consideration are large, typically in excess of 200,000 tons per year of copper. Despite this trend to larger smelters there are a number of conditions where a much smaller smelter can be economically viable. This paper examines these conditions and outlines the process concepts for a small smelter treating from 20,000 to 100,000 tons per year of copper.

The rush for alternate iron-units in the last few years spurred a true outbreak of new alternate iron units projects many of them incorporating new process in what can be classified as the.most fruitful and innovative technology outburst, in the steel industry, in decades In a recent paper we focused on what would be, in our opinion, the ultimate targets of the use of alternate iron-units by mini-mills: 1. to improve quality, 2. to reduce cost, 3. to increase plant productivity, and 4. to improve `supplyability'. With these objectives in mind liquid hot-metal, among all possible scrap substitutes, has been proven to be by far the best. This conclusion stems from many different authors who have reviewed the `value in use' of hot-metal against other alternate iron units and measured its impact on steel-shop productivity and cost (Figure 1).

Aluminium industry has an increasing interest in the diminution of the energy consumption of the Hall-Heroult process by the reduction of the anode bottom covering with gas. Electrically isolating carbon-dioxide bubbles, produced at the anode, increase the ohmic resistance of the cell. As the gas production rate is determined by the applied current density, anode covering can be decreased only by a faster evacuation of the gas from the inter-electrode space. Among others, the inclination and curvature of the anode bottom promotes the release of the bubbles and thus decreases the mean value of the covering. Indeed, anode, insert in the molten cryolite bath has a square shape with horizontal bottom. However, inhomogeneous anode consumption, electro-erosion, bath circulation and the inclination of the bath-metal interface modify this shape gradually during electrolysis. Anode bottoms become inclined with rounded comers. This concentrates the gas generation to the center zone of the anode. As the bubble layer cannot be observed directly because of the hostile environment and the opacity of the bath, real scale air-water systems are used to study the impact of the anode geometry on the anode covering and the bubble induced flow. However, the physical properties of such a system are different than that we can found in the real cells. A simulator using the Lagrangian description of the bubble layer has been built and presented in earlier papers. This tool was used to investigate the effect of the anode inclination on gas covering and bath velocity, for both C02-cryolite and air-water system. Results obtained for the second system were compared to experimental data .

AT the request of the Council of the Institute, I have the honor to submit the following remarks upon the Program of Tests under which the current work of the Watertown Arsenal Testing Laboratory is carried on, which comprises, among other items, the tests of steel ingot metal and derivative shapes. The intended scope of the tests may be illustrated by extracts from the descriptive part of the program as submitted by the Laboratory under date of April 17, 1907, and subsequently approved by the Chief of Ordnance, U. S. A. Under Item 1, Ingot Metal-Open hearth, acid and basic; Bessemer, acid and basic; crucible; fluid compressed and uncompressed-descriptive remarks were made as follows ; " A thorough, fundamental inquiry into the physical properties of steel necessarily begins with the ingot metal. Investigations, having for their object the improvement of steels, should also begin with the ingot. A knowledge of the ingot structure is essential for judging of the subsequent behavior or appearance of the metal. Under ordinary conditions, so little information is obtained from the ingot in individual cases that practically none of importance is acquired. These remarks have particular reference to the state of physical and structural soundness of the steel. Questions of chemical composition, segregation, piping and the grosser cavities have frequently been given attention. Defects of continuity of structure, which manifest themselves in the working; of the metal, and at the final stages cause distrust in the finished forging, have generally been neglected. ? The discovery of iron-manganese ores on the surface of underwater mountains was made more than a half century ago. During this time the basic ideas about the thermodynamics of the processes of hydrochemical reactions in the sea water have been developed by scientists and are revealed in geochemical and mineralogical differences between the deposits from the seamounts and the nodules of the sea bottom. The distribution of the dissolved metals, oxygen, carbonic acid and organic matter in the overlying ocean waters of seamounts in the deep ocean to depths more than 5,000 m has been studied in some detail (e.g. J.R. Hein, P. Halbach. G.B. Baturin, Ye.M., S.I. Andreev, L.I. Anikeyeva, [1-6]). In recent years scientists from YUZMORGEOLOGY have completed detailed geological survey work on the Magellan Seamounts in the Pacific Ocean. The results of drilling the ore body and geophysical and photo surveys have also been described [4]. Previous ideas about the general covering of seamount surfaces with iron-manganese crusts have been changed based on ground-truth surveys. This study examines the complex concentric-zone or spotty arrangement of the most densely covered sections, the strong dependence of the thickness of crust on the geomorphologic features, and the potential influence of the underlying substratum. One established geochemical heterogeneity in the composition of ores, also frequently inversely proportional power dependence on directions was observed. The development of a numerical model of the formation of the ore crust on the seamounts is currently a high priority.
