Tax Notes discusses/our cases that could affect the taxation 0/ operations and investment in the mining sector.Capital Gain or Income?Ever since tax reform, risk-takers in the exploration business have maintained that the taxation of capital gain s is a significant impediment to raising risk capital. It must be akin to rubbing salt in the wound, then, when an entrepreneur sells shares and the Court upholds Revenue Ca nada taxing the gain as ordinary income instead of capital gain. But, this is precisely what happened in the case of The Estate of Murray Watts, et al. v. The Queen.The issue that had to be decided by the Federal Court, Tri al Division, in this case was whether or not the profit from the sale of shares in Hearne Coppermine Exploration s Limited in 1968 was a capital gain, or income subject to tax.Hearne was incorporated in July, 1967. At that time, the three plaintiff s, together with seven other individuals, subscribed for 400,000 shares at 10 a share. The plaintiff subsequently subscribed for an additional 500,000 shares at $1.A pooling agreement was entered into by all ten shareholders regulating the disposition of any o f their shares; any sale required approval of seven of the ten initial sub scribers. It also provided for the sale of their shares 30 days after any public offering."

The construction of the Pennsylvania Station in Manhattan, the Beaux-Arts masterpiece, was completed in 1910. In financial ruin, the Pennsylvania Railroad Company sold the station in the 1960?s and the new Madison Square Garden and the Penn Plaza complex were constructed at the site. The demolition of Pennsylvania Station brought public awareness and outcry to protect historic structures and the Landmarks Preservation Commission (LPC) was subsequently established in 1965. In the 1960?s relatively little engineering data was available on the performance of historic structures during adjacent construction and thus, no published criteria were established by the LPC on allowable movements and vibrations. During the late 1970?s a commercial tower was planned adjacent to the landmark Fraunces Tavern Block (FTB) in lower Manhattan. Through negotiations between the LPC and the developer, Dr. M. I. Esrig and the author were retained to monitor the historic block during foundation construction. The monitoring data and building performance compiled from the project formed the basis of the published 1981 ASCE technical paper by Esrig and Ciancia entitled ?The Avoidance of Damage to Historic Structures Resulting from Adjacent Construction?. Based on the ASCE paper, the NYC Department of Buildings adopted Technical Policy and Procedure Notice #10/88 entitled ?Procedures for the Avoidance of Damage to Historic Structures Resulting from Adjacent Construction When Subject to Controlled Inspection by Section 27-724 and for Any Existing Structure Designated by the Commissioner?, June 1988. This paper describes the author?s recent experience during the installation of deep foundations within, or adjacent to, three Manhattan landmark structures. Discussions are provided on the foundation construction, monitoring programs and performances of the three structures.

The top size of particles in the flotation of potash ores, which can be as large as 4 mm, exceeds by far the top size in other flotation plants. It is then understandable that while long chain amines are used in the flotation of fine fractions (below 0.8 mm) of potash ores the coarse particle flotation also requires an extender oil. While new and very promising fluidized-bed flotation machines (e.g. HydroFloat) constitute a significant development in the flotation of coarse particles, in the area of extender oils, as reviewed in 2007 by Strathdee, Gotts and McEachern, there have been no new developments to replace the industry standard asphaltene-based carcinogenic extenders. This situation first of all results from the experimental problems that arise when water-soluble minerals like sylvite are to be tested in saturated brine. Both oils and longchain amines are water/brine insoluble. The oil with the amine dissolved in it can however be emulsified and then used as an extender oil. Such oil droplets must wet KCl particles and the emulsion must be stable to avoid handling problems. In this paper we test the use of the phase inversion technique as a method of studying wettability of KCl particles by the oil in saturated brine, and the effect of amine dissolved in this oil on the wettability. The results show that this relatively simple technique can be used to characterize the wettability of fine KCl particles by the tested oil and to determine the effect of added amine on it, and so it can be useful in selecting proper extender oils.

AN increased demand for information in regard to the effect of gaseous elements in steel has accompanied the recognition of the importance of grain size. Attempts to correlate grain-size characteristics with gas con-tent, particularly oxygen in solution or in the form of included metallic oxides, have not been universally successful. Certain definite effects of dissolved gases are recognized; specifically, the role of hydrogen in causing internal cracks or "flakes" and that of nitrogen in preventing excessive grain growth of ferritic chromium steels. When irregular behavior or properties are found in a well-known steel and no definite cause for the abnormality may be assigned on the basis of chemical and metallographic tests, dissolved gases are frequently blamed as the culprits. The solubilities of hydrogen1 and nitrogen2 in pure liquid iron are known but of the ternary systems, iron-alloying element-gas, only the Fe-Si-N3 and Fe-Cr-N systems have received attention and here the study was confined to liquid alloys. Krivobok4 published a curve show-ing the solubility of nitrogen in liquid Fe-Cr alloys but gave no informa-tion on the experimental procedure employed. The considerable experimental work reported on the Cr-N binary alloys has been reviewed by Hansen.5 It is generally agreed that the nitride CrN is a stable phase although the existence of nitrides within limited temperature ranges of stability, viz., Cr3N2 and Cr2N, has been disputed, Adcock6 and others7 have reported a eutectic between Cr and CrN at 1580°C., although the supporting evidence is not complete.

"Future Integrated Gasification Combined Cycle (IGCC) power plants will have superior environmental performance and unmatched efficiency.The Shell Coal Gasification Process (SCGP) is a clean coal technology, which can convert a wide range of coals into clean syngas for high efficiency electricity generation in an IGCC plant. SCGP flexibility has been demonstrated for feeds ranging from bituminous coals to lignites and petroleum coke, and the process is ideally suited for combined cycle power generation, resulting in efficiencies of 42% to 46% (LHV).In the Netherlands, a 250 MWe coal gasification combined cycle plant based on Shell technology is being built by Demkolec, a development partnership of the Dutch Electricity Generating Board (N. V. Sep). The plant is scheduled to start up in 1993. IntroductionBasic ConceptShell's experience with gasification dates back to the 1950s, when the first Shell Gasification Process was commissioned with oil as feedstock. There are now over 140 SGP gasifiers licensed. The experience gained on oil gasification provided a firm theoretical and practical base for the start of coal gasification process development in 1972.At that time, there were serious concerns about the future availability and price of crude oil. Coal gasification (making carbon monoxide and hydrogen by the partial oxidation of coal) was considered to be an important option for refinery applications, because the synthesis gas (syngas) produced can be used as:• a chemical feedstock for making transportation fuels and chemicals;• a source of hydrogen (making use of the water gas shift reaction) for upgrading petroleum products; and• a fuel for heating process streams and/or generating electricity."

In all special branches of the chemical and metallurgical industries, in which large electric furnaces became necessary for carrying out new processes or for the improvement of old ones, the development of the electric furnaces took place on much the same lines. The endeavors to make a success of a new idea brought forth many ingenious designs, which, however, almost without exception, furnished the proof that the safest and shortest way to practical success is the utmost simplicity of construction of the necessary apparatus. Our knowledge of the qualities of materials for building electric furnaces and of the constituents of the furnace-charges, especially their electric conductivity and their chemical affinity towards one another at high temperatures, is still far from being complete, and from this fact we must conclude that the smaller the number of elements in the construction of a furnace, the fewer the number of unreliable factors both in the construction and in the operation of the electric furnace. This conclusion deserves special attention when an electric furnace for making steel has to be chosen from the constantly-growing number of inventions, inasmuch as the chief constituent of steel, the element iron, is a substance which in its liquid phase has so great an affinity for those elemen'ts which are to be removed from the charge, that it is very difficult to comply with the following conditions: 1, to heat the refining-slag to the highest point of its chemical activity ; 2, to prevent the iron from entering the slag, or, where this cannot be done, to make it enter so that it finally appears in the end-product

Knowledge of the water content of oil-bearing formations is important in petroleum-reservoir evaluation work. Electric logging provides a means for making reliable estimates of water content if resistivity-saturation relationships representative of the formations are available. Relationships can be determined in the laboratory by a number of methods. This report describes and presents results of a laboratory investigation conducted at the Bureau of Mines Appalachian Experiment Station, Morgantown, W. Va. (1) to evaluate an evaporation method of attaining water saturations in sandstone samples when determining resistivity-saturation relationships and (2) to compare saturation exponents derived from data obtained, using different methods of achieving water saturations. A series of tests was conducted to determine the effect of evaporation on salinity distribution within the core specimen. Results of these tests show that a zone of high salinity was set up at the surface of a sample during evaporation and that long periods were required for the sample to reach resistance equilibrium after evaporation had ceased. Equilibrium time ranged from several minutes to several days, depending on the sample size and the technique used. The high-salinity zone was removed from the sample by using auxiliary porous material in capillary contact with the sample surface during evaporation. Salinity determinations and resistance measurements indicate that, at saturations greater than the minimum interstitial values, the mechanism of flow during evaporation was one of moisture migration mainly as a liquid from the interior of the test specimens to their exterior surfaces. The concentration of the contained brine remained essentially unchanged, except for a narrow zone near the evaporating surfaces.

The Cripple Creek district occupies a cluster of foot-hills on the south side of Pike's Peak and is a portion of an extensive, though uneven, plateau which unites the eastern range of the Rocky mountains with the Sangre de Cristo. It is essentially a small volcanic area, of about 20 square miles, amid the granite of the Front range. But though, when regarded as a rich mining district, it may be considered as an isolated area,* yet, geologically, it is, as Whitman Cross has pointed out, only an outlying portion of a much larger volcanic region, which stretches to the south and west, around Silver Cliff and the Rosita hills, forming the picturesque country cut by the deep cañons of the Arkansas river and its tributaries. The mines are situated amid a volcanic complex, consisting of tuffs and breccias which have been penetrated by an extensive system of dikes and other intrusive masses. The prevailing formation is an andesite breccia, which lies upon the worn surface of the granite and fills the deep basin around a volcanic vent. The breccia, since its deposition, has been broken into by several eruptions of phonolite and, later still, by a series of thin dikes of basalt and other allied rocks of a highly basic composition. The successive sedimentary formatione which, elsewhere in Colorado, lie upon the basal granite, are not represented in the district; whatever sediments were laid down before the volcanic period must have been removed by erosion, and there is very little evidence which affords a datum-line whereby the geological age of the volcanic eruptions can be determined. The nucleation of pearlite at proeutectoid ferrite is inhibited, to an increasing extent, at the following locations: At twin boundary-nucleated ferrite, between closely spaced ferrite sideplates, and at intragranular plates. These effects are discussed in terms of the influence of transformation strain energies and of the interfacial free energy of austen-ite:ferrite boundaries on the rate of pearlite nucleation. The growth of pearlite into the interiors of austenite grains from the region of the grain boundaries is markedly restricted when low reaction temperatures and large austenite grain sizes permit the development of interlocking networks of intragranular ferrite plates. PREVIOUS investigators have made extensive studies of the interactions which occur between the proeutectoid ferrite and the pearlite reactions from the viewpoint of the mechanisms through which pearlite interferes with the nucleation and growth of proeutectoid ferrite.1-3 In the present investigation, the processes through which proeutectoid ferrite (hereafter termed simply "ferrite") can reduce the rate of formation of pearlite have been explored in some detail. A steel with a relatively low carbon content, in which the ferrite reaction can compete successfully with the pearlite reaction over a wide range of reaction temperature, and exceptionally coarse-grained specimens, which further emphasize the role of the ferrite reaction, have been employed for most of this work. A brief examination also has been made, however, of the effects of smaller austenite grain sizes upon these processes. Experimental Procedure The steel employed had the following composition: 0.29 pet C, 0.76 pet Mn, 0.25 pet si, 0,007 pet S, and 0.005 pct P. This alloy was homogenized for 48 hr at 1250°C. In recent years, improvements made to the longwall system have accelerated at a faster pace than those made to the gate entry development system. As a consequence, unless planned years ahead of time, extending the panel length is nearly impossible without some innovative approach. At Cyprus Amax Coal's Emerald mine the G panel length was extended by 3,500 ft- by developing three entries across it to facilitate development of its headgate and tailgate entries simultaneously when the adjoining F panel was in operation. After evaluating alternative supporting methods and associated risks, determination was made to backfill these entries and crosscuts using a low strength flyash cement mixture prior to mining thru. Instrumentation was also used to monitor the stress change or front abutment stress in both the coal and the backfilled material ahead of the face. Longwall mining thru these three entries took about four eight-hour shifts and proved to be very successful. The designed flyash cement mixture provided adequate roof stability and caused no difficulty in the shearer's cutting while eliminating an in-panel longwall face move and minimizing the risk of roof or floor failure in the in-panel openings, or in the worst scenario loss of the face during the longwall cutting thru. This approach provided the intended result of extending G panel and recovered about one million tons of coal. "In this period of improved metal prices and reported profits, valuable lessons should be recalled from the 1970s when a similar cycle lured the federal and provincial governments into thinking that they could grab bigger pieces of the pie without harming the minerals industry. It took years for the industry to recover from the damage inflicted by that unprecedented scramble for higher tax revenues. It is hoped that the current policy makers will have learned from the lessons of the seventies, and will realize that mining companies need to keep a reasonable share of profits realized during the good years in order to prepare for the inevitable downturn in the cycle.INTRODUCTION"", «. We have made clear to industry that super profits... will no longer be tolerated "".With that assertion, the Honourable David Barrett , Premier and Minister of Finance of the Province of British Columbia, announced the introduction of a new mining tax regime in his February 17, 1974 bud get papers . British Columbia producers would face a basic royalty and a royalty on so-called ""super profits"", resulting in some instances in tax rates exceeding 100070 of pre-tax profits.The ball started to roll. Mining tax changes knew no political or geo graphical boundary. On April 9, 1974, Ontario's Treasurer John White stated in his budget speech:""Increased demand by major industrialized countries has resulted in sharply higher metals prices and substantial wind fall gains for the mining industry in Ontario. With the prospective demand for minerals likely to sustain current price trends into the future, it is only fair that we secure for the people a higher return from our natural resources""."

The reduction of iron oxide, such as Fe203, to iron in the blast furnace is performed principally by carbon monoxide, but partly by solid carbon by the two following reactions: Fe2O3 + 3CO = 2Fe 4- 3CO2 2Fe2O3 + 3C = 4Fe + 3CO2 It is known that reduction by carbon monoxide takes place at a much lower temperature than reduction by carbon and that the reducing action of earbon monoxide progresses to the inside of the ore in lump form by gaseous diffusion. In the reduction by carbon, however, the reducing action takes place only at the contact surface of the ore and carbon, so that the more complete the reduction by carbon monoxide, the more efficient is the operation. However, the reduction does not progress as shown in the foregoing equation, because carbon dioxide acts oxidizingly on the metallic iron to such a degree that when the gaseous composition reaches a certain proportion of carbon dioxide to carbon monoxide, the reduction practically stops, even though the gases are moving slowly through the heated ore. The proportions of carbon monoxide and carbon dioxide in the gas depend on the kind of iron oxide and the temperature of reduction, also on the duration of time in the reaction. The longer the time of the reaction, the higher the proportion of carbon dioxide obtained in the gas, but finally it will attain to a condition of equilibrium. Miners at noncoal surface mining operations are often exposed to high levels of respirable dust. In an effort to lower the respirable dust exposure of these surface miners, the National Institute for Occupational Safety and Health (NIOSH) has been conducting research to address this problem in a practical and economically viable manner. One successful effort deals with lowering the dust exposure of equipment operators in enclosed cabs. Many types of surface mining equipment utilize enclosed cabs to protect equipment operators from dust exposure. Normally when the equipment is new, the cabs are fairly airtight. These tightly sealed cabs, combined with good filtration systems, generally provide the operator with good dust protection. However, most mining equipment is older, and as aging occurs, many components of the enclosure deteriorate. The structural integrity of the cab diminishes and the effectiveness of the air filtration system fails. NIOSH has been successfully researching costs-effective methods to improve both filtration effectiveness and cab integrity of these older cabs in order to provide a healthier work environment for equipment operators. Dust sampling records indicate that drill operators and helpers have the highest dust exposure of all workers at surface mining operations. Since much of the overburden contains a high percentage of silica, the health hazard associated with this dust can be even more serious. NIOSH research is addressing techniques to lower respirable dust levels at surface drilling operations. INTRODUCTION NIOSH's mission is to assure a safe and healthy work environment for the working men and women of this nation. Of primary importance in mine-installations is the hoist, which has a very direct bearing on the successful operation of a mine. Conditions vary greatly with different mines, and especially in different localities. Such factors as depth, incline, the number of levels, permissible or desirable speeds, conditions of ore, etc., are always more or less special in each case. Veins of ore are never exactly duplicated, and the nature of the ground through which shafts are sunk may considerably modify permissible values. As mining-laws are made by the different States, they necessarily vary somewhat, and, even when not fully observed, they introduce factors which qualify the conditions of hoisting men and ore. The amount of timbering required is often of importance as relating to hoisting-conditions. Methods of loading ore affect the time required, as also does the question of the use of cars or skips. Safety-precautions must be very carefully considered, and the number of men in each mine, the number of compartments, and often the method of removing water from the mine, must have careful consideration. While a general discussion of the subject of hoisting is possible, most cases are entirely special, and can be considered only in connection with the peculiar conditions pertaining to that particular installation. The cost of installation of the hoisting-plant may be an appreciable amount, while the cost of raising the ore may be but a small part of the total operating-charge. In many cases, however, the output of the mine is limited by the capacity or the hoist, and the latter thus becomes of the first importance.

THE liability for damages to the surface caused by subsidence is an ever present threat in all underground mining. In ordinary lode mining, this threat rarely materializes into an action, due to the method of mining metalliferous ores, the dip of the veins, and the nature of the ground itself. In the mining of coal, however, this threat is very real. The coal frequently lies close to the surface, in beds underlying large areas of land of which the surface is suitable for agricultural or urban development. Furthermore, the coal is generally mined by the "room and pillar" method and when the pillars of coal are removed, the subjacent support is destroyed. This question of the duty of surface support has now become a very live one in Colorado. What was waste prairie land a few years ago has become valuable agricultural land dotted here and there with growing towns. Frequent references will be made here to Colorado conditions and adjudicated cases, but those conditions and cases and the conclusions to be drawn therefrom are applicable to all coal-mining states. Briefly stated, the question is "Does the owner of the substrata or underlying mineral owe any duty of surface support to the owner of the superjacent strata or surface?" There is -no absolute duty of support owed by the mineral owner and this assertion is made with full knowledge of numerous expressions to the contrary by courts of Pennsylvania, Illinois, Colorado and other coal-mining states. Whether or not any duty exists depends upon the circumstances surrounding each case, and since in the nature of things those circumstances are rarely identical, there can be no absolute rule.

Longwall mining has historically been considered an application for only deep reserves. This has changed in the recent past as longwall has become competitive with surface mining. Many resources marked for stripping now he in the domain of longwall. Today, the best longwall mines compete with strip mines operating in even the lowest stripping ratios. Longwall mining has become more widely applicable than it ever has been in the past and it is now generally considered the method of choice in situations where high levels of coal production are required. But the best way to use longwall mining has become less certain with the opportunities that highwall access provides. Wall-to-wall mining is the use of retreating longwall developed from and retreating toward a highwall. As a surface mine reaches its ultimate highwall, the opportunity for longwall punch mining or wall-to-wall mining is obvious. There are several clear operating advantages to operating a longwall in this way and where highwalls are available, the best economic decision will generally favor planning a direct approach. Yet wall-to-wall is not applicable in every situation even when highwalls are available. Moreover, the advantages of wall-to-wall mining do not always justify the cost of trenching or box cuts to access coal . However, many tactical advantages of operating from the highwall can be realized with the use of specially equipped blind drilled or raised bored shafts. This paper discusses novel techniques for a shaft assisted mining system which permits the addition of conveyor structure and mine systems from the surface to the face for advance and retreat mining with longwall, shortwall or room and pillar panels.

INTRODUCTION.-This paper discusses the chief existing data as to the temperature, in iron-carbon alloys, of Ae.3, the upper limit of the transformation range when in equilibrium, as distinguished from Ac3, the temperature at which the end of the transformation is noted in heating up, and from Ar3, that at which its beginning is noted in cooling down. The former is in fact carried above Ae3 and the latter below Ae3 by lag. I touch incidentally on the influence of manganese on Ae3 (§ 29, p. 1102). The sections, tables, and illustrations, are numbered consecutively with those in the accompanying papers by Howe and Levy on Determination of, the Position of Ae3 in Carbon-Iron Alloys, and by Burgess, Crowe, and Rawdon on Thermal and Microscopical Examination of Professor Howe's Standard Commercial Steels, to which the present paper forms a sequel. § 25. The contradictoriness of our present evidence is shown by grouping it together in Fig. 14. For instance, both Goerens and Meyer (Series 2) and Meuthen (Series 12) used practically stationary temperature, and thus reduced the influence of lag very greatly; yet Ae3 for 0.32 carbon steel according to the former investigators is 894°, but according to Meuthen it is at or below 770°, a discrepancy of 124° or more. In view of our ability to measure these high temperatures within a few degrees, the existence of such a discrepancy is as unwelcome as it seems needless. I attack the thankless task of bringing some order out of this chaos.

his report is going to point to that the effect of the mining dewatering on the area of Transdanubian Mountain Range has reached a phase when the cost of dewatering and providing damages can seriously jeopardize a profitable mining operation. Up to 60s the interest of mining had been dominant only, but since the begining of 80s the conceptions of industrial development and the value of enviroment protection have been changed. The natural karstwater balance of the TMR can be presented (Figure Land 2.) and the present situation of it points to that the descharge has exceeded the reacharge in 50 %. During the past 10 years the decreasing of the stored karstic water resourches was 1.1 km . The decreasing of the spring yields reached 80-82 % of the natural ones. (Figure 3-4.). Conservation of the present discharge may lead up to the totaly drain of the karstwater regime. A computer aid control system had been to develop by the bauxite mining and using of it the yield of dewatering decreased and a moderate rising of the water table has started since 1986. A recunstruction was made at the biggest thermal-medicinal lake its springs have had their source in 40 meter depth inside a spring cave at the bottom of the lake. Earlier the spring yield decreased due to the dewatering activity of mines. As a result of using of the CAC system and the providing works at the thermal sprino,the karstwater balance has got in the state of equilibrum, the first cost was decreased and spring yield was increased and the enviromental limits were adverted from the way of mining.

The development of Mount Isa Mines Limited power supply is traced through the history of the mine operations. As would be expected, growth of the power supply system follows closely the increase in mine output, although it will be seen that total kWh. produced per ton milled shows a considerable reduction in later years when the mine output showed a more rapid rate of increase. That this reduction is not more marked is possibly due to the increased community and Shire Council power usage per head of population.INTRODUCTIONThe geographical position of Mount lsa, far from any large regional power supply Authority, dictated the policy that the Company be responsible for the production and suppiy of all power required for the plant operation. The Company also, in November 1937, accepted responsibility for the supply of a part of the power requirements of the township of Mount Isa. The history of power supply to the Mine may be divided into several phases.1. The supply Of lighting and power during the first plant construction period 1929-1931.2. The construction of the first section of the Mines Power Station, comprising Nos. 1 and 2 turbo alternators and boilers.3. The addition of No. 3 turbo alternator and boiler.4. The addition of No. 4 turbo alternator and boiler.5. The addition of No. 5 boiler.6. The addition of a. 2 turbo blowers for air supply to the Copper Smelter converters; b. 1 turbo blower for air supply to the L.ead Smelter; c. 2 turbo compressors for compressed air supply to the Mine and surface plant.
