Achieving occupational health and environmental noise objectives is a major consideration in the planning or operational phase of resource development and industrial projects to meet the needs of the workforce and community and comply with legislative requirements. For material handling systems, ventilation plants, mobile equipment, process plants and fixed infrastructure, noise emissions need to be considered at the design phase. The preferred approach is to provide noise emission technical specifications, but in many cases this is not stipulated. An occupational noise requirement, such as ‘not to exceed 85 dBA at 1 m’, is often provided, but this will not achieve the required occupational or environmental noise objectives and may cause overly stringent requirements when they may not be needed. It should be noted that when developing the technical specification, measuring compliance needs to be taken into account as, in some cases, measuring may be very difficult or even not possible.This paper will discuss the requirements for providing an effective noise specification that ensures the environmental and occupational noise objectives are able to be achieved and that, once installed, compliance can be measured. It discusses planning such as when to set the objective, correlating the appropriate objectives for the environmental and occupational noise requirements, allowing for measurement tolerance, providing a suitable criteria and data format for the suppliers to respond to and methodology to measure compliance. Different phases of a project require different approaches to planning for noise management and these will be discussed in the paper. BEFORE the war we often heard the term "Big Business." And there were complaints of the ills and abuses attributed to bigness in business. Although there were examples where the small businessmen spoke for their rights and sought protection from the bigger ones, it has only been in recent war years that a tendency has developed definitely to divide the business of our nation into the big and the small. In some cases, those with an eye to the political value of the vastly greater number of small businessmen of the country have fomented this division by hurrying to the protection of these more numerous voters, and intentionally or not have emphasized in their writings and verbal attacks any and all differences of these interests that could either be found or fabricated to, suit the occasion. It has become another example of breaking the people into classes and thus setting up the basis for the claims of one class against another, and the subsequent demand for legislation and Governmental aid. The terms "big" and "small" are purely relative. One businessman, employing a hundred men, told me recently he did not know which adjective would be more appropriately applied to his operation. He did not know whether he should join the small operators' group that had been organized, or should consider himself big. He said that his present plant seemed big to him when he looked back to its humble beginning many years ago with a couple of men in two rooms. Yet, when compared with many of his competitors who employ thousands, his was small. He did add, however, that he probably became big one day a few years ago when the union moved in and organized his employees.

"It has long been recognized that coke is a more desirable fuel than bituminous coal in water-gas apparatus of present design, but still considerable headway has been made in the use of the latter fuel as a substiaute for coke. This is particularly true in the Central States where the supply of high-grade coke has been very limited and uncertain during the past few years, and where coking coals of low sulphur content were available in quan¬tities. In fact, with, the present difference in price of coal and coke, it is possible to realize a marked saving when using a coking bituminous coal as generator fuel.Difficulties have been encountered in the use of such fuel, but they have, to a large extent, been overcome. One of the chief obstacles in the use of the more general utilization of bituminous coal for water-gas manufacture, is the fact that, with normal operation, the capacity per unit of time is reduced. This of course is a serious problem for plants operat¬ing at capacity with coke fuel. However, this difficulty can, to a large extent, be remedied by a changed method of operating, and can be entirely remedied by a combination of the latter with a change in the design (or proportions) of a water-gas set. The preceding statement, the reader will understand, refers more particularly to a carburetted water-gas set.In the manufacture of water gas from coke, present practice requires that for continuous 24-hour service the heat of combustion of all the carbon monoxide (CO) generated during the air blow be utilized in addition to the sensible heat of the gas coming from the generator. This is doubly true when making carburetted water gas from bituminous coking coal. The reasons why this is so are apparent when the following factors are considered."

Drilling and blasting 12-in. blastholes started about the middle of 1946 and has worked out so well that about one half of the blasting, formerly done with 9-in. holes, is now done with 12-in. holes. In most of this work the harder benches were chosen for the 12-in. size because these were the areas where the greatest difficulty was encountered in thorough fragmentation. At the start of this experimental work a 42-T Bucyrus- Erie churn drill was available whereas all other blasthole drilling was being done with 29-T rigs. The large drill was first equipped with a standard 9-in. string of tools but it could not drill quite as fast as the 29-T drills. How- ever, when the weight of the string was increased about 700 lb, or to a total weight of about 3500 lb, it was found that the 42-T exceeded the drilling speed of the 29-T by about 25 per cent. When a 12-in. bit was substituted for the 9-in. bit the 42-T rig again dropped behind the drill- ing rate of the 29-T rigs. At this stage of the experiment the 42-T was using a 12-in. bit with detachable points and the total weight of the string of tools was about 3800 lb. It took longer to change the drill points than it did the regulation bit and this accounted for some of the slower drilling rate. When a heavier stem and standard construction 12-in. bits were used it was found that the 42-T could drill a 12-in. hole slightly faster than a 29-T could drill a 9-in. hole even in the hardest rock in the pit.

Non-electric systems, specifically shock tube, have become the pyrotechnic detonator of choice over electric due to their safety regarding accidental initiation from stray radio signals. Typically, the best practice when hooking up shock tube systems is to have direct contact to ensure initiation. When gaps are introduced to the explosives chain, there is potential for detonation to come to a halt. It is understood that direct coupling is required between the various elements in the explosive chain to ensure detonation. This holds true whether tying in non-electric detonators, loading holes in a mining related blast, or priming a block of C-4. Poor contact and gaps in the explosives chain can lead to detonators firing out sequence, leading to increased vibration, air overpressure, and other undesirable blast results. Furthering work conducted in previous experimentation, a new study was conducted at the Missouri University of Science and Technology’s Experimental Mine in Rolla, Missouri to observe the initiation potential of an air gap and fragmentation on non-electric shock tube. A series of small test blasts were conducted using 50 grain detonating cord and fragments from a blasting cap to initiate a non-electric shock tube across an air gap of varying distances. The data collected in the high-speed imagery was used to analyze the velocity of the pressure fronts and blasting cap fragments used to initiate non-electric shock tubes across an air gap. It was found that the shock tube was sensitive to 50 grain det cord at a 5cm (1.97in) distance while parallel and 10cm (3.94in) when perpendicular as well as sensitive to frag from the electric cap out to 2.4m (7.87ft).

Technology and economies of scale have, in the past decade, brought about the emergence of giant vessels. Meanwhile, to answer the need for rapid dispatch, as a means of combating the proportionately far greater demurrage charges, shiploading and unloading speeds have soared (Ref. 1, 2, 3). As the loading and unloading rates have dramatically increased, so has the cloud of dust grown in unbearable proportions. It not only has threatened to be a real menace to machinery and men, but in certain instances has also seriously jeopardized fish and marine life (Ref. 4). In an era when ecology is king, dust in shiploading and unloading can no longer be shrugged off as a mere public nuisance, and its control is now duly recognized as of grave concern to all. Even if public outcry were not a problem, from the operator's own parochial point of view, dust can adversely affect productivity and the well-being of the operating personnel. Without adequate control, it can also result in costly equipment maintenance, particularly when the dust is micronic in size, and abrasive. The Hierarchy of Control Techniques Given the great fortune of not yet having to deal with gas and odors, in the jargon of pollution control, our problem is confined to having to control "particulates" only. To deal with "particulates", the myriad of dust control techniques can be utterly confusing to those who are not entirely well versed in the methodology. Our analysis of what is available to date results in the following hierarchy of logical preferences: 1. Prevention 2. Removal 3. Suppression 4. Containment 5. (communication to the Secretary*) :—The authors have shown that, under certain conditions, the rate of dissolution of gold by chlorine and bromine is reduced by the addition of 10 per cent. of silver to the gold, and that the action is almost stopped when the silver amounts to 30 or 40 per cent. of the alloy. Even if full recognition is given to the practical way in which the work was done, however, it is to be regretted that Prof. Hofman and Mr. Magnusou did not determine the temperature at which the experiments were carried out. From the details given, it may be inferred that the temperature was raised by chemical action by about 20' C. when 21 g. of sulphuric acid was added, and that the mixture was then slowly cooled down during the experiment. When bromine or very weak chlorine solutions were used, there could not have been any perceptible heating-action. As the action of both chlorine and bromine is aided by heat, it follows that the stronger solutions of chlorine were given an unfair advantage over the weaker solutions, and over bromine. If the temperature had been the same in each case, I do not think that the conclusions deduced by Prof. Hofman and Mr. Magnuson' would have been found to be justified. (This is speaking generally. In barrel-treatment the conditions are similar to those in the experiments.) The superior speed of bromine as compared with chlorine at equivalent strengths is not yet disproved, and the differences noted between strong and weak solutions of chlorine may have been largely a function of the temperature. Many of the relevant engineering behaviours of tailings are controlled to a large degree by the density of the material. For example, loose tailings are prone to brittle strength loss, while dense tailings are dilative (i.e. gain strength) at large shear strains. The critical state framework has been successfully developed over the past few decades to assess whether in situ conditions are contractive or dilative, and estimate relevant engineering parameters on that basis. Tailings comprising primarily silt-sized particles, when subaqueously deposited, often form a particularly loose state compared to subaerially deposited material of similar index properties. Such subaqueous deposition occurs in the decant pond area, where the tailings typically pluviate in quiescent conditions within a pond of standing water. Silt tailings deposited in such a manner have been observed to be extremely loose in a number of TSF investigations. Of particular concern, the deposited material in such cases appear to be significantly looser than can be reproduced in the laboratory - even using moist tamping, the sample preparation method which can usually produce the loosest samples possible in laboratory conditions. While the loose density of subaqueously deposited silt tailings is clear, in a well-managed upstream-raised TSF the decant pond is usually small and far from the perimeter embankments, however there are a number of examples where the engineering performance of such materials becomes relevant – for example, when historical deposition practices were poor, resulting in subaqueous deposition near the perimeter embankment. This paper outlines the geotechnical characterisation of a number of such subaqueously-deposited zones, compares the in situ state to that achievable in the laboratory, and discusses options for assessing the expected engineering performance of such materials when comparable laboratory tests are unavailable.

The annual meeting of the Woman's Auxiliary was held on February 19, at 10 a. m. The president, Mrs. Sidney Jennings, said in her greeting "it is a matter of congratulation that during the past year when the demands upon women for work of all kinds has been so large our membership has grown from the 50 enrolled at the first meeting a year ago to over 300 today. Some women, when. asked to join the organization, say that they are doing so much work in other ways that they have no time for work in a new organization, but the director for Canada struck the right note in her report when she told us of the splendid work the wives of mining engineers are doing in Canada, as individuals and as leaders and members of various organizations doing patriotic work. We do not want to divert such women from the work they are now doing, but we do want them to enroll as members of the Woman's Auxiliary and let us know what they are doing, that they play give inspiration to others." Reports were made by the directors of the following sections: Canada, Chicago, Colorado, Columbia, New York, Puget Sound and St. Louis, in some of which sections excellent progress has been made in food conservation, foreign war relief, including the adoption of fatherless French children, and in work for our own engineering regiments. These reports were read, accepted, and placed on file. The reports of the corresponding secretary, of the recording secretary, and of the treasurer, were read, accepted, and placed on file. Various amendments to the Constitution were proposed and accepted, and copies of the Constitution, as amended, will be mailed to all the members of the Woman's Auxiliary.

PRIOR to June, 1937, the employees of Hollinger Consolidated Gold Mines, Ltd., at Timmins, Ontario, received medical care for themselves under a contract system developed through an agreement between the employer, employee, and a contract physician. This form of practice is common to the mining industry in Ontario. But with the improvement in mining methods and conditions of living, and through an increasing demand for provision of a complete medical care, it was not any surprise when the employees of the Hollinger mine approached organized medicine and indicated their desire for a plan to provide their families with a more or less complete medical service in addition to that supplied for themselves. In April, 1937, this approach was made, and on June 18th, 1937, the Hollinger Employees' Medical Services Association was formed and started to provide medical services. A review of five years' experience is now presented. The Association provides complete medical service for the employee, his wife and family, as well as those dependents who are the total responsibility of the employee. The employee membership is limited to employees at the Hollinger mine in Timmins who reside in the immediate vicinity. The employee is examined by a Company doctor on application for employment and is subject to further examination by a specialise in chest diseases under the direction of the Workmen's Compensation Board of Ontario. The wife and family are not subject to examination but have to be registered when the employee is accepted for employment. The dependents, other than the immediate family, are subject to medical examination and approval after the employee has applied for such dependent or dependents to be admitted. Membership in the Association is obligatory when the employee is hired, but at the end of any Association year he may drop out if he so wishes.

"Although there have been great steps forward to integrate corrosion engineering into operations, there is still an underlying tendency for maintenance tasks to be performed in a reactive manner. This is especially true when strategies focus on lagging indicators such as visual inspections, RCA (root-cause analysis), and FMECA (failure mode, effects and criticality analysis). This trend to “reactive maintenance” can be avoided by utilizing more inspection and monitoring methods to identify leading indicators of failures. Prevention is generally less costly than repairs; moreover, when paired with appropriate monitoring techniques, intervention of corrosion protection can be more effectively timed and based on more accurate data. Hatch asset reliability studies show nearly 80% of defects are introduced through operations and maintenance. Therefore, proactive corrosion management can provide the necessary feedback to optimize operations and maintenance strategies preventing costly corrosion losses. Understanding corrosion risks gives a clear picture of the benefits of a proactive approach to asset performance. Monitoring techniques (Non-Destructive Testing, field testing, sampling, etc.) by nature are a more effective means of improving maintenance efforts and preventing corrosion losses than other methods (RCA, FMECA). This paper will outline the importance of proactive corrosion management and demonstrate its benefits through industry examples.INTRODUCTION Over the past few decades, with the growth of technology and awareness of sustainable development many studies have shown the benefits of a proactive approach to maintenance strategies. "Multi-scale simulation in coupled fluid flow- geomechanical systems is a computationally efficient method for numerically solving large poroelastic systems. When using multi-scale methods, care must be taken in ensuring consistency when information is exchanged between systems that have a different discretization. Here a method is presented which provides consistency between the pore pressure being calculated on a fine scale fluid flow domain and upscaled to the coarser scale geomechanical domain and the pore volume change being calculated on the coarse geomechanical domain and down-scaled to the fine fluid flow domain. Central to this process is the characterization of the mechanical properties of the poroelastic system at both scales.Another advantage of the method presented here is that it is applicable to hydraulically disconnected but laterally drained (i.e. multi-porosity) layered systems as well as hydraulically connected, layered systems. Thus it can be used in geological situations where thin shale streaks or hardpans impede flow between laterally extensive, hydraulically conductive units. This is significant as the pressure evolution of such a hydraulically disconnected, laterally drained system can be very different than a hydraulically connected one as shown here. INTRODUCTIONA multi-scale treatment of fluid flow and deformation is a key enabler when simulation of poroelastic phenomena is limited by computational resources. As the spatial domain of the geomechanics model is usually larger than the fluid flow model, it is desireable to use a coarser discretization in the geomechanical model compared to the fluid-flow model. This type of multi-scale simulation requires a consistent up-scaling of pore pressure from the fine scale fluid flow model to the coarse scale geomechanical model and down-scaling of pore volume change from the geomechanical model to the fluid flow model (see Figure 1)."

The widespread adoption of electronic detonators has given rise to the development of linear superposition to control the environmental impact on both third-party properties and residents resulting from blast induced vibrations. Linear superposition has become a very effective tool in the hands of blasting engineers and has enabled aggregate reserves to be accessed that once had to be abandoned. This in turn has resulted in more and more complex blasting pattern to be developed that contain multiple rows and multiple decks all with different maximum instantaneous charge weights of explosives. This is then made more complex by having to consider multiple sensitive locations often with different Peak Particle Velocity vibration limits. This paper is a case study of what did happen when a blast was designed that “pushed the boundaries” of environmental blast vibration design and control, without taking fully into account the fundamental geophysical properties of seismic waves. The resulting blast design caused a greatly enhanced s-wave to be created in a critical direction from the blast pattern. The root cause being the s-waves from earlier detonating decks in the blast pattern arriving within 2 milliseconds of decks detonating later in the blast pattern. 209 individual decks were fired in the blast pattern of which 41 pairs of decks arrived at the observation location less than 2 milliseconds apart when taking into account the s-wave speed and direction. The lesson to be learned when using electronic detonators to limit ground vibrations from complex blasting patterns, is that it is just not good enough to look at the planned firing times, a professional blasting engineer must also understand the likely interaction of the various seismic wave types created and their combined impact on any given monitoring location.

WITHOUT doubt, one of the most frequent and serious annoyances connected with the practical running of a blast-furnace, especially in single-furnace plants, is caused by low steam, in spite of the fact that all boilers at blast-furnaces have grates for burning coal, and that coal is more or less continuously burned upon them, from three to a dozen men being pretty constantly engaged around the boilers as firemen or coal- and ash-handlers. At times, when the furnace is ? tight," all available men are put on to assist the regular firemen; yet sufficient steam cannot be got to keep the engines up to their regular number of revolutions, while the stoves, deprived of the gas which has been sent to the boilers, run cold, so that, when the furnace loosens-up and resumes the regular rate of driving, the blast is very considerably below normal temperature, and a.' cold," or at best a " high-sulphur," east is the result. Again, it often happens that a furnace, running at its best, becomes temporarily a little too hot; the pressure rises; the amount of gas made' is diminished; the steam soon commences to go down; and a small scaffold is likely to form before the furnace has been brought back to the proper rate of driving, and thus enabled to take its regular amount of blast. The usual remedy is either to "jerk" the furnace by a sudden, brief intermission in blowing, or to cool the furnace by lowering the heat of the blast; but if the lower blast-temperature be maintained too long, the hearth and descending stock may be cooled below the " critical temperature " mentioned by Mr. .Johnson, and the furnace may go to the other extreme, and become cold. This is especially the case when coal or coke, high in sulphur, is used:

Meerschaum or sepiolite is employed principally in tobacco pipes and cigar and cigarette holders, although a few other uses of minor importance are Down. The unique value of a meerschaum pipe is derived from the owner's pleasure in watching the color deepen with smoking and in having the color "set" at the desired shade. The name "meerschaum" (German for "sea foam") is applied because the material, when pure and dry, will float on water. Owing to its resemblance to the porous, bonelike structure of the cuttlefish, or septa, it is also known as sepiolite. There are a few scattered deposits of meerschaum in. the United States which have yielded a small product ion, but the world's supply of the' material is obtained fined principally from Asia Minor, Meerschaum deposits near Eski-Shehir, Turkey, are said to have been worked 2,000 years ago, but commercial exploitation is a development of the last hundred years DESCRIPTION AND PROPERTIES Meerschaum is a hydrous magnesium silicate (H4Mg2Si3010) having the following theoretical analysis: Si02, 60.8 percent; MgO, 27.1 percent; H20, 12.1 percent. It is a soft. (H.2 - 2.5), fine-grained, earthy, white, gray, or yellow material. It is very light weight when pure (specific gravity, 1 to 2) and is highly absorbent. Because of its porosity the proportion of water present in the mineral is affected by the humidity'of the atmosphere. In a moist atmosphere the water content may be as much as 21.7 percent. Then wet the material is soft and somewhat plastic. When dried again it becomes lard and tough. The toughness is especially apparent in some forms that have a fibrous or leathery texture.

Current coal cleaning technology uses heavy media (HM) for the recovery of coal in particles larger than 1/16 of an inch. Through the use of float sink measurements of the feed and products to commercial HM unit operations, a selection function, sometimes called Tromp curve in the coal industry, can be computed. Since the selection function is a plot f the probability of a particle appearing in the float versus the particle density, the slope of the curve will be sharper at the point where the particle has a 50% chance f appearing in the float. Thus, the separation will be better. Fine-tuning a unit operation or a circuit of unit operations requires that the selection function be accurately known. By current practice, it is difficult to obtain an accurate measure of the slope because, when the selection function is plotted versus density, the data forms an S-shaped curve which lacks data points near the 505 point of the curve. This lack of sensitivity in measuring the slope means that small recovery improvements cannot be detected; thus, only large improvements are measurable. Since most engineering improvements are small when individually considered, but large when aggregated ever many small improvements, this lack of measurement sensitivity rules out the slew march toward improved efficiency. This paper presents a method of analyzing heavy media selection functions resulting in a far more effective measure of the selective function slope. Furthermore, this improved method is applied to a number of industrial coal cleaning plants for both heavy media and heavy media cyclones. Using the work of Hudy (1968), and Deurbrouck and Hudy (1972), selection functions for individual unit operations in each plant are calculated as a function f particle size as well as density.

"Onakawana Development Ltd. and Mana/ta Coal Ltd. have completed feasibility studies on a large lignite deposit located in the James Bay lowlands of northeastern Ontario. The mining plan described in this paper would supply coal for approximately a 33-year period with peak production in the early years of approximately 6.5 million tonnes per year then declining to 1.2 million tonnes in year 33. This paper describes the geology, resources, lignite quality, mine planning and related topics. LocationThe Onakawana lignite deposit is located in northeastern Ontario in the James Bay lowlands (Fig. l). The Ontario Northland Railway crosses the property and links it to Moosonee, JOO km further north, and Cochrane 180 km south. The area is crossed by latitude 50° 37', the approximate latitude of Calgary. Toronto lies 800 km south of the study area. History of Development The deposit has been known since the late 1600s when early English settlers extracted limited amounts of lignite for use at Moose Factory. The deposit has undergone sporadic periods of exploration activity in the late 1920s and early 1930s when the Ontario government drilled 116 holes, sunk two exploration shafts and published several technical and economic studies. Interest in the property was reactivated from 1939 to 1945 when the Timiskaming and Northern Ontario Railway Ltd. drilled 182 additional closely spaced holes, excavated a test pit adjacent to the rail line and installed a boiler for testing purposes. In 1965, Alberta Coal Ltd., the predecessor of Manalta Coal Ltd., first became involved. Since then a further 182 holes have been drilled and coied, and the existing test pit reopened for sampling. In 1980, various reassessment studies were launched, including geology, mine engineering, conceptual design and environmental assessment studies. The following discussions have been drawn extensively from these reports."

This study thesis was motivated by the fact that it is of fundamental importance for open pit mining that the slopes initially have a geometry in accordance with what is proposed in the mining planning. This occurs because an inconsistency in this design can impact the operational safety and economic solutions of the mining project. These consequences can be explained by the fact that rock blasting close to mining limits requires specific study due to the attention required. Because, when this operation is not carried out properly, the mining plan in the mine may not be respected and may create risks to the operation due to the presence of unstable blocks on the slopes (Mackenzie). In this sense, Mackenzie (2004) cites pre-split, trim blasting and buffer as commonly used explosive blasting techniques that aim to limit damage beyond the projected wall. Therefore, Enaex Brazil realized the need to better understand the pre-split method. To do this, it is necessary to understand how the energy released during detonation is perpetuated in the rock mass when this technique is used and when it is absent. Thus, this analysis is based on a seismic study that allows the creation of vibration attenuation laws and an elementary wave damage model, which allows the local characterization of the rock. With this model it is possible to relate the peak levels of vibration during blasting and the extent of damage, but a critical level of vibration (PPVc) and its relationship with the Uniaxial Comprehension Resistance (UCS) are also defined for the start of fracturing and its level (McKenzie et al, 1995). And, mainly, this work aims to address a way to measure the pre-split filter potential by comparing the attenuation law with and without pre-split, ultimately knowing whether this finishing blasting is being effective, to understand the pre-split filter capacity.

"INTRODUCTION The purpose of the investigation discussed in this article was to evaluate the toxic hazard from gases produced when thermosetting plastic materials used for electrical insulating purposes are burned or thermally decomposed in enclosed spaces. For brevity the term ""toxicity"" is used throughout the article to refer to the nature of gases produced under these conditions. A need for immediate study of the problem was created as a re¬sult of the battle damage reports received from various United States Fleet units. These indicated that the fumes emitted when these materials were burned or thermally decomposed had, in several instances, resulted in toxic atmospheres. In attempting to develop a suitable test method for evaluating toxicity, it was recognized that no single test procedure could be expected to duplicate the variety of conditions that might exist in an actual fire aboard ship. In view of the immediate need, however, it was felt that considerable information could be obtained, at least to classify comparatively the several types of materials as to the toxic effect caused by burning or thermal decomposition, through the development of a sound empirical method which could be applied to all of the materials. On this basis, it was decided to modify the Navy flame resistance test for thermosetting plastics to render it applicable to the determination of the toxic, gases evolved when this test was employed. A wide variety of materials was tested, both molded and laminated, to cover the types commonly used by the Navy in electrical applications. Toxicity determinations were conducted at the Bureau of Mines Central Experiment Station, Pittsburgh, Pa. Parallel tests, to determine the flame resistance of the materials, were conducted at the Material Laboratory, U. S. Navy Yard, New York, N. Y."

In 2006, the Mine Improvement and New Emergency Response Act (?2006 MINER Act?), Pub. L. No. 109-236, 120 Stat. 493 (2006) was enacted in a bi-partisan move to strengthen the 1977 Mine Safety and Health Act. This action followed several underground coal mining accidents at the Sago and Aracoma Mines in West Virginia and the Darby Mine in Kentucky. The focus of that legislation was, in part, to force technological development and implementation. It involved the recomposition and training of rescue teams. Requirements for sealing worked out areas of mines were changed when MSHA invoked its Emergency Temporary Standard (?ETS?) authority for the first time in many years. Increased penalty amounts were established for certain types of violations for all types of mining, and minimums were set for unwarrantable failure violations issued under Section 104 (d)(1) and (d)(2); 30 U.S.C. Section 814 (d)(1),(2). The entire 30 C.F.R. Part 100 penalty criteria was revamped in a rulemaking, effective in April 2007. The visions were ambitious and noteworthy and those in industry and government have spent the last four years working through the aftermath of intended and unintended consequences of these changes. The penalty structure arrived at in 2007 has proven unwieldy and has contributed to the increase in contested caseload now before the Federal Mine Safety and Health Review Commission. In essence, litigation under the Mine Act ground to a virtual halt when the number of cases increased but the budget for Administrative Law Judges, who hear the cases, and the Solicitor?s office who represents MSHA, was not increased. Addressing the backlog effectively was one of the major challenges when Joe Main was confirmed as Assistant Secretary in early 2010.
