Mining is both exciting and rewarding-although at times somewhat frustrating-and we all can have real pride in our industry, in its people, and in its accomplishments. It is, however, with concern that I have noted a deterioration in this Country in what might be called mining's stature and in the growth of a belief in many quarters that our mineral reserves are rapidly approaching exhaustion. In other words, there is a popular image that we are fast becoming a "have not" nation in many respects and that the domestic mining industry can no longer be considered, in the vernacular of Wall Street, to offer much in the way of "growth potential." I do not subscribe to this hypothesis, nor do I believe that the record of the mining industry bears this out. However, let me add that we can, in time, talk ourselves into this frame of mind and we can hasten the day when this very well might come about by unnecessary and unwise legislation or regulation. My remarks today are basically designed to give my reasons for refuting this negative philosophy and to review our record. With your help, I know we can improve our image, and the public's recognition of our industry's peculiar problems.

Performance testing is often used by project owners and financiers to provide protection from, or assessment of, technical aspects of project design, procurement, construction and commissioning. The performance tests can range from comprehensive performance warranties relating to process performance and production in the case of lump sum turn key (LSTK) projects to less onerous demonstration tests for cost reimbursable contracts. This paper will discuss performance testing from both the contractor's and owner's perspectives and focuses on: ? when performance tests are required, ? what type of performance test/warranty is optimum for each type of project, and ? how project performance should be evaluated. The requirement for performance testing can be driven by the project financiers, particularly in the case of smaller resource development companies. In such cases, differentiation between owner's risk and contractor's risk can become contentious. At the other end of the spectrum, larger mining houses may choose to heavily influence the engineering and design process with the contractor supplying services on a reimbursable basis. In that case, the performance testing process is often limited to demonstration tests that validate performance for the owner's corporate governance requirements. This paper was prepared due to the lack of published benchmarking of performance testing and the resultant differences in expectations between a contractor and a project owner that often surface late in the contract negotiation process. The paper provides a checklist of requirements for both the owner and the contractor that may be used to provide `common purpose' early in the contract negotiation process.

THE liability for damages to the surface caused by subsidence is an ever present threat in all underground mining. In ordinary lode mining, this threat rarely materializes into an action, due to the method of mining metaliferous ores, the dip of the veins, and the nature of the ground itself. In the mining of coal, however, this threat is very real. The coal frequently lies close to the surface, in beds underlying large areas of land the surface of which is suitable for agricultural or urban development. Furthermore, the coal is generally mined by the "room and pillar" method and when the pillars of coal are removed, the subjacent support is destroyed. This question of the duty of surface support has now become a very live one in Colorado. What was waste prairie land a few years ago, has become valuable agricultural land dotted here and there with growing towns. Frequent references. will be made here to Colorado conditions and adjudicated cases, but those conditions and cases and the conclusions to be drawn therefrom are equally applicable to all coal-mining states. Briefly stated, the question: is "Does the owner of the substrata or underlying mineral owe any duty of surface support to the owner of the superjacent strata or surface?" There is no absolute duty of support owed by the mineral owner and this assertion is made with full knowledge of numerous expressions to the contrary by courts of Pennsylvania, Illinois, Colorado and other coal-mining states. Whether or not any duty exists depends upon the circumstances surrounding each case, and since in the nature of things those circumstances are rarely identical, there can be no absolute rule.

Operational readiness is a commonly used term in mining and many other industry settings. However, translating this term into a coherent scope of work that is practical and meaningful is a challenge faced by many mining projects. This inhibits the allocation of resources to the work and its completion. The problem is with understanding how the terminology applies to establishing a mining operation. Resolving this problem requires clarity around what operational readiness means for a mining project’s transition to operations and who owns the tasks of completing operational readiness. The motivation for resolution of this problem is in appreciating the consequences arising from any lack of clarity in definition of this task, the timing of the work, and ownership for its completion. In broad terms, these consequences amount to an erosion of value at a critical time for both the new mine and the company and shareholders. This situation often arises where operational readiness is not adequately addressed in project’s study phases. As a result, neither time, resources nor money are adequately provided to complete the work required. In other cases, operational readiness is sometimes assimilated with the delivery of the project’s physical assets by the project’s construction team, rather than aligned with the establishment of the operating team to deliver the desired operational outputs. This paper argues that operational readiness starts in a project’s study phases and flows through into the start of operations. The definition of operational readiness is discussed as a task, and a model for its planning and completion is presented. This discussion includes assigning ownership for operational readiness planning and delivery to the General Manager of a new operation and the operations leadership team, who are central to the success of this work. After all, the reputations of this leadership team depend on the performance of the operation in its first few years. The author’s work over the last 20 years, leading operational readiness programs and the preparation of feasibility studies for mining projects, has provided the insights and evolution of ideas that are central to this paper. Operational readiness is fundamentally directed at ensuring a new mining operation gets away to a successful start and builds a solid foundation for the future of the mine/operation/province. It requires clarity of purpose, ownership and coordination by people in the operating team, and their preparation of the requisite process definition and establishment of the significant relationships required for operations. Without its successful completion, it is unlikely the new operation will meet and sustain its start-up targets. This paper discusses a practical approach to operational readiness for mining projects.

Tunnel project contract documents often present groundwater infiltration requirements for components of the underground portions of the project. All too often these documents require quantifiable target inflows for these components, but only refer to them in subjective terms such as “dry,” “manageable,” etc. The Contractor’s definition of these terms will inevitably differ from the Engineer’s definition of these terms. The purpose of this paper is to look at common subjective terms used in documents and provide suggestions for reasonable quantifiable language. Additionally, the paper will provide information and recommendations on relative levels of cost and effort increase needed to provide increasing levels of water cutoff (i.e., achieve “dryness”?).

"Fatigue presents several challenges for the mining industry. Depending on the specific occupation, daily work or operational setup on any given mine site, mining jobs can have a fair amount of labor-intensive tasks mixed with monotonous and repetitive duties. Combined with the long working hours and shift-work schedules of mining work, the prevalence of fatigue in mine workers may seem rather unsurprising.Mining is certainly not alone in facing the challenge of addressing worker fatigue. Indeed, many of the characteristics above mirror the similarities of fatigue in other industries, such as health care, aviation and security. To the extent that fatigue in mining acts like fatigue in any other industry, then any fatigue management applications, trainings, or interventions in existence can be borrowed from other industries and applied to mining in a cookie-cutter approach. However, some have argued that mining in particular is especially susceptible to increases in the prevalence of fatigue beyond the characteristics listed above due to the multifaceted combination of factors in mining environments associated with fatigue: dim lighting; limited visual acuity; hot temperatures; loud noise; highly repetitive, sustained, and monotonous tasks; shiftwork; long work hours; long commute times due to mine site remoteness; early morning awakenings; and generally poor sleep habits (Canadian Centre for Occupational Health and Safety, 2012; Legault, 2011). Legault (2011) in particular argues that it is the combination of these factors simultaneously that can make mineworkers particularly susceptible to sleep deprivation and fatigue in comparison to other industries where these factors are often not present all together. If fatigue looks and acts different in mining, as others have argued, more research is needed to determine if, how, and why worker fatigue might need to be managed differently in mining.While the burden of fatigue on the mining population has not yet been evaluated thoroughly, methods and measures of fatigue management remain a popular point of discussion. Many commercial suppliers and consultancy groups have begun to develop technologically based fatigue monitoring systems (McMillian, 2013). Some technologies can monitor vehicle operators for indicators of wakefulness, such as percent eyelid"

This paper discusses the trials and tribulations of obtaining Velocity of Detonation (VOD) readings in small diameter blast holes in an underground mine. Montana Technological University (Montana Tech) obtained a time-domain reflectometer (TDR) type VOD monitoring unit. Purchase of the VOD monitor was justified on verifying explosives performance used in Montana Tech’s practical underground mining class and provide a teaching aid for the school’s rock fragmentation class. Before demonstrating the unit to students, we figured we better learn how to use it first so we give the students an appropriate experience. Our first learning was in obtaining the correct coaxial cable for the VOD monitor and how to properly terminate the cable. Once the cable was on-site and terminated, VOD testing could commence. Use of the VOD monitor was tested underground in small diameter holes (1.5-inch, 38 millimeter) pneumatically loaded with ANFO. After a few failed trials, and follow-up discussions with the supplier, VOD readings were obtained for the ANFO loaded holes. Additional readings were obtained for a pre-split product and detonating cord to satisfy our curiosity that the unit was performing as specified by the manufacturer. This paper will share our learnings in the hopes that others can benefit.

As far back as 1939 state laws have required reclamation of mined lands. Reclamation has been the topic of many discussions and presentations, especially since the late 1960's. In the past ten years many states have added legislation concerning the reclamation of coal-mined lands. In the near future, it seems certain that some federal regulations will be passed that will set minimum guidelines for the states to regulate. Besides the requirement of returning the land to the approximate original contour, future regulations will more than likely demand replacing topsoil from one to five feet thick. As regulations become more stringent, costs will rise accordingly. Since no one has developed a machine that can do all reclamation work by itself, it is necessary to review in detail the tools available and to select the most economical means.

The typical tunnel boring machine in use on today's tunnel project uses 15'2-inch diameter cutters at a nominal load of 45 kips per cutter. The cutterhead rotates at a speed of 120 over D revolutions per minute where D is the cutterhead diameter in feet. The typical machine operates about 50 percent of the time. Delivery of a new machine takes 12 to 15 months. The TBM is a specialized tool and not applicable to all jobs. There is a range of job conditions that limit the economic use of a TBM. The machine should provide a thrust per cutter at least twice the compressive strength of rock in psi and up to three times the rock strength is required if in "granitic rocks." The rock strength in psi must be at least three times the cover above the tunnel in feet or the machine may stick. For example, 2,500 feet of cover requires at least 7,500 psi rock to avoid problems. When the RQD's over a significant distance of the project are less than 50, the TBM becomes support-bound. When a large percentage of the time is spent waiting while the ground is supported, the TBM cannot perform well (See Figure 1). This problem increased inversely with tunnel diameter. We are finding that increasing the RPM's does not significantly increase progress. The increased RPM results in a substantial decrease in cutter penetration. The explanation for this decrease appears to be vibration, cutterhead drag, or lack of stiffness in the cutterhead (See Figure 2).

Crosshole Sonic Logging (CSL) only evaluates concrete on the inside of reinforcing cages leaving the outside unevaluated unless other types of testing are performed such as Perimeter Sonic Logging (PSL). While there have been some reports of PSL testing having accurately identified anomalies (e.g. Samtani et al 2005), experience by Case Foundation Company has indicated otherwise where false positives were determined with subsequent coring. Numerous cases of PSL false positives are presented as well as a study where a shaft was installed with both inside and outside tubes, and CSL and PSL data were compared. To date, there is very limited data published on perimeter sonic logging, or Gamma-Gamma Logging (GGL) with tubes on the exterior of drilled shafts. Several cases will be presented where false positives were experienced where PSL testing was performed. In addition, a direct comparison will also be presented where a shaft was installed with both tubes on the inside and outside where CSL and PSL data is compared. BRIEF HISTORY – CSL TESTING AND TUBES ON INSIDE The general procedure of Crosshole Sonic Logging (CSL) testing includes attaching tubes to the reinforcing cage to be able to send a transmitter in one tube and a receiver in another tube with which a sonic pulse is emitted from the transmitter and received in another tube. The time taken for the sonic pulse to travel between the tubes is measured and compared to expected values for the known distance between the tubes. Any increase in time from expected values indicates the sonic pulse traveled through a media other than homogeneous concrete such as objects in the path (spacer wheels, steel bracing, etc.), tube spacing, or soil inclusions. However, variations in arrival time can also result from differences in concrete density. The tubes have traditionally been placed on the interior of the reinforcing cage which protects them during hoisting and placement of the cage and reduces wave refraction caused by modulus of elasticity differences between steel and concrete. This allows the concrete within the interior of the reinforcing cage to be evaluated, but the concrete outside of the cage is excluded from traditional CSL testing. As a result, alternative integrity testing has been developed to not only provide different ways to evaluate the integrity of drilled shafts but to also address the issue of evaluating the concrete outside of the reinforcing cage. These alternative testing methods include Gamma-Gamma Logging (GGL), Thermal Integrity Profiling (TIP testing) and Perimeter Sonic Logging (PSL) which is similar to CSL testing but instead of the tubes placed inside the reinforcing cage, the tubes are placed on the outside of the reinforcing cage as shown in Fig. 1.

It is a pleasure for me to keynote this first Western Regional Minerals and Coal Conference here in the Black Hills of South Dakota. It is pleasing for two main reasons. First, Homestake Mining Company has been associated with the Black Hills since 1875 when gold was discovered following Custer's trek through the Hills during 1874. Second, the future mineral development of the Black Hills will depend, to a great extent, on minerals and metals covered in this conference. The metals and minerals that are featured in this conference have unique similarities--and important differences--and therefore, will be of great interest to all who are involved in our industry in this area of the country. Precious metals have always been, and likely will always be, subject to political influence; they are only partially affected by the demands of our industrial economy. Energy minerals, while more directly affected by industrial stimulus, are also politically sensitive. In this regard, the need for a minerals policy affecting the energy sphere has been made very clear to us in the last five years. More importantly, the lack of a national policy and purpose relating to our total future energy needs has severely affected the overall economy and security of this country. Very briefly today, I would like to outline for you my thoughts on the future of these most important minerals. I will start by a discussion of precious metals, primarily my favorite precious metal, gold. A brief history of gold will be helpful in setting a perspective for forecasting its future although it is difficult to give a brief description of a metal that has been prized by man for over 6,000 years. That you are giving the Daniel C. Jackling award to me is a great personal honor. But more significantly, it is a recognition that geostatistics has come of age. And since I am considered by many as belonging to an older generation of geostatisticians, I thought that it would be fitting that I reflect on where geostatistics came from and where it might be going. First, though, let me propose a definition of geostatistics. Etymologically, paraphrasing Webster's definitions of "geo" and "statistics," it is "a branch of mathematics dealing with the collection, analysis, interpretation and presentation of masses of numerical data taken from the earth." This definition is most appropriate in the context of mining geostatistics. It includes both classical and spatial statistics. It emphasizes the earth aspect, or the analysis of geologic features. And it should remind the practitioner that geologic input is a critical part of all geostatistical applications. In the 1910s, statistical methods were already used to analyze geological data. However, the origin of geostatistics, as we know it today, is best set in the late 1940s, when H.S. Sichel recognized the lognormal distribution of sample values in the South African gold mines. In 1951, Daniel Krige observed that "it can be expected that the gold values in a whole mine will be subject to a larger relative variation than those in a portion of the mine." In other words, samples taken close to each other are more likely to have similar values than if taken farther apart. This observation is the foundation on which spatial statistics, which characterizes values defined in a multidimensional space, is built. However, the 1950s were marked by studies based on classical, as opposed to spatial, statistics. It was only in the 1960s that the need was recognized to model the similarity between sample values as a function of the distance between samples and that the semivariogram was defined. A theoretical framework was developed by Matheron that supplied an elegant mathematical explanation to the empirical observations made by Krige. Matheron coined the term "kriging" in recognition of Krige's pioneering work on the geostatistical evaluation of mineral deposits. As soon as this theoretical framework was developed, it was possible to bring geostatistics to the academic world. The "Centre de Geostatistiques" was founded in Fontainebleau. Numerous students were trained there, disciples eager not only to improve the theory and develop more sophisticated mathematical tools, but also to spread the new faith throughout the world. In this paper, the annual direct cost of corrosion in Canada is estimated to be approximately $41 billion. The figure does not include the indirect (user) costs of corrosion, sometimes referred to as social costs, which would essentially double the amount. Also, corrosion is shown to be a major contributor to environmental pollution, including when it results in the leakage of hazardous materials from pipelines, vessels and nuclear reactors. Industrial accidents caused by corrosion kill and injure hundreds of people annually. At present, corrosion is at the core of safety and risk analysis in several major industries such as energy generation, oil/gas production and transportation, chemical processing and petroleum refining. With the recent steam pipeline explosion during rush hour in New York killing one man, the collapse of the bridge in Minneapolis killing 13 people and another two years ago in Montreal when 5 people were killed, infrastructure corrosion is increasingly being acknowledged as a public safety concern.

This paper will address methods for minimizing liability and protecting materials from disclosure as result of self- evaluative audits and internal investigations. Specifically, the paper will cover the role of counsel in the investigative process and how best to design and conduct internal investigations to minimize the development of problematic material and disclosure of information. The paper will also address the extent of privileges that may be relied upon to protect materials and information from disclosure. These include the attorney-client privilege, the self-critical analysis privilege, and the attorney work product privilege. These privileges are qualified and understanding the limits of their coverage is essential to minimizing liability.

For over a decade the Osterberg Load Cell has been successfully used to determine the shear capacities of drilled shafts. Since the test method measures side shear directly, analytical complications due to the influence of end bearing resistance are removed. The data suggest that the side shear component of a drilled shaft's capacity is often more significant than end bearing. Given the interest in the use of side shear in drilled shaft design in compressible materials, it is important to examine factors that can influence capacity. We have found that some factors widely believed to influence capacity, such as slurry type, are not as important as commonly thought in most materials. Factors that are not usually considered as important, such as casing use, hoop spacing, concrete slump, concrete additives, spacers and rebar clear cover, seem to be more influential with respect to side shear capacity. For example, substantially lower than predicted shear resistance can occur when the rebar clear cover is small with respect to the cage diameter. We observe this most often in fine-grained cohesive soils. This effect can be exaggerated if the rebar cage has tight hoop spacing, if the concrete has low slump and if the hole is not straight. We have also noted that improper use of temporary casing can have a dramatic effect on side shear resistance. In some cases we have observed tested shear capacities reduced to less than 5% of either predicted or available shear values.
